Eleven former high-ranking Border Patrol officials called the situation 'grave' and warned that 'criminal organizations are capitalizing on this crisis' in a first-of-its-kind letter on Wednesday.

Among them were four retired Chiefs of the United States Border Patrol who were joined by five former Chief Patrol Agents in writing a letter to Congress urging them to address the 'broken immigration system.'

The letter is addressed to Senate Majority Leader Chuck Schumer and House Speaker Nancy Pelosi - as well as Senate Minority Leader Mitch McConnell and House Minority Leader Kevin McCarthy.

'On behalf of retired Chiefs of the United States Border Patrol, we write with grave concern regarding the current crisis on the southwest border,' reads the letter.

'It is time to address our broken immigration system as well as the push and pull factors encouraging mass migration, and its impacts on border security.'

The letter continued: 'The cycle of broken immigration crises must be a priority for Congress. The patchwork system in place continues to fail us all.'

'Criminal organizations are capitalizing on this crisis, exploiting these vulnerable unaccompanied children and their families while at the same time utilizing this distraction to overwhelm front-line Border Patrol agents,' the letter added.

The letter was signed by Border Patrol Chiefs: David V. Aguilar, Ronald Vitiello, Ms. Carla Provost, and Michael Fisher.

Villareal, who retired in December, told Fox News that 'there is a monumental border issue at the border right now that is going to overwhelm the capabilities of the Border Patrol.'

'It's going to cause our system to shut down because as these populations increase, the unaccompanied children, the family units takes away from the ability to do effective border security,' he said.

Karisch told CNN: 'This is a problem we've had for many years.'

'Look back at 2014 with the unaccompanied children crisis. We didn't have the infrastructure then. We definitely were suffering from that same problem under the previous administration,' he said.

'This is something that both sides keep pointing fingers at, but unfortunately it's the agents in the field that are having to deal with a very serious issue but one that also takes them away from their law enforcement responsibilities.'

Sen. Kamala Harris (D-CA) once likened Immigration and Customs Enforcement (ICE) to the Ku Klux Klan, contending that a "perception" existed that the organization utilized the same tactics as the racist group.

Controversial aspects of Harris's record are emerging to the forefront following Joe Biden (D) announcing her as his running mate. A debate has emerged among Democrats regarding Harris's ideology. Many "Bernie Bros" do not believe she is progressive enough and point to the praise she has garnered by the establishment left. However, a look at Harris's past statements shows that she, too, shares the radical views as the country's far-left progressives, including the calls to "critically re-examine ICE."

While progressive critics say that she stopped short of calling for "abolishing ICE," she made her view of the agency abundantly clear during a November 2018 hearing with former ICE chief Ronald Vitiello:

Harris questioned Vitiello for once describing the Democrat Party as the "liberalcratic party or the NeoKlanist party," for which he apologized.

The California senator used the opportunity to liken ICE to the racist group.

"The Klan was what we could call today a domestic terrorist group," Vitiello said.

"Why?" Harris asked.

"Because they tried to use fear and force to change the political environment," Vitiello explained, prompting Harris to ask, "And what was the motivation for the use of fear and force?"

"Based on race and ethnicity, " Vitiello said, as Harris attempted to draw a parallel between ICE and the KKK, contending that she was talking about a "perception."

"Right," Harris said. "And are you aware of the perception of many about how the power and discretion at ICE is being used to enforce the law and do you see any parallels?"

Vitiello told the lawmaker that he did not see any, which did not sit well with Harris.

"How can you be the head of an agency and be unaware of how your agency is perceived by certain communities?" Harris asked.

Vitiello ultimately told Harris that many perceptions of the agency - in both the media and public eye - are "incorrect." He later referred to her attempt to maim the agency as "unprofessional, unfair," and a "disgrace" in a statement to the Washington Times.

"I thought it was totally unprofessional, unfair," he said. "She can say whatever she wants about me personally, but she was trying to tar the whole agency. I think it was a disgrace."

While Harris has stopped short of calling for the total abolishment of ICE, she has floated "starting from scratch."

Trump Picks Mark Morgan to Head ICE

WASHINGTON-Filling another gap created by a big Department of Homeland Security shake-up, President Donald Trump has tapped former Border Patrol Chief Mark Morgan to lead Immigration and Customs Enforcement (ICE). "I am pleased to inform all of those that believe in a strong, fair and sound Immigration Policy that Mark Morgan will be joining the Trump Administration as the head of our hard working men and women of ICE," Trump wrote on Twitter on May 5. "Mark is a true believer and American Patriot. He will do a great job!"

Morgan served as former President Barack Obama's Border Patrol Chief at the end of 2016 and the beginning of 2017. He is also a 20-year veteran of the FBI. Trump removed Morgan six days after taking office in January 2017 and replaced him with Ronald Vitiello. Subsequently, Vitiello moved to acting director of ICE after Tom Homan retired in June 2018. And now, Morgan will replace Vitiello. Morgan has been in the public eye about border security in the last few months, vociferously supporting a border wall and the need for Congress to change legal loopholes that are allowing for hundreds of thousands of bogus asylum claims.

In an exclusive interview with The Epoch Times on April 24, Morgan said the current crisis on the border is the "worst in our history." "The border is still 60 percent wide open, meaning it doesn't have enough infrastructure, technology, and personnel," Morgan said. "And because anywhere from 25 to 40 percent of Border Patrol resources are being pulled away and dedicated to the humanitarian side, the border is even more wide-open for the cartels to do what? Exploit. To bring drugs, contraband, and bad people in." Morgan's new job is focused on interior enforcement, investigations into trafficking, and preventing terrorism.

In our recent interview, Morgan touched upon several things he thinks ICE can do to stem the flow of illegal immigration, especially the huge influx of economic migrants from Central America. "I think we need to pass a regulation that will actually give ICE the ability to detain family units while they're going through the immigration process," Morgan said. "At the same time, let's reinstitute what they used to do called 'port courts.' That means we shoot all the assets, a whole government approach down to the border, everything that you need, soup-to-nuts, to be able to have the immigration hearing and do that quickly. And then, if those claims are found to be substantiated, then they'll be allowed in. If not, we remove them immediately. "And so the last part of that is we need to ramp up our interior enforcement. There are over a million illegal immigrants who entered the country illegally, filed a false claim, have received due justice through the immigration proceedings, and they've found to be false, and they've received a deportation order removal. A million, and they still remain here illegally. We can't wait for Congress. We need to act ourselves."

Trump removed Vitiello from his post at ICE early April, saying the agency is "going in a little different direction." "Ron's a good man. But we're going in a tougher direction. We want to go in a tougher direction," Trump said April 5. Two days later, Kirstjen Nielsen left her post as Secretary of Homeland Security, and then-CBP Commissioner Kevin McAleenan assumed the mantle of acting secretary.

I chuckled when I saw this news at Newsweek because the phrase "fake families" shows that this Administration gets it!

'Fake family?
As I've been telling you, the Left generally controls the language and their widespread use of the phrase "new Americans" is one such example.

For Open Borders activists, "New Americans" is an all-encompassing way to describe all migrants, whether legal refugees or illegal aliens, meant to erase any differences between them and make the uninformed listener or reader feel warm and welcoming toward all.

Kudos to the Trump team for coining the phrase "fake families" to describe those arriving illegally at our border with a child in tow (someone else's child in tow!).

By the way, there were thousands of fake Somali families discovered by the US State Department in 2008 causing the entire family reunification program for Somalis to be closed for years. See one early post here at RRW.

The U.S. Immigration and Customs Enforcement agency revealed on Monday that it is reallocating resources to the Southwest border in a bid to crack down on "fake families seeking to exploit U.S. immigration laws."

The Trump administration has repeatedly warned of "fake families" arriving at the U.S.-Mexico border in recent months, with Department of Homeland Security officials claiming that migrant children are being kidnapped by smugglers and then sent to the border with "fake" parents to help their chances of making a successful asylum claim in the U.S.

"ICE Homeland Security Investigations (HSI) is redirecting resources to the border in response to cases of fake families using forged documents to illegally enter our country and avoid detention," ICE Acting Director Matthew Albence, who recently replaced resigned ICE chief Ronald Vitiello, said in a statement published online.

"Our highly skilled teams are working to stop individuals, networks and organizations facilitating child smuggling and document fraud," Albence said.

In one case, the agency said HSI special agents identified two suspect family units presenting themselves as two fathers with their sons on April 22. The agency said the four individuals, two of whom were found to be 23-year-old men pretending to be minors, are now being prosecuted for visa fraud and making false statements.

In another case, ICE said an adult Honduran man had presented a false birth certificate for a 7-year-old child who was traveling with him. During an interview, the man admitted that he was not related to the child, the agency said. As a result, the man was prosecuted for illegal entry, and the child was turned over to the care of the federal Office of Refugee Resettlement as an unaccompanied minor in accordance with procedures outlined in the Trafficking Victims Protection Reauthorization Act.

New Homeland Security chief urges Congress to address border crisis

Acting Homeland Security Secretary Kevin McAleenan urged Congress on Wednesday to address what he called "both a humanitarian and security crisis" at the U.S.-Mexico border.

In his first public appearance since he replaced Kirstjen Nielsen last week at the Department of Homeland Security, McAleenan emphasized that lax asylum and immigration laws encourage Central American migrants to trek to the border.

"Without action from Congress, criminals will continue to profit from human misery along our border," McAleenan said at a press conference near the border in Hidalgo, Texas. "It's clear that all of our resources are being stretched thin. The system is full and we are beyond capacity."

McAleenan, who was previously Trump's Senate-confirmed Customs and Border Protection commissioner and a former Obama administration official, warned that a rising tide of migrants at the border will place more strain on law enforcement and local service providers.

"We don't have room to hold them, we don't have the authority to remove them, and they are not likely to be able to be allowed to remain in the country at the end of their immigration proceedings," he said.

McAleenan takes the job as arrests along the border are soaring. In March, Border Patrol picked up nearly 93,000 migrants, the highest monthly level since April 2007. Over the past year, border arrests remained well below historic peaks during the 1990s and early 2000s, but that could change if the pace of new arrivals fails to slacken.

Families made up more than half the March total, a new trend that McAleenan and other officials argue presents unique health and safety challenges.

The administration contends that migrants will be deterred from trekking north if Congress grants DHS broader enforcement authority. The White House has pressed lawmakers to permit children to be detained for longer than 20 days and to allow unaccompanied minors from Central America to be deported more swiftly.

Democrats, however, have countered that Trump's hard-line immigration policies haven't worked and have exacerbated an ongoing humanitarian crisis at the border.

The acting secretary was joined Wednesday by Matthew Albence, who became the top Immigration and Customs Enforcement official last week when former acting director Ronald Vitiello was pushed out.

Albence, the acting deputy director, said hundreds of ICE personnel had been reassigned recently to assist with the custody and processing of migrant families at the border.

"This reallocation of resources comes at a significant cost," said Albence, who donned a pair of reflective aviator sunglasses during the press conference. "Criminal aliens, gang members and public safety threats remain at large because [ICE officers] needed to locate and apprehend them have been redirected to process family units and manage the ever-increasing immigration court dockets."

Also in attendance was Rodolfo Karisch, the Border Patrol sector chief for the Rio Grande Valley.

Former Trump official: Nielsen was 'obstructionist' who wouldn't fire 'deep state' employees in DHS

Outgoing Department of Homeland Security Secretary Kirstjen Nielsen triggered her own demise by refusing to fire a pair of agency officials that were slow-walking President Trump's immigration agenda, says a former administration official who worked with all three people. "I think she was an obstructionist to getting rid of the bad people," the official, who asked to speak on background in order to speak openly, said in a phone call with the Washington Examiner Tuesday. The official specially mentioned the department's General Counsel John Mitnick and Citizenship and Immigration Services Director L. Francis Cissna - both of whom have been reported to be next on Trump's chopping block. Their departures would follow what's already been nearly a week of upheaval at DHS. In addition to getting rid of Nielsen, Trump rescinded the nomination of acting ICE Director Ronald Vitiello and terminated Secret Service Director Randolph Alles from his position.

Mitnick and Cissna are under scrutiny for not aggressively pursuing Trump's approach to stopping illegal immigration along the U.S.-Mexico border. Both are holdovers from the DHS of John Kelly, who headed the department for the Trump administration's first six months or so, before becoming the president's chief of staff. "When Kelly left, they never took the bad people with them. Everyone makes bad hiring decisions, [but] you don't leave them on." The former official named Mitnick as the "reason why most of the immigration policies from DHS never came to fruition." Mitnick, in particular, is getting blame from Trump allies for details implementing a 2015 court ruling mandating that children who arrive at the border with parents cannot be held more than 20 days in Immigration and Customs Enforcement custody.

A DHS official slammed the allegations. "Outside voices criticizing the department's general counsel for working to assiduously to follow the law while implementing the president's security first agenda likely know little about the law, and less about homeland security," the official said. Trump administration officials contend the court ruling is the reason why record-high numbers of Central American families have traveled to and illegally entered the country at the U.S.-Mexico border. That's because DHS lacks the space and legal ability to hold people for the duration of their asylum hearings.

The official said Mitnick's office is sorting through comments and making small changes to the language, but that it should not take two years to do. "John Mitnick got really good at letting this career and bureaucracy overwhelm him. You need someone that's going to be a fierce defender of what we're doing in the Trump administration, not someone who's gong to let the deep state run everything," the official said.

Cissna, meanwhile, likely hurt his own cause by having his office issue permits for those who illegally entered the U.S. to obtain work documents while they await asylum decisions, 90 percent of which are denied. "He's part of the reason we have a flood at the border," the official added.

But the DHS official broke with the rogue official again. "Director Cissna has restored USCIS' focus on national security, economic prosperity, and protecting U.S. workers. He has taken numerous steps to end illegal or inappropriate benefit programs and brought integrity to the immigration application process. He has wide support from conservatives on the Hill and in the homeland security community," the DHS official said. USCIS referred the Washington Examiner to a March list that cites 10 examples of how the agency is "improving the integrity" of the immigration system. The agency's list touted ways it says it has enhanced fraud detection among visa applicants and transparency among employment-based visa applicants."

According to Bloomberg, Secret Service Director Randolph Alles will be reassigned to another job within the agency, possibly a senior position within ICE, where he previously worked.

Alles confirmed on Monday that he would be leaving his position following reports that he had been fired by Trump amid an ongoing purge of DHS. Trump aide Stephen Miller, a well-known immigration hardliner, has reportedly been tasked with running the administration's immigration policy and is working to consolidate his control over the department.

Senator Mitt Romney said at a hearing of the Homeland Security Committee on Tuesday that he's "deeply troubled" by the vacuum at the top of DHS.

"It is dangerous," Romney said. "Dangerous given what's happening at the border, dangerous given the broad responsibilities the Department of Homeland Security has for protecting our nation. It is seriously troubling."

Alles said he had been alerted by the White House that he would be asked to step down weeks before the news broke. According to BBG, Trump likes Alles - who is a veteran Marine like former Chief of Staff and DHS Secretary Gen. John Kelly - and wants to find another role for him within the administration.

Alles confirmed on Monday that he would be leaving his position following reports that he had been fired by Trump amid an ongoing purge of DHS. Trump aide Stephen Miller, a well-known immigration hardliner, has reportedly been tasked with running the administration's immigration policy and is working to consolidate his control over the department.

Senator Mitt Romney said at a hearing of the Homeland Security Committee on Tuesday that he's "deeply troubled" by the vacuum at the top of DHS.

"It is dangerous," Romney said. "Dangerous given what's happening at the border, dangerous given the broad responsibilities the Department of Homeland Security has for protecting our nation. It is seriously troubling."

Alles said he had been alerted by the White House that he would be asked to step down weeks before the news broke. According to BBG, Trump likes Alles - who is a veteran Marine like former Chief of Staff and DHS Secretary Gen. John Kelly - and wants to find another role for him within the administration.

Border Patrol Official Drops Shocking Statistic On Nationalities Of Illegals Crossing Border

At least if you listen to Rio Grande Valley (RGV) Sector Chief Patrol Agent Rodolfo Karisch, who is, after all, a bit of an expert.

At a Senate Homeland Security Committee hearing on Tuesday, Karisch dropped a ton of data and statistics, but none was more eye-popping than this.

Karisch said that in his sector alone, border agents have captured people trying to enter the country illegally from more than 50 different countries, including Turkey, China, Bangladesh, Egypt and Romania. "People are traveling across hemispheres to attempt to illegally enter the U.S., using the same pathways as the Central Americans," he told lawmakers.

While Democrats claim President Trump is making up a fake crisis at the U.S.-Mexico border - and some presidential candidates, like former Texas Rep. Robert "Beto" O'Roarke, want to do away with all border barriers - Karisch said the influx of illegals is reaching epic proportions.

"Much media attention has focused on caravans coming across from Central America," Karisch said. "But the fact is that RGV is receiving caravan-equivalent numbers every seven days."

"Karisch noted that Border Patrol has apprehended more families illegally crossing the border in the first five months of fiscal 2019 than during all of fiscal 2018," Fox News reported. "Customs and Border Protection (CBP) apprehended more than 76,000 migrants across the border in February and said it was on track to apprehend more than 100,000 in March. In the Rio Grande Valley alone, Karisch said that at current pace, they would have more than 260,000 apprehensions in his sector by the end of fiscal 2019. There were 162,000 in RGV last year. He also said that his agents apprehend, on average, 1,000 people a day."

While partisan politicians who know nothing about the border claim Trump is playing politics, those in the know are repeatedly sounding the alarm that things are getting dire there. Last week, former Border Patrol Chief Mark Morgan, who served in the post during former president Barack Obama's time in the White House, told lawmakers that the crisis is "at a magnitude never seen in modern times" as he urged them to end the U.S.'s "open border policy."

"We're experiencing a crisis at the southern border at a magnitude never seen in modern times, it's unprecedented," Morgan told the Senate Homeland Security Committee.

Trump in February declared a national emergency and has threatened to shut down the entire U.S.-Mexico border. "If we don't make a deal with Congress...or if Mexico doesn't do what they should be doing...then we're going to close the border, that's going to be it, or we're going to close large sections of the border, maybe not all of it," he said in the Oval Office last week. He later gave Mexico a reprieve, saying officials there will have one year to shape up.

The president has been purging Homeland Security officials in an effort to get "tougher." Homeland Security Secretary Kirstjen Nielsen resigned Sunday (some say she was ousted) and Secret Service Director Randolph Alles was booted out on Monday. On Friday, the White House pulled its nominee for director of Immigration and Customs Enforcement, Ronald Vitiello, with Trump again saying he wanted to go in a "tougher direction."

More heads are expected to roll soon, news agencies report.

As President Donald Trump roils the capital over illegal immigration, his influential aide Stephen Miller is playing a more aggressive behind-the-scenes role in a wider administration shakeup.

Frustrated by the lack of headway on a signature Trump campaign issue, the senior White House adviser has been arguing for personnel changes to bring in more like-minded hardliners, according to three people familiar with the situation - including the ouster of a key immigration official at the Department of Homeland Security, whose secretary, Kirstjen Nielsen, announced on Sunday that she is resigning.

Miller has also recently been telephoning mid-level officials at several federal departments and agencies to angrily demand that they do more to stem the flow of immigrants into the country, according to two people familiar with the calls.

The pressure comes as Trump, who forced a government shutdown over his demand for a Mexican border wall, is again making immigration the central theme of his presidency; last week, Trump backed off his threats to shut down the border entirely.

The officials at the Departments of Homeland Security, Justice and State, who each handle different parts of the immigration process, were initially surprised that a high-ranking White House official like Miller would call them directly, rather than contact their bosses.

"It's intimidation," one of the people who was briefed on the calls told POLITICO. "Anytime you get a call like this from the White House it's intimidation … Under normal circumstances, if you were a deputy in one of these agencies, it would be very unusual."

"There's definitely a larger shakeup abreast being led by Stephen Miller and the staunch right wing within the administration," said a person close to Nielsen, who resigned Sunday after months of pressure from a president who felt she was not tough enough on illegal immigration. "They failed with the courts and with Congress and now they're eating their own."

It was not immediately clear whether Miller played a role in the departure of Nielsen, who resigned during a Sunday evening meeting with Trump and whose approach to border enforcement often exasperated Miller and other hardline immigration reform advocates, who saw her as insufficiently bold.

A 33-year-old policy adviser and speechwriter, Miller is the Trump administration's most influential advocate for stricter immigration policies. He uses his close relationship with Trump and tight ties to conservative media to shape the president's thinking. But he has kept a relatively low public profile in recent months, even as Trump has hammered constantly at what he calls a "crisis" on the southern border, where illegal crossings have recently surged.

But critics of Trump's policies and personnel moves believe that Miller may be playing an instrumental role. Several members of Congress, unhappily surprised by Vitiello's withdrawal, and have been asking administration officials and lobbyists for an explanation.

Miller and the White House didn't respond to a request for comment.

Miller also has been pushing for Trump to fire Lee Francis Cissna, director of U.S. Citizenship and Immigration Services, who has overseen implementation of some of the administration's lesser-known immigration policies, including green card reforms and changes to how the federal government processes and admits refugees.

"He's actively trying to put in place people who have very different points of view than the current leadership within the agencies," said a former DHS official familiar with Miller's efforts. "His idea is basically [to] clean house."

Miller also appears to have played a role in Trump's surprise move on Friday to withdraw his nomination of acting U.S. Immigration and Customs Enforcement Director Ronald Vitiello, whom he had moved to install permanently, saying he wanted to take the agency in a "tougher direction."

Miller had informed the president days before he pulled Vitiello's nomination that the acting ICE chief had reservations about closing down the southern border, which Trump has recently threatened to do against the recommendation of some of his top economic advisers and policy aides.

More than halfway through President Trump's first term, unauthorized immigration has surged to the highest levels in a decade, leaving him searching for quick-fix solutions and his administration roiling with internal tensions over how to address a problem the president promised to solve.

Trump sought to project confidence and strength on a visit to a renovated section of border fencing in Calexico, Calif., on Friday, amid warnings from federal authorities that the U.S. immigration system is at a "breaking point" in handling a record influx of Central American families.

But his public indecision over the past week - threatening in a tweet to close the border with Mexico before reversing himself six days later - revealed an administration that is grasping to deal with a humanitarian challenge without a well-defined strategy and with significant divisions within Trump's team.

A sign of the discord came Friday when the White House yanked the Senate nomination of a longtime federal immigration official, Ronald Vitiello, to lead Immigration and Customs Enforcement after a senior White House adviser, Stephen Miller, lobbied Trump to cut him loose, according to officials familiar with the matter.

Trump told reporters he would go in "a tougher direction" in finding a new nominee.

To his critics, the episodes were emblematic of the failures of a president whose policies have exacerbated the migration surge, as he has focused on outdated models of hard-line deterrence and punishment developed more than a decade ago to stop Mexican men from sneaking into the country in search of jobs. Those methods, including a border wall, are largely ineffective in keeping out the asylum-seeking families who are driving the recent immigration spike, immigration experts said.

In some cases, human smugglers have used Trump's hard-line threats as "a sales tactic" to drum up business, warning would-be migrants that they must enter the United States before the president cracks down, said Theresa C. Brown, a career policy official at the Department of Homeland Security who left in 2011.

"He ran on, 'No one else can fix it and I can.' I get that. It's very attractive to a public that has seen a complicated issue linger for a long time," Brown said. "Except it's not something that is easily fixable. His instincts to take hard stances and do tough talk have not had the impact he had hoped, and now he's proposing harsher things that will hurt us as much or more than anybody else."

But Trump aides have expressed bewilderment that a president who was vilified by his political rivals for warning of a border crisis since his 2016 campaign is now being blamed for, in their view, being right. They argue that the unwillingness of Democrats and the mainstream media to acknowledge the extent of the problem until recently has contributed to the administration's struggles to curb the flow. They also point to opposition from Democrats to embracing any of the legislative remedies the administration has proposed, or to countering with a plan of their own, as evidence that the opposition party is more interested in making Trump look bad than in addressing the migrant surge.

"I see that some of our biggest opponents over the last two days have said, 'You know what, it really is an emergency,'?" Trump said during his border tour in Calexico. The border surge "is a direct result of the obstruction by Democrats in Congress."

The administration's reliance on increasingly tougher rhetoric and policy proposals has played out vividly over the past few months. In December and January, Trump shut down parts of the federal government for a record 35 days in an unsuccessful bid to win congressional funding for a border wall. He then declared a "national emergency" to circumvent Congress for roughly $6.7 billion for the wall and vetoed a bill passed by both chambers to overturn his order.

The federal government has released more than 108,000 undocumented immigrants inside the United States in the past three months, a top U.S. immigration official said Monday.

Ronald Vitiello, the acting director of U.S. Immigration and Customs Enforcement, said the wave of immigrants, largely from three Central American countries - El Salvador, Honduras and Guatemala - is creating a crisis at the U.S.-Mexico border.

The migrants are being released, with notices to appear later before immigration judges, because detention facilities are at capacity, Vitiello said. ICE later added that the crush on the feds' ability to transport immigrants to detention facilities, and an agreement on how long asylum-seekers can be held also contributed to the releases.
Vitiello said many of the immigrants will not return to court for determinations on whether they can remain here legally.

"Unfortunately, that is … exactly what is happening," Vitiello said. "The numbers of people coming to the border, children with their families or children coming alone, is overwhelming the entire system."

Vitiello made the remarks in an interview with the San Antonio Express-News ahead of his opening keynote speech Tuesday at the Border Security Expo at the Henry B. Gonzalez Convention Center. The expo continues through Wednesday.

The wave of immigrants is creating a humanitarian crisis in local border communities and taxing the resources within Homeland Security, including ICE, Vitiello said.

Generally, migrants seeking asylum who turn themselves in at the border are held for processing for a short period by the Border Patrol. "Then, depending on who they are and their demographics, they are turned over to us and eventually released if they're a family unit," Vitiello said.

During an initial crush of Central American immigrants in 2014, ICE - under the Obama administration - turned to holding immigrant families at detention facilities called family residential centers. The two largest are in Dilley and Karnes City, both about an hour from San Antonio.

Vitiello said that, because of the complexities of immigration law, and rulings enforcing a 1997 court agreement known as the Flores agreement, ICE had to adjust because it cannot hold immigrant families longer than 20 days while they seek asylum.

That is not enough time for them to go before immigration judges to get their asylum claims adjudicated, so the facilities are now being used instead for immigrant families whose asylum claims have already been rejected and are in the process of being deported. That process lasts less than 20 days. The facility in Dilley had a population Monday of 1,528 and the one in Karnes had 110.

"What (the family residential center) was built for in 2014, now that situation doesn't exist," Vitiello said.

With no capacity to hold asylum-seeking family units longer than 20 days, they are being released.

"In the last 90 days…. ICE has released 108,500 family units in the U.S.," Vitiello said.

Nielsen, who has overseen DHS for 16 months, on Thursday was blindsided and called Vitiello after midnight for more information on what had happened, one source close to Vitiello said. Vitiello got a call from a White House official Thursday night telling him he would not be traveling with President Trump and Nielsen to Southern California the following day because his nomination had just been rescinded.

Both sources, who spoke on background because they were not authorized to speak for the White House or ICE, said Vitiello was told by a second White House official his name was pulled due to a "paperwork" issue. The second official who spoke with the Washington Examiner said it likely came down to Vitiello not being endorsed by ICE union head Chris Crane. Vitiello did not go into the office Friday due to the sudden change. He's now running ICE in an acting capacity. It's not clear where he is headed as the White House mulls over who to instead install at the agency. The move puts ICE without a leader as the agency deals with the highest number of noncitizens in its custody in over a decade.

A senior House Republican said Monday the Trump administration has resorted to implementing "catch and release" at the border instead of after being held for several weeks due to the sheer number of migrants illegally crossing from Mexico into the U.S. and claim to have a credible fear of returning home.

"Law enforcement doesn't have the resources to process and detain the crushing influx of migrants arriving at the border. As a result, they are directly releasing migrants into the United States - catch and release," House Homeland Security ranking member Mike Rogers, R-Ala., said in a statement Monday. "Without Congressional action, the situation on the ground poses a serious threat to human life and national security."

A few weeks ago, Customs and Border Protection's Border Patrol entity stopped funneling all migrants apprehended to Immigration and Customs Enforcement for the maximum 20-day detainment.

Instead, an unspecified number of migrants were released by agents in the Rio Grande Valley, Texas, El Paso, Texas, and Yuma, Ariz., communities.

Last April, the White House said it was forced to catch and release migrants, though that was after they were transferred from CBP to ICE. Now those encountered on the border are documented by agents and let go.

"Law enforcement is forced to resort to catch and release because they do not have the resources to process, transport, and detain the record number of migrants they are apprehending," Rogers' committee spokeswoman Nicole Hager said in an email.

Acting ICE Director Ronald Vitiello last week said the releases are "not really different" than what CBP did in the mid-2000s. Back then, Border Patrol agents were arresting nearly 100,000 people per month and would release some out the back door of stations.

Border Patrol expects to apprehend 100,000 illegal border-crossers in March, the majority of whom are families and unaccompanied children from countries other than Mexico and must be handled differently than single adults from Mexico.

Nearly 70 Former Judges Call for ICE to Make Courthouses Sanctuary Spaces

Almost 70 former state and federal judges have signed a letter to Immigration and Customs Enforcement (ICE) Director Ronald Vitiello asking that they stop arresting illegal immigrants at courthouses.

The letter claims that the arrests instill fear and get in the way of the criminal justice system, but ICE says they only target gang members or people who have already been ordered to leave at courthouses.

"We know firsthand that for courts to effectively do justice, ensure public safety, and serve their communities, the public must be able to access courthouses safely and without fear of retribution," the judges wrote.

The former judges also call for other "sensitive places" like schools and places of worship to be treated as sanctuary zones.

According to a report from the Hill, "ICE arrests increased in 2018 under President Trump, compared with the same period in 2017. Arrests of undocumented immigrants rose 17 percent in the first three fiscal quarters of 2018."

ICE has not responded to the letter.

Construction of US-Mexico Border Wall Begins in San Diego - With Anti-Climbing Plate

Numerous political obstacles have slowed down the development of a border wall along the U.S.- Mexico border since Trump has taken office.

But the president is keeping his word.

Construction of a U.S.-Mexico border wall began Friday in San Diego, Calif., according to U.S. Customs and Border Protection (CBP) officials. The wall included an anti-climbing plate.

The "bollard-style wall" will replace 14 miles a flimsy eight foot high barrier made out of recycled metal scraps that was constructed in the 1990s, will be at least twice as tall and will be fortified with an anti-climbing place, a CBP news release said.

"Under this President's leadership, we have a renewed commitment to secure our border," said Ronald Vitiello, CBP's acting deputy commissioner. "The new primary wall project represents an important milestone in our work to secure the international border.

"Not only does it significantly upgrade our existing infrastructure in San Diego, it also marks the third concurrent wall project in the U.S. and reflects CBP's unwavering commitment to secure our borders and protect our Nation," Vitiello continued.

Border wall renovations are already underway on two miles of wall in Calexico, California and 20 miles of wall in Santa Teresa, N.M., the CBP said.

The U.S. Border Patrol's San Diego Sector comprises 60 miles of the US-Mexico boundary and is one of the most highly traffic areas for border crossings of illegal immigrants and drugs in the country. Officers arrested more than 26,000 illegal immigrants along the section of the border last year and seized nearly 11,000 pounds of marijuana and 3,000 pounds of cocaine, the New York Post noted.

Trump insists he will get Mexico to pay us back for the wall using NAFTA re-negotiations and by potentially freezing remittances from Mexican nationals in the United States. Mexico says that won't happen.

Prototypes of Trump's border wall thwarted US commandos in tests

Recent assaults by tactical teams on prototypes of President Trump's proposed wall with Mexico indicate their imposing heights should stop border crossers, a U.S. official with direct knowledge of the rigorous assessment told The Associated Press.

Military special forces based in Florida and U.S. Customs and Border Protection (CBP) special units spent three weeks trying to breach and scale the eight models in San Diego, using jackhammers, saws, torches and other tools and climbing devices, said the official, who spoke on condition of anonymity because the information was not authorized for public release.

A CBP report on the tests identifies strengths and flaws of each design but does not pick an overall winner or rank them, though it does point to see-through steel barriers topped by concrete as the best overall design, the official said.

The report recommends combining elements of each, depending on the terrain. The official likened it to a Lego design, pulling pieces from different prototypes.

A CBP spokesman said the agency is still in "the testing phase" and that results are being evaluated.

Carlos Diaz also said combining elements of different prototypes instead of picking a winner is consistent with previous statements by officials.

Diaz noted that the agency said in its bidding guidelines that a minimum height of 18 feet (5.4 meters) would be a key characteristic. He said he did not have additional details on test results.

Contractors were awarded between $300,000 and $500,000 for each prototype. Prototypes were built last fall to guide future construction of one of Trump's signature campaign pledges. Four were concrete and four were made of other materials.

Ronald Vitiello, the agency's acting deputy commissioner, said after visiting the prototypes in October that he was struck most by the 30-foot (9.1-meter) heights, which are significantly higher than existing barriers.

Taller barriers are undoubtedly more effective, but whether the cost is justified will be up for debate

The highly trained testers scaled 16 to 20 feet (4.9 to 6.1 meters) unassisted but needed help after that, said the official who described the assaults on the wall prototypes to the AP.

Testers also expressed safety concerns about getting down from 30 feet.

Only once did a tester manage to land a hook on top of the wall without help, the official said. Tubes atop some models repelled climbing devices but wouldn't work in more mountainous areas because the terrain is too jagged.

The report favors steel at ground level because agents can see what is happening on the other side and holes can more easily be patched, the official said.

With concrete, large slabs have to be replaced for even small breaches, which is time-consuming and expensive. Topping the steel with smooth concrete surfaces helps prevent climbing.

CBP leaders were scheduled to be briefed on the findings this week amid intensifying discussions between the White House and Congress on immigration legislation to avert a government shutdown and renew protection for about 800,000 young immigrants who were temporarily shielded from deportation under an Obama-era program, Deferred Action for Childhood Arrivals (DACA), which is scheduled to end in March.

The administration has insisted wall funding be part of any immigration deal but Trump has been unclear about how long the wall would be and how it should be designed.

The administration has asked for $1.6 billion this year to build or replace 74 miles (118.4 kilometers) of barriers in Texas' Rio Grande Valley and San Diego and plans to request another $1.6 billion next year.

A proposal by CBP calls for spending $18 billion over 10 years to extend barriers to cover nearly half the border, though it is unclear if Trump supports that plan.

The agency proposes 316 miles (505 kilometers) of additional barrier by September 2027, bringing total coverage to 970 miles (1,552 kilometers). It also seeks 407 miles (651 kilometers) of replacement or secondary fencing.

Mexico has steadfastly rejected Trump's demand that it pay for the wall.

Contracts to do work on that scale would be hugely lucrative, and the prototypes, spaced tightly together in a remote part of San Diego, have captured widespread attention, including from architecture critics.

Vitiello said in October that the testing could last up to two months and lead to officials to conclude that elements of several designs should be merged to create effective walls, raising the possibility of no winner or winners.
