Israel-Palestine War: For UK Mainstream Media, What Israel Says Goes
The media coverage of the genocidal war on Gaza shows that it is still ingrained in the western psyche that Israel, not its Palestinian victims, has the benefit of the doubt
Israel to cut Gaza links after war, said a Financial Times headline last weekend, with no attribution or quotation marks. As if such a cut could happen.
What Israel says goes.
This sums up much of western mainstream media coverage of Israel and Palestine over the past 22 years, and especially the BBC's. This is because, since the Second Intifada in 2001, the realities and origins of Israel's 75-year campaign to oust or subdue the Palestinians have never been properly explained.
The long displacement of the Palestinian nation and its reduction by means of expulsion, attrition, containment and violence have rarely been granted corrective context in our media.
Now, it seems the BBC and others are making desperate attempts to put this right, with background analysis and explanatory programmes, such as the series last week on BBC Radio 4, Understand: Israel and the Palestinians. But it is all much too late.
Israel, after the 7 October attack by Palestinian fighters, has been able to grasp the moral high ground and portray the breakout and killings as "unprovoked", with western reporters' acceptance. It became, in the eyes of the West, simply a robust response to terrorism.
In the same FT, HA Hellyer, from the Royal United Services Institute, a London military think-tank, is quoted repeating points by analysts such as Greg Philo and Mike Berry, in their two books Bad News from Israel and More Bad News from Israel, and myself, in the Guardian and elsewhere, made during and after the Second Intifada.
"There are scores of international journalists in Israel who can cover every detail of every atrocity," Hellyer said. "But there is nothing of similar depth available when it comes to the incredible civilian catastrophe unfolding in Gaza."
This, crucially, he went on, has the effect of dehumanising Palestinian victims.
"This means... " he said, "that westerners are more immune to Palestinian civilian suffering than to Israeli suffering."
So, basically, Israelis are "people like us", and Palestinians are an incoherent and anonymous mass.

Vaccine mandate for Navy SEALs to remain blocked, US Court of Appeals rules
A federal appeals court denied the Biden administration's attempt to reinstate the U.S. Navy's COVID-19 vaccine requirement Monday, more than a month after a federal judge in Fort Worth initially halted the mandate.
The mandate, which required all active-duty Navy service members to be fully vaccinated by Nov. 28, is being challenged by a group of U.S. Navy SEALs and other Naval special warfare personnel. The group says the mandate violates their religious freedom and that they have unjustly been denied religious exemptions from receiving the vaccine.
Their lawsuit is against President Joe Biden, the Department of Defense, the Secretary of Defense and the Secretary of the Navy.
In early January, U.S. District Judge Reed O'Connor of the Northern District of Texas signed a preliminary injunction blocking the mandate while the case reaches a final judgment.
On Monday, the U.S. Court of Appeals for the Fifth Circuit denied the Department of Defense's emergency stay request, which would have allowed the mandate to go into effect as the case goes through courts.
"[Evidence] suggests that the Navy has effectively stacked the deck against even those exemptions supported by Plaintiffs' immediate commanding officers and military chaplains," the three-judge panel said.
First Liberty Institute, a nonprofit interest law firm based in Plano, is representing the SEALs and other personnel in the suit.
"Our military should be welcoming service members, not forcing them out because of their religious beliefs," said Mike Berry, director of military affairs for First Liberty Institute.

Federal judge blocks Pentagon from punishing unvaccinated Navy SEALs, other special forces members
Thursday, January 13, 2022
Judge Reed O'Conner recently ruled that the Wuhan coronavirus (COVID-19) pandemic provides the government with "no license to abrogate the freedom" that any American has. The January 3 ruling barred the Department of Defense (DOD) from punishing a group of Navy SEALs and other special forces members who refused COVID-19 vaccines on religious grounds.
The judge said the "loss of religious liberties outweighs any forthcoming harm to the Navy" and that even the direst circumstances cannot "justify the loss of constitutional rights."
First Liberty Institute (FLI) General Counsel Mike Berry hailed the ruling as a victory, but noted that Navy service members continue to face "intimidating tactics" in the guise of military discipline actions for refusing the vaccine.
In several Fox Business Live interviews, Berry said these Navy service members are fighting for their careers, their futures and their families.
"What the Navy is doing to them is outrageous. They're punishing them - forcing them to choose between their faith and serving their country. They're going after their families. Their dependents [spouses and children who are not subject to DOD authority] have been told that they can't travel even for unofficial reasons," Berry said.

Federal Judge Grants Temporary Injunction to Group of Navy SEALs Seeking Religious Exemption from COVID Vaccine
United States District Judge Reed O'Connor granted a temporary injunction to a group of Navy SEALsfrom the Biden COVID vaccine mandate based on their requested religious exemptions.
Judge O'Connor was appointed by George W. Bush in 2007.
The AP reported:
The United States District Court for the Northern District of Texas today issued a preliminary injunction, stopping the Department of Defense from punishing military service members who have religious objections to the vaccine mandate. First Liberty Institute filed a federal lawsuit and motion for preliminary injunction on behalf of dozens of U.S. Navy SEALs and other Naval Special Warfare personnel against the Biden Administration and the Department of Defense for their refusal to grant religious accommodations to the COVID-19 vaccine mandate.
The court's order can be read here.
"Forcing a service member to choose between their faith and serving their country is abhorrent to the Constitution and America's values," said Mike Berry, General Counsel for First Liberty Institute. "Punishing SEALs for simply asking for a religious accommodation is purely vindictive and punitive. We're pleased that the court has acted to protect our brave warriors before more damage is done to our national security."

A coalition of Navy SEALs and other highly trained fighters are suing the Biden administration over its COVID-19 vaccine mandate.
The group: composed of 26 Navy SEALs, five Navy special warfare combatant craft crewmen, one Navy explosive ordnance disposal technician and three Navy divers.
"The fact that the government has not granted a single religious exemption from the vaccine mandate shows that the Biden Administration does not care about religious freedom," Mike Berry, general counsel for First Liberty Institute.
"After all these elite warriors have done to defend our freedoms, the Navy is now threatening their careers, families, and finances. It's appalling and it has to stop before any more harm is done to our national security," he said.

US Navy reverses unlawful order banning troops from indoor Mass, religious services
'This proves' that 'there is no pandemic exception to the First Amendment,' said Mike Berry, First Liberty Institute General Counsel.
WASHINGTON, D.C., July 9, 2020 (LifeSiteNews) - The United States Navy has revised its policy prohibiting active service members from attending in-person religious services. Those who disobeyed and attended church services had risked court-martial.
The move is seen as an important victory on behalf of religious liberty by Navy personnel affected by the previously enacted ban, and by those who fought on their behalf.
The change comes just days after First Liberty Institute sent a letter on behalf of active duty officer Daniel Schultz and several other service members affected by the order, asking the U.S. Navy to grant an accommodation so that he could attend indoor religious services.
The rollback also comes after LifeSiteNews launched a petition on June 30 which quickly garnered more than 18,000 signatures asking President Donald Trump - who had previously declared religious services to be essential - to intervene.
Archbishop Timothy Broglio, Archbishop for the Military Services, USA, issued a statement on July 5 in which he called the ban "odious to Catholics."
On June 24, the Navy issued an order banning troops from attending indoor religious services, although other activities such as using mass transit, hosting social gatherings of any size, and participation in protests were all permitted.
The order specifically stated that "service members are prohibited from visiting, patronizing, or engaging in … indoor religious services."
The Navy has now walked back the order, which religious liberty advocates said was a most egregious overstepping of military personnels' freedom to worship.
A memo from Acting Undersecretary of the Navy Gregory Slavonic sent to the Commandant of the Marine Corps and the Chief of Naval Operations offered new guidance concerning the order stating that nothing contained in previous instructions "should be construed to restrict attendance at places of worship where attendees are able to appropriately apply COVID-19 transmission mitigation measures, specifically social distancing and use of face covering."
"I am directing you ... to inform Commanders to incorporate this clarification allowing attendance at religious services where COVID-19 transmission mitigation measures may be appropriately applied," added Slavonic.

Cmdr. Elizabeth Baker, Navy Region Mid-Atlantic spokeswoman, said in response to the complaint
that no one was being coerced to attend the seminar.
"It's not any kind of directive from the chaplain to lead like Jesus ...
it's a discussion series after services only for those who volunteer to attend," she said in a response to Navy Times.
An advisory board member of MRFF countered that discussions called "Lead like Mohammed"
or "Atheist Leadership" would likewise not be "tolerated" on the base.

The high court ruled that the monument, which has stood on public land in Maryland for approximately 50 years,
does not violate the Establishment Clause of the U.S. Constitution.

An adviser to the Pentagon's Counter-Extremism Working Group (CEWG) is warning the Biden administration's efforts to purge the military of "extremists" could violate individual First Amendment rights.
Mike Berry, general counsel for First Liberty Institute and Marine Corps reservist, first sounded the alarm in a recent op-ed that said the CEWG is looking to formulate a new definition of extremism that could include constitutionally protected speech.
He wrote in the Washington Examiner on June 19:
Instead of monitoring external threats, the Pentagon is on a mission to identify and remove whomever it labels as extremists from America's armed forces. Ironically, the CEWG has yet to define what it means by 'extremism.' Extremism is usually defined as the threat or use of violence to achieve an ideological agenda. But the Pentagon is now poised to expand upon that definition to include constitutionally protected speech. In other words, sticks and stones may break our bones, but words are the biggest threat.
Defense Secretary Lloyd Austin set up the Counter-Extremism Working Group (CEWG) in April after vowing to root out extremists and ordering the entire military force to spend a day discussing "extremism." Since there is no Pentagon definition for "extremism," Austin tasked the CEWG, led by Bishop Garrison, to come up with a definition and to define activities that would be considered "extremist."
Berry, who is part of an outside group of experts appointed to help the CEWG, told Breitbart News in a recent phone interview some of the things the group discussed on a recent hour-long conference call were "eyebrow raising or alarming." He said members of the advisory group are bound by "Chatham House rules" in where they can discuss what was said on the call, but not who said it.
Berry said he asked the CEWG how it intended to define "extremism" and the answer he got was something to the effect of: "We're still working on that, we'll probably take the existing definition and expand it." Berry said that response was "problematic."
"The existing definition - which has been around for years and has developed really through a law enforcement perspective - it seems to be pretty adequate," he said. "It sufficiently captures what needs to be captured. And if they want to expand it, they're really going to expand it to things that have been traditionally protected by the Constitution."
As Breitbart News recently reported, a senior Biden administration official said on a background conference call with reporters that the Pentagon was working "quite hard" to come up with a definition that "ratchets up the protections but also respects expression and association protections."
Berry said he was also alarmed by what sounds like a plan to monitor service members' social media accounts for signs of extremism - which he feels crosses the line between defining extremism by one'sactions- which the Pentagon has said it would stick to - and defining extremism by one's "thoughts or beliefs."
"I just don't know how you can reconcile the Constitution with trying to criminalize someone's thoughts and beliefs," he said. Berry added questions were raised about it and there was no adequate answer.
"When somebody asked how does DOD intend to reconcile the social media monitoring with First Amendment issues, the response was, 'Yeah, we need to figure that out, it's really complicated.' So then why are you looking to do it when you haven't even figured it out, the legality of it?" Berry said.
He said he does not know about any current effort to monitor social media posts and that the group just discussed future plans to do so.
The Intercept recently reported the Pentagon was considering using private contractors to monitor service members' social media accounts to circumvent First Amendment concerns, but the Pentagon denied the report was true.
In addition, Berry said monitoring social media accounts sounds like an "intelligence collection type activity," which is problematic since the Defense Department cannot conduct intelligence collection on U.S. citizens.
He revealed one hypothetical discussed on the call for how social media information could be used - if a service member was found to have an "88" tattoo - which could potentially stand for "Heil Hitler," since "h" is the 8th letter of the alphabet, or refer to something benign, such as someone's birth year.
Participants speculated that if the service member denied it was linked to white supremacy, social media could be used to "cross-reference" the claim. Berry said the notion that a service member would have to effectively prove his or her innocence was odd.
"The social media monitoring thing really reminds me of what China does with its social credit system," he said. ......
