Tricare fraud 'mastermind' sentenced to 18 years in prison

A Mississippi man described as the "mastermind of the largest health care fraud scheme" in that state's history has been sentenced to 18 years in prison and ordered to pay nearly $350 million in connection to his role in a scheme to defraud Tricare, Justice officials said.

Wade Ashley Walters, 54, of Hattiesburg, Miss., who earlier pleaded guilty to one count of conspiracy to commit health care fraud and one count of conspiracy to commit money laundering, was sentenced Jan. 15 in federal court in Mississippi, according to an announcement from the Justice Department. He is co-owner of numerous pharmaceutical distributors and compounding pharmacies - companies that make individualized medications for people.

He was ordered to pay nearly $288 million in restitution, and to pay an additional $57 million to forfeit his personal profit from the scheme, officials stated.

The sentencing "is another mile marker on the long road to justice for victims, our veterans, our military, and all American taxpayers, as the mastermind of the largest health care fraud scheme in Mississippi history has been held to answer for his crimes," said Mike Hurst, U.S. Attorney for the Southern District of Mississippi, in the Justice Department announcement.

Since 2007, federal officials have been engaged in a coordinated, large-scale investigation of health care fraud. Some involve schemes to submit claims to Medicare, Medicaid and Tricare for treatments that weren't medically necessary, and sometimes never provided. Some schemes resulted in convincing Tricare beneficiaries to fill prescriptions for pain creams, ointments and other topical medicines they didn't necessarily need, resulting from illegal kickback schemes.

Between 2012 and 2016, Walters ran a scheme to defraud Tricare and other health care benefits programs by distributing compounded medications that weren't medically necessary, officials stated.

According to Justice officials, Walters and his co-conspirators:

*adjusted prescription formulas to ensure the highest reimbursement without regard to effectiveness; and solicited recruiters to get prescriptions for high-margin compounded medications,

JACKSON, Miss. – Four executives from two Mississippi poultry processing plants have been indicted on federal charges tied to one of the largest workplace immigration raids in the U.S. in the past decade.

U.S. Attorney Mike Hurst and the acting director of U.S. Immigration and Customs Enforcement, Matt Albence, announced the indictments as the documents were unsealed Thursday.

Their announcement happened a day before the one-year anniversary of the raids in which 680 people were arrested at seven poultry plants in central Mississippi.

Hurst and Albence also scolded journalists for reports that focused on the arrests separating children from immigrant parents who were sent to detention centers.

"If a parent puts their child in that position where they commit a criminal act that subjects them to being arrested and detained … that responsibility falls on them," Albence said.

None of the four people from the newly unsealed indictments were arrested on the day of the raids, said Hurst, who is the U.S. attorney for south Mississippi. He said they worked as managers, supervisors or human resources employees.

Hurst said journalists have failed to focus on the American victims of identity theft - people whose Social Security numbers have been falsely used by immigrants working in the U.S. without proper documentation.

"The simple fact of the matter is, illegal aliens steal jobs of American citizens," Hurst said. "And illegal aliens depress the wages of American citizens."

Amelia S. McGowan, an attorney who works on behalf of immigrants for the Mississippi Center for Justice, responded later: "Trotting out anti-immigrant accusations won't hide that the only theft here is the executives' profiteering off vulnerable workers in unsafe conditions and at inadequate wages."

Albence said last year's raids in Mississippi have brought 126 indictments, 117 criminal arrests and 17 convictions. Hurst said the investigation continues.

The chairman of the U.S. House Homeland Security Committee, Democratic Rep. Bennie Thompson of Mississippi, said in a statement Thursday that he's glad the Trump administration, a year later, is bringing criminal charges against employers and plant managers.

"However, the Administration still has not answered for the cruel and unnecessary family separation inflicted on hundreds of Mississippi families and how it continues to poorly treat immigrants," Thompson said. "With hundreds left behind, it's clear that working families, rather than the employers taking advantage of these families, are the ones that continue to suffer from the effects of this raid."

Two people from the indictments unsealed Thursday - Salvador Delgado-Nieves and Iris Villalon - worked at A&B Inc., a plant in Pelahatchie.

Delgado-Nieves, 57, of Pelahatchie, was charged with harboring people who were in the U.S. illegally and assisting them with falsely presenting themselves as U.S. citizens. He was also charged with helping immigrants obtain false Social Security cards and of making false statements to law enforcement. Conviction would carry up to 74 years in prison and $2.5 million in fines, Hurst said.

Villalon, 44, of Ocean Springs, Mississippi, was charged with harboring a person who was in the U.S. illegally and one count of making false statements about hiring immigrants without proper documentation. Conviction would carry up to 20 years in prison and $750,000 in fines, Hurst said.

The two others indicted - Carolyn Johnson and Aubrey "Bart" Willis - worked for Pearl River Foods LLC in Carthage.

A indictment says Johnson, 50, of Kosciusko, Mississippi, was a human resources manager, and Willis, 39, of Flowery Branch, Georgia, was manager of the plant.

Johnson was charged with harboring people who were in the U.S. illegally, wire fraud and aggravated identity theft. Conviction on all charges would carry up to 84 years in prison and $2.25 million in fines, Hurst said.

Willis was charged with harboring people in the U.S. illegally. Conviction on all charges would carry a maximum of 50 years in prison and $1.25 million in fines, Hurst said.

An indictment says both Willis and Johnson harbored immigrants after the plant was raided.

Villalon, Johnson and Willis appeared before a magistrate Thursday. Each pleaded not guilty, and each was released. Each declined to comment outside the courtroom.

A hearing for Delgado-Nieves was also scheduled for Thursday but was delayed by more than an hour.

Georgia man sentenced for transporting drugs disguised as children's candy

JACKSON, Miss. - A Georgia man was sentenced to 151 months in federal prison Tuesday, followed by five years of supervised release, for illegally transporting 41.97 kilograms of 100% pure methamphetamine and 4.5 kilograms of heroin that had been smuggled into the United States from Mexico. The sentencing was announced by U.S. Immigration and Customs Enforcement's (ICE) Homeland Security Investigations (HSI) New Orleans Special Agent in Charge (SAC) Jere T. Miles and U.S. Attorney Mike Hurst.
"By concealing dangerous narcotics as children's candy, the defendant targeted our most vulnerable population, our youth," said HSI New Orleans SAC Jere T. Miles. "Thanks to HSI special agents, and our partners at the Mississippi Bureau of Narcotics and the Rankin County Sheriff's Office, our communities will be safer with this criminal behind bars."

"This criminal endangered not just our citizens but our children, stooping so low as to disguise this poison as candy just so he could make a quick buck, caring not that it would cause damage, destruction and death in our communities. Because of the great work of our federal, state and local law enforcement, as well as our prosecutors, this criminal will not be peddling these toxins to our kids or anyone else anymore," said U.S. Attorney Hurst.

On April 16, 2018, Cleveland James McKinney, 30, of Atlanta, traveled to Brandon, Mississippi from Atlanta, to retrieve a drug shipment that originated in Mexico and entered the United States through Brownsville, Texas. The drugs were concealed in what appeared to be shrink-wrapped, bulk packaged children's candy. McKinney was to transport the drugs to Atlanta and deliver them to his co-conspirator, Evelyn Michelle Hernandez.

Unbeknownst to McKinney, HSI already had intercepted the narcotics shipment and had replaced the drugs with a false substance in packaging almost identical to the children's candy packaging that had concealed the illegal methamphetamine and heroin. McKinney drove to the designated location and retrieved the packages that he believed contained the illegal drugs. He then began his return trip to Atlanta. He was arrested shortly thereafter. McKinney was charged in a federal criminal indictment and pled guilty Nov. 21, 2019. At the Tuesday sentencing by Senior U.S. District Judge David Bramlette III, McKinney was also ordered to pay a $1,500 fine.

Hernandez was also indicted and sentenced Nov, 19, 2019 to 168 months in federal prison.

This case was investigated by HSI, the Mississippi Bureau of Narcotics, and the Rankin County Sheriff's Office Interdiction Task Force. It was prosecuted by Assistant United States Attorney Carla J. Clark.

Illegal Alien from Mexico Pleads Guilty to Human Smuggling Conspiracy

Gulfport, Miss. - Javier Tellez-Lopez, 38, an illegal alien from Mexico living in South Carolina, pled guilty yesterday before Senior U.S. District Judge Louis Guirola, Jr. to conspiracy to transport illegal aliens within the United States, announced U.S. Attorney Mike Hurst, Jere T. Miles, Special Agent in Charge of U.S. Immigration & Customs Enforcement's (ICE) Homeland Security Investigations (HSI) in New Orleans, and Gregory K. Bovino, Chief Patrol Agent of the U.S. Border Patrol's New Orleans Sector.

Tellez-Lopez will be sentenced by Judge Guirola on July 31, 2019, at 10:00 a.m. He faces a potential maximum penalty of 10 years in prison, followed by three years of supervised release, a maximum $250,000 fine, and special assessments that could total $5,100. He will also be subject to immigration removal proceedings.

On January 28, 2019, an interdiction agent with the South Mississippi Metro Enforcement Team conducted a traffic stop on a GMC Yukon XL with South Carolina license plates at or about the 62-mile marker on interstate I-10 eastbound in Jackson County. The agent observed eight occupants of the vehicle, which was being driven by Javier Tellez-Lopez.

Border Patrol Agents arrived on the scene shortly thereafter, and interviewed the occupants of the vehicle as to their citizenships, determining none had proper documents and all were illegally present in the United States. Of the eight total vehicle occupants (two drivers and six passengers), all were illegal aliens from Mexico. All occupants were arrested and transported to the Border Patrol Station in Gulfport. HSI and Border Patrol agents determined the six passengers were being smuggled within the United States. Further investigation determined that five of the six passengers had unlawfully returned after being formally removed from the United States. Each of these five passengers were separately prosecuted by the U.S. Attorney's Office.

U.S. Attorney Hurst praised the cooperation exhibited by Homeland Security Investigations, the United States Border Patrol, the South Mississippi Metro Enforcement Team, the Jackson County Sheriff's Department and the City of Gautier Police Department. Assistant United States Attorney Stan Harris is the prosecutor for the case.
