The hits keep coming: Apotex loses 31 drug approvals after FDA cites plants for 'inadequate' controls
Jul 10, 2019
t's been a troubled few years for Canadian generics maker Apotex after the unsolved murder of founder Barry Sherman and a possible sale in the works. Now, after multiple warnings from the FDA, Apotex faces a future without approvals for a big slice of its portfolio.
The FDA approved the voluntary withdrawal of 31 of Apotex's generic drug nods Wednesday after the agency identified manufacturing deficiencies at two of the drugmaker's India-based plants. The list of drugs that lost their FDA blessing includes the common blood pressure drugs valsartan and losartan, the antibiotic azithromycin and copycat Viagra.
Apotex noted that it voluntarily withdrew the Abbreviated New Drug Applications (ANDAs) for the 31 drugs back in late 2017. The FDA's decision Wednesday formalized that withdrawal.
The FDA' decision follows a warning letter issued in late 2018, Apotex's third in four years, which cited a lack of accuracy and integrity in the site's data production. The drugs on the list were approved by the FDA between 2007 and 2014.
"FDA has previously communicated about the need for appropriate and global quality oversight to Apotex senior management during several regulatory meetings," the agency said in its warning letter (PDF) in August. "These repeated failures at multiple sites demonstrate that management oversight and control over the manufacture of drugs is inadequate."
Apotex valsartan and losartan products were among those pulled off the market in Australia and Canada amid the global recall of drugs in that class. Potential cancer-causing impurities were found in active ingredients used by multiple drugmakers around the world.
[RELATED: Apotex plant in India hit with third warning letter in 4 years]
The FDA hit is just the latest in a series of troubling events at Apotex since the still-unsolved murder of Barry Sherman and his wife, Honey, at their suburban Toronto home in December 2017.
Almost immediately after the Shermans' death, Apotex CEO Jeremy Desai announced he would step down. A Teva lawsuit had accused Desai of accepting the Israeli drugmaker's trade secrets from his girlfriend. Apotex vice chairman and former CEO Jack Kay replaced Desai and the company promoted global generics president Jeff Watson to president and chief operating officer.
Despite resigning, Desai denied the allegations against him and filed a countersuit in March 2018. Teva and Desai settled the lawsuits in April 2018, and Desai now serves as president and CEO of Mandara Pharma, a cannabis-based research company.

With the company in turmoil, the Sherman family appointed a financial advisor in April to weigh options to sell the company, which could have been worth $3 billion at the time, according to Bloomberg.
In 2018, Apotex sold its businesses in five European countries to Aurobindo for ?74 million ($83 million) to focus on sales in the Americas.
Editor's Note: This story has been updated to clarify the FDA's decision Wednesday. The FDA approved the voluntary withdrawal of 31 of Apotex's Abbreviated New Drug Applications. Apotex voluntarily withdrew those applications in late 2017.

Canadian pharmaceutical billionaire couple was murdered
TORONTO (Reuters) - Canadian pharmaceutical billionaire couple Barry and Honey Sherman were murdered in a targeted killing, Toronto police investigators said on Friday in their first detailed comments on the case since the couple's bodies were found on Dec. 15.
Police said they are treating the case as a double murder, but declined to say if they had any suspects.
The Shermans were found hanging by belts from a railing next to a swimming pool at their Toronto mansion, police said.
Toronto homicide detective Susan Gomes said at a press conference that authorities believed the Shermans were targeted, but did not elaborate.
Police have "an extensive list of people we're looking forward to speaking to," she said.
The Sherman family said in a statement that it had expected police would classify the deaths as homicides.
The family hired a private investigator in late December and conducted an independent autopsy after complaining that police mishandled the case in its early days.
Citing unnamed police sources, multiple news organizations had reported last month that investigators were operating on the working theory that the deaths were a murder-suicide.
Gomes said those reports were wrong and that investigators initially reviewed three possibilities: double suicide, murder suicide and double homicide.
Sherman was 75 and his wife was 70. Their deaths stunned the worlds of Canadian business, politics and philanthropy, and drew public condolences from prominent figures including Canadian Prime Minister Justin Trudeau, who attended a memorial service on Dec. 21 that was broadcast on television.
Barry Sherman founded Apotex Inc in 1974 and built it into a pharmaceutical giant before stepping down as chief executive in 2012. He and his wife were known for their donations to hospitals, universities and Jewish organizations.
Separately, Apotex said on Friday that its Chief Executive Jeremy Desai had resigned and would be replaced by his predecessor and company co-founder Jack Kay.
Apotex is in a legal dispute with Teva Pharmaceuticals Industries (TEVA.TA) (TEVA.N), the world's biggest maker of generic drugs, over allegations that a former Teva executive shared trade secrets with Desai.

Does anyone remember Barry Sherman of Apotex and his wife Honey? They were murdered back in 2017.
"Billionaire Apotex founder Barry Sherman and wife found dead in Toronto home" December 15, 2017
https://www.theglobeandmail.com/amp/news/toronto/two-found-dead-at-home-of-billionaire-apotex-founder-barry-sherman/article37348222/
The anons looked rather closely at that event. It seems to me that what happened then is relevant to what is happening now.
The had just put their house on the market when the murder happened. Something must have spooked them. But their influence was wide. I doubt they could have gotten away from whoever was after them. Seems he may have suspected that his number was up.
"Barry Sherman"
https://en.wikipedia.org/wiki/Barry_Sherman
"Sherman himself acknowledged the long-running conflict between Apotex and the major pharmaceutical companies over drug patents, saying 'The branded drug companies hate us. They have private investigators on us all the time. The thought once came to my mind: why didn't they just hire someone to knock me off?'"
Seems that scandal surrounded him.

Seems he was involved in the nutraceutical business as well, which must have further pissed off the pharmaceutical companies.
"Bernard Sherman Success Story"
https://successstory.com/people/bernard-c-sherman
Back in 2007, he was involved in a scandal relating to a threat to produce generic Plavix. Apparently, the guy was a bit of a hot head with a history of stepping on people's toes. But this would have been too early, being 10 years before the murder.

The image part of my archive is broken at present. But there are notes from posts saying that the Shermans had a connection to HRC that related to Haiti. So the murder was not related to the hydroxychloroquine, most likely. But interesting that hydroxychloroquine leads us back to HRC and Haiti.
"Generic drugs billionaire with Clinton Foundation links and his wife found strangled in their home"
https://www.michaelsmithnews.com/2017/12/generic-drugs-billionaire-with-clinton-foundation-links-and-his-wife-found-strangled-in-their-home.html
The new CEO resigned immediately. He had received trade secrets from his mistress. This might be related to the deaths.
"Jeremy Desai resigns as CEO of Apotex, the drug company founded by Barry Sherman"
https://www.cbc.ca/news/business/apotex-ceo-Jeremy-Desai-1.4505624
"Desai's resignation comes as he faces allegations in a U.S. lawsuit from Teva Pharmaceutical Industries Ltd. for allegedly accepting trade secrets from a Teva employee that he was thought to be in a romantic relationship with."
The murderers may have spooked him, too. He's on the board's resignations list.
There are also some notes in posts about a scandal surrounding tainted blood or expired or tainted HIV drugs, also related to the Clinton Foundation.
Apparently, according to a post, there was an Abel Danger show done in February 2018 in which it was mentioned that the murder had been filmed. The make of the camera was known. The motivation was to warn CEOs to not interfere with the lucrative patent medicine business.
Notice also that Dr. Fauci kept trying to steer away from hydroxychloroquine. They are favoring a newer patented ebola drug, remdesivir, that is estimated will cost something like $900 to $1000 per course. This is perhaps a hundred of times more than the hydroxychloroquinone would cost, if not more.
https://www.biopharmadive.com/news/coronavirus-remdesivir-gilead-antiviral-drug-covid-19/573261/
So the question becomes: Is Dr. Fauci motivated by investment or is he being pressured to favor patentable drugs?
