The Court decided a number of important cases addressing the relationship between states and the Federal government under the Constitution.

In Virginia office for Protection and Advocacy v. Stewart (09-529), the Court held that principles of state sovereign immunity did not prevent Virginia's office for Protection and Advocacy ("VOPA") from suing the State of Virginia in Federal court to enforce Federal law. Federal legislation had offered states money for implementing assistance programs for people with disabilities. Virginia had created VOPA as an independent agency pursuant to this legislation, and VOPA was seeking injunctive relief to compel the State to disclose documents pursuant to the Federal law. The majority held this to be permissible under Eleventh Amendment sovereign immunity principles. Chief Justice Roberts, joined by Justice Alito, dissented strongly, arguing that the majority's holding represents a dangerous intrusion into state sovereign immunity and will lead more state agencies to sue state officers in Federal court.

In Bond v. U.S. (09-1227), the Court held that a person indicted under a Federal statute has standing to challenge the statute on the Tenth Amendment grounds that, in enActing the statute, the Federal government invaded state powers under the Constitution. The question was whether individuals can assert states' rights under the Tenth Amendment, or whether this is something that is left to states. The Court held that an individual's right not to be jailed for an allegedly unconsitutional law does not belong to the states. "Federalism secures the freedom of the individual," and thus creates individual rights alongside state rights, according to the Court.

In three cases involving significant Federal legislation, conflicting state law and state law claims were held to be preempted. In AT&T Mobility LLC v. Concepcion (09-893), a divided Court held that the Federal Arbitration Act preempts a California law that rendered arbitration agreements unenforceable if they involved waiver of class-wide arbitration. In Bruesewitz v. Wyeth LLC (09-152), the Court held that the Federal National Childhood Vaccine Injury Act of 1986 preempts design defect claims brought under state law against Vaccine manufActurers. And Pliva, Inc. v. Mensing (09-993, 09-1039, 09-1501) held that Federal drug regulations applicable to generic drug manufActurers preempt state tort law claims based on an alleged failure to provide adequate warning labels. Justices Sotomayor and Ginsburg dissented in all three of these cases; Justices Breyer and Kagan joined the dissents in the Concepcion and Mensing cases.

In Chamber of Commerce v. Whiting (09-115) a divided Court held that Arizona's controversial law penalizing the employment of illegal immigrants is not preempted by Federal immigration law. The majority reasoned that the Arizona statute doesn't conflict with Federal immigration law; dissenting Justices Breyer, Ginsburg, and Sotomayor disagreed

Judge Blocks Washington Law That Let Children Get Vaccines Without Parental Consent

A federal judge on March 18 blocked a Washington, D.C., law that allowed children in the nation's capital to receive a Vaccine without parental consent.

The parents who sued over the law appear likely to succeed in proving claims that the law violates federal statutes and will be irreparably harmed if a preliminary injunction weren't entered, U.S. District Judge Trevor McFadden wrote in a 38-page opinion.

The D.C. Council passed the District's Minor Consent for Vaccinations Amendment Act in 2020. It lets children as young as 11 get a Vaccine without permission from their parents.

But the National Childhood Vaccine Injury Act of 1986 mandates health care providers who administer many Vaccines provide information on the shots to the legal representative of a child.

Plaintiffs in the case and another similar lawsuit are parents who say their minor children are under pressure to get vaccinated because of a citywide campaign to push vaccinations, including giving incentives like gift cards to people who get a jab and the placement of clinics that will inject the children in some schools, with other clinics near schools.

The child of Joshua Mazer, one of the plaintiffs, visited a doctor's office in the city without her parents and asked to get a Vaccine, according to the motion for a preliminary injunction. The child confirmed her parents were not aware of the request. The office did not check the girl's medical history or prior reActions to a Vaccine and also did not provide any Vaccine information, according to the filing; instead, workers convinced the girl to get two other shots as well.

The girl changed her mind at the last minute, which caused workers to "physically position themselves" around her, making her feel trapped. She was eventually able to leave.

Defendants, including Washington Mayor Muriel Bowser, a Democrat, said in a counter-filing that the court shouldn't block the law, calling it "an eminently reasonable public health measure that does not require plaintiff or his daughter to do anything."

McFadden, a Trump appointee, disagreed, noting that testimony from Mazer indicates his daughter, a teenager who lives in Maryland, is likely to try to get vaccinated in D.C.

The law presents a threat of imminent harm "because without it there is no avenue for minors to receive Vaccines absent parental consent," the judge said. "Removing the law would revert the District to the standard age of consent of 18."

Bowser and the other defendants are enjoined from enforcing the law until further order from the court.

The office of Bowser and the D.C. Department of Health did not respond to requests for comment.

Aaron Siri, a lawyer representing Mazer, said on social media that he was "pleased to announce" the ruling in the suit.

Eventually, some drugmakers decided to stop making Vaccines altogether. This drew alarm from public health officials, who worried about sustaining existing Vaccines and also the development of new Vaccines.
The National Childhood Vaccine Injury Act

Congress stepped in with the National Childhood Vaccine Injury Act of 1986 (the Vaccine Act) as a way to ensure that the injured would receive compensation, but also to protect drugmakers from open-ended liability.

In 2011, an important United States Supreme Court ruling clarified the type of lawsuits Vaccine manufActurers are protected from under the Vaccine Act. In a 6-2 decision, the Court ruled that the federal law protects drugmakers from design-defect claims as long as the Vaccine was properly manufActured and carried adequate warnings labels.
The National Vaccine Injury Compensation Program

When Congress granted drug companies immunity in regular court with the Vaccine Act, it established the Vaccine Injury Compensation Program. The no-fault compensation program was created as its own "court" to compensate those who claim to have suffered side effects caused by Vaccines.

Since the program was created in the late 1980s, it has paid out more than $4 billion to those who said they were harmed by Vaccines. The average payment per injured party from 2013 to 2017 was about $430,000, with an average of $229 million per year in total.
How Does the Vaccine Injury Compensation Program Work?

Because the program is not fault-based, people claiming Vaccine injuries do not have to prove that the Vaccine Actually caused the Injury. Instead, they only have to show that the Injury occurred immediately after the Vaccine was given.

Additionally, the Vaccine-related Injury has to be included on the Vaccine court's list of side effects, called the Vaccine Injury Table. The Vaccine involved must also be covered by the program. All routinely administered Vaccines are included:

Who Can File a Vaccine Injury Petition?

Anyone who has received a covered Vaccine and believes they have been injured as a result can file a claim with the program. Parents or legal guardians can file on behalf of their children. Legal representatives are permitted to file on behalf of the disabled and deceased.

However, all claims (with limited exceptions) must be filed within three years of the first symptoms, or within two years of death and within four years of the first symptoms that resulted in death.

The Injection Fraud - It's Not a Vaccine
Writings by Forrest Maready, Jon Rappoport, Dr. Suzanne Humphries and Arthur Firstenberg have helped me understand the role of Vaccines in the con man trick of saving money for insurance companies and the legally liable.

Here is one example of how the trick may play out. A toxin creates a disease. The toxin might be pesticides or industrial pollution or wireless technology radiation. The toxin damages millions of people and their communities. Companies or their insurance provider may be liable for civil or criminal violations. A virus is blamed. A "cure" is found in a "Vaccine." As a portfolio strategist, I admit it has been a brilliant trick and likely has protected the insurance industry from the bankrupting losses it would experience if it had to fairly compensate the people and families destroyed.

Thanks to the work of Robert Kennedy and Mary Holland of Childrens Health Defense, I now understand the enormous profits generated by so-called "Vaccines" subsequent to the passage of The National Childhood Vaccine Injury Act of 1986 and the creation of the National Vaccine Injury Compensation Program - a federal no-fault mechanism for compensating Vaccine-related injuries or death by establishing a claim procedure involving the United States Court of Federal Claims and special masters.

Call a drug or biotech cocktail a "Vaccine" and pharmecutical and biotech companies are free from any liabilities - the taxpayer pays. Unfortunately, this system has become an open invitation to make billions from "injectibles" particularly where government regulations and laws can be used to create a market through mandates. Unfortunately, various schemes have developed for government agencies and legislators as well as corporate media to participate in the billions of profits - resulting in significant conflicts of interest.

Why Are Moderna Executives Dumping Their Stock?

The U.S. Health and Human Services' Operation Warp Speed has pledged to deliver 300 million doses of a COVID-19 Vaccine by 2021, if not sooner. However, developing a safe and effective Vaccine normally takes years and begins with animal studies. The COVID-19 Vaccines are all being rushed straight into human clinical tests, forgoing lengthy animal trials altogether.

Such fast-tracked Vaccines pose unknown risks, which are further magnified since governments are granting COVID-19 Vaccine makers immunity from liability for all Vaccine injuries and deaths that occur after the Vaccines are recommended (or mandated) by public health officials.

At the end of July 2020, AstraZeneca announced most countries it expects to supply with COVID-19 Vaccine will grant the pharmaceutical company complete liability protection if people are harmed.

In the U.S., Vaccine makers already have something of a "free pass" when it comes to Vaccine Injury liability and lawsuits through the National Childhood Vaccine Injury Act of 1986 and the Public Readiness and Emergency Preparedness (PREP) Act, passed in 2005.

The main concern is that the combination of COVID-19 Vaccines being fast-tracked to market at "warp speed" with minimal testing, together with blanket liability protection against Vaccine injuries could be a public health nightmare in the making.

Problems With Moderna's Vaccine Are Becoming Apparent

Early warning signs that something might be amiss have already started emerging. As detailed in "Gates Tries to Justify Side Effects of Fast-Tracked Vaccine," results from Moderna's Phase 1 human trial revealed 100% of volunteers in the high-dose group suffered systemic side effects. Side effects included fatigue, chills, headache and myalgia (muscle pain); 21% suffered "one or more severe events."

According to Bill Gates, those side effects are largely due to the high dosages Moderna had to use in order to achieve desired antibody levels. But, if high dosages are required to create a robust-enough immune response, and higher dosages also cause systemic side effects in nearly all people, just how safe will this vaccination campaign be?

Moderna Executives Have Raked in Millions on Dumped Stocks

As reported by NPR September 4, 2020, executives at Moderna have also cashed in stock options, raking in tens of millions of dollars of personal profit in the process. Considering the patent problems now emerging and the lingering safety and efficacy questions, this move has raised significant concerns among financial experts.

November 14, 1986: The National Childhood Vaccine Injury Act (NCVIA) of 1986 (42 U.S.C. §§ 300aa-1 to 300aa-34) was signed into law by United States President Ronald Reagan as part of a larger health bill. NCVIA's purpose was to eliminate the potential financial liability of Vaccine manufActurers due to Vaccine Injury claims in order to ensure a stable market supply of Vaccines, and to provide cost-effective arbitration for Vaccine Injury claims. Under the NCVIA, the National Vaccine Injury Compensation Program (NVICP) was created to provide a federal no-fault system for compensating Vaccine-related injuries or death by establishing a claim procedure involving the United States Court of Federal Claims and special masters. Pres. Reagan said he had approved the bill "with mixed feelings" because he had "serious reservations" about the Vaccine compensation program.

This was a major coup for the pharmaceutical industry. As a result of this bill, pharmaceutical companies no longer have any liability for harm caused by their Vaccines based on whether the Vaccines caused harm in testing. To make sure that no harm was found, testing of Vaccines has since been greatly reduced compared to previous testing protocols. While this assured that a pharmaceutical company could rush a Vaccine to market to aide in an "emergency," it has also meant that those who take the Vaccines have now unwittingly become the test subjects.

One of the provisions of the NCVIA is that your health care providers who administer Vaccines against diphtheria, tetanus, pertussis, polio, measles, mumps, rubella, hepatitis B, Haemophilus influenzae type b and varicella must provide a Vaccine Information Statement (VIS) to the Vaccine recipient, their parent or legal guardian prior to each dose. But how often does this happen? And what about additional Vaccines that have been created since then?

Since 1980s, U.S. Government Agency Has Paid Over $4B for Vaccine Related Injuries and Death. Still Want a Flu Shot?

Many Americans are not aware that there is a National Vaccine Injury Compensation Program for those who have been injured by flu shots and other vaccinations. This is why Donald Trump and many others are opposed to mandatory vaccinations, especially for "The Flu" which isn't usually fatal.

As of last year, over $4 billion had been paid out for Vaccine injuries and deaths:

A Dec. 1, 2018 update by the U.S. Health Resources and Services Administration (HRSA) on the federal Vaccine Injury Compensation Program (VICP) reported that the total amount of awards to children and adults who have been injured or died after receiving federally recommended Childhood Vaccines has surpassed $4 billion.1 2

The VICP was created by Congress under the National Childhood Vaccine Injury Act of 1986 as a federal compensation system alternative to Vaccine Injury lawsuits filed in civil court.3

According to an article published in Fair Warning, almost no media attention has been given to payouts made to Vaccine victims by the government, which are adjudicated in the U.S. Court of Federal Claims (also known as "Vaccine Court").1 Fair Warning points out that one of the reasons that the "Vaccine Court" works in relative obscurity is because public health officials maintain that "Vaccines provide vast public health benefits" and are reluctant to talk about Vaccine casualties for fear that publicity about Vaccine Injury compensation awards would dissuade the public from getting vaccinated.1

The HRSA report reveals that over the past 30 years (since 1989), the VICP has received 20,123 petitions claiming Vaccine Injury and death, out of which 18,000 claims have been resolved. of those 17,576 cases, 6,313 cases (about two out of three claims) have received compensation awards via settlements or judgments.1 2 Nevertheless, HRSA does not acknowledge that Vaccine injuries are rare and estimates that one person has been compensated for every million doses distributed in the United States.1 However, HRSA fails to acknowledge that there is no mechanism for measuring how many injuries and deaths after vaccination have occurred but have never been reported.

The issue at hand is that the number of petitions to the VICP has dramatically increased over the last few years. Approximately $1 billion (a quarter of the total amount of payout since 1989) has been given out to Vaccine-injured victims in just the last four years.1

Fair Warning quotes Barbara Loe Fisher, co-founder and president of The National Vaccine Information Center, who said, "We're bitterly disappointed. In my view, this has been turned into stockholder's dream and a consumer's worst nightmare,"1 She noted that two thirds of petitioners to the VICP are turned away, which deviates from the original purpose of the VICP-to presume causation unless there is another biologically plausible explanation for the Injury or death following vaccination.1

In 2014, the Government Accountability office (GAO) was critical of the VICP, pointing out that most claims took multiple years-some more than a decade-to be resolved.4

Flu-like symptoms are also common with Microwave Sickness, a federally recognized illness (see 1, 2) and Electromagnetic Sensitivity, a federal recognized disability (see 1, 2). These conditions are caused or worsened by exposure to Electromagnetic Radiation (EMR) including cell phone and WiFi radiation.

The Vaccine Compensation Program Has Doled Out $4.1 Billion and Obama Added More Vaccines To Government Protected List in Dec. 2016

In 1986 the government established a federal no-fault system to compensate victims of Injury caused by Vaccines after Congress passed the National Childhood Vaccine Injury Act (NCVIA). They created an excise tax, which supports this Federal program while relieving drug companies of liability for the side effects from Vaccines. This translates to taxpayers picking up the tab on all petitions filed for Injury or death from Vaccines, and settlements agreed upon through the Vaccine Injury Compensation Trust Fund. To date, taxpayers have paid $4.1 billion in settled claims. Who oversees this?

- U.S. Department of Health and Human Services (HHS) hosts the Program, conducts medical reviews of petitions, and makes Court-ordered compensation payments;

- U.S. Department of Justice (DOJ) represents HHS in Court; and

- U.S. Court of Federal Claims (the Court) makes the final decision regarding whether a petition is compensated and the type and amount of compensation.

It is important to note that once an individual files a petition with the U.S. Court of Federal Claims, HHS has a medical staff review the petition to determine if it meets medical criteria for compensation. The DOJ then develops a report that includes the medical recommendation and legal analysis, and submits it to the court. It finally makes its way to a court-appointed special master, who decides whether the petitioner should be compensated, which generally takes place after a hearing in which both parties present evidence. The special master determines the amount and type of compensation, if awarded. In some cases where the petition is dismissed, they court (taxpayers) may pay attorneys' fees and costs. In short, it is a process that can take quite some time to reach finality.

Dear Mrs. McDaniels:

In 2016 then-candidate president Donald J. Trump campaigned on a matter of grave interest to many Americans, especially those who have Vaccine damaged children. Upon becoming President he spoke about establishing a Vaccine Science and Safety Commission headed up by Robert F. Kennedy Jr.

As a supporter of, and advocate for, Robert F. Kennedy Jr.'s Children's Health Defense organization (www.ChildrensHealthDefense.org) I would like to see the RNC's platform from now until the 2020 election cycle, include the fulfillment of one of President Trump's campaign issues i.e., Vaccine safety. President Trump has already fulfilled many of his campaign promises and establishing this Vaccine commission would be like 'icing on the cake'.

Vaccine industry misrepresentation of Vaccine safety is rooted in their failure of fully informed consent regarding health harming and toxic ingredients mandatorily injected into our children. Concomitantly, and possibly coincidentally, since the enActment of the National Childhood Vaccine Injury Act of 1986 the number of mandated Vaccines has escalated significantly. Currently, a child born today will have 65 doses of various Vaccines by the time they reach 18, with 49 of those doses for 14 Vaccines by age 6. The cumulative impAct of health damaging and toxic ingredients in Vaccines have never been studied and are now thought by many scientists to be a major part of the neurodevelopment and immune system damage being visited on our children. For example, most Vaccines contain aluminum, a known brain toxin, and many contain live viruses now suspect in this health crisis.

Particularly egregious is vaccinating pregnant women, which was anathema to the teaching of all health prActitioners who considered even the consumption of one aspirin to be of concern. . Could pregnancy vaccinations be contributing to the U.S. having 50% more first-day newborn deaths than all other industrialized nations combined? (5/7/13 Michelle Castillo CBS news report) Could the Hepatitis B Vaccine given newborns on their day of birth be contributing to these deaths?

Could these vaccinations be part of the reason our children are dead last in mortality of the 20 wealthiest nations? (1/8/18 CNN report by Jacqueline Howard).

According to Robert F. Kennedy Jr. and the Children's Health Defense more than half of our kids are chronically ill; Autism is as high as 28% in some states; and one in six children has a learning or behavioral disorder.
