Alibaba fires manager after sexual assault case rocks industry
https://www.straitstimes.com/asia/east-asia/alibaba-fires-manager-after-sexual-assault-case-rocks-industry
In one of the highest-profile incidents so far, JD.com Inc. founder Richard Liu was arrested in the US in 2018 and accused of raping a 21-year-old female Chinese undergraduate, though prosecutors there subsequently decided not to press charges against the billionaire.
More recently, former Korean boy band member Kris Wu has been detained after a university student accused him of pressuring young women into sex.
"I expect the biggest impact to be recruitment and talent management," said Michael Norris, an analyst with Shanghai-based consultancy AgencyChina.
"Alibaba's growth required a strong talent pipeline across various business units. This incident may dissuade promising female graduates and highly-qualified female managers from joining Alibaba."

Judge rejects motion to remove Chinese billionaire's corporation as defendant in sexual assault lawsuit
It is difficult to determine when a CEO is "off duty," a Hennepin County judge said in a ruling.
By Randy Furst Star Tribune April 28, 2020 - 5:06pm
Billionaire Richard Liu, CEO of JD.com, is accused of raping a University of Minnesota student in 2018. The company's lawyers don't want JD.com to be a target of the lawsuit.
A judge rejected a request by Chinese billionaire Richard Liu to remove his corporation as a defendant in a lawsuit filed by a University of Minnesota student who claims she was raped in 2018.
Hennepin County District Judge Edward Wahl declined the motion to dismiss JD.com from the litigation, in which Liu is also individually named as a defendant. The company, similar to Amazon, is one of China's two giant online retailers.
Liu's attorneys argued that JD.com should not be implicated in the woman's accusations because the sexual contact occurred off company premises and on Liu's own time. Liu has maintained that sex with the woman was consensual, and he was never charged in connection with the allegation.
In his ruling issued Monday, Wahl declared that "it is difficult to determine when defendant Liu is 'on duty' and 'off duty,'" as a CEO, observing "the determination is significantly more difficult for someone identified as a CEO and owner of an international corporation" compared to an average worker.
Peter Walsh, an attorney for JD.com, said the ruling was "not unexpected," and that they expect to prevail once more evidence is admitted.
"Courts often conclude, as the court did here, that they cannot dismiss claims without the benefit of additional facts," Walsh said. "The judge specifically stated that he was not making any factual findings and that it was simply 'premature' to rule in JD.com's favor."
The woman, Jingyao Liu, a Chinese undergraduate at the U who is no relation to Liu, has alleged Richard Liu got her drunk at a business networking party he hosted in August 2018, then sexually assaulted her in her apartment.
Liu was arrested by Minneapolis police, then released. After an investigation, Hennepin County Attorney Michael Freeman declined to file criminal charges because he did not believe he could convince a jury of Richard Liu's guilt beyond a reasonable doubt.
Wahl concluded that JD.com's attorneys did not provide sufficient information to conclude the company should not be held liable, and more evidence was needed to reach a determination.
Richard Liu's Chinese name is Liu Qiangdong. He is the 40th richest man in China and has a net worth of $9.6 billion, according to Forbes Magazine.
He was attending a special business doctorate program at the Carlson School of Management at the U for some of the wealthiest executives in China when the incident occurred.
Jingyao Liu, who was 21 years old at the time of the alleged assault, was asked by a Carlson School dean to volunteer during a week in which the Chinese executives were attending the school.
Wahl was not asked by Liu's legal team to dismiss the case altogether, a motion expected to come later.
The company had argued it could not be held liable for the acts of an employee and the alleged assault did not occur when Liu was on the job. Jingyao Liu's attorneys say the company bears responsibility because it was part of an uninterrupted chain of events that began with a corporate-sponsored party and continued with a drive to her apartment in a corporate paid-for van.
Wahl noted the woman's claims that Richard Liu told her that she could "be a woman just like Wendi Deng." Deng is corporate magnate Rupert Murdoch's ex-wife and was employed by Murdoch's firms. "The mention of such name arguably implies business opportunities," Wahl wrote.
Joseph Daly, professor emeritus at Mitchell Hamline School of Law, described Wahl's decision as "quite significant" and a likely turning point in the lawsuit which was filed last year. Daly, who is not involved in the litigation, predicted it would spur JD.com and Richard Liu to settle rather than subject themselves to drawn-out depositions and more publicity.
However, Jingyao Liu's attorney, Wil Florin, said his client does not want to settle. "Our client is intent on going to trial," he said. "It's hardened her resolve to get this case decided by a jury."

I watched the Pence/China video from Q drops. After hearing the tactics they are using to influence our election I did a little digging on Tay Tay to see if maybe she has close connections to China. I started out looking for a connection between POTUS saying he likes her music 25% less and possibly a company she owns 25% of. No smoking gun showing Chinese fuckery but there are some connections.
She released her clothing line in 2015 and only released it in China at the time.
"JD.com is delighted to become the sole online source of authentic, high-quality Taylor Swift merchandise," said Richard Liu, JD.com founder and CEO.
JD.com is China's largest online direct sales company.

The company representing Swift at the time was Heritage 66.
"Swift is working with Heritage66Company, a Tennessee-based branding company that works with American corporations and celebrities to extend their brands into the Chinese market."

Unhinged MSNBC Panelist: With Kavanaugh's Confirmation, Republicans Have Set Themselves Up For 'A Thousand-Year Reich'
On MSNBC, the editor of Above the Law, Elie Mystal, went bonkers when he was asked about the impact of Justice Brett Kavanaugh being confirmed to the Supreme Court, bloviating that President Trump was the "devil" for encouraging racism and that conservatives' control over the three branches of government could lead to a "thousand-year Reich."
Prior to Mystal's unhinged remarks, the conversation, led by host Richard Liu and joined by Associate Editor of Commentary Noah Rothman, MSNBC analyst Zerlina Maxwell, and SiriusXM host Danielle Moodie-Mills, had discussed the idea that the GOP is "anti-woman," segued to Nazism, and risen to fever pitch with the accusation against the conservative Rothman that he was "mansplaining."
But the zenith of idiocy was reached with Mystal, who stated, "The thing about making a deal with the devil is that the devil backs up his bargain. The devil does not welch."
As Caleb Howe noted ironically at Mediaite, Mystal got that completely wrong. Howe noted, "The point of 'making a deal with the devil' parables is that the devil does betray you."
Mystal continued, "Trump has delivered for these people on the things that they care about most; he has delivered racism for these people. He has delivered misogyny for these people, and now he's delivered the Supreme Court for these people, which is something they've been trying to get for a generation."
Mystal said feverishly, "So then the question now becomes, not so much like, 'Oh, will this stick for the Republicans?' I think it will stick for the Republicans; this is what they want. The question is, what are the Democrats going to do? Democratic turnout doesn't need to be high for a midterm; it needs to be high for a presidential election. And that's what we're about to see. We're going to see if this reign that they now have control over all three branches of government, we're going to see if this reign lasts for thirty days, or two years, or a thousand-year Reich. Because that is how, that is what these people have set themselves up for. And it's simply a question of whether or not the Democrats are going to join the battle and meet them at the polls."

Minnesota - Chinese Billionaire Arrested for Criminal Sexual Misconduct
Authorities have confirmed that Chinese e-commerce billionaire Liu Qiangdong was arrested for a brief time in Minneapolis over allegations of criminal sexual conduct.
The Chinese billionaire is also known as Richard Liu. He is 45 years old.
The brief arrest happened on Friday evening and he was released in the afternoon on Saturday. Public Information Officer John Elder said Liu was released pending formal complaint.
The Minneapolis Police Department reported the investigation is ongoing and would not give further details at this point.
Liu is the founder and CEO of Chinese online retail giant JD.com
Liu's company was founded in 1998 and is part of the Fortune Global 500. The company is also China's second-largest e-commerce firm and has emerged as an aggressive competitor of Alibaba.
The company became popular for offering a "one-stop" shopping experience to over 300 million active customers in China, boasting of same- and next-day delivery as standard.
Google also announced in June that it would invest more than half a billion dollars into JD.com as part of a move to expand retail services around the world.
The two companies said they are poised to marry JD's supply chain and logistics experience with Google technology to create "next generation" personalized retail in regions including Southeast Asia, the US and Europe.
JD.com's shares trade in the United States have prospered by appealing to the increasing sophistication of Chinese shoppers. Big global brands such as Nike, Prada and Levi's actively use JD.com's sales platform to reach the country's burgeoning middle class.
JD.com addressed the criminal sexual misconduct allegation involving Liu in a released a statement posted on Chinese social media network Weibo. It confirmed the arrest but claimed that such arrest was carried out on "false allegation during a business trip."
The statement released by Liu's company also said authorities "found no evidence of misconduct" and released Liu to continue his trip. Said statement contradicted the U.S. police.
"Criminal sexual conduct" encompasses a broad spectrum of non-consensual sexual activity in the state of Minnesota.
The details of the allegations remain unclear at this point but we may be enlightened as the investigation progresses. This does not mean the Chinese billionaire businessman is off the hook yet.
Business industry observers regard the allegation against Liu as another unwelcome bit of publicity for a company that reflects the business potential of China's rising middle class.

Chinese Billionaire Liu of JD.com Arrested in Minneapolis
MINNEAPOLIS-Chinese billionaire Liu Qiangdong, also known as Richard Liu, the founder of the Beijing-based e-commerce site JD.com, was arrested in Minneapolis on suspicion of criminal sexual conduct, jail records show.
Liu, 45, was arrested late night of Aug. 31 and released on the afternoon of Sep. 1 pending possible criminal charges, Hennepin County Jail records show. The jail records don't provide details of the alleged incident.
Minneapolis police spokesman John Elder said on Sep. 2 that he couldn't provide any details because the investigation is considered active. He declined to say where in Minneapolis Liu was arrested or what Liu was accused of doing.
Minnesota law defines five degrees of criminal sexual misconduct, ranging from a gross misdemeanor to felonies, covering a broad array of conduct ranging from nonconsensual touching to violent assaults with injuries. The jail records for Liu don't indicate a degree.
JD.com, the main rival to Alibaba Group, said in a statement posted Sep. 1 on the Chinese social media site Weibo that Liu was falsely accused while in the U.S. on a business trip, but that police investigators found no misconduct and that he would continue his journey as planned.
"We will take the necessary legal action against false reporting or rumors," the company said.
Liu recently tried to distance himself from a sexual assault allegations against a guest at a 2015 party at Liu's penthouse in Australia. Liu was not charged or accused of wrongdoing, but Australian media reported he tried unsuccessfully to get a court to prevent the release of his name in that case. The guest was convicted.
In June, Google said it would invest $550 million in JD.com. The investment reflected an effort by the U.S. tech company to expand its reach into Asian e-commerce.
JD.com is China's second-largest e-commerce company after Alibaba. Among its other investors is Chinese internet gaming and social media giant Tencent Holdings, the developer of the WeChat messenger app and a major rival of Alibaba, and U.S. retailer Walmart Inc.
