Ex-coal executive sentenced to 5 years in prison for $20 million fraud scheme
A former Signal Peak mining executive Larry Price was sentenced to 5 years in prison for $20M fraud scheme. Price used his role as a mining expert to defraud 3 coal-mining firms which he used to finance the construction of his 26,000-square-foot home.
A former Signal Peak mining executive and developer of Billings' largest mansion was sentenced Friday to five years in federal prison and three years supervised release for a $20 million fraud scheme.
Larry Wayne Price Jr., 40 of Billings, pleaded guilty in December 2018 to three counts of wire fraud, conspiracy to commit money laundering and making false official statements, according to a news release from U.S. Attorney Kurt Alme. Price was released and allowed to report to prison.
Prosecutors said in court documents that he used his role as a mining expert to defraud three coal-mining firms, including his employer, Signal Peak in Roundup, out of about $20 million, which he used to finance construction of the 26,000-square-foot home on Canyonwood Drive in the Ironwood subdivision.
Restitution will be determined later.
"The defendant's crimes resulted in staggering financial losses and harm to many people, including some who lost their entire life's savings, all so he could live in luxury. Today's sentence is a warning to anyone considering looking for 'easy money' from others: You will be caught and you will go to prison. This case also serves as a reminder to all investors to be sure to do thorough due diligence before investing," Alme said in a statement.
Price was sentenced by U.S. District Judge Dana L. Christensen of Missoula.
In addition to Signal Peak, the other victims in Price's scheme were two Wyoming firms looking at coal-mining investments: Ninety M LLC and Three Blind Mice LLC.
In April 2018, Price learned that representatives of Ninety M were questioning him about fraudulent transactions he made while representing them in their efforts to develop a coal mine in Virginia, prosecutors said.
He hid out in a house in Virginia and his wife reported him missing. When he was found later by Virginia law enforcement on the side of a road, he lied and said he had been kidnapped by a motorcycle gang, authorities said.
Price knew his statements about his alleged kidnapping were false and that he was not abducted by anyone. The false statements cost the government significant investigative resources and hampered the investigation into Price's own wrongdoing, prosecutors stated.
The Billings mansion has never been occupied and is listed for $13.9 million.

After a two-day trial, the jury found Jack Preston Coversup, 57, guilty of sexual abuse of a minor and abusive sexual contact.

93-Year-Old Montana Man Sentenced For Sexually Abusing Children
GREAT FALLS - A Poplar man who admitted sexually abusing a child was sentenced to four years in prison to be followed by five years of supervised release, U. S. Attorney Kurt Alme said.
Lloyd Wallace Youpee, 93, pleaded guilty in January to abusive sexual contact.
The prosecution said in court documents that the sexual contact occurred on or about February 2018 to December 2018 in Poplar on the Fort Peck Indian Reservation. Youpee had sexual contact with the victim, who was under the age of 12. Youpee initially denied touching the victim but then admitted to the sexual assault. During an interview with investigators, Youpee indicated that he did not want kids to be around him while he is drinking. He told investigators that he knows how he is, clarifying that he likes sex.
Assistant U.S. Attorney Cassady Adams prosecuted the case, which was investigated by the FBI and Fort Peck Tribes Department of Law and Justice.

Three Mexico citizens sentenced for smuggling aliens from Canada
GREAT FALLS-Three Mexico citizens who admitted trying to smuggle aliens across the border from Canada into Glacier County in Montana last year were sentenced this week to time served, U.S. Attorney Kurt Alme said.
Samuel Velasco-Tovar, 28, who was a foot guide, and Omero Banderas-Rodriguez, 39, who was a driver, both were sentenced on Wednesday to 158 days of time served. Alberto Guillen-Gordillo, 23, who was intended to be a driver, was sentenced today to 159 days of time served. All three defendants pleaded guilty in February to transportation of illegal aliens.
Chief U.S. District Judge Brian M. Morris presided. Judge Morris referred all defendants to Immigration and Customs Enforcement for deportation proceedings.
Human smuggling across the Canadian border is dangerous both to those who are being smuggled and to Montanans who may cross paths with the smugglers. Those who are smuggled and cannot pay the fee may be forced to work to pay it off. Those who prey on the aspirations of those from other countries wanting a better life for themselves, putting them and Montanans at risk, will be prosecuted to the full extent of the law," U.S. Attorney Alme said.
The prosecution said in court records that on Nov. 17 at about 11:15 p.m., Border Patrol agents conducted traffic stops of two vehicles south of the United States-Canada border in Glacier County. In the first vehicle, which was a Chevrolet Suburban, the agent found the driver, Banderas-Rodriguez, and nine passengers. All of the passengers admitted to being in the United States illegally. During the stop of the second vehicle, a Chevrolet Tahoe, all of the occupants ran into a nearby field. Agents found eight individuals within a few minutes. Each of the individuals admitted to being in the United States illegally.
In all, law enforcement transported 19 suspects to the Sweetgrass Border Patrol Station for processing. Four of the transported illegal aliens told agents they had paid from $4,000 to $4,750 to be smuggled into the United States and identified Velasco-Tovar as the foot guide who helped them cross into the United States.
Banderas-Rodriguez rented hotel rooms in Cut Bank prior to this pickup, was one of the contacts prior to the trip to cross the border and was one of the drivers at the pickup. He told law enforcement he would be paid $2,000 for driving an SUV full of aliens from Montana to Utah.
Shortly after the arrests, a Border Patrol agent and Glacier County Sheriff's deputy went to a Cut Bank hotel where the subjects had been staying to determine if any remaining occupant in one of the hotel rooms was in violation of trafficking laws.
Co-defendant Guillen-Gordillo answered the door, identified himself and was taken into custody. Guillen-Gordillo admitted to being in the United States illegally. He rented the two SUVs from a Utah rental company. A co-defendant identified Guillen-Gordillo as the driver of a third vehicle but that he stayed at the hotel because he was not feeling well.
A fourth co-defendant, Josue Bermudez-Lopez, of Mexico, pleaded guilty to illegally transporting aliens and was sentenced to four months in prison.
Assistant U.S. Attorneys Paulette Stewart, Jeff Starnes and Ethan Plaut are prosecuting the case, which was investigated by the U.S. Border Patrol and the Glacier County Sheriff's Office.

A few months ago, on law day, President Trump explained that in the United States, "we govern ourselves in accordance with the rule of law rather than according to the whims of an elite few or the dictates of collective will. Through law, we have ensured liberty. We should not ... take that success for granted."
The President's words are of central importance to the Department of Justice, because the rule of law in America depends on the character of the people who enforce the law.
All executive branch employees take the same oath. The first clause requires us to "support and defend the constitution of the United States against all enemies, foreign and domestic."
Everyone is familiar with that duty.
But some overlook the final clause: a promise to "well and faithfully discharge the duties of the office on which I am about to enter."
The first obligation is general. It imposes a duty to pursue the national interest over any personal interest. That applies equally to every government employee.
But the final clause is specific. Everyone recites the same words, but the meaning varies. In order to well and faithfully discharge the duties of "the office," you need to understand your unique responsibilities. What is the mandate of your agency; what is the mission of your component; and how do you add value?
You need to know what you stand for.
In 1940, Attorney General Robert Jackson spoke eloquently about what our Department stands for. He said that "the citizen's safety lies in the prosecutor who tempers zeal with human kindness, who seeks truth and not victims, who serves the law and not factional purposes, and who approaches [the] task with humility."
If you follow that advice, you will remain faithful to our mission.
The mission attracted me to work in this Department, but what I treasure most are the people who faithfully carry out the mission.
I am grateful for your service, and I am honored to work with you in the cause of justice.

I thought the Yellowstone Boys and Girls Ranch link was going to be just a normal laundering situation. But this is just too coincidental.
The U.S. Senate on Thursday confirmed Kurt Alme of Billings as the new U.S. Attorney for the District of Montana, more than two months the White House nominated him to fill the post.
Alme - a former First Assistant U.S. Attorney - currently runs the Yellowstone Boys and Girls Ranch Foundation.
In late June the White House announced the nomination of Alme after Sen. Steve Daines - Montana's senior Republican congressman - recommended him. Sen. Jon Tester, a Democrat, joined Daines in supporting Alme for the role.
