The former Trump national security adviser will be sentenced by Clinton appointee Emmet Sullivan.
President Donald Trump's former national security adviser, Michael Flynn, will face a different judge to be sentenced than the one who took Flynn's guilty plea to a felony false statement charge last week, court records show.
Judge Emmet Sullivan was randomly assigned to take over the case after Judge Rudolph Contreras recused himself.
A court spokeswoman confirmed to POLITICO that the reassignment was due to Contreras' recusal, but said the court generally does not disclose the reason that a judge begged off the case.
Sullivan is an appointee of President Bill Clinton, and Contreras was appointed by President Barack Obama.
Flynn pleaded guilty last Friday to a false statement charge brought by prosecutors from the office of special counsel Robert Mueller, who is investigating whether there was collusion between the Trump campaign and Russia.
The retired Army lieutenant general and Defense Intelligence Agency director, who was fired after 24 days as national security adviser in the Trump White House, admitted he lied to FBI agents about his interactions with Russian Ambassador Sergey Kislyak during the transition and lied to the Justice Department about his lobbying dealings related to Turkey.
No sentencing date has been set for Flynn, who has agreed to cooperate with Mueller's team.
Contreras had told both sides to report on the status of the case by Feb. 1. It will now be up to Sullivan to decide whether to stick with that schedule or set a new one.
Sullivan is best known for overseeing the corruption trial of the late Sen. Ted Stevens (R-Alaska) and then assigning an outside lawyer to investigate the conduct of prosecutors in the case who were accused of withholding evidence helpful to the defense. Sullivan previously served as a judge on the D.C. Superior Court and the D.C. Court of Appeals.

There is a shroud of mystery regarding the actual facts that surround the first interview former National Security Advisor Michael Flynn had with two FBI Special Agents at the White House. Pieces of the puzzle, however, have slowly come together over the past year. In the past week, those pieces of evidence, or lack thereof, have become even more pronounced after Special Counsel Robert Mueller's office was ordered by Judge Emmet Sullivan to turn over all documentation and FBI interviews - known in the bureau as 302s - to the court.
The highly redacted documents revealed a startling fact, the 302 from the first interview with Flynn on Jan. 24, 2017 appears to be missing. The only document referencing the interview conducted by both Former FBI Special Agent Peter Strzok and his partner at the time FBI Special Agent Joe Pietka III, is an August 2017 document. The 302 from Aug. 22, 2017, is of an interview the bureau had with anti-Trump agent Strzok based on notes he had put into the FBI system on July 19. Those notes apparently were regarding his impressions of his interview with Flynn in January.
Improper doesn't begin to describe what's going on with the documents, said multiple former U.S. and senior FBI officials. The main question, they have, like so many others, is what happened to the original notes regarding the FBI's interview with Flynn?
It isn't difficult to decipher but there were only two people who would know directly what happened with the Jan. 24 interview: Strzok and Pientka.
So why hasn't Pientka ever been questioned by Congress or by anyone that we know of, for that matter?

REPORT: AG Bill Barr's Discussions With Mueller on General Mike Flynn Led to Memo Ending Cooperation
President Trump's former NatSec Advisor General Mike Flynn has officially completeld his cooperation with Mueller's investigation, according to a status report filed Tuesday.
CNBC reported:
Despite the special counsel's view that Flynn has completed his cooperation, Flynn remains "in a position to cooperate with law enforcement authorities," according to the status report.
Flynn may continue to cooperate with prosecutors in Virginia who are investigating his former business partners, Bijan Rafiekian and Kamil Alptekin, ahead of a trial slated to begin in July. The two men have denied charges that they unlawfully lobbied on behalf of Turkey.
But the attorneys wrote that "in the government's view his cooperation is otherwise complete."
According to One American News reporter Jack Posobiec, Attorney General Bill Barr, who is overseeing the special counsel's investigation is the one who told Mueller that there wasn't enough evidence to keep General Flynn around and to end his cooperation.
Posobiec said that Mueller's corrupt prosecutor Andrew Weissmann pushed back and wanted to continue to harass General Flynn.
This is an indicator that Bill Barr may actually be reeling in Mueller's out-of-control inquisition - a stark contrast from Jeff Sessions and Rod Rosenstein.
General Flynn was ambushed by corrupt FBI officials just days after Donald Trump was sworn into office in January of 2017.
Flynn pleaded guilty to making a false statement to the feds, however, evidence later released proved Flynn never lied to investigators.
General Flynn is facing between zero and six months in jail.
It is now clear that there is one set of rules for Republicans and the working man - And there is another set of rules for crooked Democrats and the elite class.
In December Judge Emmet Sullivan abused and harassed General Michael Flynn in federal court.
Sullivan even suggested General Flynn committed treason for his work with Turkey - a totally unrelated case.

Michael Flynn's cooperation in Robert Mueller's Russia investigation is complete, lawyers for the special counsel said in a Tuesday night report to a federal judge presiding over the former Trump national security adviser's case.
In the same joint status report, Flynn's lawyers asked for a 90-day delay in their client's sentencing so he could continue to cooperate with the government in his former business partner's upcoming trial in Alexandria, Va. Flynn expects to testify in the mid-July trial against Bijan Rafiekian, who faces charges of conspiracy and acting as an unregistered foreign government agent for Turkey.
"At this time, the defendant continues to request a continuance since the case in EDVA has not been resolved, and there may be additional cooperation for the defendant to provide pursuant to the plea agreement in this matter," Flynn's attorneys said in the report to U.S. District Judge Emmet Sullivan, referring to the Eastern District of Virginia.
Sullivan urged Flynn at his December sentencing hearing to keep requesting delays until he'd done all he could to satisfy the government - an offer Flynn has now accepted twice.
Mueller didn't take a position on Flynn's request for a delay but noted that prosecutors had exhausted the witness of information since he pleaded guilty to lying to the FBI in December 2017.
"While the defendant remains in a position to cooperate with law enforcement authorities, and could testify in the EDVA case should it proceed to trial, in the government's view his cooperation is otherwise complete," Mueller's lawyers wrote.
Mueller's prosecutors had recommended to Sullivan that he sentence Flynn to little if any prison time.
"The defendant deserves credit for accepting responsibility in a timely fashion and substantially assisting the government," the special counsel wrote in a heavily redacted December sentencing memo that counted 19 Flynn interviews with its office and other Justice Department prosecutors.
Federal sentencing guidelines call for Flynn to receive between zero and six months in prison, and Mueller's office recommended the "low end" of the spectrum. Sullivan could give the retired Army general up to a five years.

The disclosure came in a joint court filing between Flynn's lawyers and Special Counsel Robert Mueller's office in which they asked for another delay in Flynn's sentencing, citing his ongoing cooperation with the other federal investigation. The conversations took place between Trump's November 2016 election victory and his inauguration in January 2017. The indictment against Rafiekian accuses him of working with Turkish government officials on a secret plan to return Muslim cleric Fethullah Gulen, who is living in exile in Pennsylvania, to Turkey - all without registering as a lobbyist as is required by law. Flynn worked with Rafiekian, a former director at the U.S. Export-Import Bank, on that project.

On June 6, 2018 Chairman of the Senate Judiciary Committee Charles Grassley sent a three-page letter to Deputy Attorney General Rod Rosenstein, questioning the DOJ's and FBI's failure to provide information regarding Flynn's interview with the FBI and any exculpatory information with regard to Flynn's case that Special Counsel Robert Mueller's office may be withholding from Congressional inquiries.
Grassley's office also requested and was denied numerous times the opportunity to interview Pientka by Rosenstein and FBI Director Christopher Wray, according to the June 6, letter and interviews with multiple sources.
Grassley wrote in his letter to Rosenstein, "Finally, it is disingenuous and extremely disturbing that the Department would imply that a request to interview a fact witness, such as Special Agent Pientka, has anything whatsoever to do with "allegations against" that witness. As you well know, seeking information from a fact witness is not the same thing as an allegation of wrongdoing. Quite the contrary, it seems he is likely to be an objective, reliable, and trustworthy witness, which is precisely why the Committee would benefit from his testimony."
According to multiple sources who spoke to SaraACarter.com FBI procedures require that the notes of an interview with witnesses or victims be submitted within 5 days into the bureau's Sentinel computer system.
"The only person who has credibility and could shed light on this matter is Pientka," said a former senior U.S. official. "He's the only person the FBI, DOJ and Mueller investigation has purposefully muzzled."
As former FBI Supervisory Agent Jeff Danik told this news site, the policy is put in place to ensure that "memory recollection" is accurate so that agents can reference those notes in the future. He said submitting notes more than seven months after an interview is "unheard of" and a "disaster." He stressed that in order for Sullivan to get an accurate account of what happened he needs to ask the Special Counsel for "the workflow chart, which would show one-hundred percent, when the 302s were created and when they were sent to a supervisor and who approved them."
Danik makes a crucial and important point, "who was the supervisor who approved the notes going into the system in August 2017 and what happened to the 302 interview in January?"

Clinton testified that she used the controversial email system for the "purpose of convenience." Clinton initially objected and refused to answer the questions but was ordered to do so last month by U.S. District Court Judge G Emmet Sullivan.
The court ordered Clinton to "[D]escribe the creation of the clintonemail.com domain name and the decision to set the domain up on the existing server, the date it was decided to create the domain and set it up on the existing server, who made those decisions, and when the domain became operational on the existing server."
Clinton answered under oath:
Subject to and without waiving the forgoing objections, Secretary Clinton answers as follows: As Secretary Clinton prepared in late 2008/early 2009 to serve as Secretary of State, she was aware that President Clinton's office had set up an e-mail system, but she had no role in this process. Secretary Clinton knew that President Clinton's staff had recently upgraded that system. Secretary Clinton does not know what equipment that system used, how it was created, who decided that the system needed to be upgraded, or who else had accounts on the system. Secretary Clinton believes that one of the President's aides, Justin Cooper, set up the system. Secretary Clinton decided to use a clintonemail.com account on the system for the purpose of convenience. Secretary Clinton recalls that the clintonemail.com account was created in early 2009. Although Secretary Clinton does not have specific knowledge of the details of the creation of the account, the "domain," or the "domain name," her best understanding is that Mr. Cooper set it up.
To another question regarding her October 22, 2015, testimony before the U.S. House of Representatives Select Committee on Benghazi, during which she testified that 90 to 95 percent of her emails "were in the State's system" and "if they wanted to see them, they would certainly have been able to do so," Clinton suggests she learned this from her attorneys, who seem to have guessed this answer.
In a separate Judicial Watch Freedom of Information Act (FOIA) lawsuit that first led to the disclosure of the "private" Clinton email system, U.S. District Court Judge Royce C. Lamberth called the Clinton email issue "one of the gravest modern offenses to government transparency" and ordered additional discovery into whether Hillary Clinton's use of a private email while Secretary of State was an intentional attempt to "stymie" FOIA.
"Mrs. Clinton's assertion that she used a separate email system as a matter of 'convenience' is simply not credible and is belied by evidence and testimony," said Judicial Watch President Tom Fitton. "We intend to pursue additional questions with Mrs. Clinton and others on this blatant attempt to hide her emails from Judicial Watch, the courts, Congress, and the American people."
In 2016, Clinton was required to submit under oath written answers to Judicial Watch's questions. Clinton objected to and refused to answer questions about the creation of her email system; her decision to use the system despite warnings from State Department cybersecurity officials; and the basis for her claim that the State Department had "90-95%" of her emails.
After a lengthy hearing on November 13, U.S. District Court Judge Emmet Sullivan ruled that Clinton must address two questions that she refused to answer under-oath.
Judge Sullivan read his opinion from the bench, deciding that the question about the creation of the email system was within the scope of discovery. Judge Sullivan rejected Clinton's assertion of attorney-client privilege on the question about the emails "in the State's system."
The answers now provided by Clinton are the latest development in a Judicial Watch FOIA lawsuit about the controversial employment status of Huma Abedin, former deputy chief of staff to Clinton. The lawsuit, which seeks records regarding the authorization for Abedin to engage in outside employment while employed by the Department of State, was reopened because of revelations about the clintonemail.com system (Judicial Watch v. U.S. Department of State (No. 1:13-cv-01363)). The court also granted discovery to Judicial Watch to help determine if and how Clinton's email system thwarted FOIA.

Judge Sullivan stressed that he had not presided over earlier proceedings in the case and that he was prepared to have Mr. Flynn change his plea or even ask for a dismissal of charges. At times, the judge seemed to implore Mr. Flynn to reopen the deal he made with special counsel Robert Mueller, implying that there was reason to believe his guilty plea had been wrongfully arranged.
Mr. Flynn wasn't interested. Over and over he told Judge Sullivan that he was comfortable with his confession, did not wish to have it reconsidered, and wanted the judge to pronounce sentence. But Judge Sullivan continued unsuccessfully to invite a change in Mr. Flynn's plea.

A federal judge blocked the Trump administration's attempts to speed up deportations for people with bogus asylum claims, ruling Wednesday that the president and his team had gone beyond what Congress intended.
Judge Emmet G. Sullivan - who a day earlier had excoriated former Trump National Security Adviser Michael Flynn - ordered the government to allow migrants with iffy claims to be given a full chance to make their case for asylum.
And he ordered the U.S. to un-deport plaintiffs in the case who were already ousted under the new policy, saying they deserve to be brought back and allowed to claim asylum.
"Because it is the will of Congress - not the whims of the executive - that determines the standard for expedited removal, the court finds that those policies are unlawful," Judge Sullivan wrote.
His decision overturns a move by former Attorney General Jeff Sessions, who had tried to block asylum claims of migrants who said they faced gang violence or domestic abuse back home.

Flynn, who plead guilty to lying to the FBI about his contacts with Russia, faced a fierce reprimand from U.S. District Judge Emmet Sullivan over the course of the dramatic hearing. Sullivan said he was "not hiding my disgust" for Flynn's crime, telling Flynn "arguably, you sold your country out." While Abrams criticized Flynn's team for including language in their sentencing memo that suggested he was entrapped, he said that did not excuse the judge for making unfounded accusations.
Sullivan questioned if prosecutors could have charged Flynn with treason for his work as an unregistered agent of Turkey during the campaign, but later walked back those scathing remarks and apologized - confessing he messed up the timeline of Flynn's work as an unregistered agent.
Abrams seemed particularly troubled by Judge Sullivan asking prosecutors about treason. "Words matter" Abrams asserted, but noted while he thought Flynn was treated "unfairly," he did not think it was politically motivated.
"This is a judge who has been appointed to the bench by Reagan, Bush and Clinton," Abrams said. "I think a lot of people on the right were counting on him to be the savior of Michael Flynn - but it ended up being the opposite today in court."
"He was either unprepared, or he was just being vindictive," he asserted.

Michael Flynn, President Trump's first national security adviser who began cooperating with special counsel Robert Mueller's investigation about a year ago, will be sentenced Tuesday for lying to the FBI.
Flynn's appearance in D.C. federal court before U.S. District Judge Emmet Sullivan will be viewed as a key milestone in an investigation that has prodded along for 19 months amidst high public intrigue and increasing vitriol from the president.
It is arguably the most highly anticipated sentencing yet in Mueller's investigation, and comes on the heels of the three-year sentence handed down to Trump's former personal attorney Michael Cohen for a slew of federal charges that sprung from details uncovered by Mueller's sprawling probe.
Flynn is unlikely to be sentenced to significant prison time. Citing his "substantial assistance" in ongoing investigations, Mueller recommended a lenient sentence for Flynn and has not asked for any jail time.
But Flynn and his attorneys may have scrambled his situation by arguing that Flynn was entrapped by the FBI into lying about his Russia contacts, giving new life to a theory among conservatives that the one-time Trump campaign surrogate was wronged by the Justice Department and Mueller.
Flynn's defense attorneys asked the court to spare him from prison and sentence him to at most one-year probation last week. They cited an FBI report stating that agents did not warn Flynn of the penalties for making a false statement "because they wanted Flynn to be relaxed, and they were concerned that giving the warnings might adversely affect the rapport."
Without disputing Mueller's characterization of the crime, they argued Sullivan should consider the circumstances of his interview when evaluating "the seriousness of the offense."
The court filing added fresh drama to Flynn's case and prompted Sullivan, who has a reputation as a hawk for any government misconduct, to ask Mueller to produce documents related to Flynn's interview, which the special counsel filed in redacted form on Friday and Monday.
It also inspired a firm rebuke from Mueller, who wrote that Flynn "chose" to lie and asserted that Flynn, a retired three-star Army general and former chief of the Defense Intelligence Agency, "knows he should not lie to federal agents."
Mueller also asked Sullivan to reject Flynn's attempt to "minimize the seriousness of those false statements to the FBI."
The developments have energized conservatives who have speculated that Flynn was mistreated by the FBI and duped into lying. One of the agents who interviewed Flynn was former agent Peter Strzok, who became a popular target among Republicans after a Justice Department inspector general probe unearthed text messages he sent critical of Trump prior to the 2016 election.
Trump himself suggested last week that Mueller's prosecutors gave Flynn a "great deal because they were embarrassed by the way he was treated" and attempted to "scare" him into making up stories. The president has also seized on accounts that agents did not observe outward signs indicating Flynn knew he was lying as evidence his former national security adviser was wrongly ensnared Mueller's probe.
Some legal experts say that the decision by Flynn to cast his FBI interview as deceptive could backfire, if the judge views him as downplaying his culpability.
"I think it's kind of surprising, and actually potentially risky on his part," said Randall Eliason, a George Washington University law professor and former assistant U.S. attorney in D.C. "That could actually work against him."
Federal sentencing guidelines call for Flynn to face between zero and six months in prison and up to a $9,500 fine. Others ensnared in Mueller's probe who have pleaded guilty to the same offense received small sentences, including George Papadopoulos, a former Trump campaign adviser who was released from prison after 12 days.
Flynn, once a vocal Trump campaign surrogate, served less than a month in the White House before he was forced to resign over revelations he misled Vice President Pence and other administration officials about his conversations with then-Russian ambassador Sergey Kislyak regarding sanctions on Moscow during the transition.

Two senior JD officials have confirmed to Fox that the department's Office of Inspector General is reviewing the role played in the Hillary Clinton email investigation by Peter Strzok, a former deputy director for counterintelligence at the FBI who was removed from the staff of SC Mueller earlier this year, after Mueller learned that Strzok had exchanged anti-Trump texts with a colleague.
The task will be exceedingly complex, given Strzok's consequential portfolio. He participated in the FBI's fateful interview with Hillary Clinton on July 2, 2016 - just days before then-FBI Director Comey announced he was declining to recommend prosecution of Mrs. Clinton in connection with her use, as secretary of state, of a private email server.
As deputy FBI director for counterintelligence, Strzok also enjoyed liaison with various agencies in the intelligence community, including the CIA, then led by Director Brennan.
House investigators told Fox they have long regarded Strzok as a key figure in the chain of events when the bureau, in 2016, received the infamous anti-Trump "dossier" and launched a counterintelligence investigation into Russian meddling in the election that ultimately came to encompass FISA surveillance of a Trump campaign associate.

On June 6, 2018 Chairman of the Senate Judiciary Committee Charles Grassley sent a three-page letter to Deputy Attorney General Rod Rosenstein, questioning the DOJ's and FBI's failure to provide information regarding Flynn's interview with the FBI and any exculpatory information with regard to Flynn's case that Special Counsel Robert Mueller's office may be withholding from Congressional inquiries. Grassley "noted that as both the Committee's request and the Department's reply note, any exculpatory evidence must be turned over to the defense. However, the Department's assurance that, 'Mr. Flynn is represented by skilled and experienced attorneys who ... will have access to favorable evidence in the government's possession,' is not relevant to the Committee's inquiry. Regardless of whether all exculpatory evidence has already been or will be produced to the defense, Congress has a wholly separate, independent, constitutional oversight interest in the information."

His lover Lisa Page reportedly resigned from the FBI in May 2018 - and was removed from Special Counsel on July 15th, 2017. She was fired two weeks before Strzok was fired from the special counsel.
Lisa Page's phone was scrubbed and not turned over to OIG until September 2018.
The only known 302 report provided by Robert Mueller to Judge Emmet Sullivan last week was a report created on July 19, 2017, six months after the setup of Flynn by FBI agents in the White House in January.

The Special Counsel's Office released key documents related to former National Security Advisor Lt. Gen. Michael Flynn Friday. Robert Mueller's office had until 3 p.m. to get the documents to Judge Emmet Sullivan, who demanded information Wednesday after bombshell information surfaced in a memorandum submitted by Flynn's attorney's that led to serious concerns regarding the FBI's initial questioning of the retired three-star general.
The highly redacted documents included notes from former Deputy Director Andrew McCabe regarding his conversation with Flynn about arranging the interview with the FBI. The initial interview took place at the White House on Jan. 24, 2017. The documents also include the FBI's "302" report regarding Flynn's interview with anti-Trump former FBI Agent Peter Strzok and FBI Agent Joe Pientka when they met with him at the White House. It is not, however, the 302 document from the actual January, 2017 interview but an August, 2017 report of Strzok's recollections of the interview. Flynn's attorney's had noted in their memorandum to the courts that the documents revealed that FBI officials made the decision not to provide Flynn with his Miranda Rights, which would've have warned him of penalties for making false statements.
McCabe, who has since been fired for lying to the DOJ's Office of Inspector General about leaking information to the media, also asked Flynn not to have his lawyer present during the initial meeting with the FBI agents. The July 2017 report, however, was the interview with Strzok. It described his interview with Flynn but was not the original Flynn interview. 'Apparent discrepancies within the 302 documents are being questioned by may former senior FBI officials, who state that there are stringent policies in place to ensure that the documents are guarded against tampering.'
On Thursday, FBI Supervisory Agent Jeff Danik told SaraACarter.com that Sullivan must also request all the communications between the two agents, as well as their supervisors around the August 2017 time-frame in order to get a complete and accurate picture of what transpired. Danik, who is an expert in FBI policy, says it is imperative that Sullivan also request "the workflow chart, which would show one-hundred percent, when the 302s were created when they were sent to a supervisor and who approved them." He stressed, "the bureau policy - the absolute FBI policy - is that the notes must be placed in the system in a 1-A file within five days of the interview." Danik said that the handwritten notes get placed into the FBI Sentinel System, which is the FBI's main record keeping system. "Anything beyond five business days is a problem, eight months is a disaster," he added. In the redacted 302 report Strzok and Pientka said they "both had the impression at the time that Flynn was not lying or did not think he was lying." Information that Flynn was not lying was first published and reported by SaraACarter.com.
Flynn was found guilty by Mueller on one count of lying to the FBI. Supporters of Flynn have questioned Mueller's tactics in getting the retired three-star general to plead guilty to this one count of lying. n the report, the two agents describe Flynn as being very open and noted said Flynn "clearly saw the FBI agents as allies." Flynn is described as discussing a variety of "subjects." The report includes his openness regarding Trump's "knack for interior design," the hotels he stayed at during his campaign, as well as other issues. The documents turned over by Mueller also reveal that other FBI personnel "later argued about the FBI's decision to interview Flynn."

It seems that a January 302 may not even exist.
Look, there are only two alternatives : either there is a 302 of the Jan 24 interview between General Flynn, Peter Strzok and Joe Pientka, or there is not.
You would hope that any FBI agent interviewing the NSA of the President, would keep contemporaneous notes and record them in a FBI 302. It's not just because it is FBI policy to do so, within 5 days of the interview.
It's because of the importance of the officials involved. As stated, General Flynn was the NSA of an inaugurated US government.

Surely not just the word of the disgraced and fired Peter Strzok, seven months later? That's what it looks like. Because if there's no 302, it appears to indicate that the evidence used by Mueller to trap the General, was based on the interview between Mueller's SC and Peter Strzok, on 22 August.
This, even though the same Peter Strzok admitted that General Flynn did not appear to be lying, when he interviewed him with FBI agent Pientka, on 24 January.

Robert Mueller's office had until 3 p.m. to get the documents to Judge Emmet Sullivan, who demanded information Wednesday after bombshell information surfaced in a memorandum submitted by Flynn's attorney's that led to serious concerns regarding the FBI's initial questioning of the retired three-star general.
The highly redacted documents included notes from former Deputy Director Andrew McCabe regarding his conversation with Flynn about arranging the interview with the FBI. The initial interview took place at the White House on Jan. 24, 2017.
Anything beyond five business days is a problem, eight months is a disaster
The documents also include the FBI's "302" report of the interview Flynn had with anti-Trump former FBI Agent Peter Strzok and FBI Agent Joe Pientka when they met with him at the White House. McCabe, who has since been fired for lying to the DOJ's Office of Inspector General about leaking information to the media, also asked Flynn not to have his lawyer present during the initial meeting with the FBI agents.
The July 2017 report, however, was the interview with Strzok. It described his interview with Flynn but was not the original Flynn interview.
The apparent discrepancies in with the 302s documents of the interview are being questioned by may former senior FBI officials, who state that there are stringent policies in place to ensure that the documents are guarded against tampering.

This is around the time that Strzok was working for the special counsel, and Robert Mueller was informed of the strongly biased text messages retrieved by the DOJ inspector general.
The July 19, 2017, interview notes with Strzok are the only FD-302 notes submitted with the filing.

The Washington, D.C.-based judge also suggested that Attorney General Jeff Sessions could be held in contempt over the deportation, according to the ACLU.
In June, Attorney General Jeff Sessions announced domestic violence and gang violence no longer qualify as sufficient reasons to grant asylum to immigrants.

Both sides in the special counsel's case against former national security adviser Michael Flynn are staying tight-lipped after a judge demanded information about why Flynn's sentencing is once again being delayed.
In a joint Monday court filing, Mueller and Flynn's lawyers only replied that they are not "ready for sentencing."
But responding to that filing, U.S. District Court Judge Emmet Sullivan late Monday ordered a July 10 hearing over the delays.
The delay could suggest Flynn is still in the process of cooperating with investigators in the special counsel investigation into Russia's meddling in the 2016 election.
Flynn in December pleaded guilty to one count of making false statements to the FBI about his conversations with then-Russian Ambassador Sergey Kislyak during the transition. He has not been sentenced in the case.
FLYNN'S SENTENCING DELAYED BY MUELLER TEAM FOR THIRD TIME
Mueller's team on Friday once again delayed sentencing Flynn, marking the third time sentencing has been postponed.
Mueller for months has vaguely cited "the status of the Special Counsel's investigation" for not offering a suggested sentencing date.
Over the weekend, Sullivan said the delays have forced the court to change its procedures in a presentence investigation. The judge demanded "reasons why the Court should expend the Probation Office's resources and depart from the Court's usual practice of ordering a presentence report, scheduling a sentencing date, and establishing a sentencing briefing schedule at the same time."
The joint filing from Mueller and Flynn's lawyers didn't offer specifics - but said "the parties will notify the court as soon as the matter is ready to be scheduled for a sentencing hearing." They asked Sullivan to begin the pre-sentence process, but that no specific sentencing date should be made.
The parties have asked to update the court Aug. 24.
Fueling intrigue in the case is a report from the House Intelligence Committee in May stating that former FBI Director James Comey testified to the committee that FBI agents did not believe that Flynn intentionally lied about talks with Russia's ambassador.
Comey, who has been on tour promoting his new book, has suggested his testimony about Flynn had been misunderstood, saying "someone misunderstood something I said. I didn't believe that and didn't say that."
But the House report also states that then-FBI Deputy Director Andrew McCabe said the FBI didn't "detect deception" from Flynn in the interview.

Senator Demands Truth on Flynn Interview
Senator Charles Grassley is ramping up pressure on the leaders of the Justice Department and the FBI to finally release the documents related to the interview of former General Michael Flynn.
Flynn pleaded guilty to one count of lying to the FBI last year, but accounts of the interview that led to the plea are conflicting. Seeking clarity, Grassley requested documents about the interview 15 months ago, but the FBI and DOJ refused to comply, citing an ongoing criminal investigation.
Instead, FBI director James Comey appeared before the Committee in March last year and provided wide-ranging testimony, including details about Flynn's interview. According to notes taken by the committee, "agents saw no
change in [Flynn's] demeanor or tone that would say he was being untruthful."
But Comey now denies making the statement and Grassley is demanding a set of documents to get to the truth. In a letter (pdf) to Deputy Attorney General Rod Rosenstein and FBI Director Christopher Wray, the senator demanded the information requested 15 months ago, which includes transcripts of Flynn's call with the Russian ambassador as well as the memos written by the agents who interviewed Flynn.
In the letter, Grassley substantiated his request by revealing that FBI Special Agent Joe Pientka was present at Comey's testimony and also recorded that Comey told the lawmakers that the agents who questioned Flynn "saw nothing that led them to believe [he was] lying."
Special Counsel Robert Mueller's team has requested to delay Flynn's sentencing several times. In February, the judge in the case demanded that the prosecutors produce all exculpatory evidence. Flynn's plea and the judge's request led Grassley to believe that the Justice Department had no excuses left to hold on to the information.
"Thus, although the case is not yet adjudicated, the Committee's oversight interest in the underlying documents requested more than a year ago now outweighs any legitimate executive branch interest in withholding it," Grassley wrote.
"So too does the Committee's interest in learning the FBI agents' actual assessments of their interview of Lt. Gen. Flynn, particularly given the apparent contradiction between what then Directory [sic] Comey told us in March 2017 and what he now claims," Grassley continued.
The Senator demanded to receive all relevant documents before May 25 and requested that Pientka be available for an interview with the Senate Judiciary Committee shortly after.
The names of the two agents who interviewed Flynn have never been officially confirmed, but according to sources who spoke to investigative journalist Sarah Carter, one of the agents was FBI Deputy Head of Counterintelligence Peter Strzok.
Strzok's involvement in the interview would create potentially insurmountable problems for Flynn's prosecutors. Strzok was removed from Mueller's probe after anti-Trump texts between him and his alleged FBI lover, Lisa Page, were discovered. Strzok was also the agent in charge of the FBI's Russia probe and the investigation into Hillary Clinton's emails. Both probes are now being scrutinized by federal prosecutors for investigative misconduct and abuses of government surveillance.
The judge in Flynn's case, Emmet Sullivan, handed a stunning rebuke to the Justice Department in 2009 by overturning the conviction of former Senator Ted Stevens and naming a special prosecutor to investigate the government lawyers who worked the case.
Sullivan's decision led to an extraordinary special investigation which found that the prosecution's team concealed information that could have helped Stevens defend himself. Law professors described the blistering 500-page report as a "milestone in the history of prosecutorial misconduct."
Stevens, a Republican, lost his long-held seat in the Senate before the legal struggle was over, allowing the Democrats to secure a filibuster-proof majority and pass Obamacare. Stevens died in a 2010 plane crash.
