Washington-Senior Policy Advisor to the President Stephen Miller appears to have violated the Hatch Act during an interview this morning on Fox and Friends, according to a complaint sent today to the Office of Special Counsel by Citizens for Responsibility and Ethics in Washington (CREW). Miller criticized presumptive Democratic nominee Joe Biden while giving an interview from the White House in his official capacity. The Trump campaign then tweeted it out, again identifying him with his official title.
"This administration continues to use its official powers improperly to assist the president's re-election and to chip away at the checks and balances that preserve our democracy," said CREW Executive Director Noah Bookbinder. "It is well past time for those like Stephen Miller, who show an open disdain for ethics laws like the Hatch Act and who illegally use official resources to promote the president's re-election bid, to be held accountable for their actions."
The Hatch Act prohibits executive branch employees from "us[ing their] official authority or influence for the purpose of interfering with or affecting the result of an election." "Political activity" is defined as "an activity directed toward the success or failure of a political party, candidate for partisan political office, or partisan political group."
"Senior officials in this administration repeatedly act as though laws and ethics rules do not apply to them, particularly when it comes to misusing office for the president's political or personal benefit, and it needs to stop," said Bookbinder. "OSC should act swiftly and decisively to investigate Miller and take appropriate action."
Throughout this presidency, CREW's complaints have led to an unprecedented number of Trump administration officials being reprimanded for Hatch Act violations, including Dan Scavino, Nikki Haley, Stephanie Grisham, Raj Shah, Jessica Ditto, Madeleine Westerhout, Helen Aguirre Ferre, Alyssa Farah, Jacob Wood, Kellyanne Conway and Lynne Patton. Following CREW's complaints against Kellyanne Conway, OSC took the unprecedented step of recommending Conway be removed from federal service in a scathing report detailing her numerous ethics violations.

White House begins search for person who leaked president's schedule: report
The White House has reportedly launched an internal probe into who leaked the president's schedule to Axios this week.
Politico reported late Friday that the search, which has been approved by acting chief of staff Mick Mulvaney and President Trump himself, has reached out to the White House IT office and begun narrowing down a list of suspects.
One administration official told Politico that the culprit was probably a career government employee who works in the White House and not somebody the president had handpicked for the administration.
The White House earlier this week blasted the leak, which showed that the president has spent about 60 percent of his time over the past three months in "Executive Time."
"What a disgraceful breach of trust to leak schedules. What these don't show are the hundreds of calls and meetings @realDonaldTrump takes everyday. This POTUS is working harder for the American people than anyone in recent history," White House Director of Oval Office operations Madeleine Westerhout tweeted in response.
Aides told Politico that Trump uses those time blocks to watch TV, call people, read newspapers and do other work.
While critics have slammed the schedules as proof the president is slacking on the job, the White House says executive time is used to keep Trump abreast of legislation and maintain relationships on Capitol Hill, among other things.
"He's not a slacker. The guy works. He may not have it all scheduled but the guy's a grinder," David Urban, a former senior Trump campaign adviser, told Politico. "He's not a guy who sits on his hands."
The White House did not immediately respond to a request for comment from The Hill on Friday night.
Trump personally has fumed over the massive amounts of leaks that have characterized his tenure in the White House.
"The spotlight has finally been put on the low-life leakers! They will be caught!" the president tweeted in early 2017, shortly after taking office.

Trump's secretary blasts leak of president's private schedule
President Trump's executive assistant took the unusual step Sunday night of defending the president publicly against a report that he spends most of his days in unstructured "executive time."
Madeleine Westerhout, the president's personal secretary whose desk is just outside the Oval Office, called it a "disgraceful breach of trust" for a West Wing insider to leak Mr. Trump's private daily schedules for the past three months.
Axios reported Sunday that the schedules show the president spends an average of 60 percent of each day in unstructured "executive time," primarily in the White House residence in the morning before he arrives in the West Wing. The report said Mr. Trump spends much of that time watching TV, tweeting and talking on the phone.
"What these don't show are the hundreds of calls and meetings @realDonaldTrump takes everyday," Ms. Westerhout tweeted. "This POTUS is working harder for the American people than anyone in recent history."
