The US Commodity Futures Trading Commission has issued updated guidance for tokenized collateral in derivatives markets, paving the way for a pilot program to test how cryptocurrencies can be used as collateral in derivatives markets.

The CFTC pilot is another step toward integrating crypto into regulated markets, and Circle CEO Heath Tarbert said it will also protect customers, reduce settlement frictions and assist with risk reduction.
Pham said in a statement that the pilot program "establishes clear guardrails to protect customer assets and provides enhanced CFTC monitoring and reporting."
As part of the pilot, participating FCMs will be subject to strict reporting criteria, which require weekly reports on total customer holdings and any significant issues that may affect the use of crypto as collateral.

Federal Report Warns of Financial Havoc From Climate Change
WASHINGTON - A report commissioned by federal regulators overseeing the nation's commodities markets has concluded that climate change threatens U.S. financial markets, as the costs of wildfires, storms, droughts and floods spread through insurance and mortgage markets, pension funds and other financial institutions.
"A world wracked by frequent and devastating shocks from climate change cannot sustain the fundamental conditions supporting our financial system," concluded the report, "Managing Climate Risk in the Financial System," which was requested last year by the Commodity Futures Trading Commission and set for release Wednesday morning.
Those observations are not entirely new, but they carry new weight coming with the imprimatur of the regulator of complex financial instruments like futures, swaps and other derivatives that help fix the price of commodities like corn, oil and wheat. It is the first wide-ranging federal government study focused on the specific impacts of climate change on Wall Street.
Perhaps most notable is that it is being published at all. The Trump administration has suppressed, altered or watered down government science around climate change as it pushes an aggressive agenda of environmental deregulation that it hopes will spur economic growth.
The new report asserts that doing nothing to avert climate change will do the opposite.
"This is the first time a government entity has looked at the impacts of climate change on financial markets in the U.S.," said Robert Litterman, the chairman of the panel that produced the report and a founding partner of Kepos Capital, an investment firm based in New York. "Rather than saying, 'What's the science?' this is saying, 'What's the financial risk?' "
The commodities regulator, which is made up of three Republicans and two Democrats, all of whom were appointed by President Donald Trump, voted unanimously last summer to create an advisory panel drawn from the world of finance and charged with producing a report on the effects of the warming world on financial markets. The initial proposal for the report came from Rostin Behnam, one of the panel's two Democrats, but the report is written by dozens of analysts from investment firms including Morgan Stanley, S&P Global and Vanguard; oil companies BP and ConocoPhillips; and agricultural trader Cargill, as well as academic experts and environmental groups.
It includes recommendations for new corporate regulations and the reversal of at least one Trump administration policy.
"It was shocking when they asked me to do this," Litterman said. "This is members of the entire community involved in financial markets saying with one voice, 'This is a serious problem, and it has to be addressed.'"
A White House spokesman, Judd Deere, declined Tuesday to comment on the report because the White House had not yet seen it.
Douglas Holtz-Eakin, president of the American Action Forum, a conservative research organization, who served as economic adviser to John McCain's 2008 presidential campaign, said: "This was initiated by the Trump administration. It is the only document of its type."
He added, "If you're denying this exists, you don't ask for a report on it."
The Republican chairman of the CFTC, Heath Tarbert, acknowledged the risk of climate change, but he noted that the report also detailed what the regulators called "transition risk" - the financial harm that could befall the fossil fuel industry if the government enacted aggressive policies to curb carbon dioxide pollution.

20 Minutes That Broke the U.S. Oil Market
Frantic sell orders had been pouring in overnight and any traders who connected to the Nymex platform that morning could see a bloodbath was coming. By 7 a.m. in New York, the price on a key futures contract – West Texas Intermediate for May delivery – was already down 28% to $13.07 a barrel.
And then, in a 20-minute span that ranks among the most extraordinary in the history of financial markets, the price cratered to a level that few, if any, thought conceivable. Around the world, Saudi princes and Texan wildcatters and Russian oligarchs looked on with horror as the world's most important commodity closed the trading day at a price of -$37.63. That's what you'd have to pay someone to take a barrel off your hands.
While the deeply negative prices of that Monday were largely limited to the U.S., and in particular the soon-to-expire WTI contract for May delivery, the world felt the shockwaves, with ripple effects dragging global prices to the lowest since the late 1990s. Traders are still piecing together the confluence of factors that led to the collapse. And regulators are scrutinizing the issue, according to people familiar with the matter.
USO, into which investors poured $1.6 billion the previous week, hadn't been holding the May WTI contract on Monday. But the rout sparked a chain reaction in the market that burned these investors, too. By the time Monday April 20 rolled around, most ETFs and other investment products - though not the Crude Oil Treasure fund - had shifted their position out of the May WTI contract into the next month.
The physical settlement for the benchmark WTI takes place at Cushing, Oklahoma. When storage tanks there fill up, the price on the expiring contract can plunge and become disconnected from the global market. With demand evaporating, inventories at Cushing were soaring. In March and April, they climbed 60% to just under 60 million barrels, out of a total working capacity of 76 million -- and analysts reckon much of the remaining space is already earmarked. So on the crucial Monday, the penultimate day of trading in the May WTI contract, there were precious few traders able or willing to take physical delivery.
Much of the market was focused then on the settlement price, determined at 2:30 p.m. in New York. Investment products -- including Bank of China's -- typically seek to achieve the settlement price. That often involves so called trading-at-settlement contracts, which allow oil traders to buy or sell contracts ahead of time for whatever the settlement price happens to be.
No Buyers. On that afternoon, with trading volumes thin and sellers outnumbering buyers, the trading-at-settlement contracts quickly moved to the maximum discount allowed, of 10 cents per barrel. For a period of around an hour, from 1:12 p.m. until 2:17 p.m., trading in these contracts all but dried up. There were no buyers.
The result was the carnage of that afternoon. At 2:08 p.m., WTI turned negative. And then, minutes later, sank to as low as minus $40.32 before rebounding slightly at the close. Within the Commodity Futures Trading Commission, unpacking what occurred during those final minutes of trading on April 20 has since become top priority, according to people familiar with the matter. While reviews and investigations into what occurred are just beginning, thus far, top officials believe the moves were likely the result of a confluence of economic and market factors, rather than the result of market manipulation.
An issue the CFTC is exploring is whether the storage capacity data posted by the U.S. Energy Information Administration accurately reflected the actual availability of space, two of the people said. "The temporarily negative price at which the WTI Crude futures contract traded earlier this week appears to be rooted in fundamental supply and demand challenges alongside the particular features of that futures product," CFTC Chairman Heath Tarbert told Bloomberg News.
Nonetheless, he added: "CFTC is conducting a deep dive to understand why the WTI price moved with the velocity and magnitude observed, and we will continue to oversee our markets' role in facilitating convergence between spot and futures prices at expiration."
The CME, for its part, argues that Monday's plunge was a demonstration of the market working efficiently. "The markets worked exactly how they're supposed to do," CEO Terry Duffy told CNBC

Senate confirms Treasury official to lead derivatives regulator
WASHINGTON (Reuters) - The U.S. Senate voted Wednesday to confirm Heath Tarbert to serve as the next chairman of the Commodity Futures Trading Commission. Tarbert, who previously was a senior official at the Treasury Department, will step in to head the agency overseeing the nation's derivatives market. He will replace Chairman Christopher Giancarlo, whose term at the post expired in April.
He was confirmed by a vote of 84 to 9. At Treasury, Tarbert was the assistant secretary for international markets, and focused on advancing U.S. interests within the international regulatory forums, including the Financial Stability Board.

Citi Hires FinCEN's Blanco as Financial Crimes Compliance Chief
Citigroup Inc. hired Ken Blanco, the director of the Financial Crimes Enforcement Network, as its chief compliance officer of its newly created financial crimes unit. Blanco worked on combating financial crimes and enforcing regulations on money laundering and terrorism financing at FinCEN, a bureau in the Department of Treasury. Before that, he spent 29 years in the U.S. Department of Justice, including serving as Deputy Assistant Attorney General and overseeing the investigation of white-collar fraud.

Blanco will start at Citi in the second quarter, according to an internal memo seen by Bloomberg News. He will step down from FinCEN on April 9. Satisfying regulators and reshaping global operations are among the top challenges faced by Jane Fraser, who became Citi's chief executive officer in March. Last year, the bank was fined by the Office of the Comptroller of the Currency for what the agency called an ongoing "failure to establish effective risk management and data governance programs and internal controls." The bank announced last year that it would create a new Financial Crimes Unit, integrating the anti-money laundering, sanctions and anti-bribery teams.
Blanco's appointment follows a list of recent hires from U.S. regulators by Wall Street. On Thursday, Citadel Securities announced it hired Heath Tarbert, the former chairman of the U.S. Commodity Futures Trading Commission, as its chief legal officer.

Firms May Be Shut Out of Swaps on Libor Issue, CFTC Chief Warns
A significant number of asset managers risk being locked out of the interest-rate swaps market early next year unless they sign on to a new protocol designed to smooth the transition away from Libor, warned the chairman of the U.S. Commodity Futures Trading Commission.
With the London interbank offered rate set to be phased out at the end of 2021, market participants are being encouraged to adopt standardized language by January that will convert Libor-linked contracts to an alternative reference rate once the benchmark expires. While about 400 banks, dealers and other groups have already adopted the new framework, roughly 2,400 parties including numerous money managers with swap exposure tied to Libor have yet to do so, CFTC Chairman Heath Tarbert said in a statement Tuesday.
Swaps are used by corporations and investors to hedge their interest-rate risk as well as speculate on movements in markets. There's about $110 trillion in notional value of dollar-denominated interest-rate swap contracts outstanding, according to data from the Bank for International Settlements. Banks and dealers will likely avoid entering into swap agreements with parties that haven't adopted the protocol by early next year because they wouldn't be able to hedge their Libor exposure, Tarbert said.
The protocol, developed by the International Swaps and Derivatives Association, was unveiled last month and has been touted as a key means of preventing a cliff-edge scenario when the benchmark expires at the end of next year.
Most of the world's largest banks, including Barclays Plc, Credit Suisse Group AG, Goldman Sachs Group Inc. and JPMorgan Chase & Co. were early adopters.
But "unless both counterparties to a swap have adopted the protocol, that swap cannot fallback to a non-Libor rate," Tarbert said.
The Alternative Reference Rates Committee, convened by the Federal Reserve to guide the Libor transition in the U.S., has urged firms to comply. "The ISDA protocol is a perfect example of an area where market participants can solve this problem on their own," Tom Wipf, vice chairman of institutional securities at Morgan Stanley and chairman of the ARRC, said in an emailed statement. "We don't need to wait for legislation to solve the problems with derivatives contracts, we can all solve them by adhering to the protocol."

The Commodity Futures Trading Commission review, which could be released as soon as next week, will chronicle the day's unusual market dynamics and its trading flows, said the people. Yet it won't draw a firm conclusion for what caused oil to plunge to -$37 a barrel – the first time it ever traded at a negative price.
The document the product of a lengthy analysis by economists and market-oversight officials isn't binding, so it won't prevent a CFTC chief appointed by President-elect Joe Biden from pursuing tougher rules. Plus, a key factor that might influence future policy decisions wasn't incorporated into the report: an ongoing investigation by the CFTC's enforcement division into whether manipulative or reckless trading contributed to crude's nosedive.
Pressure has been mounting on the CFTC to get to the bottom of what triggered the unprecedented plunge in West Texas Intermediate futures – the world's most-widely traded oil instrument. While prices bounced back a few hours later, retail investors, brokers and oil-producing nations were all among the day's losers. CFTC Chairman Heath Tarbert, a Republican picked by President Donald Trump, has said the agency is conducting a "deep dive" into what happened. A CFTC spokeswoman declined to comment. The report will focus heavily on macroeconomic factors such as the impact that the coronavirus pandemic had on demand for oil, said the people who asked not to be named in discussing a document that isn't yet public. It will also reference the lack of storage space in Cushing, Oklahoma, where holders of expiring WTI contracts are obligated to take physical delivery of crude, the people said.
In addition to not proposing oil-market structural reforms, the report refrains from suggesting revisions to specific contracts, the people said. The document, which still could change before it's published, also won't name specific firms or traders. Since WTI's historic plunge, market participants themselves have made changes. Many clearinghouses now limit how much of the nearest contract exchange-traded funds and passive oil funds can accumulate and models have been adjusted to account for negative prices. Meanwhile, a glut in crude that contributed to the price decline has receded and demand has bounced back with an uptick in economic activity.
Within the CFTC, the report has been the subject of fierce debate, with some officials arguing that its publication should be delayed until the agency finishes its examination into whether misconduct contributed to oil's crash. The squabbling underscores the balancing act the agency faces in providing a swift assessment of what happened, while thoroughly probing potential wrongdoing. A few months after the 2010 flash crash for stocks and futures, the CFTC published a joint report with the Securities and Exchange Commission that largely pinned the blame for the temporary market collapse on macro-economic conditions and a reckless order by a Kansas mutual fund. That conclusion was called into question in 2015, when the CFTC brought a case against British trader Navinder Singh Sarao suggesting his manipulative trading had helped cause the tumult.
In August, Bloomberg News reported that the CFTC, the U.K.'s Financial Conduct Authority and CME Group Inc. owner of the Nymex exchange where WTI contracts trade were examining whether actions tied to U.K.-based Vega Capital London Ltd. may have breached regulations and allowed traders at the firm to make a $500 million windfall on April 20. Vega hasn't responded to multiple requests for comment about its trading. Vega's profits involved instruments called trade at settlement, or TAS, according to people familiar with the matter. When using the products, buyers and sellers agree to transact at wherever the price ends up at 2:30 pm on settlement days such as April 20, when the closing price for a monthly contract is determined. The CFTC report will discuss the TAS mechanism, the people said, but it won't detail how trading of the instruments by any specific parties may have impacted the price of oil.
