DOJ Opens First Inquiry Into 1921 Tulsa Massacre

The Department of Justice (DOJ) has launched its first-ever investigation into the 1921 Tulsa Race Massacre, more than a century after one of the most devastating racial attacks in U.S. history left hundreds of Black residents dead and destroyed a thriving community, Axios reported.

Assistant Attorney General kristen clarke announced the investigation Monday under the Emmett Till Unsolved Civil Rights Crime Act, a law that allows the federal government to reopen civil rights cases involving deaths that occurred before 1980.

The Tulsa massacre, which took place over 100 years ago, saw a white mob descend upon Greenwood, a prosperous Black community in Tulsa, Oklahoma, known as "Black Wall Street." Over the course of 24 hours, beginning on May 31, 1921, the mob destroyed 35 blocks of homes, businesses, schools, and churches. An estimated 300 Black residents were killed, and thousands were left homeless.

Despite the scale of the atrocity, no one was ever charged or prosecuted for the violence.

clarke emphasized that while there is little expectation of prosecuting any living perpetrators due to the time that has passed and the absence of federal hate crime laws in 1921, the investigation is still significant.

"Federal prosecution is often legally impossible because no federal hate crime laws existed at the time of the crime that would have given the federal government jurisdiction over these racial atrocities," she said. However, the DOJ will issue a report that examines the massacre in the context of both modern and historical civil rights law.

The massacre was sparked by unfounded rumors that a Black teenager had assaulted a white woman. In response, city officials deputized members of the white mob, who randomly shot Black residents and set fire to their community. Greenwood, once a thriving economic hub, was wiped out, and city authorities later obstructed efforts by Black residents to rebuild by refusing to sell them construction materials. Many survivors were forced to live in makeshift tents.

Although historians, lawyers, and a state commission have conducted investigations into the Tulsa massacre, this is the first time the federal government has taken steps to examine the events and their legal implications.

The massacre has gained increased attention recently, particularly after being depicted in popular HBO series such as "Watchmen" and "Lovecraft Country." Additionally, researchers have uncovered a mass grave in Tulsa's Oaklawn Cemetery, which many believe contains victims of the massacre.

However, the DOJ will issue a report that examines the massacre in the context of both modern and historical civil rights law.

Without any fanfare or mainstream media reporting HUD Secretary Marcia Fudge rolled out a Chan Zuckerberg Initiative-Style election effort in the 3,000+ Public Housing Agencies she managed. Secretary Fudge was given more than a billion dollars and orders to build a nationwide election infrastructure on top of the nation's 3,000+ Public Housing Agencies. As a result, she was able to multiply the Chan Zuckerberg Initiative's 2020 election successes by more than ten times - expanding it from five states to all fifty.

When Democrats learned that Mark Zuckerberg had decided to discontinue his effort to build election infrastructure they looked to the government to fill the void. The billionaire invested more than $400 million in the 2020 presidential election to help election officials in five swing states set up parallel election infrastructure consisting of thousands of ballot drop boxes, voter registration efforts targeted at Democrat communities, and the personnel to manage and maintain them. To fill that gap the Biden-Harris regime signed the Executive Order 14019 on Promoting Access to Voting on March 7, 2021. Six months later Biden allocated more than $5 billion for the effort including more than a billion dollars for the Department of Housing and Urban Development and outlined specific actions to be taken by the agency.

Secretary Fudge stepped down in March but her initiative was expanded to include ALL 15 cabinet secretaries - each of whom were directed to implement Executive Order 14019. Flush with more than $4 billion in taxpayer funds these political appointees have been able to use the infrastructure, personel, and power of their federal agencies to duplicate HUD's efforts to mobilize voters in Democrat communities - under the guise of mobilizing 'historically disenfranchised groups'.

correctly pointed out that this effort violates the Constitution's 'times, places, and manner of elections' clause. As a result Steil issued subpoenas to 15 cabinet secretaries on June 13, 2024, demanding they provide documents related to their strategic plans for implementing the executive order. These plans were originally supposed to be submitted to the White House under the guidance of then-Domestic Policy Advisor Susan Rice. Despite Steil's repeated requests, the agencies have only provided publicly available information effectively stonewalling the committee. The plan seems to be to run out the clock before the November election.

Democrats have repeatedly attempted to pass legislation that would nationalize federal elections. Their most recent effort was called "Freedom to Vote: John R. Lewis Act" (H.R.5746) and would have turned over elections to unelected and unaccountable bureaucrats from the Civil Rights Division of the DOJ which is headed by kristen clarke who has written extensively on race claiming that Blacks have "greater mental, physical, and spiritual abilities" than other races. Republicans blocked the legislation but Biden's EO has opened the backdoor allowing for the creation of a de facto National Election Infrastructure.

The Justice Department announced today that it has published a new guidance addressing limits on when and how jurisdictions may remove voters from their voter lists. The guidance document reflects the department's commitment to ensuring that every eligible voter can exercise their right to vote free of discrimination or voter intimidation.

"Ensuring that every eligible voter is able to vote and have that vote counted is a critical aspect of sustaining a robust democracy, and it is a top priority for the Justice Department," said Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division. "As we approach Election Day, it is important that states adhere to all aspects of federal law that safeguard the rights of eligible voters to remain on the active voter lists and to vote free from discrimination and intimidation."

In its guidance, the department reminds states that efforts to ensure accurate and current voting rolls must be accomplished in compliance with federal law and in a nondiscriminatory manner. Specifically, the department explains important limits imposed by federal law on the rules and procedures states may adopt regarding their voter registration lists.For example, list maintenance efforts must be uniform and nondiscriminatory, and a program to systematically remove ineligible voters must not be done within 90 days of a federal election. There also are specific rules about how to remove registered voters because they have moved. Importantly, these federal protections apply whether the process is initiated by the state or is responsive to third-party submissions.

The department also released a fact sheet as a resource for jurisdictions and provides information on certain civil provisions of federal law that protect the right to vote.
-Section 11(b) of the Voting Rights Act:Federal law broadly prohibits intimidation, threats and coercion - or attempts to do so - throughout every stage of the voting process, including registering to vote, casting a ballot and counting votes.
-Section 2 of the Voting Rights Act:Federal law also prohibits discrimination in voting because of race, color or membership in a minority language group, defined to include American Indian, Asian American, Alaskan Native andSpanish heritage citizens(I doubt that is in there).
-Section 208 of the Voting Rights Act:For voters with disabilities and those unable to read or write, federal law guarantees voting assistance in all aspects of the voting process by a person of the voter's choice subject to only two exceptions barring assistance by the voter's employer or union. And, under theAmericans with Disabilities Act, state and local governments must ensure people with disabilities have a full and equal opportunity to vote.
-Section 203 of the Voting Rights Act:The fact sheet explains that some jurisdictions, as determined by the Census Bureau, are required to provide all election information that is available in English in the covered minority language.

In April, the department announced an updated website, www.justice.gov/voting, a one-stop resource for information on voting and elections. This website includes guides on a range of topics to inform voters and state and local election officials. It includes, among other topics, information about Voting Protections for Language Minority Citizens under Section 203 of the Voting Rights Act, state-by-state rules regarding voting after a criminal conviction, the voting rights of members of the armed services and U.S. citizens living overseas, and information related topost-election audits (see attached), including the requirements under federal law that state and local election officials "retain and preserve" voting-related records.

After deliberating for two days, a jury found a former U.S. Customs and Border Protection agent, Aaron Mitchell, guilty of both a federal civil rights offense and a kidnapping charge for sexually assaulting and kidnapping a victim who was a minor. The jury also found that the defendant's conduct included aggravated sexual abuse, kidnapping and resulted in bodily injury.

"The heinous crimes committed against a young middle school student by an individual sworn to uphold the law are unspeakable," said Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division. "This defendant had a duty to protect his community but instead he abused his power, kidnapped, cuffed and restrained a young girl, and repeatedly sexually assaulted her in his apartment for hours. The Justice Department will continue to stand up for sexual assault victims, especially children, and we will prosecute law enforcement officials who break the law with every tool at our disposal."

During a two-week trial, jurors heard evidence that, on the morning of April 25, 2022, Mitchell traveled to Douglas, Arizona, where he abducted a 15-year-old female middle school student, restrained her, drove her to his apartment and sexually assaulted her.

According to evidence presented at trial, Mitchell found the child waiting for school to start, introduced himself as a law enforcement officer, and asked for her papers. Next, after flashing his police badge and credentials, Mitchell ordered the child into his car and explained that he was taking her to the police station. Instead, Mitchell drove the child miles away from her school, pulled over and restrained her hands and feet with two pairs of handcuffs. The victim testified that, after being handcuffed, the defendant told her to do everything he said because he didn't want to have to hurt her.

Once the defendant forced the victim into his apartment, he repeatedly sexually assaulted her over the course of several hours. Mitchell eventually returned the victim to the area of the middle school where he had abducted her earlier that morning and reminded her not to tell anyone. The victim immediately reported the abduction and sexual assaults to her friends, family members and multiple law enforcement agencies. During an interview with police, the defendant exclaimed that the victim "better hope I don't get out of here."

An examination of the defendant's cellphone revealed that the defendant had conducted numerous searches regarding rape and how to stop someone from screaming and, while he had the child captive in his apartment, he conducted an additional internet search for how long it takes to smother someone.

A sentencing hearing will be set at a later date. Mitchell faces a maximum penalty of life in prison. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

The Douglas Police Department and FBI Phoenix Field Office, Sierra Vista Resident Agency investigated the case.

Assistant U.S. Attorney Carin Duryee for the District of Arizona and Trial Attorney MarLa Duncan of the Civil Rights Division's Criminal Section are prosecuting the case.

DOJ Bullies Cities to Revoke Crime-Free Housing Laws it says "Unfairly Penalize Communities of Color"

The Biden administration is threatening-and has sued-local governments and law enforcement agencies across the country that have implemented measures to curb an epidemic of crime, drugs and gang violence in rental properties asserting that the policies "unfairly penalize communities of color." The popular laws, enacted by thousands of cities nationwide are commonly known as "crime-free" and "nuisance" programs that restrict housing based on criminal and arrest records and punish landlords and tenants with excessive calls to police and emergency services or those engaged in criminal activity. To improve living conditions in mainly low-income rentals 2,000 cities across 48 states have adopted crime-free and nuisance policies, according to the Department of Justice (DOJ), which has legally challenged many of the measures in the last few years claiming that they are discriminatory and therefore violate federal law.

"Even when well-intentioned, these programs can disrupt lives, force families into homelessness and result in loss of jobs, schooling and opportunities for people who are disproportionately low-income people of color - all in violation of federal law," said Assistant Attorney General kristen clarke, who heads the DOJ's Civil Rights Division. "These programs can also discourage people with disabilities and their loved ones from seeking help during a mental health crisis and prevent victims of domestic violence from seeking the protection they desperately need." The lifelong civil rights lawyer, who has dedicated her career to "combating discrimination faced by African American and other marginalized communities," assures that the agency will continue to fight what she calls "discriminatory and unlawful housing programs across the country" while supporting the efforts of local governments and police to prevent violent crime. clarke delivered the comments a few days ago when the DOJ sternly warned cities with crime-free and nuisance measures that they are violating federal housing protections.

In a lengthy document warning local governments and their law enforcement agencies about policies to curb crime in rental housing, the DOJ writes that it has successfully challenged many of them and forced "a number of municipalities," to repeal their measures. The feds also remind those still enforcing their crime-free and nuisance policies that "states from California to Iowa have passed legislation prohibiting" them. The agency essentially threatens the local enforcers of crime-free and nuisance initiatives by stating that they are violating four federal laws-the Fair Housing Act, Title VI of the Civil Rights Act of 1964, the Americans with Disabilities Act, and the Violence Against Women Act. The DOJ graciously offers to work collaboratively with local police and governments to reverse, or at least relax, tough-on-crime policies widely opposed by the left.

In its widely distributed warning, addressed to "Dear Colleague," the agency lists examples of how it has successfully challenged the laws around the country, apparently an intimidation tactic since it can be daunting-and financially impossible-for local governments to take on the federal government with its vast resources. "Remedies arising from violations of these four statutes include monetary relief (including damages, civil penalties, and attorneys' fees), potential termination of federal funding, and injunctive relief (including potential repeal of a program and judicial oversight)," the DOJ warning to local governments states, adding that "recent settlements have required law enforcement agencies and local governments to pay millions of dollars in monetary relief and to repeal or rehaul their programs." The agency offers numerous cases with extensive background information to illustrate how it has flexed its muscle to eliminate tough on crime housing policies nationwide.

Examples include Hesperia, California repealing its policies and paying nearly $1 million in "relief" after the feds sued the southern California desert city with a population of around 100,000. Faribault, Minnesota doled out nearly $700,000 to settle its federal case and is prohibited from enforcing the types of criminal history that may be considered by private landlords when screening tenants. Bedford, Ohio repealed its laws after dishing out a $350,000 monetary award. Hemet, California got rid of its measures and was forced to create a $200,000 remediation fund. Anoka, Minnesota made "substantial program amendments" and paid $175,000 to settle with the DOJ.

Justice Department Sues Five Individuals for Protesting at an Abortion Clinic

The Justice Department filed a civil federal lawsuit today in the Middle District of Florida against five people for violating the Freedom of Access to Clinic Entrances (FACE) Act, which prohibits anyone from using force, threats of force or physical obstruction against any person because they are seeking or providing reproductive health services.

The lawsuit alleges that Calvin Zastrow, Kenneth Scott, Chester Gallagher, Eva Zastrow and Katelyn Sims, also known as Katelyn Velasco, committed violations of the FACE Act in Ft. Myers, Florida, on Jan. 27, 2022. Specifically, the complaint alleges that the defendants trespassed onto a reproductive health center's property, blocked the entrances and temporarily stopped operations at the center. The complaint seeks injunctive relief and monetary penalties as provided by the FACE Act.

"These five defendants deliberately obstructed access to reproductive health services," said Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division. "Physically blocking those seeking or providing reproductive health services in order to impose their views is unlawful. The Justice Department will continue enforcing the FACE Act to protect against such obstruction."

"The Justice Department ensures that individuals cannot pick which laws they wish to follow," said U.S. Attorney Roger B. Handberg for the Middle District of Florida. "We look forward to continuing to protect the rights of patients and providers to access reproductive health care."

INSANE: Biden Regime Sues State of Tennessee Over Law Punishing Prostitutes for Knowingly Spreading HIV - Claims Law Violates the Americans with Disabilities Act

The Biden Department of Justice (DOJ) filed a lawsuit against the state of Tennessee Thursday over a law penalizing prostitutes for spreading the Human Immunodeficiency Virus (HIV), insanely claiming it is a "prohibited form of discrimination" under the Americans with Disabilities Act (ADA).

The Tennessee law, which was passed in 1991, characterizes intentionally spreading HIV as "aggravated prostitution." Specifically, this occurs when a person "engages in sexual activity as a business or is an inmate in a house of prostitution or loiters in a public place for the purpose of being hired to engage in sexual activity" despite knowing that they are infected with HIV.

A person convicted of "aggravated prostitution" faces up to 15 years in prison and a fine of up to $10,000. Most of Tennessee's prostitution occurs in the Memphis area.

Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division released a statement claiming the law targets HIV-infected individuals because of their "disability." Yes, in the eyes of the Regime, having a deadly, infectious disease counts as a disability.

The enforcement of state criminal laws that treat people differently based on HIV status alone and that are not based on actual risks of harm, discriminate against people living with HIV. People living with HIV should not be subjected to a different system of justice based on outdated science and misguided assumptions.

This lawsuit reflects the Justice Department's commitment to ensuring that people living with HIV are not targeted because of their disability.

As the Daily Caller notes, the law also requires those convicted of aggravated prostitution to register as a sex offender for life. This means those convicted cannot " live or accept employment within 1,000 feet of any school, daycare center, other childcare facility, or public park, playground, recreation center, or athletic field."

The DOJ whines that such restrictions violate HIV-infected prostitutes' "right" to "live, work, and go in public."

The state attorney general's office said it is aware of the complaint and will review it.

The Caller notes that the DOJ announced in December 2023 that it had found that the law was discriminatory and ordered the state not to enforce it. They waited until today to drop the hammer when Tennessee rightfully refused to comply.

Rebecca Bond, chief of the DOJ's Disability Rights Section, wrote in a letter to Tennessee officials that since 1991, there had been "significant progress" in understanding and treating AIDS. She argued that this makes the law "outdated."

"Beliefs and assumptions that individuals with HIV will spread it, or that having HIV is a death sentence, are now outdated and unfounded," Bond wrote.

However, the Tennessee State Legislature is considering at least partially caving to the Regime's demands. There is a bill currently under consideration that would remove the requirement for prostitutes to register as sex offenders if they knowingly have sex with HIV.

More than 5,600 federal-only ballots were cast in the 2020 presidential election in Arizona, without proof of U.S. citizenship required by the voters who cast them, according to data from the state's counties.

Arizona is a state with the unusual situation of bifurcated elections, in which residents who provide proof of U.S. citizenship can vote in all elections while the others may vote only in federal elections, resulting in ballots cast by voters who haven't proven their U.S. citizenship.

Arizona law requires residents registering to vote in the state to provide proof of U.S. citizenship.

However, after the Supreme Court ruled in 2013 that Arizona must accept U.S. voter registration forms because of federal requirements under the 1993 National Voter Registration Act, the state allows residents registering to vote who don't provide proof of citizenship to receive ballots for federal races only.

Federal voter registration forms require those filling them out only to sign a sworn declaration that they are U.S. citizens.

When residents of Arizona register to vote or update their registration, an election system accesses their driver's license records to verify whether they have proof of citizenship.

Those without documentation are ineligible to vote in state elections and registered as "federal-only" voters, according to the Associated Press.

Last year, Arizona enacted a law that requires counties to check federal-only voters for citizenship against multiple databases. The counties must reject any federal applications if they find the individual is not a U.S. citizen, and any official knowingly ignoring the requirement could receive a felony charge.

The Justice Department sued Arizona over the law in July 2022, claiming it is "a textbook violation of the National Voter Registration Act," according to Assistant Attorney General kristen clarke of the agency's Civil Rights Division. The agency also claims the law violates the Civil Rights Act of 1964.

Former Arizona Assistant Attorney General Jennifer Wright told Just the News on Thursday that she believes Arizona is "one of the only states to have bifurcated elections" because the U.S. Election Assistance Commission didn't allow the state to require driver's licenses for voter registration, despite other states having the requirement.

Wright said that when a person registers to vote, their name is supposed to be compared to the U.S. Citizenship and Immigration Services' SAVE database by county recorders to determine if they're non-citizens.

While there is not a system in place to ensure that the recorders are checking for non-citizens when registering voters, state law requires them to only register residents and certify that the voter roster is correct, she added, citing A.R.S. 16-183 and A.R.S. 16-169A.

If non-citizens register to vote before becoming naturalized citizens, then it could hinder their naturalization.

The recent House Judiciary Subcommittee on the Constitution and Limited Government hearing turned tense as kristen clarke, the Assistant Attorney General for the Civil Rights Division of the Department of Justice, claimed ignorance regarding a major free speech case. The case in question, Missouri v. Biden, involves The Gateway Pundit's founder, Jim Hoft, as the lead plaintiff.

During the hearing focused on the oversight of the Department of Justice's Civil Rights Division, tasked with ensuring adherence to federal anti-discrimination laws, Representative Dan Bishop (R-NC) scrutinized clarke about her lack of knowledge regarding the Missouri v. Biden case, which is set to be reviewed by the Supreme Court of the United States (SCOTUS).

In October, the Supreme Court announced that it is granting "certiorari", meaning that it will hear the case, to the litigants in Missouri v. Biden.

However, it also stopped the injunction against the government continuing to censor American citizens. Meaning that, the government will be able to turn the censorship regime back on while the court hears the case.

The Missouri v. Biden case involves the question of whether the Biden regime can use federal government resources to overtly censor American citizens, a practice aggressively begun under the COVID lockdowns. The case has revealed a wide array of government agencies and officials engaged in telling social media companies exactly what to censor, whom to ban, and what speech is permissible.

Legal experts describe Missouri v. Biden as the most important case for free speech in at least a decade. This case has attracted significant attention after a US District Court labeled the Biden regime's actions as "the most massive attack against free speech in United States' history."

clarke admitted to not being familiar with the litigation. Rep. Bishop questioned how the leader of the Civil Rights Division could be unaware of a case described by a U.S. District Court as a major free speech issue. clarke requested more facts to better understand the case.

Rep. Bishop: Ms. clarke, in the Biden v. Missouri case in the district court, the court explained, "If the allegations made by the plaintiffs are true, the present case arguably involves the most massive attack on free speech in United States history."

The court went on to find that the plaintiffs were reasonably likely to succeed on the merits at trial and entered a preliminary injunction. The Fifth Circuit has affirmed, and the Supreme Court has taken jurisdiction of the case. Of course, that's all civil litigation is any criminal investigation or prosecution of the persons responsible for that activity in the FBI, CISA, and at the White House and their co-conspirators underway in the Civil Rights Division.

clarke: Congressman, I'm not familiar with this litigation, but happy to bring your question back.

Bishop: So, let me just make sure I understand that you are not aware of the Missouri versus Biden litigation that is currently being taken up by the United States Supreme Court. Is that correct?

clarke: Unfortunately, I'm not. Congressman.

Bishop: Assuming that you're not aware of that, what reason would there be that the Civil Rights Division of the Justice Department leader is unaware of what a United States District Court has described as the most massive attack on free speech in the United States history?

clarke: If you could share more of the facts, that could be helpful, Congressman.

Bishop: Otherwise, you just don't know, is that correct?

clarke: That's correct. Unfortunately, this does not appear to be a case that I'm familiar with.

Biden Admin Threatens Banks That Refuse To Lend Money To Illegal Immigrants

The Biden administration released a statement Thursday warning financial institutions against using a person's immigration status in credit applications.

The Consumer Financial Protection Bureau (CFPB) and the Department of Justice (DOJ) released a joint statement telling financial institutions that while it is not illegal to consider a person's immigration status in the decision on whether to lend money, an overreliance on it could run afoul of the law, according to the statement. The statement implicates the Equal Credit Opportunity Act (ECOA), which makes it illegal to discriminate on the basis of race, color, religion, national origin, sex and more in considering a person's credit application as the mechanism, even though the law does not list citizenship status as a protected attribute.

"Fair access to credit is crucially important for building wealth and strengthening household financial stability," Rohit Chopra, CFPB director, said in a press release. "The CFPB will not allow companies to use immigration status as an excuse for illegal discrimination."

The CFPB notes that the reason for the guidance comes after the agency received a number of instances of consumers being rejected in their applications for credit cards and auto, student, personal and equipment loans on the basis of their noncitizen status despite having a good credit history and a tie to the United States, according to the press release.

"Lenders should not deny people the opportunity to take out a loan to buy a home, build their businesses or otherwise pursue their financial goals because of unlawful bias and without regard to their actual ability to repay," kristen clarke, assistant attorney general of the DOJ's Civil Rights Division, said in the press release. "This guidance reminds lenders that denying someone access to credit based solely on their actual or perceived immigrant status may violate federal law."

The two agencies acknowledge that while the ECOA permits creditors to consider someone's citizenship status, the act of doing so may violate prohibitions on the consideration of other factors like national origin or race, according to the press release. The regulators emphasize that there is no "safe harbor" when considering an applicant's immigration status.

These investigations, conducted under Title VI of the Civil Rights Act of 1964 and its regulations and Title IV of the Civil Rights Act of 1964, involved concerns about discrimination in schools' use of out-of-school suspensions, expulsions, school-based arrests, referrals to law enforcement, involuntary discipline transfers, informal removals and other disciplinary actions against Black, Latino and Native American students.

The Resource demonstrates ways school districts can take steps to proactively improve their administration of student discipline.

Cop Gets 14 Years for Responding to Child Rape Case by Raping the Child Himself

A cop with a history of misconduct was never fired and eventually assigned to a case involving a child victim who he sexually assaulted.

New Orleans, LA - As frequent readers of the Free Thought Project know, police officers are arrested weekly in this country for sex crimes involving children. This is a massive problem but becomes even worse when victims of child sex abuse seek out help and run right into the arms of someone even worse than they are trying to report. For one girl in New Orleans, Louisiana, this is exactly what happened to her.

In 2020, the New Orleans Police department arrested one of its own officers for sexually assaulting a 14-year-old child. Rodney Vicknair, 55, was arrested and charged with sexual battery, indecent behavior with a juvenile, and malfeasance for sexually assaulting the child while investigating a sexual assault that she reported. After fighting the case for two years and pleading not guilty, last, Vicknair changed his tune.

Vicknair finally admitted to grooming and raping the girl while taking her to the hospital to have a rape kit done for a previous sexual assault she had just endured. On Tuesday, he was sentenced in federal court to 14 years in prison.

"We are grateful to this young survivor for coming forward, even though she thought no one would believe her," said Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division. "Had she not been willing to do so, we would not have been able to hold the defendant accountable for his heinous crime. This case should send a strong message to law enforcement officers who sexually abuse victims, particularly children, that they are not above the law and will be held accountable."

"The public must be able to trust that law enforcement will faithfully execute their sworn duties or face the consequences for failing to do so," said U.S. Attorney Duane A. Evans for the Eastern District of Louisiana. "Our office, along with the Department of Justice, the FBI and state and local law enforcement agencies, will continue to investigate and prosecute any violations of constitutional rights."

As we reported at the time, this officer had a history of discipline problems, and he should have never had his job when the child's sexual assault took place.

2 native Hawaiian men learn their fates after brutal hate-crime beating of white man with a shovel

Two native Hawaiian men were sentenced to prison terms for a federal hate crime in the brutal beating of a white man who was trying to move into their remote Maui village.
A jury in November found that Kaulana Alo-Kaonohi and Levi Aki Jr. attacked Christopher Kunzelman because of his race - punching, kicking and beating him with a shovel in 2014, when he tried to move into their neighborhood of Kahakuloa.
Alo-Kaonohi, 33, was sentenced to 78 months;Aki, 33, was sentenced to 50 months, the Justice Department said.
"The defendants in this case nearly killed a man because they believed he did not belong in their neighborhood because of the color of his skin," said Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division.
"The law protects everyone in this country from racially motivated violence, and these sentences send a strong message that such violence will not be tolerated."
Local lawyers believe it's the first time the US has prosecuted native Hawaiians for hate crimes. The case has highlighted the struggle between native Hawaiians looking to preserve their culture and newcomers to Hawaii who are unaware of its history and racial dynamics.
Lawyers for the two men deny the attack was racially fueled, but because of the victim's entitlement and disrespectful attitude.
Kunzelman's wife Lori said the couple loved Maui, and that her husband had purchased a home sight unseen for $175,000 to repair after she was diagnosed with multiple sclerosis.
When he began working on the house, he was harassed and threatened by locals who claimed things like: "This is a Hawaiian village. The only thing coming from the outside is the electricity," and "You don't even belong in Hawaii," according to evidence presented during the trial.
"It was obviously a hate crime from the very beginning," she said. "The whole time they're saying things like, 'You have the wrong skin color. No 'haole' is ever going to live in our neighborhood.'"
"Haole" is a Hawaiian word with a complicated history. Its meanings include foreigner and white person. According to Judy Rohrer, the author of "Haoles in Hawai'i," when someone is "acting haole" they are acting out of entitlement and like they "own the place."
Video from cameras on Kunzelman's vehicle shows Aki saying "You's a haole, eh," which Kunzelman testified was said in a derogatory way.
"When you watch the video ... there was almost like enthusiasm,"said US District Judge J. Michael Seabright. "Maybe that's what's so disturbing about this case."
The two men took Kunzelman's phone, which recorded the attack, and tossed it into the ocean. After the assault, Aki referred to Kunzelman to police as a "rich Haole guy," a "dumb haole" and a "typical haole thinking he owning everything ... trying to change things up in Kahakuola," according to prosecutors.
The men were upset after Kunzelman cut locks to village gates, their lawyers said. Kunzelman said he did so because residents continuously locked him in and out while he was fixing his new home. He testified that he wanted to provide the village with better locks and distribute keys to residents.
"The hate crime messed me up," Kunzelman said in court Thursday.
In a letter to the judge, Aki said he doesn't see himself as racist: "Not only because I am almost half-Caucasian but also because I have people who I love and care about who are white." He added that he's ashamed of his immature and hurtful works and actions.

A vandal or vandals dumped a bucket of red paint on the Washington, D.C.-based Capitol Hill Crisis Pregnancy Center in June, spray-painted the words "Jane's Revenge" on the wall of the center, and egged the windows. The center is filled with baby clothing, baby food, and resources for D.C.-area parents who come to the center hoping they can find help rather than resorting to abortion.

The Metropolitan Police Department has increased its presence around the center, Director Janet Durig told The Daily Signal on Thursday morning, and though the center itself has increased security measures, there have still been several incidents involving a male allegedly beating on the center's windows that have made her feel very uncomfortable.

Durig praised the D.C. police for keeping her center safe. But she said that she has not heard from the FBI and does not believe that the vandalism is being investigated by federal authorities.

And on Thursday morning, D.C. police told The Daily Signal that its investigation into the June vandalism has been suspended pending further evidence-meaning that if the FBI is not investigating this attack, no one is.

Meanwhile, the Biden Justice Department is heavily focused on protecting abortion clinics from pro-life activists who pray outside or seek to persuade women not to abort their unborn babies. On Wednesday, the Justice Department charged 11 more pro-life activists with violations of the Freedom of Access to Clinic Entrances Act for blocking the entrance of an abortion clinic in 2021.

"Reproductive health care providers must be free to carry out their work free from interference or intimidation," said Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division in a Monday statement. "The Justice Department is committed to enforcing federal law to protect providers and all people seeking access to reproductive health care across our nation."

clarke, who oversees the Justice Department's investigations into potential FACE Act violations, has called pro-life centers "harmful" and "predatory" and called for exposing "fake clinics," as The Washington Free Beacon's Chuck Ross reports.

She did not immediately respond to requests for comment from The Daily Signal.

"Today's #SCOTUS ruling striking down CA law that required crisis pregnancy centers to provide factual information about state-offered services, including abortions, will have harmful consequences for women, especially women of color who are often targeted by predatory CPCs [crisis pregnancy centers]," she tweeted in 2018.

"Make no mistake," she tweeted later. "Today's decision at the #SCOTUS striking down a CA disclosure requirement for crisis pregnancy centers is part of a coordinated strategy to tear down #RoevWade. The anti-choice movement will stop at nothing. #EndTheLies #ExposeFakeClincs"

When former President Donald Trump's administration created a religious liberty task force in 2018, clarke called the move "shameful."

"DOJ should be working to fight discrimination and protect the rights of vulnerable communities," she said at the time. "Instead, [then-Attorney General] Jeff Sessions is launching a Religious Liberty Task Force to make it easier for people to use religion to mask their discriminatory goals. Shameful."

On several occasions when Mark Houck went to sidewalk counsel last year, he took his eldest son, who was only 12 at the time, she explained. For "weeks and weeks," a "pro-abortion protester" would speak to the boy saying "crude ... inappropriate and disgusting things," such as "you're dad's a fag," and other statements that were too vulgar for her to convey.

Repeatedly, Mark Houck would tell the man that he did not have permission to speak to his son and please refrain from doing so. And "he kept doing it and kind of came into [the son's] personal space" obscenely ridiculing his father. At this point, "Mark shoved him away from his child, and the guy fell back."

In addition to "sidewalk counseling," Houck founded a ministry called The King's Men, which helps men heal from their pornography addictions. Clearly, he's a menace to Leftist society.

And that's why clarke is after him and others, conducting "actions in more than a dozen states" and digging around in "investigations in other states" for these crimes. I'm a law and order person, but let's call this what it is: "padding the file." And it's reminiscent of what we've seen in the January 6 prosecutions by clarke and Garland.

According to an FBI whistleblower, "The Washington, D.C. field office is 'manipulating' FBI case management protocol and farming out J6 cases to field offices across the country to create the false impression that right-wing domestic violence is a widespread national problem that goes far beyond the 'black swan' event of Jan. 6, 2021."

Who's cheerleading the investigation into these "white nationalists"? kristen clarke…

In a department headed over the years by the likes of Merrick Garland and Eric Holder, that's saying something.

Though at her confirmation hearing she claimed she didn't believe in defunding police, she did. If you feel uncharitable, you could make a case for blaming the legal Leftist activist and now civil rights director of the DOJ for the bodies piling up in major American cities. Some civil rights matter more than others.

clarke's leadership at the very far-left Lawyers' Committee and the New York Attorney General's office saw the Harvard and Columbia Law grad take the side of black perpetrators always. Except for Enrique Tarrio, the Hispanic leader of the Proud Boys, whom she derided as a "white nationalist."

While Leftist Antifa terrorists and Black Lives Matter grifters held major cities throughout the country hostage in 2020, including D.C. Their rioters literally burned a church, in addition to the other mayhem, violence, and terror they caused.

Tarrio and the Proud Boys ripped a banner festooned with a Black Lives Matter logo from a churchyard. clarke's Lawyers' Committee sued Tarrio and his "white nationalist" group for conducting a "violent riot." While we don't doubt that was troubling to the people who put up the banner at the traditionally black church, and while it certainly is not civil, it hardly rises to the level of a "violent riot." But clarke framed the theft as "an attack on a black church," intentionally drawing a moral equivalence between an act of vandalism and an actual church burning by Antifa and Black Lives Matter.

Indeed, as the head of the Civil Rights Division, clarke now has at her disposal the FACE Act, which also covers churches.

And she's in charge.

A former DOJ prosecutor told me the other day, "It's not just Merrick Garland, Victoria. There's a boss that makes these calls before Merrick Garland ever hears of a case. Name the names."

Sens. Ted Cruz (R-Texas), Josh Hawley (R-Mo.), and Tom Cotton (R-Ark.) warned us about kristen clarke. clarke considers her calling in Biden's Justice Department one of score-settling for past decisions, holding contemporaries responsible for historical injustices, and chasing ghosts of the past.

She greenlit the federal case against Mark Houck, a Pennsylvania Catholic pro-life author, whose seven children screamed for mercy for their "best friend," their dad, as an estimated 20-25 FBI agents trained their rifles on him after beating on the family's door at seven in the morning last Friday. According to LifeSiteNews, Houck was already aware that the Feds were after him and had offered to come in and talk with them. But gun-toting agents dragged him out and took him to a federal facility.

And it was clarke who reached into the past and pulled out the more-than-a-year-old discredited case against Houck, whom a pro-abortion protester accused of "attacking" a man escorting abortion seekers. But that's not how it went down. That story was such a put-up job that even Pennsylvania authorities threw out the case against Houck because it didn't pass the smell test.

But clarke, fueled by her upset over the Dobbs decision, which sent abortion decisions back to the states, reached back, shook off the dust from the Houck case, and sought to find a crime to fit the man. She found it in the 1994 so-called FACE Act.

"The Freedom of Access to Clinic Entrances Act of 1994 (FACE)...prohibits the use or threat of force and physical obstruction that injures, intimidates, or interferes with a person seeking to obtain or provide reproductive health services or to exercise the First Amendment right of religious freedom at a place of religious worship," according to the DOJ website.

The end game of the FACE act is financially ruining the perp and locking him up in one of Merrick Garland's political gulags.

"The DOJ said that Houck could face "up to a maximum of 11 years in prison, three years of supervised release, and fines of up to $350,000" if he is convicted of the alleged offenses," according to Trib24/7.

The case is meant to chill free speech by conservatives who oppose abortion and just about any other issue. And here was his crime: in October 2021, Houck was legally praying and standing by to counsel women outside abortion clinics with his 12-year-old son. Both were exercising their free speech rights, as were the pro-abortion activists. But an abortion escort wouldn't leave his son alone.

"The pro-life leader's wife Ryan-Marie told LifeSiteNews on Friday the abortion facility worker had been harassing their 12-year-old son by using vulgar language and getting into the boy's 'personal space,' and that Houck had shoved him away to protect his son."

According to court documents, Moreno owned, operated and managed Los Villatoros Harvesting (LVH), a farm labor contracting company, that functioned as a criminal enterprise compelling victims to work in Florida, Kentucky, Indiana, Georgia and North Carolina. After charging Mexican farm workers exorbitant sums to come into the United States on short-term, H-2A, agricultural visas to work for LVH, Moreno and his co-conspirators coerced over a dozen workers into providing long hours of physically demanding agricultural labor, six to seven days a week, for de minimis pay. Moreno and his co-conspirators used various coercive means, including imposing debts on workers; confiscating the workers' passports; subjecting workers to crowded, unsanitary and degrading living conditions; verbally abusing and humiliating the workers; threatening workers with arrest, jailtime and deportation; isolating workers by preventing them from interacting with anyone other than LVH employees; and threatening to physically harm the workers' family members back in Mexico if the workers failed to comply with their demands. In addition to conspiring to subject H-2A workers to forced labor, Moreno and his coconspirators also harbored H-2A workers in the United States after their visas had expired for financial gain and committed visa fraud and fraud in foreign labor contracting.

Earlier this year, three co-defendants who had worked for Moreno and assisted him in operating LVH pleaded guilty to related offenses. Christina Gamez, 43, a U.S. citizen, who worked for LVH as a bookkeeper, manager and supervisor, pleaded guilty to RICO conspiracy. Efrain Cabrera Rodas, 32, a citizen of Mexico, who worked for LVH as a recruiter, manager and supervisor, also pleaded guilty to RICO conspiracy. Guadalupe Mendes Mendoza, 45, a citizen of Mexico, who worked for LVH as a manager and supervisor, pleaded guilty to conspiring to obstruct a federal investigation.

The Palm Beach County Human Trafficking Task Force, which includes the Federal Bureau of Investigation, Homeland Security Investigations, and the Palm Beach County Sheriff's Office, investigated the case. The Task Force received assistance from the Department of Labor (DOL) Office of the Inspector General, the DOL Wage and Hour Division, the Department of State Diplomatic Security Service, and Coalition of Immokalee Workers, Colorado Legal Services Migrant Farm Worker Division, Legal Aid Services of Oregon Farmworker Program and Indiana Legal Services Worker Rights and Protection Project.

The announcement was made by Assistant Attorney General kristen clarke for the Justice Department's Civil Rights Division and U.S. Attorney Roger Handberg for the Middle District of Florida.

Owner of Farm Labor Contracting Company Pleads Guilty in Racketeering Conspiracy Involving the Forced Labor of Mexican Workers
Bladimir Moreno, 55, pleaded guilty in federal court in Tampa, Florida, to charges of conspiracy under the Racketeer Influenced and Corrupt Organizations (RICO) Act and conspiracy to commit forced labor. A federal grand jury in the Middle District of Florida had previously returned a six-count indictment against multiple defendants for their roles in a federal racketeering conspiracy that victimized Mexican H-2A workers who, between 2015 and 2017, had worked in the United States harvesting fruits, vegetables and other agricultural products.

"The scheme these defendants employed trapped the victims through fear of serious harm if they did not continue to toil away for the defendants' profit," said Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division. "The Department of Justice is committed to combating human trafficking in all its forms, including prosecuting agricultural employers who break the law to subject their vulnerable migrant farm workers to forced labor."

The marriage of government with turning out the partisan vote - using social services as a sweetener - is a throwback to the workings of Tammany Hall, the Daley machine, and other Democrat Party traditions.

After years of advocating using the power of government to benefit a single party, Demos issued its December 2020 recommendations for the incoming Biden-Harris administration in what turned out to be the blueprint for Biden's election agenda.

The first of the six recommendations says, "The Biden-Harris administration can make voting more accessible by directing specified federal agencies, in their administration of federal programs, to act as voter registration agencies, including providing voter registration applications, assisting clients to complete applications, and transmitting completed applications to state authorities."

In an apparent response, Biden issued an overly broad executive order on March 7, 2021, ordering federal agencies to do exactly that.

"Agencies shall consider ways to expand citizens' opportunities to register to vote and to obtain information about, and participate in, the electoral process," Biden's executive order says. "The head of each agency shall evaluate ways in which the agency can, as appropriate and consistent with applicable law, promote voter registration and voter participation."

The order also says agencies are to "expand citizens' opportunities to register to vote and to obtain information about, and participate in, the electoral process." The order directs agencies to focus on "distributing voter registration and vote-by-mail ballot application forms," "assisting applicants in completing voter registration and vote-by-mail ballot application forms," and "soliciting and facilitating approved, nonpartisan third-party organizations and state officials to provide voter registration services on agency premises."

Demos specifically singled out using U.S. Citizenship and Immigration Services to sign up new voters at naturalization ceremonies.

Under Biden's executive order, the Department of Homeland Security's focus will be on voter registration "at the end of naturalization ceremonies for the hundreds of thousands of citizens naturalized each year," according to the White House summary of agency plans.

The second Demos recommendation for Biden's executive actions was to "strengthen Department of Justice's enforcement of and guidance on voting rights statutes" and "pursue aggressive civil and criminal enforcement of federal voting rights protections."

The Justice Department seems to have obliged, filing lawsuits against the election laws in Arizona, Georgia, and Texas, while also issuing election law guidance seemingly as a warning to other states.

Apart from the executive order, Biden appointed top Justice Department officials with a long record of opposing any voter ID laws. Biden named Vanita Gupta as the associate attorney general. She returned to the department after running the civil rights division during the Obama administration.

During that run, she oversaw the 2015 lawsuit against North Carolina to attempt to block the voter ID law there. Biden also named kristen clarke as the assistant attorney general, who would lead the Civil Rights Division that oversees the Voting Section. As a private lawyer, clarke led a lawsuit to stop the then-Georgia Secretary of State Brian Kemp from enforcing election integrity policies.

Justice Department Announces Investigation Of New York City Police Department's Special Victims Division

Comprehensive Review of Policies, Procedures, and Training, Including SVD's Investigations of Sexual Assault Crimes and Treatment of Survivors

The investigation will assess whether the SVD engages in a pattern or practice of gender-biased policing. The investigation will include a comprehensive review of the policies, procedures, and training for SVD investigations of sexual assault crimes, including how SVD interacts with survivors and witnesses, collects evidence, and completes investigations; any steps NYPD has taken to address deficiencies in its handling of sexual assault crimes; how SVD allocates staffing and other resources; and the services and support offered to survivors of sexual assault. As part of this investigation, the Justice Department officials will reach out to community groups and members of the public to learn about their experiences with SVD.

Prior to the announcement, Justice Department (Department) officials notified Mayor Eric Adams, NYPD Commissioner Keechant L. Sewell, and NYC Corporation Counsel Sylvia O. Hinds-Radix, who have pledged to cooperate with the investigation.

Arizona AG Mark Brnovich strikes back at DOJ over election integrity lawsuit

Arizona Attorney General Mark Brnovich's patience appears to be wearing thin with the Biden Department of Justice following the announcement that it was suing Arizona for "restrictive voter registration requirements."

Specifically, the DOJ complaint challenges Arizona's recently-passed House Bill 2492, which requires residents to provide "satisfactory evidence of citizenship" to be eligible to vote. The law will take effect in January.

"House Bill 2492's onerous documentary proof of citizenship requirement for certain federal elections constitutes a textbook violation of the National Voter Registration Act," contended kristen clarke, assistant attorney general for the DOJ's Civil Rights Division, in a Tuesday press release.

"For nearly three decades, the National Voter Registration Act has helped to move states in the right direction by eliminating unnecessary requirements that have historically made it harder for eligible voters to access the registration rolls," clarke continued. "Arizona has passed a law that turns the clock back on progress by imposing unlawful and unnecessary requirements that would block eligible voters from the registration rolls for certain federal elections."

In its complaint, the DOJ states that House Bill 2492 contravenes the Supreme Court's 2013 ruling in Arizona v. Inter Tribal Council of Arizona, Inc. The ruling holds that a previous proof-of-citizenship requirement in Arizona was "pre-empted by the NVRA's mandate that States 'accept and use' the Federal Form" for voter registration, which merely requires applicants to swear under penalty of perjury that they are U.S. citizens.

Following the DOJ's announcement, Rep. Andy Biggs, R-Ariz., weighed in on the matter via Twitter, writing: "DOJ doesn't think you should prove that you're an American to vote in an American election. DOJ is suing Arizona over proof of citizenship requirements. Unbelievable."

Meanwhile, Arizona gubernatorial candidate Kari Lake had a shorter response, tweeting, "F (& I cannot stress this enough) JB."

The lawsuit comes amid growing election integrity concerns in the Grand Canyon State, where many still question the validity of the results of the 2020 presidential election.

Last month, inventor and entrepreneur Jovan Pulitzer presented additional evidence to Arizonan politicians and candidates of 2020 election fraud from a forensic analysis he conducted into the paper ballots used in the Maricopa County election.

"There is sufficient and irrefutable evidence of pervasive voter fraud and widespread election fraud in Maricopa County, Arizona," Pulitzer said at the June 27 event, at which he announced his finding that President Donald Trump, not Joe Biden, won Maricopa County with 59 percent of the vote.

As evidence continues to surface challenging the prevailing narrative of what happened on Nov. 3, 2020, voters in Arizona and around the country will undoubtedly be watching closely to see how the court rules on election integrity laws like House Bill 2492.

Biden DOJ Sues To Block Arizona's Proof Of Citizenship Voting Law

The Biden administration sued Arizona on Tuesday to block a new law requiring proof of citizenship in order to vote in federal elections.

Calling it a "textbook violation of the National Voter Registration Act," Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division said that the law's requirement was "onerous" - and took particular issue with provisions such as "requiring election officials to reject voter registration forms based on errors or omissions that are not material to establishing a voter's eligibility to cast a ballot."

The new law would require voters to prove citizenship using documentation such as a driver's license, passport, birth certificate or naturalization papers.

clarke added that the new law, scheduled to take effect in January after it was signed into law by GOP Gov. Doug Ducey, is similar to an Arizona law struck down by the US Supreme Court in 2013.

The suit describes how the attorney for Arizona legislators warned them that the bill would violate federal law and contradict the earlier Supreme Court ruling. House Speaker Pro Tempore Travis Grantham said trying again "is a fight worth having," according to the court filing.

Arizona Attorney General Mark Brnovich told clarke in a letter that he intendeds to defend Arizona's H.B. 2492 all the way up to the U.S. Supreme Court if needed. He pointed to his victory in a separate election integrity suit from last year, in which he argued successfully in front of the Supreme Court that Arizona election integrity laws and policies did not violate the nation's Voting Rights Act or the Constitution.

In his letter, Brnovich chided clarke and the DOJ for using its resources "to challenge a common sense law," while at the same time the Biden administration is "opening our borders to encourage a flood of illegal immigration."

Brnovich questioned whether the DOJ was attempting "to undermine [Arizona's] sovereignty" and "destabilize" the state's election infrastructure.

"I hope that is not your intention," he noted. "I strongly urge you to reconsider your pursuit of this misguided suit and to instead recognize Arizona's constitutional authority to conduct lawful and secure elections."

Joe Biden's Department of Justice and the FBI have raided, arrested, and charged the legendary Joan Andrews Bell and eight other pro-lifers with "conspiracy against rights" and "FACE Act offenses" after they conducted a "traditional rescue" at a prominent D.C. abortion mill in October 2020.

The Department of Justice wrote on March 30 that Assistant Attorney General kristen clarke from the DOJ's Civil Rights Division, along with U.S. Attorney Matthew M. Graves for the District of Columbia, had announced "a two-count indictment charging" nine pro-lifers "with federal civil rights offenses in connection with an alleged reproductive healthcare clinic invasion in Washington, D.C., on Oct. 22, 2020."

October rescue leading to nine arrests

Hialeah, FL - Disgraced Hialeah Police Sergeant Jesus Manuel Menocal Jr., 34, of Miami pleaded guilty this month to sexually assaulting multiple victims, including two children aged 14 and 17 while on duty and in uniform. For using his badge to commit these crimes, he should be put away for decades but that will not happen and Menocal won't even have to register as a sex-offender.

"Menocal sexually exploited the very people he swore to protect," said U.S. Attorney Juan Antonio Gonzalez of the Southern District of Florida. "He betrayed his oath as a police officer and cast a dark shadow over the outstanding work done by the fine law enforcement professionals who serve our communities. Such egregious civil rights violations will not be tolerated."

On Friday, Menocal was granted an act of blue privilege that likely made his victims physically ill. In a last minute plea deal before U.S. District Judge Kathleen M. Williams, Menocal admitted his crimes - at least some of them. He admitted that he kissed a victim and caused her to touch his exposed penis; had a second victim, who was in psychiatric crisis, perform oral sex on him; and coerced a third victim, who was walking alone at night, into submitting to oral and vaginal sex.

A fourth victim who wasn't even tied to the offenses for which he pleaded guilty was also mentioned. In that case, Menocal admitted to bringing a fourth female into a Hialeah Police Department building and ordering her to remove her shorts and underwear, causing her to expose her buttocks to him. She was just 17.

Menocal admitted that he was on-duty and in uniform during all of these acts, abusing his official authority.

In fact, in 2019, a report from the Miami Herald found that Menocal brought another eight women and girls into a Hialeah police station without filing any reports, a violation of department procedure. Instead of being arrested at the time, Menocal was given a promotion and a raise.

The statements released from the prosecutors, though fiery, rang hollow given Menocal's sweetheart plea deal and years of blue privilege.

"We will not stand by idly when law enforcement officials abuse their power and position to sexually exploit and harm women," said Assistant Attorney General kristen clarke of the Justice Department's Civil Rights Division. "The Civil Rights Division will continue to vigorously investigate and prosecute government officials who use the power of their office to sexually abuse and harm vulnerable people in their communities. We hope that this conviction sends a strong message to survivors of law enforcement sexual misconduct, that their allegations will be investigated and taken seriously."

Apparently, this "strong message" means that cops who rape the citizens they are tasked with protecting, will likely get off scot free or face little more than a slap on the wrist.

According to federal court records, Menocal was originally indicted on three counts of depriving a person's rights under the color of law - felonies.

Jude Faccidomo, Menocal's attorney, told reporters that this plea deal knocks down the felonies to misdemeanors so his client won't even be subject to sex offender registration laws. And instead of decades in prison he now faces a maximum of just 1 year per count, for a total of three years.

"Jesse made a decision today as a father and as a son to put this case behind him," Faccidomo told reporters on Friday. "The government prosecuted this case very aggressively and spared no expense. They employed some of their top tactics and skills. They decided to dismiss the felony counts, and Jesse pleaded to misdemeanors. Again, this means he can get on with his life."

"Jesus Menocal is a predator who disgraced the badge he once wore by using his status as a police officer to sexually abuse women," said Assistant Special Agent in Charge John J. Bernard of FBI Miami. "His actions are depraved and serve only to diminish the hard work and professionalism of the vast majority of South Florida law enforcement officers who follow their oath of office and whose conduct is above reproach."

The complaint also alleges that Senate Bill 1 harms those voters by "barring their assistors from providing necessary help, including answering basic questions, responding to requests to clarify ballot translations or confirming that voters with visual impairments have marked a ballot as intended."

The complaint also contends that Senate Bill 1 violates Section 101 of the Civil Rights Act of 1964 by "requiring rejection of mail ballots and mail ballot request forms because of certain paperwork errors or omissions that are not material to establishing a voter's eligibility to cast a ballot."

The complaint asks the court to prohibit Texas from enforcing these requirements.

Greenbelt, Maryland - A federal grand jury has returned an indictment charging former Fairmount Heights Police officer, Martique Cabral Vanderpool, age 32, of Fairmount Heights, Maryland, for deprivation of civil rights under color of law, for allegedly sexually assaulting a woman he arrested after a traffic stop. The indictment was returned on September 8, 2021.

The indictment was announced by Acting United States Attorney for the District of Maryland Jonathan F. Lenzner; Assistant Attorney General kristen clarke of the Department of Justice's Civil Rights Division; Special Agent in Charge Thomas J. Sobocinski of the Federal Bureau of Investigation, Baltimore Field Office; and Chief Malik Azziz of the Prince George's County Police Department.

According to the single-count indictment, on September 6, 2019, Vanderpool arrested a 19-year-old female after a traffic stop. Vanderpool allegedly deprived the woman of the right to be free from unreasonable seizure by a person acting under color of law, which includes the right to be free from unwanted sexual assault by a police officer.

The indictment alleges that Vanderpool transported the victim to the Fairmount Heights police station, where he sexually assaulted her. The indictment also alleges that the civil rights violation included: kidnapping; the use, attempted use, and threatened use of a firearm; and aggravated sexual abuse and attempted aggravated sexual abuse of the victim.

If convicted, Vanderpool faces a maximum sentence of life in federal prison Actual sentences for federal crimes are typically less than the maximum penalties. A federal district court judge will determine any sentence after taking into account the U.S. Sentencing Guidelines and other statutory factors. Vanderpool will have an initial appearance scheduled in U.S. District Court in Greenbelt at a later date.

An indictment is not a finding of guilt. An individual charged by indictment is presumed innocent unless and until proven guilty at some later criminal proceedings.

The second guidance document, entitled "Federal Law Constraints on Post-Election Audits," provides information on the how states must comply with federal law when preserving and retaining election records and the criminal penalties associated with the willful failure to comply with those requirements. This guidance document also details the statutes that prohibit the intimidation of voters and the department's commitment to act if any person engages in actions that violate the law.

Transgender: White House to Denounce GOP Child-Protection Laws

White House officials will stage an event on Wednesday to denounce the popular state bills that are being passed to protect children and athletes from pro-transgender activists, teachers, and Democrats.

The event will "highlight the hopes, joys, and success of young transgender and nonbinary people across America," said a June 29 report from LGBTQnation.com.

But Biden "is throwing our women and girls under the bus," responded Terry Schilling, the president of the American Principles Project. He told Breitbart News:

The fact that they are hosting an event where they are weaponizing gender-confused children against women's rights is downright evil. I never thought I'd miss having President Obama, but at least he only sued Catholic nuns and didn't go after all of our girls. President Biden is a disgrace.

The report said the White House will use the June 30, 7:00 p.m. event to portray the establishment-backed, lavishly-funded, media-backed, pro-transgender child activists as the victims of the GOP's popular child protection laws.

The convening is specifically focused on transgender youth and how systemic discrimination affects their daily lives.

"Young transgender and gender nonbinary leaders from across the country will share stories about the impact that state-level anti-transgender legislation has had on their wellbeing, their experiences of multiple, intersecting forms of discrimination, and best practices for advancing acceptance and equality for transgender people," the White House said.

Education Secretary Miguel Cardona, Assistant Secretary for Health Dr. Rachel Levine, and Assistant Attorney General kristen clarke will join Psaki along with transgender athletes and elected officials.

The report did not say the White House invited any supporters of women's rights to speak at the event.

An increasing number of girls and women are pushing back against the transgender ideology after watching other girls and women being pushed off award podiums by males posing as women, or being forced to share cells with violent men who insist they are women.

Brian Kemp, Brad Raffensperger Blast DOJ Lawsuit Against Georgia Election Integrity Law

Georgia Gov. Brian Kemp and Secretary of State Brad Raffensperger pushed back quickly on Friday to the Department of Justice announcement earlier in the day that it had filed a lawsuit against the State of Georgia, Secretary of State Raffensperger, and the Georgia State Election Board in federal district court alleging the intended purpose of the state's Election Integrity Act of 2021 is to disenfranchise black voters, a violation of Section 2 of the Voting Rights Act.

"This lawsuit is born out of the lies and misinformation the Biden administration has pushed against Georgia's Election Integrity Act from the start," Kemp said in a statement released on Friday:

Greg Jarret, legal analyst for Fox News, said the DOJ's 46-page complaint is long on historical rhetoric and short on supporting empirical evidence. Consequently, they argue, the Biden administration's chances of winning the case are a longshot.

The key premise of the DOJ lawsuit is that the intent of the Georgia law is to discriminate against black voters.

"The right of all eligible citizens to vote is the central pillar of our democracy, the right from which all other rights ultimately flow. This lawsuit is the first step of many we are taking to ensure that all eligible voters can cast a vote; that all lawful votes are counted; and that every voter has access to accurate information," Attorney General Merrick Garland said in a statement released by the DOJ on Friday:

"The right to vote is one of the most central rights in our democracy and protecting the right to vote for all Americans is at the core of the Civil Rights Division's mission," said Assistant Attorney General kristen clarke for Justice Department's Civil Rights Division. "The Department of Justice will use all the tools it has available to ensure that each eligible citizen can register, cast a ballot, and have that ballot counted free from racial discrimination. The Senate confirmed kristen clarke to head the Justice Department's Civil Rights Division with only one vote from Sen. Susan Collins (R-ME).

clarke was confirmed as the first black woman to run the Civil Rights Division with a close 51-48 vote Tuesday afternoon. Sen. John Kennedy (R-LA) did not vote. Senate Majority Leader Chuck Schumer (D-NY) reportedly called this vote "particularly poignant and appropriate" as it came on the one-year anniversary of the death of George Floyd.

Vice President Kamala Harris had sworn clarke on Tuesday evening as the assistant attorney general for civil rights.

Previously, her nomination was stuck in the Senate Judiciary Committee with a split 11 to 11 vote. Under the provisions of S. Res. 27, Schumer reached into the committee and filed a discharge motion for her nomination to place a vote in the full senate. The motion in the Senate to discharge clarke's nomination from the Judiciary Committee was voted on by a 50-48 margin.

Democrats have praised voting for clarke, saying her two-decade-long career as a civil rights attorney made her uniquely qualified to lead a unit.

Chairman of the Senate Judiciary Committee Dick Durbin (D-IL) previously released a statement supporting clarke, saying she is "the right person to restore credibility to the Civil Rights Division." He also added, "at this moment in history, our country needs her combination of expertise, experience, skills, and thoughtfulness to ensure the Civil Rights Division will again work for all Americans."

The Republicans in the Senate had great opposition to her confirmation. On the eve of her confirmation vote, Senate Minority Leader Mitch McConnell took to the Senate floor calling clarke unfit for the Justice Department due to her past far-left comments. He argued clarke will be working in the Justice Department but has argued Americans "must invest less in police."

McConnell had continued to bring light the time at Harvard in which she "invited, welcomed, introduced, and then defended a famously antisemitic guest speaker who had authored a book literally entitled - now listen to this - The Jewish Onslaught," he said.

Tuesday, Sen. Ted Cruz (R-TX) released a statement saying, "Let me be clear: kristen clarke is completely unfit to serve as Assistant Attorney General for the Civil Rights Division." He added that "clarke is one of the most radical nominees ever put forward for any position in the federal government, and today Democrats have voted to give her a top position at the Department of Justice."

Dems Hosted Ex-Black Panther Implicated in Torture for Event Where Panelists Praised Cop Killers

Black Panthers accused of torture compared their movement to Black Lives Matter

Three Democratic lawmakers hosted a forum earlier this month where several convicted cop killers were hailed as political prisoners. The event featured a former Black Panther implicated in the torture of a member suspected of being a police informant.

Speakers at the May 10 forum, hosted by Reps. Steve Cohen (D., Tenn.), Bobby Rush (D., Ill.), and Barbara Lee (D., Calif.), praised Mumia Abu-Jamal, Mutulu Shakur, H. Rap Brown, and other black liberationists who are all serving life sentences for killing police officers. The topic of the event was COINTELPRO, the FBI program that tracked black separatist groups in the 1960s and 1970s.

The defense of the cop killers comes as Democratic leaders are trying to downplay the perception that the party is anti-police. Some congressional Democrats have supported defunding police departments in the wake of high-profile deaths of minorities during interactions with police. kristen clarke, who was confirmed this week to lead the Justice Department's civil rights division, penned an essay last year in which she supported defunding the police. She also moderated a conference in 1999 where Abu-Jamal and other cop killers were touted as political prisoners.

Lee introduced perhaps the most controversial speaker at the event, former Black Panther leader Ericka Huggins. Lee, who worked closely with the Black Panthers as an Oakland community activist in the 1970s, referred to Huggins as her "former colleague and comrade."

Huggins and another forum speaker, Black Panther Party cofounder Bobby Seale, were charged in 1970 with the murder of Alex Rackley, a party member suspected of snitching to the police. Rackley was tortured on May 18, 1969, at a Black Panther hideout in New Haven, Conn. He was fatally shot and dumped in a river two days later. Huggins and Seale were accused of ordering the hit on Rackley, who was 19 years old.

While the case was dropped against Huggins and Seale after a jury failed to reach a verdict, a tape recording introduced at their trial revealed that Huggins was present while Rackley was being tortured. Black Panthers beat Rackley with sticks and poured boiling water over him to force him to confess that he was a police informant, according to contemporaneous news reports of the trial.

The Washington Post reported in a 1977 retrospective of the case that Huggins admitted to boiling the water poured on Rackley, verbally abusing him and kicking him while he sat tied to a chair.

Huggins's lawyer claimed at her trial that she was pressured into taking part in the interrogation and that she played no role in his death.

Lee and her Democratic colleagues did not mention Rackley's murder at the hands of Black Panthers. But Lee hailed Huggins as an example of the strength of leadership of women in the Black Panther Party. She said it was "mind-boggling" to her that Black Panthers were harassed, assaulted, and killed by police.

Huggins, who did not respond to the Washington Free Beacon's request for comment, told the Guardian in 2015 that she stayed with the party for another decade after the Rackley murder because she was "committed to the party, not to orchestrations of the FBI." Huggins, who refers to herself as a "former political prisoner" on her personal website, has forged a career in academia since leaving the Panthers.

Huggins did not discuss the Rackley affair during her remarks at the forum. She instead criticized unspecified "forces" that she said are spreading disinformation about the Black Lives Matter movement. She said that, like modern-day activists, the Black Panthers' goal was "to help create a just and equitable world."

The Democrats also did not rebuff two other speakers who claimed that a group of black liberation activists convicted of killing police officers were political prisoners.

One speaker, Akua Njeri, called for the release of Abu-Jamal and Brown, referring to them as "political prisoners, prisoners of war, prisoners of consciousness." Nkechi Taifa, a civil rights activist, lamented that the cop killers had not received parole even though they are all in their 70s and 80s.

Abu-Jamal, a former Black Panther, was sentenced to death for the 1981 murder of Philadelphia police officer Daniel Faulkner. He has become a martyr of sorts for left-wing activists, who claim he was given an unfair trial.

Biden Nominee Denied Working With An Anti-Semitic Poet, But An Academic Journal Shows Otherwise

Justice Department nominee kristen clarke said while under oath she didn't work with an anti-Semitic poet, though she was listed as an assistant editor for the same scholastic journal as the poet for several years. clarke said she never worked with poet and political activist Amiri Baraka despite being named an assistant editor for a scholastic journal that listed Baraka as a contributing editor in 1999 and 2000, according to the journal's archives, first reported by The Washington Free Beacon. Baraka was known as a black nationalist and Marxist and was criticized for anti-Semitic lines in his poem "Somebody Blew Up America" after the Sept. 11 terror attacks, The New York Times reported in his 2014 obituary. Republican Sen. Mike Lee questioned clarke's relationship with Baraka as a supplement to her April 14 confirmation hearing, the Free Beacon reported. Lee asked Clark if she was ever "on the editorial staff of a journal with Amiri Baraka" to which she replied '"no."'

clarke was listed as an associate editor of the scholastic journal Souls, A Critical Journal of Black Politics, Culture, and Society for two years along with Baraka, who was named as one of 25 contributing editors. She also shared Baraka's essay "Mumia, 'Lynch Law' & Imperialism" which compared law enforcement officers to Klu Klux Klan members with one of her mentors in June 1999, the Daily Caller News Foundation reported. Baraka's work was criticized for including anti-Semitic, racist, isolationist, homophobic and militant content, the Times reported. In "Black Art" he wrote, "we want ... dagger poems in the slimy bellies of the owner-jews." "Who put the Jews in ovens, and who helped them do it Who said 'America First' and ok'd the yellow star," Baraka wrote in "Somebody Blew Up America." He included that Israel knew of the Sept. 11 attacks beforehand and told 4,000 Israeli workers to stay home from work that day, though the statement was found to be a baseless conspiracy theory.

clarke was criticized over other possible misrepresentations during her Senate confirmation, the Free Beacon reported. She penned a letter to The Harvard Crimson editor about "melanin theory" of black racial superiority in November 1994 which she claimed was satirical during her hearing. "Melanin endows Blacks with greater mental, physical and spiritual abilities-something which cannot be measured based on Eurocentric standards," clarke said in her letter, according to The Harvard Crimson. Staff members of Harvard's school paper called clarke's letter "outrageous" and accused her of "bigotry." The newspaper staff said they "searched in vain for a hint of irony in clarke's letter" without success. clarke told the Crimson "she doesn't 'necessarily' believe her assertions," though the staff said, "she has given us every indication that she does." The paper called for clarke's resignation if she did not retract her statements and publicly apologize for them. clarke did not immediately respond the Daily Caller News Foundation's request for comment.

Biden nominee for DOJ post pushed essay comparing cops to KKK

President Joe Biden's nominee to lead the Justice Department's civil rights division circulated an essay from self-proclaimed Marxist poet Amiri Baraka defending cop killer Mumia Abu-Jamal and referring to police officers as members of the Ku Klux Klan, according an email from her days at Columbia University.

kristen clarke forwarded the Baraka essay in an email on June 25, 1999, to her mentor, the late historian Manning Marable.

She suggested that the essay, entitled "Mumia, 'Lynch Law' & Imperialism" be placed in a magazine Marable edited and used for a panel on the death penalty.

"Here is a piece for the magazine & the panel 3 Race and The Death Penalty," clarke wrote to Marable.

The email was obtained by the American Accountability Foundation, a conservative advocacy group founded by two former Republican Senate staffers. The foundation, which has published other materials about clarke on its website, BidenNoms.com, says that the email is from Marable's academic archives at Columbia University.

clarke studied under Marable at the time she sent the email. She contributed to a journal on black studies that Marable founded and helped the historian organize academic conferences for his Institute for Research in African-American Studies.

The American Accountability Foundation has published other documents showing that clarke helped organize a conference with Marable in 1999 where Mumia Abu-Jamal, Assata Shakur and other convicted cop killers were hailed as "political prisoners."

clarke testified at her Senate confirmation hearing last week that she was unfamiliar with the Abu-Jamal and Shakur cases and that she only provided logistics for Marable's conference.

"I am not familiar with their cases, I've never worked on those matters," clarke said in her confirmation hearing.

"I was not the organizer of that conference, but I provided logistical support as a student at that time."

clarke's handling of Baraka's article about Abu-Jamal suggests she had some familiarity with the convicted murderer's case. It also suggests that she thought the material was acceptable for publication in a journal and for use at an academic conference.

Texas Sen. Ted Cruz responded to the document posted by the American Accountability Foundation, saying it shows that clarke is a "radical" nominee.

"I've been sounding the alarm about just how radical Biden's pick for DOJ kristen clarke is," he tweeted.

In his essay, Baraka said that police officers and judges are the modern equivalent of the Ku Klux Klan.

"The Klan is now the Police, with Blue uniforms replacing the sheets and hoods. The corrupt racist Judges, are petty Klan administrators," Baraka wrote in the essay.

He also asserted that Abu-Jamal was "being held hostage."

"Mountains of evidence and testimony show clearly that Mumia is another Black scapegoat, another Lynch victim."

"The rulers want to show us what will happen if we mobilize and mount full scale attack on Imperialism as Mumia did as part of the Black Panther party as a sector of The Black Liberation Movement," Baraka also wrote in the essay shared by clarke.

Abu-Jamal, a former Black Panther, was sentenced to death row in 1982 for the murder of Daniel Faulkner, a Philadelphia police officer.

His case became a cause célèbre for left-wing activists who believe he was unfairly convicted.

Baraka, who died in 2014, had a lengthy history of making anti-white, anti-Semitic and homophobic statements. Most American white men are trained to be fags," he wrote in a 1965 essay. "Smile, jew. Dance, jew. Tell me you love me, jew," Baraka wrote in one poem cited by The New York Times in his obituary. "I got the extermination blues, jewboys. I got the hitler syndrome figured." clarke's organization, the Lawyers' Committee for Civil Rights Under Law, did not respond to a request for comment about the email or whether she supports Baraka's rhetoric. If confirmed, clarke will oversee an investigation just opened into the Minneapolis police department in the wake of the conviction of Derek Chauvin.

In 2019, clarke criticized the Chicago police department for seeking access to the cell phone of actor Jussie Smollett, who claimed he was attacked by two white Trump supporters. Smollett was later charged with filing a false police report. Two men, both black, told police that Smollett paid them to stage the attack.

Left-Wing Jewish Groups Defend Justice Department Nominee Accused of Anti-Semitism

kristen clarke hosted an anti-Jewish conspiracy theorist at Harvard

Left-wing Jewish groups are defending embattled Justice Department nominee kristen clarke against charges of anti-Semitism related to an event she sponsored for an anti-Jewish conspiracy theorist.

The National Council of Jewish Women and other groups say those accusing clarke of anti-Semitism are misrepresenting her record. This defense is unusual for the NCJW, which has traditionally been vocal in opposing nominees for past views. clarke, who President Joe Biden tapped to lead the department's civil rights division, will appear before the Senate Judiciary Committee on Wednesday.

The battle over clarke's record comes amid a broader debate over the Biden administration's commitment to Israel. Secretary of State Antony Blinken announced the resumption of tens of millions of dollars in aid for Gaza and the West Bank on April 7 that will likely benefit the Palestinian Authority.

As an undergraduate at Harvard University in 1994, clarke hosted an event with Wellesley College professor Tony Martin. Just one year earlier, Martin published a book called The Jewish Onslaught, which purported to show the global slave trade was controlled by Jews. The book accused Jews of attacking black scholars and undermining community leaders. A majority of Martin's faculty colleagues condemned the book as anti-Semitic.

clarke invited Martin in her capacity as president of the Black Students Association. The decision deeply divided the campus and was covered at length in the campus newspaper, the Harvard Crimson. A letter to the editor from a Jewish student, Martin Lebwohl, who attended the event noted that Martin "lavished praise" on clarke "who, he said, had courageously invited him 'in the face of enormous pressure from the forces of reaction.'"

In addition to the National Council of Jewish Women, clarke has received support from the American Jewish Congress and the Union for Reform Judaism. Writing in defense of clarke in February, NCJW CEO Sheila Katz said calling clarke to account for decisions she made in college is proof of a double standard for nominees of color.

"Black women in our country too often get disproportionate criticism and harmful backlash for the same actions or behaviors that would be overlooked from white and male colleagues," Katz wrote.

The argument is atypical for the usually vocal organization. The NCJW opposed at least two of former president Donald Trump's judicial nominees, one of whom was a woman of color, in light of statements they made in college.

Ryan Bounds was made to withdraw his nomination for the Ninth U.S. Circuit Court of Appeals in 2018 after the NCJW publicized opinion columns he wrote about campus race issues as an undergraduate at Stanford University. The columns generally derided campus multicultural initiatives and criticized campus affinity groups in hyperbolic terms. Bounds withdrew after Sens. Tim Scott (R., S.C.) and Marco Rubio (R., Fla.) decided to oppose his confirmation.

Biden DOJ Pick Reportedly Organized Controversial Conference 'Championing Cop Killers'

kristen clarke has been chosen by the Biden administration to head the Department of Justice's (DOJ) Civil Rights Division as assistant attorney general in January, along with Merrick Garland who was nominated for the post of the US Attorney General at the time.

Biden's DOJ nominee, kristen clarke, is claimed by the American Accountability Foundation (AAF) to have organised a 1999 university conference that gathered supporters of the idea of releasing people convicted for killing police officers and other death-row criminals, Fox News reported on Friday, citing the free-market group.

clarke was allegedly one of the organizers behind the Race-ing Justice Conference during her studies at Columbia Law School in April 1999.

The AAF said it obtained a transcript of the conference, which allegedly shows that clarke was the organizer.

"Let me begin by acknowledging the work of Manny Marable and kristen clarke who drew us all together," said conference speaker and author, Ashe Bandele, during the conference, according to the reported transcript.

According to the report, the conference was a gathering of "left-leaning students and anti-government activists" who stood for freeing death row inmates they believed were "political prisoners".

Among such inmates are convicted cop-killers Mumia Abu-Jamal, Mutulu Shakur, Sundiata Acoli and Assata Shakur - the latter, particularly, has been on the FBI's Most Wanted Terrorists list since 2013, the first woman to appear. Alongside Acoli, Shakur was convicted for murdering a New Jersey state trooper in 1973.

The participants of the conference, repeatedly described the above-mentioned criminals as "political prisoners". Among the speakers were City College of New York professor Herb Boyd and founder of the Free Mumia Abu-Jamal Coalition, Safiya Bukhari.

"I think we need to extend that definition [of political prisoners] to include, you know, a number of particularly Puerto Rican, African American political prisoners that we have - most particularly Sundiata Acoli, they talk about Sekou Odinga, we have the situation where Susan Rosenberg and you know Sylvia [Blyden], of course [Mumia Abu-Jamal] and hopefully many of you will be on your way to Philadelphia tomorrow to participate in that situation," Boyd is reported to have said during the conference.

Bukhari, according to the report, described herself as a "prisoner of war" and downplayed the events of the Holocaust, saying it "was only 6 million Jews killed in the camps and prisons of Germany and Poland."

Ashe Bandele, another conference speaker who allegedly referred to clarke as an organiser, compared the prisoners with late South African President Nelson Mandela.

"And I'm trying to figure out how we get to do that with our own Mandelas right here, [Sundiata Acoli, and Sekou Odinga, Mutulu Shakur]," said Bandele, according to the transcript.

Judge Merrick Garland received a hero's welcome from the Democrats on the Senate Judiciary Committee on Monday. Several noted how thrilled they were to see him testifying in a confirmation hearing - as they had hoped in 2016, when Garland was nominated to fill the late Justice Antonin Scalia's seat on the U.S. Supreme Court.

But Garland's testimony - shaky at times, radically left-wing at others - made clear that America dodged a bullet when Republicans blocked him.

Garland is no "moderate." He is a standard-issue left-liberal, ready to follow the lead of the radicals who have taken over the Democratic Party.

It was both sad and amusing to see him attempt to define the term "systemic racism." First, he said it meant "discrimination and widespread disparate treatment of communities of color and other ethnic minorities in this country." He listed several examples - all of which showed economic inequality, without showing "disparate treatment."

Pressed further by Sen. John Kennedy (R-LA), who noted that Garland's definition looked more like "disparate impact" than any act of deliberate racial discrimination, Garland said that such difference "in some cases is the consequence of historical patterns, sometimes the consequence of unconscious bias."

Kennedy challenged him: "When you were at the Department of Justice, was the Department of Justice then systemically racist?" All he could do was dodge the question.

Another question he evaded was the yes-or-no query posed by Sens. Chuck Grassley (R-IA), Tom Cotton (R-AR), and Ted Cruz (R-TX): should Special Counsel John Durham be kept in his job? And would Garland commit to publishing Durham's report, when it emerged?

All three noted that Attorney General William Barr had said "yes" when asked the same about Special Counsel Robert Mueller. But Garland refused to be pinned down, saying he needed to know more.

In so doing, Garland endorsed a clear double standard: an inquiry into President Donald Trump had to be protected, but one that could implicate Democrats - including President Joe Biden himself - could be dismantled.

Likewise with his ludicrous attempt to differentiate between the left-wing riots against the federal courthouse in Portland, Oregon, and the recent Capitol riot. The former riots might not be "domestic terrorism," he suggested, because they took place after hours.

So much for Judge Garland's high-minded statements about keeping politics out of the Department of Justice.

After his admirable statements about prosecuting white supremacists, he defended kristen clarke, nominated to lead the Civil Rights Division, despite questions about her alleged racist and antisemitic views. He struggled to assure Sen. Mike Lee (R-UT), who questioned him about clarke, that the Department of Justice would protect conservatives' rights, too.

That will continue to be a tough sell, after Garland appeared to support Democrats' interest in drafting new laws to limit free speech online.

He also attempted to evade a question about transgenderism being imposed on school sports, and declined to say if crossing the U.S. border illegally should remain a crime. He pleaded ignorance when asked his view of the Department of Justice giving big grants to left-wing activist groups. He said he would consider the issue - later, after he was confirmed.

What Monday's hearing proved was that the previous hype about Garland being a "moderate" was completely empty. At the very least, he is willing to go along with the most left-wing agenda ever brought into government in the United States.

That has dangerous implications, when the ruling party is itching to criminalize its opposition. But we can take comfort in at least one thing: Judge Merrick Garland is not a Supreme Court Justice. What a disaster that would have been

Biden Justice Department Pick Opposed Enforcing Civil Rights Laws Against Blacks

The incoming Justice Department civil rights chief has a history of opposing civil rights prosecutions of black defendants, opposing a complaint against an African-American Democratic leader who discriminated against white voters.

As an NAACP lawyer, kristen clarke lambasted the Justice Department for bringing a complaint against an African-American party boss in Mississippi who worked to suppress white votes, according to a federal probe. On a separate occasion, a federal oversight commission investigated claims that clarke worked with allies at the Justice Department to quash the prosecution of the Black Panthers who menaced voters outside a Philadelphia precinct in 2008.

clarke's nomination to an influential Justice Department post will test the Biden administration's commitment to "equity-based" policy making, which purportedly promotes racial justice by giving special attention to marginalized groups. clarke's professional history suggests a staunchly ideological approach to civil rights enforcement where touchstone civil rights laws are applied to advantage some demographic groups but not others.

clarke made waves in 2007 as an outside critic of the Justice Department's civil prosecution of a corrupt party leader in Mississippi. A federal judge found that the leader, Ike Brown, violated the Voting Rights Act by suppressing white votes in a rural Mississippi county where whites are the minority. He was found to have pushed election workers to count deficient absentee ballots from blacks but disqualify ballots from whites with the same problems and held rigged caucuses in the homes of friends and supporters.

Then legal director of the NAACP's Legal Defense Fund, clarke opposed the Justice Department's decision to prosecute him, according to 2010 testimony from Justice Department official Christopher Coates before the U.S. Civil Rights Commission.

Coates described a 2008 meeting with clarke in which she "spent a considerable amount of time criticizing the division and the voting section for bringing the Brown case," and identified clarke as part of a coterie of civil rights litigators who "believe incorrectly but vehemently that enforcement of the protections of the Voting Rights Act should not be extended to white voters but should be extended only to protecting racial, ethnic, and language minorities."

Unanswered questions also linger over clarke's role in the Justice Department's abrupt retreat from the 2009 prosecution of two uniform-clad Black Panthers intimidated voters and poll workers outside a Philadelphia voting precinct. An internal Justice Department report said that the pair intimated voters, shouted racial epithets, and castigated a black couple serving as poll watchers for the Republican party. One of them carried a billy club.

Federal prosecutors brought a civil complaint against the two Black Panthers in 2009, alleging violations of the Voting Rights Act. The defendants never responded to the complaint-effectively a forfeit-so the government was poised to win its case by default. But on the cusp of victory, in May 2009 the Justice Department dismissed its case against one of the panthers and recommended reduced sentencing for the other.

USCCR began investigating her involvement following a press report that she was in touch with DOJ lawyers about the case.

In a deposition before the Civil Rights Commission the following year, clarke acknowledged contact with two Justice Department lawyers about the case but denied those contacts were substantive. Coates, the Justice Department official, revealed a third alleged contact, testifying in September 2010 that clarke approached one of his subordinates about the case in 2009.

Wayne County Reverses Decision, Certifies Disputed Election Results as Video Goes Dark

Wayne County, Michigan, canvassers reversed course late Tuesday night and voted to certify the results from the November 3 election, which have been disputed.

The Board of Canvassers had originally voted 2-2 along party lines. The tie meant the election results were not certified.

But later into the night, the Republican canvassers flipped and voted with the Democrats, while the live video stream was down.

"After hours of angry responses from Wayne County residents, the change in course was approved by the two Republican and two Democratic canvassers with the demand that the Secretary of State's office conduct a 'comprehensive audit' of precincts with unexplained out-of-balance tallies," the Detroit News reported.

It is not clear if the approval was conditional on the "comprehensive audit," or if the investigation was merely requested.

The News reported the broadcast of the meeting went about as well as the vote counting on Election Day:

The high-stakes vote, with the eyes of the nation on Michigan's largest county, apparently took place while the video stream for the virtual meeting wasn't working.

"That passed unanimously," Republican member William Hartmann said when the video began functioning again. "We just voted on that."

Moments later, he said, "We're going to adjourn," and the board ended its meeting at 9:08 p.m.

WXYZ said the board "voted to certify the results under the stipulation that Secretary of State Jocelyn Benson does a comprehensive audit of the election in the county."

The Detroit Free Press stated the board "passed a resolution calling on Michigan Democratic Secretary of State Jocelyn Benson to conduct an independent comprehensive audit of all of the jurisdictions in the county that recorded unexplained discrepancies between the number of absentee ballots recorded as cast and the number of absentee ballots counted."

The Republican canvassers caved after withering attacks from Democrat activists.

Ned Staebler, whose Twitter profile said he lives in Ann Arbor - not even in Wayne County - assailed the two Republicans on the board:

"Just know when you try to sleep tonight, that millions of people around the world now on Twitter know the name Monica Palmer and William Hartmann," he said, referring to the two Republican canvassers, "as two people completely racist and without an understanding of what integrity means or a shred of human decency. The law's not on your side. History won't be on your side, he declared."

Victory! Public pressure matters.

The Wayne County Board of Canvassers has reversed course and unanimously agreed to certify the results (upon the condition that the Sec'y of State's office conduct an audit of precincts across the county).

With the certification by Wayne County, the results will now move to the State Board of Canvassers, which also has two Republicans and two Democrats as members.

Over 100 observers have filed affidavits related to the vote counting process in Detroit. Several individuals have alleged ballots being counted multiple times, ballots arriving in the dead of night, and observers being blocked from watching the tabulation process.

claims that cause confusion about the established laws, regulations, procedures, and methods of a civic process, or about the actions of officials or entities executing those civic processes."2 Twitter may temporarily lock accounts for violations of its Civic Integrity Policy or permanently suspend offending users for severe and repeated violations.3

In the last day, President Trump has used Twitter's platform, in violation of Twitter's Civic Integrity Policy, to repeatedly broadcast false claims about the 2020 election - including, but not limited to:

? Claiming victory "for Electoral Vote purposes" the states of Pennsylvania, Georgia, and North Carolina, when no such claims have been made by state officials.4
? Amplifying unproven assertions regarding "a large number of secretly dumped ballots."5
? Alleging the unauthorized deletion and/or addition of votes,6 unsubstantiated claims which would constitute a felony violation of federal election law.7
? Spreading a debunked8 claim that 128,000 new votes spontaneously appeared in Michigan.9

President Trump has also used Twitter's platform to openly call for election interference by falsely claiming that any ballot received after Election Day will not be counted.10 This is in direct violation of Twitter's Civic Integrity Policy, prohibiting misleading claims that cause confusion about established laws regarding our civic process. In the past, Twitter has suspended the accounts of foreign and domestic actors for making similar false claims.

We note that this conduct is not new but follows his repeated abuse of the platform to spread misinformation throughout the election and the COVID-19 pandemic. Particularly, Twitter has repeatedly taken action against President Trump's claims about security of mail-in balloting, which millions of voters relied on to cast their ballots safely this year.

Each of the above examples clearly and intentionally violates Twitter's policy. If Twitter's rules are to have any meaning, they must be enforced, and we would expect any other Twitter users who repeatedly and deliberately violated Twitter's terms of service in this manner would also have their account locked.

President Trump's continued use of Twitter's platform to spread disinformation may incite the public in ways that could prove harmful to public safety, if it has not done so already.11

We fear that, in the absence of action by Twitter, the President may be successful in his goal of delegitimizing the integrity of our democratic processes for many, and not just Twitter users but other voters and members of the public, sowing uncertainty about the voting and elections process, and potentially inciting violence against civil servants or others.

Even a twelve hour pause today would provide a cooling period to recognize the multiple violations identified above. The intensity and frequency of these violations suggests that President Trump will continue to use Twitter's platform to promote disinformation in the period ahead.

Furthermore, Twitter's present remedy to his repeated violations of the Terms of Service - limiting his posts' organic reach and applying a disclaimer - are insufficient. President Trump's posts to the platform are quickly noticed regardless of their level of engagement.

We understand the difficult situation Twitter finds itself in as it works to balance the newsworthiness of a public figure's use of the platform, and the potential threats to democracy and public safety from its unfettered use. We believe that, particularly in the next 24-48 hours, the balance must be weighted towards the free, fair, and transparent operation of our civic processes.

"By Design" and a "Test Run for November" - Georgia Chaos Is Blueprint for November Election

Georgia is shaping up to be an unlikely battleground state in the November presidential election, and if Trump loses Georgia, his chances of overall victory are slim.

Chaos and dysfunction ruled yesterday, as Georgians went to the polls amid a pandemic that has already claimed over 2,000 lives in the state. Within minutes, many of the state's new voting machines had crashed, resulting in massive waits for voters - up to four and a half hours in some localities. June temperatures topped 90 degrees, with many forced to stand in line until after 11 p.m. to cast their ballot. Mayor of Atlanta, Keisha Lance Bottoms, issued a plea to voters to persevere through the difficulties. "If you are in line, PLEASE do not allow your vote to be suppressed. PLEASE stay in line. They should offer you a provisional ballot if the machines are not working," she wrote, but paper ballots also ran out in some places.

Postal voting had its problems, too. Even Stacey Abrams, tipped by many to be Joe Biden's running mate in November, could not use her absentee ballot as the envelope arrived sealed shut. Another problem encountered was the lack of trained staff at stations. The average age of a poll worker in Georgia is 70, and concerns over working in an enclosed public space in the middle of a pandemic that particularly affects the elderly doubtless kept many away.

Or at least that was the situation in many of the poorer neighborhoods of the state, where the population is often predominantly black. In the affluent white suburbs of Atlanta, reports suggest the day went ahead without major incidents. Georgians were voting for district, state and national representatives, although the latter is more of a formality for both Democrats and Republicans. kristen clarke, president of the group the Lawyers' Committee for Civil Rights Under Law, described the situation as catastrophic. "If we view the primary election as a dry run for November, then Georgia gets an F today," she said.

But others saw the situation differently: not as an error, but as a well-planned triumph of election malfeasance. In response to the scenes of long lines and frustration, Congresswoman Alexandria Ocasio-Cortez stated that "Republicans don't want vote by mail because it chips away at their ability to do exactly this: target and disenfranchise black voters and people of color. These scenes are specifically happening in black communities, not white ones," she said, "This is by design and it's their test run for November." Pramila Jayapal, co-chair of the Congressional Progressive Caucus agreed, "This is no accident. Black and brown people have been kept out of our elections - 100% on purpose and by design," she wrote. Amid the fiasco, the state's (Republican) Attorney General has opened up an investigation, while calls for the United Nations to monitor the elections in November are growing louder.

WASHINGTON - Presidential elections are typically prime time for bringing new people into the political process, but the coronavirus pandemic is making voter registration more difficult than ever, prompting concerns that many young Americans and other nonvoters might miss their chance to get onto the rolls before November.

"This is the moment when we historically see people take action to register to vote," said kristen clarke, the president and executive director of the Lawyers' Committee for Civil Rights Under Law. "The public health crisis has brought all of that activity virtually to a grinding halt."

Voter registration happens year-round, but the months leading up to a presidential election are crucial as interest in politics spikes and funding for registration efforts flows in.

In the runup to the 2016 presidential election, Americans filed more than 77.5 million voter registration applications, according to the Election Assistance Commission, a federal agency that helps states administer elections, and total registration topped 200 million.

That still left tens of millions of eligible Americans who are not registered to vote. And this year, millions of new Americans will become eligible by turning 18 as Generation Z (born between 1997 and 2012), the most diverse in history, is expected to surpass the silent generation (born between 1928 and 1945) as a share of the electorate."

Reacting to the news that the Trump administration would not ask the citizenship question on the census, Elizabeth Warren quipped at a town hall, "Wow, he's going to follow the law?"
Trump had emphasized his exasperation at the situation earlier in the day at a White House conference focused on social media censorship of conservatives.

"We spend $20 billion on a census," Trump told attendees. "They go through houses, they go up, they ring doorbells, they talk to people. How many toilets do they have? How many desks do they have? How many beds? What's their roof made of? The only thing we can't ask is, are you a citizen of the United States. Isn't it the craziest thing?"
DOJ spokesperson Kerri Kupec told Fox News that Trump's "alternative path" ended the legal fight over the citizenship question.

"The Supreme Court held that Secretary Ross reasonably concluded that including the citizenship question on the 2020 decennial census would provide the most complete and accurate citizenship information, but it invalidated his decision to include that question on other grounds," Kupec said.
She added: "The Department of Justice disagrees with the Supreme Court's decision. Today's Executive Order represents an alternative path to collecting the best citizenship data now available, which is vital for informed policymaking and numerous other reasons. Accordingly, the Department will promptly inform the courts that the Government will not include a citizenship question on the 2020 decennial census."
kristen clarke, the executive director and president of the Lawyers' Committee for Civil Rights Under Law, which has challenged the citizenship question in court, told Fox News she had "grave concerns about the administration's continued dogged pursuit of citizenship information for what appear to be improper, discriminatory and unconstitutional uses."

"There simply was no legally sound basis that would have allowed President Trump to make an end run around the Supreme Court's decision blocking the citizenship question on the Census," clarke said. "By prolonging this battle, the administration has sowed chaos and confusion. … We will use every tool in our arsenal to police the administration should their executive action violate constitutional or legally-protected rights."
The president had said last week that he was "very seriously" considering an executive order to try to force the citizenship question's inclusion.

Earlier Thursday, ABC News first reported that Trump would "back down" from his efforts to add a citizenship question to the 2020 census, and instead would "take executive action that instructs the Commerce Department to obtain an estimate of U.S. citizenship through other means."

Trump's administration has faced numerous roadblocks to adding the question, beginning with the ruling by the Supreme Court temporarily barring its inclusion on the grounds that the government's justification was insufficient. The court challenged the reasoning given that the Justice Department wanted the question to better enforce the Voting Rights Act. Chief Justice John Roberts joined the Supreme Court's four more liberal members in last month's decision and was openly skeptical about that justification.
A federal judge on Wednesday also rejected the Justice Department's plan to replace the legal team fighting for inclusion, a day after another federal judge in Manhattan issued a similar ruling, saying the government can't replace nine lawyers so late in the dispute without satisfactorily explaining why.

Days after the U.S. Supreme Court halted the addition of a citizenship question to the 2020 Census, the U.S. Census Bureau has started the process of printing the questionnaire without the controversial query.

Trump administration attorneys notified parties in lawsuits challenging the question that the printing of the hundreds of millions of documents for the 2020 counts would be starting, said kristen clarke, executive director of the National Lawyers' Committee for Civil Rights Under Law.

Justice Department spokeswoman Kelly Laco confirmed Tuesday there would be "no citizenship question on 2020 census."

Facebook extends hate speech ban to include white nationalism

Facebook announced Wednesday it is broadening its definition of banned hate speech and taking action against white nationalism and white separatism. The social media giant said that those concepts are linked to organized hate groups and, "have no place on our services." Facebook had previously banned posts endorsing white supremacy.

The move comes less than two weeks after a white supremacist live-streamed his deadly attack at a New Zealand mosque. Facebook hopes its new policy will help prevent the promotion of hateful content, reports CBS News' Jeff Pegues.

Starting next week, Facebook and Instagram will ban "praise, support and representation of white nationalism and separatism," saying "it's clear that these concepts are deeply linked to organized hate groups."
"There was a huge gaping hole that allowed violent white supremacists, and neo-Nazis and racists to exploit the Facebook platform," said civil rights attorney kristen clarke.

Self-avowed white nationalists used Facebook to organize the Unite the Right rally in Charlottesville where James Fields ran down and killed a counter-protester in 2017. He pleaded guilty to committing a hate crime Wednesday. Facebook said it has been cracking down on hate speech. Last year, the company says it took action on nearly eight million pieces of content that violated its rules.
"The volume need not stop them from doing their job and doing their part to make sure that they're standing up to hate," clarke said. "It is so critical that we get Facebook and other companies across the tech sector to do their part. We must hold them accountable."

On Wednesday, Facebook acknowledged it needs "to get better and faster at finding and removing hate from our platforms." It says the artificial intelligence it uses to find material from terrorist groups will now be used for a broad range of hate groups.

YouTube and Twitter both say their user agreements also prohibit violent and hateful content.

As part of the settlement, McCarty agreed to assist Dumpson as she sued his two co-defendants, Anglin and Brian Andrew Ade. McCarty must also apologize to Dumpson in writing and on video, which she can then use for "civil rights advocacy, outreach and educational activities," according to the settlement.

McCarty also agreed to undergo anti-hate training and at least one year of counseling, complete four academic classes on race and gender issues and perform 200 hours of community service related to racial justice. Dumpson's legal team will monitor his compliance and will hit him with monetary penalties if he fails to comply, according to The Times.

"What we are doing here is pulling back the veil on online racist trolls," said kristen clarke, president of the Lawyers' Committee for Civil Rights Under Law, which filed the lawsuit on Ms. Dumpson's behalf, according to The NY Times. "For too long, they've been allowed to act with impunity."

Washington (CNN)Immigration and Customs Enforcement and the Department of Justice have gotten a court order for North Carolina to turn over eight years of voter registration records from the state.
The North Carolina board of elections made the subpoena public as part of the materials for a public meeting it is holding Friday, where the request will be considered.
There is little context provided for the request, which is only listed by the board as "Consideration of subpoenas issued by U.S. Immigration and Customs Enforcement via the U.S. Attorney's Office for the Eastern District of North Carolina."
The subpoena asks the state records office to provide "any and all voter registration applications and/or other documents, as identified below, that were submitted to, filed by, received by, or maintained by the North Carolina State Board of Elections from January 1, 2010, through August 30, 2018, within any of the counties in North Carolina."

The list of documents include voter registration forms, absentee ballots, early voting application forms, provisional voting forms, "Admission or Denial of Non-Citizen Return" forms and voter cancellation or revocation forms.

A separate subpoena issued to Pitt County requests poll books, voting records, voting authorization documents and "executed official ballots," including absentees, from August 30, 2013 through August 30, 2018.
It's not clear from the request whether this would apply to every single voter registration that has been filed in those eight years or just the forms that would be used.
The State Board Office provided CNN with what it says is a preliminary estimate of how many records would be involved. For the county ballots, the request could cover more than 2.2 million ballots that are traceable to individual voters, and more than 3.2 million that are untraceable to individuals.
The eight-year records request would cover more than 15 million documents, the state said.
A federal law enforcement official confirmed the request is related to indictments announced in late August, when the Department of Justice and ICE announced they had charged 19 foreign nationals with voting illegally.
That press release noted, "The indictments follow an investigation by U.S. Immigration and Customs Enforcement's (ICE) Homeland Security Investigations (HSI) as part of a newly created Document and Benefit Fraud Task Force (DBFTF) in the Eastern District of North Carolina."

According to the official, the request was designed as a preservation request. North Carolina law would dictate that records are destroyed after two years, the official said, so as the ongoing investigation develops, law enforcement wants to be sure they can access relevant records. The request is confined to the Eastern District of North Carolina and two state agencies, including the Department of Motor Vehicles but only in regards to the Eastern District.
That scope is not spelled out in the actual subpoena, which informs records officials they can present the full records in hard copy or in person at a federal grand jury on September 25.
Both ICE and the US Attorney's office declined to comment, ICE citing an inability to comment on an ongoing investigation.
In a statement, the Lawyers' Committee for Civil Rights Under Law called the subpoena a "clear voter suppression scheme" during an election cycle. The group advocates for civil rights and equal justice, particularly for minorities.
"At a time when the federal government should be deploying its limited resources to enforce the Voting Rights Act and to promote access to the polling place, we instead see them taking action intended to have a clear chilling effect on minority voters," President and Executive Director kristen clarke said in the statement. "We reject this campaign to intimidate voters and urge the federal government to immediately abandon this unprecedented and dangerous voter suppression scheme."

President Donald Trump has repeatedly claimed without evidence that there was widespread election fraud in 2016 and has sought to use his administration to investigate it.

Fact checkers have debunked the President's false claims that there was widespread voter fraud during the 2016 election. Election experts emphasize that such fraud is rare in the context of more than 1 billion votes cast since 2000.

kristen clarke, assistant attorney general for civil rights at the Department of Justice, is a vocal abortion proponent who has repeatedly expressed her support for preserving Roe v. Wade. She also oversees investigations into violations of the Freedom of Access to Clinic Entrances Act-which she has used to charge 26 pro-life individuals this year.
"It appears she's violating her oath of office and she's violating her duty, which is to fairly administer the law regardless of political views," John Daukas, former acting assistant attorney general for civil rights in the Trump administration, told The Daily Signal. "She appears only to be prosecuting groups that she doesn't like, doesn't agree with."
Few would expect such a high-ranking DOJ official to retain the slew of political hot-takes and public condemnations that litter clarke's social media from before she assumed her current role. She has called Alliance Defending Freedom a "hate group" and Liberty University a "fundamentalist Christian school." She has said that those protesting Dr. Anthony Fauci should be "publicly identified and named, barred from treatment at any public hospital if/when they fall ill and denied coverage under their insurance."
She has hurled insults at Republican politicians from Lisa Murkowski to Donald Trump, supported the allegations of Christine Blasey Ford, and has submitted testimony to the U.S. Senate that Amy Coney Barrett was unfit to serve as a justice because she would likely rule to overturn Roe v. Wade (which clarke vociferously and publicly supported). She has frequently critiqued pro-life laws and courts that upheld them, branding a law protecting Down Syndrome babies "draconian."
Significantly (in light of the scores of recent attacks on pro-life centers following the Roe v. Wade leak), clarke called pro-life pregnancy care centers "predatory" and "fake clinics," claiming they are part of a "coordinated strategy to tear down Roe" (as The Washington Free Beacon's Chuck Ross reported).
