Australian tribunal rules 'All Zionists are terrorists' chant is unlawful

Melbourne Jewish community representative successfully argues the protest slogan crosses from political speech into illegal racial and religious vilification as it incites against Jews

A tribunal in the Australian state of Victoria ruled on Thursday that the chant "All Zionists are terrorists" at a central Melbourne rally constituted racial and religious vilification, finding the slogan broadly targeted Jewish people rather than serving as a legitimate political protest over Israel's war against Hamas in Gaza, Australian media reported.

Melbourne Jewish community advocate Menachem Vorchheimer filed the case against Hash Tayeh, the former owner of the Burgertory restaurant chain and a prominent anti-Israel, pro-Palestinian activist, who led the chant at a rally in May 2024.

"The notion of being labeled the derogatory term of 'terrorist' for something I have no responsibility for, and for that to be seen as normal, is gut-wrenching and soul-destroying to me," Vorchheimer said, according to the ruling by the Victorian Civil and Administrative Tribunal. "I felt dehumanized. I felt like the lowest of the low. I no longer feel safe going into the Melbourne CBD, given I am identifiably Jewish."

Tayeh had argued the slogan was directed at the Israeli government and its supporters, not at Jewish people, and that protest chants are necessarily provocative simplifications of political positions.

However, the tribunal rejected that defense, finding under the Racial and Religious Tolerance Act 2001 that - because a significant majority of Australian Jews identify as Zionists - the chant failed to draw a meaningful distinction between political ideology and personal identity, amounting to inciting hatred against a racial and religious group.

Zionism Is Strangling Free Speech in Australia

A Palestinian-Australian man has been criminally charged for voicing criticisms of Zionism during a protest against Israel's genocide in Gaza. He could spend months in prison.

The Age reports that restaurant owner Hash Tayeh has been charged with four counts of "using insulting words in public" for repeatedly uttering the phrase "all Zionists are terrorists" at a pro-Palestine rally in Melbourne last year. According to The Age's Chris Vedelago, the punishment for this crime of political speech is "up to two months in prison for a first offence and six months for three or more offences."

"It is believed to be the first time that potential political speech has been deemed a criminal offence that breached the 'insulting' law," Vedelago reports, adding, "The charges are normally levied for using abusive or obscene language against police officers."

You really couldn't ask for a better illustration of the authoritarian dystopia that Australia has become than a news report about a man getting criminally charged for normal political speech with a law that is normally used to jail people who speak impolitely to the police.

These charges for speech crimes against Zionism follow a controversial assertion made last year by Australia's attorney-general Mark Dreyfus:

"The label Zionist is used, not in any way, accurately. When critics use that word, they actually mean Jew. They're not really saying Zionist, they're saying Jew because they know that they cannot say Jew, so they say Zionist or words [such as] Zeo or Zio."

Dreyfus might want to have a chat with outgoing Canadian prime minister Justin Trudeau, who just made headlines by proudly proclaiming "I am a Zionist" at his final press conference on Thursday.

Trudeau is not Jewish, nor is genocidal war criminal Joe Biden, who is on record saying on numerous occasions some variation of "I'm a Zionist. You don't have to be a Jew to be a Zionist."

Not all Jews are Zionists, and most Zionists are not Jewish. Zionism is a political ideology which upholds the western decision to drop an abusive apartheid ethnostate on top of a pre-existing civilization in historic Palestine and defend it by any amount of violence and tyranny necessary, and the majority of the people you see defending this status quo are westerners with no connection to the Jewish faith. The cult of Christian Zionism alone outnumbers the world's Jewish population by about two to one.

It is therefore wildly incorrect to conflate Zionism with Judaism, and it is also highly immoral. People who do this are assigning all Jews the blame for Israel's abuses, when the blame actually lies with the state of Israel and its western backers. As much as Israel apologists shriek and moan about "antisemitism" when they really mean supporting Palestinians, the real antisemitism problem in our society is the way our ruling institutions keep lumping all Jews in with the abuses of a genocidal apartheid state and the western empire which supports it.

The Palestinian-Australian owner of a popular Melbourne burger chain says he has moved his wife and young child into a safe house after receiving a threat on his life over social media.

Hash Tayeh, the owner and CEO of Burgertory, said an anonymous message told him he would be made a "Shahid", an Islamic term for a Muslim martyr.

He has since reported the message to the police.

The death threat came shortly after the Caulfield store of his fast-food chain was firebombed and prompted him to move his family into a different home as a safety measure.

"Our staff were getting phone calls daily, saying, 'You don't belong here. We're going to boycott you. We're going to close you down, your shop's going to go','' he told 7.30.

Police have so far said there is no evidence indicating the firebombing of the store was racially or politically motivated.

Shock burger store explosion before protest

Terrifying CCTV footage has emerged of the moment a Melbourne burger store that sparked pro-Palestinian protests exploded in flames.
The popular gourmet burger chain was founded by Hash Tayeh, 32, a prominent supporter of Palestine who recently wrote an open letter to the Jewish community explaining why he was filmed leading anti-Israel chants.

Police say the fire, which is being investigated as suspicious, has not been linked to date as politically motivated.

"At no stage have I ever called for harm to any individual, and I want to emphasise that I have deep and meaningful friendships with members of the Jewish community," he said.

But on Friday, a shocking social media post in response to fire prompted Palestinian protesters to descend on the suburb which has a large Jewish community including Jewish day schools and synagogues.

In the post the man says "Ooh something smells burnt. Is it the burgers? We're not sure if it's the cooking or the smell of burnt children in Gaza."

That post was widely circulated on pro-Palestinian groups with claims it was posted by a Jewish man in Melbourne.

He has now deleted his social media accounts. Some say it was the spark that prompted large groups from outside of the area to descend on the suburb.

However, Jewish leaders who condemned the post said there was nothing to link the man to the suburb or the synagogue that was forced to evacuate on Friday and could not possibly justify the scenes of violence and intimidation that followed.
