Convicted Child Molester Let Out Of Prison Because They're Transgender, No Longer A Threat, Government Says
A convicted sex offender is being let out of prison in Iowa because they identify as a woman and the Iowa Attorney General's Office says that the transgender criminal is no longer a threat because they have different hormones.
The Storm Lake Times reported that Joseph Matthew Smith, a 23-year-old convicted of molesting a fellow MCS student in 2014, also molested up to 15 kids, according to a report prepared by the state.
"A preliminary report prepared by the state's expert, Dr. Jeffrey Davis, says Smith molested as many as 15 victims, ranging from ages 1 to 13, before being sentenced to prison in December 2015," The Storm Lake Times reported. "The report found the likelihood of re-offending within five years of release exceeded 20% because victims were of both genders, and because Smith was under age 25 and never had a long-term relationship."
"Mr. Smith has not had an intimate relationship," the government report stated. "His sexual encounters appear to have primarily involved molestation, including his own molestation by multiple perpetrators, or his victimization of others."
"The Iowa Sex Offender Registry shows Smith was convicted of 2nd degree sexual abuse against a female victim in 2012, and lascivious acts with a child against a male victim in 2014," The Blaze reported. "The registry does not give the victim's ages; they are listed as children under the age of 13."
Smith received transgender treatment for the last two years at Newton Correctional Facility and started using female pronouns.
"We don't believe we have evidence sufficient to prove Josie Smith has a significant chance of reoffending," Iowa AG spokesman Lynn Hicks said. "Josie Smith will be subject to strict sex-offender reporting required of those who commit the crimes [they] did. [They'll] be subject to supervision for the rest of [their] life."
"The report recommended Smith be confined at the Cherokee Civil Commitment Unit for Sex Offenders (CCUSO) in Cherokee for an indefinite period," The Storm Lake Times added. "But it was premised upon Smith having the sex drive of a man."

Straight from the desk of WTF, Iowa man convicted of being a serial child molester is freed from prison because he now says he is a woman
You want to see just how screwed up our world has become? Look no further than this story from corn country, Iowa, where a felon, convicted of no less than 15 sexual assaults against children aged 1 to 13, has turned justice on its head by declaring that he is now a woman. That is all the prosecutors and court had to hear. He/she/it/they are now a free man/woman/thing.
The message we are hearing from the courts is clear: "Man bad, woman good."
So, I guess the surest route to world peace is the castration of all males at birth. Utopia is so complicated.
According to the Des Moines Register, the Iowa Attorney General's Office is no longer seeking the commitment of a former Midwest Christian Services student convicted of myriad sex crimes because the individual now identifies as a woman.
Court records show the state dismissed the application on Jan. 9. Attorney general spokesman Lynn Hicks wouldn't comment on the reason for the dismissal other than to say "an offender's hormone levels are an important part of substantiating an offender's likelihood of recidivism."
In November, the Storm Lake Times reported that Joseph Matthew Smith, a 23-year-old convicted of molesting a fellow MCS student in 2014, was "undergoing medical treatment that is needed prior to (Smith) potentially undergoing gender reassignment surgery."
Smith has received treatment for gender reassignment over the past two years at Newton Correctional Facility. She first expressed a desire to "get started on transgender classification" in October 2017 and started using female pronouns.
Smith has expressed a preference to identify as Josie, according to court documents.
"We don't believe we have evidence sufficient to prove Josie Smith has a significant chance of reoffending," Hicks said late last week.
An Iowa Department of Corrections spokesman said Smith was transferred on Saturday to the Sioux City Residential Treatment Facility for transitional release. He did not say when Smith will be released.
Hicks cautioned the public not to overreact to Smith's upcoming release. Smith will be subject to sex-offender registration requirements for the rest of her life, Hicks said, which includes regular meetings with a probation officer and a listing on an attorney general clearinghouse.
"Josie Smith will be subject to strict sex-offender reporting required of those who commit the crimes she did," Hicks said. "She'll be subject to supervision for the rest of her life."
Hicks said the attorney general's office has never encountered a case exactly like Smith's.
A preliminary report prepared by the state's expert, Dr. Jeffrey Davis, says Smith molested as many as 15 victims, ranging from ages 1 to 13, before being sentenced to prison in December 2015.
The report found the likelihood of re-offending within five years of release exceeded 20% because victims were of both genders, and because Smith was under age 25 and never had a long-term relationship.
"Mr. Smith has not had an intimate relationship," the report says. "His sexual encounters appear to have primarily involved molestation, including his own molestation by multiple perpetrators, or his victimization of others."
The report says Smith was molested repeatedly as a child in Louisiana, starting at age 7.
The report recommended Smith be confined at the Cherokee Civil Commitment Unit for Sex Offenders (CCUSO) in Cherokee for an indefinite period. But it was premised upon Smith having the sex drive of a man.
Dr. Tracy Thomas, a forensic psychologist and former clinical director of CCUSO, said the statute that outlines civil commitment requires the state to "essentially prove an offender has a chance offending greater than 51% for the rest of his life." That becomes harder to prove when an offender significantly lowers his testosterone levels, which has a significantly higher impact on sex drive than estrogen.
Thomas said there are no women confined at CCUSO.
"From an evaluator's standpoint, our recommendation is based on whether someone is more than likely to re-offend," Thomas said on Monday. "Between 5% and 15% of sex offenders re-offend, so it takes an extraordinarily high burden to prove someone has a 51% chance."

Moar in Goodwin Gaw: current owner of The Standard hotels.
https://nypost.com/2017/08/08/hong-kong-investor-buys-standard-hotel-for-a-discount/
The High Line-straddling Standard Hotel has found a surprise potential buyer, sources tell The Post: Hong Kong-based wheeler-dealer Goodwin Gaw.
Of perhaps greater interest to the city's potentially oversaturated hotel market, the purchase price is likely 15 percent less than what the Standard was in contract to sell for in 2014 - although the deal never closed.
Sources said that a fund controlled by Gaw Capital Partners - which is run by Goodwin, 48, and his brother and sister - is in advanced talks to pay $340 million for the marquee property.
Although Gaw has been called the "poster boy for fronting Asian capital to Western markets and Western capital to Asia," he's no money-shuffler.
Gaw Capital owns properties valued at $8 billion around the globe. Its American affiliate, Gaw Capital Partners USA, has more than $2.7 billion in gross assets under management - including Los Angeles' fabled Hollywood Roosevelt Hotel. One of Gaw's investment funds recently bought the Marriott City Center in Oakland, Calif.
But in an intriguing twist, if the deal for the Standard goes through, the seller won't be the company that's been widely - but incorrectly - reported as its current owner.
Standard International, the management company for Standard-branded inns, was reported to be in contract to buy the hotel for $400 million from Dune Capital Management and Greenfield Partners in early 2014.
However, it turns out that the deal was never completed - despite news reports as recent as two months ago that claimed Standard International had bought the hotel from Dune and Greenfield.
The alleged purchase was "incorrect information," Standard International marketing and communications VP Corey Tuttle told us by email. "The original owners still own the property," he confirmed.
Tuttle had "no comment at this time" regarding Gaw's potential purchase. He didn't provide contact information for André Balazs, the visionary hotelier who founded the Standard brand and still owns 20 percent of Standard International.
JLL's Jeffrey Davis, who's marketing the Standard with his firm's Gilda Perez-Alvarado, responded to our questions with a "no comment." Goodwin Gaw didn't respond to an email.
Why would the Standard sell for $60 million less than it was valued three years ago?
Three different hotel industry analysts told us all of its vital numbers - revenue per available room, occupancy rate, and food-and-beverage revenue - were "down significantly" since early 2014 due to greater competition from new supply and Airbnb.
The authoritative STR hotel marketing survey reported that nearly 16,000 new rooms will soon come on line in the city on top of the Big Apple's existing all-time high of 115,145 rooms.
Competition's especially fierce in the hip and trendy, party-central class of hotels that includes The Standard. It made news back in 2009, when guests were spotted having sex in the windows over the High Line - but this summer, the amorous window action shifted to Ian Schrager 's new Public Hotel on Chrystie Street.
Cushman & Wakefield hotel sale specialist Tom McConnell, who's not involved at the Standard, said that a price cut from $400 million to $340 million for it would be "similar to the diminution in values that we've seen around the city."
He said the Standard was particularly vulnerable to competition on the food-and-beverage front. "The Standard is like a big restaurant complex with venues at the top and on the bottom, with hotel rooms sandwiched in between. I'd venture to say that it does more food and beverage income as a percentage of revenue than any other hotel in town," McConnell said.

HONG KONG & The Standard Hotel: Goodwin Gaw
Hong Kong investor poised to land $170M loan for Standard Hotel buy
By Mark Maurer | September 29, 2017 06:44PM
Gaw Capital Partners is obtaining a $170 million loan from Natixis to make one of the largest single-asset New York City hotel deals of the year: the $340 million purchase of the Standard Hotel.
Natixis, the French bank, is set to provide a 10-year acquisition loan and is shopping the B-note on the four-star hotel, sources said. The loan would comprise exactly half of the purchase price.
Goodwin Gaw, who runs the Hong Kong private equity fund Gaw Capital, was in late-stage talks in August to buy the 18-story, 338-room hotel at 848 Washington Street. Sources said Gaw has since entered contract.
The $340 million price is notably a step down from the $400 million the hotel management company Standard International was in contract to pay to sellers Dune Capital Management and Greenfield Partners in 2014. That deal didn't go through.
The owners put the property on the market in May with a JLL team led by Jeffrey Davis and Gilda Perez-Alvarado.
"New York's hospitality sector is a little out of favor at the moment," Gaw told Forbes this week.
The 219,000-square-foot hotel, which opened in 2009, has a substantial food-and-beverage component. It's home to the Standard Grill, Le Bain, Top of the Standard and the Standard Biergarten.
Neither Gaw nor Natixis could be reached for comment.
Earlier this year, Natixis provided $350 million in financing for Ivanhoe Cambridge's purchase of 85 Broad Street85 Broad Street and $250 million in CMBS debt for JEMB Realty's 75 Broad Street75 Broad Street. The bank also was one of the lenders on Extell Development's $500 million construction loan for One Manhattan Square.
