Another child accuses Loudonville rabbi of sexual abuse (October 7, 2008). ALBANY - Another child has accused a local rabbi of sexual abuse, city police said today. Police spokesman Det. James Miller said the 13-year-old boy was identified as another alleged victim of Rabbi Yaakov Weiss, 28, of Loudonville, during the initial investigation of a referral from the New York State Child Protection Agency. Weiss, rabbi at Chabad of Colonie and founder of the Chabad Hebrew School, was charged Sept. 29 with several counts of sexual abuse and endangering the welfare of a child for alleged incidents involving another 13-year-old boy as a result of the initial referral. The latest allegations involve an alleged incident that occurred in June on Whitehall Road, Miller said. Weiss was charged with second-degree sexual abuse and endangering the welfare of a child this afternoon in response to that allegation and was arraigned in City Criminal Court.

"To protect myself, my family, and reputation, I decided to withdraw from this project," he wrote in an e-mail as the paper was going to press with a story announcing Hikind's formation of the task force. "From this point, I am avoiding participation in any forms of public service. Public life is not for me."
Hikind, a Brooklyn Democrat who represents Borough Park and Flatbush, deplored Twerski's abrupt departure from his new panel. "He was basically forced to resign," said Hikind. "He was literally put against the wall, and he felt he had no choice. We'll get somebody else who's very respected. But that's not the point. The point is they got to him, they threatened him." But he added: "Anything that contributes to apprehending the bad guy and helping the victims, we need to do - period, end of the story. That's my position. I have a new perspective because I've taken a close look, because I've spent almost four weeks now listening non-stop to horror stories, and then I'm told by people today who met with me, 'Dov, it's worse than even you think right now.' I said, 'what?'"

District Attorney Dan Dow announced today that Operation Reclaim and Rebuild was a success in San Luis Obispo County between February 6 and February 12, 2022. San Luis Obispo County's Anti-Human Trafficking Task Force enforcement effort resulted in disrupting criminal trafficking networks with the arrest of nine individuals in San Luis Obispo County over three days of enforcement operations.
This year marked the fourth year that the San Luis Obispo County Anti-Human Trafficking Task Force has participated in the annual Operation Reclaim and Rebuild led by the Los Angeles Regional Human Trafficking Task Force. The statewide operation included more than 80 participating federal, state, and local law enforcement agencies, and task forces from across California focused on combatting human trafficking in southern California.
San Luis Obispo County's effort resulted in the following arrests and prosecutions:

A trustee for the Cajon Valley Unified School District claims the district's superintendent and other board members retaliated against her for voicing concerns about frequent travel and alleged misspending of district funds.
Board member Jilane Barto's claims are detailed in a federal lawsuit filed against Cajon Valley Unified superintendent David Miyashiro and four school board members: James Miller, Jo Alegria, Tamara Otero, and Karen Clark-Mejia.
Barto claims she was targeted when she first questioned Miyashiro's use of district funds and the superintendent's travel at district expense.
According to her lawsuit, "[Barto] raised issues about how much money District Superintendent Miyashiro has spent on his travel and conference costs, and raised questions about the size and nature of expenditures from his discretionary funds."
Public records obtained by NBC 7 Investigates confirm district staff took frequent trips at district expense, and Miyashiro had attended conferences and "Ted Talks" in Vancouver, Chicago,Beijing, O'ahu, London, as well as Tallahassee, Florida.
The data reveals district staff has spent $1.1 million dollars on trips and conferences since March 2017. According to the California Department of Education, Cajon Valley Unified is the tenth-largest in San Diego County with 17,468 students. Miyashiro's $295,596 salary makes him the second-highest-paid superintendent in San Diego County.

California's Assault Weapons Ban Violates Second Amendment: Judge

California's ban on so-called assault weapons violates the Second Amendment, a federal judge ruled Friday.
The government through the law "bans an entire class of very popular hardware-firearms that are lawful under federal law and under the laws of most states and that are commonly held by law-abiding citizens for lawful purposes," U.S. District Judge Roger Benitez, a George W. Bush nominee, wrote in his 94-page ruling in Miller et al. v Bonta et al.
"Under no level of heightened scrutiny can the law survive," he added.
California laws prohibit the manufacture, use, or sale of an "assault weapon," defined as a semiautomatic rifle with certain characteristics such as a fixed magazine that has the capacity to hold more than 10 rounds. People who violate the laws face a felony or a misdemeanor and could land prison sentences of up to eight years.
James Miller, a California resident who has a concealed carry permit, sued the state's top law enforcement official in 2019 over the laws, alleging they violate his Second Amendment rights.
"Plaintiff Miller seeks to use his lawfully acquired large-capacity magazine(s) in his California-compliant, 'fixed magazine rifle.' However, Plaintiff Miller is prevented from lawfully doing so without risk of persecution resulting in injury to his life and liberty; and the unlawful confiscation and loss of his personal property because said use would reclassify his rifle as a prohibited 'assault weapon,'" the lawsuit stated.
Xaiver Becerra, the attorney general at the time-he has since become President Joe Biden's health secretary, and been replaced by Rob Bonta-argued that plaintiffs lacked standing and that all federal circuit courts had previously upheld the constitutionality of assault weapon restrictions like the laws in question.
But Benitez said the Supreme Court recognizes "that the Second Amendment guarantee includes a right to keep and bear firearms that have 'some reasonable relationship to the preservation or efficiency of a well-regulated militia,'" quoting from Miller's filing.
He referenced the Supreme Court's ruling in District of Columbia v. Heller, which broadly found that the Constitution protects Americans' rights to own guns.
"The Heller test asks: is a modern rifle commonly owned by law-abiding citizens for a lawful purpose? For the AR-15 type rifle the answer is 'yes.' The overwhelming majority of citizens who own and keep the popular AR-15 rifle and its many variants do so for lawful purposes, including self-defense at home. Under Heller, that is all that is needed. Using the easy to understand Heller test, it is obvious that the California assault weapon ban is unconstitutional. Under the Heller test, judicial review can end right here," Benitez wrote.
The Firearms Policy Coalition (FPC), a nonprofit that advocates for constitutional rights, said the ruling was the correct one.
"In his order today, Judge Benitez held what millions of Americans already know to be true: Bans on so-called 'assault weapons' are unconstitutional and cannot stand," said Brandon Combs the president of the group, in a statement. "This historic victory for individual liberty is just the beginning, and FPC will continue to aggressively challenge these laws throughout the United States. We look forward to continuing this challenge at the Ninth Circuit and, should it be necessary, the Supreme Court."
But others disagreed.
"Overturning CA's assault weapon ban and comparing an AR-15 to a SWISS ARMY KNIFE is a disgusting slap in the face to those who have lost loved ones to gun violence," California Gov. Gavin Newsom, a Democrat, said late Friday. "This is a direct threat to public safety and innocent Californians. We won't stand for it."
"Today's decision is fundamentally flawed, and we will be appealing it. There is no sound basis in law, fact, or common sense for equating assault rifles with swiss army knives," Bonta added.

On the evening on June 2, James Miller, an official on the Defense Science Board and a former under secretary of defense for policy, issued a public letter of resignation to Secretary of Defense Mark Esper, according to the Washington Post. In the letter, Miller accused Esper of violating his oath of office to "support and defend the Constitution of the United States ... and to bear true faith and allegiance to the same."
Specifically, Miller claimed that "[l]aw-abiding protesters just outside the White House were dispersed using tear gas and rubber bullets - not for the sake of safety, but to clear a path for a presidential photo op," which Esper attended. The incident outside of St. John's Episcopal Church and the following statement from President Donald Trump received widespread condemnation after footage revealed that police dispersed the crowd using tear gas and rubber bullets.

A Department of Defence adviser resigned, effective immediately, from the military's science board citing what he believed to be a violation of conduct from Defence Secretary Mark Esper.
In his resignation letter, James Miller Jr., the former under secretary of defence for policy from 2012 to 2014, recalled that he swore an oath of office to "support and defend the Constitution of the United States ... and to bear true faith and allegiance to the same," similar to what the defence secretary had done before he took office.
"On Monday, June 1, 2020, I believe that you violated that oath," Miller wrote in his letter to Esper, which was obtained by The Washington Post.
Miller's reasoning centered around President Donald Trump's controversial visit to St. John's Episcopal Church in Washington, DC, on Monday, where he posed with a Bible for photographs as protesters in the surrounding area were hit with smoke canisters and pepper balls at the event, according to the United States Park Police.
The trip was widely condemned by religious leaders, including Washington Archbishop Wilton Gregory, who called it "baffling and reprehensible."
Esper, along with US Army Gen. Mark Milley, the chairman of the Joint Chiefs of Staff, was also present during the visit.
"Law-abiding protesters just outside the White House were dispersed using tear gas and rubber bullets - not for the sake of safety, but to clear a path for a presidential photo op," Miller wrote. "You then accompanied President Trump in walking from the White House to St. John's Episcopal Church for that photo."

An enormous black hole sitting some 8,000 light years from Earth has such a powerful gravitational pull that as it moves it's literally dragging nearby space along with it, according to new research.
Black hole V404 Cygni, an incredible nine times bigger than the sun, is drawing in material from a companion star. As the material streams toward the black hole, it forms a rotating disk around it about 10 million kilometers wide.
Researchers from the International Center for Radio Astronomy Research (ICRAR) found jets of fast-moving material shooting from this surrounding disk are "wobbling so fast that their change in direction can be seen in periods as short as minutes."
We were gobsmacked by what we saw in this system - it was completely unexpected," said Greg Sivakoff, an East Asian Observatory Fellow involved in the research.
This strange wobble phenomenon is, according to the team, evidence of one of the effects of Einstein's general theory of relativity, which states that enormous objects like black holes can distort space and time, but the speed of it in this case is striking.
"We've never seen this effect happening on such short timescales,"said James Miller-Jones, who led the ICRAR team.
The material is moving so fast, in fact, the astronomers said it's zooming at a phenomenal 60 percent of the speed of light.
The black hole's orbit is misaligned from that of its companion star, meaning that as the hole pulls on space and time nearby it warps the inner part of its surrounding disk. This distorted or warped portion is then in turn pulled around with the spinning black hole, which creates the wobbling effect observed by the researchers.
"You can think of it like the wobble of a spinning top as it slows down, only in this case, the wobble is caused by Einstein's general theory of relativity," Miller-Jones explained.

With Packet-Radio, two modulation methods are common: FSK and AFSK.
AFSK (Audio Frequency Shift Keying) with 1200 baud (bit/s)
a audio tone is shifted in frequency, e.g. from 1200 to 2200 Hz and transmitted with a standard FM-radio. Advantage: very simple connection by using the microphone and speaker connector of every radio. Disadvantage: the data rate is lower as the channel capability.
FSK (Frequency Shift Keying) with 9600 baud (bit/s) or faster
The frequency of the RF carrier is directly shifted. This requires a direct access to the modulator of the FM-radio transmitter. The receiver signal has to be tapped directly at the demodulator / FM-discriminator. Some radios with too narrow IF-filters need to be modified before use with FSK. Advantage: much higher transmission rate compared to AFSK. 9600 baud data rate is the maximum reasonable speed which can be used with a standard FM radio channel.
Different Baudrates
300 Baud AFSK / FSK, Packet-Radio on short wave
With Packet-Radio on short wave (HF), 300 baud FSK is common. The simplest way is to modulate a SSB-transmitter with a AFSK signal with 200 Hz shift. Which frequencies are actually used makes no difference if the difference is 200 Hz. Packet-Radio does not distinguish between 'Mark' and 'Space', i.e. it makes no difference if the frequencies are swapped.
1200 Baud AFSK, the standard on VHF and UHF
The transmission speed with Packet-Radio is normally 1200 baud = 1200 bit/sec., this means approx. 150 characters per second. The mode is AFSK, that means one of two audio tones is applied to the microphone input of a common FM radio. Amateur radio uses normally the Bell 202 standard with tone frequencies 1200 and 2200 Hz. Just make a suited cable between radio and packet-radio-controller, which connects the signals 'mikrophone', 'loudspeaker', 'PTT' and ground.
1200 baud technique is widespread ad is used with most digipeaters. For data transmission with CB-radios (FM), 1200 baud AFSK is the optimum.
9600 baud G3RUH FSK, growing mode for fast Packet-Radio
As data traffic constantly grows, more and more nodes move to faster transmission on the user access frequencies. New digipeaters skip the slow 1200 baud mode and use 9600 from beginning. In Germany (2000), 50% of the user access frequencies use 9600 baud, i.e. 80% of the total data uses the 8-fold speed.
The FSK modulation standard was defined by James Miller, G3RUH. It can be adapted for various radios and gives a maximum yield of speed for a given channel bandwidth.
9600 baud: developed for satellite communication first
19200 Baud G3RUH FSK, somewhat expensive but fast
With this speed, the RF bandwidth is about 50 kHz, this is the double of the normal (20/25kHz) channel spacing. The IF filters of standard transceivers are too narrow to let such wide signasl pass without distortion. So, a user speed of 19200 baud did not succeed. For linking two digipeaters on a dedicated frequency, 19200 is often used (with special transceivers). 19200 baud can be decoded using the 1980's TNC2 concept, but the Z80 processor of these packet radio controllers is at its limits with 19200 baud data rate.
38400 baud, 76800 baud, 153600 baud, 307200 baud G3RUH FSK, for experiments, fast links and satellite download
To connect the nodes of a radio net, high speed is necessary. The new satellites (launched in 2000) use 38400 baud or faster to downlink their picture data. SYMEK offers special equipment for reception and transmission of very high data rates and the matching high-speed packet-radio controllers (TNC3). TNC2 controllers with Z80 microprocessor cannot decode or transmit data so fast. The only radio with data capabilities of over 19200 baud up to 153kbaud is the SYMEK TRX4S.
up to 1 Mbaud, for special high-speed Packet-Radio applications
With special radio transceivers thers speeds can be realised. In most cases, those very high speed links use frequencies above 1,2 GHz. Amateur radio is a playground for experimenters. Since 1998, fullduplex packet radio links with 1,220 kbit/s (1.2 Mbaud) are operative using TNC3S and inexpensive 10 GHz microwave radio links.
For distance they need HF and the bandwidth is very considerably limited.
For local comms 2m FM more bandwidth is available but it's distance limited, no ionospheric propagation.
Like I said before, any commercial use of ham radio is prohibited by the FCC regs.

Turnberry is a small village situated about 16 miles south of Ayr. The lighthouse at Turnberry is built on the spot where there used to be a castle, believed to be where Scotland's most famous king, Robert the Bruce, was born.
The Monument by the Lighthouse, is in honour of British, United States and Australian servicemen that lost their lives while at the Turnberry School of Aerial Gunnery & Fighting during the two World Wars.
The golf course was laid out in 1901 by Troon professional Willie Fernie for Archibald Kennedy (3rd Marquess of Ailsa). The course was soon taken over by the Glasgow and South Western Railway, a company looking to set up the first golf resorts. Turnberry Hotel opened in 1906 as the first golf resort of its kind.
This golf resort is still regarded by many as the finest in Scotland. A light railway between Alloway, Turnberry and Girvan was completed in 1905, with the main purpose of carrying golfers from all over the UK to the resort. The rail line was closed in 1942. The architect James Miller designed the hotel on a plateau overlooking the golf course.

West Australian ban thwarts AUKUS submarines tour

A high-level AUKUS delegation to Australia to help fast-track the nation's nuclear submarines has been forced to postpone a planned visit to Western Australia's HMAS Stirling - home of the Collins-class subs - due to the McGowan government's strict quarantine requirements.
The delegation includes top US and UK officials, including Admiral James Caldwell, director of the US Naval Nuclear Propulsion Program, and UK Defence Nuclear Organisation head Vanessa Nicholls.
The US co-ordinator for AUKUS initiatives, Dr James Miller, is also heading to Australia with the 10-person mission, hosted by the head of Australia's AUKUS nuclear-powered submarine task force, Vice Admiral Jonathan Mead.
The experts will arrive in Australia on Thursday to tour Adelaide's Osborne naval shipyards, and visit Australia's only nuclear reactor at Sydney's Lucas Heights.
They will also stop in Canberra to meet with Admiral Mead's task force, and visit Melbourne for further talks with Defence officials.
The delegation had hoped to inspect Australia's main submarine base at HMAS Stirling in Perth, where the planned nuclear boats would be based.
But Defence was informed its members were unlikely to receive exemptions to enter the state without quarantine, under WA's hard border rules.
The US and UK have vowed to help deliver Australia's planned eight nuclear submarines "at the earliest possible date" under the trilateral AUKUS partnership, after initial forecasts the first would not be in the water until at least 2040.
WA's hard border regime has been notoriously impervious for much of the pandemic.
Until February 5, when the restrictions were partially eased, people trying to return to WA from states to visit dying relatives or attend funerals were barred from entry if they were from a state experiencing a large-scale outbreak.
The rules were changed earlier this month to allow people with family connections or compassionate reasons to travel to WA on the condition they isolate upon arrival. That isolation period for people entering WA from overseas or interstate has since been trimmed from 14 days to seven.
Exemptions to that isolation requirement have proved all but impossible to obtain, although several sporting teams - most recently two AFLW sides from Victoria - have received special authority to enter the state on the provision they instead observe strict biosecurity protocols.
The requirement to isolate upon entry extends to the uppermost reaches of politics. Scott Morrison and Anthony Albanese would both need to isolate for a week if they entered WA under the current rules, and have had to amend their election campaign strategies accordingly.
Even WA Premier Mark McGowan faces the prospect of being caught up in the isolation requirements, given he will have to travel to Sydney later this month to testify in his defamation battle with Clive Palmer. The Premier will be required to isolate for a week upon his return.
Mr McGowan on Tuesday flagged that the end of the border rules may be nearing, telling reporters a new date could be set by the end of this month.
"We are reviewing (the border restrictions) as we speak. We are going to review it over February and no doubt we will reach an announcement some time in February," he said.
"The reality is though that we are getting the third dose vaccination rate up, the eastern states appear to be coming off their peak, which is a good thing. We are getting children vaccinated, and every thing we are doing every single day is saving many West Australian lives."
Admiral Mead's task force has been given 18 months to examine every aspect of the nuclear submarine acquisition, including the planned design, regulatory issues, and how they will be built in Adelaide as promised by the Morrison government.
US Secretary of State Antony Blinken told The Australian last week the US was "focused very intensively on the pathways to the submarines, looking at what the most efficient and effective pathway would be".
"That's being very actively looked at by our experts right now," he said.
