Assange visitors given green light to sue CIA
A US federal judge has ruled that lawyers and journalists, who claim their phones were illegally searched, can seek damages
A federal judge has ruled that four US nationals can proceed with their lawsuit against the CIA in court. They claim their electronic devices were illegally searched on behalf of the agency when they visited WikiLeaks founder Juilian Assange at the Ecuadorian embassy in London.
The decision by Manhattan-basedUS District Court Judge John Koeltlon Tuesday relates to a case filed by attorneys Margaret Ratner Kunstler and Deborah Hrbek, as well as John Goetz and Charles Glass - journalists who report on national security issues. Their complaint was initially submitted in August 2022, but the CIA sought to have it dismissed.
The case focuses on events at the Ecuadorian embassy in 2017 and 2018, when the four individuals visited Assange. Undercover Global, the now-defunct Spanish firm hired by the diplomatic mission to provide security, was allegedly compromised by US spies. It had installed secret cameras and microphones to snoop on Assange, and shared personal data about visitors with the CIA, according to press reports and court filings.
The complaint wasdirected against Undercover Global, its CEO David Morales Guillen, the CIA and its then-director Mike Pompeo.The latter had publicly branded WikiLeaks "a non-state hostile intelligence service," and expressed animosity towards Assange. The plaintiffs claim this attitude motivated the agency's monitoring by a proxy.
Koeltl partially granted the CIA's request to dismiss, ruling that the plaintiffs could not hold Pompeo personally accountable for alleged violations of their constitutional protection from unreasonable search and seizure. He also struck down their complaints about hidden cameras, but allowed the claims against the agency regarding personal devices to proceed.
According to US media reports, Pompeo's CIA was prepared to resort to drastic measures in targeting Assange. He was hiding at the embassy over fears of being arrested and extradited to the US. An investigation by Yahoo News based on multiple interviews with agency officials claimed in 2021 that Pompeo had considered various scenarios for getting Assange, including possible kidnapping or assassination.
Ecuador allowed British law enforcement to arrest Assange in 2019, after a new government in Quito revoked his asylum. He has since been detained at a top-security prison. London's High Court is set to review his final legal bid to stop extradition to the US in February, WikiLeaks announced on Tuesday.

Some of the nation's most powerful law firms are warning America's elite universities to crack down on antisemitism on campus - or the schools and their students will face real consequences.
"Over the last several weeks, we have been alarmed at reports of anti-Semitic harassment, vandalism and assaults on college campuses, including rallies calling for the death of Jews and the elimination of the State of Israel," more than two dozen law firms wrote in a letter obtained by CNN. "Such anti-Semitic activities would not be tolerated at any of our firms."
The law firms added they would not "tolerate outside groups engaging in acts of harassment and threats of violence, as has also been occurring on many of your campuses," and say they are putting universities on notice about hiring implications in the future.

"As employers who recruit from each of your law schools," the law firms wrote, "we look to you to ensure your students who hope to join our firms after graduation are prepared to be an active part of workplace communities that have zero tolerance policies for any form of discrimination or harassment, much less the kind that has been taking place on some law school campuses."
The law firms behind the letter are among the most sought-after landing spots for students who graduate from these same law schools, including: Cravath, Swaine & Moore; Debevoise & Plimpton; Kirkland & Ellis; Paul, Weiss, Rifkind, Wharton & Garrison; Skadden, Arps, Slate, Meagher & Flom; and Wachtell, Lipton, Rosen & Katz.
Since the initial publication of the letter, additional law firms have signed on. A full list is available here.
The letter campaign was spearheaded by Joe Shenker, senior chair of Sullivan & Cromwell, according to the New York-based law firm.
The letter was sent Monday to the deans of law schools including Yale, Harvard, Columbia, the University of Virginia, Georgetown, the University of Pennsylvania, Cornell, the University of Michigan, New York University and Stanford, a person familiar with the matter told CNN.
"There is no room for anti-Semitism, Islamophobia, racism or any other form of violence, hatred or bigotry on your campuses, in our workplaces or our communities," the letter said.
Impact is already being felt
There have already been real-world consequences for some students.
Last month, the president of the NYU Student Bar Association, Ryna Workman, released a letter saying Israel "bears full responsibility for this tremendous loss of life." Law firm Winston & Strawn promptly pulled a job offer to that NYU student, who had previously worked as a summer associate at the firm.
Afterwards Workman said in a statement that her message "came across as insensitive to the suffering of Israeli's during a time of crisis and that is not what I intended." Workman also said they've received multiple death threats attacking "all facets" of their identity after the initial comments.
In the letter from the law firms on Wednesday, they requested a dialogue to understand how the law schools are "addressing with urgency this serious situation at your law schools."

On the same day the letter was sent, some elite universities grappling with sky-high tensions over the Israel-Hamas war launched new efforts to fight antisemitism.
Facing a backlash from donors calling for her ouster, University of Pennsylvania President Liz Magill on Wednesday unveiled an action plan to counter antisemitism. That plan was designed after convening with national and local Jewish leaders, faculty, staff, students and alumni, the school said.
"This is an incredibly challenging moment in the world, and we are feeling its reverberations on our campus," Magill wrote in a letter to the Penn community on Wednesday. "We can and will do better to combat antisemitism and to reject hate in all its forms."
Columbia University also announced Wednesday it is forming a task force on antisemitism following a "series of antisemitic incidents" on campus.
"One would hope that by the twenty-first century, antisemitism would have been relegated to the dustbin of history," Columbia University leaders said in a statement. "But it has been rising here in New York City, across the country, and around the world in recent years."
Gillian Lester, dean of the Columbia Law School, recounted how an antisemitic epithet was recently directed toward a visibly Jewish member of the law school.
Last month, a Columbia student hanging up posters on campus in support of Israel was assaulted.
A Cornell University student accused of posting online threats to members of the school's Jewish community was arrested earlier this week and charged federally with "posting threats to kill or injure another using interstate communications."

Deutsche Bank Whistleblower Who Gave Up $8.25 Million Award Is Going Bankrupt
At the height of the financial crisis, when risk assets were imploding and counterparties were in danger of overnight collapse, Deutsche Bank avoided failure and nationalization by fabricating the value of its $130 billion derivative portfolio of "leveraged super senior" trades.
Some history: back in 2005, these trades were seen as "the next big thing" in the world of credit derivatives, something which DB at the time was building a massive position in. They were designed to behave like the most senior tranche of a typical collateralized debt obligation, where assets such as mortgages or credit default swaps are pooled to give investors varying degrees of risk exposure. Deutsche became the biggest operator in this market, which involved banks buying insurance against the possibility of default by some of the safest companies.
There was just one problem: when it was building up its portfolio, Deutsche never accounted for the possibility of the financial world nearly collapsing. Which is why as the illiquid portfolio was careening, instead marking it to market - an act that would have resulted in the bank's insolvency - DB's risk managers misstated the value of the positions by anywhere from $1.5bn to $3.3bn.
Several years later, in 2012, the SEC found out about this, and in 2015 slapped a $55 million fine on Deutsche Bank for this criminal fabrication (of course, nobody went to jail). "At the height of the financial crisis, Deutsche Bank's financial statements did not reflect the significant risk in these large, complex illiquid positions," said Andrew Ceresney, then-director of the SEC's enforcement division (who after his particular "revolving door" is currently a partner in the Litigation Department of Debevoise & Plimpton where he represents the same banks he was prosecuting during his SEC tenure); "Deutsche Bank failed to make reasonable judgments when valuing its positions and lacked robust internal controls over financial reporting", he said.
Not the reason why the SEC learned about DB's massive mismarked derivative exposure, is because two former employee whistleblowers, Matthew Simpson and Eric Ben-Artzi, told it: the duo alleged that if Deutsche had accounted properly for its positions, its capital would have fallen to dangerous levels during the financial crisis and it might have required a government bailout to survive. The highest estimate for the unaccounted loss was $12bn. Which explains why Deutsche Bank was desperate to manipulate the numbers.
End result: DB got its wristslap with a token fine, the SEC came out looking like it knew what it was doing, and - as we learned back in August 2016 - the two whistleblowers got major awards for helping the SEC collected the $55MM fine, amounting to 15% each.
Only, something unexpected happened: one of the whistleblowers who helped expose the false accounting at Deutsche Bank turned down a multimillion-dollar award from the Securities and Exchange Commission in protest against the agency's failure to punish executives at the bank.
In a move that sent shockwaves across the pragmatic Wall Street, Eric Ben-Artzi, the former Deutsche risk officer, told the SEC he is declining his share of a $16.5 million payout - the third largest in the whistleblower program's history - which represents 30% of the $55 million Deutsche Bank fine.

On pg. 503 a document lauds the work of an individual (name redacted) in the public corruption investigation of WJC and the controversial Marc Rich and Pincus Green pardons. This agent worked from Feb. 2001 to November 2002. Further in the 2004 document, "Despite the likely declination of prosecution in this sensitive investigation…."
Who was the US Attorney for the SDNY in 2001, 2002? Mary Jo White (who was followed in 2002 by James Comey). Reading about Mary Jo White was interesting: "…in March 1993 was appointed by President Bill Clinton as U.S. Attorney for the Southern District. She is noted for having led the prosecution of John Gotti and overseen those of the terrorists responsible for the 1993 World Trade Center bombing, chief among them Sheik Omar Abdel Rahman and Ramzi Yousef.[9]"

Mary Jo White served as the US Attorney for the SDNY from 1993 to 2002, during which period former President Bill Clinton was in office. White held the SDNY position during the time period in which painter Maria Farmer told The New York Times that she reported crimes by both convicted sex offender Jeffrey Epstein and Maxwell to authorities.
Former President Barack Obama would later appoint her as the 31st Chair of the Securities and Exchange Commission, in which role she served from April 2013 to January 2017. She now serves as senior chair at Debevoise & Plimpton, a New York law firm.
The Daily Caller News Foundation repeatedly asked White why Maxwell was not arrested until July 2020, though reports of her alleged misconduct date back to 1996. On Friday, Debevoise spokeswoman Greer Hunter refused to comment on the matter.

Rockefeller University Has Admitted "There Were Warning Signs" That A Doctor Sexually Abused Children For Decades
Reginald Archibald, a former doctor and scientist at Rockefeller University Hospital, sexually abused many of his child patients for decades, and his employer had multiple "warning signs" about his behavior, according to a report released Thursday by Rockefeller.
The report is the result of an investigation into Archibald's alleged misconduct that started in the fall of 2018, after a former patient lodged a complaint with the hospital. The investigation, conducted by a law firm hired by Rockefeller, reveals that the university also received many other complaints as far back as the early 1960s against Archibald, who worked at the hospital from the 1940s to the 1980s and died in 2007.
"What's most outrageous is they knew going back for decades about this man, and what they did is typical of large institutions: They protected the institution over the safety and welfare of the children," Paul Mones, an attorney representing 200 of Archibald's former patients, told BuzzFeed News.
Archibald, a pediatric endocrinologist who studied and treated issues related to childhood growth and maturation, fondled young patients, had them masturbate, masturbated them until they ejaculated, pulled their erect penises, brushed his face against their genitals, touched them while having them sit naked in his lap, and took semen samples from them without any professional justification, according to the report. Archibald also published research that included photographs he'd taken of nude patients, ostensibly to document their growth and sexual maturation.
Several former patients told BuzzFeed News earlier this year that these doctor visits, which they stayed silent about for years, were traumatizing, humiliating, and life-altering. Two journals are now planning to acknowledge the patients' allegations in the scientific record.
Archibald's misconduct was apparently not confined to the doctor's office. He also invited patients to his summer cabin in Canada, and a few of them told investigators that sexual abuse took place there, according to the report.
For its investigation, the law firm Debevoise & Plimpton interviewed more than 1,000 witnesses and reviewed Archibald's records, patient records, and other Rockefeller documents. Its report acknowledges that, at this point, many witnesses have died or do not remember what happened.
"With the benefit of hindsight, however," it concludes, "and viewed in light of today's greater knowledge of sexual abuse and current standards of appropriate practices and procedures for studies and treatment of children, there were warning signs that could have been seen, appreciated or further pursued earlier."
Mones said the report's findings verify his clients' experiences with Archibald. But he criticized the report for at times attempting to rationalize the doctor's misconduct. Also, he said, it downplayed the university's failure to act on concerns about him.

US Presidents Donald Trump and his Colombian counterpart Ivan Duque Marquez said in a joint statement on Wednesday that Washington and Bogota are determined to work together to resolve the ongoing political crisis in Venezuela. However, Trump declined to clarify if the United States will send additional troops to Colombia amid the ongoing crisis in neighboring Venezuela.
Trump said earlier in an interview with the CBS broadcaster that US military intervention in Venezuela was "an option".

In short, suspicions of vote fraud?
That's too bad, because a race-based consent decree negotiated by Democrats against the Republican National Committee a generation ago still has tied the RNC's hands, and GOP officials could be cited for contempt - or worse - if they try to make sure American elections are clean.
Impossible?
No. Fact.
The case is the Democratic National Committee vs. the Republican National Committee, originally from 1982.
Democrats alleged Republicans were trying intimidate minority voters in New Jersey and brought the legal action. The RNC, inexplicably, decided to agree to a consent decree before a Democrat-appointed judge rather than fight the claims.
The judge, Dickinson Debevoise, appointed by Jimmy Carter, later retired but decided he would continue to control the case. The decision requires the RNC - but not the DNC - to "refrain from undertaking any ballot security activities in polling places or election districts where the racial or ethnic composition of such districts is a factor in the decision to conduct, or the actual conduct of, such activities there and where a purpose or significant effect of such activities is to deter qualified voters from voting; and the conduct of such activities disproportionately in or directed toward districts that have a substantial proportion of racial or ethnic populations shall be considered relevant evidence of the existence of such a factor and purpose."
The rest of the agreement essentially requires the RNC to follow applicable state and federal election laws.
But the section cited above has been used for decades to warn off Republicans from any challenge to evidence of voter fraud in districts with "racial or ethnic populations."
The law has remained, even though the RNC recently challenged it at the appellate level only to be turned down by Judges Joseph Greenaway Jr., appointed by Bill Clinton; Dolores Sloviter, appointed by Carter; and Walter Stapleton, appointed by Ronald Reagan, in the 3rd U.S. Circuit Court of Appeals.
It now is pending before the U.S. Supreme Court.
But two election veterans both told WND it still is hurting the fight against voter fraud in the United States.

Freedom of Information Filing Seeks Disclosure of CIA Records on Khashoggi Killing
NEW YORK-The Open Society Justice Initiative has today filed a Freedom of Information Act request with the U.S. Central Intelligence Agency and other federal agencies seeking the disclosure of all records relating to the killing of U.S. resident and Washington Post columnist Jamal Khashoggi.
The FOIA request, prepared with assistance from the law firm Debevoise & Plimpton LLP, covers records "including but not limited to the CIA's findings on the circumstances under which he was killed and/or the identities of those responsible."
In addition to the CIA, the request was filed with the U.S. Departments of State, Justice and Defense, as well as with the Federal Bureau of Investigation, the National Security Agency, and the Office of the Director of National Intelligence.
In making the request, the Justice Initiative argues that disclosure of the records is essential "for a public evaluation of the federal government's efforts to investigate and hold accountable those responsible for Khashoggi's killing." It also asserts that "the American public has a right to know what its government is doing to uphold human rights and the rule of law" in the context of the murder.
James A. Goldston, executive director of the Open Society Justice Initiative, underscored that the FOIA request is vital not only to enable robust discussion of a matter of intense public interest in the United States, but also to contribute to accountability for a horrific crime:
"So long as the evidence in the CIA's possession is suppressed, the perpetrators of this murder may be more likely to get away with it. Only by making available what the CIA knows can prosecutors and judges-not just in the U.S., but around the world where jurisdiction may lie-be able to bring the perpetrators to justice."
Amrit Singh, lead lawyer for the Justice Initiative on the filing, said:
"In the face of widespread public and bipartisan Congressional outrage about the murder of a U.S. resident, the Trump Administration has responded with what appears to be a cover-up. The Administration's own selective disclosures appear to have been misleading and plainly insufficient. The full disclosure of these records is a vital step towards ending impunity for the perpetrators, no matter how powerful they might be, and allowing the public to evaluate for itself how the U.S. government is responding to this flagrant disregard for the rule of law."
The Justice Initiative is a public interest law center that has operated as part of the Open Society Foundations since 2003. It has participated in more than 100 cases in national and international courts around the world, including on behalf of the victims of police torture and killings in custody. It also won judgments against three European nations-Poland, Romania, and Macedonia-over their participation in the program of secret rendition, imprisonment, and torture run by the CIA after the attacks of September 11, 2001.

Puerto Rico Bond Default Called Over Fiscal Plan's Debt Cuts
Puerto Rico's entry into court protection is exacerbating tensions between Wall Street firms holding sales-tax bonds that the territory's federal overseers want impaired. Bank of New York Mellon alleges default on $17 billion in sales tax bonds
Bank of New York Mellon Corp. , the trustee for $17 billion in sales-tax bonds known as Cofina s, notified Puerto Rico in a Thursday letter that it believes events of default have occurred, according to a copy reviewed by WSJ Pro Bankruptcy. The alleged defaults stem from the controversial fiscal plan that Puerto Rico's oversight board adopted as its framework for restructuring a $73 billion mountain of public debt. Last week Governor Ricardo Rossello signed a local law to comply with the fiscal plan that allows him under certain circumstances to break the lockbox securing the sales tax revenues and move them into Puerto Rico's grasp. "As a result of these limitations and restrictions on Cofina's rights and ability to meet its obligations to bondholders, the commonwealth's enactment of the fiscal plan compliance law constitutes a default," BNY Mellon said in the letter. A spokeswoman declined to comment further.
A spokesman for the federal oversight board didn't immediately respond to a request for comment. Creditors holding Cofina bonds, which Puerto Rico began issuing a decade ago as an alternative way to borrow, have continued to be paid even after Puerto Rico stopped servicing other debts. Even so, Bank of New York's position has become increasingly untenable. All signs indicate that Cofina's special status is likely to end, leaving the bank caught between senior creditors arguing that the oversight board's stated plans to confiscate the pledged sales tax revenues are a default, and junior creditors who want to avoid an acceleration of the senior bonds.
This week the oversight board placed Puerto Rico under a restructuring proceeding akin to bankruptcy that empowers a federal court to write down bonds by force. The fiscal plan allocates roughly $800 million a year in payments for creditors, compared with the $35 billion they are owed over the next decade. Sales taxes that had previously serviced only Cofina bonds would be commingled with other revenue streams and used for general purposes.
U.S. Supreme Court Chief Justice John Roberts on Friday appointed U.S. District Judge Laura Taylor Swain of the Manhattan, New York federal court to preside over the unprecedented proceeding. Federal officials didn't invoke the same bankruptcy option for Cofina, the public entity that issued the sales tax bonds, though they could do so at any time without public notice. Judge Swain is a Brooklyn native who practiced employment law at Debevoise & Plimpton LLP before assuming a bankruptcy judgeship in 1996. Former President Bill Clinton appointed her to the federal bench in 2000. Whitebox Advisors LLC, a holder of senior bonds, and Ambac Assurance Corp., which guarantees senior bonds, recently sued Bank of New York complaining that the trustee had failed to protect their interests and prioritize their holdings over those of junior creditors. Accelerating the maturity of senior bonds after a default would put their claims ahead of subordinated holders that include some of Puerto Rico's largest mutual-fund creditors.
Negotiations between Puerto Rico and major creditor groups collapsed last week when the territory indicated it wanted deeper debt concessions from Cofina creditors than from competing general obligation bondholders. The territory released offers to pay sales tax bondholders a maximum of 58 cents on the dollar, compared with 77 cents for so-called G.O. creditors.
Puerto Rico later revised its offer to 90 cents on the dollar for the G.O.s, after which the oversight board stopped negotiations and placed the territory under bankruptcy protection, as reported by WSJ Pro Bankruptcy.

SEC Chair Gensler Will Tiptoe Around Questions of Meaningful Reform on Wall Street at Today's Senate Banking Hearing
The Senate Banking Committee will hold a hearing today titled "Oversight of the U.S. Securities and Exchange Commission." The SEC needs a lot of oversight because that's the federal agency that didn't catch Bernie Madoff for more than four decades, despite a financial expert, Harry Markopolos, sending the SEC detailed written reports (in 2000, 2001, 2005, 2007 and 2008), making the case that Madoff was running a Ponzi scheme.
The SEC was also asleep at the switch while Wall Street banks concocted their subprime debt bombs, then bet billions of dollars that they would fail while selling them to public pension funds as good investments. Those subprime bombs blew up in 2008, cratering the U.S. economy and leaving millions of innocent Americans jobless and homeless. More recently, the SEC was caught flat-footed when the family office hedge fund, Archegos Capital Management, blew up and the public learned for the first time that Wall Street banks have been disguising massive, highly-leveraged stock positions held by these hedge funds as belonging to the banks.
The SEC is also currently turning a blind eye to a practice that screams illegal manipulation: it is allowing the serially-charged mega banks on Wall Street to trade their own bank's stock in their own Dark Pools. The reason that the Senate Banking Committee has to closely police the SEC with these regular oversight hearings is because this Senate Banking Committee has repeatedly confirmed the outside counsel to the largest trading banks on Wall Street to serve as Wall Street's top cop. The guy before Gensler, SEC Chairman Jay Clayton of Sullivan & Cromwell, was nominated by President Donald Trump. Clayton had legally represented 8 of the 10 largest Wall Street banks in the three years prior to the Senate Banking Committee confirming him to Chair the SEC. Before Clayton, the Senate Banking Committee had confirmed Mary Jo White, a law partner at Debevoise & Plimpton, as SEC Chair. White was nominated by President Barack Obama. Between White and her husband, John White, a law partner at Cravath, Swaine & Moore LLP, they had represented almost every major trading bank on Wall Street.

If the Senate Banking Committee genuinely wanted a real cop on the beat on Wall Street, it would stop confirming captured regulators. The jury is still out on Gensler, who previously spent 18 years at Goldman Sachs and served as Chair of the Commodity Futures Trading Commission under President Obama. Gensler's initial performance as SEC Chair earned him an early black eye when he picked a 20-year Wall Street bank defender as his crime chief. That crime chief, Alex Oh of the Wall Street go-to law firm, Paul Weiss, exited the role after only six days on the job and considerable unfavorable publicity. To his credit, Gensler went with a career prosecutor the second time around.
