The Curious Fraud Case Against Trump Just Got 'Curiouser'
1/2
"Curiouser and curiouser." Those words from Alice in Wonderland seem the only apt description of the case unfolding in the New York courtroom of Justice Arthur F. Engoron over the alleged fraudulent practices of former president Donald Trump, his family and his business.
The charges brought by New York State Attorney General Letitia James were curious from the start. James had run for office on the pledge that she would hunt down Trump, a promise that apparently thrilled many New Yorkers. However, she brought a civil case based on Trump over- and under-estimating the values of his properties.
As some of us have previously stated, there do appear to have been assets that were inflated or deflated in value. That may be a common practice in New York real estate, but it is not a good practice. Indeed, I believe a penalty is warranted for such practices, but those should be uniformly imposed and would be a fraction of the fortune sought by James in this case.
The evidence shows that banks made money on these loans, which were paid off either early or on time. In fact, none of the banks complained about the Trump organization's estimations, which were accompanied by a warning that the banks should not rely on those estimates.
Moreover, James is seeking to kill a corporation once viewed as iconic in New York, not just by denying the certificates for the Trumps to do business in the city but by imposing $250 million in penalties for money that no one actually lost.
That all became curiouser this week when two bankers were called by the defense. Rosemary Vrablic and David Williams worked on Deutsche Bank loans to the Trumps for years, and they testified that the banks made millions and viewed Trump as a much-sought-after "whale" client - what Vrablic described as a "very high net-worth individual."
Williams testified that net worth is "subjective" in such documents as property valuations and are offered as mere "estimates." It is not uncommon for a bank's estimates to differ from a client's.
Vrablic wrote emails at the time about the benefits to the bank in dealing with the Trumps, as well as pitches to the family that the bank was happy to extend conditions which allowed added benefits of "flexibility, rate and service" to get the business relationship.
Justice Engoron seemed irritated by the testimony, however, and when Trump counsel asked why the bank was so eager to secure future loans, Engoron snapped back: "They're trying to make money. Why wouldn't they be interested?"
The real question here is James' overriding interest in killing the company. Engoron has already declared that Trump is guilty of fraud, and he is now weighing the massive penalties sought by James - and eagerly supported by many New Yorkers....

POTUS!
Donald J. Trump
@realDonaldTrump
"Another Deutsche Bank managing director at the time, Rosemary Vrablic, testified that the bank's revenues from its relationship with Trump went up and up in the early 2010s. 'Her division's revenue from Trump business shot up from about $13,000 in 2011 to a projected $6 million in 2013, according to a bank document,' the Associated Press reported. Deutsche Bank executives, per the Associated Press, referred to Trump as a 'whale' of a client, one they enthusiastically pursued.
In 2014, also according to the Associated Press, Vrablic's 'direct boss went to lunch with Trump to thank him and 'ask whether we can work on other opportunities with them,' according to a document for that meeting.'
In short: Deutsche Bank did its own research for the loans. It made the loans. Trump paid the loans. Deutsche Bank made a big profit. Bank officials were happy and wanted to do more business with Trump." washingtonexaminer.com/opinion

NY Prosecutor Scrambles To Salvage Anti-Trump Case, Argues Deutsche Bank Being Happy Is 'Irrelevant'
It gets even better…
Not only did that completely dismantle the prosecution's core argument that the bank was harmed by Trump inflating his assets, Trump's former private banker, Rosemary Vrablic, testified on Wednesday that the bank had aggressively pursued the real estate mogul as a 'whale' client.
"We are whale hunting … haven't seen him yet," she told bankers in a Nov. 29, 2011 email entered into evidence by Trump's defense team and displayed on screens during the trial. "Also maybe Dad will convert like Ivanka did," she added.
Vrablic is one of four current and former employees called to testify this week as part of Trump's defense against claims brought last year by New York Attorney General Letitia James. The state alleges Trump inflated his net worth by as much as $3.6 billion a year to get better terms from banks and insurers, reaping $250 million in "illegal profit" over more than a decade.
While James has portrayed Deutsche Bank as a victim of Trump's lies, the former president is seeking testimony supporting his argument that lenders were eager to do business with him and weren't bothered by discrepancies in the value of his assets. -Bloomberg
What's more, Trump attorney Jesus Suarez on Wednesday asked Vrablic to comment on internal documents from 2014 which described plans to build "lasting, broad private banking relationships" with a list of US clients.
Vrablic, who brokered a loan for Trump's Doral golf course in Florida as well as properties in Chicago and Washington, testified that Trump fit the bill because "he was in the US commercial real estate market and had a successful track record."
Internal documents further showed that the bank made $6 million from Trump loans in 2013 alone.

Did Deutsche Bank Just Destroy New York AG's Case Against Trump?
A Deutsche Bank executive may have just tanked New York Attorney General Letitia James' lawsuit against former President Donal Drump - which revolved around portraying the German lender as Trump's biggest victim in an alleged scheme to inflate his assets in order to obtain favorable terms from banks and insurers.
David Williams, who directly worked on at least one of several loans obtained by Trump over several decades, testified on Tuesday in Manhattan that it's "atypical, but not entirely unusual" for a bank to internally slash a client's stated asset values by 50% and approve a loan anyway, as they did with Trump, Bloomberg reports.
"It just depends on the circumstances," said Williams, a managing director at the bank.
Deutsche Bank, which loaned hundreds of millions of dollars to Trump for properties in Miami, Chicago and Washington, cut his stated net worth in 2011 and 2012 from about $4.2 billion to $2.3 billion, according to internal bank credit memos. The same documents indicated the bank approved the loans anyway because it expected them to generate a profit based on Trump's history of successful developments and other criteria.
Trump, who denies wrongdoing and claims the case is politically motivated, is calling to the stand this week four current and former Deutsche Bank employees — including the family's former private banker Rosemary Vrablic - as part of his defense case, seeking to flip the script on the state's version of events. -Bloomberg

Trump's son-in-law problem
Blah blah blah...
Donald Trump, costing Senate seats bybacking inferior candidates for nomination.Trump's responsehas been churlish at best, striking out at Ron DeSantisand even Glenn Youngkin.
Meanwhile, Gov. DeSantis played 2022 like a fiddle, redirecting the focus back onto the millions of illegal aliens pouring across the border...DeSantis and his Florida Republicans then pulled off a tsunami of a Red Waveon Tuesday night.
Team Trump noticed, & Jared Kushner was out early to complain. If you recall,it was Kushner who worked against the Border Wall & other Trumpian policies, who pushed out Steve Bannon and his allies in the White House and brought in so many D.C. lifers==, like the generals - Kelly, McMaster, and Mattis - who hated Trump.
It wasKushner who took over COVID policy (Mike Pence was just a figurehead) and empowered Fauci and Birx to run the response to the pandemic
Apparently, things were so bad in late 2020 that Peter Navarro led a "coup" to get Kushner fired, butJared and Ivanka simply ignored Trump's request to leave.
So who is this all-powerful son-in-law, anyway? It's important to understand thatKushner's influence is not just from the fact that Trump adores Ivanka and will give her just about anything she asks. He is deeply indebted to Jared himself. After Trump's near-business-death experiences, it was Jared, the scion of the billionaire Kushner family, who came to his rescue.
Having burned his old lenders with Atlantic City casinos and the Plaza Hotel deal, Trump was able to get a lifelineat the Deutsche Bankto build his Chicago hotel project, but he soon defaulted there also and wound up in litigation in 2011.
But coming to the rescue were the new son-in-law and Jared's buddy in another division of Deutsche Bank, Rosemary Vrablic. Trump then got all the refinancing he needed to stay afloat and keep going.
It turned out that Vrablic was a bit too close to the Kushners, and she was later herself fired by the bank when it came out she was doing real estate deals with them on the side. No matter.
And again, it wasKushner and his friends- Steve Roth of Vornado Realty and a tiny bank in San Diego - who justrecently arranged sales and refinancing of the lion's share of troubled Trump properties, leaving The Donald sitting pretty, with a mountain of cash. So, in any contest for influence inside Team Trump, there can only be one winner: Jared. He has the keys to the mint -the trust of powerful lenders Trump can't live without.
Kushner and his family have had their own financial problems, namely 666 5th Ave., the massive NYC office tower that threatened to ruin them. After Trump was elected president, Jared took over the Middle East desk for Trump, and suddenly the Kushner family entreaties to Qatar's sovereign wealth fund to buy 666 off their hands were no longer ignored. A lot of suspicious people think Jared got his friends in Saudi Arabia to lighten up their sanctions on Qatar, and as a reward, Qatar's Brookfield Properties bailed them out. Democrats have long been investigating the deal, but I doubt they even know where to begin.
After Jared returned to the private sector, he also formed a venture firm, like Hunter Biden, with no previous experience. Buthe did manage to get $2 billion from the Saudis, thesame Saudi fund, in fact, investing in LIV Golf, which is working with Trump golf coursesand now has a pay-for-play deal with Fox Sports. Democrats were also investigating all this.
The latest Kushner mess may even be the juiciest of all. Jared's droopy little brother, Joshua (married to supermodel Karlie Kloss) is at the center of what Kanye West says was the ripping off his share in ex-wife Kim Kardashian's underwear line. With West's money and career going down like MC Hammer, he will have a lot of time on his hands the next few years to complain about the Kushner family.
While the Democrats have until now never been able to land a punch on Trump's son-in-law, someone with more savvy and political know-how might - say, the Governor of Florida. DeSantis wouldn't even have to say anything bad about Trump himself.Just pummel Jared for the rotten job he did on the campaign, running the White House, the pandemic response, border security, and the continuing crime wave.
Rather than be angry, a lot of die-hard MAGA folks might even cheer him on as their b?te noire got his just desserts. Mr. Trump has always had a lot of untalented courtiers, from Michael Cohen to Omarosa Manigault, whom he had no trouble dismissing. But the problem with a son-in-law is, it's not so easy to just say, "You're fired!"

Deutsche, Signature Bank Abandon Trump Over Capitol Unrest
Whatever disappointment President Trump is feeling about being barred from his Twitter and Facebook accounts, he's probably more upset about this: Deutsche Bank, one of the Trump Organizations biggest lenders from the past 20 years, says it will no longer do business with the Trump family, according to the NYT.
Another bank, Signature Bank, where Trump has checking, savings and money-market accounts, said that it would close accounts belonging to Trump worth some $5.3MM.
NEW: Banks are moving away from Trump & his company.
- @DeutscheBank won't work with him in the future, source says.
- Signature Bank, which long had close ties with Trump and Kushner, is closing his accounts. with @EricLiptonNYT @SteveEder @maggieNYT https://t.co/Zu7HzJAS6z
- David Enrich (@davidenrich) January 12, 2021
What's more, Signature Bank, where Ivanka Trump once sat on the board, is officially calling on Trump to resign, saying that while it hopes to soon go back to assiduously avoiding politics, the president had put Signature in an uncomfortable position.
"We believe the appropriate action would be the resignation of the president of the United States, which is in the best interests of our nation and the American people," the bank said in a separate statement on Monday.
For years, Signature has served Trump and others in his orbit, including Ivanka, Jared Kushner and even Michael Cohen. It even helped finance the construction of Trump's Florida golf course. But the bank added that not only would it stop banking with Trump, it would also bar any lawmakers who backed the election challenge from banking there as well.
The head of Deutsche Bank US also released a statement calling Wednesday's Capitol riot a "dark day" for American democracy.
"Yesterday was a dark day for America and our democracy," Deutsche Bank Americas head Christiana Riley posted on LinkedIn. "We are proud of our Constitution and stand by those who seek to uphold it to ensure that the will of the people is upheld and a peaceful transition of power takes place."
As the NYT reported shortly before the election, Trump still owes about $300MM in a series of personally guaranteed loans to DB that come due in 2023 and 2024. That doesn't give him a ton of time to work out new deals, but his son Eric Trump has insisted that some deals involving foreign partners are in the works. Rosemary Vrablic, the DB banker who managed the relationship with the Trumps, left DB shortly after the election
A lot could change in that time. For all we know, DB could change its mind and offer Trump an opportunity to roll over the remaining balance that he can't afford to pay back (the bank has already lent Trump money against its better judgment once).
DB faced pressure from lawmakers throughout Trump's term in office after it was revealed that the bank was the Trump Organization's primary lender since the late 1990s. Now, according to the NYT, the bank has determined that, short of forgiving Trump's massive debt, the bank has few options for extricating itself from its business ties to Trump.
All of this practically ensures that Trump will need to look abroad for financing if he wants to roll over the DB loans. When that happens, we imagine Democrats will be waiting to pounce and accuse him of trading American secrets for financial favors.

Longtime Trump Banker Investigated Over Kushner-Linked Deal Resigns From Deutsche Bank
Less than six months after Deutsche Bank launched an investigation into Rosemary Vrablic, longtime personal banker to President Trump and son-in-law Jared Kushner, the elite banker is resigning along with colleague Dominic Scalzi.
Vrablic, a managing director and senior director in Deutche Bank's wealth management division, is stepping down effective Dec. 31 for unknown reasons, however in August the bank launched an investigation into a 2013 transaction in which Vrablic, Scalzi and others purchased a $1.5 million Park Avenue apartment from a company called Bergel 715 Associates, which Kushner and wife Ivanka Trump held an ownership stake at the time.
The transaction, which posed a potential conflict of interest in violation of firm rules, was discovered by the New York Times after Kushner disclosed that he had received between $1 million and $5 million in 2019 from Bergel. And now, the Times has its scalp.
"I've chosen to resign my position with the bank effective Dec. 31 and am looking forward to my retirement," said the 60-year-old Vrablic in a statement.
Ms. Vrablic and Mr. Scalzi joined Deutsche Bank in 2006 from Bank of America. Ms. Vrablic quickly made a name for herself as one of her division's leading rainmakers. In 2011, she landed a prominent new client: Mr. Trump, who for decades had been mostly off-limits to the mainstream banking world because of his tendency to default on loans. With her bosses' approval, Ms. Vrablic agreed to a series of loans, totaling well over $300 million, for his newly acquired Doral golf resort in Florida, for his troubled Chicago skyscraper and for the transformation of the Old Post Office building in Washington into a luxury hotel. -NYT
After Trump became president, congressional Democrats, special counsel Robert Mueller, and regulators put his finances under a microscope - during which Vrablic's role in his life pushed the publicity-shy banker into the spotlight.

Deutsche Bank launches investigation into longtime banker of Trump, Kushner
Deutsche Bank launched an internal investigation into the longtime personal banker for President Trump and his son-in-law, Jared Kushner, a bank spokesman confirmed to The Hill on Sunday.
The New York Times first reported Sunday that the bank was looking into Rosemary Vrablic to determine if she had acted improperly when she and two colleagues bought an apartment for about $1.5 million in 2013 from Bergel 715 Associates.
In a financial disclosure report filed Friday, Kushner and his wife, Ivanka Trump, said they had received $1 million to $5 million from Bergel 715 in 2019. The couple had not previously reported having an ownership stake in the company.
A person familiar with Kushner's finances told the Times he had an ownership stake in Bergel 715 at the time Vrablic bought the apartment. The 2019 reported income is unrelated to Vrablic's purchase in 2013.
The Times reported Deutsche Bank did not know Vrablic and her colleagues had bought the apartment from a company Kushner had a stake in until it was contacted by the newspaper.
"The bank will closely examine the information that came to light on Friday and the fact pattern from 2013," bank spokesman Daniel Hunter said.
Kushner and President Trump were clients of Vrablic at the time of the 2013 sale and had received about $190 million in loans from Deutsche Bank. Both were also granted hundreds of millions of dollars after that point, according to the Times.
Banks usually prohibit employees from conducting personal business with clients out of concerns of conflicts of interest.
But Christopher Smith, the general counsel for Kushner Companies, told The Hill in a statement that "Kushner is not the managing partner of that entity and has no involvement with the sales of the apartments."
Vrablic's lawyer, a senior private banker and managing director at Deutsche Bank, declined to comment to the Times.
It is unclear how big Kushner's stake is in the company, which has sold several condo units in the apartment building since the 1980s, according to records viewed by the Times. At least one apartment had been sold to Kushner Companies.
The Times noted that there is no evidence Vrablic and her colleagues purchased the apartment at a below-market price. The apartment was also sold at "a not-unheard-of 22 percent increase from the 2013 purchase price," the newspaper reported.
Kushner testified during a 2017 closed-door House Intelligence Committee meeting that he introduced Vrablic to the president.
The president borrowed $175 million for his Doral golf resort and the Trump International Hotel & Tower in Chicago in 2012. The bank had also lent him money to create his Trump International Hotel in Washington, D.C., out of the Old Post Office building.

Deutsche Bank Executive Who Signed Off On Trump Loans Kills Himself At Age 55
Thomas Bowers, a former Deutsche Bank executive and head of the American wealth-management division, killed himself in Malibu, California, on Tuesday, November 19th, according to the coronor's initial report.
First reports of his death were reported by the New York Times David Enrich.
Bowers was the boss of Trump's personal banker Rosemary Vrablic, according to a New York Times article in early 2019. Vrablic's other clients have included Jared Kushner and Stephen M. Ross.
Vrablic reportedly attended the Trump inauguration in the VIP section, and expects to be called before Congress regarding Trump's relationship with the bank.
The Los Angeles County Medical Examiner/Coroner reported that Bowers died by suicide by hanging at his residence on the 19th.
One source who has direct knowledge of the FBI's investigation into Deutsche Bank said that federal investigators have asked about Bowers and documents he might have. Another source who has knowledge of Deutsche Bank's internal structure said that Bowers would have been the gatekeeper for financial documents for the bank's wealthiest customers.

Deutsche Bank Refused To Lend To Trump During 2016 Race: NYT
As the chairwoman of the House Financial Services Committee prepares to subpoena Deutsche Bank, which she described in a recent interview as "perhaps the biggest money laundering banks in the world", the New York Times on Saturday revealed that just as Trump was winning primaries in New Hampshire and South Carolina in March 2016, DB refused to expand a loan to the Trump Organization, which had been requested to pay for renovations at Turnberry, one of Trump's golf clubs in Scotland. The money was to be backed by Trump's golf club in Doral, Fla.
At the time, the bank already had hundreds of millions of dollars in loans oustanding to the Trump Organization, and Trump's go-to bankers in Deutsche's private banking unit were inclined to approve his request. However, senior executives at the bank - including now-CEO Christian Sewing - were skittish because of the "reputational risks" pertaining to Trump's divisive statements on the campaign trail. They also were uncomfortable with the political risks, fearing that if Trump won and then defaulted on the loan, Deutsche would be left in the awkward position of having to seize assets from the president of the US.
According to the NYT, Trump asked for the money at a time when he was lending tens of millions of dollars to his campaign. But as the request wound its way to a committee of senior executives in Frankfurt, executives at the bank reportedly became aware for the first time just how much business DB had with the New York real estate developer who would soon become president.
Since Trump's relationship with Deutsche first blossomed in the late 1990s, when the bank agreed to lend him $125 million to finance renovations on a Wall Street skyscraper, the relationship has endured its ups and downs.
At the time, Deutsche was struggling to break into the US market and was more tolerant of risk than its US peers, who had more or less severed ties with Trump after a series of bankruptcies in the early 1990s.
Though it was rocky at times (Trump sued DB during the apex of the financial crisis), his relationship with the bank continued through the dawn of his political career.
The relationship between Mr. Trump and Deutsche Bank had survived some rocky moments. In 2008, amid the financial crisis, Mr. Trump stopped repaying a loan to finance the construction of a skyscraper in Chicago - and then sued the bank, accusing it of helping cause the crisis. After that lawsuit, Deutsche Bank's investment-banking arm severed ties with Mr. Trump.
But by 2010, he was back doing business with Deutsche Bank through its private-banking unit, which catered to some of the world's wealthiest people. That unit arranged the Doral loans, and another in 2012 tied to the Chicago skyscraper.
Mr. Trump's go-to in the private bank was Rosemary Vrablic, a senior banker in its New York office. In 2013, she was the subject of a flattering profile in The Mortgage Observer, a real estate magazine owned by Mr. Trump's son-in-law, Jared Kushner, who was also among her clients. In 2015, she arranged the loan that financed Mr. Trump's transformation of Washington's Old Post Office Building into the Trump International Hotel, a few blocks down Pennsylvania Avenue from the White House.
In a statement to the Wall Street Journal, a rep from the Trump organization denied that it had sought money for Turnberry in 2016, and denounced the NYT story as "absolutely false."
"This story is absolutely false. We bought Trump Turnberry without any financing and put tens of millions of dollars of our own money into the renovation which began in 2014. At no time was any money needed to finance the purchase or the refurbishment of Trump Turnberry," she said.
In a separate but similar story, the Wall Street Journal reported on Saturday that Deutsche Bank rushed to offload a $600 million loan to Russian state-controlled banking giant VTB in late 2016 as the German lender sought to limit its exposure to Russia following the infamous mirror trading scandal.
The bank decided to shed the loan amid worries about its financial relationships with Russian entities. And though WSJ couldn't figure out how VTB used the money that DB lent it, a Deutsche spokesman insisted that the money wasn't intended to benefit President Trump or his businesses as part of some back-door deal.
