Elizabeth Warren are among the candidates coming to court thousands of party faithful at the California Democratic Party's annual convention, a major draw for activists who get far fewer chances to interact with presidential hopefuls than their counterparts in traditional early-voting states.
But they'll be sharing the weekend's spotlight with an election for a new party chair. Former chairman Eric Bauman resigned in November, weeks after Democrats made sweeping electoral gains, amid allegations he drank on the job and sexually harassed and abused staff. Two former California Democratic Party employees and an activist sued the organization in Sacramento County Superior Court on Monday, alleging that they were subjected to sexual assault, harassment, racial discrimination and retaliation by former Chairman Eric Bauman, and that the party failed to protect them.
The lawsuit is the second filed against the party and Bauman in two weeks and the third legal action against both since he resigned in November following allegations of sexual misconduct and inappropriate behavior toward party staff members and activists.
In the lawsuit filed Monday, former party operations director Tina McKinnor alleges that Bauman discriminated against her because she is black and former communications director John Vigna claims that Bauman groped him and sexually harassed him "on nearly a daily basis." The complaint also alleges that the state party retaliated against McKinnor and Vigna for helping another employee file a sexual harassment complaint against Bauman when it fired them in December.
A third plaintiff, party activist Spencer Dayton, alleges in the suit that he was groped on at least two occasions by Bauman.
The plaintiffs are suing to be compensated for pain and suffering and lost income, and for punitive damages.
Neal S. Zaslavsky, an attorney for Bauman, said his client had not been served with the lawsuit as of Monday afternoon.
"Mr. Bauman has not yet seen this lawsuit, and once again, we have only learned of its existence through media inquiries," Zaslavsky said. "It is therefore premature for Mr. Bauman to have any further comment. As with the other pending matters, Mr. Bauman will not be trying this case in the media."
Alexandra "Alex" Gallardo Rooker, the acting chair of the California Democratic Party, declined to comment through a spokesperson.
"We find it curious that the complainants decided to share the complaint with the media before it was filed or served," Rooker said. "In any event, the CDP will not be commenting on pending litigation. As we've stated previously, the most appropriate venue for litigation to be resolved and the truth to see the light is in the courtroom through proper legal procedures."
The lawsuit is the latest to cast the California Democratic Party as an organization with a toxic workplace culture. Last week, Bauman's former assistant sued the organization, alleging he was repeatedly groped and sexually assaulted by the former chair. In January, Bauman and the party were sued by three other current and former employees, who alleged discrimination and a culture of harassment and sexual misconduct that was "well-known and apparently tolerated" by top officials.
Similarly, the lawsuit filed Monday accuses current leadership of condoning Bauman's "widely known" conduct. It also claims acting Chair Rooker acted in a way that "made it clear that the safety and well-being of CDP employees was subservient to her own political agenda."
The plaintiffs declined to comment on the suit through their attorney, Micha Star Liberty.
"Sweeping these serious problems under the rug and then suggesting everyone then moves forward is not good enough," Liberty said.
In the lawsuit, McKinnor alleges that Bauman took job duties away from her and gave them to white colleagues instead, saying her "style was 'too urban'" to run staff meetings and that the party "was 'not ready' to have an African AmErican responsible" for interacting with major donors.
The suit also alleges that Bauman used her employment as a "token," particularly to appease Kimberly Ellis, a black female activist who narrowly lost to Bauman in his race for chair in 2017.
According to the complaint, Bauman asked McKinnor to run a September 2017 executive board meeting and told her to sit up front "for the benefit of 'the black folks.'" Later, when McKinnor confronted Bauman about why she wasn't being permitted to do her job, the lawsuit says, "Bauman plainly stated that he had needed to hire a 'strong black woman'" to keep Ellis "quiet."
The suit also alleges that Bauman used stereotypes and derogatory language to describe African AmEricans. At a dinner with colleagues in the fall of 2017, the complaint says, Bauman said that his mother, a teacher, did not like "poor black kids" and that the students' parents were "probably 'drug dealers.'" He later said that "most black people are poor," the lawsuit claims.
The lawsuit alleges that last year, after McKinnor helped a colleague file a harassment claim against Bauman, she learned from others that he was "ranting about her disloyalty and calling her the 'schwartze,' a derogatory Yiddish term for black person." According to the complaint, McKinnor knew that Bauman commonly used the term to refer to Ellis.

In a leadership shake-up, the California Democratic Party fired seven top staffers Monday and Tuesday as part of the continuing fallout over the misconduct allegations surrounding former party Chairman Eric Bauman.
Alexandra Gallardo Rooker, who took over as acting party leader after Bauman resigned two weeks ago, let go of the senior staffers who came in with Bauman when he was elected chairman in May 2017.
"This is not unusual when there is a change in leadership," Roger Salazar, a spokesman for the party, said in a statement. "These moves are not necessarily a reflection upon the work of each of the individuals involved, but are part of a desire by the acting chair to start fresh and keep the party moving in the right direction."
Among the staffers let go were the party's communications director, political director and senior strategist. The party also closed its Los Angeles office on Tuesday.
Though Rooker plans to make some hires, the party will likely depend on a smaller core senior staff with 2019 a non-election year.
The staffing upheaval marks the latest twist in a tumultuous stretch for the party following its strong showing in the November elections. Two weeks after the midterms, Bauman was publicly accused of workplace misconduct. In an investigation by The Times, 10 party staffers and political activists alleged that Bauman made inappropriate sexual comments in professional settings and engaged in unwanted touching.

California's Democratic Party Chairman Eric Bauman has taken leave of his position over allegations of sexual misconduct.
Bauman said in a statement on Wednesday that he plans to seek treatment for alcohol abuse and health issues, according to CBS.
Bauman, 59, who is the CDP's first openly gay chairman, took his leave of absence on Monday after party Vice Chairman Daraka Larimore-Hall accused Bauman of sexual harassment and assault against unnamed alleged victims last week.

Head Of CA Democrats Resigns After Sexual Misconduct Allegations
On Thursday. the head of the California Democratic Party resigned after there were multiple claims of sexual misconduct made against him. Eric Bauman released a statement to the Los Angeles Times that said, "I have made the realization that in order for those to whom I may have caused pain and who need to heal, for my own health, and in the best interest of the party that I love and to which I have dedicated myself for more than 25 years, it is in everyone's best interest for me to resign my position as chair of the California Democratic Party."
According to The Sacramento Bee, "One of Bauman's deputies, Daraka Larimore-Hall, initiated the process to remove him last week after hearing from individuals who said Bauman had sexually harassed and assaulted them at party events. By Monday, the party had launched an investigation into the complaints and Bauman took a leave of absence."
On Wednesday, the Los Angeles Times reported that 10 party staff members and political activists reported Bauman had made vulgar sexual comments and participated in unwanted touching or physical intimidation in professional settings.
On Thursday, governor-elect Gavin Newsom said Bauman should resign. His spokesman Nathan Click stated, "Sexual harassment shouldn't be tolerated - no person or party, no matter how powerful, is above accountability." Newsom's call for Bauman's resignation was echoed by the gay rights group Equality California and California Democratic Party Secretary Jenny Bach.
The Bee reported that Spencer Dayton, a 21-year-old party delegate from Lodi, said Bauman groped him twice at party events, the first time at the May 2017 convention in Sacramento. Dayton said he wanted to question Bauman about his perspective on certain issues, but when he shook Bauman's hand, Bauman yanked him closer and grabbed his penis. Dayton concluded, "It was very, very quick, but very intentional."
The following November, at the party's executive board meeting, Dayton said he wanted Bauman to support a resolution Dayton was going to offer, but Bauman put his arm over Dayton's shoulder and "reached down and grabbed my butt and said, 'Well, I'm going to have think about it.'" Dayton has retained a lawyer.
In 2017, Bauman won a hotly-contested race for the leadership of the California Democratic Party, defeating Kimberly Ellis by a bare 62 votes, 1,493 to 1,431. He had been the chairman of the Los Angeles County Democratic Party. After the election, Ellis questioned the legitimacy of the election and the review process after it, writing in a memo, "Based on the information contained here, the actual vote count is in question. It is believed that the wrong individual is serving as chair."
Mike Roth, the incoming spokesman for the state Democratic Party, responded at the time, "From what we can tell at this point, it appears to be more unsubstantiated allegations and still no facts."
Bauman tried to offer an olive branch, insisting that unity was vital so the state party could maintain its position as the "beating heart of the resistance." He stated, "I am well aware that 49 percent of the delegates to the convention voted for Kimberly Ellis and that if we are to keep California the big blue beacon of hope and the beating heart of the resistance, those who have felt shut out of the process must have a true seat at the table. But I also know that doing so does not require burning down every institution and trashing those activists and volunteers who have given their blood, sweat and tears over the years to make the California Democratic Party the most successful Democratic Party anywhere in AmErica."

California Democratic Party Chairman Eric Bauman is facing an internal investigation after multiple sexual misconduct allegations were made against him.
The party decided to launch a probe after Vice Chair Daraka Larimore-Hall officially called on state Democratic Party leadership to remove Bauman from the elected position in an email over the weekend.
Larimore-Hall said the "credible, corroborated and utterly heart-breaking allegations" included "a number of party staff" who said Bauman sexually harassed or assaulted them at party events, the San Francisco Chronicle reported Saturday.

BIG BEAR LAKE, Calif. - The chairman of the California Democratic Party is facing accusations of sexual misconduct from within his party's ranks, prompting an investigation and at least one congressman to call for his ouster.
In a written statement circulating among state party officials Friday and Saturday, party Vice Chairman Daraka Larimore-Hall lit into Chairman Eric Bauman, saying he had recently "learned of multiple serious and credible allegations that Chairman Bauman sexually harassed, and in some cases sexually assaulted, individuals during Party functions."
Larimore-Hall did not detail the accusations or identify the people he said were victimized. Nor did Larimore-Hall respond to a request for comment from POLITICO. But the accusation roiled the party, with both Larimore-Hall and Rep. Ro Khanna (D-Calif.) calling for Bauman to be removed.
"The allegations of sexual assault that @DarakaKenric is filing against @EricBauman are shocking," Khanna said on Twitter.
In a prepared statement late Saturday, Bauman said a "prompt, thorough and independent investigation of the allegations has been undertaken by a respected outside investigator, ensuring these individuals making the charges are treated with respect and free from any concerns of retaliation."
But Bauman appeared unwavering, saying, "I look forward to putting these allegations behind us and moving forward as unified Democrats."
Bauman, a longtime Democratic Party activist in California, was narrowly elected chairman of the state party last year. The accusations against him come less than three weeks after a Democratic romp at the ballot box in his heavily Democratic state, with Democrats maintaining their dominance in statewide offices and expanding their delegation in Congress.
Larimore-Hall's written statement was framed as a "statement of charges," which suggested a formal effort to remove Bauman from power. The state party's bylaws would allow Bauman to resign or submit a written answer to such a charge, after which his accuser could move for his removal at a meeting of the party's executive board.
Khanna called for the state party to replace Bauman with Michele Dauber, the Stanford law professor who spearheaded an effort to recall a Santa Clara County Superior Court Judge Aaron Persky following a controversial sexual assault sentencing.
"We need a bold feminist to lead for 2020," Khanna tweeted.
In his statement, Bauman said that "the California Democratic Party should and will be the model for how allegations like these are treated to ensure fairness and to determine truth. Procedures are in place to handle these matters, and independent counsel will ensure that they are followed."

Anthony Grigore is a Democrat. But as he waited Thursday at an In-N-Out Burger in El Segundo for his meal, Grigore made it clear party loyalty would only go so far.
Just hours earlier, the head of the California Democratic Party called for a boycott of the famed burger chain after a public filing revealed that the company had recently donated $25,000 to the state's Republican Party.
"Eating at In-N-Out is such a standard thing to do across California," Grigore said, dismissing the boycott idea as a bit silly.
California has emerged as the center of the Democratic resistance since President Trump took office. But this activism might meet its match when it comes to In-N-Out, a California institution that some hold with the same level of esteem as the Golden Gate Bridge and Joshua Tree.
By the end of the day, Democrats were distancing themselves from the idea and Republicans were enjoying a political feast, with some making big lunch orders to show their support for the chain and posting photos on social media.
"We have all of our children eating In-N-Out burgers. Even my son's German Shepherd eats In-N-Out," said state Sen. Jim Nielsen (R-Gerber), whose staff ordered 25 burgers and 50 bags of fries for lunch.
Political experts said they aren't surprised that In-N-Out has proven hard to demonize, especially if the company's sin was simply donating to the Republican Party.
"The stomach overrules the mind," Jaime Regalado, emeritus professor of political science at Cal State L.A. "A cheap, good-tasting burger is hard to dismiss politically."
The political food fight began when Eric Bauman, the head of the California Democratic Party, called for the boycott on Twitter on Wednesday night.
Bauman tweeted a link to a story about the contribution and wrote, "Et tu In-N-Out?" with the hashtag #BoycottInNOut.

Amanda Renteria, a longtime Democratic operative and the national political director for Hillary Clinton's 2016 presidential campaign, has filed paperwork to run for California governor.
Renteria, Attorney General Xavier Becerra's operations chief, a job she took following her 2014 loss to Rep. David Valadao, R-Hanford, had been telling Democratic strategists that she was mulling what one described as a "disruptive" bid to succeed Gov. Jerry Brown. She did not immediately return a text message seeking comment on her statement of intention to run.
Becerra, who is running for a full term this year, has not endorsed in the governor's race.
Renteria, 43, would join a contest featuring a male-dominated field led by Lt. Gov. Gavin Newsom and former Los Angeles Mayor Antonio Villaraigosa. Her filing comes amid renewed questions into the leading Democrats' extramarital affairs, now against the backdrop of the roiling #Metoo movement. Delaine Eastin, the state's former schools chief, is far behind in polls and fundraising.
Renteria, who grew up in Woodlake southeast of Fresno, has been a favorite of Central Valley Democrats, even drawing then-Vice President Joe Biden to a rally for her campaign. She first met Becerra, whom she joined in Sacramento as a way to battle the Trump administration in the legal arena, while working as chief of staff for Sen. Debbie Stebenow, D-Michigan. She also worked for California Sen. Dianne Feinstein.
"California and other states are recognizing that the White House has real implications on everyday life even though you are 3,000 miles away," Renteria told McClatchy's Vida en el Valle last year.
Democrats were shocked and puzzled by the filing, with former state Sen. Dean Florez, a Villaraigosa supporter from Shafter, saying he was saddened by the development.
"If you are running for Governor, announce 6 months ago, attend the debates, hold a press conference with your supporters & speak directly to the press," he wrote on Twitter, adding the hashtags #spoiler and #badpolitics.
Others close to Villaraigosa, who could lose voters to her given his focus on Latinos and voters in the Central Valley, downplayed her significance, unless Renteria can raise considerable money.
It's unclear who would staff Renteria's campaign: Three of the people who worked on her 2014 congressional bid are working on a Super PAC aimed at helping Villaraigosa.
California Democratic Party Chairman Eric Bauman told The Sacramento Bee on Wednesday that she won't have a speaking slot at the party's convention later this month in San Diego.
"The convention program is done. I couldn't even squeeze in two minutes," Bauman said.
She also will not be part of the party's endorsement process, he added.
Garry South, a strategist from Los Angeles who has helped run four gubernatorial campaigns in the last 20 years, noted Renteria does not have a public profile in the state.
"Her name on the ballot alone won't make her a player in California," he said.
Newsom and Villaraigosa, meanwhile, have been campaigning for some time, and both were early Clinton backers in 2016 and 2008, when Villaraigosa was her national co-chairman.
"It's way too late to get into the 2018 race. It's too late to raise any significant amounts of money," South said.
"I don't know what she's thinking. I just don't see it. I think it's crazy."
