Trump's Former DHS Secretary Lobbies Senate to Approve Biden's DHS Pick

Kevin McAleenan, former acting secretary of the Department of Homeland Security (DHS) for the Trump administration, is lobbying senators to approve President Joe Biden's pick to lead the agency, Alejandro Mayorkas.

In a letter leaked to CNN's Jake Tapper, McAleenan writes to the Senate Homeland Security and Governmental Affairs Committee asking members to quickly approve Mayorkas's nomination.

"Ali Mayorkas is ... committed to the success of the Department, the people who serve in it, and he understands the essential role it maintains in protecting our homeland and our values. ... I urge the Committee to complete its work and the Senate to confirm Alejandro Mayorkas as the next Secretary of Homeland Security," McAleenan wrote.

The letter comes despite Mayorkas's scandal-plagued background in the Obama administration where he was accused by the DHS inspector general of acting "improperly" for securing EB-5 visas for wealthy foreign investors.

During a hearing, Mayorkas defended his actions, saying he "fixed problems," and promised to help Congress pass an amnesty for 11 to 22 million illegal aliens despite its potential to drive an uncontrollable mass migration to the United States-Mexico border.

McAleenan was one of a handful of Washington, DC, insiders from the national security establishment who was promoted to the top job at DHS while Donald Trump was president. Others included Gen. John Kelly, Kirstjen Nielsen, Elaine Duke, and Chad Wolf.

Days before resigning, McAleenan gave an interview where he attacked Trump's policy at the U.S.-Mexico border. McAleenan claimed the Zero Tolerance policy "went too far" and repudiated the term "illegal alien."

McAleenan had also been accused of leaking the details of Immigration and Customs Enforcement (ICE) raids to the establishment media in order to stop the operation. About a month after his announced resignation, a report alleged that McAleenan had led a quiet front inside DHS to stoke opposition to Trump's "Remain in Mexico" policy.

Sen. Josh Hawley (R-MO), who sits on the committee, has said he will oppose Mayorkas's nomination.

Trump to nominate Wolf as secretary of Homeland Security

Aug. 25 (UPI) – President Donald Trump on Tuesday said he plans to nominate Chad Wolf to be secretary of the Department of Homeland Security in an effort to make official the role he has fulfilled in a temporary capacity since November.

The president made the announcement on Twitter.

"I am pleased to inform the American Public that Acting Secretary Chad Wolf will be nominated to be the Secretary of Homeland Security. Chad has done an outstanding job and we greatly appreciate his service!" Trump wrote.

The president first named Wolf as acting secretary in November, the same day the Senate voted to confirm him as undersecretary of the department's Office of Strategy, Policy and Plans.

Wolf replaced former acting Secretary Kevin McAleenan, whom was never formally nominated to serve in the position. McAleenan replaced Kirstjen Nielsen.

Before her, Elaine Duke served as acting secretary after John Kelly's July 2017 departure to serve as chief of staff. Kelly is no longer with the White House.

Wolf has worked at the Department of Homeland Security since the beginning of Trump's administration, both at the Transportation Security Administration and as chief of staff to Nielsen.

The former Acting Secretary for President Trump's Department of Homeland Security (DHS) admits that she helped weaken the legal case for the administration's rescission of former President Obama's Deferred Action for Childhood Arrivals (DACA) program.

In September 2017, then-Attorney General Jeff Sessions rescinded Obama's DACA program that has allowed nearly 800,000 illegal aliens to remain in the U.S.

At the time, then-Acting DHS Secretary Elaine Duke - a former DHS official under former President George W. Bush - signed the inter-agency memo to end DACA but now admits she purposefully helped weaken its legal standing by not putting any policy reasons for the program's rescission.

Duke said she wanted Congress to pass a DACA amnesty to make sure the hundreds of thousands of illegal aliens enrolled in the program could permanently remain in the U.S.

The New York Times reported in Duke's first interview since leaving DHS:

Ms. Duke said she did not include policy reasons in the memo because she did not agree with the ideas being pushed by Mr. Miller and Mr. Sessions: that DACA amounted to an undeserved amnesty and that it would encourage new waves of illegal immigration. [Emphasis added]

She said she still agreed that DACA "isn't a legal program," but hoped that Republicans and Democrats in Congress would eventually find a way to allow the undocumented immigrants covered by the program to live and work permanently in the United States. [Emphasis added]

Duke's refusal to include specific policy reasons for ending DACA was vital to the U.S. Supreme Court's recent decision that demanded the Trump administration refile paperwork to end the program, as Breitbart News's Joel Pollack reported at the time:

In a complex, 5-4 opinion, in which Chief Justice John Roberts joined the Court's four liberal justices, the majority held that the administration had failed to offer sufficient reasons for rescinding the policy, and had failed to provide enough consideration about what would happen to the 700,000 people who had registered for the DACA program. [Emphasis added]

Likewise, Duke revealed in the Times interview that she will not yet commit to voting for Trump for a second term against Democrat Joe Biden.

"That's a really hard question," Duke told the Times when asked if she would vote for Trump in November. "But given the choices, I don't know yet."

Writer Catches the New York Times Accidentally Reporting Who Sabotaged the DACA Decision at SCOTUS

The New York Times reported a bombshell on Friday that they didn't even realize. In a report attempting to smear Donald Trump for wanting to sell Puerto Rico, the New York Times inadvertently revealed who was responsible for the loss at the Supreme Court over Deferred Action for Childhood Arrivals (DACA).

On Thursday, the Supreme Court ruled against President Trump's efforts to end Barack Obama's immigration program called Deferred Action for Childhood Arrivals (DACA), which granted pseudo amnesty for minors brought to the United States illegally.

Chief Justice John Roberts, who was nominated to the court by George W. Bush, joined the four liberals on the court. Roberts argued that the Trump administration's ending of the program was "arbitrary and capricious," and violated federal law governing administrative procedure.

Many were left scratching their heads at what administrative procedure could be relevant to reversing an executive order.

Lower spends the bulk of the article correctly lampooning the increasingly clowinsh New York Times for desperately flailing about for any angle they can dig up to make President Trump look bad/incompetent/racist. The story makes up for a paucity of substance with unintentional comedy.

Duke, Lower writes, had a problem with Trump's "hard talk" about Puerto Rico's corruption and how it was disrupting the island territory's recovery from devastating hurricanes.

It just becomes more clear by the day how radical and anti-American the New York Times is and always has been.

Under Article 2 of the US Constitution, the Presidency is granted control of the Armed Forces. Few SCOTUS cases limiting this in regards to Habeus Corpus apply in the cases which are emerging here EXCEPT that the defendants are involved in High Treason. Then, Article 2§2 clause 2 of the US Const grants the President the right to suspend habeus corpus, when it is cited in conjunction with Military Commissions Acts which have resulted in Miltary Detainee Acts. Once their defences reach this point, they will be sunk. Presumably in the first motions.

Second federal appeals court rules against Trump administration over DACA rollback

A second federal appeals court on Friday ruled against the Trump administration in its attempt to rollback the Obama-era Deferred Action for Childhood Arrivals program and said its decision to do so was unlawful. A divided three-judge panel on the 4th U.S. Circuit Court of Appeals said in its ruling that the Department of Homeland Security's decision to rescind the DACA program violated federal law because "it was not adequately explained and thus was arbitrary and capricious." The Richmond-based federal appeals court is the second appeals court to rule against President Trump in his attempt to wind down the DACA program, which was implemented by the Obama administration in 2012 and protected immigrants brought to the U.S. illegally as children from the threat of deportation.

In November, the 9th U.S. Circuit Court of Appeals upheld a lower court order blocking the government from rescinding the DACA program. The San Francisco-based court said then that plaintiffs in that challenge to the administration's efforts to end DACA were likely to succeed in their claim that the rescission "is arbitrary, capricious, or otherwise not in accordance with law." The Justice Department has asked the Supreme Court to take up the dispute over its attempted rollback, though the court has not acted on numerous petitions currently before it.

The Trump administration announced in 2017 that it would be ending the DACA program, and the Department of Homeland Security predicated its decision on the grounds DACA was unlawful to begin with. But the president's move was met with a host of lawsuits filed by immigrant-rights groups and individuals who argued DACA's wind down violated federal law and the Constitution. Federal district court judges in Washington, D.C., New York, and San Francisco delivered losses to the Trump administration and blocked it from moving forward with DACA's rollback. But one judge in Greenbelt, Md., sided with the Trump administration and said the president acted within his authority to wind down the Obama-era program. The 4th Circuit, however, reversed the ruling from the federal judge in Maryland that upheld DACA's rescission.

In its ruling against the Trump administration, the 4th Circuit said the Department of Homeland Security failed to account for those affected by the decision. "Hundreds of thousands of people had structured their lives on the availability of deferred action during the over five years between implementation of DACA and the decision to rescind it," the court said. "Although the government insists that Acting Secretary [Elaine] Duke considered these interests in connection with her decision to rescind DACA, her memo makes no mention of them." Judge Julius Richardson, a Trump appointee, dissented and said the executive branch's rollback of DACA is judicially unreviewable. "We in the judicial branch have a narrowly circumscribed role. It is not our place to second-guess the wisdom of the discretionary decisions made by the other branches," Richardson wrote. "The rescission of DACA was a controversial and contentious decision, but one that was committed to the executive branch."

Adam Clark of World Relief is lamenting that they no longer get any insider information from the government!

A refugee ceiling of 25,000 would be the lowest since the passage of the 1980 Refugee Act, and it would follow the hard-line approach to all types of immigration touted by White House adviser Stephen Miller. Last year, Miller pushed for even more aggressive cuts to the refugee resettlement program - suggesting a cap of 15,000 - but faced pushback from other administration officials, including former Secretary of State Rex Tillerson and former Acting Secretary of Homeland Security Elaine Duke. With Tillerson's and Duke's departures earlier this year, refugee advocates fear that Miller may prevail this time around. "We don't get any insider information. We just hear what the government chooses to announce to the public, and then we have to adjust accordingly," said Adam Clark, director of World Relief Durham, which has a State Department contract to resettle refugees. When Trump set a cap of 45,000 last year, Clark said, roughly 60,000 already-vetted refugees were left in limbo. "Since Trump took office, we've learned to prepare for the worst. More cuts would be tragic, but they wouldn't surprise us."

The drastic decrease in refugee admissions has led to the weakening of decades-old systems that help refugees transition to life in their new home, making it likely that the program will have to be rebuilt if a future U.S. administration moves toward welcoming more refugees. Many refugee centers have shut down, while many others have been forced to cut staff, said Clark. "What made matters worse was, at the beginning of the fiscal year 2016, when [President Barack Obama] was pushing to take more refugees, many of us were told to beef up our staff in order to be able to accept 85,000 to 100,000. Then, after the inauguration of Donald Trump, the number was slashed to 45,000. Several hundred staff members lost their jobs."

Obama promised us 100,000 so we beefed up or staff and now we have to fire them!

Readers, have you ever seen such a dysfunctional and chaotic way to run a program where the government pays these supposed non-profit groups on a refugee per head basis and then when numbers fluctuate, the agencies run to the media and wail about their budgetary shortfall!

The result has been the reduction of the overall refugee flow to a bare trickle. "The pipeline has dried up," said Clark of World Relief. "When there aren't enough people abroad to interview and process the cases, there is no way to keep the stream of vetted refugees coming." In the past year, Clark said, his Durham office has seen only about one-third of its usual number of cases. "In 10 years of this work, I've seen numbers fluctuate somewhat, but the changes under the Trump administration have been by far the most drastic," he said. "This feels like a different kind of change."

Clark goes on to report that they aren't getting as many Muslims as they would like in North Carolina.

"We've definitely seen a shift in the nationalities of our clients since Trump," said Clark. "We're getting fewer Afghans, no Syrians - the pattern seems clear."

Sirine Shebaya, senior staff attorney at the national civil rights and legal organization Muslim Advocates, said the religious makeup of the incoming refugee pool is striking as well.

"Despite the fact that over half of the world's refugees come from three Muslim-majority countries - Syria, Somalia, and Afghanistan - admissions of Muslim-identifying refugees fell by 94 percent between January and November 2017," she said. As of May, only about 2,000 Muslim refugees had been admitted this fiscal year, down from 38,900 in fiscal year 2016. Syria, Iraq, and Somalia are no longer among the top five countries of origin for refugees, reversing a trend that had taken shape in recent years. Shebaya blames a combination of burdensome vetting measures, Trump's myriad bans, and an overall anti-Muslim sentiment for the reversal. "It seems that the government is intent on making it as difficult as possible for Muslims to come to the United States, whether as refugees or immigrants."
