Former investment NSW boss Amy Brown sacked in wake of John Barilaro job saga

The NSW bureaucrat at the centre of the controversial appointment of John Barilaro to a US trade role has been sacked.
Key points:

A review found Amy Brown failed to adhere to the Code of Ethics when appointing former deputy premier John Barilaro to a trade job earlier this year
The secretary for the Department of Premier and Cabinet say Ms Brown can no longer hold office
In a LinkedIn post, Ms Brown said leadership could at times be "difficult"

Amy Brown was the CEO of Investment NSW - the government body responsible for hiring senior trade and investment commissioners - when former deputy premier John Barilaro was selected for the Americas job.

Between June and August Ms Brown was grilled three times by a parliamentary inquiry into the Barilaro appointment, and an independent report by Graeme Head AO found she failed to act in accordance with the Code of Ethics and Conduct for government sector employees.

This morning the secretary of the Department of Premier and Cabinet, Michael Coutts-Trotter, issued a statement saying Ms Brown would no longer be employed by the government.

Although she lost her position of chief executive of Investment NSW last month, she had kept the higher position of secretary of the Department of Enterprise, Investment and Trade.

However, Mr Coutts-Trotter said the conclusions made by the Head review meant Ms Brown could no longer continue to hold office.

"It's a privilege to hold a role as a senior leader in the NSW public service. With this, rightly, comes a high degree of accountability," Mr Coutts-Trotter said.

"I acknowledge that dealing with the events of recent months, and doing so under such intense public scrutiny, has weighed heavily on Ms Brown.

"I want to thank her for her service."
'Leadership can be difficult'

The Head report found Ms Brown had kept information from other members of the job panel, including the fact she discussed Mr Barilaro's suitability with the then minister for trade Stuart Ayres.

The recruitment process was supposed to be independent of the minister.

Mr Head recommended the Department of Premier and Cabinet consider whether it needs to take action against Ms Brown.

In a LinkedIn post uploaded before Mr Coutts-Trotter's statement was released, Ms Brown said during her time in the public sector she had learned "leadership can, at times, be difficult".

"Courageous leadership is not always comfortable. But it is a necessary part of how the public service performs its professional role in support of responsible government," she wrote.

Ms Brown said she was now exploring new opportunities in the private sector.

"[I] hope to make an announcement about that soon," she said.

On LinkedIn, Ms Brown said she joined the government in 2013 as she wanted to improve the lives of people in NSW.

"My goal was to create an enhanced focus on delivery, and partnering with the private sector in a way that drives innovation and creates value for taxpayers," she wrote.

Former deputy premier John Barilaro charged with assault, malicious damage

Former NSW deputy premier John Barilaro has been charged with assault over an alleged altercation with a TV camera operator in Sydney last month.

Mr Barilaro, who retired from politics in December last year, allegedly assaulted freelancer Matt Costello and damaged his camera outside a bar in Manly on July 23.

NSW Police on Friday confirmed officers had served Mr Barilaro's lawyers with a future court attendance notice for alleged assault and malicious damage offences.

The 50-year-old former MP is due to appear before Manly Local Court on October 12.

Mr Barilaro declined to comment when contacted by ABC.

Vision of the incident was circulated through the media after being posted on social media.

Mr Barilaro was at the time subject to intense scrutiny over his appointment to a public service trade role based in New York.

Embattled deputy Liberal leader Stuart Ayres has insisted he did not help John Barilaro land a $500,000 trade job in New York in a lengthy Facebook post.

Mr Ayres dismissed allegations he had a hand in appointing Mr Barilaro as the Senior Trade and Investment Commissioner to the Americas.

The minister claimed the only person who had the power to make the trade appointment was the CEO of Investment NSW.

Mr Ayres added in a press conference on Monday he had only texted a copy of the job advertisement to Mr Barilaro after it had already been placed on the Australian Financial Review.

Labor accused Mr Ayres of lying after he said he did not meet with Mr Barilaro during the recruitment process and had maintained his distance.

Documents released to the NSW parliament have contradicted previous claims made by the Premier and Trade Minister about the US trade commissioner recruitment process.

The documents reveal briefing notes were sent to then-treasurer Dominic Perrottet, Trade Minister Stuart Ayres and former deputy premier John Barilaro and stated a successful candidate had been picked for the plum New York-based trade commissioner role last year.

The notes contradict previous claims by Mr Perrottet and Mr Ayres that they were told there wasn't a suitable candidate identified in the first recruitment round.

Almost identical briefing notes were sent to all three ministers to notify them of the "outcome of the recruitment search for a STIC (Senior Trade and Investment Commissioner) Americas" in August 2021.

"Note the selection of Ms Jenny West as the successful candidate for the STIC - Americas," the briefing note said.

Jenny West, a former senior bureaucrat within Investment NSW, was verbally offered the job in August last year but the offer was rescinded the following month after the government changed the recruitment process.

Mr Barilaro successfully took a submission to cabinet to change the trade commissioner roles into ministerial appointments.

He successfully applied for the New York job after leaving politics in a second recruitment round.

However, last month he announced he would withdraw from the job, which comes with a $500,000 annual salary package, following intense scrutiny over the recruitment process.

The documents released to the parliament show neither Mr Barilaro nor Mr Perrottet signed the briefing note but Mr Ayres did.

An email chain between a staffer from Investment NSW, which was overseeing the recruitment process, and a staffer from the Treasurer's office has also been released.

In the emails, it is acknowledged that Mr Perrottet's office received the briefing note on August 13, 2021.

Christian Porter, on Thursday (14/7/22), lost his appeal in a unanimous decision against Jo Dyer in relation to having his barrister Sue Chrysanthou SC restrained from representing him at his 2021 defamation case against the ABC and journalist Louise Milligan.

For a barrister to have to be restrained by the court from representing a client because the barrister thinks they are above the law and they are caught lying to the court under oath doesn't get any more corrupt than that.

Sue Chrysanthou SC has not only represented alleged rapist Christian Porter but also alleged paedophile Alan Jones and fraudster and thief John Barilaro who now has multiple crimes under investigation by the NSW ICAC.

The old media regularly refer to Sue Chrysanthou SC as a star barrister and/or part of a star legal team when in fact she is a dud who has done major damage to her own reputation as well as the reputation of her clients and the legal fraternity as a whole.

Below we'll have a look at the three clients I just mentioned that Sue Chrysanthou SC has left worse for wear which says a lot given all three had extremely poor reputations before they met Sue Chrysanthou.

Christian Porter's defamation case against the ABC and Louise Milligan

Sue Chrysanthou SC had every opportunity to stop representing Christian Porter but she refused which left Jo Dyer with no option but to institute proceedings against Christian Porter and in the end she had to be restrained by the Federal Court of Australia from representing him.

The reason Sue Chrysanthou SC refused to stop representing Porter is that she thought she was above the law and never believed that Jo Dyer would follow through with an application to have her restrained by the court from representing Porter.

The defamation case related to reports that Christian Porter raped the now deceased Katharine Thornton in 1988 who was a friend of Jo Dyer.

The defamation case settled in 2021 and the only purpose for Christian Porter appealing against having his barrister Sue Chrysanthou SC restrained from representing him was so Porter could avoid the $430,000 of costs awarded to Jo Dyer.

Ms Dyer wanted the restraining order because she was going to be a witness for the ABC in Porter's defamation case against them and Ms Dyer had previously been represented by Sue Chrysanthou SC over the same issues regarding an article written in the Australian Newspaper that was possibly defamatory of Ms Dyer.

That meant Sue Chrysanthou SC had confidential information about Jo Dyer and it was a huge conflict for her to represent Porter. But Christian Porter and Sue Chrysanthou SC are both so corrupt they didn't care and they underestimated Jo Dyer.

When Jo Dyer took legal action both Christian Porter and Sue Chrysanthou SC were respondents and from memory, Sue Chrysanthou SC said she would not appeal after they lost the original decision. But based on the information reported from the decision on Thursday Sue Chrysanthou SC did appeal and also lost along with Porter. (The whole judgment hasn't been published yet)

New South Wales Labor has called for a senior public servant to step down after bombshell revelations at an inquiry into the recruitment of the NSW trade commissioner in the United States.

he inquiry is investigating why the deputy secretary of Investment NSW, Jenny West, was initially offered the trade job before it was handed to former New South Wales deputy premier, John Barilaro.

Yesterday, Ms West told the inquiry she was told by the chief executive, Amy Brown, that the job was now going to be a "present for someone" else.

Mr Barilaro's appointment to the position - which comes with a $500,000 annual salary package - was confirmed last month.

The state's Shadow Treasurer, Daniel Mookhey, said the public was entitled to think there is "something rotten" in the New South Wales government.

"We think it would be appropriate for Ms Brown to be stood down, pending the outcome of all investigations into this matter," Mr Mookhey said.

Penny Sharpe, leader of the opposition in the legislative council, said that what happened to Ms West was a "word of warning to the way the government operates".

"How are exceptionally qualified women able to get positions in this government where it seems to me that there's been collusion from others in the government to make sure that she never got that job," Ms Sharpe said.

A transcript from the parliamentary hearing will now be referred to the state's corruption watchdog, according to the head of the committee, Cate Faehrmann.

A damning auditor-general's report into a NSW grants scheme at the centre of pork barrelling allegations has described it as "deficient" and "lacking integrity".

Auditor-general Margaret Crawford has found 96 per cent of grants available from the $250 million Stronger Communities Fund were allocated to projects based in Coalition-held seats.

The former premier Gladys Berejiklian had previously conceded that grants from the scheme were used to try to shore up Coalition-held seats in the lead up to the last election, but said the practice was "not unique" to her government.

In her report to parliament, Ms Crawford said the scheme's guidelines "lacked the necessary information to safeguard against biased or subjective assessment".

The report paints a picture of chaotic decision making, where funding for projects was determined by Ms Berekijlian, her deputy John Barilaro and the minister for local government.

Decisions were then communicated by their staff through emails to the Office of Local Government, which was tasked with administering the scheme.

Ms Crawford wrote that these emails contained "little or no information about the basis for the council or project selection" and that funds were allocated "without questioning or recording the basis for selection".

While the local government minister was responsible for distributing the funds, he only approved two of the 24 projects that received money - with the rest identified by the offices of Ms Berejiklian and Mr Barilaro.

Ms Crawford concluded that the exclusion of information and the lack of formality in those approvals "prevent accountability and transparency over the government's approach to selecting councils for funding".

In October 2020 a parliamentary inquiry heard that Ms Berejiklian's office had physically shredded and then digitally deleted documents relating to the Stronger Communities Fund.

Her staff gave evidence they had sent emails saying Ms Berejiklian had "approved" or "signed off" on projects.

But one staffer told the inquiry that was just a "turn of phrase" and that the then premier was not technically approving the payments as that "was not a role she had under the program".

A month later Ms Berejiklian told reporters she was only "consulted" and "provided advice" on the grants, but she conceded the way the scheme was used amounted to pork barrelling.

"It's not something the community likes … but it's an accusation I will wear," she said.

"It's not an illegal practice. Unfortunately it does happen from time to time by every government."

And secondly, all the witnesses have so far said that Gladys Berejiklian should have declared her relationship with Daryl Maguire and that they would have acted differently in awarding the $5.5 million grant if they had known. But if it can be proven they knew about other conflicts of interests involving others such as John Barilaro having relationships with staffers, and they took no action then their credibility as a witness against Gladys Berejiklian is greatly damaged.

As it stands Gladys Berejiklian has no friends in the Liberal Party and National Party as politicians and staffers from both parties have lined up at ICAC, last week and this week, to throw her under a bus so she has nothing to lose by going the nuclear option and naming other MP's who have had affairs and failed to declare the affairs when there has been a conflict of interest.

A senior NSW bureaucrat was told former MP Daryl Maguire "had the ear" of then-premier Gladys Berejiklian as he advocated for a multi-million-dollar grant for his electorate, the corruption watchdog has heard.

The inquiry has heard that Ms Berejiklian's office took a particular interest in a $5.5m grant to a Wagga Wagga shooting club
A senior bureaucrat says there were frequent requests for updates from the premier's office
The bureaucrat took to emailing Ms Berejiklian's chief of staff with progress reports

The Independent Commission Against Corruption (ICAC) is considering whether Ms Berejiklian breached public trust in connection to grants awarded in Wagga Wagga, due to a potential conflict of interest created by her secret relationship with the local MP, Mr Maguire.

Secretary of the Department of Regional NSW, Gary Barnes, today recalled there being a "particular interest" from Ms Berejiklian's office in a $5.5 million grant to the Australian Clay Target Association.

In late 2016, that proposal received conditional approval from a cabinet committee chaired by then-treasurer Ms Berejiklian, who went on to become premier in January 2017.

"I seem to remember someone in the deputy premier's office had told me Daryl was well-regarded by the premier as a person that understood the bush, as a Liberal party person and that he had the ear of the premier," Mr Barnes said.

Mr Maguire was a "strong advocate" for projects in his electorate, he said.

Mr Barnes agreed the frequency with which staff from the offices of then-deputy premier John Barilaro and Ms Berejiklian asked for updates on the Australian Clay Target Association proposal was "atypical".

He told the commission he gave the project priority partly because of the "political imprimatur" which came with the expenditure review committee's conditional backing.

Mr Barnes emailed Ms Berejiklian's then-chief of staff, Sarah Cruickshank, with updates about the project.

He said he felt this was "warranted" due to the particular interest being shown.

The ICAC had previously heard the conditions for approval of the grant included a satisfactory business case, as the original document was considered "deficient".

The shooting club had received government funding for its initial business case, but Mr Barnes said proponents were usually expected to fund their own grant applications and this was "unusual".

The Office of Regional Development provided $26,950 for the business case to be revisited.

Upon revision, the project was found to have met a government benefit-to-cost benchmark to qualify for funding.

Ms Berejiklian denied wrongdoing when she resigned at the beginning of this month and said history would show she always acted with integrity.

Former NSW Labor leader Jodi McKay has announced she is quitting politics nearly five months after resigning as opposition leader.
"The lockdown has given me time to reflect and consider my future," the member for Strathfield said in a statement.
"Over the last 15 years, I have witnessed the best and worst in NSW politics.

"I have always been true to myself and my principles and have stood up for what is right, regardless of the consequences.
"I value integrity in public life - it's something I have demonstrated in my role each and every day. I hope that is a legacy I leave our party and NSW politics," Ms McKay said.
Ms McKay stepped down as Labor leader back in May after Labor suffered a crushing defeat at the crucial Upper Hunter by-election.
Her resignation from parliament will spark a fifth by-election in NSW.

Last week Liberal MP Melanie Gibbons announced she was resigning from state politics to contest Craig Kelly for the federal seat of Hughes.
Then there will be one in Willoughby after former premier Gladys Berejiklian stepped down amid an ICAC investigation, and another in Monaro after deputy premier John Barilaro quit politics.
Transport Minister Andrew Constance also announced he would resign as Member for Bega and contest Liberal pre-election for his local federal seat of Gilmore.

A total of six officials have resigned in the span of three days following tyrannical New South Wales Premier Gladys Berejiklian's difficult resignation on Friday. Berjiklian announced her 'difficult decision' to resign after a corruption watchdog announced it was looking into her 'alleged misconduct.' It was the corruption charges that finally brought the tyrannical leader to step down.

Following NSW Premier Berejiklian's exit, her Deputy Premier John Barilaro also announced his resignation and will leave parliament. Barilaro said the constant pressure from media scrutiny and his defamation case against YouTuber Jordan Shanks is a 'big reason' for his departure from politics.

YouTube star Jordan Shanks responded to Barilaro's departure and attacks. Barilaro accused the YouTube star of "vile racism" after Shanks called him 'a conman to the core, powered by spaghetti.' "FriendlyJordies" accused Barilaro of using his press conference to smear him as racist.



New South Wales is in a state of political disarray and chaos, facing multiple costly and distracting by-elections and an uncertain path towards post-Covid freedom.

In the space of three days, NSW has lost its Premier and Deputy Premier, a senior Cabinet Minister, three veteran Coalition members of parliament and will likely need to find a new Treasurer in coming weeks.

The shock resignation on Friday of Premier Gladys Berejiklian, both from the state's top job and parliament representing the seat of Willoughby, has sparked a domino effect of departures.

Following her today is Deputy Premier John Barilaro, who announced he's stepping aside from the role as well as quitting as Nationals leader and exiting politics, leaving vacant his regional seat of Monaro.

John Barilaro resigns as NSW Deputy Premier

NSW Deputy Premier John Barilaro has announced he will step down as Nationals leader and resign from parliament.

"I have decided now is the right time for me to hand the reins over to new leadership, and resign as Deputy Premier of NSW," he said in a media statement.

His announcement means there will be a by-election in the seat of Monaro.

It comes one day after Transport Minister Andrew Constance resigned, triggering a by-election for his seat of Bega.

On Friday Gladys Berejiklian resigned as Premier and from parliament, which will trigger another by-election in her seat of Willoughby.

Mr Barilaro says he will call a party room meeting for this Wednesday where he will formally resign as the NSW Nationals Leader and call for a ballot to find a replacement.

Government leaders in the state of New South Wales - where the bureaucracy just a month ago announced that it was giving vaccinated citizens a "reward" of one extra hour outside their homes for recreation time - announced during a Monday press briefing that unvaccinated folks "will lose their freedoms" in October, Sky News reported.
What did they say?

NSW Premier Gladys Berejiklian and Deputy Premier John Barilaro announced updated COVID protocols Monday morning in remarks to the press to give more details for their so-called "blueprint for freedom."

Berejiklian's announcement revealed "extra freedoms" residents can experience once the state hits an 80% vaccination rate - above and beyond the current 70% goalpost, News.com.au reported.

The state has been touting its 70% threshold goal and said Monday that it expected to hit that goal by Oct. 11. The updated "freedoms" for the 80% threshold will include freely traveling anywhere in NSW; allowing people to stand up and drink in pubs (aka "vertical drinking"); up to 10 visitors at a private residence; groups of up to 20 people allowed to gather outside; no limits on fully vaccinated attendance at weddings and funerals; and a number of other "extra freedoms" the government will deign to give the hoi polloi.

But anyone who is not vaccinated can expect to "lose their freedoms," the government announced.

The 70% roadmap that will kick in on Oct. 11 will apply to the whole state, Deputy Premier Barilaro said. Which means that restrictions for non-vaxxed will also kick in.

"The message to the unvaccinated is that you will not achieve any further freedom unless you get vaccinated," he stated.

And then he made it clear that not only would unvaccinated people not "achieve any further freedom," but also they will "lose" freedoms they currently enjoy.

"So there will be individuals in regional and rural New South Wales who choose not to be vaccinated who will lose their freedoms on the 11th of October," Barilaro declared. "So my message to everybody in regional and rural New South Wales is to continue to get vaccinated. We are seeing vaccination rates climb right across the state including in the regions."

John Barilaro said he found Ms Turley's comments "disgusting" and was disappointed a leader at any level of politics would draw that comparison.

"I actually heard some of those comments, which I find disgusting," he said.

"That's strong language to be using at a time of crisis when people have fear and anxiety in what is a global pandemic.

"To be using the word genocide, I think no political leader, or any community leader, should ever use such words because it actually causes trauma for people that associate with that word."

The comments were made in front of a state parliamentary committee that was hearing from community leaders and local elders in western and far-western NSW about the COVID response in towns like Broken Hill and Wilcannia.

'Tantamount to genocide'

Ms Turley was repeating what she said public health experts had told her, that there was a failure to act adequately in advance to a COVID outbreak.

"What we're seeing at the moment could've been predicted, or should've been predicted, in terms of how this rapid spread is affecting our vulnerable communities," she said.

"People have spoken to me and believe - public health experts in the past - that the failure to act adequately in advance is tantamount to a genocide."

The Deputy Premier revealed vaccine passports for venues will only be mandatory when the state's Covid-19 vaccination rate is between 70 and 80 per cent.

Once the 80 per cent double dose rate is hit, businesses can decide to let unvaccinated patrons enter if they wish.

However, Gladys Berejiklian cautioned that the NSW Government was yet to finalise the way out of lockdown.

'However, don't assume that at 80% double-dose vaccination, the unvaccinated are are going to have all the same freedoms,' she said.

'I want to make that point very clear.'

NSW - where 46 per cent are fully vaccinated - is predicted to hit the 70 per cent rate in mid October and the 80 per cent rate in early or mid November.

'There will be businesses that don't like the idea [of mandatory vaccines] but the 70 per cent road map gives us an opportunity to open up the economy and lift restrictions,' Mr Barilaro told 2GB radio on Monday.

'If they don't want to do it that's fine, you might have to wait another three to four weeks after that when we get to 80 per cent and above.

'I apologise for that but it will only be a three to four weeks of short inconvenience.

'According to the national road map and to the Doherty Institute report, we'll go and then lift further restrictions including for the unvaccinated.'

The deputy premier made similar comments in a second interview on Canberra radio station 2CC.

Barilaro stated on Tuesday that citizens who want to partake in the newly allowed allocation of five adults meeting to have an outdoor picnic from the 13 September onwards, will need to prove that they've been vaccinated, meaning NSW police officers will be approaching to check.

So, looking into the future, when certain restrictions are placed on unvaccinated members of the community, it will mean that all of us will be subjected to extra police scrutiny - at random and without reasonable suspicion - which will entail being stopped to prove your vaccination status.

And bear in mind, as Dr Sentas pointed out in August, over the 3 months ending on 15 June last year, 45 percent of all individuals stopped by NSW police over a suspected COVID breach were subsequently searched.

Unvaccinated people in rural areas will lose freedoms

NSW officials have warned even if regional NSW comes out of lockdown as planned on Friday, unvaccinated residents will lose the freedoms they have regained when the state reaches its 70 per cent vaccination goal.

The regional NSW lockdown is due to end at 11.59pm on September 10 but deputy Premier John Barilaro said a decision still hadn't been made about which areas will be able to have restrictions eased.

And even if some areas do come out of lockdown, when the road map for extra freedoms for vaccinated residents is released, those who haven't received their jabs will lose their new-found freedoms.

"I don't believe that if we open them up we'll open them to an environment pre-lockdown ... There is an opportunity to open but I would argue it would be in a restricted environment, not like the environment pre-lockdown," Mr Barilaro said.

"If and when we announce the road map and talk about the vaccinated, it's clear that those who are unvaccinated in regional and rural NSW, if they may have a freedom now, they'll lose that freedom.

"The vaccination rates in regional and rural NSW have to continue to rise on par with metro Sydney and the state average and therefore the pressure point must apply that for some people in the regions.

"If we get to that point, if they come out of lockdowns now, they could go backwards and could lose freedoms if they're unvaccinated and I make no apology for that."

John Barilaro sued Jordan Shanks for defamation a couple of months ago for videos he published on the Friendlyjordies YouTube channel. A month or two later the police from the anti-terrorism division, Fixated Persons Investigation Unit, charged Shank's employee Kristo Langker with stalking John Barilaro. Not long after John Barilaro denied on Sky News that he had any involvement in having the Fixated Persons Investigation Unit involved.

A couple of days ago John Barilaro's police statement was leaked which proves John Barilaro has been lying to the media and that Barilaro has been dealing with the Fixated Persons Investigation Unit since December 2020 trying to get Jordan Shanks charged with an offence. Shanks hasn't been charged although Shanks has recently said there is a warrant for his arrest but I suspect the police are too scarred to arrest Shanks now with all the lies being exposed.

Kristo Langker has been charged with 2 counts of stalking. The second count of stalking relates to Kristo Langker trying to hand Mr Barilaro a legal document, which is also on video as per below, and looks like rock-solid evidence that Mr Barilaro polished up his police statement to make sure Kristo Langker was falsely charged by the police. Most participants in the influential group say the health advice usually prevails - and NSW is ratcheting up controls. Whether they work remains to be seen
From the beginning of the pandemic, NSW's crisis cabinet has met - initially at 8am but now more often in the afternoon - to discuss the unfolding coronavirus caseload in NSW and the steps needed to combat the spread and keep the state operating.
It's an immensely powerful body that in normal circumstances would not be tolerated in a democracy.
As one participant said: "We make decisions there that would take 18 months under normal circumstances and would require legislation through parliament. We're taking decisions that curtail people's freedoms or pay out millions in an afternoon."
The meeting takes place a few times a week, online. It usually begins with a briefing by health officials led by Dr Kerry Chant, the chief health officer, and more recently, a briefing on the ongoing vaccination effort by deputy secretary of NSW Health, Susan Pearce.
More often than not there's an update on the hospital capacity, and more recently, the resilience commissioner, Shane Fitzsimmons, briefs on the efforts in the 12 LGA hotspots of concern to co-ordinate services between community leaders, staff on the ground delivering care parcels to infected families, and non-government organisations like the Salvation Army.
Then there is usually a briefing from NSW police on enforcement of the lockdown rules before they turn to the businesses of what more needs to be done. Sometimes it's the police commissioner, Mick Fuller, or one of the deputy commissioners, Gary Warboys or Mick Willing.
The key ministers attending include the premier, Gladys Berejiklian; the deputy premier, John Barilaro; the health minister, Brad Hazzard; and the treasurer, Dominic Perrottet.
Also in attendance are the Services NSW minister, Victor Dominello, who's been under pressure on the slow pace of processing business support; and the tourism minister, Stuart Ayres (who's been responsible for standing up quarantine hotels and health accommodation for families, usually in Meriton suites in the west).
Not everyone is happy about the line-up. There have been reports that police minister David Elliott was miffed at not being included, though most of the police matters are operational ones rather than matters of policy and funding.
Fuller has recently stepped back into the role of state emergency operations commander and is responsible also for deploying the Australian Defence personnel across the state. He's been responsible for making recommendations about what tools he needs to achieve effective compliance with the stay-at-home orders.
Berejiklian is fond of saying she is following the health advice - so often that it's become a meme - but most participants say that generally the health advice does prevail in crisis cabinet.
When asked about whether this is true, Chant said on Wednesday that her role was to put the health advice squarely and clearly and that obviously it was for others to apply a political lens and to consider economic and social impacts. More recently the chief psychiatrist has had a louder say.
"The premier and I have a shared vision. That's to get vaccine rates up and to limit movement as much as possible," Chant said in response to a question about whether they had diverged in their views about a lockdown.

Liberal and National Party MPs attack free speech and political communication with 4 defamation cases in the Federal Court

Three Liberal Party MP's, Peter Dutton, Andrew Laming and Christian Porter, and one National Party MP, NSW Deputy Premier John Barilaro, currently have defamation cases in the Federal Court of Australia which I suspect is a record for the number of politicians suing social media users and journalists at any one given time.

The 4 court cases by themselves are an attack on free speech and political communication and while Porter has in theory settled his defamation case, and he has tried to claim a win, it is still afoot. And if the other three were to win their cases it would have a huge negative effect on free speech and political communication in this country. How much coordination has happened between the 4 is unknown but there would likely of been at least some discussion between a couple of them if not all of them.

Christian Porter sued the ABC and journalist Louise Milligan for defamation and while Porter has settled the defamation case elements of the case have not been finalised. (Click here and here to read more) Porter has been using the lawyer Rebekah Giles who runs the law firm Company Giles and he used the barrister Sue Chrysanthou SC before she was restrained by the court from representing Porter anymore.

Federal MP Andrew Laming, who is also suing journalist Louise Milligan, is also using lawyer Rebekah Giles and it is hard to believe he would not have consulted Christian Porter before hiring Rebekah Giles. Which barrister Mr Laming is using at this point is unknown.

"lawyers acting on behalf of Laming lodged documents in the federal court alleging Milligan had "gravely injured" the embattled MP's "character and reputation" in a series of tweets on 28 March relating to a photo he took of a woman bending over at a Brisbane landscaping business in 2019."

The claim, seen by the Guardian, alleges that Milligan "intended" for the "sensational, accusatory and spiteful" tweets to "irrevocably damage" Laming's "personal and professional reputation". (Click here to read more)

Federal MP Peter Dutton is suing Twitter user Shane Bazzi for one Tweet and is using the law firm Baker & Mckenzie. Which barrister Mr Dutton is using at this point is unknown.

Peter Dutton has followed through with his threat to sue social media users for defamation by starting proceedings against Twitter user Shane Bazzi for calling Dutton a "rapist apologist". But there is a video and a Twitter message below of Peter Dutton saying, "QLD Premier Palaszczuk should be shamed into joining a federal push for a public sex offender register" and asking "why Premier Palaszczuk is siding with and protecting paedophiles and sex offenders is just beyond anyone's comprehension and it is for her to explain". NSW Deputy Premier John Barilaro is suing YouTube comedian FriendlyJordies (Jordan Shanks-Markovina) and Google who own YouTube. Barilaro is using the law firm Mark O'Brien Legal, who also represent Ben Roberts-Smith, and Christian Porter's former barrister Sue Chrysanthou SC who was in her usual fine form in the Federal Court on Friday. FriendlyJordies have raised over $1million for their legal defence for the defamation matter as well as criminal charges against employee Kristo Langker who has been charged with stalking Barilaro which based on video evidence is a false charge.

At Friday's pre-trial hearing in the Barilaro v FriendlyJordies matter his barrister Sue Chrysanthou SC argued:

"John Barilaro boasting about pork barrelling government grants may be "the wrong thing to do", but it does not show the New South Wales deputy premier is a corrupt conman, his lawyers have argued in court." (Click here to read more)

"The necessary reasons include if you can't work from home and you have to work outside of home. If you can't get educated at home and you have to get educated outside of home. If you exercise outside, although we don't want any more groups than 10. And if you need to provide care or compassion to a relative. And fourthly, of course, if you need to buy essential goods or services."

Ms Berejiklian noted she was captured by those rules.

"I don't live in those areas but I work there and have done so in the last fortnight, so therefore, I'm captured by that stay-at-home order," she said.

NSW recorded its biggest rise in daily Covid-19 cases since the latest outbreak began on Friday, with 22 new locally acquired infections bringing the total to 70.

Existing restrictions announced earlier this week applying to seven local government areas - Woollahra, Waverley, Randwick, City of Sydney, Canada Bay, Inner West and Bayside - have been extended until 12.01am on Saturday, July 3.

It came after NSW Deputy Premier John Barilaro hinted at a possible Sydney lockdown, saying health advice "could change in the next few hours".

The state government was holding crisis talks at 9.30am to assess whether the restrictions to contain the outbreak are enough.

Mr Barilaro said lockdown wasn't required based on the current advice.

"We look at the numbers, 11 cases (does) sound alarming (but only) one is a mystery case," he told Nine's Today.

"It is not just the numbers, it is the detail, the information we have behind the scenes that our expert health officials look at that gives us the confidence to make the decision and the advice at this stage is not to lock down. At this stage I don't think we need a lockdown. But that advice could change in the next few hours and it could change over the weekend."

Public health experts are divided on whether Sydney needs to impose a "short, sharp" lockdown.

"I have not been contacted by police in relation to any allegations.

"Until this matter is resolved, it is appropriate I stand aside from my role as Minister. I will also remove myself from the Liberal Party room.

"I will not be making any further comment at this time."

Mr Ward is the Minister for Families, Communities and Disability Services.

NSW Premier Gladys Berejiklian said she accepted Mr Ward's decision to step down and Attorney General Mark Speakman would act in his portfolio.

"I was made aware through media reports today that an MP is under investigation by police," she said.

"I have subsequently received advice from Minister Gareth Ward of his decision to step aside as Minister and sit on the crossbench while there is speculation about his future.

"I support his decision."

Earlier, before Mr Ward named himself, Deputy Premier John Barilaro told 2GB the matter involved "very serious allegations".

"If there is an individual in this Parliament that is under investigation, then of course we will need to deal with that," he said.

"This is not acceptable."

The inquiry is investigating the allocation of $250 million worth of grants under the Stronger Communities Fund amid accusations of pork-barrelling in the run-up to the 2019 NSW election.

Nearly all the grants were awarded to local councils in Coalition-held seats.

The inquiry heard that $141.8 million of the grant funding was allocated by the Premier, with $61.3million allocated by the Deputy Premier John Barilaro and $48.9 million by the Minister for Local Government.

Two senior staff from the Premier's office were today called to give evidence on the process by which the grant money was allocated and approved.

Ms Lau said she prepared two working advice notes on which the Premier marked her approval of the grants.

She said she later destroyed the notes because she had sent an email recording the outcome.

"And how did you dispose of those working advice notes?" asked Labor MP John Graham.

"It's likely they would have been shredded," she replied.

The Premier's former chief of staff, Sarah Cruickshank, was asked whether it was routine practice in the Premier's office to destroy documents related to the spending of millions of dollars in public money.

"No, I would say it's not," she replied.

Ms Cruickshank was also quizzed about six grants worth just over $40,000 awarded by the Premier's Discretionary Fund to projects in the electorate of Wagga Wagga in 2017.

"Are you aware of the Premier making any disclosures about her relationship with Daryl Maguire before approving these funds?" asked Labor MP Courtney Houssos.

"No, I'm not," Ms Cruickshank replied.

She said MPs would typically write to the Premier to lobby for projects in their electorate.

But, under this particular scheme, the allocation of funding was totally at the discretion of the Premier.

Mr Graham: "If there was a decision where the Premier was making an allocation and there was any sort of conflict, there would have had to have been a conflict of interest declaration?"

Ms Cruickshank: "I'm actually not clear on whether or not if that's a requirement for the Discretionary Fund, however I accept that does sound plausible."

Mr Graham: "Are you aware of any declaration of a conflict of interest at any time in your role as Chief of Staff, for example over the Badgerys Creek deal or any other (deal)?"

Ms Cruickshank: "No, I'm not."
