Silicon Valley Congresswoman Anne Eshoo is retiring
SAN JOSE, Calif. - For the first time in two decades, a Silicon Valley congressmember is poised to retire and shake up the South Bay's political landscape – with many local Democrats reportedly eyeing the seat.
Rep. Anna Eshoo plans to end her three-decade congressional career at the end of her term in 2024. She posted a video announcing her retirement on Tuesday.
Eshoo, who earned notoriety for spearheading cybersecurity, innovation and high-tech legislation, was elected to the U.S. House of Representatives in 1992 after serving on the San Mateo County Board of Supervisors for a decade.
Her retirement marks a monumental shift in Silicon Valley politics. Eshoo is a powerhouse politician who rose through the ranks as a senior member earning coveted committee assignments in Washington on health care, energy and commerce. As news spread about Eshoo's decision to call it quits late Monday, speculation circled about who will run for the competitive seat to represent District 16.
The district includes a large swath of Santa Clara County, including parts of San Jose, and San Mateo County.
Candidates rumored for the seat include California Sen. Josh Becker, Assemblymember Evan Low, Santa Clara County Supervisor Joe Simitian and former San Jose Mayor Sam Liccardo.

San Jose Mayor Talks About Seizing Guns from Owners Who Don't Pay City Fee
San Jose Mayor Sam Liccardo (D) spoke to Slate about seizing firearms from people who refuse to pay the city's new $25 gun owners' fee or comply with the city's new liability insurance requirement for gun owners.
Breitbart News reported that San Jose's city council passed the fee ordinance and the liability insurance ordinance on January 25, 2022.
Slate notes the city fee is $25 and quotes Mayor Liccardo saying the funds collected will go to a foundation overseen by "Stanford professors, an epidemiologist who has been focused on gun harm, and nonprofit experts who understand domestic violence prevention programs, suicide prevention."
Liccardo explained that the ordinance requiring the fee is "civil," rather than criminal in nature. However, he made clear that failure to pay the fee can result of seizure of a firearm.
He said:
For example, there's a bar brawl and they're patting down everybody and someone's got a gun. "Have you paid your fee? You have insurance?" "No." OK, well, there's an opportunity for us to remove the gun. And then when the gun owner comes back and demonstrates that they comply with the law and they're a lawful gun owner, they get their gun back. But in the meantime, you've taken a gun out of a bar brawl. And that's not a bad thing.
Liccardo then took exception to the suggestion the city fee is actually a tax on guns:
I don't blame anyone for being emotional about this. These are really important issues that go to the core of what we believe about freedoms and rights and our own safety. But I'd say this. First, it's a fee, it's not a tax, and I won't go into the details about what the difference is, but the reality is that in this country, there have been taxes on guns and ammunition since at least 1919, and they've been upheld by the courts. So the fact that there's a constitutional right attached somewhere to the exercise of a particular activity doesn't mean it can't be regulated, taxed, or have a fee imposed.
The text of the Second Amendment ends with four words, "Shall not be infringed."

California city becomes first to demand gun owners pay liability insurance and an annual fee
San Jose, California, became the first city in the United States to impose restrictions on gun owners demanding they purchase liability insurance and pay an annual fee.
The new law was spearheaded by San Jose Mayor Sam Liccardo, who cited a study claiming that residents of San Jose collectively paid $442 million per year because of gun violence in the city.
Under the new ordnance, gun owners would need to keep proof of insurance and proof of fee payment with their gun at all times. They would be required to be able to provide documentation to police officers when requested.
Those who do not comply with the law could be nailed with a fine or even have their guns impounded.
The annual fee would be assessed per family with a gun in the home and would come to $25 a year plus some administrative fees. The money would go to social programs including thos related to mental health, suicide prevention, and domestic violence prevention.
Gun rights advocates said they would challenge the constitutionality of the ordnance in the courts.
"Any abridgment of a constitutional right, any chipping away, no matter how small, is the beginning of the downfall of the Constitution and what our rights really mean," said Sam Paredes, the executive director of the Gun Owners of America.
The Firearms Policy Coalition also released a statement objecting to the new law.
"If San Jose adopts Mayor Liccardo's outrageous and unconstitutional gun control proposals, we will not hesitate to challenge the city's policies in federal litigation and take every possible action to block their enforcement," the organization wrote.
Supporters of the law said that the fees will not be collected until the legal challenges are resolved in court.

Opinion: Sen. Feinstein writes, 'our bill would close the ghost gun loophole'
Two years ago, a student at Saugus High School in Santa Clarita shot five classmates, killing two before turning the gun on himself. A year later, a retired San Jose police officer was shot as he tried to stop two men from stealing a car. And in April this year, a valet was killed during his shift at a boutique hotel in Downtown San Diego.
These three cases, and countless others like them, are all linked by a common thread: The shooter used manufacturers of components to make "ghost guns." These unregistered, untraceable firearms are increasingly being used by criminals to avoid attention or background checks, and we must take action at every level of government to remove them from our streets.
Ghost guns are homemade firearms built using a kit or 3-D-printed parts. And because they're not completed firearms when sold, ghost guns don't have serial numbers and can be sold without background checks, making them nearly impossible to trace.
Manufacturers of ghost guns evade all federal regulations that apply to normal firearms by sending incomplete frames or receivers along with the necessary components to finish building a fully functional weapon.
Because of the anonymous nature of these guns, they often end up in the wrong hands. And they are contributing to the rise in gun violence throughout the United States, including in California.
In San Francisco, the number of ghost guns confiscated has increased over the last five years from six in 2016 to 164 in 2020. In the first five months of 2021, the San Francisco Police Department seized 91 ghost guns. In Oakland, 147 ghost guns were confiscated in the first six months of 2021, compared to just 43 in all of 2020. These firearms contributed to the 36 percent increase in homicides in the Bay Area during the first half of this year.
In Los Angeles, a major hub for underground firearms dealers, ghost guns now account for a third of all weapons recovered by police. The city is on pace to confiscate 1,500 ghost guns this year. And homicides are up 25 percent in the first half of 2021 compared to the Same time last year; nearly three-quarters involved a firearm.
California has long been a champion for commonsense gun legislation at the state and local levels. So it's no surprise we're leading the way to ban these weapons.
In May, San Francisco became the first city in California to introduce legislation to ban the possession and sale of ghost gun kits and parts. And this week, the district attorney sued three manufacturers of ghost gun components.
In June, San Jose Mayor Sam Liccardo introduced a proposal to make it illegal to possess, manufacture or assemble a ghost gun.
And in early August in San Diego, where nearly 20 percent of all weapons seized the first half of this year lacked a serial number, the City Council voted overwhelmingly in favor of an ordinance to ban ghost guns.
The federal government, unfortunately, is lagging far behind in this area.
Under the leadership of President Joe Biden, the Justice Department issued a new rule in May that would require stronger regulations on ghost guns. The proposed rule would update the definition of a firearm and close a loophole that allows these guns to be sold without a serial number, allowing buyers to evade background checks.
In addition, the Justice Department recently launched a new federal strike force to directly target makers of local ghost guns in Los Angeles, New York, Chicago, Washington and the Bay Area. The aim is to disrupt the illegal flow of weapons into California from neighboring states while also targeting underground, unlicensed firearm dealers. I applaud the president's commitment to this critical issue.
But the president's actions could be undone by future administrations. That is why earlier this year, I joined Sens. Ed Markey, D-Mass., and Richard Blumenthal, D-Conn., and Rep. David Cicilline, D-R.I., to introduce the Untraceable Firearms Act. Our bill would close the ghost gun loophole once and for all, making these untraceable firearms illegal.
This is a commonsense bill that Democrats and Republicans should support. No one should accept the presence of untraceable firearms in our communities.
It's time for Congress to pass our bill and save lives.

Govt to Force Gun Owners to Pay Annual Tax, Will Confiscate Guns from Those Who Refuse
San Jose, CA - In a move that is being celebrated by the anti-gun crowd, the government of San Jose, California has passed a resolution - unanimously - to force gun owners to pay an annual tax and carry insurance for the privilege of self-defense.
Though the forthcoming tax has yet to be determined, lawmakers have already determined that they will begin confiscating guns from anyone who refuses to pay it.
This move comes on the heels of another Orwellian gun law the city passed two weeks ago which requires every single gun purchase to be video and audio recorded and that media stored indefinitely.
The city claims the gun tax is necessary to force gun owners to cover the costs related to gun violence in the city. Given the fact that most gun crimes are not committed by law-abiding gun owners, this measure is little more than an attack on legal guns.
Naturally, this has gun rights activists up in arms and they are promising to take the city of San Jose to court if they follow through with the measure.
"The whole proposal is completely disingenuous. It fails to provide any proven solutions. It is blatantly unconstitutional," San Jose resident Dave Truslow, a National Rifle Association firearm instructor, told the San Jose Spotlight. "In the meantime, (Mayor Sam Liccardo) is hoping to bask in the sunlight."
Another valid point brought up by those who oppose this new law is the fact that - like most taxes, fines, or monetary requirements - it targets poor people. For those who can afford to pay, it won't be that big of a burden but for those who can't afford it, they will be forced to turn in their guns or become criminals overnight.
It appears this is a back-door means of disarming the city's poor population.
"What these measures really do is penalize the less affluent," Truslow said.
According to the San Jose Spotlight, Truslow is concerned that there are no measures to address issues that drive crime, including increasing the number of San Jose police officers, pursuing unlawful possession of guns, constructing a city jail for those who violate Santa Clara County's sanctuary policy, more effective gang intervention programs and workplace violence training for public employees. He wants the city to address crime instead of Liccardo's gun measures.
Sam Paredes, executive director of gun rights policy group Gun Owners of California, told the Mercury News last month that Liccardo would "have his rear end handed to him in a basket by a judge."
"We think that the mayor must have aspirations to be king or something because his proposals are not allowed under federal or state law because of the constitution on the federal side and the preemption law on the state side," Paredes told San José Spotlight.

SAN JOSE, Calif. (KRON) - A suspicious house fire in San Jose that broke out just before the mass shooting may be connected, according to Mayor Sam Liccardo.
The San Jose Fire Department responded to the1100 block of Angmar Ctat 6:36 a.m. for a fire. It was a single-family home and the fire was extinguished by 7:30 a.m.
The shooting was reported around 6:45 a.m.
KRON4's Sara Stinson reports that the house is about a 10 minutes drive from the railyard.

"An early morning house fire in San Jose has been linked to a mass shooting at the VTA rail yard Wednesday. The San Jose Fire Department received a call at 6:36 a.m. for a structure fire on the 1100 block of Angmar Court, a quiet, dead-end residential street near the East Capitol Expressway exit from Highway 101. The fire was knocked down about an hour later.
"Fire damage to home on Angmar Ct described as heavy," the department said in a statement. "The structure is currently uninhabitable." San Jose Mayor Sam Liccardo confirmed that the home is linked to the shooter.
Reporters from multiple local news stations posted images showing San Jose police officers blocking off Angmar Court and checking with people coming in or out of the street. NBC Bay Area reported no one was found inside the home and a large amount of ammunition was discovered. A bomb squad is also at the home. The FBI is investigating both the VTA shooting and the house fire."

San Jose Mayor Ignored Health Protocols During Holiday Celebration
San Jose Mayor Sam Liccardo appears to have broken health protocols in celebrating Thanksgiving with family members outside of his own household.
The NBC Bay Area Investigative Unit has learned Liccardo celebrated with his elderly parents at their Saratoga home with an unknown number of other guests. While the mayor's staff did confirm the dinner took place, they have not disclosed how many other people attended, how many different households were present, and whether any of those in attendance wore masks while not eating.
"This is a private event - not public," said Jim Reed, Liccardo's Chief of Staff. "We are going to redraw the line between what is personal and what is public because that line has become blurred."
The mayor's press team, when questioned by the Investigative Unit about the mayor's Thanksgiving plans, initially said Liccardo was marking the holiday by "staying home" with his immediate family. The day after Thanksgiving, however, Reed notified the NBC Bay Area Investigative Unit that his staff "misspoke" and explained that Liccardo spent the holiday at his parents' home with other relatives.
Last week, Liccardo urged his more than 33,000 Twitter followers to cancel "big gatherings this year" and noted the importance of following safety protocols, even with friends and family.
"Cases are spiking," he wrote. "We're letting our guard (and masks) down with family and friends."

Why is Fox morning news talking about 'domestic terrorism' (5/30/2020)? If you can label something 'terrorism', what powers become available? Terrible leaders would abuse this power. When things turn dangerous, you hear less from these leaders. Where is Ilhan Omar? Why is mayor of Minneapolis making it about race and not bad cops? Are the leaders of Minneapolis Democrat or Republican?
Research is the best way to learn the game. It's like a game, but it's not a game. The wins and losses determine policies, which can then be applied to the People. Therefore, some bad leaders are always looking for ways to increase their powers and abuse them afterwards. This is why when the news starts mentioning 'domestic terrorism', some informed good people can imagine where this might be headed. The ones who believe channels like CNN, New York Times, Buzzfeed, and Washington Post have been lead astray many times during the past 3 years and more.
Fake news media are not the only bad people hurting the People by lying to them. Fake leaders are another challenge citizens must overcome. Simplify the game. If Obama, Biden, Yates, Power, Comey, Brennan, Rice, Abedin, Podesta, Clinton, Epstein, Weinstein, DeNiro are dirty liars against the People, how can a person be a Democrat? If Obama, Rice, Comey, Yates, and Biden betrayed Lt. Gen Flynn during their January 5th meeting in 2017, how can a person follow their lead? Would Democrat leaders and fake news expose Anifa as George Soros paid shills or continue to hide that fact? Simplify the game citizens, vote all Democrat leaders out and stop paying for fake news.

'Let's get this motherf-ker': San Jose officer suspended after viral protest comments
Officer Jared Yuen has been viewed millions of times antagonizing George Floyd protesters while getting into downtown skirmish line
The San Jose Police Department was doing damage control after one of its officers trended nationally on social media for aggressive comments toward demonstrators protesting the George Floyd killing in Minneapolis, shouting "Let's get this motherf-er" and "Shut up, bitch" as he manned downtown skirmish lines.
The officer, confirmed to be six-year SJPD veteran Jared Yuen, was recorded in multiple instances late Friday afternoon and drew immediate and wide rebukes from thousands of people who watched the video and called for Yuen's firing.
One of the videos had been viewed more than 10 million times and been shared nearly 500,000 times on Twitter as of Sunday morning. Authorities confirmed that Yuen has been temporarily taken off street duty and will not be staffing any more demonstrations.
Raj Jayadev, director of the South Bay social-justice group Silicon Valley De-Bug, said the videos are particularly troubling because of the fears elicited by the police killing of Floyd last week, after Minneapolis police officer Derek Chauvin pressed his knee on a handcuffed Floyd's neck for more than eight minutes. Chauvin was fired and has since been charged with murder.
"Officer Yuen's actions are extremely dangerous because you have someone who actually has a license to kill," Jayadev said. "It's one thing for someone to be a bully. But when you have the tools and state authority to act upon that violent aggression, it's not just words, as far as I see it. It's a criminal threat."
There was no shortage of condemnation from city leaders for the behavior shown in the videos, which surfaced as the police department parries criticism for its use of rubber bullets, tear gas and other force tactics to dispserse protesters after they shut down Highway 101, and some people took to vandalism. By the end of Friday, at least 38 people were arrested and several officers were injured by thrown objects including glass bottles, and one officer went to the hospital after a protester punched him in the face.
"I found the video of Officer Yuen's statements disturbing, and his conduct undermines what was overwhelmingly excellent work by San Jose police officers to exercise restraint and professionalism amid very difficult, intense moments," Mayor Sam Liccardo said Sunday. "It's apparent that the officer allowed his emotions to undermine his professional duty to the public."
Through the police department, Yuen declined to comment for this story. Police Chief Eddie Garcia, who told this news organization Saturday that the officer's actions were a product of an environment in which "emotions were running high," offered a wider response Sunday that firmly denounced the incident while also extending support for Yuen.
"I'm not happy about this, and I'm not defending this," Garcia said. "He let his emotions get the best of him, and it's not right."
The chief, who was among the first police leaders in the country to condemn Floyd's killing, said Yuen will be held accountable for his conduct, but stopped short of saying whether Yuen's career was on the line. He said Yuen is a good police officer "who has put his life on the line for the city multiple times." In 2016, Yuen was deemed a victim officer in an encounter where an auto-theft suspect rammed his car during an escape attempt, prompting two other officers to open fire on the suspect.
"He's a good kid and a good cop. He will have to deal with this. And I will have to deal with this," Garcia said. "This is not going to get swept under the rug."
The San Jose Police Officers' Association sought to toe a similarly fine line between acknowledging the damaging power of Yuen's acts and trying to offer a sense of measure.
"San Jose police officers are performing an extremely delicate job, in an incredibly dangerous and difficult time, and our entire community is under an enormous amount of stress. That stress manifested itself in language directed at a protester that is appropriately being investigated by the department," Sgt. Paul Kelly said in a statement Sunday. "We urge everyone to protest peacefully and know that San Jose police officers remain committed to ensuring the safety of protesters and all residents of our city."

George Floyd protest in Oakland intensifies with fires, tear gas as thousands take to the streets

A protest in Oakland Friday night over the police-custody death in Minneapolis of George Floyd devolved into chaos, with fires being set, windows smashed, police officers struck by thrown objects and tear gas and rubber bullets fired at protesters.
Thousands of people took to Oakland's streets in what began as a largely spirited but peaceful assembly four days after Floyd, a black man, died after a white police officer pinned him to the ground by kneeling on his neck and refusing to let up, even as the man yelled that he couldn't breathe.
Protesters spray painted buildings, stopped traffic on I-880, threw fireworks and set fires inside some buildings. At one point, Several people tore off the wooden boards at Walgreens near 14th Street and Broadway near Oakland City Hall and used the boards to break their way in. They ran out with baskets with merchandise. A fire was ignited inside the store.
At the corner of Eighth Street and Broadway, protesters shattered the windows and glass doors of a Starbucks. Protesters also smashed windows at City Hall and a Chase bank.
The doors of a Target at 27th Street and Broadway were smashed and a fire burned in a dumpster across the street. Clothing, hangers and bedding were strewn outside the store. People formed an assembly line to loot. One person ran back and forth and handed off merchandise to people standing outside.
Smoke billowed out of a Mercedes Benz showroom near 29th Street and Broadway. The windows of a Honda dealership at 33th Street and Broadway were smashed.
A person spray-painted outside City Hall, "We have nothing to lose but our chains." Another group of protesters tore a row of Lyft bikes out of the pavement nearby city hall and dragged it out into the middle of the street. The dock that held the bikes was set on fire. And a large trash bin was set ablaze.
Just before 11 p.m., police officers walked in a line up 14th Street toward Broadway, pushing protesters back from where a fire had been set in the middle of the road. Officers deployed smoke bombs to disperse the crowd. A large fire was also burning near the 19th Street BART station.
Earlier in the evening, at Seventh and Broadway, police declared an unlawful assembly and deployed tear gas after officers were struck by thrown objects.
Protesters poured milk or water in their eyes bending over on the sidewalks and in the street once they had retreated.
Officials estimated more than 5,000 people were protesting in Oakland. One officer was injured and several people were detained, said Johnna Watson, a spokeswoman for the Police Department.
Two security guards were shot near 12th and Clay streets. The shooting doesn't appear to be related to the demonstration, the police department said.
In San Jose, police officers fired rubber bullets and deployed tear gas on hundreds of protesters outside of San Jose's City Hall Friday evening as people chanted "F- the police." People screamed, "Gas, gas, gas" as loud flash bangs could be heard and smoke filled the air near Fifth and Santa Clara streets.
At least one officer was injured during the protest and was taken to Valley Medical Center, said Mayor Sam Liccardo. The officer's condition was unknown. Several arrests were made, Liccardo said.
Dozens of people keeled over, coughing, and poured water into their eyes. Some protesters weaved throughout the dense crowd, shouting, "Water, who needs water?"
Kiara Topete, a 19-year-old from Milpitas, said she was standing in front of police when one shot her with a rubber bullet in the shin.
"I didn't do anything, I didn't throw anything, I didn't pose a threat to them, they just shot me," she said. "It burns. It really hurts, I've never felt anything like this."
Several people picked up spent gas canisters and water bottles, hurling them toward the line of police blocking City Hall. Police responded by deploying more tear gas and firing rubber bullets.
Just before 9 p.m., most of the crowd had dissipated. A charred trash bin remained in the middle of the street near City Hall. A destroyed Toyota 4Runner sat at the corner of Third and Santa Clara streets. And police remained on guard.
At 9:06 p.m., Santa Clara County Sheriff deputies were involved in a shooting that occurred just blocks away at Sixth and Santa Clara streets, said Sgt. Enrique Garcia, a spokesman from the San Jose Police Department.
Garcia did not provide any additional information.

Tech companies such as Google and Alphabet, Google's parent company, have faced issues from local communities because they say the company's expansion affects places like the Bay Area. This announcement could dissipate planned protests for Alphabet, CNBC reported. There are more than 45,000 Google employees living in the San Francisco Bay Area, which is known to have limited housing opportunities, according to CNBC.

A homeless man arrested on Monday for stabbing a San Jose woman to death last month was an undocumented immigrant who had been ordered detained by federal authorities nine times, officials said Tuesday. But the man, who had multiple convictions for misdemeanor and felony offenses, was released from the Santa Clara County jail twice in the months before the killing.
On Tuesday, San Jose Mayor Sam Liccardo issued a sharply-worded criticism of the county's policy of not honoring federal immigration detention orders at the jail. Liccardo said the policy "undermines public safety, and violates common sense."
San Jose Police Chief Eddie Garcia joined with Liccardo and Santa Clara County Sheriff Laurie Smith in criticizing the policy Tuesday. At a press conference, Garcia said he was well aware of the ways in which the case probably would be politicized amid a heated national debate over immigration and local "sanctuary" policies meant to protect undocumented residents from federal authorities.
But, Garcia said, there was a distinction between protecting and embracing "otherwise law-abiding undocumented residents" and policies that he said "shield admitted gangsters or violent criminals."

SAN JOSE - Santa Clara County officials are firing back at critics who say their policy of not notifying immigration authorities when undocumented immigrants are released from their jails led to the release of a homicide suspect who had nine detention orders issued against him.
The suspect Carlos Eduardo Arevalo-Carranza, 24, is suspected of stabbing to death Bambi Larson, 59, in her South San Jose home last month. On Tuesday, San Jose Mayor Sam Liccardo criticized the county's policy of "ignoring requests" by the Immigration and Customs Enforcement that inmates about to be released be held until they are picked up by ICE. But county officials said on Wednesday that federal authorities, not they, were to blame for Arevalo-Carranza's release.
"ICE should've gotten a warrant here. They could've gotten a warrant here," said County Counsel James R. Williams, at a press conference late Wednesday afternoon. "And the county's practice has always been to honor warrants that are issued."
The disclosure Tuesday that Arevalo-Carranza is in the United States illegally, and that the county jail ignored six requests by immigration authorities to turn him over - Los Angeles County received three other detention requests from ICE - has renewed criticism that "sanctuary" policies allow serious and violent criminals to slip through the cracks.
According to officials with ICE, between October and November 2016, the agency requested three times that Arevalo-Carranza be detained at the Los Angeles Police Department's central jail, none of which were fulfilled. From June 2016 to January 2019, the agency also asked Santa Clara County to hold him six times, according to ICE.

California voters reject gas tax repeal
California voters on Tuesday rejected Proposition 6, a measure to repeal a recent increase in the state's gas tax and one that, in many ways, determines the fate of California's roads, bridges and transit. The measure, which lost by a nearly 11 percentage points, would have repealed a law passed last year, called SB1, that increased the tax on gasoline by 12 cents and the tax on diesel by 20 cents per gallon. The Same law also increased registration fees by an average of $50 per vehicle and imposed an additional $100 fee for vehicles that don't use gasoline.
At stake was not just the estimated $5.4 billion annually from those taxes and fees to pay for road, highway, bridge and transit repairs, but also how the state could raise money to pay for transportation improvements in the future. Supporters of the measure painted the repeal initiative as a David-versus-Goliath battle pitting the needs of working families against Sacramento special interests. "It's about whether working families will be given some breathing room and whether we can address the high cost of living in California," said Carl DeMaio, a former San Diego city councilman who led the repeal effort. "That's real money." Opponents of the repeal, however, characterized it as a cynical political ploy to get more Republicans to vote in midterm elections - GOP gubernatorial candidate John Cox mentioned the measure in nearly every stump speech - and one that would have dangerous consequences for Golden State motorists.
Prop 6 would have required two-thirds of voters to approve any increase in fuel taxes or vehicle fees in the future, making it all that much harder to pay for roads, rails, bridges and buses, said Carl Guardino, a member of the California Transportation Commission, who opposed the repeal. Before SB1 was approved, the state was facing a $57 billion funding shortfall over the next 10 years to rehab the state's crumbling roads and bridges. "California voters are smart, and they don't like to be deceived," Guardino said. "The more it became clear what was at risk - the safety of our highways and bridges, the loss of funding for traffic relief and transit alternatives, the ongoing frustration of potholes and a lack of road and street maintenance - the more people saw through it." And, in the gridlocked Bay Area, voters were staunchly in favor of keeping the taxes and fees in place, with a supermajority of voters opposing to the measure. Across the entire Bay Area, 69.6 percent of voters rejected the measure, with opposition to the repeal highest in San Francisco County, where 82 percent of voters opposed Prop 6, and lowest in Solano County, where 56 percent of voters rejected the measure.
Bob Braun, 73, of Martinez, said the money is critical for ongoing maintenance and repairs. "I think it's crazy that people will pay money to fix their cars, but they won't pay money to fix the streets," he said. "There have been some improvements on the streets that we typically use, but in general, they need maintenance." The state's transportation commission, which reviews and oversees transportation funding in the state, has already approved more than 9,200 projects across the state funded by SB1. Of those, 6,500 have already started construction, and roughly half of those were at risk of being delayed or defunded if Prop 6 passed, Guardino said. Among the projects in the Bay Area at risk of losing funding were $730 million to help extend BART to downtown San Jose, $318.6 million for BART to buy new train cars so the agency can carry more passengers by running longer trains, $233 million for toll lanes on Highway 101, $164 million to help electrify Caltrain, $150 million for more AC Transit buses, and $67.5 million in pedestrian and bicycle improvements. San Jose Mayor Sam Liccardo lauded the measure's defeat, saying it will enable the Santa Clara Valley Transportation Authority to continue building its 6-mile BART extension underneath the city's downtown. "I'm grateful Californians recognize it's time to stop kicking the can down the road and start investing in infrastructure projects like BART," he said.

Ninth Circuit Lets Trump Supporters Hurt in San Jose Riot Sue Police
The U.S. Court of Appeals for the Ninth Circuit ruled Friday that a lawsuit by supporters of Donald Trump against San Jose police officers who allegedly failed to protect them from an anti-Trump riot in June 2016 could proceed, defeating the city's appeal.
The three-judge panel upheld the lower court's decision that the officers were not entitled to qualified immunity from suit because they "violated clearly established rights" - assuming, for the moment, that the plaintiff's factual claims against them were true.
The lawsuit stems from a riot that took place outside the San Jose Convention Center on June 2, 2016 during and after a speech by then-candidate Trump, just days before the California primary. As Breitbart News reported from San Jose at the time, anti-Trump protesters outside the venue chanted profane slogans and tore up an American flag. Later, as Trump supporters left the rally, the mob chased them, beat them, and attacked them in their cars. One woman was pelted with eggs in full view of the national media.
That woman, Rachel Casey, is one of the plaintiffs, who are represented by attorney (and Republican national committeewoman for California) Harmeet Dhillon. Dhillon is also representing engineer James Damore's in his discrimination suit against Google, and she is suing UC Berkeley for free speech issues, on behalf of Berkeley College Republicans and Young America's Foundation.
San Jose Mayor Sam Liccardo - a Democrat and Hillary Clinton supporter - blamed Trump for provoking the violence. The local police chief commended the police for showing restraint, even as the mob assaulted people who were simply trying to leave.
The plaintiffs claim that San Jose police failed to arrest the violent anti-Trump demonstrators and allowed Trump supporters to be attacked. Worse, they say, the officers directed them straight toward the waiting mob, even though they were aware of the violence.
The case will now be sent back down to the district court, where Judge Lucy H. Koh, a Barack Obama appointee, presides.

San Jose Mayor Talks About Seizing Guns from Owners Who Don't Pay City Fee
San Jose Mayor Sam Liccardo (D) spoke to Slate about seizing firearms from people who refuse to pay the city's new $25 gun owners' fee or comply with the city's new liability insurance requirement for gun owners.
Breitbart News reported that San Jose's city council passed the fee ordinance and the liability insurance ordinance on January 25, 2022.
Slate notes the city fee is $25 and quotes Mayor Liccardo saying the funds collected will go to a foundation overseen by "Stanford professors, an epidemiologist who has been focused on gun harm, and nonprofit experts who understand domestic violence prevention programs, suicide prevention."
Liccardo explained that the ordinance requiring the fee is "civil," rather than criminal in nature. However, he made clear that failure to pay the fee can result of seizure of a firearm.
He said:
For example, there's a bar brawl and they're patting down everybody and someone's got a gun. "Have you paid your fee? You have insurance?" "No." OK, well, there's an opportunity for us to remove the gun. And then when the gun owner comes back and demonstrates that they comply with the law and they're a lawful gun owner, they get their gun back. But in the meantime, you've taken a gun out of a bar brawl. And that's not a bad thing.
Liccardo then took exception to the suggestion the city fee is actually a tax on guns:
I don't blame anyone for being emotional about this. These are really important issues that go to the core of what we believe about freedoms and rights and our own safety. But I'd say this. First, it's a fee, it's not a tax, and I won't go into the details about what the difference is, but the reality is that in this country, there have been taxes on guns and ammunition since at least 1919, and they've been upheld by the courts. So the fact that there's a constitutional right attached somewhere to the exercise of a particular activity doesn't mean it can't be regulated, taxed, or have a fee imposed.
The text of the Second Amendment ends with four words, "Shall not be infringed."

A US news outlet published a report regarding WE Charity's involvement with California Governor Gavin Newsom, while a number of Canadian parliamentary committees continue to investigate the organization and its ties to the Liberal government.
According to ABC7 NEWS, approximately 1,400 schools and nearly 400,000 students in the state were funnelled through WE Charity programs with the endorsement of Newsom.
Between 2014 and 2016, while Newsom was still the Lt. Gov. of California, he became a co-chair of WE Day California alongside his wife, Jennifer Newsom.
During a 2016 WE Day California event, Newsom delivered remarks alongside San Jose Mayor Sam Liccardo.
"No one is given a ticket here, you have to earn the right to get here," said Newsom at the time.
Newsom's involvement with the charity extended beyond even speaking engagements, after a letter sent to former California State Superintendent Tom Torlakson revealed that Newsom had urged Torlakson to have school districts and administrators attend WE Charity's event.
State records also reveal that a request by Newsom led to a donation from Comcast to WE Charity totaling $242,500. Additionally, it was revealed that another organization with ties to WE founders Craig and Marc Keilburger sent Newsom and his wife baby gifts worth $110.
"Over the years, WE Charity has provided youth volunteerism programs to 18,000 schools in Canada, the United States and the United Kingdom, empowering young people to help more than 5,000 causes. In California, WE Charity serves 1,400 schools and educational groups with free curricular programs supporting youth service, youth mental health, and trauma-informed learning programs," WE Charity said in a statement provided to ABC 7 NEWS.
Currently, Prime Minister Justin Trudeau is being investigated by the Office of the Conflict of Interest and Ethics Commissioner regarding his involvement in WE being awarded a $900 million student service grant last summer despite the Trudeau family receiving close to half a million dollars in compensation and reimbursements from the group.
During the most recent testimony by the Kielburgers before the House of Commons ethics committee, Marc Kielburger blamed the Trudeau government of "hiding behind" the children's charity to avoid a political scandal.
"WE Charity agreed to help, that's what charities do, they help for what is needed. We didn't advise the prime minister and Minister Morneau to not recuse themselves, we never prorogued parliament, we're not involved in the decision to filibuster the committee this fall," said Marc Kielburger.
"This is a political scandal for the government, not WE Charity. The government hid behind a children's charity by letting it take the fall for their political decisions, and the opposition allowed them."

Multiple victims are dead after a mass shooting early Wednesday at a Valley Transportation Authority (VTA) light rail yard in San Jose, California, according to sources cited by the San Jose Mercury News.
The alleged shooter is also dead, the Santa Clara County Sheriff's Office said. The gunfire reportedly erupted shortly after 6:30 a.m. PT.
VTA spokeswoman Brandi Childress told The Daily Beast that the shooting occurred at the Guadalupe light rail maintenance yard, and resulted in "multiple casualties" but "the extent of the injuries is still being determined."
"All employees were evacuated. The sheriff's office which is just down the street from the location is the reunification center for employees and family members who may be looking for them," she added. San Jose Mayor Sam Liccardo said in a tweet that "several" people are being treated for injuries, but that the facility has been evacuated and the shooter "is no longer a threat."
The circumstances of the shooting remain unclear, but the mother of a VTA employee reportedly contacted KTVU to say her son called to say he was sheltering in the auditorium of the Santa Clara County Sheriff's Office, and that the shooting occurred during a union meeting.
The violence comes amid a spate of gun violence across the nation, including a "targeted attack" at a New Jersey birthday party last weekend that killed three.
