United States Attorney John F. Bash Announces Resignation
This Friday-eight years to the day after I first joined the Department of Justice-I will step down as United States Attorney for the Western District of Texas. Last month I accepted an offer for a position in the private sector and informed the Attorney General of my decision. I tendered formal letters of resignation to both the President and the Attorney General this morning.
I am grateful to the President, Senator John Cornyn, Senator Ted Cruz, and the other members of the United States Senate for the opportunity to serve the people of Texas. I am also grateful to former Counsel to the President Donald F. McGahn II, who gave me steadfast support throughout the nomination and confirmation process, and to former Solicitor General Donald B. Verrilli, Jr., for first bringing me into the Department in 2012. And I am honored that during my tenure as U.S. Attorney, the Attorney General has seen fit to entrust me with significant responsibilities and to appoint me to his Advisory Committee.
I am also deeply indebted to the over 300 attorneys and staff members who work in our office, including the 73 Assistant United States Attorneys hired during my tenure. Through their tireless efforts, we have held accountable child abusers, drug-cartel leaders, gang members, bank robbers, embezzlers, fraudsters, scammers, and corrupt public officials. The exceptional public servants of our office have continued to perform at a high level during the national health crisis.
I owe special gratitude to my executive team-First Assistant U.S. Attorney Ashley Hoff, Executive Assistant U.S. Attorney Kristy Callahan, Counselor Mickey Tapken, Criminal Division Chief Christina Playton, Civil Division Chief Mary Kruger, Administrative Division Chief Gretchen Randall, and Legal Support Division Chief Lora Makowski. They are all women of extraordinary integrity, intelligence, and candor. I am proud to have served alongside them.
Most importantly, I would not have succeeded in this demanding role without the love and support of my wife, Zina, my daughter and son, my parents, my wife's parents and siblings, and of course the Lord.
The Attorney General has elected to appoint Gregg Sofer to succeed me as U.S. Attorney. Gregg is an inspired choice. He is a veteran Department of Justice attorney, serving first in the National Security Division at Main Justice and then for over a decade as a national-security specialist in our Austin office. In the latter role, he built a reputation as a dogged and tremendously effective prosecutor. In 2018, I selected Gregg to serve as our office's Criminal Division Chief, where he designed and implemented significant improvements to our operations, oversaw thousands of prosecutions, and provided me with invaluable advice on a range of important issues and cases. Since early this year, he has served in Washington, D.C., as Counselor to the Attorney General. He will make an excellent U.S. Attorney.
Like any job, serving as U.S. Attorney has had its high points and its low points. No day was worse than August 3, 2019, when we lost so many of our fellow Americans and our Mexican brothers and sisters to an almost inconceivable act of hatred. But there was nothing more soul-stirring than the way El Pasoans came together in the wake of that nightmare in a spirit of love and perseverance.
I hope that I have discharged my authority wisely and have improved the safety and security of my fellow Texans. I leave the Department with a profound respect for its people, its traditions, and its importance to our constitutional democracy.

Texas U.S. Attorneys Announce $18 Million in Domestic Violence Funding from DOJ's Office on Violence Against Women

The Justice Department's Office of Violence Against Women (OVW) will direct more than $18 million in grant funding to Texas to support efforts to curb domestic violence throughout the state, announced U.S. Attorneys John F. Bash, Erin Nealy Cox, Ryan K. Patrick, and Stephen J. Cox.

"Today's announcement is a huge win for Texas in the fight against domestic violence. I am proud to be a part of a department that prioritizes this issue," stated U.S. Attorney Bash.

Among the $18 million in awards that will be issued to organizations and government agencies in Texas are:

- More than $11.8 million in formula funds to the state to support law enforcement, prosecutors, victim services providers, and courts in working collaboratively to respond to domestic and sexual violence.

- $1.76 million to cities and counties across Texas to improve the criminal justice response to domestic and sexual violence: $1,000,000 to the City of Austin, $400,000 to Webb County, and $355,573 to Bastrop County.

- $2.85 million to domestic violence organizations to provide legal service to victims: $600,000 to SafeHaven of Tarrant County, $600,000 to the Women's Center of Tarrant County, $600,000 to the Houston Area Women's Center, $650,0000 to the SAFE Alliance in Austin, and $404,486 to the Bastrop County Women's Shelter.

- $1.54 million to advocacy groups to help underserved populations, including disabled victims and minority victims of domestic violence: $588,297 to Saheli, Inc., $500,000 to Brownsville Friendship of Women, Inc., $450,000 to the SAFE Alliance in Austin.

- More than half a million to domestic violence shelters to provide transitional housing and therapy services: $515,000 to SafeHaven of Tarrant County.

- $152,345 to the Texas Association Against Sexual Assault plus $91,274 to the Texas Council on Family Violence, two statewide organizations working to address violence against women.

New projects to provide critical training and technical assistance throughout the country include:

- The $5 million new National Violence Against Women Law Enforcement Training and Technical Assistance Consortium, a project with the Institute for Intergovernmental Research, in Florida, that will deliver training on investigating and responding to domestic violence, sexual assault, and stalking.

- $675,000 to continue the work of the San Diego-based Alliance for HOPE's Training Institute for Strangulation Prevention, which provides education on investigating and prosecuting nonfatal strangulation in domestic violence cases.

- $400,000 to the International Association of Forensic Nurses, headquartered in Maryland, to develop a national protocol to guide medical-forensic care for domestic violence victims who seek treatment for their injuries.

In July 2015, University Loft Company filed a False Claims Act qui tam action in the U.S. District Court for the Western District of Texas, Austin Division, alleging that Blue Furniture and others were importing wooden bedroom furniture into the U.S. without paying the required anti-dumping duties and other customs fees. After investigating University Loft's allegations, the United States elected to intervene in the action.

The FBI's Weapons of Mass Destruction Squad and the Joint Terrorism Task Force are investigating this case. Assistant U.S. Attorney Mark Roomberg is prosecuting the case on behalf of the government.

Justice Department Files Its First Enforcement Action Against COVID-19 Fraud

Federal Court Issues Temporary Restraining Order Against Website Offering Fraudulent Coronavirus Vaccine

The Department of Justice announced today that it has taken its first action in federal court to combat fraud related to the coronavirus (COVID-19) pandemic. The enforcement action filed today in Austin against operators of a fraudulent website follows Attorney General William Barr's recent direction for the department to prioritize the detection, investigation, and prosecution of illegal conduct related to the pandemic.

As detailed in the civil complaint and accompanying court papers filed on Saturday, March 21, 2020, the operators of the website "coronavirusmedicalkit.com" are engaging in a wire fraud scheme seeking to profit from the confusion and widespread fear surrounding COVID-19. Information published on the website claimed to offer consumers access to World Health Organization (WHO) vaccine kits in exchange for a shipping charge of $4.95, which consumers would pay by entering their credit card information on the website. In fact, there are currently no legitimate COVID-19 vaccines and the WHO is not distributing any such vaccine. In response to the department's request, U.S. District Judge Robert Pitman issued a temporary restraining order requiring that the registrar of the fraudulent website immediately take action to block public access to it.

"The Department of Justice will not tolerate criminal exploitation of this national emergency for personal gain," said Assistant Attorney General Jody Hunt of the Department of Justice's Civil Division. "We will use every resource at the government's disposal to act quickly to shut down these most despicable of scammers, whether they are defrauding consumers, committing identity theft, or delivering malware."

"Attorney General Barr has directed the department to prioritize fraud schemes arising out of the coronavirus emergency," said U.S. Attorney John F. Bash of the Western District of Texas. "We therefore moved very quickly to shut down this scam. We hope in the future that responsible web domain registrars will quickly and effectively shut down websites designed to facilitate these scams. My office will continue to be aggressive in targeting these sorts of despicable frauds for the duration of this emergency."

"At a time when we face such unprecedented challenges with the COVID-19 crisis, Americans are understandably desperate to find solutions to keep their families safe and healthy," said Special Agent in Charge Christopher Combs of the FBI's San Antonio Field Office. "Fraudsters who seek to profit from their fear and uncertainty, by selling bogus vaccines or cures, not only steal limited resources from our communities, they pose an even greater danger by spreading misinformation and creating confusion. During this difficult time, protecting our communities from these reprehensible fraud schemes will remain one of the FBI's highest priorities."

The United States filed today's announced action to shutter the website immediately while an investigation of the website and its operators continues. In so doing, the government is employing a federal statute that permits federal courts to issue injunctions to prevent harm to potential victims of fraudulent schemes.

The Department of Justice recommends that Americans to take the following precautionary measures to protect themselves from known and emerging scams related to COVID-19:

Independently verify the identity of any company, charity, or individual that contacts you regarding COVID-19.
Check the websites and email addresses offering information, products, or services related to COVID-19. Be aware that scammers often employ addresses that differ only slightly from those belonging to the entities they are impersonating. For example, they might use "cdc.com" or "cdc.org" instead of "cdc.gov."
Be wary of unsolicited emails offering information, supplies, or treatment for COVID-19 or requesting your personal information for medical purposes. Legitimate health authorities will not contact the general public this way.
Do not click on links or open email attachments from unknown or unverified sources. Doing so could download a virus onto your computer or device.
Make sure the anti-malware and anti-virus software on your computer is operating and up to date.
Ignore offers for a COVID-19 vaccine, cure, or treatment. Remember, if a vaccine becomes available, you won't hear about it for the first time through an email, online ad, or unsolicited sales pitch.
Check online reviews of any company offering COVID-19 products or supplies. Avoid companies whose customers have complained about not receiving items.

During sentencing yesterday, Senior U.S. District Judge David Briones also ordered 41-year-old Ana Marie Hernandez to pay a $100,000 money judgment.

On June 21, 2010, the legal permanent resident in the U.S. pleaded guilty to one count of conspiracy to import a controlled substance and one count of aiding and abetting the bribery of a public official. By pleading guilty, Hernandez admitted that between June 2005 and October 2005, she conspired with others, including her husband, former DHS Customs and Border Protection officer Daniel Ledezma, to allow hundreds of kilograms of cocaine into the U.S. without inspection through the Paso de Norte Port of Entry. For their actions, Hernandez and Ledezma received more than $100,000 in U.S. Currency.

An arrest warrant was issued for Hernandez when she failed to appear for sentencing on January 24, 2011.

On October 3, 2018, Hernandez was extradited from Mexico to El Paso. She has since remained in federal custody.

"This sentencing is a result of the ongoing partnership and collaboration between the FBI, DEA and our international partners to bring to justice an individual who corrupted U.S. law enforcement officials in order to import drugs into the U.S. The FBI and its partners will relentlessly pursue and prosecute individuals that poison the communities of El Paso," stated FBI Special Agent in Charge Buie.

Sentencing in November
MIDLAND, PRESIDIO COUNTY - Former Presidio County Precinct 3 Commissioner Lorenzo Padilla Hernandez in Midland federal court on Friday admitted to defrauding the citizens of Presidio County by taking bribes while in office in return for his support and vote on a county contract, said United States Attorney John F. Bash and FBI Special Agent in Charge Emmerson Buie Jr. of the El Paso Division.

Appearing before United States District Judge David Counts, Hernandez pleaded guilty to one count of conspiracy to commit mail fraud, wire fraud and deprivation of honest services. By pleading guilty, Hernandez admitted that from August 2015 to June 2017, he conspired to collect approximately $19,800 in bribes from a federal agent acting in an undercover capacity. In exchange for the money, Hernandez agreed to support and vote on May, 9, 2017, for a Presidio County document management services contract to be awarded to a specific company.

Hernandez faces up to 20 years in federal prison. He remains on bond pending sentencing scheduled for November 19, 2018, in Pecos federal court.

Hernandez's co-defendant, 66-year-old Carlos Eduardo Nieto, former Special Projects Coordinator for the City of Presidio and former Presidio Independent School District trustee, is charged by indictment with one count of conspiracy to commit mail and wire fraud and one count of mail fraud and the deprivation of honest services.

Jury selection and trial is scheduled for October 16, 2018, in Pecos before Judge Counts.

The indictment in this case alleges that Nieto also solicited and received $8,300 in bribes for using his position and influence to secure that same contract for that specific company.

Upon conviction, Nieto faces up to 20 years in federal prison. An indictment is merely a charge and should not be considered as evidence of guilt. Nieto is presumed innocent until proven guilty in a court of law.

Texas Seeks Death for El Paso Shooter, Feds Treating as 'Domestic Terrorism'

El Paso prosecutors say they will seek the death penalty against the man who allegedly killed 20 people and wounded 26 others in the mass-casualty shooting on Saturday. The U.S. Attorney's Office says they will treat the shooting "as domestic terrorism."
Police have not formally released the name of the alleged killer but many news outlets have released a name of a suspect in the shooting. El Paso County District Clerk court records obtained by Breitbart Texas on Sunday morning indicate that prosecutors filed a capital murder charge.

"We will seek the death penalty," El Paso County District Attorney Jaime Esparza told reporters in a press conference on Sunday morning. "We will hold him accountable."

The U.S. Attorney's Office for the Western District of Texas John F. Bash said, "We are treating this as domestic terrorism." The federal prosecutor said the suspect could also face federal hate crimes and firearms charges. "We will deliver swift justice," he added.
Breitbart Texas provided live-wire coverage of the events surrounding the active shooter situation in El Paso beginning Saturday morning. The shooter allegedly opened fire on customers at a Walmart filled with back-to-school shoppers. Within a few minutes, the shooter allegedly killed 20 people and sent 26 others to area hospitals - including at least two children. The Cielo Vista shopping area is well known to be a place where Mexican nationals also shop after legally crossing the border from Mexico. At least three of the dead were Mexican nationals, Mexican President Andrés Manuel López Obrador said in a Twitter video.

Governor Abbott promised the people of El Paso, We are going to aggressively prosecute it both as capital murder but also as a hate crime, which is exactly what it appears to be." The governor said the thoughts, actions, and crimes allegedly committed by the shooter "are not who and what Texas is and we will not tolerate it."
Authorities say they arrested the alleged shooter a short distance away from the Walmart and placed him into custody without incident. El Paso Police Chief Greg Allen said that none of his officers responded to the active-shooter incident within six minutes and did not fire any rounds in response to the shooting. He referenced a manifesto allegedly written by the accused shooter, calling it a "potential nexus to a hate crime."
On Sunday morning, Chief Allen told reporters that investigators were "reasonably confident" the accused shooter is the author of the manifesto, NBC News reported.
