How to beat the woke: Never apologize, rally friends and punch back harder

Americans hate woke culture, as I noted in these pages not too long ago. Black, white, Republican and Democrat, a large majority of Americans oppose it. Even people like former President Barack Obama, Bill Maher and ultra-liberal comedienne Sarah Silverman hate it (Maher calls it "Stalinist").
But it keeps going. Why is that? And what can you do about it - especially if you or someone you are close to comes under attack? In short, it keeps going because it's easy and fun - and you have to make it less so.
Lesson one: Don't panic - and don't give in. Ian Prior, of Loudoun County, Va., publishes The Daily Malarkey, an Internet humor site that goes after what he calls the "Chardonnay Antifa." As he recently recounted to Fox News, after he published an op-ed attacking political correctness, he found himself on the sharp end of woke attacks led by a group of teachers, administrators and woke citizens.
According to news reports, the Loudoun Stalinists put together a list of people opposing their policies and planned to "hack" them, "expose" them and "infiltrate" them. Did Prior chicken out?
No. He called them out, he mocked them, and he made sure the whole thing got as much attention as possible. Now there's a criminal investigation into the group. The publicity not only generated blowback against the people who targeted him, it also brought in lots of new subscribers to The Daily Malarkey. Win-win.
Learn from this. Never apologize, don't act afraid, and, to borrow a phrase from Obama, "punch back twice as hard." Call the mob out for what it is: a bunch of bad people trying to pretend they stand for something moral. Going after people for their political views this way isn't an act of morality. It's an attempt at political terrorism, and it's un-American.
The second lesson: Stick together. The woke mob tries to isolate its victims and to make others afraid to stand up for them. Instead, it's important to ask for help from friends and potential supporters, if you're a target, and to offer it to the targets if you're on the sidelines. Solidarity.
This is what's going on with the University of San Diego Law School, whose dean shamefully capitulated to an absurd student campaign against a professor who did nothing wrong. In a post on his personal blog, Professor Thomas Smith said that those who dismiss the possibility that the Wuhan coronavirus escaped from a lab there were "swallowing whole a set of Chinese" - and here he used an scatological phrase meaning, in effect, "balderdash."
He was, of course, referring to the Chinese regime's denials, which are facing growing scientific skepticism.
Asian students complained - preposterously - that this was somehow a racist slur against Chinese people, rather than a criticism of the brutal Communist regime. Rather than telling them that, as law students, they needed to work on their reading skills, Dean Robert Schapiro issued a craven response, suggesting that there was some basis to the complaints. In an e-mail to the law-school community, he charged Smith with "bias" and with using "offensive" language and announced an investigation.
But here's where the story changes. Some of the most eminent faculty members at the law school - including such big names as Larry Alexander, Maimon Schwarzschild, Steve Smith, Chris Wonnell and Gail Heriot - fired back at Schapiro. They wrote: "We are concerned that treating these complaints the way you are doing validates student reactions and strained interpretations that are misguided, that reflect a lack of critical thinking and that will chill faculty members' teaching and scholarship."….

Update (1400ET): AG Letitia James' investigation into the sexual harassment allegations lodged against Cuomo is strictly a professional affair. But following revelations that Cuomo aggressively groped a female staffer under her shirt, Albany Police Department officials said Thursday that they had received a complaint about the governor's actions from a state official.
The concern is that Cuomo's actions may have "risen to the level of a crime," according to Steve Smith, a spokesman for the Albany police, who explained that the department had not received a formal complaint from the woman, who has not been identified, but that it had reached out to a representative for the woman.
News of the criminal referral elicited a strong reaction on social media, as President Trump's son Donald Trump Jr. tweeted "lock him up!" - a humorous reference to a popular chant started by his father and often directed at his erstwhile opponent, Hillary Clinton.
Police have confirmed via the anonymous woman's lawyer that she didn't want to file a police report. Still, the issue was referred to the police in accordance with various protocols, according to an NYT report.
Mr. Smith said the call had come from the New York State Police. But the governor's acting counsel, Beth Garvey, said on Thursday that she had called the police on Wednesday night and reported the allegations, after a lawyer for the female aide told the governor's office that the aide did not want to file a report.
"As a matter of state policy, when allegations of physical contact are made, the agency informs the complainant that they should contact their local police department," Ms. Garvey said in a statement. "If they decline, the agency has an obligation to reach out themselves and inform the department of the allegation."
"In this case, the person is represented by counsel and when counsel confirmed the client did not want to make a report, the state notified the police department and gave them the attorney's information," Ms. Garvey added.
While the police department's actions are part of standard procedure, the situation underscored the potential criminal exposure that the governor may face should the anonymous aide decide to press charges. Cuomo has denied touching anyone inappropriately.

EDD responds weeks after claims of fraud come to light
SACRAMENTO, Calif. -
The California Employment Development Department is responding weeks after people reported getting mailed dozens of letters from the agency to their homes that were addressed to someone else.
Steve Smith got 34 letters from the EDD.
"They were all in our compartment. They all came all at once, and they were bounded with a rubber band," The problem is, Smith said, "I've never had an unemployment check in my life."
Smith is just the latest in a growing list of people to contact KCRA 3 Investigates about stacks of letters coming to their homes. All to the right address, but none of them were addressed to the people living at that home.
"If it's like two letters to a married couple, you know, a married couple each getting a letter or something like that, OK, the post office put them in the wrong box," Smith said. "Or if the address was across the street or something like that. OK, that's a mistake. But 34 letters? For 15 different people? From offices all up and down the state? There's something's going on."
For weeks, KCRA 3 has been trying to get information from EDD about how many fraudulent letters, how many fraudulent claims or even, how the state's unemployment department was handling what they called fraud.
On Thursday, the agency sent a news release, saying "perpetrators are often using stolen identity information from national and global data breaches, as well as exploiting expedited payment efforts in the federal PUA program."
EDD has outlined two steps to combat fraud: First, they are going to limit multiple claims at the same address. Second, to combat the fraud in the Pandemic Unemployment Assistance Program, they will no longer allow automatic back-timing of unemployment benefits. Though this is something many ride-share drivers and contractors need to do when they lose work.
KCRA 3 brought the news release to Assemblymember Jim Patterson, R-Fresno. He started to laugh.
"Excuse me for laughing," Patterson said. "I just find this release absolutely astounding."
Patterson and other members of the legislature requested, and got, an emergency audit of EDD due to, what he called, a lack of transparency. He still has some big issues with the steps EDD outlined to stop fraud.
"First of all, this release admits to astounding incompetence, where they are now saying, 'Well, we're going to stop sending these multiple at the envelopes to the single address.' Well, where were they when the first 30, 40, 50, showed up weeks and months ago?" Patterson questioned.
Patterson also thinks preventing back-timing of PUA claims is the wrong approach, particularly since getting through to someone at the EDD call center for help can take hours - if they get through at all.
"They're basically putting it on the backs of the unemployed in the state of California to go figure out a way how they work their self through the minefield of incompetence at the EDD in order to get their unemployment dated back from when they were first unemployed," Patterson said.
As for Smith, the multiple checks and the money that may have been paid out concerned him.
"Absolutely it worries me," Smith said. "And take it a step further, I'm a state worker! They just cut my pay 10% .. And, if these are all checks going to people - come on, man!"
KCRA 3 Investigates has asked for weeks how many letters have been sent by EDD due to fraudulent claims and how much money may have been paid out as well. These are questions Patterson and other members of the California Legislature have as well. Patterson said even lawmakers can't get answers to those questions.
As for the letters, EDD wants people getting these to either mail them back to EDD at P.O. Box 826880, MIC 43, Sacramento, CA 94280-0225.
Homeowners can also write "return to sender on them" and put them in the mailbox.
Patterson has issues with that, saying fraudsters know the addresses and this just puts a target on homeowners who already got fraudulent mail.
EDD asks PUA applicants who need to back-time their unemployment to use the website or call the EDD call center.

ST. PAUL, Minn. (AP) – In hindsight, their first mistake may have been holding a memorial service in a big basketball arena.

The Oct. 29 service held for Sen. Paul Wellstone after he was killed in a plane crash turned into a raucous political pep rally that turned off many voters. Some analysts say it not only led to the defeat of Wellstone stand-in Walter Mondale but also may have contributed to the Democrats' setbacks nationally.
In studying the anatomy of a debacle, many critics have focused on the blunt-edged speech of Wellstone's close friend Rick Kahn. But the event was designed from the start to be boisterous and, yes, political.
"The problem was the labeling," said Kathleen Hall Jamieson, dean of the Annenberg School for Communication at the University of Pennsylvania. "The mistake was in labeling this as a memorial instead of a celebration of the lives of these individuals, which is what it was."
She said people tuned in expecting a funeral and instead got a rally.
Others said that holding the event in a sports arena that seats nearly 15,000 all but predetermined the tone.
"To expect that 15- or 20,000 Wellstone supporters would be quiet as pictures of Trent Lott and others flashed on the screen was too much to expect," said Steve Smith, director of the Weidenbaum Center on the Economy, Government and Public Policy at Washington University in St. Louis.
The crowd's booing of Lott was difficult to hear on television but obvious to reporters there. The event was featured prominently on the national news, and conservative pundits seized on the spectacle.
"The problem here was that this was an event controlled by a family that was grieving and a campaign staff that was no longer in the campaign," Smith said. "So, there were errors in judgment."
Wellstone campaign manager Jeff Blodgett apologized for the event the next morning but declined to revisit it in a recent interview, saying: "We've paid the price for the memorial many times over. We're moving on."
The event almost happened in an entirely different way.
Speaking on condition of anonymity, a source familiar with the planning meeting the day after Wellstone died said the small group considered holding the service in a more somber setting such as a cathedral. But that idea was rejected for a variety of reasons.
One reason was that the senator was Jewish. But organizers also believed that any tribute to Wellstone had to reflect the populist bent of the man. Thus the big arena.
To those paying close attention, the intent of the memorial was clear in the advertised theme: "Stand up, keep fighting."
During the event, Wellstone's wife, daughter and three campaign staffers were given tearful eulogies. But when Kahn, chosen by sons Mark and David to speak of their father, took the podium, he almost immediately changed the tone.
"We are begging you to help us win this election for Paul Wellstone," he told the crowd. "We can redeem the sacrifice of his life if you help us win this election for Paul Wellstone." Kahn also singled out some Republican lawmakers in the crowd to ask them to honor Wellstone by supporting a Democrat for his seat.
Mark Wellstone spoke later and started a finger-jabbing chant of "We will win!" When the video monitors in the arena focused on Mondale, then Wellstone's presumed replacement, the crowd began chanting, "Fritz!"
Democratic National Committee Chairman Terry McAuliffe recently told a group of editorial writers that the big-screen close-ups were the biggest mistake of the event, which he said could have cost Democrats nationwide.
Afterward, the event's organizers were in shock, one person present said, and some immediately realized it was a public relations disaster.
Minnesota Gov. Jesse Ventura, a political independent, said the very next morning that he was so disgusted he walked out. Republican challenger Norm Coleman was essentially given a fresh start.
"Up until the event, the Coleman people were scared out of their minds," said GOP strategist Sarah Janecek.
Neither Kahn nor the Wellstone brothers would comment for this story. But Kahn said in a radio interview the week after the election he intended his speech to be a personal expression of grief. He said he had no regrets: "I didn't say anything bad at all, and I wouldn't. It's not in my heart."

The owner of Kid Rock's Big Ass Honky Tonk Rock N' Roll Steakhouse in Nashville said he is refusing to follow Mayor John Cooper's plan to shut down all bars in the city's tourist hot-spot Lower Broadway during the coronavirus pandemic. After a video of a packed bar went viral overnight, the Metro Board of Health approved a plan to shut down all bars in Davidson County, including the honky-tonks in downtown Nashville. The Tennessee Department of Health reported 39 cases of coronavirus in the state, with 17 in Davidson County alone.
After Cooper announced his plans, Steve Smith, who owns the bar with Kid Rock's name on it, as well as The Diner and Tootsie's Orchid Lounge, said he will not follow the rule until a statewide mandate is issued. Smith called the decision "unconstitutional."
"Unless there's a statewide mandate that directs all bars and restaurants to be closed, the request made by Mayor Cooper is unconstitutional as he is targeting a select group of businesses," Smith said in a statement. "We are compassionate with those who have contracted the COVID-19 coronavirus and all who are helping manage the crisis as the entire world addresses the outbreak. However, a Tootsie's patron as immediate as last night, mentioned having lived through the polio epidemic and didn't recall such extreme measures being handed down in history."
Cooper's plan did not just target bars though. He also set new limits on restaurant capacity, limiting seating to less than 50 percent capacity and limiting total occupancy to 100 people. Bar service at restaurants were also limited to 50 percent capacity with no standing allowed. The Metro Board of Health had an emergency meeting Sunday afternoon to approve the plan, reports The Tennessean.
The decision to close the bars and set limits for restaurants came after a Twitter user shared a video showing a packed bar in Lower Broadway Saturday night, even as people had already been advised to self-quarantine due to the coronavirus. The video quickly went viral, with over 3 million views. It was not a good look for the city, with even celebrities calling out the bars for letting so many customers pack into close quarters.
"While the rest of us are trying to be responsible in our homes and get this s- over with, THIS?!" country singer Maren Morris wrote on Twitter. "Broadway, you aren't a hero for staying open."

Earlier Sunday Nashville Mayor John Cooper called for all bars on lower Broadway to close and all restaurants to hold no more than 50 patrons.
According to The Tennessean:
The city's move, which was praised by some but rejected by at least one prominent area businessman, includes:
closing bars throughout Davidson County, including in the tourist-heavy Lower Broadway area;
limiting restaurant seating to less than 50% of capacity, with no more than 100 individuals allowed in a given establishment; and
limiting bar service at restaurants to 50% capacity with no standing allowed.
This did not go over well with local business owners.
Steve Smith, the owner of Tootsie's Orchid Lounge, Rippy's, Honky Tonk Central, Kid Rock's Big Ass Honky Tonk Steakhouse & The Diner, responded to the mayor telling him his mandate is "unconstitutional."

Francis Ford Coppola Winery today announced the opening of a new winery, Domaine de Broglie, in Willamette Valley, Oregon. It's not every day breaking news happens at MediaPost events. But this morning, Janiene Ullrich, EVP, direct to consumer at the winery, told the Brand Insider Summit D2C audience about it.
"Francis has an appreciation for the sciences," she explained, and named it after Louis de Broglie, who won a Nobel Prize. "Francis had wanted to be a scientist as a child."
MediaPost's Steve Smith noted this is "not your typical wine marketing. In fact, it's the opposite of everything being done today, letting the consumer tell you where to go." Instead, FFC Winery is bringing consumers to places they didn't know they want to go, he added.
"Our D2C Club is at the core of what we do," Ullrich said. There are clubs at each winery and at FFC Winery, there is a pool, restaurants, a pavilion for events and even bocce ball courts. The brand's main point of contact with consumers is the winery in Sonoma County, California. More than half the club's members live in The Golden State. Following that, emails reach the rest of their consumers.
FFC Winery collects data through its tasting room, ecommerce, the club and layers on points of sale and reservations for the pool. "A good thing about being in a highly regulated industry is that we have to get a birth date. From there, we can get purchase behavior."
With the help of an agency, the winery did an audit of its data sources, KPIs and methodology. It found that D2C, which it has always been, was the most profitable and learned it needs to get people to come to the property and to build awareness.
One of its chief acquisition channels is a rewards program launched last year that gives buyers points and gives the winery more data.
The brand's most important element is family. It's at the heart of everything the famous movie director does, Ullrich said, talking about the resorts he has opened in Belize, Guatemala, Buenos Aires and his family's hometown, Bernalda, Italy.
Smith then asked, rhetorically, "So no 'Godfather' theme park with Fredo boat rides?"
An illuminating story Ullrich told involved Corey Beck, the former head of winemaking at FFC. When the eponymous owner wanted to put wine in a can, he asked his winemakers to make it happen. They sent him an email outlining why it would not be possible. And received a one-sentence response: "Don't be the roadblock to great creativity." Wine was produced in a can, and Beck is now the CEO of FFC Winery.

Steve Smith joins Pat Cummins in call for Australia Day date change

Former Australian captain Steve Smith has followed the current skipper Pat Cummins in, saying he thinks Australia Day should be celebrated on a more appropriate date.
Cricket is caught in a storm of controversy over its determination to not associate any of its matches with the public holiday, but conceded on Wednesday that there would be mention of Australia Day over the public address system at the Test on January 26.
Earlier chief executive Nick Hockley had said there would be no announcements.
Cricket's Indigenous advisory panel endorses the stance and players in the Test team have been influenced by discussions with fast bowler Scott Boland and Ash Gardner, Indigenous players who says there needs to be a more appropriate date.
"I've just spoken to Scott Boland about this just the other day and as Australians you want all Australians to celebrate that day," Smith said.
"All Australians don't the way it is at the moment and maybe that is the way forward (change the date) to have all Australians celebrating on that day."
Gardner spoke last year about being uncomfortable personally and for "all the people I'm representing" about even playing a woman's ODI match on that day.
"I just don't understand why this one day of the year, which is a day of mourning, which doesn't have a very good history of what happened on that day, that there needs to be cricket," Gardner said at the time. "I see sport as a celebration and entertainment and an event you want to go to. Why does there need to be something that represents something that's quite morbid. It's probably not overly appropriate."
Boland was of the same mind.
"It's a day of mourning for a lot of people. I'm not sure January 26 is the day that is inclusive of everyone," Boland said.
The fast bowler is in the squad but not part of the XI for this match.
Cummins and chief executive Nick Hockley set off a firestorm of criticism for a similar stance. The CEO and his organisation claimed they were not banning Australia Day and would play on the date without mentioning it.
Cummins is also of the opinion that January 26 is not an appropriate date for Australia Day.
"This conversation comes up every year really and Cricket Australia has been pretty consistent over the last four or five years in the way they approach it," Cummins said.
"My personal opinions is I absolutely love Australia, it is the best country in the world by a mile and I think w should have an Australia Day, but I think we can probably find a more appropriate day to celebrate
"I think in particular a sport like cricket, which has such diversity and has millions of people following it and supporting it and playing it. You get a good spectrum of the community and a good feel for what the community kind of expects.
"So, knowing a couple of those players. You hear the stories and their feelings and it does gather extra importance."
