.... Right to Try laws. They are not promises that diseases will be cured or that new drugs will save lives. But they give people early access to therapies that stand a chance of curing or turning back their illnesses. It's a humane and compassionate thing to do, though not uncomplicated. Pharmaceutical companies, understandably, are reluctant to give access to their medicines without the shield of a rigorous investigation and approval by the Food and Drug Administration. Is extremely difficult to provide liability protection for drugmakers, but I Indiana got it done. After we had passed the bill, I had told Jordan and his mom that if there was ever anything I could do for them to call me.
And they did. In 2018, they made their way to Washington to encourage Congress to pass a federal Right to Try law. It was already on our agenda; at a rally in Lancaster, Pennsylvania, during the presidential campaign, I took a question from an eleven-year-old boy named Zack Mongiello: "Will you and Donald Trump, when you are elected, will you support the Right to Try? My father and our friend Matt, they both have ALS, so they are dying? I told him we would take it to DC and get it done. I hadn't even talked to the president about it, but I knew he would support it, and he did.
During our second year, we worked with Congress; this time both parties participated, and the bill was passed. Huge credit was due to Oregon's Greg Walden, the chairman of the House Energy and Commerce Committee, who worked through iterations of the bill and with patients, regulators, and drugmakers to create a law that would balance access to drugs that did not yet have FDA approval with liabil-ily protection for manufacturers and hospitals, and protect patients.
The final bill passed the House on May 29, bearing both Jordan's and
Zack's dads' names.
The president signed the bill in a small theater in the Eisenhower Erecutive Office Building across from the White House. Jordan, wear ing a suit and bow tie, was to Trump's left. After the president signed the legislation, he began handing out pens that he had used during the signing, a presidential custom. While the president shifted around, Jordan got up from his wheelchair and leaned in for a hug. Trump, busy passing out pens, didn't notice. Then Jordan went in for a hug again. Trump, who was addressing reporters, didn't see it the second time. Jordan then played it cool and leaned on the desk, propping his chin on his hand. Then the president noticed him and gave him a big hug and a kiss. It was a sweet moment. Jordan and his mom, and Zack and his dad, had made it possible.

As House Republican Conference Chair Liz Cheney (R-Wyo.) prepares for an intense primary election, business PACs are giving her an early fundraising boost.
Cheney's campaign and leadership PAC received $74,600 from business PACs through February, a figure that pales in comparison to previous years but was second only to Schumer's $111,000 this year.
Cheney will need money to compete with Trump's deep-pocketed committees and outside groups aiming to unseat her such as the Club for Growth. PACs associated with several major companies -including Walmart, American Express, Morgan Stanley, T-Mobile and Pfizer - bankrolled Cheney's accounts last month. AT&T, one of the top annual PAC donors, gave $10,000 to Cheney's campaign.
House Minority Leader Kevin McCarthy (R-Calif.), who raked in $2.3 million from business PACs in the 2020 cycle, didn't receive any such PAC donations to start the new year. He was one of 147 Republicans who voted to overturn the 2020 election results. Several top firms are no longer donating to these lawmakers, although some company PACs continue to fund party committees overseen by them.
Moderate GOP lawmakers, particularly anti-Trump Republicans, have emerged as early business PAC favorites. Rep. Adam Kinzinger (R-Ill.) ranks among the top PAC recipients so far, raising over $37,000. The six-term lawmaker launched a PAC to defend Republicans who sided against Trump.
Business PACs also favored a leadership PAC controlled by Sen. Mitt Romney (R-Utah), a leading Republican Trump critic, and campaign accounts run by Senate Minority Whip John Thune (R-S.D.). Sen. Lisa Murkowski (R-Alaska), another top Trump target, was the only active GOP candidate to receive money from Google's PAC through February.
Cheney and other anti-Trump Republicans will likely benefit from establishment support as Trump aims to remake the GOP in his image. Through February, Cheney received donations from leadership PACs controlled by Rep. Tom Rice (R-S.C.) and Sen. Bill Cassidy (R-La.) - both voted against Trump on impeachment - as well as former Rep. Greg Walden (R-Ore.) and Senate Minority Leader Mitch McConnell (R-Ky.). Former House Speaker Paul Ryan is also raising money for Cheney's reelection bid, Politico reported.

Bill Clinton's telecom law: Twenty years later
Washington's tech policy wonks are celebrating an anniversary this week: 20 years ago Monday, President Bill Clinton signed the 1996 Telecommunications Act into law at the Library of Congress.
Designed to de-regulate aspects of the telecommunications business, it was the first overhaul of the law that created the Federal Communications Commission in more than six decades.
Supporters of the law said it would create more competition in the telecommunications industry that, at the time, was only beginning to grapple with the transformative power of the Internet.
"It promotes competition as the key to opening new markets and new opportunities," Clinton said at the bill signing. "It will help connect every classroom in America to the information superhighway by the end of the decade. It will protect consumers by regulating the remaining monopolies for a time and by providing a roadmap for deregulation in the future."
Among other things, the bill brought deregulation to the cable industry and lifted the national cap on radio station ownership. It also eased the rules that apply to broadcasters.
It touched on universal service, the idea that the government should help make sure that all Americans have access to communications services. The act authorized the FCC's E-Rate program, which helps connect schools and libraries. That program remains in effect today; in 2013, President Obama asked the commission to look at expanding it.
A number of technology groups will commemorate the law's passage next week, with players from big-name technology companies participating.
On Monday, technology groups and companies are expected to mark the signing of the bill. INCOMPAS, which represents the so-called "competitive" communications companies and used to be called COMPTEL, will hold a policy summit on Wednesday that includes Colin Crowell, the vice president of global public policy at Twitter, and representatives from the FCC and 21st Century Fox. The group is also throwing a party in honor of the anniversary.
The Georgetown Center for Business and Public Policy will also host an event evaluating the successes and failures of the law with some of the people involved in its creation.
Some have argued that parts of the law had detrimental effects on the communications market. A 2005 report from public interest group Common Cause found that political forces blunted its impact.
"In many ways, the Telecom Act failed to serve the public and did not deliver on its promise of more competition, more diversity, lower prices, more jobs and a booming economy," the group said. "Instead, the public got more media concentration, less diversity, and higher prices."
Technology has also changed substantially since the law was signed in 1996. Internet speeds have risen, with Americans making the switch from dial-up to broadband, which in turn has disrupted the old order in other industries, like broadcasting. And more recently, the rise of smartphones has forced regulators to confront challenges posed by mobile networks.
It had seemed as though lawmakers might update the law as the 20th anniversary approached. In 2013, House Energy and Commerce Committee Chair Fred Upton (R-Mich.) and Subcommittee on Communications and Technology Chair Greg Walden (R-Ore.) announced that they were embarking on a multi-year process to update the law.
"A lot has happened since the last update," Walden said. "A lot of companies have been born out of the innovation of the communications act. There's a lot that's changed in the legal world."
The lawmakers spent time talking to various stakeholders and begin to hone in on issues that could be addressed. But then the debate became more complicated when the FCC approved rules governing net neutrality almost a year ago.
Those regulations - which increased the FCC's regulatory authority over Internet service providers - are reviled by many Republicans, who view them as a power grab. Their implementation heightened partisan tensions on the commission and has ratcheted up tensions between Chairman Tom Wheeler and Congress.
"Net neutrality certainly was a mini-atomic bomb in the middle of [the communications act update]," Walden told reporters last summer, before noting that he held hope that some sort of piecemeal update would be possible.
Since then, neither Walden's subcommittee or his Senate colleagues have gotten closer to an update.

GOP calls Clyburn-led committee redundant
House Speaker Nancy Pelosi (D., Calif.) announced the formation of a new coronavirus oversight committee led by House Majority Whip Jim Clyburn (D., S.C.), who last month said the pandemic gives Democrats "a tremendous opportunity to restructure things to fit our vision." The speaker's announcement on Thursday comes as her caucus plots another relief package, with a national vote-by-mail requirement as a top priority. Pelosi faced criticism in March after stalling the then-proposed stimulus bill in favor of her own version, which included increased fuel emissions standards for airlines, an expansion of wind and solar credits, and vote-by-mail provisions. President Donald Trump called the Democrat's proposal "crazy." Pelosi said Thursday the committee would monitor the billions in federal money spent fighting the virus and would have subpoena power. House Republicans immediately expressed concern over Clyburn's participation, arguing that his March remarks indicate he is looking to use the pandemic as a pretext to advance Democratic policy goals.
House Minority Leader Kevin McCarthy (R., Calif.) on Thursday said he is concerned by the choice. "[The committee] is concerning to me because Congressman Clyburn is the one who thought this crisis was an opportune time to restructure government," McCarthy said in a conference call with reporters. "That's not what we should be doing." Pelosi said in a Thursday conference call that the committee would ensure the $2 trillion in coronavirus relief is "spent carefully and effectively," but McCarthy indicated that Republicans were given few details on the committee, which will need to be approved by Congress before it is launched. "For that committee to get up and running, it takes a vote of Congress," McCarthy said. "I don't know when we'd go back and vote on this, I don't know what the budget would be, I don't know what the responsibility would be."
Other top House Republicans argued that existing congressional oversight efforts are sufficient and that a new committee will only hamper the federal response to the pandemic. "Our committee has a very rich tradition of both parties doing very effective and aggressive, bipartisan oversight," Rep. Greg Walden (R., Ore.), ranking member of the House Energy and Commerce Committee, said. "We're already conducting oversight, looking at what's working, what's not, and how we can learn from any mistakes that we made. I think creating yet another committee is a big mistake." He added that the committee "will be costly and cause conflict and delay."
The stimulus package already allocates $45 million toward oversight, with $25 million to establish a special inspector general tasked with tracking the Department of the Treasury's stimulus spending. Another $20 million went to the Government Accountability Office, which will "help Congress conduct oversight of the spending," according to the House Committee on Oversight Reform. Committee chair Rep. Carolyn Maloney (D., N.Y.) praised the bill's oversight provisions, saying they will "ensure that taxpayer dollars are used effectively and efficiently." Pelosi's creation of a new oversight committee may highlight a lack of trust in her members who are already charged with oversight, McCarthy said. "I'm just wondering, does the speaker not trust the Oversight Committee? I know she's got a new chair on that committee, and all the other committees to go through, or committees being created with the last bill itself," McCarthy said. "So it mainly questions, to me, what the speaker is trying to do with that." Clyburn did not respond to request for comment.

GOP Leaders Hit Nadler For Holding Up A Ban On Fentanyl During Impeachment Trial
Republican Oregon Rep. Greg Walden believes House Democrats' "obsession" with impeaching President Donald Trump is distracting them from passing a temporary ban on fentanyl substances.
Democratic New York Rep. Jerry Nadler is holding up legislation preventing the distribution of a substance health officials say is responsible for tens of thousands of deaths, Walden said in a statement Friday to the Daily Caller News Foundation. The Oregon Republican said time is of the essence on this matter.
"Democrats on the House Judiciary Committee's partisan obsession with impeachment is preventing us from taking common-sense action to extend a critical tool for law enforcement to combat the trafficking of fentanyl-related substances," Walden said.
He added: "The Senate has passed an extension, but the House has yet to act. The House leadership needs to put the Senate bill on the floor next week so this critical authority does not lapse."
Nadler spokesman Daniel Schwarz told the DCNF that Nadler is aware of the legislation.

A conservative group is targeting House Republicans with a digital billboard campaign that is heavily critical of President Donald Trump.
In the new ads, Republicans for the Rule of Law calls out Trump for prohibiting key witnesses in the Ukraine scandal from testifying in the House impeachment inquiry against him.
The ads show Trump with a finger over his mouth to indicate that he wants silence. He appears next to Secretary of State Mike Pompeo, former National Security Adviser John Bolton, acting White House Chief of Staff Mick Mulvaney and Trump's personal lawyer, Rudy Giuliani, in the images.
All apart from Trump have tape placed over their mouths to keep them from speaking.
"What Is Trump Hiding?" ask the ads, which will be placed in the congressional districts of House Republicans, including Reps. Greg Walden (Ore.), Mac Thornberry (Texas), Fred Upton (Mich.) Brian Fitzpatrick (Penn.), Adam Kinzinger (Ill.) John Katko (N.Y.) and Martha Roby (Ala.).
House Democrats unveiled two articles of impeachment against Trump on Tuesday. Trump is accused of abuse of power in relation to his alleged pressuring of Ukraine's president to investigate potential 2020 Democratic rival Joe Biden, and obstruction of Congress, following his administration's stonewalling of the congressional probe into the initial allegation.
"The president doesn't own the government and he's not above the law," Republicans for the Rule of Law spokesperson Chris Truax said in a statement to HuffPost. "He's merely a caretaker acting on our behalf and when Congress demands an accounting, it's the President's duty to comply."
"President Trump has been given every opportunity to answer the charges against him," the statement continued. "He demands friendly witnesses, yet refuses to allow his most loyal supporters to testify. He complains the proceedings are unfair, yet refuses to allow his lawyers to participate in the hearings."
"If President Trump really could prove he is innocent of the impeachment charges against him, he would have made some effort to do so by now," Truax concluded. "If the President really does think the facts will exonerate him, why won't he let those facts come out?"
Last month, Republicans for the Rule of Law launched an ad campaign on Fox News in a bid to educate GOP voters on the facts of the Ukraine scandal.

House approves anti-LGBT discrimination Equality Act
The House on Friday for the first time approved legislation banning anti-LGBT discrimination in a 236-173 vote.
Every Democrat voted for the measure, as did eight Republicans.
The Equality Act would expand the Civil Rights Act of 1964 and the Fair Housing Act to ban discrimination in employment, housing, jury selection and public accommodations based on sexual orientation and gender identity.
"This legislation will provide members of LGBTQ Americans protections from being denying medical care or being fired or thrown out of their homes," House Judiciary Committee Chairman Jerrold Nadler (D-N.Y.) said on the floor ahead of the vote.
He said the bill would expand the definition of "who is understood to be included in the Declaration of Independence."
Rep. John Lewis (D-Ga.), a civil rights leader, applauded the legislation for continuing efforts to fight discrimination in the United States.
"Today on this day we have an opportunity to send a message now to help end discrimination in our country and set all of our people free," Lewis said.
The measure, spearheaded by Rep. David Cicilline (D-R.I.), was expected to be approved but faced opposition from conservatives, who said it would infringe upon people's religious liberties.
Opponents argued the bill "is anything but equalizing," in the words of Rep. Vicky Hartzler (R-Mo.).
"In fact, this bill legalizes discrimination - government imposed top-down discrimination against those with time-honored views of marriage and gender," she said in remarks on the floor ahead of the vote.
GOP Reps. Susan Brooks (Ind.), Mario Diaz-Balart (Fla.), Brian Fitzpatrick (Pa.), Will Hurd (Texas), John Katko (N.Y.), Tom Reed (N.Y.), Elise Stefanik (N.Y.) and Greg Walden (Ore.) all opted to vote with Democrats.
More than 200 businesses, including Facebook, Google, Hilton and JPMorgan Chase, backed the measure. Groups opposing it included the Heritage Foundation and the Family Research Council.
The Heritage Foundation alleged the bill would "force employers and workers to conform to new sexual norms," "force hospitals and insurers to provide and pay for these therapies against any moral or medical objections" and "lead to the erasure of women."
The bill faces an uphill battle in the Republican-controlled Senate, where it is unlikely Majority Leader Mitch McConnell (R-Ky.) will bring the measurer up for a vote.

The top Democrats and Republicans on the U.S. House Energy and Commerce Committee on Tuesday wrote Google Chief Executive Sundar Pichai raising concerns about reports of a massive database known as Sensorvault containing precise consumer location information on hundreds of millions of devices.
The letter seeks a briefing and answers on how this information is used and shared, citing a New York Times report that the database includes nearly every consumer with an Android mobile device, in some cases storing information dating to 2009.
Alphabet Inc, Google's parent, did not immediately respond to a request for comment.
The letter is one of several sent by members of Congress raising concerns about how Google or other big Internet companies use information they have gathered about consumers.
The letter, which was signed by Democratic Representatives Frank Pallone and Jan Schakowsky and Republicans Greg Walden and Cathy McMorris Rodgers, asked Google who has access to the Sensorvault database and which Google services or apps collect the information. Pallone and Walden are the top members of the House Committee on Energy & Commerce.
The lawmakers asked for answers to their questions as well as a briefing on the issue by May 10.
They also asked Google if information is collected from consumers who requested that their data not be shared and asked to be briefed on any third parties, other than law enforcement, given access to location data.
Google, Facebook, Twitter and other free online services rely on advertising for revenue and use data collected on users to more effectively target those ads.
Congress has long been expected to take up privacy legislation after California passed a strict privacy law that goes into effect next year.
Two U.S. senators introduced a bill in early April that would ban online social media companies like Facebook and Google from misleading consumers in order to convince them to give up personal data.
The bill from Mark Warner, a Democrat, and Deb Fischer, a Republican, would also ban online platforms with more than 100 million monthly active users from designing addicting games or other websites for children under age 13.

While the Green New Deal has been embraced by leftmost Democrats and a handful of 2020 presidential hopefuls, Democratic leadership has withheld overt support for the resolution. Moderate Democrats have distanced themselves from the resolution or, like West Virginia Sen. Joe Manchin, joined with Republicans to reject it altogether.
The Green New Deal calls for aggressive goals of achieving "net-zero" greenhouse gas emissions within 10 years, which implies more aggressive policies than cap-and-trade. Republicans worry such policies will raise energy prices and dramatically expand government control of the economy. "Taken together, we fear the Green New Deal would hurt Americans struggling to make ends meet - the very people it purports to help," Republicans wrote to Pelosi. "Worst of all, it could permanently put the American Dream out of reach for millions of Americans."
Republicans' letter comes on news Senate Majority Leader Mitch McConnell is set to bring the Green New Deal to a vote in the last week of March. Senate Democrats are trying to avoid voting on the non-binding resolution and even put forward an alternative bill. Republicans in the Western Caucus, including Bishop, held a public forum on the Green New Deal in late February, and even invited the bill's sponsor, New York Rep. Alexandria Ocasio-Cortez, who wasn't able to attend. At the event, Bishop ate a hamburger in defiance of the Green New Deal - in reference to Ocasio-Cortez's bungled Green New Deal rollout FAQ that mentioned getting rid of "farting cows."
It seems doubtful Pelosi would agree to hold hearings on the Green New Deal. Pelosi referred to the Green New Deal as "the green dream or whatever" after it was introduced in February. Likewise, Pelosi has resisted her party's calls for votes on Medicare for All and impeachment. Pelosi also remembers the defeat of cap-and-trade in 2010, despite Democratic control of both chambers of Congress.

Apple Tells Lawmakers iPhones Are Not Listening In On Consumers
Apple Inc told U.S. lawmakers on Tuesday that its iPhones do not listen to users without their consent and do not allow third-party apps to do so either, after lawmakers asked the company if its devices were invading users' privacy.
Representatives Greg Walden, Marsha Blackburn, Gregg Harper and Robert Latta wrote to Apple's chief executive Tim Cook and Alphabet Inc chief executive Larry Page in July, citing concerns about reports that smartphones could "collect 'non-triggered' audio data from users' conversations near a smartphone in order to hear a 'trigger' phrase, such as 'Okay Google' or 'Hey Siri.'"
In a letter to Walden, an Oregon Republican who chairs the House Energy and Commerce Committee, Apple said iPhones do not record audio while listening for Siri wakeup commands and Siri does not share spoken words. Apple said it requires users to explicitly approve microphone access and that apps must display a clear signal that they are listening.
The letters, in which lawmakers cited reports suggesting third-party applications had access to and used 'non-triggered' data without users' knowledge, followed congressional hearings in April into Facebook Inc's privacy practices, which included testimony by its CEO Mark Zuckerberg.
Alphabet did not respond to questions about whether it had replied to lawmakers. Apple declined to comment beyond its letter, which was seen by Reuters.
A spokeswoman for the Republican majority on the House Energy and Commerce Committee said "both companies have been cooperative thus far. The Committee looks forward to reviewing and analyzing the responses as we consider next steps."
Apple wrote that it had removed apps from its App Store over privacy violations but declined to say whether it had ever banned a developer. It also said it was up to developers to notify users when an app was removed for privacy reasons.
"Apple does not and cannot monitor what developers do with the customer data they have collected, or prevent the onward transfer of that data, nor do we have the ability to ensure a developer's compliance with their own privacy policies or local law," Apple wrote.
The iPhone maker's App Store has generated $100 billion in revenue for developers over the past decade. Apple told lawmakers in its letter that it rejected about 36,000 apps from among the 100,000 submitted each week for violations of its guidelines.

Axios reports that House Majority Leader Kevin McCarthy sent a letter Thursday to Greg Walden, the chairman of a powerful House committee, to ask that he publicly grill Twitter chief executive Jack Dorsey over recent allegations that the platform limits the reach of some conservative accounts.
