CONCORD, N.H. – Lawyers defending New Hampshire's state-run youth detention center against allegations ofhorrific abusewill be allowed to undermine an accuser's credibility when the first of more than 1,000 lawsuits goes to trial next month, even as a separate team of state lawyers relies on his account to prosecute former workers.
The scandal at the Sununu Youth Services Center in Manchestercame to light after two former workers were arrested in 2019 and charged with abusing David Meehan, a former resident who had gone to police two years earlier. In the four years since Meehan sued the state, nine more workers have been charged and hundreds of other former residents have filed their own lawsuits alleging physical and sexual abuse.
With both Meehan's civil case and the first criminal case scheduled for trial in April, a judge's recent ruling highlights the unusual dynamic of having the state attorney general's office simultaneously prosecuting perpetrators and defending the state.
Meehan's attorneys asked Judge Andrew Schulman in January to prohibit the state from undermining Meehan's credibility and trustworthiness through cross-examination based on a legal doctrine that prevents a party from taking a position in one legal proceeding that contradicts a position it took in another.
"The State cannot be allowed to take a Janus-faced position - wholeheartedly proffering David's allegations of abuse on the State's criminal proceedings, while disavowing or discrediting those same allegations in David's civil action," they wrote.
Attorneys for the state argued that the request, if granted, would effectively prohibit the state from putting on any defense whatsoever. The doctrine doesn't apply because the defendants in the civil case and prosecutors in the criminal cases are not the same party, they said.
"Plaintiff's request for what would essentially be a sham trial is what threatens judicial integrity and public confidence in the courts," they wrote last month. "State defendants' ability to cross-examine plaintiff, who chose to bring this suit against state defendants, or offer other evidence, does not."
Schulman denied the motion Friday, issuing a three-sentence order saying that applying the doctrine in question was inappropriate while warning state lawyers about contradicting the criminal indictments.
A spokesperson for Attorney General John Formella did not respond to a request for comment Tuesday. In the past, officials have defended the decision to oversee concurrent civil and criminal investigations by citing strong "ethical walls" to keep them completely separate.
But Jamie White, a Michigan-based attorney who has been involved in multiple institutional sexual abuse cases, said he disagrees with the ruling and has never seen a similar scenario in which an attorney general's office is both defending the state and prosecuting abusers. Though he praised Formella for investigating the abuse and bringing charges, he called it "mind-boggling" that Formella didn't outsource the defense on the civil side to a private firm.
"They can explain it away all they want, but the firewall might as well be made of cardboard," said White, who has represented gymnasts abused by Dr. Larry Nassar and victims of the late Dr. Robert Anderson at the University of Michigan. "This idea that they can play both sides of the fence is not realistic. It's not healthy, and it's not good for the survivors."

Former Middle School Paraprofessional Sentenced to 20 Years in Prison for Child Sextortion Scheme
MINNEAPOLIS - A Coon Rapids man has been sentenced to 240 months in prison followed by 12 years of supervised release for a sextortion scheme that targeted minors through social media and an online gaming forum, announced United States Attorney Andrew M. Luger.
According to court documents, Glen Robert Anderson, 24, previously worked as a middle school paraprofessional in special education. Anderson used multiple internet applications and social media accounts for email, file sharing, and chatting with minors, including Snapchat and Grindr. Anderson also owned and administered an online gaming forum. To participate in the forum, users were required to submit an application, which included the age of the user. As Anderson knew, many of the users were minors. Between April 1, 2016, through August 20, 2021, Anderson used his position as the forum administrator to groom minors to produce child pornography and engage in sexual activity with him, including by providing minors with in-game perks, privileges, and other gifts. For example, Anderson coerced a 13-year-old victim to engage in sexually explicit acts for the purpose of producing images and videos. Anderson later threatened to release those sexually explicit images if the victim did not respond to Anderson's demands.
Anderson pleaded guilty on June 28, 2022, to two counts of production of child pornography, one count of enticement of a minor, and one count of interstate communications with intent to extort. He was sentenced on March 15, 2023, before Chief Judge Patrick J. Schiltz.
This case was the result of an investigation conducted by the FBI, the Anoka County Sheriff's Office, the Erie County (Ohio) Sheriff's Office, with assistance from the Minnesota Bureau of Criminal Apprehension and Waterloo Regional Police Service in Ontario, Canada.
Assistant U.S. Attorney Angela M. Munoz and former Assistant U.S. Attorney Miranda E. Dugi prosecuted the case.

COVID-19 vaccines more likely to kill people than save lives, research reveals
Recent data from the Centers for Disease Control and Prevention (CDC) revealed that there have been over one million excess deaths recorded since the Wuhan coronavirus (COVID-19) pandemic started two years ago. Excess deaths refer to deaths in excess of historical average.
Reported deaths during that time were caused by heart disease, high blood pressure, dementia and many other diseases that are not associated with SARS-CoV-2. Researchers from the University of Warwick said that "the scale of excess non-COVID deaths is large enough for it to be seen as its own pandemic."
Across the globe, the rise of death rates coincide with the vaccine rollout that started in December 2020. Deaths attributed to COVID-19 are consistently higher in areas with high vaccination rates. "We've never seen anything like it," Robert Anderson, CDC's head of mortality statistics, told the Washington Post in mid-February.
The vaccines are not preventing infections, either. Walgreens data shows that during the week of April 19 to 25, only 13 percent of unvaccinated tested positive for COVID-19. In comparison, 23.1 percent of those who received two doses and 26.3 percent of those who received a third dose at least five months ago have tested positive for the disease. The University of Michigan has agreed to a $490 million settlement with more than 1,000 former students who say they were sexually abused by a former sports doctor, their lawyers said Wednesday.
The university had been in mediation to resolve multiple lawsuits by mostly men who accused the late Dr. Robert Anderson of sexually assaulting them during routine medical examinations dating back to the 1960s.
"It has been a long and challenging journey, and I believe this settlement will provide justice and healing for the many brave men and women who refused to be silenced," said attorney Parker Stinar, who represents about 200 victims.
Stinar said $460 million of the settlement would be shared among 1,050 victims, while the remaining $30 million has been set aside for future accusers.
University spokesman Rick Fitzgerald confirmed the settlement, but provided no additional details.
Anderson, who died in 2008, had worked at the university from 1966 until his 2003 retirement.
His tenure included stints as the top physician for multiple athletic teams, including football, and director of the university's Health Service.
Several football players and other athletes were among those to come forward and accuse Anderson of sexually abusing them.
The university said it was first notified of the allegations against Anderson in July 2018 when an ex-student wrote a letter detailing the alleged abuse in the early 1970s.
A report by a firm hired by the school to probe the allegations later determined that staff missed many opportunities to stop Anderson throughout his nearly four-decade career.
Attorney Jamie White, who represents about 100 victims, said the university should be "commended and not condemned" for agreeing to the settlement.
"The University of Michigan has accepted responsibility financially and otherwise for harm that was caused by Anderson to so many young people that could have been avoided," White said in a statement.
"Most of our clients had a strong love for the University and did not want to see permanent damage, but wanted accountability. I believe we accomplished those goals yesterday."
The deal came just days after the university fired its president, Dr. Mark Schlissel, for having an alleged years-long affair with a subordinate.

The election of Abraham Lincoln in November of 1860 brought to a head the issue of slavery in the United States. In direct response to Lincoln's election as president, seven southern states seceded from the Union rather than continue to negotiate and compromise over the issue of slavery, which had been the norm for so many decades.
The first state to secede was South Carolina on December 20, 1860. By February 1861, six more states had joined the new Confederate States of America. With their secession declarations came the demands that all United States property be turned over to those states, including military property, and said installations abandoned by United States soldiers, sailors, and marines. The new Lincoln administration sought not to provoke armed conflict but refused to surrender Federal installations to the Confederates. Instead, Lincoln chose to resupply Fort Sumter in Charleston Harbor and other forts when required. No arms, munitions, or troops would be sent to the garrisons. Rather, supply ships with food, fodder, and other necessities of life were sent south.
One attempt to resupply Sumter took place in January but the ship, the Star of the West, was turned away by Rebel guns. Negotiations continued in Charleston between Confederate General Pierre G.T. Beauregard, in command of the Confederate forces there and Maj. Robert Anderson, the Fort Sumter garrison commander. The talks failed to resolve tensions. On April 9, Confederate President Jefferson Davis and the Confederate cabinet decided to "strike a blow!" The next day, Davis ordered Beauregard to reduce Fort Sumter. Early on the morning of April 12, 1861, Confederate guns around the harbor opened fire on Fort Sumter. At 2:30 pm on April 13th, Major Robert Anderson, garrison commander, surrendered the fort and it was evacuated the next day.
With the firing on Fort Sumter, the American Civil War was officially upon both the North and the South. A war that lasted four years and cost the lives of more than 620,000 Americans and freed 3.9 million people from the bondage of slavery.

The term "Only 6%" trended over the weekend as QAnon supporters promoted tweets that falsely suggested the CDC had overblown the number of cases.
The U.S. Centers for Disease Control and Prevention did not "backpedal" on the number of deaths caused by COVID-19, reducing the figure from nearly 154,000 to just over 9,000, as social media posts claimed.
The term "Only 6%" trended widely on Twitter over the weekend as supporters of the QAnon conspiracy theory promoted tweets that falsely suggested the CDC had updated its records to show that only 6% of U.S. deaths tied to COVID-19 were legitimate. President Donald Trump was among those who tweeted the information, which was later taken down by Twitter for violating platform rules.
The posts, which received hundreds of thousands of shares online, were based on a regularly updated CDC data table showing underlying conditions for those who died of COVID-19. The conditions included high blood pressure, diabetes and obesity, as well as problems that are caused by COVID-19 itself, such as respiratory failure and pneumonia
The CDC data table is based on an analysis of death certificates that mention COVID-19 as a cause. For 6% of the deaths, COVID-19 was the only cause mentioned, the CDC notes.
The other 94% list COVID-19 and other conditions together. Among those deaths, there were, on average, 2.6 additional conditions or causes per death, the public health agency said.
As of Aug. 26, the CDC said, there were 161,332 deaths where COVID-19 was listed on the death certificate. Social media users over the weekend posted an older screenshot of the data that showed 153,504 deaths. The posts used the 6% figure to claim the U.S. death toll was much lower - 9,210.
"CDC just backpedaled (quietly) and adjusted the U.S. COVID deaths from 153,504 to 9,210. Admitting that their numbers are so (expletive) that they are off by a whopping 94%," said a post being shared on Facebook Monday.
But such claims misrepresent the data. A death isn't excluded from the COVID-19 tally just because the person was obese or had diabetes or dementia. Someone with heart problems can still be killed by COVID-19, and the death certificate could mention both as contributing.
Experts say it's not surprising that so few people who died from COVID-19 had no underlying conditions listed on their death certificates. It is rare for people not to have multiple medical issues at death.
"The underlying cause of death is the condition that began the chain of events that ultimately led to the person's death," Dr. Robert Anderson, who oversees the CDC's death statistics work, said in a statement. "In 92% of all deaths that mention COVID-19, COVID-19 is listed as the underlying cause of death."
Also, while death certificates are supposed to list any causes or conditions that contributed, past research has shown that the documents aren't perfect. Doctors might not know - or specify - all the reasons behind a particular death.
More important, the CDC figures show what medical professionals have been saying since the outset of the pandemic - that the virus tends to have a more severe impact on people with underlying conditions.
For example, people died with diabetes not because of it, said Dr. William Schaffner, an infectious-diseases expert at Vanderbilt University.
"If it hadn't been for the COVID virus infection, these people would be living today," he said. "So yes, although they have contributing underlying chronic health factors, it's still the COVID virus that killed them."

CDC expert issues chilling warning that U.S. coronavirus death toll of 34,846 is just 'the tip of the iceberg' as 'untold numbers' of people who haven't been tested are dying at home
As the COVID-19 death toll neared 34,800 in the US on Thursday, an advisory panel expert from the Centers of Disease Control (CDC) has issued a chilling warning that the alarming number is just the 'tip of the iceberg'.
Mark Hayward, a sociology professor at the University of Texas-Austin who is an expert on mortality statistics for the CDC, believes the country's coronavirus death count is being severely underestimated.
The purported inaccuracy of the figures could be caused by a number of factors. Staff shortages in certain states may be causing delays in reporting the latest figures to the CDC,and an 'untold' number of people potentially infected by the disease have also been also dying at home before they could be tested. Medical examiners do not test people after death.
'The biggest challenge in obtaining an accurate tally of COVID-19 deaths is to [be able to] implement widespread testing,' Hayward explained to Newsweek.
'Locales that lack testing and where populations are rural, reside in nursing homes, or people live alone are likely to be major contributors to the undercount; note that these are not mutually exclusive categories.
'There are also varying standards (and timing of rollouts) of testing by state,' Hayward continued. 'Cause-of death classification schemes have also been evolving and it's not always straightforward in assigning COVID-19 as a cause of death. I think the biggest barrier, though, is the lack of testing.'
As of Thursday evening, 3,420,39 people in the US have been tested for the virus - less than one percent of the country's total population.
It's precisely this lack of widespread testing that has led Hayward to believe the US death count, which currently stands at 34,846, is just the 'tip of the iceberg'.
Just how underreported the deaths are, Hayward says he can't be certain.
He said: 'I do not have an actual figure of underreporting and this will vary over time as testing becomes more widespread. The degree of under-reporting will vary across localities in the U.S. and over time.
'The geographic and temporal variability are tightly linked because of the geographic differences in testing.'
Hayward also pointed out that it's hard to use other countries as a standard to gauge how underreported death statistics may be, 'given differences in vital registration systems'.
Having an accurate understanding of the country's death toll is imperative for mitigation purposes, not only to know when stay-at-home and social distancing orders may appropriately be lifted, but to also help spot any potential emerging hotspots for the virus.
Identifying a potential hotspot before an explosion in COVID-19 cases will allow local and federal governments to mobilize the required resources to prevent an outbreak - potentially saving thousands of lives in the process.
Chief of the CDC's mortality statistics branch, Robert Anderson, reiterated this point to ProPublica.
'One of the reasons we count deaths is to allocate resources to where they need to go,' Anderson said. 'It becomes a little more time-sensitive when you're dealing with something like a pandemic.'

Whitaker speaks to John Demers, the assistant attorney general who runs the Department of Justice's National Security Division, which inherited the Russian hacking case from Special Counsel Robert Mueller. There is no doubt in his mind the Russian agents executed the hack and strategically released the stolen documents using the online persona "Guccifer 2.0." The agents behind the plot gave the stolen data to political operatives and bloggers, and some material eventually found its way into the mainstream media. "Guccifer 2.0 is a fictional online persona," says Demers. "It's all an effort on the Russian side to hide their involvement."
The Russian information warfare operation is laid out in a remarkably detailed 29-page indictment compiled by Special Counsel Robert Mueller's team and handed off to the Justice Department's National Security Division. The case remains open. "The insight here is that behind every one of those keyboards is not an IP address. It's a human being," says Demers. He says he'd be surprised if he ever gets to try the Russians in court, but adds: "The purpose of this kind of indictment is to educate the public." Even so, he's confident he could get a conviction. "We believe that if we had to, we could prove [that the Russians interfered with the U.S. election] in court tomorrow using only admissible, non-classified evidence to 12 jurors."
Robert Anderson, who oversaw the FBI's counterintelligence and cybersecurity divisions, says the Russian hacking teams are made up of "some of the best mathematical minds in Russia." He says the operation in 2016 was "a huge success" and warns that the Russians will be back for the 2020 election. "The thing that you need to worry about with Russia and every one of their intelligence services is they will learn from these operations...They will analyze everything they did right or wrong. And when they attack again, they will not come at you the same way," he says.

Rep. Devin Nunes (R-Calif.), the top Republican on the House Intelligence Committee, sharply criticized the Mueller report during a June 12 hearing, saying the report failed to address key players and irregularities in the FBI's investigation and contained selectively edited information.
Nunes also called out his Democratic counterparts, saying that former special counsel Robert Mueller's report did debunk many of the false claims of collusion between the Trump campaign and Russia that had been perpetuated by Democrats, including members of the House Intelligence Committee.
Witnesses at the hearing-titled "Lessons from the Mueller Report: Counterintelligence Implications of Volume 1?-included Robert Anderson and Stephanie Douglas, described by House Intelligence Committee Chairman Adam Schiff (D-Calif.) as former executives from the FBI's counterintelligence division. Left out of Schiff's description was the fact that both witnesses had worked under former FBI Director Mueller prior to his role as special counsel.
In Nunes's opening statement, he noted that allegations of collusion between Russia and the Trump campaign were perpetuated by Democrats on the House Intelligence Committee more than two years ago.
"The entire scheme has now imploded and the collusion accusation has been exposed as a hoax," Nunes said.
He then summed up the catch-22 position that Democrats now appear to find themselves in:
"But it's clear they couldn't stop this grotesque spectacle even if they wanted to. After years of false accusations and McCarthyite smears, the collusion hoax now defines the Democratic Party. The hoax is what they have in place of a governing philosophy or a constructive vision for our country."

Nunes indicated there is evidence the illegal counterintelligence investigation into Trump and his associates started back in 2015, not July of 2016 as the FBI claims.
"There's been a lot of talk about when this investigation began, now that's an open-ended question because we can say this investigation coulda begun in 2015 because we know some of the same players were having run-ins with individuals that have questionable ties to either Western intelligence or possibly political campaign operatives, but officially they have said that it started at the end of July [2016]." Nunes said.
Nunes blasted the Steele-Media-Mueller loop of information, leaks and articles that ravaged the US for years and said the FBI is in big trouble.
The FBI witnesses were left speechless when Nunes asked them if it's normal to have an FBI informant (Christopher Steele) who was paid by the FBI to investigate Trump's campaign while simultaneously being paid by the Clinton campaign to investigate Trump - then went on to leak to the press.
"This counterintelligence department over at the FBI I think is in big trouble - the fact that you guys are sitting here, former FBI officials, and not saying anything and basically making the case that it is ok to use these very special powers to target a political campaign really troubles me," Nunes said warning the FBI witnesses.

This is the second open hearing in the series; the first focused on the Kremlin's use of oligarchs and money to influence foreign actors. A subsequent hearing will explore the facts discussed in the report about Russian intrusions into U.S. elections infrastructure. The Committee also plans to consider targeted legislative initiatives designed to respond to the counterintelligence concerns highlighted by Russia's interference in the 2016 election.
Chairman Adam Schiff staid in a statement:

Stephanie Douglas was actually named Executive Assistant Director of National Security Branch by then-FBI Director Robert Mueller in October of 2012.
"I am confident that under Stephanie's leadership, the National Security Branch will continue to protect national security and make further strides in its goal of fully integrating intelligence into operations," then-FBI Director Robert Mueller said back in 2012.
Robert Anderson was named executive assistant director of the Criminal, Cyber, Response, and Services Branch at FBI Headquarters by then-FBI Director James Comey in 2014.

He is smart and dedicated and cares about the agents and professional staff who fulfill the FBI's mission," then-FBI Director Comey said in 2014. Previously, Robert Anderson worked under FBI Director Robert Mueller as the assistant director of the Counterintelligence Division.

'We've never really seen anything like this': US suicide rates hit 50-year peak
The US witnessed the most deaths in a single year, since official records began, in 2017, with suicide and drug overdose deaths soaring among an aging population, according to the Centers for Disease Control and Prevention (CDC).
It marks the third consecutive year life expectancy has dropped in the US, and the longest life expectancy decline trend since the late 1910s when WWI and the worst flu pandemic in modern history combined to kill approximately 675,000 Americans.
All told, the US recorded 2.8 million deaths in 2017, with middle-aged deaths making the biggest impact on life expectancy.
"These sobering statistics are a wake-up call that we are losing too many Americans, too early and too often, to conditions that are preventable," Dr. Robert Redfield, the CDC's director, said.
The suicide rate in 2017 was the highest in 50 years reaching roughly 47,000 cases (up from just below 45,000 the previous year).
"We've never really seen anything like this," said Robert Anderson, who oversees CDC death statistics. Suicide is the tenth leading cause of death in the US for the tenth year in a row.
Increases have been prominent among the female population despite the fact that most people who die by suicide are still male. The female suicide rate rose by 53 percent between 1999 and 2017, with a 26 percent increase for men during the same period.
"I really do believe that people are increasingly hopeless, and that that leads to drug use, it leads potentially to suicide," said Dr. William Dietz, a disease prevention expert at George Washington University.
Among the 10 leading causes of death, only cancer deaths fell while there were increases in suicide, stroke, diabetes, Alzheimer's, flu/pneumonia, chronic lower respiratory diseases and unintentional injuries.

On the same day the Queensland Supreme Court handed down the interim suppression order, a Toowoomba magistrate complained that Mr Lehrmann's lawyer "did not have the courtesy" to tell her court they had applied for a Supreme Court injunction to suppress the man's identity.
The hearing was told the defendant had been seeing a psychologist, who had provided a letter mentioning suicidal ideation that formed part of his suppression order application.
Prosecutor Nicole Friedewald opposed the suppression order and said there was "an absence of evidence supporting the application for an interim order".
She told the court that the complainant in the case had expressed her view that the man's identity should be published under the new laws.
Ms Philipson ultimately granted an interim order to keep the man's identity suppressed until the matter could be heard on October 13.
On that date, Lehrmann's legal team and lawyers acting for the media outlets faced Toowoomba Magistrates Court, where his legal team argued the order should stay in place.
Barrister Andrew Hoare, acting for him, said there was a "real existing risk of harm" to his client if his identity were to be published.
He said the man suffered from "severe" suicidal ideation that had manifested over years.
But Robert Anderson KC, representing the media outlets, said the high-profile man had not given evidence before the court, instead relying on his solicitors and his psychologist.
He noted the man was prepared to go public with certain statements but was "unprepared" to face the court and give evidence himself.
Mr Anderson said the defendant had "no automatic right to protection" under the recent amendments to the legislation.
On Friday, October 13, Magistrate Clare Kelly, in the Toowoomba Magistrates Court handed down her judgement on the application for a suppression order sought by the defendant.
Magistrate Kelly found the defendant was not formally linked to a mental health professional and was not prescribed medication.
"In my view the evidence relied upon doesn't establish that the order is necessary to prevent prejudice to the proper administration of justice," she said.
Mr Lehrmann did not attend the hearing and his lawyers submitted his mental health would be impacted if he was named.
The Director of Public Prosecutions Nicole Friedewald also revealed at that hearing that the complainant in the case wanted the man identified.

The Toowoomba Magistrates Court has previously heard that the complainant, a Toowoomba woman, had told prosecutors she wanted the man to be identified under new state laws.
The Director of Public Prosecutions Nicole Friedewald told the court that the complainant in the case wanted the man identified.
"She has taken an active position on this matter and instructed my office that she does wish for the applicant to be named. It is not a case that she has taken a neutral position or that she opposes it.
"She is desirous of him being identified and for the non-publication order not to be made," Ms Friedewald said Magistrate Kelly had found the defendant was not formally linked to a mental health professional and was not prescribed medication.
Lawyers acting for Mr Lehrmann had opposed his identification on mental health grounds citing a letter from a psychologist raising concerns over suicidal ideation.
The decision to allow the media to name Mr Lehrmann follows a long running-legal battle to name him that has played out in the Queensland magistrates court and the Supreme Court.
Until this year, Queensland laws prohibited the identification of the accused prior to committal, a legal process that can take many months.
But those laws were changed, allowing the media to name Mr Lehrmann for the first time from midnight, October 3.
Under the new laws, the defendant, their alleged victim(s) or the prosecution can apply to a Queensland court for a non-publication order.
On September 30, just days before the changes came into force, Mr Lehrmann's legal team sought a temporary suppression order protecting his identity due to the imminent change to Queensland laws.
Queensland Supreme Court Justice Peter Applegarth AM said the man intended to apply for a suppression order under the new laws "as soon as practicable".
Justice Applegarth said the committal proceeding had "attracted publicity", leading to "substantial risk" the high-profile man's identity would be published before he had an opportunity to obtain a suppression order.
He said it would be "contrary to the interests of justice" if he were to not allow the application.
"The applicant's right to apply should not be defeated by such publicity," the judge said.
