JACKSON, Miss. – Four executives from two Mississippi poultry processing plants have been indicted on federal charges tied to one of the largest workplace immigration raids in the U.S. in the past decade.
U.S. Attorney Mike Hurst and the acting director of U.S. Immigration and Customs Enforcement, Matt Albence, announced the indictments as the documents were unsealed Thursday.
Their announcement happened a day before the one-year anniversary of the raids in which 680 people were arrested at seven poultry plants in central Mississippi.
Hurst and Albence also scolded journalists for reports that focused on the arrests separating children from immigrant parents who were sent to detention centers.
"If a parent puts their child in that position where they commit a criminal act that subjects them to being arrested and detained … that responsibility falls on them," Albence said.
None of the four people from the newly unsealed indictments were arrested on the day of the raids, said Hurst, who is the U.S. attorney for south Mississippi. He said they worked as managers, supervisors or human resources employees.
Hurst said journalists have failed to focus on the American victims of identity theft - people whose Social Security numbers have been falsely used by immigrants working in the U.S. without proper documentation.
"The simple fact of the Matter is, illegal aliens steal jobs of American citizens," Hurst said. "And illegal aliens depress the wages of American citizens."
Amelia S. McGowan, an attorney who works on behalf of immigrants for the Mississippi Center for Justice, responded later: "Trotting out anti-immigrant accusations won't hide that the only theft here is the executives' profiteering off vulnerable workers in unsafe conditions and at inadequate wages."
Albence said last year's raids in Mississippi have brought 126 indictments, 117 criminal arrests and 17 convictions. Hurst said the investigation continues.
The chairman of the U.S. House Homeland Security Committee, Democratic Rep. Bennie Thompson of Mississippi, said in a statement Thursday that he's glad the Trump administration, a year later, is bringing criminal charges against employers and plant managers.
"However, the Administration still has not answered for the cruel and unnecessary family separation inflicted on hundreds of Mississippi families and how it continues to poorly treat immigrants," Thompson said. "With hundreds left behind, it's clear that working families, rather than the employers taking advantage of these families, are the ones that continue to suffer from the effects of this raid."
Two people from the indictments unsealed Thursday - Salvador Delgado-Nieves and Iris Villalon - worked at A&B Inc., a plant in Pelahatchie.
Delgado-Nieves, 57, of Pelahatchie, was charged with harboring people who were in the U.S. illegally and assisting them with falsely presenting themselves as U.S. citizens. He was also charged with helping immigrants obtain false Social Security cards and of making false statements to law enforcement. Conviction would carry up to 74 years in prison and $2.5 million in fines, Hurst said.
Villalon, 44, of Ocean Springs, Mississippi, was charged with harboring a person who was in the U.S. illegally and one count of making false statements about hiring immigrants without proper documentation. Conviction would carry up to 20 years in prison and $750,000 in fines, Hurst said.
The two others indicted - Carolyn Johnson and Aubrey "Bart" Willis - worked for Pearl River Foods LLC in Carthage.
A indictment says Johnson, 50, of Kosciusko, Mississippi, was a human resources manager, and Willis, 39, of Flowery Branch, Georgia, was manager of the plant.
Johnson was charged with harboring people who were in the U.S. illegally, wire fraud and aggravated identity theft. Conviction on all charges would carry up to 84 years in prison and $2.25 million in fines, Hurst said.
Willis was charged with harboring people in the U.S. illegally. Conviction on all charges would carry a maximum of 50 years in prison and $1.25 million in fines, Hurst said.
An indictment says both Willis and Johnson harbored immigrants after the plant was raided.
Villalon, Johnson and Willis appeared before a magistrate Thursday. Each pleaded not guilty, and each was released. Each declined to comment outside the courtroom.
A hearing for Delgado-Nieves was also scheduled for Thursday but was delayed by more than an hour.

Jackson, Miss. - U.S. Attorney Mike Hurst, joined by Acting Director of U.S. Immigration and Customs Enforcement Matt Albence, ICE's Homeland Security Investigations (HSI) New Orleans Acting Special Agent in Charge Gilbert Trill, and U.S. Department of Labor Office of Inspector General Special Agent in Charge Rafiq Ahmad announced today the unsealing of indictments returned by a Federal Grand Jury in the Southern District of Mississippi against four individuals who were managers, supervisors, or human resources personnel at companies where criminal and administrative search warrants were executed in August 2019 and 680 illegal aliens were detained.
"This office has a successful history of prosecuting employers for violating our immigration laws, and today marks another step in ensuring that justice is fairly and impartially done, no Matter the law-breaker. I want to thank our partners at ICE Homeland Security Investigations& and our office's federal prosecutors for doggedly pursuing these criminal violations. The indictments unsealed today mark the beginning, not the end, of our investigations and prosecutions. Rest assured that we will continue to pursue criminal wrongdoers and enforce our criminal laws wherever the evidence may take us," said U.S. Attorney Mike Hurst.
"The results of this ongoing criminal investigation illustrate the importance of strong interior enforcement. The arrests made last year pursuant to U.S. Immigration and Customs Enforcement's execution of more than a dozen search warrants, have thus far yielded 126 indictments, 117 criminal arrests and 73 convictions. In total, more than 403 individuals falsified social security information in order to gain illegal employment in the United States," said acting ICE deputy director and senior official performing the duties of the director Matthew T. Albence. "Companies who intentionally or knowingly base their business model on an illegal workforce deprive law abiding citizens and lawful immigrants of employment opportunities, which are especially critical as our economy looks to recover from the challenges faced by the COVID-19 pandemic. ICE Homeland Security Investigations will continue its commitment to uphold the laws Congress has passed. These laws protect jobs for the legal workforce, reduce incentives for illegal migration, and eliminate unequitable financial advantages for businesses employing illegal immigrants."

Matt Albence, the acting director for U.S. Immigration and Customs Enforcement, will leave his post by Labor Day, the Washington Examiner has learned.Albence informed senior ICE officials in a private phone call Thursday evening that he plans to retire after serving a year in his position.Albence, a 26-year law enforcement veteran, was appointed as head of ICE instead of being nominated or Senate-confirmed for the job. He assumed the position in June 2019 after working as deputy director of its deportation operations, replacing then-acting ICE Director Mark Morgan after he moved to head Customs and Border Protection.Albence made headlines in 2018 when he told lawmakers at a congressional hearing that family immigration detention centers were "more like summer camp" than jail.Albence is the fourth acting director of ICE since President Trump took office in January 2017. The Trump administration selected Tom Homan as acting director in early 2017. Homan was nominated for the job in November 2017 but retired in June 2018 after the Senate did not move to confirm him.

ICE Denver names new Field Office Director
DENVER - U.S. Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO) is pleased to announce the selection of John Fabbricatore to the Senior Executive Service and to serve as the field office director (FOD) for the Denver Field Office May 26.
ICE Deputy Director and Senior Official Performing the Duties of the Director Matt Albence announced the selection.
Fabbricatore's area of responsibility as the FOD for the Denver office includes Colorado and Wyoming, covering over 207,000 square miles of territory with 10 sub-offices.
Most recently, Fabbricatore served as a deputy FOD for ERO Denver, where he also served as acting FOD for much of 2019. In 2018, he was detailed for six months to the DHS Joint Task Force-West in San Antonio, Texas, where he served as deputy chief of staff.
Fabbricatore oversaw the initial rollout of Operation Opioid Counter Strike, a multi-agency, cross-corridor operation at the federal, state, local, tribal, and international levels to disrupt Transnational Criminal Organizations trafficking in opioids. Part of this operation resulted in over 50 Honduran nationals dealing heroin being taken off the streets of Denver in 2016.
Fabbricatore is a proud veteran of the U.S. Air Force where he served as a security forces airman from 1991 to 1996 where he completed tours in Germany and Saudi Arabia during Operation Desert Storm and Operation Southern Watch. He transitioned to civilian service in 1996 with the Federal Protective Service as a police officer for the General Services Administration, where he was assigned to the New York Terrorist Trials Operations Command in New York City.
In 1997, FPS transferred him to Denver, Colorado, to work on both of the Oklahoma City bombing trials. Two years later, he became a deportation officer for U.S. Immigration and Naturalization Service in Denver.
In 2003, Fabbricatore was selected to be an instructor for the newly formed ICE ERO Academy at the Federal Law Enforcement Training Center, where he taught in the Physical Techniques Division and the ICE ERO Fugitive Operations Academy.
In 2005, Mr. Fabbricatore was promoted to supervisory detention and deportation officer for the Denver Field Office where he helped establish the Criminal Alien Program and the 287(g) Task Force. The Criminal Alien Program identifies, detains and removes aliens who are incarcerated within federal, state, and local prisons and jails, as well as at-large criminal aliens.
He was promoted in 2011 to assistant FOD, where he managed a variety of programs including the Non-Detained Docket, Criminal Alien Program, Violent Criminal Alien Section, Mobile Criminal Alien Team, Alternatives to Detention, and Fugitive Operations.
Fabbricatore attended the U.S. Marshals Service Training Academy and completed the Fugitive Investigator Course.
A native of Long Island, New York, Fabbricatore, 47, has lived in the Denver area for over 20 years, making Colorado his home.

The acting head of Immigration and Customs Enforcement (ICE) is accusing the state of New York of putting lives at risk by shutting federal immigration authorities out of state Department of Motor Vehicles (DMV) databases – and highlighting that the state is still granting access to that same data to Canadian law enforcement.

If we learned anything from 9/11 it's that information needs to be shared quickly and fully, and what this has done is to roll back the clock," Acting Immigration and Customs Enforcement (ICE) Director Matt Albence told Fox News in an interview Friday. "This is a pre-9/11 mentality in a post-9/11 world and it's dangerous."
The controversial "Green Light Law," which went into effect in New York in January, primarily grants drivers' licenses to illegal immigrants. It's part of a number of laws nationwide designed to integrate illegal immigrants into society, and also protect them from deportation. But, in a crucial step that goes further than similar license laws in other states, New York's forbids state DMV agencies from sharing data with immigration authorities like ICE and Customs and Border Protection (CBP).
It is this aspect of the law that's furiously opposed by the Department of Homeland Security (DHS) as well as New York police groups, who say it blinds law enforcement and makes officers less safe. An association of New York sheriffs said it was "offensive" that they had been forced to sign non-disclosure agreements promising not to share info with their federal partners. The law also requires that license holders be told within days when immigration enforcement agencies request DMV data – something law enforcement fears could alert suspects that they are being investigated.
While agencies like ICE deal with immigration, they are also tasked with investigating other crimes such as human smuggling, drug trafficking and narcotics cases. All such investigations can be impacted by the law. Albence noted to Fox News that New York, like many other states, shares DMV data with Canadian law enforcement – including its border authorities – but not American law enforcement authorities like ICE and CBP.
"Drivers' licenses, car registrations, all that is part of the same database and they're frozen out under the Green Light Law," he said. "All of those are critical and what is unbelievable is that the state of New York continues to give that information to Canadian law enforcement, but they won't share with their own law enforcement in this country."

U.S. Immigration and Customs Enforcement is prepared to go to court with two "sanctuary cities," New York City, New York, and Denver, Colorado, if they fail to provide personal information on illegal immigrants with criminal records released in each city instead of being transferred to ICE.
"We expect them to comply" with subpoenas for the information, said acting ICE Director Matt Albence at a press conference in Washington on Thursday. "If they don't comply, we'll be working with DOJ to go to district court to force them to comply with the requirements," Albence said, noting the rule in the U.S. Code that he said justified the move. "The individuals that fail to comply can be held in contempt," he said. "They can show up to court with a toothbrush because they might not be going home that night. Because they could be jailed for failure to comply with a lawful order from a judge. That's the route we're going."
ICE looks at local arrests to see if a person is illegally in the country. If they appear to be an illegal immigrant, the officer can request that the local law enforcement agency notify ICE before they are released so that ICE can take custody and begin deportation proceedings. Sanctuary zones release illegal immigrants, including those with criminal convictions, after they make bail or serve time in jail without notifying ICE.
Albence said the subpoenas were a "last resort" to force "sanctuary cities" to help federal officers find people at their homes and jobs if local jails will not turn them over while in secure settings. ICE focuses most of its effort going after people illegally in the country charged or convicted of criminal offenses.
"Hopefully, when some of these other jurisdictions that don't want to cooperate see that we're taking this seriously, maybe they'll come around and try to help us help their own communities," said Albence, who was tapped to lead the 20,000-person agency six months ago. He did not answer if Denver or New York would face retaliation from the federal government if they do not honor the subpoenas.
Last year, ICE asked New York City to notify it before releasing 7,500 illegal immigrants so that it could transfer each person into custody. None of the requests were honored.
For the first time ever last week, ICE subpoenaed a local law enforcement office, sending four requests to the New York Department of Corrections and four to the Denver Justice Center.
The subpoenas ask for the phone number, home address, type of vehicle, employer, and more information that can help ICE's Enforcement and Removal Operations officers go into the person's community and try to arrest them. Albence said that sanctuary cities force ICE to squander resources running around trying to find people and that localities are forced to waste manpower rearresting criminals who could have been deported.
"How much time could NYPD could have dedicated to doing other functions instead of continually arresting people that are here illegally, have no lawful right to be here, and are committing further crimes?" he asked. "Our goal is to find them before they commit further crimes, right? We're actually able to prevent crimes if we can get these people off the street."

ICE deportation raids underway in New York City, 'number of jurisdictions,' official says
A nationwide crackdown to apprehend thousands of illegal immigrants across the country began late Saturday in the nation's largest city and several other places, according to an official.
Immigration and Customs Enforcement (ICE) resumed its previously announced plan to apprehend thousands of illegal immigrants who've been given orders to leave the country, targeting people in at least 10 cities. The ICE raids began late Saturday and into the early morning hours on Sunday in "a number of jurisdictions," not just New York City, a senior administration official confirmed to Fox News.
In an exclusive interview on "FOX & friends," Acting ICE Director Matt Albence said while he couldn't speak to anything specifically from an operational perspective, the overarching concern when the agency conducts any sort of enforcement operation is "the safety and security of both our officers that are conducting the operation as well as the public."
"We are doing targeted enforcement actions against specific individuals who have had their day in immigration court and have been ordered to be removed by an immigration judge," Albence told Fox News' Griff Jenkins. "We are merely executing those lawfully issued judge's orders."
Albence, who said using the term raid does everyone "a disservice," added the agency is focusing on people who had had the opportunity to make an asylum claim in front of an immigration judge and chose not to do so or didn't appear for their first hearing. The acting director added that ICE gave those individuals the opportunity back in February to arrange for an orderly process to be removed from the country, but only 3 percent of people responded to letters that were sent out.
"At this point, we have no choice but to go out and execute those lawfully-issued removal orders from an immigration judge," he told "FOX & friends."

Pro-immigration 'activists' are about to be livid with rage - probably more so than at any time since Trump cancelled the 'zero tolerance' family separation policy last spring - as President Trump has reportedly directed ICE to begin rounding up illegal migrants who have received deportation orders, according to the Washington Post.
The mass roundups are expected to begin with a series of pre-dawn raids on Sunday across some of America's largest cities. As many as 10 cities, including Houston and Miami, are slate to host ICE agents during the first round of raids. Up to 2,000 families are expected to be targeted in what's been described as a "family op" (we can already imagine the wording of that AOC tweet).
Acting DHS Secretary Kevin McAleenan has been urging ICE to consider more targeted operations that would seek to detain smaller sums of illegal immigrants, most of whom have already been provided with attorneys.
McAleenan has warned that an indiscriminate operation to arrest migrants in their homes and at work sites not only risks separating children from their parents, but it risks undermining the agency's case to Congress as it begs for more money to combat the crisis at the border (if the border is where the crisis is, then why isn't ICE concentrating its assets at the border?)
But moving ahead with the raids is critical for the Trump Administration after the president warned on Monday that the mass roundups would begin 'next week'.
Next week ICE will begin the process of removing the millions of illegal aliens who have illicitly found their way into the United States. They will be removed as fast as they come in. Mexico, using their strong immigration laws, is doing a very good job of stopping people…….

Since WaPo sourced its story mostly to anonymous officials, ICE spokesperson Carol Danko declined to comment on the record, saying only that "as a law enforcement agency, ICE's mission is to uphold the rule of law; operations targeting violators of immigration laws are not only standard practice, but within the statutory authority prescribed by Congress."
As it rounds up families, ICE is planning to use hotel rooms and other spaces as ad hoc detention center for families as the roundups begin. Even certain individuals who can't be immediately deported might find themselves in custody under a policy known as "collateral arrests", explained in more detail below:
The agency is planning to use hotel rooms as temporary staging areas to detain parents and children until all the members ofi a family are together and ready for deportation. Officials also acknowledge that they might arrest individuals they cannot immediately deport - known as "collateral arrests" - and likely will release those people with ankle monitoring devices. Morgan, deputy ICE director Matt Albence and others are eager to begin the operation despite the risk of a public backlash against an agency after calls to "Abolish ICE" intensified in the wake of the administration's failed "Zero Tolerance" crackdown last year that separated more than 2,700 children from their parents.
Others believe Trump's warning serve an important purpose: To put migrants thinking of coming here on notice.
According to DHS statistics, fewer than two percent of the families who arrived from Central America in 2017 have been deported.
But with the first round opf Democratic primary debates just weeks away, regardless of how successful the operation is, expect these 'mass roundups' to generate some more unfavorable comparisons to the Third Reich from the furthest left elements of the Democratic Party.

Trump administration delivers warning to liberal states moving to bar ICE from courthouses

Attorney General Bill Barr and Acting Homeland Security Secretary Chad Wolf are warning state supreme courts in Washington and Oregon that moves to stop federal immigration enforcement from making arrests in and around courthouses will create an "unacceptable risk" by letting illegal immigrants convicted of violent crimes loose in communities.
"Regardless of how one views our immigration laws, we should all agree that public safety should be of paramount concern," says the letter from Barr and Wolf to chief justices in those states, obtained by Fox News. "Court rules that would purport to further restrict the lawful operations of federal law enforcement officials only serve to exacerbate sanctuary laws and policies that continue to place our communities at unacceptable risk.".....
"Put simply, the policies you are considering endanger the public and hamper law enforcement by interfering with that lawful process," the letter says.....
The letter, coming from two top department chiefs, is the latest sign of the administration ramping up its efforts against sanctuary cities. Acting ICE Director Matt Albence has held a series of press conferences highlighting the dangers of sanctuary policies, while the department is releasing lists of those with serious arrests who could one day be released into communities.
