KEY FACTS
Chris Krebs, the director of the Department of Homeland Security's Cybersecurity and Infrastructure Security Agency (CISA), is the latest casualty, who Trump fired Nov. 17 after his agency released a statement refuting the president's claims of widespread voter fraud.

Two other Department of Homeland Security (DHS) officials-Bryan Ware, CISA's assistant director, and Valerie Boyd, the DHS's assistant secretary of international affairs-were also forced out of their positions last week, per reports.

The Defense Department's chief of staff, Jen Stewart, was replaced on Nov. 10 by former Rep. Devin Nunes staffer Kash Patel, who played a role in helping Republicans discredit the Russia probe.

Also on Nov. 10, the Pentagon's undersecretary of defense Joseph Kernan, a retired Navy SEAL, and the Pentagon's top policy official James Anderson both resigned from their positions, though they were more likely pressured out-Politico reported that Anderson had fallen out of favor after pushing back against a White House attempt to install several Trump loyalists at the Defense Department.

These Pentagon departures came a day after Trump fired Secretary of Defense Mark Esper, who, though initially derided as "Yesper" for his compliance with the White House's wishes, angered Trump over the summer by opposing the deployment of active-duty troops to quell street protests in the wake of George Floyd's death, and for pushing for the renaming of military installations named after Confederate generals.

The head of the Department of Justice's election crime branch Richard Pilger, who has held the role for 10 years, resigned on Nov. 9 in protest of Attorney General Bill Barr's memo authorizing investigations of "substantial allegations" of voter fraud before the results of the current election are certified, which contradicts the DOJ's long-standing guidance designed to prevent the department from interfering with elections.

Between Nov. 6 and Nov. 8, the Trump administration also quietly fired the heads of the three federal agencies overseeing nuclear weapons, electricity and natural gas regulation, and overseas aid: Lisa Gordon-Hagerty, the administrator of the National Nuclear Security Administration; Bonne Glick, the deputy administrator of the U.S. agency for International Development; and Neil Chatterjee, the chairman of the Federal Energy Regulatory Commission, who said his dismissal could "perhaps" be retaliation for recent actions promoting an agency response to climate change.

The Trump administration also removed Michael Kuperberg, the scientist who oversees climate change for the U.S. Global Change Research Program, Nov. 6, with The New York Times reporting that people familiar with the changes expect the position to be given to a climate change skeptic.

(CNN)A group of federal prosecutors on Friday urged Attorney General William Barr to rescind his order for any prosecutor to examine allegations of voting irregularities before states move to certify the results in the coming weeks, according to an internal letter obtained by CNN.

The letter from the 16 prosecutors comes days after Barr released a memo earlier this week telling prosecutors not involved with the election crimes branch of the Justice Department's Public Integrity Section to skip procedural steps to investigate "substantial" allegations of voter fraud.
"We urge you to rescind it," the prosecutors, who were assigned to enforce federal voting rights laws across the country on Election Day, wrote in boldfaced type about Barr's memo.
The bipartisan coalition of federal "District Election Officers" said Barr's marching orders are "not based on fact."
"It was developed and announced without consulting non-partisan career professionals in the field and at the Department. Finally, the timing of the Memorandum's release thrusts career prosecutors into partisan politics," the prosecutors wrote.
Barr's memo served as a catalyst for the resignation of Richard Pilger, the leader of the election crimes branch. Pilger spoke out against Barr's memo in a resignation letter that he forwarded to colleagues.
The letter was co-signed by 16 assistant US attorneys from 15 out of the 44 jurisdictions that were chosen by the Justice Department's Civil Rights Division to monitor the November 3 general election. The assistant US attorneys said in the letter that, in the districts they monitored, they found no evidence of substantial voting irregularities.
The federal prosecutors in the letter covered jurisdictions in the Eastern and South Districts of New York, Eastern Kentucky, Kansas, Maryland, New Mexico, Northern California, Southern Ohio, Southern Iowa, Western Pennsylvania, Western North Carolina, Western Arkansas, the Virgin Islands and the Northern Mariana Islands, plus two prosecutors from Oregon.
"In the jurisdictions where we serve as DEOs, in the 2020 election cycle, there is no evidence of 'substantial allegations of voting and vote tabulation irregularities' that 'could potentially impact the outcome of a federal election,' to use the language from the Memorandum," according to the letter.
Kerri Kupec, a spokeswoman for the Justice Department, declined to comment on the prosecutors' letter.
Instead, Kupec referred to the last paragraph of Barr's memo, which includes: "Nothing here should be taken as any indication that the Department has concluded that voting irregularities have impacted the outcome of any election. Rather, I provide this authority and guidance to emphasize the need to timely and appropriately address allegations of voting irregularities so that all of the American people, regardless of their preferred candidate or party, can have full confidence in the results of our elections."

Why is this seemingly commonsense order so important?

According to the Manual of Investigation and Prosecution of Election Crimes:

Consultation with the Public Integrity Section is REQUIRED
to:
- expand an election fraud or patronage investigation
- conduct interviews with individual voters during the pre-election period, on election day, or immediately after
the election, concerning the circumstances under which
they voted;
- issue a subpoena or search warrant in connection with an
election fraud or patronage matter;
- present evidence involving an election fraud or patronage matter to a grand jury;
- file a criminal charge involving an election fraud or
patronage offense; or
- present an indictment to a grand jury that charges an
election fraud or patronage offense.

The order from AG Barr FREED the US Attorneys from having to get approval from the Public Integrity Branch before proceeding with an investigation.

Previously, without the approval, the US Attorneys could really only document complaints and collect a couple facts before calling the PIB.

Who was the gatekeeper at PIB who would (NOT) approve investigations?

When you can't keep investigations from (truly) starting, what is the point of having that responsibilty anymore?

The evidence I have outlined above is an indicia of criminal conspiracy. It provides sufficient predicate for criminal investigations. These were not isolated acts or mere human error. The evidence is being accumulated.

I do not know what the Attorney General is going to do. But, he is not going to ignore evidence. Based on his emotional defense of the voting system when interviewed by Wolf Blitzer, I do not believe he is going to let this slide. Stay hopeful.

Richard Pilger, an Election Crimes Prosecutor with the DOJ resigned today according to a New Your Times article covering Barr's memo. Pilger, who started with the DOJ in 1992 under the Clinton Administration resigned his post stating: "Having familiarized myself with the new policy and its ramifications, I must regretfully resign from my role as director of the Election Crimes Branch."

The NY Times article goes on to incorrectly assert "Justice Department policies prohibit federal prosecutors from taking overt steps, like questioning witnesses or securing subpoenas for documents, to open a criminal investigation into any election-related matter until after voting results have been certified" which Barr directly addressed with the clear direction to avoid violating standing policy.

Pay No Attention to the Drama Queen at DOJ who Resigned After AG Barr Authorized Fraud Investigations

On Monday afternoon the Department of Justice put out a statement confirming that Attorney General William Barr had authorized federal prosecutors and investigators to initiate federal criminal investigations into "substantial allegations" of vote fraud in the Presidential election.

The whinging and hand-wringing on the left began immediately, with claims that Barr was again using the Justice Department as a weapon against President Trump's political opponents, and there is no evidence of vote fraud that warrants any federal investigations.

Then, to cap things off, late in the day on Monday the left-wing press - led by the NYT I believe - shrieked that the Director of the DOJ's Election Crimes Branch had resigned in protest following the announcement by AG Barr. That individual's name is Richard Pilger, who is a "career" official with the Department of Justice.

But let's draw back the curtain a bit more so everyone can understand what is happening here behind the scenes.

"Federal prosecutor" is a generic term that covers two groups of DOJ lawyers - Assistant United States Attorneys who work in 94 US Attorneys' Offices around the country, and DOJ Trial Attorneys who work out of DOJ Headquarters in Washington, D.C., in the DOJ Criminal Division. Within the Criminal Division, there is the "Public Integrity Section" which handles most cases involving public office holders or other government officials. Within the Public Integrity Section is the Election Crimes Branch.

The DOJ Trial Attorneys view themselves as "subject matter specialists" - experts on specific areas of law within the jurisdiction of their specific section. Among the Sections, Public Integrity was far and away the leader in the "This is our subject matter specialty so stay the hell out of what we do" attitude. It was neck-and-neck between them and Civil Rights, but Civil Rights trial attorneys were a source of amusement for AUSAs because they were clueless about how to actually try a case in a courtroom. Public Integrity was better - at least a little bit better.

Someone in the Public Integrity Election Crimes Branch got the brilliant idea in 2006 that they should write a manual on investigating and prosecuting various types of election-related crimes.

What they produced was a 345-page monstrosity, the most useful function of which was as a doorstop.

When Richard Pilger took over as Director of the Branch, he decided that the manual needed updating. So under his guidance it was updated and edited down some in 2017 - now it's only 296 pages long.

I've never brought myself to read the thing, but in merely "perusing" it, I noticed that about 900 times in the course of 300 pages the Election Crimes Branch tells the AUSAs that they must consult with and obtain approval from Election Crimes Branch before an AUSA or FBI Agent can do anything operationally in response to an allegation that an election-related crime might have taken place. Without their approval, there would be no investigation.

What happened today, and what prompted Pilger to "quit" was that AG Barr said to US Attorneys - "If you have substantial allegations of election fraud in your district, you have authority to investigate that." Basically, Barr cut Pilger and Election Crimes Branch out of the picture as "gatekeepers" to starting investigations in places like Philadelphia, Milwaukee, Detroit, and Atlanta.

DOJ official quits after Barr move on election fraud allegations

A Justice Department official stepped down from his role overseeing probes into voting crimes hours after Attorney General William Barr announced on Monday that he had authorized the agency to investigate any "substantial allegations" of voter fraud in the presidential election.

In an email first obtained by The New York Times, Richard Pilger wrote to colleagues, "Having familiarized myself with the new policy and its ramifications … I must regretfully resign from my role as director of the Election Crimes Branch."

Pilger added in the email that the new policy is "abrogating the forty-year old Non-Interference Policy for ballot fraud investigation in the period prior to elections becoming certified and uncontested."

According to the Times, Pilger, who had served as director of the Justice Department's Election Crimes Branch since 2010, added that he would "move to a non supervisory role working on corruption prosecutions."

The Hill has reached out to the agency for comment.

Pilger's resignation came after Barr wrote in a memo Monday that Justice Department investigations "may be conducted if there are clear and apparently-credible allegations of irregularities that, if true, could potentially impact the outcome of a federal election in an individual State."

"Nothing here should be taken as any indication that the Department has concluded that voting irregularities have impacted the outcome of any election," Barr added. "Such inquiries and reviews may be conducted if there are clear and apparently-credible allegations of irregularities that, if true, could potentially impact the outcome of a federal election in an individual state."

President-elect Joe Biden on Saturday was projected by every major news outlet as the winner of the presidential election, but President Trump has indicated he will not concede, alleging without evidence that there were several instances of voter fraud in a Democratic attempt to steal the election from him.

The Trump campaign has filed lawsuits in several key battleground states that Biden won, asking local judges to either invalidate or stop counting mail-in ballots.

For decades, federal prosecutors have been told not to mount election fraud investigations in the final months before an election for fear they could depress voter turnout or erode confidence in the results. Now, the Justice Department has lifted that prohibition weeks before the presidential election.
A Justice Department lawyer in Washington said in a memo to prosecutors on Friday that they could investigate suspicions of election fraud before votes are tabulated. That reversed a decades-long policy that largely forbade aggressively conducting such inquiries during campaigns to keep their existence from becoming public and possibly "chilling legitimate voting and campaign activities" or "interjecting the investigation itself as an issue" for voters.

For example, a month prior to the election, the phrase "how to sell ballot" rose in popularity, hovering around 50% and hit peak popularity on October 30th.

"Election fraud jail" also spiked in popularity a few days prior to the election, as did the other terms pertaining to inquiries about punishments for conducting "election fraud."

Google trends also reveals how these search terms were considerably more prevalent in specific areas of the country - especially swing states like Pennsylvania and Arizona.

Cause and effect, funny how random things could possibly be connected.

NBC News and several other major media outlets projected Joe Biden the winner of the 2020 presidential election on Saturday after several states spent days counting ballots following a record turnout, including mail-in and absentee voting. Trump has refused to concede to President-elect Biden and one of his appointees in the General Services Administration has yet to sign paperwork to begin the presidential transition.

Barr was not asked or directed by the president, any lawmaker, or anyone in the White House to issue this memo to federal prosecutors, according to a Department of Justice senior official. Barr, however, met with Senate Majority Leader Mitch McConnell, R-Ky., earlier Monday. McConnell defended the president earlier Monday on the Senate floor, arguing he has a right to pursue recounts and lawsuits in court.

Barr did not respond to questions when he left McConnell's office and a DOJ spokesperson has declined to comment on what the two men discussed.

A DOJ official told NBC News that the memo from Barr does not allege that there are substantial irregularities in the election. It authorizes local U.S. attorneys to investigate if they learn "clear and apparently-credible allegations of irregularities that, if true, could potentially impact the outcome of a federal election in an individual State."

It added, "While serious allegations should be handled with great care, specious, speculative, fanciful or far-fetched claims should not be a basis for initiating federal inquiries. Nothing here should be taken as an indication that the Department has concluded that voting irregularities have impacted the outcome of any election."

IRS scandal is a violation of Americans' trust

Recently, it was revealed that Lerner sent an email titled "DOJ Call" on May 8, 2013, to Nikole Flax, chief of staff to acting IRS Commissioner Steven Miller at the time. Lerner advised that she received a call that day from Richard Pilger, director of the election crimes branch at the Department of Justice. Pilger inquired how DOJ could work with the IRS to construct criminal cases against nonprofits they believed were engaged in political activity.

Lerner had already clarified that conservative nonprofits were being targeted when she wrote "Tea Party Matter very dangerous" in a Feb. 1, 2011, email.Pilger told her "DOJ is feeling like it needs to respond" to a "Senator Whitehouse idea" raised at a congressional hearing. Pilger's actions are troubling. They suggest the existence of a coordinated effort between the IRS and Department of Justice to criminally prosecute conservative groups.This presents a serious conflict of interest. Attorney General Eric Holder should recuse himself out of an abundance of caution.

The House Oversight Committee learned about a database Lois Lerner, then head of the tax-exempt organizations division of the Internal Revenue Service (IRS), shared with the Federal Bureau of Investigation (FBI) after interviewing Pilger and reviewing emails between him and Lerner. "The Department's refusal to allow Mr. Pilger to testify about matters highly relevant to the Committee's investigation unnecessarily delays and frustrates the Committee's Constitutional oversight obligations," said Chairman Issa in a letter sent with the subpoena.

"The Department's obstruction in this regard, coupled with its failure to produce any relevant material to date, leads the Committee to conclude the Department is not seriously committed to cooperating with the Committee's investigation on the Committee's terms," said Issa.

The subpoena follows on the heels of an Apr. 23 letter from 17 members of the committee to the DOJ for materials "concerning the Department's involvement in efforts to scrutinize tax-exempt applicants after emails surfaced between Pilger and the Internal Revenue Service's Lois G. In the statement issued today by the Oversight Committee, it says the Federal Election Committee, the IRS, and the DOJ sought ways to minimize the impact of the Supreme Court's decision in the Citizens United case, claiming that "a clear outline emerges of government agencies cracking down on constitutionally protected free speech."

The statement also quotes Lois Lerner from Oct. 19, 2010, saying of the Citizens United case: "And everyone is up in arms becuase they don't like it. The Federal Election Commission can't do anything about it. They want the IRS to fix the problem." (See video.)

Staff for the Oversight Committee interviewed Richard Pilger on May 6, 2014. During that interview, Pilger was instructed by a DOJ attorney not to answer questions in 34 instances. The DOJ sought to limit the scope of the question to Pilger's communications with Lerner, reads the May 20 letter from Chairman Issa.

The letter say "the Department's lawyer refused to allow Mr. Pilger to answer questions about conversations within the Department in wake of Citizens United v. Federal Election Commission, Mr. Pilger's interactions with the Federal Election Commission about Citizens United, or whether Mr. Pilger had communicated with any IRS official since Lois Lerner's apology for the targeting on May 10, 2013."

"These matters are highly relevant to the Committee's investigation of the IRS targeting," says the letter, "and the Department's refusal to allow Mr. Pilger to provide this information unduly impedes the Committee's oversight obligations."

Because of that refusal and the DOJ's "failure to produce any relevant material to date," reads the letter, the committee issued its subpoena for the documents it had requested back on Apr. 23, 2014.

In a day when numerous lawsuits were filed challenging the outcome of the presidential election, and when prominent Republicans such as Mitch McConnell finally came out in support of Trump's contention that the election was rigged, late on Monday Attorney General William Barr authorized the Justice Department to launch a probe into "substantial allegations" of voter fraud in the 2020 election, the AP first reported.

In a letter to US attorneys across the country, Barr said they could conduct investigations "if there are clear and apparently-credible allegations of irregularities that, if true, could potentially impact the outcome of a federal election in an individual state."

According to the Washington Times, this is an unusual move, since Justice Department policy prohibits any action that could influence the outcome of an election until the vote is formally certified. But the Justice Department is responsible for ensuring the integrity of federal elections.

Barr's memo comes days after presumptive President-elect Joseph R. Biden was declared the winner by several media outlets in the 2020 presidential election. President Trump has not conceded and has launched several legal efforts challenging the results in states where the voting margins are razor-thin. By granting prosecutors the power to pursue such cases, U.S. attorneys around the country could give Trump more ammunition for his lawsuit.

The DOJ's action, which many republicans will claim is long overdue, comes after Republicans in recent days turned up the heat on Barr to take some action in response to the voter fraud allegations. Earlier on Monday, Barr reportedly met with McConnell on Monday.

On Friday, nearly 40 Republican members of Congress sent a letter to the AG asking him to get to the bottom of the voter fraud claims.

"What are you doing to ensure the integrity of the voting and counting process right now?" the Republicans asked Mr. Barr in their letter. The lawmakers also called on the attorney general to commit to "using all the resources" at his disposal to ensure only legal votes are being counted "in a fully transparent manner."

Also last week, the Nevada Republican Party sent a criminal referral to the Justice Department claiming they have received reports of at least 3,062 instances of voter fraud in the battleground state.

"We expect that number to grow substantially," the party said in a tweet. "Thousands of individuals have been identified who appear to have violated the law by casting ballots after they moved from NV."

The Trump campaign has filed lawsuits in several key battleground states that Biden won, asking local judges to either invalidate or stop counting mail-in ballots, a record number of which were cast this year amid the coronavirus pandemic.

Earlier in the day several prominent Republicans backed Trump's claims of voter fraud or his right to challenge the count, including Senate majority leader Mitch McConnell: "Obviously no states have yet certified their election results. We have at least one or two states that are already on track for a recount and I believe the president may have legal challenges underway in at least five states," McConnell said during a floor speech Monday.

The Trump admin has also accused local election officials of not allowing their representatives to watch vote counts and claiming illegal votes were cast in states including Michigan, Nevada and Pennsylvania.

Attorney General William P. Barr, wading into President Trump's unfounded accusations of widespread election irregularities, told federal prosecutors on Monday that they were allowed to investigate "specific allegations" of voter fraud before the results of the presidential race are certified.

Mr. Barr's authorization prompted the Justice Department official who oversees investigations of voter fraud, Richard Pilger, to step down from the post within hours, according to an email Mr. Pilger sent to colleagues that was obtained by The New York Times.

Mr. Barr said he had authorized "specific instances" of investigative steps in some cases. He made clear in a carefully worded memo that prosecutors had the authority to investigate, but he warned that "specious, speculative, fanciful or far-fetched claims should not be a basis for initiating federal inquiries."

Mr. Barr's directive ignored the Justice Department's longstanding policies intended to keep law enforcement from affecting the outcome of an election. And it followed a move weeks before the election in which the department lifted a prohibition on voter fraud investigations before an election.

"Given that voting in our current elections has now concluded, I authorize you to pursue substantial allegations of voting and vote tabulation irregularities prior to the certification of elections in your jurisdictions," Mr. Barr wrote.

A Justice Department official said that Mr. Barr had authorized scrutiny of allegations about ineligible voters in Nevada and backdated mail-in ballots Pennsylvania. Republicans have circulated both claims in recent days without any evidence emerging to back them.

Mr. Barr did not write the memo at the direction of Mr. Trump, the White House or any Republican lawmakers, the official said.

Mr. Barr has privately told department officials in the days since the election that any disputes should be resolved in court by the campaigns themselves, according to three people briefed on the conversations. He has said that he did not see massive fraud, and that most of the allegations of voter fraud were related to individual instances that did not point to a larger systemic problem, the people said.

But critics of Mr. Barr immediately condemned the memo as a political act that undermined the Justice Department's typical independence from the White House.

Vladeck, a professor at the University of Texas School of Law.

"But to do so when there is no such evidence - and when the president's clear strategy is to delegitimize the results of a proper election - is one of the more problematic acts of any attorney general in my lifetime," Mr. Vladeck added.

Mr. Pilger, a career prosecutor in the department's Public Integrity Section who oversaw voting-fraud-related investigations, told colleagues he would move to a nonsupervisory role working on corruption prosecutions.

"Having familiarized myself with the new policy and its ramifications," he wrote, "I must regretfully resign from my role as director of the Election Crimes Branch." A Justice Department spokeswoman did not immediately respond to a request for comment about Mr. Pilger's message.

Justice Department policies prohibit federal prosecutors from taking overt steps, like questioning witnesses or securing subpoenas for documents, to open a criminal investigation into any election-related matter until after voting results have been certified to keep their existence from spilling into public view and influencing either voters or local election officials who ensure the integrity of the results.

Don Jnr accuses head of DOJ election crimes unit Richard Pilger, of being the 'Deep State' after he resigned in protest over Bill Barr authorizing federal prosecutors across US to pursue 'substantial allegations' of voter fraud despite little evidence

President Donald Trump's son, Don Jr, was quick to criticize Pilger.
He wrote: 'Wait. Seriously? Isn't this the guy who was involved with the IRS and Lois Lerner in targeting conservatives and the Tea Party? Maybe that's why he hasn't done s**t at DOJ. #deepstate'
His tweet seems to be a reference to a meeting Pilger had in 2010 with then-IRS unit director Lerner, which was scrutinized by Republicans in congress.
Lerner headed the IRS division that processes applications for tax-exempt groups. An inspector general's report in 2013 found that the IRS had singled out conservative and tea party groups for extra scrutiny when they applied for tax-exempt status.

The attorney general authorized investigation of 'substantial allegations'
It raises the specter of the Justice Department getting involved in the case
Within hours the head of the election crimes branch, Richard Pilger, resigned

Barr met with Mitch McConnell, Senate majority leader, on Monday
Shortly after the pair met McConnell defended Trump on the floor of the Senate
