Ex-Steinhoff CEO Jooste Dies [Suicide] Day After He's Fined $25 Million

(Bloomberg) – Markus Jooste, former chief executive officer of scandal-ridden retailer Steinhoff International Holdings NV, has died at 63.
His death comes just one day after South Africa's financial regulator levied a 475 million rand ($25 million) fine against him for making and publishing false, misleading or deceptive statements about the company. That was in addition to a 20 million rand previously levied by the regulator for insider trading.
The police statement said the cause of death was a fatal gunshot wound to the head.

A source, who declined to be named, told "Business Report": "Jooste thought he could keep the courts busy for many years."
The death of Jooste, 63, born on January 22, 1961, comes just a day after the FSCA imposed a R475-million administrative fine on Jooste for accounting irregularities at the company - the biggest such penalty that the FSCA has imposed on an individual.
After Deloitte confirmed that Steinhoff had falsified its financial statements, the JSE fined Jooste about $880 000 (R16.5m) for violations of its listing regulations while the SARB in 2021 seized assets worth up to R1.4 billion from Steinhoff and from Jooste's family trust. Jooste was also barred from holding office in listed companies for a period of 20 years.
Steinhoff International was liquidated last year after an accounting scandal brought it to its knees. In 2017, news broke of the country's biggest corporate fraud amounting to ?6.5bn (R134bn) which was explained as an accounting error. The fraud also cost the Public Investment Corporation close to R21bn of investments.
The FSCA said on Wednesday its administrative penalty on Jooste followed a thorough investigation of the former Steinhoff top executive. The FSCA also found former Steinhoff chief finance officer, Dirk Schreiber, guilty of publishing false, misleading, or deceptive statements about the company.
FSCA commissioner Unathi Kamlana said: "The imposition of a financial penalty of R475m on Markus Jooste comes after a thorough investigation found that Jooste and Dirk Schreiber made or caused the publication of misleading statements about Steinhoff. These are statements they knew or ought to have known were false, misleading or deceptive."
The authority found that Jooste was in contravention of the Financial Markets Act pertaining to the publication of financial statements for the period of 2014 to 2016 as well as for the 2017 half-year period. It said the Steinhoff securities which were listed on the JSE and on the Frankfurt Stock Exchange resulted in heavy losses for investors, including South African pension funds.
According to Kamlana, the FSCA was concerned that the "efficiency and integrity of financial markets" in South Africa had taken a knock from the behaviour of Jooste. For the period 2014 to 2016 and for the 2017 interim period, "the financial statements published for Steinhoff failed in material respect to provide useful information to investors, to lenders and other creditors and thereby concealing the true financial position" of Steinhoff.
"This meant that investors based their assessment of Steinhoff on false, incomplete or misleading information which resulted in material destruction of value estimated to run into hundreds of billions of rand, including losses suffered by pension funds. This type of behaviour is unacceptable, especially by senior executives," said Kamlana.
Jooste, at the time of his death, was under investigation by the National Prosecuting Authority in a criminal case, in which he faced penalties of up to R15m or 10 years' imprisonment, or both.
However, questions still remain unanswered about the SARB [South African Reserve Bank] and Steinhoff cross-border transactions after news broke this month that one of its former employees allegedly facilitated billions of Steinhoff rand out of South Africa via 16 exchange control applications.
The SARB told "Business Report" this week that: "All matters related to corruption or of a criminal nature were referred to the relevant law enforcement authorities in 2022, and the matter now resides with them."

Former Steinhoff executive, Stephanus Johannes Grobler, is appearing in the Pretoria Specialised Commercial Crimes Court on charges relating to corporate fraud against Steinhoff International Holdings.
In a media statement, police spokesperson Brigadier Thandi Mbambo said the Directorate for Priority Crime Investigation (known as the Hawks) and the National Prosecuting Authority (NPA) secured warrants of arrest against Grobler and Steinhoff chief executive officer, Markus Jooste.
"The exit routes were secured before the message of securing their attendance in court was shared with the defence to ensure that none of the suspects leave the borders," Mbambo said.
She said the suspects were expected to hand themselves over to police at the Pretoria Central police station on Friday, however, on Thursday, IOL reported that Jooste had died by suicide.
"After being notified of the arrest warrants, Mr Jooste allegedly committed suicide on the afternoon of March 21, 2024. Mr Grobler appeared in court this morning on the said charges," Mbambo said.
Western Cape police spokesperson, Lieutenant Colonel Malcolm Pojie said police were activated to attend to a shooting incident at about 2.40pm at Kwaaiwater Beach in Hermanus on Thursday.
"The deceased succumbed to a fatal gunshot wound to the head shortly after arrival at a private hospital. We can confirm that Hermanus SAPS opened an inquest docket for investigation," he said.
Grobler and Jooste face charges of fraud, a pattern of racketeering activities and contravention of Financial Markets Act brought against Steinhoff International Holdings.

While details around Jooste's death remain the subject of a police investigation, it has been reported that Jooste shot himself on Thursday.
Jooste's death comes following a penalty of R475million imposed by the Financial Sector Conduct Authority (FSCA) after it found that he contributed to the publication of misleading or deceptive financial statements about the company.
According to Business Report, Steinhoff was rocked by an accounting scandal in 2017, with audit firm Deloitte confirming the accounting irregularities.
In October last year, the disgraced businessman appeal against a fine given by the Johannesburg Stock Exchange (JSE) to the value of R15m, was upheld by the Financial Services Tribunal.
At the time, IOL reported that The JSE imposed "a public censure and the maximum permissible fine of R7,500,000 for Steinhoff's consolidated financial statements for the 2015 and prior financial periods and for the 15 months ended September 30, 2016, which did not comply with IFRS and the Listings Requirements, and was incorrect, false and misleading in material aspects".
Furthermore, the exchange also stated that Jooste would be given a "public censure and a permissible fine of R7,500,000 for his breaches of the listings requirements regarding the Steinhoff at Work transaction".
In addition, Jooste was served with an arrest warrant by a German court last year.
According to Bloomberg, the Regional Court of Oldenburg issued the warrant.
Born in Cape Town in 1961, Jooste rose through the ranks of the business world with a combination of sharp intelligence, undeniable charisma, and an ambitious vision for the future.
His early career was marked by significant achievements in the South African corporate sector, leading him to the pinnacle of his profession as the CEO of Steinhoff International, a global retail conglomerate with operations across Europe, Africa, and Australasia.
The avid horse breeder in 2016 was reported to be one of Africa's richest people, worth $400 million, according to Wikipedia.
Under Jooste's leadership, Steinhoff experienced unprecedented growth, expanding its footprint through aggressive acquisitions and diversification strategies.
His ability to navigate complex international markets and merge differing corporate cultures under the Steinhoff umbrella was widely regarded as a testament to his business acumen.
However, Jooste's illustrious career took a dramatic turn in December 2017 when allegations of accounting irregularities surfaced, leading to his immediate resignation.
The revelation sent shockwaves through the financial world, wiping billions off Steinhoff's market value and sparking investigations by regulatory authorities across several countries.

The uMkhonto weSizwe party has hit back at FNB after it closed the accounts of former president Jacob Zuma.
FNB earlier said the decision to close his accounts was based on an order of the High Court in KwaZulu-Natal.
But MK party spokesperson Nhlamulo Ndhlela said the decision was politically motivated and not based on reputational risk as claimed by the bank.
"The FNB's latest stunt of denying President Zuma access to much-needed banking services is not an isolated incident," Ndhlela said.
"It is part of a concerted effort by banks to punish those that are viewed by the colonial establishment as enemies."
He said financial institutions target those who are challenging the "colonial establishment".
The MK party called on the bank to re-open the accounts of Zuma because the decision it was ill-advised. This goes to other banks who have targeted other individuals in a similar fashion, it said.
If banks refuse to open the accounts of these individuals, the party said it would urge its supporters to close their accounts with these banks.
The MK party will engage in mass action against banks to stop them from getting into the political space.
The party wants banks to stay away from politics and focus on their business.
Ndhlela said Zuma was not the only one who has been targeted by the banks, but they must not allow this to continue.
"It is common course that Dr Iqbal Surve and his companies including Sekunjalo Group - a shining example of black excellence [yet he is Indian] - have had their banking facilities arbitrarily closed by all the infamous Big Four gang of ABSA, FNB, Nedbank and Standard Bank, for a flimsy and nebulous reason of allegedly posing reputational risks to these financial institutions," Ndhlela said.
"It is clear that they are a law unto themselves."
He said they will force financial institutions to transform.
He said the courts must be fair when adjudicating on these matters as well.
People like Markus Jooste who have caused reputational risk to the banks because of their alleged crimes have not been touched by the banks.
"The courts have also not been helpful in confronting these racist, politically- motivated moves. When Nedbank appealed the Equality Court's ruling that it reopens Sekunjalo Group's account(s), an all-white bench was allocated this case that is essentially about confronting the demon of racism that is rearing its ugly head within and across the banks," Ndhlela said.
"Unsurprisingly, the Equality Court's ruling was overturned with the net effect that Nedbank can close Sekunjalo Group accounts," he said.
"uMkhonto we Sizwe Party condemns this reckless, insensitive and unprecedented move by the Supreme Court of Appeal of appointing an all-white bench to hear a case against racism and calls for the judiciary to introspect and make amends."
The MK party will push for the transformation of the sector.
They do not want banks to give its clients different treatment.. They must have the same rules for everyone.

Some political leaders have questioned the timing by FNB to close the bank account of former president Jacob Zuma's with elections a few months away.
Zuma has been leading the uMkhonto weSizwe (MK) party for the last four months after he announced his support for the new party and is number one of the list of candidates for the party.
It was reported on Sunday that the bank was closing his account. This is the same account where the now defunct VBS Mutual Bank deposited a loan of R7.8 million to Zuma.
FNB said it was complying with an order of the High Court in KwaZulu-Natal.
"FNB is complying with a specific order by the High Court (KZN division). However, given client confidentiality, FNB cannot comment further on any client's specific bank accounts and treats all customers objectively and consistently," said FNB.
African People's Convention (APC) leader and former chairperson of the Standing Committee on Public Accounts (Scopa) Themba Godi said it appeared that the banks have enormous power and this could render the democratic project meaningless.
He said there needs to be changes in how banks were regulated.
Godi said it was also unclear if this was an administrative decision or a political decision.
The APC leader said the timing was suspicious given the fact that the country was a few months away from the elections.
"The starting point is the suspicion around the timing. The bank exposes itself to be playing a political game. The powers that the banks have in our country is enormous and it renders our democratic practice meaningless. If they can do this to a former president who else is at their mercy.
"With Markus Jooste we haven't heard his accounts being touched, but he has brought this country into disrepute," said Godi.
There needs to be a regulatory framework where banks will not be able to do these things.
Former Pan Africanist Congress (PAC) leader Letlapa Mphahlele said this raises eyebrows.
"FNB has reportedly issued a notice to terminate former president Jacob Zuma's bank accounts in which his R7.8m VBS loan was deposited. The timing raises eyebrows. Only the most gullible among us think that the banks are impartial referees in the game of politics," said Mphahlele.
The Sunday World reported that the bank said it was closing the account because Zuma is a politically exposed person.
