>Codename 'Apalachee':
Wide Range of New Surveillance Programs
Obama's appearance before the press was an attempt to morally justify the work of the intelligence agencies; to declare it as a type of emergency defense. His message was clear: Intelligence is only gathered because there is terror – and anything that saves people's lives can't be bad. Ever since the attacks of Sept. 11, 2001, this logic has been the basis for a wide range of new surveillance programs.
With his statement delivered in the White House briefing room, Obama hoped to take the pressure off, primarily on the domestic political front. In Washington the president is currently facing opposition from an unusual alliance of left-wing Democrats and libertarian conservatives. They are supported by veteran politicians like Republican Congressman Jim Sensenbrenner, one of the architects of the Patriot Act, which was used to massively expand surveillance in the wake of 9/11. On July 24, a bill that would have curtailed the power of the NSA was only narrowly defeated by 217 to 205 votes in the House of Representatives.
Even stalwart Obama supporters like Democrat Nancy Pelosi, minority leader in the House of Representatives, are now calling into question the work of the intelligence agency. Pelosi says that what she reads in the newspapers is "disturbing." It wasn't until late last week that news broke that the NSA had illegally collected tens of thousands of emails over a number of years.
Obama's public appearance was aimed at reassuring his critics. At the same time, he made a commitment. He gave assurances that the NSA is a clean agency that isn't involved in any dirty work. Obama has given his word on this matter. The only problem is that, if internal NSA documents are to be believed, it isn't true.
The classified documents, which SPIEGEL has seen, demonstrate how systematically the Americans target other countries and institutions like the EU, the International Atomic Energy Agency (IAEA) in Vienna and the UN. They show how the NSA infiltrated the Europeans' internal computer network between New York and Washington, used US embassies abroad to intercept communications and eavesdropped on video conferences of UN diplomats. The surveillance is intensive and well-organized – and it has little or nothing to do with counter-terrorism.
Targeting Foreign Governments
In an internal presentation, the NSA sums up its vision, which is both global and frighteningly ambitious: "information superiority." To achieve this worldwide dominance, the intelligence agency has launched diverse programs with names like "Dancingoasis," "Oakstar" and "Prism." Some of them aim to prevent terrorist attacks, while others target things like arms deliveries, drug trafficking and organized crime. But there are other programs, like "Blarney" and "Rampart-T," that serve a different purpose: that of traditional espionage targeting foreign governments.
Blarney has existed since the 1970s and it falls under the Foreign Intelligence Surveillance Act of 1978, at least according to the NSA documents, which state that it is based on the cooperation of at least one US telecommunications company that provides services to the agency. The NSA describes the program's main targets as "diplomatic establishment, counter-terrorism, foreign government and economic." These documents also say that Blarney is one of the "top sources" for the President's Daily Brief, a top-secret document which briefs the US president every morning on intelligence matters. Some 11,000 pieces of information reportedly come from Blarney every year.
No less explosive is the program dubbed "Rampart-T" by the NSA and which, by the agency's own accounts, has been running since 1991. It has to do with "penetration of hard targets at or near the leadership level" – in other words: heads of state and their closest aides.
This information is intended for "the president and his national security advisors." Rampart-T is directed against some 20 countries, including China and Russia, but also Eastern European states.
The Americans recently drew up a secret chart that maps out what aspects of which countries require intelligence. The 12-page overview, created in April, has a scale of priorities ranging from red "1" (highest degree of interest) to blue "5" (low interest). Countries like Iran, North Korea, China and Russia are colored primarily red, meaning that additional information is required on virtually all fronts.

Tucker challenges Jim Jordan after Big Tech hearing: 'Google is your second biggest campaign contributor'
'Tucker Carlson Tonight' host asks Jordan 'what the consequences are going to be' for censorship
By Yael Halon Fox News
Published July 29, 2020 10:26pm EDT
The CEOs of Amazon, Apple, Facebook and Google appear for congressional hearing on monopolies, accusations of political bias; reaction from Ohio Rep. Jim Jordan, Republican member of the House Judiciary Committee.
Fox News' Tucker Carlson told House Judiciary Committee Ranking Member Jim Jordan, R-Ohio, to explain "what the consequences are going to be" for Big Tech companies that censor conservative viewpoints after Jordan blasted the leaders of Google, Facebook and other tech giants at a subcommittee hearing.
"Big Tech's out to get conservatives, that's clearly true," the "Tucker Carlson Tonight" host told Jordan. "It's time they face the consequences. There are too many frustrated viewers out there who don't think Republicans have forced them to face any consequences for the past four years. Tell us, simply, what the consequences are going to be."
Jordan insisted that House Republicans are working with the Senate to address the issue, and emphasized the importance of retaking the House in November, asking Carlson, "do you think Joe Biden, Kamala Harris, and Jerry Nadler are going to fix this? "
"I'm a talk show host," Carlson answered.
"We've got four million viewers or whatever, but my job is to talk. Lawmakers are tasked with running the country and passing our laws, by definition, and these companies operate with a special carve-out provided them by Congress and Congress has never done anything to rein them in."
"We've got, what, 96 days until the election," the host added. "Are there going to be any consequences until then?"
"There are three possible remedies here," Jordan acknowledged. "All I know is there is a big problem and there has to be a remedy, we are looking at which is the best course of action to take."
The interview took a turn when Carlson observed that Jordan and Rep. Jim Sensenbrenner, R-Wis., have accepted campaign contributions from Google.
"Google is your second-biggest campaign contributor in the last cycle," Carlson told Jordan. "Why do you think they would give you money?"
"Look, if they want to exercise their First Amendment liberties to give me money – I raised $3 million last quarter," Jordan fired back. "If Google gives me a few thousand-dollar check, God bless them. That doesn't change who I am."
Jordan pointed to his behavior in Wednesday's hearing, during which he rattled off a list of instances where major tech and social media companies either censored or removed posts from conservative lawmakers or thinkers.
"In 2016, Google tried to tailor their features to help [Hillary] Clinton in key states …" Jordan stated. "The good news is in 2016, in spite of what Google did, the American people saw it for what it was and Donald Trump was elected.
"I think its gonna happen again," he predicted, "but we've got to keep our eye on them."

House Rep Calls For Ethics Investigation Into Swalwell Over Relationship With Chinese Spy
House Speaker running interference for Swalwell claiming his innocence without even looking into allegations
As questions swirl around the revelation that US Rep. Eric Swalwell (D-CA), had a years-long, ongoing relationship with a woman who turned out to be a spy for the Communist Chinese, Democrat Party leadership in the House refuse to remove him from the House Intelligence Committee.
Christine Fang, a Chinese national who has now been identified as a clandestine agent for the Communist Chinese, arrived in the United States as a "student." She quickly cultivated "targets" or "marks" in government to include Swalwell.
Fang established "close ties" to Swalwell beginning in 2014.
Fang operated in Swalwell's campaign circles as a fundraiser and campaign finance facilitator during his 2014 congressional campaign. She even succeeded in placing an operative intern in Swalwell's congressional office.
It has been suggested by many - including those close to the Swalwell camp, that he and Fang had a sexual relationship, a common tactic used by female Chinese espionage operative to syphon information out of "marks" during pillow talk.
GOP Rep. Sensenbrenner seeks ethics investigation of Swalwell relationship with China spy https://t.co/PYOPBeFnDq pic.twitter.com/HeZGVVgzLy
- New York Post (@nypost) December 11, 2020
In fact, the FBI became so concerned about Swalwell's relationship with Fang that they provided the Congressman a "defensive briefing" to warn him of exactly who he was engaged.
The matter is so explosive and wide-ranging that US Rep. Jim Sensenbrenner (R-WI), filed a complaint with the House Ethics Committee, urging the committee to "immediately open an investigation" into the allegations that Swalwell had been compromised by Fang.
But House Speaker Nancy Pelosi (D-CA), is defending Swalwell - a fellow San Franciscan, and is actively refusing to remove him from the House Intelligence Committee.
"In terms of Mr. Swalwell - in the spring of 2015, the leadership of the House and the [Intelligence] Committee were informed that overtures from a Chinese person were being made to members of Congress," Pelosi said. "When that was made known to the members of Congress, it was over."
In addition to Pelosi refusing to safeguard the House Intelligence Committee from a probable secure breach in Swalwell, she said has no intention of asking for background checks on Swalwell's interns.
Swalwell's affair with Fang commenced in 2012 when Fang arrived. Congressional members were not briefed about Fang for 3 years.

House Judiciary Republicans Send Letter to Nadler Demanding He Denounce Violent Left-Wing Extremism, Acknowledge Antifa is Not a 'Myth'
House Judiciary Republicans on Tuesday sent Chairman Jerrod Nadler (D-NY) a letter demanding he denounce violent left-wing extremism, acknowledge Antifa is not a 'myth' and immediately convene a Committee hearing to examine the civil unrest seen in Democrat-run cities across the US.
Nadler previously called Antifa a "myth that's only being spread in Washington, D.C."
Republican Reps. Jim Jordan (OH), Ken Buck (CO), Mike Johnson (LA), and Jim Sensenbrenner (WI) sent Nadler a 3-page letter lambasting the Judiciary Committee Chairman for wasting the "first twenty months of your chairmanship on fruitless partisan investigations in furtherance of your obsession with attacking President Trump."
"We urge you not to waste any more time. The jurisdiction of the Judiciary Committee provides you with a unique authority to condemn the violence and disorder in Democrat-run cities," the GOP lawmakers wrote.
"Democrats have failed to stop the violence and destruction in [Portland, Minneapolis, Kenosha, Seattle, New York City]" the GOP lawmakers said asserting that President Trump has sought to restore order to these cities.
"There are two specific actions that you can take now to help restore law and order to Democrat-run American cities: 1. Publicly and forcefully denounce left-wing violent extremism and acknowledge that left-wing violence is neither "imaginary" nor a "myth." 2. Immediately convene a hearing of the Judiciary Committee to examine the civil unrest caused by left-wing violent extremists in Democrat-run cities. This is an issue of life and death that the Committee must not ignore,"

Mark Zuckerberg Antitrust Hearing: Facebook CEO Grilled About Whether Instagram Buy Was Monopolistic
Mark Zuckerberg was among the tech giant leaders questioned Wednesday by a House antitrust subcommittee. The Facebook CEO was quick to point out in his prepared statement that his company faces significant competition from all sides and that every company represented at the hearing could be put out of business if they fail to innovate. Nevertheless, he faced hard questions backed up by company emails about its alleged attempts to stamp out competition.
Zuckerberg was first engaged by Rep. Jim Sensenbrenner, R-Wis., on accusations from Rep. Jim Jordan, R-Ohio, that Facebook's platform censors conservative voices, singling out the recent restriction of Donald Trump Jr. for sharing a video that encouraged the use of hydroxychloroquine as a treatment for COVID-19.
This incident occurred on Trump Jr.'s Twitter account, not Facebook.
While stating that this incident occurred on a rival platform, Zuckerberg said that Facebook does not allow posts that might lead to harm. He stated that Facebook would not take down content discussing trials, but would do so for posts claiming that there is an effective treatment for the virus, which there is not.
"We do not want to become the arbiters of truth," Zuckerberg stated.
Zuckerberg's testimony became especially heated when House Judiciary Committee Chairman Jerry Nadler questioned the CEO on its 2012 acquisition of photo-based social media company Instagram. An email obtained by the committee showed Zuckerberg calling the platform potentially "very disruptive" to Facebook's business. Another email said that an acquisition could do away with a competitor, and the CEO replied that this was part of his motivation for the deal.
Zuckerberg denied that Facebook acquired Instagram to stamp out potential competition. He also stated that his company could not have predicted the scale that Instagram would grow.
"It was not a guarantee that Instagram was going to succeed," Zuckerberg said. "In hindsight, it looks obvious that Instagram reached the scale it has. At the time, it was far from obvious."
Zuckerberg noted that the Federal Trade Commission (FTC) in 2012 declined to challenge the acquisition as anti-competitive. Nadler referred to this as one of the "failures" of the FTC in the past.
The FTC is actively reviewing its ruling from the past decade. If it decides against its previous ruling, it is possible that antitrust enforcement could see Instagram spun off from Facebook.

Patriot Act author: 'There has been a failure of oversight.'
Rep. Jim Sensenbrenner (R-Wis.) authored the original Patriot Act after the September 11, 2001, terrorist attacks, and previously served as chair of the House Judiciary Committee. Recently, he has become a vocal critic of how that legislation has been used to justify broad National Security Agency spying powers since they came to light due to documents from former NSA contractor Edward Snowden. Sensenbrenner is introducing legislation called the USA FREEDOM Act with Sen. Patrick Leahy (D-Vt.) and Rep. John Conyers (D-Mich.) to try to reform those programs. I spoke to the congressman Thursday afternoon about the proposal, congressional oversight over the NSA, and how opposition to the spying programs is building alliances in a time of bitter partisanship. This interview has been lightly edited for length and clarity.

Big Tech Floods House Judiciary with Cash as Committee Intensifies Antitrust Review
Apple, Amazon, Facebook, and Google have donated vast sums of money to members of the House Judiciary Committee's antitrust subcommittee in advance of its Big Tech hearing on Wednesday.
The House Judiciary Subcommittee on Antitrust, Commercial, and Administration Law will hold a hearing on Wednesday, which will feature testimony from Amazon CEO Jeff Bezos, Apple CEO Tim Cook, Google CEO Sundar Pichai, and Facebook CEO Mark Zuckerberg.
This arises as Republicans and Democrats have become increasingly critical of the big tech's dominance on the Internet; however, big tech companies' donations to members of the House Judiciary subcommittee on antitrust may undermine potential efforts to find antitrust solutions against the power and influence of these big tech companies.
During the antitrust hearing, House Judiciary Committee Chairman Jerry Nadler (D-NY), and Ranking Member Jim Jordan (R-OH), will ask these tech giants questions alongside members of the House antitrust subcommittee. The House Judiciary antitrust subcommittee members include:
House Judiciary Committee Antitrust, Commercial, and Administrative Law Subcommittee Chairman David Cicilline (D-RI)
House antitrust subcommittee Vice Chair Joe Neguse (D-CO)
Rep. Hank Johnson (D-GA)
Rep. Jamie Raskin (D-MD)
Rep. Pramila Jayapal (D-WA)
Rep. Val Demings (D-FL)
Rep. Mary Gay Scanlon (D-PA)
Rep. Lucy McBath (D-GA)
House antitrust subcommittee ranking member Jim Sensenbrenner (R-WI)
Rep. Matt Gaetz (R-FL)
Rep. Ken Buck (R-CO)
Rep. Kelly Armstrong (R-ND)
Rep. Greg Steube (R-FL)
As the House Judiciary Committee prepares to hold its hearing, Amazon, Apple, Facebook, and Google have donated large sums to the members of the committee.
Google
Google has donated $140,939 to members of the House Judiciary Committee during the 2020 term. Google donated $96,939 to House Judiciary Democrats, and $44,000 to House Judiciary Republicans. $26,439 of the donations came from individuals, whereas $114,500 of the donations come from political action committees (PACs).
Further, they have donated large sums to the committee's leaders and members of the antitrust committee, including:

"The requested minority hearing day must take place before articles of impeachment are considered by the Committee. I'll remind you once more: [t]he Chairman is entitled to his opinions. He is not entitled to break the rules, abuse his power, and impose his will.'"
WASHINGTON - Rep. Doug Collins (R-Ga.), Ranking Member of the House Judiciary Committee, wrote the following letter to Chairman Jerrold Nadler (D-N.Y.) reminding him of his duty to schedule the minority hearing day before articles of impeachment reach the committee.
The letter is available here and below.
December 5, 2019
The Honorable Jerrold Nadler
Chairman
House Judiciary Committee
House of Representatives
Washington, D.C. 20515
Dear Chairman Nadler,
During yesterday's impeachment hearing, Representative Jim Sensenbrenner furnished you with a timely demand for a minority day of hearings, signed by all Republican Members of the Committee. You declined repeated requests by Republican Members during the hearing to acknowledge your obligation to schedule such a hearing or to provide any details on your planned schedule for further impeachment proceedings.
Clause 2(j)(1) of Rule XI is clear and unequivocal: Once the demand is made, Minority Members "shall be entitled to . . . call witnesses selected by the minority to testify with respect to that measure or matter during at least one day of hearing thereon." As you have previously stated: "It is not the Chairman's right to determine whether we "deserve" a hearing; it is not the Chairman's right to decide whether his prior hearings were sufficient; it is not the Chairman's right to decide whether what we say or think is acceptable; and it is certainly never the Chairman's right to violate the rules in order to interfere with our right to conduct a hearing."
Considering the haste with which this sham impeachment has been conducted, it is imperative that you contact me or my office as soon as possible to consult on scheduling the requested minority hearing day. The requested minority hearing day must take place before articles of impeachment are considered by the Committee. I'll remind you once more: "[t]he Chairman is entitled to his opinions. He is not entitled to break the rules, abuse his power, and impose his will."
Sincerely,
Doug Collins

GOP calls for minority hearing on impeachment, threatens procedural measures
BY JULIEGRACE BRUFKE - 12/10/19 04:40 PM EST 919
752
"Top Republicans in the House are vowing to use every procedural tool available to them to strong-arm Democrats on the House Judiciary Committee and get them to hold a minority hearing on impeachment.
In a letter led by House Freedom Caucus Chairman Andy Biggs (R-Ariz.), sent to Judiciary Committee Chairman Jerrold Nadler (D-N.Y.) on Tuesday, the conservative members noted Republicans had previously requested a minority hearing be held before articles of impeachment were introduced. The group argued that while Democrats did not comply with their requested timeline, under current rules they are entitled to a hearing.
"During the open hearing on December 4, 2019, Congressman [Jim] Sensenbrenner [R-Wis.], on behalf of all of the Republican members of the House Judiciary Committee, presented you with a request for a minority hearing in compliance with Clause 2(1)(1) of Rule XI. To date, you have ignored the request and failed to respond to repeated questioning on the matter," they wrote.
…"Until our procedural rights as Members of the United States House of Representatives are respected, we will avail ourselves of every parliamentary tool available to us in committees and the House floor in order to highlight your inaction," it reads.
In addition to Biggs, 71 GOP lawmakers including House Minority Leader Kevin McCarthy (Calif.), Minority Whip Steve Scalise (La.), GOP Conference Chairwoman Liz Cheney (Wyo,) signed onto the letter.
…"The Democrats haven't thrown out the rule book, they lit it on fire, and, you know, danced around it. There is no mechanism for us to be able to put on our case given Adam Schiff's veto of our witnesses and Jerry Nadler's rejection of our entitled evidentiary hearing," Rep. Matt Gaetz (R-Fla.) told The Hill. "This would be like a criminal trial where the prosecution put on their case, and the defense wasn't allowed to admit evidence, unless the prosecution agreed to it."
The House Judiciary Committee could hold a markup on the two articles of impeachment unveiled on Tuesday as soon as Wednesday evening, with some projecting a floor vote before Christmas.
Nadler declined to comment on whether the minority hearing will take place."

FIREWORKS Erupt On House Judiciary Committee Two Days In A Row
WASHINGTON - Although Attorney General Bill Barr decided not to appear before the House Judiciary Committee Thursday, it did not stop fireworks from erupting two days in a row when members debated about the hearing format, procedure, as well as the treatment of Republican members.
Chairman Jerry Nadler appeared to lose control of his own committee on Wednesday when Republican members called him out for not recognizing Republican members at various times during the hearing.

Wisconsin Republican Rep. Jim Sensenbrenner, a former chairman of the committee repeatedly called to be recognized while Texas Republican Rep. Louie Gohmert called the hearing a "kangaroo court" and said he was not surprised that Barr did not want to appear before the committee the following day.
The debate spilled over into Thursday's hearing when members of the committee faced an empty witness chair intended for AG Barr. Ranking member Doug Collins excoriated Committee Democrats for disrespecting minority member rights on the committee the previous night while attempting to create an impeachment like atmosphere.

Rep. Sensenbrenner: "I'm proud to be a leader in this bipartisan push to lower drug prices and bring relief to the American people. By holding accountable those who game the system, we can find market-based solutions that make prescription medicines more affordable. I thank Chairman Cicilline and Congressman Jeffries for joining me in this effort."

"The U.S. Government is currently seeking the criminal forfeiture of more than $14 billion in drug proceeds and illicit profits from El Chapo, the former leader of the Sinaloa drug cartel who was recently extradited to the U.S. to face criminal prosecution for numerous alleged drug-related crimes, including conspiracy to commit murder and money laundering," Cruz added.
Wisconsin Rep. Jim Sensenbrenner proposed similar legislation in the U.S. House of Representatives, which would use money seized from drug cartels to fund a border wall.
"This is a way to fulfill the president's desire to have Mexico pay for the wall," Sensenbrenner, a member of the Judiciary Committee, told the Washington Examiner. "Having the money seized from Mexican drug cartels would mean that the bad Mexicans would end up paying for the wall, and the bad Mexicans have been terrorizing the good Mexicans with crime and kidnappings and murders within Mexico itself."...
"The [Drug Enforcement Agency] has estimated that the gross receipts of the Mexican drug trade or somewhere between $19-$29 billion a year," he said. "We don't have to be 100 percent efficient to get the the money we need to completely pay for the wall relatively quickly."
El Chapo's $14 billion would fund well over half of the proposed wall along the southern border between the U.S. and Mexico.

New GOP Legislation To Make Mexican Drug Cartels Pay for Border Wall
House Republicans introduced legislation this week that would allow the federal government to use money and property seized from Mexican drug cartels to pay for border security, which could potentially break the gridlock in Washington over funding a wall.
Following President Donald Trump's Oval Office address on Tuesday night, Rep. Jim Sensenbrenner of Wisconsin announced his plans to reintroduce the Build Up Illegal Line Defenses With Assets Lawfully Lifted (BUILD WALL) Act.
According to a news release from the Republican, "This legislation would direct money and assets seized from Mexican drug cartels to be used to increase border security between the U.S./Mexican border.
"In addition to building a physical wall, the funding may also be used to construct other types of barriers or to implement technology-supported solutions where appropriate," the release said.
Sensenbrenner argued his legislation offers a way out of the stalemate over funding the construction of a border barrier.

Parts of the Patriot Act aren't a thing anymore anyway because it was renamed the USA Freedom Act. It's magic! SEE HOW THAT WORKS?! From the Wiki:
"Following a lack of Congressional approval, parts of the Patriot Act expired on June 1, 2015.[11] With passing the USA Freedom Act on June 2, 2015, the expired parts were restored and renewed through 2019.[12] However, Section 215 of the law was amended to stop the National Security Agency (NSA) from continuing its mass phone data collection program.[12] Instead, phone companies will retain the data and the NSA can obtain information about targeted individuals with permission from a federal court.[12]"
It was renewed… we're using their tools against (((them))), remember? We'll be able to fix this shit after November, but until then, we're watching a show and we're not even at that Part (3) yet.
Besides, you're overlooking that it's JUST about the NSA and PRISM, and none of the other tentacles and nigger machinations.
"After suspected abuses of the USA PATRIOT Act were brought to light in June 2013 with articles about collection of American call records by the NSA and the PRISM program (see 2013 mass surveillance disclosures), Representative Jim Sensenbrenner, Republican of Wisconsin, who introduced the Patriot Act in 2001, said that the National Security Agency overstepped its bounds.[207] He released a statement saying "While I believe the Patriot Act appropriately balanced national security concerns and civil rights, I have always worried about potential abuses." He added: "Seizing phone records of millions of innocent people is excessive and un-American."[207][208]"
So… There are still things in play we [We] are not aware of. The fuck's DARPA been up to, for example. Google is just a part of Alphabet, so does everyone under that umbrella get to access whatever information? Etc etc.

Congressional group asks FBI boss Wray to explain Apple lawsuit
How dark can crims really go?
By Richard Chirgwin 16 Apr 2018 at 02:00
21 Reg comments SHARE ?
Ten members of the US Congress have asked the FBI to explain its battles with Apple, after doubts were raised over the extent to which criminals use encryption to "go dark" and evade law enforcement authorities.
Criminals using encryption to evade law enforcement - "going dark" - is the foundation of the FBI's calls for a special legislative mathematics and not-backdoors that means good guys can access bad guys' messages, without compromising everyone else.
But a recent Department of Justice Office of the Inspector General report cast doubt on just how often crims "go dark". The report, by the Justice Office of the Inspector General (OIG), included statements that "appear to indicate that the FBI was more interested in forcing Apple to comply than getting into the device".
Now 10 members of Congress have written (PDF) to FBI director Christopher Wray asking for answers.
Shrug
You won't believe this, but... nothing useful found on Farook
iPhone.
In their letter posted Friday, April 13, the group said they are "troubled" by the report, which was penned in the wake of the November 2015 attack by San Bernadino shooter Syed Farook. During its investigation into the incident, the FBI conducted a very public battle with Cupertino over access to Farook's encrypted iPhone. The FBI took Apple to court demanding a special iOS build to crack the iPhone 5c, something Apple defended on the basis that it would set a bad legal precedent.
In March 2016, the Feds said they'd cracked the phone and withdrew the lawsuit, and later, then-FBI director James Comey said a third party banked more than a million dollars to crack the phone (which in the end didn't really help the case).
The OIG report suggested the FBI's Remote Operations Unit (ROU) might have access to a third-party vendor's crack for the iPhone, but investigators in the San Bernardino case didn't ask, and the ten Congressman would like to know why.
They're also concerned at hints that there's a degree of turf-warring within the FBI, between the ROU and the Cryptographic and Electronic Analysis Unit (CEAU), which was frustrated that the ROU's vendor contact jinxed its lawsuit: "The CEAU Chief told the OIG that ... he became frustrated that the case against Apple could no longer go forward, and he vented his frustration to the ROU Chief."
The letter says the timeline detailed in the OIG report "undermines statements that the FBI made ... that only the device manufacturer could provide a solution", and raises the possibility that "the FBI has not been forthcoming about the extent of the 'Going Dark' problem".
They also highlight that rather than the more-than-a-million Comey discussed in 2016, Cellbrite claims it can unlock an iPhone for about US$1,500.
The group add that the FBI's claim that it was unable to crack 7,800 devices last year seems "highly questionable", now the existence of third-party unlocking tools is common knowledge.
The letter asks the following questions of Wray:
Have you consulted with relevant third-party vendors to understand what tools are available to help the FBI access device content?
Do you agree that there are solutions available to help unlock or decrypt nearly every device on the market? If not, why are these solutions, particularly [Cellbrite and GrayShift], insufficient?
Why can't the FBI unlock the 7,800 devices? Have you attempted to use tools developed by third-parties to unlock these devices?
Of these locked phones, how many are equipped with biometrics or how many have data available through a cloud service, which would provide additional means to access data or unlock phones?
For each device that you have not used a third-party tool to unlock, what is the rationale for not doing so?
The signatories to the letter are Democrats Zoe Lofgren, Jerrold Nadler, Ted Leiu, Jared Polis and Suzan DelBene; and Republicans Darrell Issa, Jim Sensenbrenner, Ted Poe, Matt Gaetz, and Jim Jordan. ®

Crime Subcommittee to Hold Hearing on Sex Trafficking and Section 230 of the Communications Decency Act
Email
Washington, D.C. - On Tuesday, October 3, 2017 at 10:00 a.m., the Crime, Terrorism, Homeland Security, and Investigations Subcommittee will hold a hearing titled, "Online Sex Trafficking and the Communications Decency Act."
In recent years, there has been a spate of criminal and civil litigation against Backpage.com, a website that offers classified listings, including an extensive adult services section in which minors and women forced into prostitution are advertised. Backpage.com is considered the leading online marketplace for commercial sex and operates in 97 countries. At one point, Backpage.com was involved in 73% of all child trafficking reports that the National Center for Missing and Exploited Children receives from the general public. Despite several lawsuits, Backpage.com has not yet been held liable criminally or civilly and the online website asserts it has immunity under Section 230 of the Communications Decency Act.
At the hearing, members will examine court interpretations about the breadth of the Communications Decency Act and its effect on online sex trafficking, as well as potential consequences of amending Section 230.
Witnesses for the hearing are:
The Honorable Chris Cox, President, Morgan Lewis Consulting
Mr. Jeff Kosseff, Assistant Professor, United States Naval Academy
Ms. Mary G. Leary, Professor of Law, Catholic University Columbus School of Law
Mr. Evan Engstrom, Executive Director, Engine
House Judiciary Committee Chairman Bob Goodlatte (R-Va.) and Crime, Terrorism, Homeland Security, and Investigations Subcommittee Chairman Jim Sensenbrenner (R-Wis.) issued the statements below in advance of this hearing.

Judge Napolitano says Trump should veto FISA bill: Nothing but 'cosmetic' reforms
Fox News senior judicial analyst Judge Andrew Napolitano had a message for President Trump on Thursday "Fox & Friends": Veto the Foreign Intelligence Surveillance Act (FISA) renewal bill that the House passed on Wednesday with broad bipartisan support.
The legislation reauthorizes FBI crime-fighting tools that were set to expire on Sunday and reforms the secret FISA court process that has been under the microscope in the Russia probe.
"I want the president to veto this because the president knows he has been victimized by this culture which allows suspicionless warrants on no basis whatsoever," Napolitano said.
"Mr. President, if you are watching, tell them this is not good enough and it violates the Constitution and that you have been victimized by it," he continued, speaking directly to President Trump.
USA Freedom Reauthorization Act – passed by a 278-136 vote – brought together the staunchest President Trump supporters like Reps. Devin Nunes, R-Calif., and Jim Jordan, R-Ohio, and some of his fiercest critics like Reps. Jerrold Nadler, D-N.Y., and Adam Schiff, D-Calif., who wanted improvements to protect Americans' privacy and safeguard against surveillance abuses.
The bill includes enhanced congressional oversight of the FISA process, penalties for those who abuse the Foreign Intelligence Surveillance Court (FISC) process for political purposes, and the requirement to have transcripts of court proceedings.
"The only changes in this new bill are cosmetic, some secret reporting requirements to the attorney general," Napolitano said, adding that "the same thing will happen again."
Rep. Jim Sensenbrenner, R-Wis., however, said, "This legislation places much-needed safeguards to prevent another Carter Page-type scandal from happening again."
Page, a former Trump campaign adviser, blasted the legislation as a "sham" and a Republican "failure," saying it represents a "lazy authorization" of the surveillance tool that improperly targeted him during the FBI's Russia investigation.
"He's absolutely right. It doesn't dial back any of the authorities," Napolitano said of Page's criticism.
He added that he doesn't know why some Republicans are on board with this legislation.
At issue were three surveillance provisions that are set to expire Sunday, including one that permits the FBI to obtain our orders to collect business records on subjects in national security investigations. Another, known as the "roving wiretap" provision, permits surveillance on subjects even after they've changed phones, and to monitor subjects who don't have ties to international terrorist organizations.
The bill seeks to rein in a controversial portion of the surveillance powers, known as Section 215, which gives the government broad powers to demand "business records" from companies in the name of national security investigations. In an effort to better protect privacy, the legislation would prohibit using Section 215 to acquire information that would otherwise require a warrant and would ban obtaining GPS and cell site locations, Rep. Jerrold Nadler, D-N.Y., said.
"The statute that expires Saturday night is the one that allows judges to issue what are called 'general warrants,'" Napolitano explained. "A general warrant is not based on probable cause or suspicion and it doesn't identify the person or thing to be seized or to be surveilled."
"For example, we need a warrant to listen to all the phone calls in a given area code or a given zip code," he continued. "One of these warrants was for all the customers of Verizon, all 113 million of them. That absolutely defies the Constitution and it creates the culture in the FBI and the intelligence community that caused all the problems that the president had."
