Arizona man charged over online posts that allegedly incited Australian attack in which 6 died
FBI agents arrested a 58-year-old man near Heber Overgaard, Arizona, last week on a U.S. charge that alleged he incited the violence through comments posted online last December.
by Associated Press
A U.S. citizen has been charged in Arizona over online comments that allegedly incited what police describe as a "religiously-motivated terrorist attack" in Australia a year ago in which six people died, officials said Wednesday.
Queensland state police officers Rachel McCrow and Matthew Arnold and innocent bystander Alan Dare were fatally shot by Gareth Train, his brother Nathaniel Train, and Nathanial's wife Stacey Train in an ambush at the Trains' remote property in the rural community of wieambilla last Dec. 12, investigators say.
Four officers had arrived at the property to investigate reports of a missing person. They walked into a hail of gunfire, police said at the time. Two officers managed to escape and raise the alarm.
Police killed the three Trains, who have been described as conspiracy theorists, during a six-hour siege.
FBI agents arrested a 58-year-old man near Heber Overgaard, Arizona, last week on a U.S. charge that alleged he incited the violence through comments posted online last December, Queensland Police Assistant Commissioner Cheryl Scanlon said at a joint news conference in Brisbane with FBI legal attach? for Australia Nitiana Mann. Police did not release the suspect's name.
He was remanded in custody when he appeared in an Arizona court on Tuesday. He faces a potential five-year prison sentence if convicted.
"We know that the offenders executed a religiously-motivated terrorist attack in Queensland," Scanlon said, referring to the Trains. "They were motivated by a Christian extremist ideology."
The FBI is still investigating the alleged motive of the American. Queensland police had flown to Arizona to help investigators there.
"The attack involved advanced planning and preparation against law enforcement," Scanlon said.
Gareth Train began following the suspect on YouTube in May 2020. A year later, they were communicating directly.
"The man repeatedly sent messages containing Christian end-of-days ideology to Gareth and then later to Stacey," Scanlon said.
Mann said the FBI was committed to assisting the Queensland Police Service in its investigation.
"The FBI has a long memory and an even longer reach. From Queensland, Australia, to the remote corners of Arizona," Mann said.
"The FBI and QPS worked jointly and endlessly to bring this man to justice, and he will face the crimes he is alleged to have perpetrated," she added.

Australia Banks are Now "Debanking" Independent Journalists Exercising Their Free Speech Rights
Maria shared that for approximately one month she noticed that her bank card was not working at most ATM's. She recently rang ING Bank to see whether there was anything wrong with her card, or her account, or any flags on their end that would be restricting her card access, they advised there was nothing showing on their end.
Then on March 3, 2023, ING emailed Zeee saying her accounts would be closed and access stopped within one week.
Zeee next called ING on the same day and they confirmed the email was from them. She shared that she spoke to their "Specialist Team" member who she was told could give her more information. The team asked Zeee to read the email to them, advising that although it was from them they did not have a copy of the email. In response, they repeated the same information that Zeee had to read to them as to why her account was shut, but still, no reason was specified.
Zeee shared that she has a legitimate, registered business and she pays her taxes. The bank then confirmed that there was nothing showing on their end to indicate she had done anything "wrong" in financial terms or my financial conduct.
So Zeee asked:
Do you shut down people's accounts due to their political views by any chance?" I was met with a long silence, followed by being placed on hold. The representative came back to me repeating the same, generic information. I asked the question several times, and the representative refused to answer.
Knowing ING has done this to people before as reported in the MSM based not on what they've done but who they are, I both called and emailed their PR Manager, asking the following:
1. What is the reason ING is still doing this?
2. What are some likely reasons ING would close an account?
3. Why are the Complaints Resolutions Team, touted as specialists, unable to provide a reason as to why this is occurring when customers call them for an explanation?
4. Does ING close people's accounts for their political views?
ING responded a week later with:
Thank you for reaching out. We're unable to discuss any account closures due to customer confidentiality.
Zeee notes that ING Group is listed as a partner on the WEF website. Its leadership has attended the WEF in Davos.
Zeee says that Zeee Media reports extensively on the WEF, exposing their true agenda and Australian politicians linked to the WEF. ING's refusal to answer our questions led us to believe that this may be politically motivated. This timing coincides with a hit piece run by 60 minutes on the wieambilla tragedy, where I am featured warning about Australian soldiers training to turn against Australian people, and Channel 9 is indirectly lumping me in with domestic terrorists:

Police told to keep record of 'conspiracy theorists' and 'communists'
Law enforcement in Australia's Queensland must report interactions with 'extremists' to counter-terror teams
The Queensland police are required to report interactions with people who "allegedly hold a range of ideological beliefs" including "conspiracy theorists," according to an email sent to all members of the Queensland Police Service on Thursday and seen by ABC News.
Police must record interactions with such individuals in the state's QPrime database "at the first available opportunity," the email states, explaining that in addition to "conspiracy theorists," "religious, social or political extremists and sovereign citizens, as well as people with ideologies relating to capitalism, communism, socialism or Marxism" also fit the bill.
Officers were also told to report "all matters that indicate concerning or escalating behavior due to ideological beliefs, including religious and single-issue ideologies" and advised of the "risks" inherent in dealing with these groups.
The guidance comes after a deadly shooting in wieambilla in December left two officers and a civilian dead, in addition to the three shooters. Nathaniel, Gareth and Stacey Train reportedly gunned down constables Rachel McCrow and Matthew Arnold and injured two other officers on their property, also killing neighbor Alan Dare when he was drawn to the scene by the noise. The Trains were then killed by specialist police following an hours-long standoff.
Authorities are calling the incident a "religious terror attack," citing theTrains' Christian fundamentalistbeliefs, a strain known as premillenarianism, whose adherents prepare for and anticipate the End of Days. A police investigation concluded the family had "acted as an autonomous cell" to carry out the attack, Queensland Police Deputy Commissioner Tracy Linford told reporters on Thursday.
"Christian extremist ideology has been linked to other attacks around the world but this is the first time we've seen it in Australia," the deputy commissioner said, acknowledging that there was no evidence the family had identified themselves as "sovereign citizens." Stacey Train's diary reportedly described police as "monsters and demons."
Police were potentially "lured" to the Trains' farm in search of Nathaniel, a high-school principal who had been reported missing by his estranged wife in New South Wales and was wanted on firearms charges.
Much has been made of Gareth Train's postings on online forums, where he described Covid-19 as a "neurological bio-weapon" and the 1996 Port Arthur massacre, which led to sharply restricted gun ownership for civilians, as an operation to "disarm the Australian population."

Queensland police beef up assessments of sovereign citizens, people with extremist beliefs following wieambilla 'terrorist attack'
Queensland police must report matters involving sovereign citizens, religious extremists and conspiracy theorists to top counter-terror teams in the wake of the wieambilla shooting in which two officers and a local man were killed.
Key points:
Police said their investigations concluded the December 12 ambush was a "religiously motivated terrorist attack"
Once reported in the system, concerns will be assessed by the state's counter-terrorism investigation teams
Police have been told interactions with extremists "may heighten the personal safety risk to police and other members of the community"
In an email sent to all Queensland Police Service (QPS) members, which has been sighted by the ABC, officers have been briefed on new procedures for recording interactions with conspiracy theorists and those spouting religious-related ideology.
It was disseminated on Thursday, the same day police held a press conference in relation to the wieambilla shooting referring to it as a "religiously motivated terrorist attack".
Nathaniel, Gareth and Stacey Train shot constables Rachel McCrow, Matthew Arnold and neighbour Alan Dare on their property in the Western Downs on December 12 last year before the trio were shot and killed by specialist police.
"You will be aware of recent media reporting regarding a statement released by the QPS relating to the tragic events in wieambilla in December 2022," the email said.
"This commentary will result in increased reporting to police regarding members of the community who allegedly hold a range of ideological beliefs.
"This includes conspiracy theorists and religious-related ideology."
Police were advised in the internal document of risks associated with dealing with extremists.
As a result, officers must record all interactions with people holding ideological beliefs in the central information database used by officers across the state known as QPrime at the "first available opportunity", according to the email sighted by the ABC.
It will then be assessed by the state's counter-terrorism investigation teams.
The matter can then be escalated and individuals flagged.
The memo describes the at-risk groups as conspiracy theorists, religious, social or political extremists and sovereign citizens, as well as people with ideologies relating to capitalism, communism, socialism or Marxism.

Police told to keep record of 'conspiracy theorists' and 'communists'
Law enforcement in Australia's Queensland must report interactions with 'extremists' to counter-terror teams
The Queensland police are required to report interactions with people who "allegedly hold a range of ideological beliefs" including "conspiracy theorists" according to an email sent to all members of the Queensland Police Service on Thursday and seen by ABC News.
Authorities are calling the incident a "religious terror attack," citing the Trains' Christian fundamentalist beliefs, a strain known as premillenarianism whose adherents prepare for and anticipate the End of Days.
Police were potentially "lured" to the Trains' farm in search of Nathaniel, a high school principal who had been reported missing by his estranged wife in New South Wales and was wanted on firearms charges.
Much has been made of Gareth Train's postings on online forums, where he described Covid-19 as a "neurological bio-weapon" and the 1996 Port Arthur massacre, which led to sharply restricted gun ownership for civilians, as an operation to "disarm the Australian population."

Australian State Media - WOW - the satanists are outing themselves
Queensland police say the wieambilla shooting is a terrorist attack motivated by premillennialism. Here's what that means
Premillennialism is the belief that after a period of extreme suffering, Jesus Christ will physically return to Earth for 1,000 years.
"In its basic interpretation, there was a belief that Christ will return to the Earth ... and provide peace and prosperity but it will be preceded by an era, or a period of time of tribulation, widespread destruction and suffering," Deputy Commissioner Linford said.
"They started preparing for the end of days.

Vaccines, Satan and false flags: Inside the wild online conspiracy theories posing 'real-world dangers' and why the horrific mass shooting in Queensland is a 'wake-up call' for Australia
Online posts in the name of Gareth Train are being scrutinised by the police
The comments featured conspiracy material about Jesuits and vaccines
Also claimed high-profile shootings were hoaxes or 'false-flag' operations
The shooting deaths of six people during an ambush in Queensland should be a wake-up call for Australians about the real-world dangers posed by online conspiracy theories, analysts say.
Online posts in the name of Gareth Train, one of three shooters who killed two police officers and a bystander, have been under police scrutiny since Monday's siege at wieambilla, in rural Queensland.
The other shooters were his brother Nathaniel, and Stacey Train who was married to Nathaniel but left him from Gareth.
Gareth Train's online comments featured conspiracy material about Jesuits and vaccines, as well as claims high-profile shootings such as the Port Arthur massacre were hoaxes or 'false-flag' operations.
Conspiracy theories have existed for centuries and tend to ramp up during periods of intense societal change or uncertainty, such as the Covid-19 pandemic.
However, there's growing concern the current peak will never ease.
Katharine Gelber, from the University of Queensland, says one reason for this is the attention-based business model of social media.
Algorithms have to present users with increasingly extreme material to keep them logged on.
Bots are also spreading conspiracies wider and more rapidly, she said.
'The new conspiracism relies on people saying, 'well, I heard it or I saw it on Facebook' or 'people have said',' Professor Gelber told AAP.
Elise Thomas, a senior online data analyst at the Institute for Strategic Dialogue, said unregulated apps such as Telegram allow multiple theories to blend into overarching conspiratorial world views.
'You see a lot of cross-propagation between different kinds of conspiracy narratives, from different countries, in different contexts, all sort of stewing together in this sort of very confusing soup of suspicion,' she said.

>>20841393 Christian extremist allegedly linked to wieambilla police shooting, Donald Day, offered plea deal by the FBI - An American man with alleged links to Queensland's wieambilla police shootings has been offered a plea deal. Arizona District Attorney Gary Restaino filed the court motion to have a pre-trial hearing delayed to allow time for Donald Day Jr and his lawyers to consider the deal. "A plea offer has been extended and the deadline for acceptance is May 17," Mr Restaino said in court documents. After a joint Queensland Police Service and FBI investigation, Mr Day was arrested in December and charged with two counts of making an interstate threat. In January, he was further charged with illegal gun possession and threatening FBI agents added. The 58-year-old is alleged to have communicated directly with Nathaniel, Gareth and Stacey Train online, sending messages containing Christian end-of-days ideology. Police constables Matthew Arnold and Rachel McCrow and neighbour Alan Dare were killed in the religiously motivated terrorist attack by the Trains, who were later shot dead by specialist police.
>>20846679 Australian regulator says Musk's X should not set limits of internet law - Elon Musk's X has policies to take down harmful content when it chooses but should not be allowed to overrule Australian law in deciding what can be viewed there, a lawyer for the cyber regulator told a hearing into video of a bishop being stabbed. X, formerly Twitter, is fighting an order by the eSafety Commissioner to remove 65 posts showing video of an Assyrian Christian bishop being knifed mid-sermon in Sydney last month, in what authorities called a terrorist attack. "X says ... global removal is reasonable when X does it, because X wants to do it, but it becomes unreasonable when X is told to do it by the laws of Australia," Tim Begbie, the lawyer, told a hearing of the Federal Court, Australia's second-highest. Begbie said the dispute was not a debate about free speech but rather about the practicality of the Australian law that gives the regulator power to protect citizens from the most objectionable content. Geo-blocking Australians, the solution X offered, was ineffective because a quarter of the population used virtual private networks that disguise their locations, he added. "Global removal in these circumstances is a reasonable step," he said. "It would achieve what parliament intended, which is no accessibility to end users in Australia."
>>20846729 Video: Australia targets social media with parliamentary probe - Australia announced on Friday that it would hold a parliamentary inquiry to look into the negative impacts of social media platforms, saying they have significant reach and control over what Australians see online, with almost no scrutiny. The government has criticised social media platforms for not being quick enough to remove violent posts and seeks more oversight over content posted on Meta's Facebook, ByteDance's TikTok and Elon Musk-owned X. "Across a range of issues, whether it be the issue of domestic violence, whether it be the radicalisation of our young people, across a range of areas, something that keeps popping up over and over again is the role of social media," Prime Minister Anthony Albanese told reporters. "(They) can be very positive but also can have a negative influence which is there."

Chance Saltzman underscored the importance of the U.S.-Australia strategic partnership during the Royal Australian Air Force's 2024 Air and Space Power Conference in Canberra, May 9. The conference brought together members of Australia's military forces and partners, including the U.S. Space Force, to discuss the nation's security interests in air and space. Saltzman's keynote, titled Deterrence Down Under, began with a brief history of U.S. and Australian defense relations, starting with the Battle of Hamel in 1918 during World War I. In this engagement, U.S. Army infantry fought under the same command as Australian soldiers, supported by British tanks, against German positions in and around the town of Le Hamel in Northern France. "This was the first time in history that U.S. Army troops were commanded operationally by non-American officers," said Saltzman. "And by the end of the war, [General John Monash] said, 'success is not measure by how high you climb, but by how many people you bring with you.''

wieambilla shooting: Donald Day allegedly had buckets of ammunition and threatened FBI agents, US court told
Arizona conspiracy theorist faces fresh weapons charges and is accused of threatening five special agents during his arrest in late 2023
Christopher Knaus - 18 Jan 2024
A US conspiracy theorist linked to the wieambilla shooters allegedly held a significant stockpile of weaponry, including five-gallon buckets of ammunition, and made threats to kill five FBI agents, telling them he would "come for every fucking one of you", court documents reveal.
The FBI arrested Arizona conspiracy theorist Donald Day Jr in December in connection with the religiously motivated terrorist attack at a remote Queensland property in wieambilla which left two Queensland police officers and a neighbour dead.
Day had regularly interacted with Queenslanders Gareth and Stacey Train, who, along with Gareth's brother, Nathaniel, perpetrated the police shooting in 2022.
During the standoff, Gareth and Stacey posted a 41-second YouTube video titled "Don't Be Afraid", in which they spoke of the killings and expressed their love for "Don", saying they would "see you at home".
Day allegedly commented on the video saying "those bastards will regret that they ever fucked with us".
"Truly from my core, I so wish that I could be with you to do what I do best," he wrote.
In a subsequent video posted under his username, "Geronimo's Bones", Day allegedly said: "The devils come for us, they fucking die. It's just that simple. We are free people, we are owned by no one."
The FBI alleges Day's comments constituted "a threat to injure the person of another, that is any law enforcement individual who comes to Day's residence". They also allege he uttered threats against Tedros Adhanom Ghebreyesus, the director-general of the World Health Organization.
A fresh indictment filed this week in the Arizona district court has added additional charges against Day, court documents show.
He is alleged to have possessed weaponry despite being a convicted felon - comprising four handguns, four rifles including an "AK style rifle", a shotgun and significant amounts of ammunition. The latter allegedly included three five-gallon plastic buckets of ammunition.
He is also accused of threatening five FBI special agents during his arrest.
Day allegedly said: "I'll tell you this, if anything happens to my wife, and I ever get out of these cuffs, I'll come for every fucking one of you."
"How's that? You better kill me, if you fuck my wife up, you hurt her in any way, you better kill me here and now and just dump my body somewhere ... I'm not playing with you guys, I'm not making idle threats here."
Last month, Day's lawyers filed a motion to have the case thrown out, seeking to protect his comments under the first amendment.
His lawyers said the indictment failed to allege a "true threat" to commit violence and Day was "therefore protected by the first amendment to the United States constitution", which covers the right to free speech.
"Even accepting as true the indictment's assertion that 'devils' is code for 'police officers' specifically, as opposed to 'unlawful government actors' in general, Mr Day's assertion that if 'devils come [to kill] us,' he would respond in kind cannot fairly be read as 'a serious expression of an intent to commit an act of unlawful violence'."
His lawyers argued the statements Day allegedly made were not threats against a "person" as required under the statute. Their motion argued the group of persons allegedly threatened by the statement was too vague and ill-defined to constitute a "person".

US government urges court not to drop charges against Donald Day, the extremist linked to wieambilla shooting
Jade Macmillan - 10 January 2024
The US government has urged a court in Arizona to reject a request by an American extremist, linked to the wieambilla killers, for charges against him be dropped.
Donald Day Jr was a close confidant of Stacey and Gareth Train, the couple who, alongside Gareth's brother Nathaniel, shot dead constables Rachel McCrow and Matthew Arnold and a neighbour in a rural Queensland community in 2022.
Mr Day stands accused of inciting violence online and making interstate threats.
His lawyer, Luke Mulligan, said those charges should be thrown out because his client's communications were not "true threats" and that "even violent political hyperbole ... [was] constitutionally protected".
Prosecutors have now filed their response to that request, arguing that the motion to dismiss was "premature" and "should be denied".
In court documents filed Tuesday, the US Attorney's Office in Phoenix said it should be left to a jury to decide whether the threats were "true".
"Whether the communications at issue are serious expressions of intent to commit acts of unlawful violence is a question for the jury to consider after it has heard all the evidence," the prosecutor's filing said.
It also said the threats "were far from political hyperbole".
"According to the indictment, (the) defendant has had a history of inciting violence against law enforcement and government authorities, encouraged individuals in Australia who engaged in a deadly shootout with law enforcement, has publicly acknowledged that he is an "x-con, who's armed to the teeth", and has publicly announced that if law enforcement came for him, his plan would be to attack and kill them," prosecutors said.
'I wish I had been there'
Court transcripts released last month revealed disturbing interactions Mr Day had with the FBI after he was arrested, including his desire to have been with the wieambilla killers when they carried out their attack.
"I wish I had been there to kill those f*ckers with them so they weren't alone," Mr Day allegedly said, referring to the Trains.
The transcript also detailed Mr Day's violent criminal history - particularly towards police.
It revealed allegations he made threats towards his arresting officers and his "extremely dangerous" mindset, which ultimately led a judge to deny him bail.
Mr Day is on the extremist end of the sovereign citizen movement - people who do not recognise the authority of governments - and it was this ideology, coupled with a world view where "many of the evil entities in his mind are governmental authority", that the prosecutor argued made him a flight risk and a danger to the public.
The court was previously told that agents found nine firearms, several thousand rounds of ammunition, body armour, and gas masks at Mr Day's Antelope Valley ranch.
The prosecution said Mr Day had referenced this property as the spot for his "last stand" against any law enforcement.

Mr Day is on the extremist end of the sovereign citizen movement - people who do not recognise the authority of governments - and it was this ideology, coupled with a world view where "many of the evil entities in his mind are governmental authority", that the prosecutor argued made him a flight risk and a danger to the public.
The court also heard Mr Day had an extensive history of violence, particularly towards police.
Cases for the Arizona man retrieved by the court show that from 1986 to 1990, he was convicted for robbery, five counts of battery including against police and emergency personnel, and the assault of a prisoner.
The court heard he had spent more than six years in jail.
After he was arrested, Mr Day also told officers he went to prison after killing his stepfather for raping his sister. However, prosecutors have been unable to verify his account, stating it was possible this occurred when Mr Day was a juvenile and the records are inaccessible.
Ms Osborne also indicated Mr Day was not legally allowed to own firearms and that further charges were expected to be laid against him.
'He has nowhere to go'
Mr Day's legal team, represented by Luke Mulligan, have filed to have the charges dismissed on constitutional grounds.
"We have the right to free speech in this country," Mr Mulligan said.
"The government's case is exceedingly weak. The government just had 20 minutes talking about all ... these terrible things he's done.
"For something to rise to being criminalised speech, it has to be a true threat. It can't be conditional. There must be an identified target. Internet hyperbole, internet venting, does not qualify as that."
Mr Mulligan said Mr Day was not a threat to anybody, did not have contact with law enforcement for more than 20 years, that his firearms were owned by his wife, and they used the shooting perch to defend their chickens against coyotes.
The defence lawyer also revealed Mr Day had stage four colon cancer, with the accused understanding it was brain cancer which went into remission after he received "treatment from his wife and a medicine woman" before it metastasised to his colon.
"He can't flee. He has nowhere to go. He has no ability to flee, and his physical condition prevents him from fleeing," Mr Mulligan told the court.
He said Mr Day has not been able to eat the food at jail and, after five days of not eating, was found unconscious in a pool of his own blood.
In her decision to keep the accused behind bars, Federal Judge Camille Bible referenced the "very, very devastating series of events that occurred in Australia" and Mr Day's role in them.
She dismissed the defence's First Amendment arguments, saying that Mr Day was not being prosecuted for his ideologies, but for the "very specific" threats he made and the pattern of adverse interactions he has had with police officers.
She said the weight of evidence suggested he posed a danger to the public.
Judge Bible recognised Mr Day's declining health but said "it is concerning to the court that he's not sought medical treatment" and that there was no formal diagnosis.
She said given the circumstances, Mr Day would be "better off in custody where he can get care and treatment".
The jury trial for Mr Day is scheduled to commence on February 6.

Donald Day Jr, US sovereign citizen linked to wieambilla murders, was prepared for deadly 'last stand' with police, court hears
Kevin Nguyen and Emilie Gramenz - 29 December 2023
1/2
An American extremist linked to the wieambilla killers claims he wished he had joined in on their massacre of Queensland police officers and threatened to kill the FBI agents who arrested him, a US court has heard.
WARNING: This story contains strong language and references to political violence.
A newly-released court transcript has revealed the disturbing interactions Arizona sovereign citizen Donald Day Jr had with the FBI after he was arrested earlier this month.
In it, a federal prosecutor detailed Mr Day's violent criminal history - particularly towards police - allegations that he made threats towards his arresting officers, and his "extremely dangerous" mindset which ultimately led a judge to deny him bail.
Mr Day was a close confidant of Stacey and Gareth Train, the couple who, alongside Gareth's brother Nathaniel, shot dead constables Rachel McCrow and Matthew Arnold and a neighbour in wieambilla last year.
The 58-year-old was arrested in Heber-Overgaard, a rural community of around 3,000 people in Navajo County, on December 1 and stands accused of inciting violence online and making interstate threats.
Later, during Mr Day's detention hearing days, Dondi Osborne from the US Attorney's Office said Mr Day and his wife Sabrina Spires were prepared to die during a "last stand" with police at his fortified off-grid property.
Mr Day was arrested by tactical teams inside a shared Dairy Queen and service station parking lot in town, after police believed it too dangerous to detain him at his Antelope Valley ranch.
The prosecutor described how a shipping container surrounded by stacked sandbags on his property created an effective sniper's nest for Mr Day.
The court heard agents found nine firearms, several thousand rounds of ammunition, body armour, and gas masks at the address.
The prosecution said Mr Day had referenced this property as the spot for his "last stand" against any law enforcement.
'I wish I had been there'
On the day he was apprehended, Mr Day was urged to record a video for his wife - who has appeared in several videos with him, including those discussing the Trains - asking her to come out peacefully.
It's alleged Mr Day told FBI agents: "If anything happens to my wife, and if I ever get out of these cuffs, I'll come for every f*cking one of you".
When asked about the Trains' deaths, Mr Day allegedly said: "I wish I had been there to kill those f*ckers with them so they weren't alone".
Mr Day, who had waived his right to silence, also allegedly told the agents that if the SWAT teams had come for him at his ranch, he would've died in a shootout with them.
Ms Spires echoed the sentiment in a later interview with the FBI and said she was prepared to fight and die alongside her husband.
"She said ... if the SWAT team had responded, I would essentially be in heaven now with Mr Day as well as the Trains," Ms Osborne told the court.
In arguing for his continued detention, the prosecutor referenced repeated calls Mr Day made for the mass killing of law enforcement and government officials in the lead-up to the death of the Trains.
One instance cited was in July last year. On a YouTube channel called Kansas Prepper, Mr Day allegedly called for people to rally with him at Wounded Knee - the site of an infamous massacre of Native Americans in South Dakota by the US Army - to "kill the bad guys", but none had answered his call.
"I am not one of the pussified patriots who refuse to rally, fight, and die, if necessary," Mr Day allegedly commented.
"My wife has a lunch packed for me, my gear is within arm's reach of me, and my rifle is oiled. I'm ready to head out the door in less than five minutes."

wieambilla shooting: lawyers for Donald Day mount freedom-of-speech defence over alleged threats to police
Christopher Knaus - 28 Dec 2023
A US conspiracy theorist linked to the wieambilla shooters has argued he was not seriously expressing an intent for violence when he said "the devils come for us, they fucking die", and as such should be protected by the US constitution's first amendment.
Donald Day Jr, a conspiracy theorist in Arizona, was recently arrested by FBI agents in connection with last year's religiously motivated terrorist attack on a remote Queensland property in wieambilla.
Day was in contact with Gareth and Stacey Train in the lead-up to the shootings, which killed two police officers and a neighbour, before the pair were shot dead, alongside Gareth's brother Nathaniel, by police.
Court documents show Day is alleged to have posted a video on YouTube four days after the killings, saying:
"The devils come for us, they fucking die. It's just that simple. We are free people, we are owned by no one."
The comments were allegedly in response to a video posted by Gareth and Stacey during the standoff with police, in which they addressed Day directly, saying: "They came to kill us, and we killed them. If you don't defend yourself against these devils and demons, you're a coward."
Two indictments were issued against Day by a grand jury in Tucson, Arizona recently for interstate threats. Investigators allege Day's video constituted "a threat to injure the person of another, that is any law enforcement individual who comes to Day's residence".
He is also separately accused of making threats toward Tedros Adhanom Ghebreyesus, the director-general of the World Health Organization.
In a motion filed on Boxing Day, seen by Guardian Australia, Day's lawyers sought to have the charges against him dismissed.
They argued that the statements Day allegedly made were not threats against a "person" as required under the statute. Their motion argues the group of persons allegedly threatened by the statement is too vague and ill-defined to constitute a "person".
"It presumably includes not merely some unspecified number of federal, state, local, and even international law enforcement officials but would also include people who aren't even police officers now but who may at some point in the future decide to become police officers such that they might someday have reason to go to Mr. Day's house," Day's lawyers argued.
They also argued the indictment fails to allege a "true threat" to commit violence and Day is "therefore protected by the First Amendment to the United States Constitution", which covers the right to free speech.
"Even accepting as true the indictment's assertion that 'devils' is code for 'police officers' specifically, as opposed to 'unlawful government actors' in general, Mr. Day's assertion that if 'devils come [to kill] us,' he would respond in kind cannot fairly be read as 'a serious expression of an intent to commit an act of unlawful violence'."
The motion is yet to be considered by the Arizona district court, where the case is being heard.
Queensland police told the media earlier this month that Gareth Train began following Day on YouTube around May 2020.
The Queensland police assistant commissioner, Cheryl Scanlon, said they began commenting on each other's videos in 2021.
"We know that the offenders [Gareth and Stacey Train] executed a religiously motivated terrorist attack in Queensland," she said. "They were motivated by Christian extremist ideology and subscribe to the Christian fundamentalist belief system known as premillennialism.
"The motivation of the United States national is still under investigation by the FBI."

No 'ringleader' among them
The four officers went to the property to follow up an outstanding warrant relating to firearms and a border breach by shooter Nathaniel Train, as well as a missing person report.
Nathaniel was reported missing by his wife in NSW and after crossing the border during COVID restrictions, he went to the wieambilla property owned by Gareth and Stacey.
An officer visited the address in August last year and later tried calling the Trains.
"I don't think there's any question that they would have known that at some point in time police were coming, but whether or not they would have anticipated it was specifically that day, we wouldn't say that," Deputy Commissioner Linford said.
"The way that they had set their property up, there are clear indications that they had done a lot of planning."
She said police did not know Nathaniel was residing at the address at the time of the siege, but thought he could have camped in bush nearby.
Deputy Commissioner Linford said police would have anticipated that Nathaniel had three firearms with him, but he didn't have any previous serious criminal history.
"There was nothing to indicate to the members that would have attended on that day, that they were going to be ambushed," she said.
Deputy Commissioner Linford said there was no indication from Stacey's diaries that she was a victim of domestic violence and "she clearly had a view similar to what we saw from Nathaniel and Gareth".
Furthermore, there was no particular "ringleader" among them, she said.
"When you have three acting together, it's challenging to say it's a mental health issue," Deputy Commissioner Linford said.
Police have taken statements from the family of the trio.

Queensland police say wieambilla shooting was 'a religiously motivated terrorist attack'
Kym Agius - 16 February 2023
1/2
Three people who killed two Queensland police officers and a neighbour in December last year executed a "religiously motivated terrorist attack", police say.
Deputy Police Commissioner Tracy Linford said Nathaniel, Gareth, and Stacey Train acted as an autonomous cell and executed a planned "attack directed at police" at wieambilla in December.
They shot Constable Rachel McCrow, 29, Constable Matthew Arnold, 26, and neighbour Alan Dare at their property in the Western Downs on December 12.
"We don't believe this attack was random or spontaneous," Deputy Police Commissioner Linford said.
"We do believe it was an attack directed at police.
"There was significant evidence of advanced preparation and planning."
Police found camouflaged hiding places at the property, barriers such as dirt mounds and logs, six firearms, three bow and arrows, a number of knives, CCTV, radios, mirrors on trees, and a trap door under the house, which might have enabled an easy escape.
Deputy Commissioner Linford said police had been investigating Stacey Train's diary, as well as the trio's texts, social media postings and 190 interviews.
"What we've been able to glean from that information is that the Train family members subscribe to what we would call a broad Christian fundamentalist belief system, known as premillennialism," she said.
Deputy Police Commissioner Linford said the trio saw police "as monsters and demons".
She said the COVID pandemic, climate change, global conflicts and social disparity contributed to their belief in their system.
"Whilst the behaviour was similar in some respect to sovereign citizens, we don't believe this was connected to a sovereign citizen ideology, we believe it's connected to the Christian extremist ideology," she said.
"There was a belief that Christ will return to the Earth for 1,000 days, and provide peace and prosperity.
"But it will be preceded by an era, or a period of time of tribulation, widespread destruction and suffering.
"They started preparing for the end of days."
'Not one catalyst' for extremism
Deputy Commissioner Linford said police had garnered from Stacey's diary, which was written over the last few years, that there was "not one catalyst event" which led to their extremism, but Nathaniel's heart attack in 2021 made him more religious.
Other factors included Nathaniel and Stacey losing their jobs - as a principal in Walgett primary school in NSW and head of curriculum at a school in Tara in Queensland - because they did not get the COVID vaccine.
"They certainly had their views around anti vaccination, and as a consequence of that, anti-government," she said.
Deputy Commissioner Linford said police do not believe any other people were locally involved in planning the attack.
"There is absolutely no evidence at this time that there is anyone else in Australia that participated or assisted in this attack," she said.
However, police are working with the FBI in the United States over people who commented on the Train's social media posts.
She said Christian extremist ideology has been linked to other attacks in the world, such as the Waco massacre in the 1990s, but this was the first time it had occurred in Australia.
She said the coroner will make the final determinations on the motivation and what led to the attack.

During the hours-long siege on the day of the shootings, Gareth and Stacey posted a video on YouTube boasting that they killed "these devils and demons".
The wieambilla property, which sits on 44 hectares along a dirt road, had been prepared for an ambush. CCTV cameras had been installed to monitor the grounds, with mirrors attached to trees.
Camouflaged hides were erected, where it is believed the Train family members would lie in wait, and barriers made of logs, dirt and steel were scattered around the property. A trap door was installed under the house for an easy escape.
Six firearms, three compound bows and arrows and several knives were found at the property. Camouflage clothes were also discovered, and it was previously reported one of the Trains wore a gillie suit during the attack.
"I want to stress there is absolutely no evidence at this time, that there is anyone else in Australia that participated or assisted in this attack," said Ms Lindford.
A Queensland Police officer stationed in Chinchilla had attended the property in August regarding Nathaniel's crossing of the NSW and Queensland border in December 2021 near Goondiwindi, where he broke an e-gate.
The gate to the wieambilla property was closed and the officer did not enter.
The primary school principal had a gun license and was the registered owner of five firearms, three of which were brought across the border. Two were found at the property following the attack, with the remaining guns unregistered.
During the hours-long siege on the day of the shootings, Gareth and Stacey posted a video on YouTube boasting that they killed "these devils and demons".
It followed a series of increasingly ominous online posts leading up to the ?attack at their property, in which Gareth ranted about the "Jesuit World Order" and police, and described convicted Port Arthur shooter Martin Bryant as the "perfect patsy" for the 1996 mass killing of 35 people, staged to enable a crackdown on gun ownership.
Investigators have met with the FBI regarding postings on online forums which were responded to by American citizens.
Each of the Trains had worked extensively within Queensland's education network. Stacey left her teaching job in 2021 a day before Covid-19 vaccinations were mandated.
Stacey and Nathaniel were married at 18, and soon after had two children together from which they were estranged at the time of the shooting. It is still unclear when Stacey and Nathaniel's elder brother Gareth married, but the three had spent time living together throughout regional Queensland.
The killings have raised questions about the need for greater gun control nationally. Prime Minister Anthony Albanese said it was earlier this month it was "quite clear we need to do better in co-operation between jurisdictions when it comes to firearms".
A report will be prepared for the coroner.

wieambilla: Queensland shooting declared act of domestic terror
MACKENZIE SCOTT & MICHAEL MCKENNA - FEBRUARY 16, 2023
1/2
The deadly ambush that led to the execution-style murders of two Queensland police officers and a civilian on a remote property last December has been declared an act of domestic terrorism linked to the Christian fundamentalist belief system known as premillennialism.
Queensland Police Deputy Commissioner Tracy Linford confirmed the three Train family members who perpetrated the shooting at their property at wieambilla, 290kms northwest of Brisbane, last December were an "autonomous cell" that was "religiously motivated".
She said there was an indication they were linked to the sovereign citizen movement, although they held similar ideological beliefs.
"We have now had the opportunity to go through many, many documents," Deputy Commissioner Linford said.
"One of those being a diary that Stacey Train maintained.
"We've had an opportunity to go through all the phone messages texts, emails, the social media postings. I can tell you our investigators at this point in time have taken over 190 statements and recorded interviews. We've gone through body-worn camera footage and also CCTV.
"That analysis has provided us significant information and understanding about what drove the motivation of the Train family members on that day and our assessment has concluded that Nathaniel, Gareth and Stacey Train acted as an autonomous cell and executed a religiously-motivated terrorist attack."
Four young police officers from the Western Downs towns of Chinchilla and Tara attended the sprawling property on December 12 after a request NSW Police in the search for missing school principal Nathaniel Train.
When they entered the property, Train, his brother Gareth and his wife Stacey opened fire, killing Constables Rachel McCrow, 29, and Matthew Arnold, 26, and injuring one policeman who managed to escape and raise the alarm. Another officer hid in the tall grass, with the Train's lighting fires and taunting her to lure her out.
Neighbour Alan Dare, 58, was shot and killed when he went to investigate.
Premillennialism is the Christian belief of the second coming of Christ based on a literal interpretation of the Bible's book of Revelation that Christ will return to the earth for 1000 years and provide peace and prosperity before a period of tribulation, widespread destruction and suffering.
Christian ideology has never been linked to an Australian terror attack.
As revealed by The Australian, the remote property was fortified for an ambush of police if they attended. Ms Lindford said there was significant evidence of advanced preparation and planning.
"We can see that they do see the police as monsters and demons," Ms Linford said.
"We don't believe this attack was random or spontaneous. We do believe it was an attack directed at police."

Right-wing terror threat has receded as COVID restrictions have eased, ASIO chief says
Stephen Dziedzic - 13 February 2023
The head of Australia's domestic spy agency says the threat of a terrorist attack by nationalist extremists or conspiracy theorists has receded since governments abandoned lockdowns and other strict COVID-19 control measures.
Last year the Australian Security Intelligence Organisation (ASIO) dropped the terrorism threat level from "probable" to "possible", with the agency instead ploughing additional resources into growing threats posed by espionage and foreign interference.
The head of ASIO, Mike Burgess, told a Senate estimates hearing this morning that some of the uncertainties created by the COVID-19 pandemic - which in turn fuelled anti-government conspiracy theories against lockdowns and vaccination campaigns - had eased over time.
"The volatility has reduced somewhat, in particular around the COVID [measures], so there's less angst these days. We're not subject to mandates," he said.
"Some of that feeling does live on, but the number of cases we've been looking at, they've reduced significantly."
Mr Burgess previously created headlines when he sounded the alarm over the growing terrorist threat posed by far-right racist and nationalist groups.
He also warned those extremist groups were trying to swell their ranks by recruiting people potentially radicalised by COVID-19 conspiracy theories.
Today he told senators that at its peak, right-wing extremism accounted for about half of ASIO's counter-terrorism workload - but that figure had now dropped considerably.
"It did get to 50/50 ... but has actually since moderated, so now we're in the territory of 70/30," he said.
"So 70 per cent [are] religiously motivated, and 30 per cent [are] ideologically motivated.
"Most of that is nationalist and racist, violent extremism."
He said ASIO was not "all seeing and all knowing" but the agency did not believe extremist groups had much success recruiting people who had been radicalised during the pandemic.
"They do manage to recruit some people. Would I say it has been a bumper campaign for them? Probably not," he said.
"[But] they continue to focus on how they will attract people to their cause."
He also warned that while the threat of a terrorist attack was lower, it was still real.
"The most likely threat will come from an individual who goes to violence with little or no warning and they're acting on their own because something has set them off ... including maybe the group they're in is not satisfying their need," he said.
In December, two police officers and another person were killed in an ambush in wieambilla, Queensland, by people who were known conspiracy theorists.
Mr Burgess also dismissed criticisms from some Muslim groups which have urged ASIO not to characterise extremist Islamist groups as "religiously motivated" terrorists, arguing the terminology risks giving organisations like the Islamic State group a patina of religious authority.
"I am aware of that critique," Mr Burgess said.
"I appreciate hearing from them. I don't agree with them, but I understand their concern.
"Our umbrella terms of religiously motivated violent extremism - and there are many forms of that - or ideologically motivated violent extremism are just that, they are umbrella terms."

PM flags overhaul of Australia's counter-terror laws to combat 'real threat' of rightwing extremism
Recent murders of police officers at wieambilla highlight need for action to protect community safety, Anthony Albanese says
Josh Butler and Daniel Hurst - 3 Feb 2023
1/2
Anthony Albanese has flagged a substantial update of Australia's counter-terrorism laws as he warned of the dangers posed by rightwing extremists and "so-called sovereign citizens".
The prime minister said after a national cabinet meeting in Canberra on Friday that the "premeditated, calculated murder" of two police officers and a neighbour in rural Queensland in December showed the need for action to protect community safety.
He also expressed hopes of making progress by the middle of the year on implementing a national firearms register.
The head of intelligence agency ASIO, Mike Burgess, briefed national cabinet earlier on Friday. Albanese said Burgess had been invited to speak "about the rise of rightwing extremism, in particular the so-called sovereign citizens, and other issues as well".
Asked for an update on the terrorism laws review that was foreshadowed by the home affairs minister, Clare O'Neil, the prime minister said: "That work is certainly under way and is substantial."
Albanese went on to offer a personal reflection about his attendance at the memorial service for Queensland police constables Matthew Arnold and Rachel McCrow, saying it was "one of the most moving things that I've done in my life".
The pair and a neighbour, Alan Dare, were shot dead on a rural property at wieambilla by Gareth Train, his wife, Stacey, and his brother Nathaniel. A daughter of the killers spoke to Guardian Australia last month about their descent into conspiracy theories and ultimately, violence.
Albanese described the shooting as "a catastrophic premeditated, calculated murder that occurred there on the basis of a warped ideology".
"It requires us to do what we can to keep the citizens we all represent safe," Albanese said.
"We know that the threat is real and, tragically, we have seen the consequences of it."
In addition to the ongoing review of terrorism laws, Albanese said it was "quite clear we need to do better in cooperation between jurisdictions when it comes to firearms".
Police ministers across the country have been asked to report back to national cabinet mid-2023 with options to implement a national firearms register.
