A Christmas Day social media brawl between President-elect Donald Trump's backers in Silicon Valley and the MAGA base highlighted the looming battle facing the incoming White House and Congress over high-skilled immigration.

Early conversations are already taking place on Capitol Hill,where Republican lawmakers are openly mulling new plans to boost numbers of high-tech immigrantsas Elon Musk and other tech billionaires - including many who have named skilled immigration a priority - flex their expanding influence on Trump and the GOP.

But this week's online blowup suggests immigration hard-liners won't surrender easily to Trump's new tech friends.The president-elect's Sunday naming of Sriram Krishnan, a former partner at venture capitalist firm Andreessen Horowitz, to serve as his artificial intelligence advisercaused panic among Trump's base, with many fretting over his recent advocacyfor removing country caps on green cards for high-skilled workers. Laura Loomer, a far-right immigration restrictionist close to Trump, called Krishnan's appointment "deeply disturbing" and said tech leaders are cozying up to Trump to "enrich themselves" and get Pentagon contracts.

Musk and David Sacks, another venture capitalist tapped to serve as Trump's AI and crypto "czar," fiercely defended Krishnan and his ideas from Loomer and other MAGA critics.

"There is a permanent shortage of excellent engineering talent," Musk posted on X on Christmas Day, calling it "the fundamental limiting factor in Silicon Valley." Musk later claimed that"America will LOSE" without more high-skilled immigrants.

The debate over high-tech immigration is not new -Republicans and Democrats have repeatedly tried to pass laws making it easier for foreign experts to work in the U.S.,most recently in 2022. But anti-immigrant sentiment and concerns about weakening a comprehensive immigration package with a high-skilled carve-out always sunk their plans.

Now the long-stymied effort is getting new life from Musk, Sacks, Krishnan and other tech leaders advising Trump as he prepares to take office. The tech lobby sees an opening and is pressing its advantage. And GOP lawmakers - even some immigration hawks - interviewed on Capitol Hill say Congressshould consider letting foreign-born students who earn advanced STEM degrees stay in the country after graduation.

"Every Ph.D. in a STEM field that is awarded by an American university should come with a green card," said Rep. Jay Obernolte (R-Calif.), co-chair of the House Task Force on Artificial Intelligence, in a recent interview. He added that the issue "is something that Congress should look at."

Obernolte said more foreign tech experts are needed to compete with China on AI. Despite his support for laws cracking down on immigration, he said immigrants "have proven throughout U.S. history the impact that they can have on the U.S. economy."

The online fight reflects a key point of tension in today'sRepublican Party, though some of its most fierce immigration opponents appeared to stay outof the holiday week fracas. Stephen Miller, Trump's incoming deputy chief of staff for policy, worked during Trump's first term to slash the number of green cards and skilled visas issued or extended. Dan Stein, president of the conservative Federation for American Immigration Reform,has told POLITICO that tech lobbyists expecting to get what they want on foreign visas "are in for a big surprise."

"Secretary Mayorkas has not just presided over the greatest wave of illegal immigration in the nation's history, he has actively encouraged it, facilitated it, and then forced the costs down the throats of the American people. This month marks three years since he swore to uphold the laws of the United States and protect the security of the homeland. Secretary Mayorkas, however, has done precisely the opposite.

"At every turn, Secretary Mayorkas has ignored statutes and undermined the rule of law. He has released illegal aliens into the U.S. instead of detaining and removing them. He has established permanent parole programs for hundreds of thousands of foreign nationals, violating the law that requires parole be granted temporarily and only on a case-by-case basis. He has allowed known terrorists and Special Interest Aliens to cross into the country unimpeded. And, he has actively undermined immigration enforcement, claiming that being in the country illegally is not by itself grounds for removal.

"The results of Mayorkas' actions have been catastrophic. Since taking office, more than 8.5 million illegal aliens have been encountered at our borders and another 1.8 million are known to have entered the country without being encountered by a Customs and Border Protection agency that is overwhelmed with the task of processing and releasing illegal migrants. At a time of unprecedented terror threats posed by Iranian proxy groups, and heightened espionage activity by China, Mayorkas has admitted that 85 percent of the migrants being encountered at the southern border are being released into the country."

5.5 Million Illegal Aliens Crossed US Border Since Biden Took Office: Report

The total number of people who have entered the United States illegally since President Joe Biden took office has climbed to 5.5 million, according to the Federation for American Immigration Reform (FAIR).

Dan Stein, president of FAIR, shared the stark number during a recent interview on NTD's "Capitol Report" program, which followed a recent announcement by the Biden administration that nearly 2.8 million illegal border crossers were stopped in the fiscal year ended in September, a record high.

U.S. Customs and Border Protection (CBP) disclosed the figures in a recent operational update that brought the total official number of illegal border crossers to around 4.4 million since Biden took office.

Stein said FAIR arrived at the 5.5 million figure by adding to the 4.4 million an estimated 1.1 million who managed to evade capture and entered the United States undetected.

"It's pretty straightforward," Stein said of the estimate. "There are typical projections that are confirmed by Census data of people who just run around-they call them 'gotaways'-who enter without inspection, then disappear."

"If you look at the entire period, it's about 5.5 million since Biden took office," adding that FAIR projections estimate the cost to taxpayers to be $20 billion.

Exclusive-Stein: 'Final Straw', New Evidence Shows Mayorkas Whipped the Border Patrol, Must Be Impeached

We have all seen the iconic photo allegedly showing a horse-mounted Border Patrol agent "whipping" a Haitian migrant on the banks of the Rio Grande on Sept. 24, 2021. We now all know that the report was false. No "whipping" or "strapping" ever occurred.

The Border Patrol agent captured in the photo was using split reins to better control his horse, and Paul Ratje just happened to click his camera as the motion of the animal caused the reins to flare out. As Ratje stated, "Some of the Haitian men started running, trying to go around the horses. I've never seen them whip anyone."

The American public only found out later that, in Ratje's own words, the photo was "misconstrued." The White House and Homeland Security Secretary Alejandro Mayorkas knew almost immediately. A Sept. 24, 2021 email obtained by the Heritage Foundation under a Freedom of Information Act request (actually, they had to sue DHS to get it) reveals that they knew the whipping narrative was a lie more than two hours before President Joe Biden publicly accused border agents of "strapping" migrants and vowed that "those people will pay."

Shortly thereafter, Mayorkas, who was already aware that the accounts of the incident were very much in doubt, added more fuel to the fire by suggesting that racism played a role in the Border Patrol agents' actions. "Our nation saw horrifying images that do not reflect who we are. We know that those images painfully conjured up the worst elements of our nation's ongoing battle against systemic racism," Mayorkas charged.

The "smoking gun" email reveals that far from being a "fog of war" incident, the administration's incendiary, and knowingly false, response was the escalation of an actual war it began waging on Jan. 20, 2021 against border security and immigration enforcement. On this new front, the honorable men and women who are trying to enforce those laws also became targets. The email provides further evidence that Mayorkas, who took an oath to "well and faithfully discharge the duties of the office" is in contempt of that oath.

Following the orders of President Biden and acting on his own, Mayorkas has willfully spearheaded the purposeful abandonment of the laws of the United States and the successful policies of the previous administration to secure our borders and protect our people. On that basis alone, he must be brought up on impeachment charges in the next Congress.

In relentless pursuit of the Biden administration's unconstitutional objective of nullifying the nation's immigration and border enforcement statutes, the lives and careers of the three Border Patrol agents knowingly and falsely accused by both the president of the secretary were mere collateral damage.

More broadly, what Mayorkas has done has resulted in the death and enDangerment of Americans, damage to property and communities across the border, loss of operational control of our border to Dangerous cartels imprisoning thousands of migrants sold into human trafficking, and the fueling of deadly drug poisonings of thousands of Americans. This is clearly a violation of the oath Mayorkas took to "support and defend the Constitution of the United States against all enemies, foreign and domestic."

In spite of a comprehensive investigation of the incident by U.S. Customs and Border Protection concluding that there was "no evidence" that Border Patrol agents whipped or struck migrants in the course of carrying out their duties, neither President Biden nor Secretary Mayorkas has publicly conceded that their statements were erroneous, much less intentionally false. The agents continue to face unpaid suspensions and a black mark on their records. Nor are we likely to hear any sort of contrition from the White House because, as the email revealed in the FOIA suit confirms, much as in actual wars, truth has become a casualty in this administration's war against the immigration laws they are seeking to undermine.

DHS's Alejandro Mayorkas Builds Escalator for Asylum Migrants

President Joe Biden's border chief has released draft rules that will allow low-level officials to quickly and quietly award the huge prize of asylum and citizenship to myriad economic migrants, without oversight from judges or Congress.

"What they're doing is giving low-level bureaucrats authority equivalent to Congress as a whole to decide how many foreigners should move to the United States and become American citizens," said Mark Krikorian, director of the Center for Immigration Studies.

Officials "say it's streamlining the process, which it is truly not," Krikorian said. "The goal of the regulation is to dramatically increase the number of people successfully getting asylum and to speed that process up as much as possible."

In 2021, Alejandro Mayorkas, the secretary at the Department of Homeland Security, allowed more than 1 million economic migrants across the southern border, alongside the legal inflow of myriad visa workers and roughly 1 million legal immigrants. The inflow adds about two million people to the nation every year, as approximately 4 million Americans begin searching for jobs.

He is a Cuban-born, pro-migration zealot. The regulation is the centerpiece of his bureaucratic campaign to build a network of new migration pathways that operate outside the numerical limits set by Congress, and alongside the labor-trafficking networks run by the drug cartels.

The 512-page March 24 regulation converts the preliminary "Credible Fear Interview" process for new arrivals into a fast-track, full-scale asylum hearing, where migrants can get political asylum in a face-to-face interview with a low-level agency official.

Under current rules, migrants can ask for a Credible Fear Interview. If approved, they can stay in the country for a few years while a courtroom judge decides if their evidence justifies the award of asylum. The award of asylum is a huge prize - it allows migrants the right to take jobs, rent homes, become a citizen, and bring relatives into the United State via chain migration.

"This will only encourage more illegal immigration and fraudulent asylum claims, which is the Biden administration's end goal," said a statement from Dan Stein, the president of the Federation of American Immigration Reform.

The mass inflow cuts Americans' wages and pushes up rents, but it grows Wall Street values for the business groups that fund the pro-migration advocacy by progressives.

The new rule likely will face a lawsuit by advocates for Congress' authority over immigration policy.

House Democrats Pass Plan to Stop Travel Bans After Terror Suspects Caught at U.S. Border

House Democrats passed a plan on Wednesday that would make it increasingly difficult for any president to impose a travel ban to protect American citizens and would allow individuals to sue when a president imposes such a ban.

Titled the "No Ban Act," the legislation would limit a president's authority to issue travel bans without first consulting Congress and would open the process up to litigation by foreign nationals in the U.S. who are "harmed by such a restriction," a summary of the plan notes.

The legislation would force the State Department, Department of Homeland Security, and the president to only issue travel bans "when required to address a compelling government interest" and even then, they would be required to "narrowly tailor the suspension to use the least restrictive means to achieve such an interest."

All 217 House Democrats and one Republican, Rep. Brian Fitzpatrick (R-PA), supported the plan.

House Democrats' passage of the plan comes after a report this month revealed that two illegal aliens from Yemen were apprehended at the U.S.-Mexico border. Following background checks, both were found to be listed on the FBI's Terrorism Watch List and No-Fly List.

Dan Stein with the Federation for American Immigration Reform (FAIR) said in a statement:

Just a week or so after we learned that terrorists are exploiting the Biden border crisis, the House now wants to make it easier for them to waltz in the front door by stripping presidents, current and future, of the authority to bar entry to foreign nationals based on legitimate security concerns.

Today, the U.S. continues to have travel bans on China, Iran, Europe, Brazil, and South Africa as a result of the Chinese coronavirus crisis. President Joe Biden kept former President Trump's travel ban on China after previously having called it "xenophobic" and "hysteria."

Biden, though, has ended Trump's travel ban that prevented immigration from foreign countries considered exporters of state-sponsored terrorism. Likewise, Biden ended Trump's order that halted a number of visa programs to prioritize jobless Americans for U.S. jobs.

In June 2018, the U.S. Supreme Court reaffirmed in a 5-4 decision that presidents have the authority to limit the entry of any such group of foreign nationals from the U.S. in the interests of the nation.

Apparently, President Joe Biden thinks of immigration like he does stimulus money - a freebie for a favored constituency.

But his recent policy changes willfully undermining effective immigration enforcement and limits is an historic sabotage of the nation's self-determination and financial health.

Because the globalist corporate elite see borders as an anachronism at best, and impediments to further enriching themselves at worst, they view immigration controls as anathema. Therefore, beholden major parties have neglected border and immigration enforcement - an historic pattern that presented itself right up until the election of Donald Trump.

The Trump administration revealed a long-held secret about border and immigration controls: They actually can work if the proper level of deterrence and enforcement are applied. Watching Biden's breathtaking steps to reverse effective policies - with the specific intention of enabling more illegal immigration and fraudulent entries - is historic.

Our new president is facing a grim picture of a nationwide pandemic, high unemployment, and national despair. He needs a tight labor market. But what is his response?

He is now is working on eliminating policies and agreements that protect the interests and security of the American public, scrapping historic bilateral and multilateral agreements that stemmed the flood of migrants, and is inducing a new border crisis by promising entry to new illegal aliens and amnesty to those already here. Biden even wants to open the floodgates to well over 100,000 refugees (or putative refugees) at the same time he's restarting the massive flow of fraudulent asylum claims at our borders.

Biden could at least consider limiting refugee admissions until he gets some sense of how many asylum seekers he will be admitting at the borders.

The Biden Betrayal is jaw dropping and generating outrage across the land. The great Danger is that Biden views handing out green cards and citizenship as a freebie; a cost-free way to mollify a rabid, irrational constituency that cares more about those elsewhere than here. By passing on all the costs and consequences of these decisions to taxpayers, unsuspecting communities, the unemployed and our children in dysfunctional schools, he can simply act sanctimonious while failing to even consider the impacts of this now and over time.

On top of this, his demands to accelerate citizenship and reward lawbreaking with an 11-20 million person amnesty program creates yet another downstream crisis. Giving amnesty to over 10 million people means you are creating a downstream demand for 25 to 30 million more relatives, as numbers and backlogs create more and more pressure to admit more and more people. Launching this at a time of evaporating social trust and a decrepit infrastructure is to truly sink our national prospects long term.

White House Posts H-1B Visa Reforms to Help American Graduates Get Good Jobs

The administration has announced reforms of the H-1B visa-worker program to help American graduates get many of the U.S. jobs that Fortune 500 CEOs are now giving to compliant and cheap foreign graduates.

"This is a truly huge announcement ... with a tremendous positive impact for American workers and our economy," said Ken Cuccinelli, the acting deputy secretary of the Department of Homeland Security. The regulations will be posted as soon as October 6 and will go into effect by October 8.

For example, officials said, the Labor Department will require H-1B workers to be paid at least 45 percent of the prevailing wage levels, sharply up from the 17 percent level in current rules.

The rule will also target the H-1B staffing industry, for example, by setting a one-year term for H-1Bs imported by staffing companies. "The vast majority will be rejected," predicted one official.

The rule will largely implement President Donald Trump's 2016 promise to "end forever the use of the H-1B as a cheap labor program."

The rule will be "effective 60 days after its publication in the Federal Register."

"The changes that go into effect immediately will ensure that U.S. companies will use H-1B workers to augment our domestic labor force, not replace it," said a statement from the Federation for American Immigration Reform (FAIR).

"Millions of American workers who are in crisis due to the COVID-19 pandemic applaud the changes being implemented by Labor Secretary Eugene Scalia and Acting Homeland Security Secretary Chad Wolf," stated Dan Stein, president of FAIR.

Nationwide, U.S. CEOs employ roughly 1.3 million foreign graduates in jobs needed by new American graduates and experienced U.S. professionals. Many of the foreign workers are compliant and cheap, in part, because they are hoping to get valuable green cards in exchange for the work. This "Green Card Economy" is expanding from software and science jobs into health care, accounting, and other careers, so crowding out Americans, reducing technical quality, and slowing technological innovation.

9th Circuit Court Rewrites Nation's Immigration Laws

Unrestrained by the strictures of the U.S. Constitution, judges in the 9th U.S. Circuit Court of Appeals have wrested so much lawmaking authority away from the people's elected representatives in Congress that they are now rewriting U.S. immigration law by judicial fiat, conservative critics say.

Accusing it of relentless liberal bias, Republican lawmakers have tried for years without success to break up the San Francisco-headquartered circuit, which is by far the largest of the 13 courts of appeals, with 29 active judgeships. Within its 15 federal district courts, there are 112 judgeships. The circuit entertains appeals from Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, Washington, Guam, and the Northern Mariana Islands.

Sometimes called "the nutty 9th" and "the 9th circus" by detractors, the circuit is the most reversed of all 13 federal circuits. Since 2007, at 181 cases, the Supreme Court has accepted more cases from the 9th than any other circuit, overturning 138 of those lower court rulings, according to Ballotpedia.

"They're not judges; they're just political activists," Susan Carleson, chairman and CEO of the Alexandria, Va.-based American Civil Rights Union (ACRU), told The Epoch Times in an interview.

Dan Stein, president of the Federation for American Immigration Reform (FAIR), lamented the sorry state of the 9th Circuit in an emailed statement.

"True to form, President Trump-through his forceful leadership-has made his political opponents within the Judicial Branch identify themselves in ways they never would intend," Stein told The Epoch Times.

"The composite picture is clear: The Judiciary-with the complicity of the ACLU and allied partisans-is trying to run the nation's immigration program without regard to the downstream consequences of its politicized judgments."

In conservatives' view, the latest outrage came July 2 when Seattle-based U.S. District Judge Marsha Pechman, a Clinton appointee, effectively rewrote a 1996 law requiring the detention of asylum claimants, in a case known as Padilla v. ICE.

As Daniel Horowitz put it at Conservative Review, the judge invented a Fifth Amendment right for claimants to be released on bond and then kept on inventing.

"She went a step further and required that all those within custody receive bond hearings within seven days, that the proceedings of the immigration court trials must be recorded, and that the immigration judges must provide explanations for the basis of denying bond."

Pechman also defied 130 years of case law by placing the burden of proof "on the government, not on the alien, to show why these people shouldn't be released."

Pechman is "creating an impossible situation," said the ACRU's Carleson.

Report: Migrants' Remittances Drain $150 Billion a Year from Economy

Legal and illegal migrants send $150 billion in untaxed funds back to their homelands each year, denying the remittances to Americans and their communities, according to a Federation for American Immigration Reform (FAIR) report.

The United States's "generous and lax immigration policies have led billions of dollars to flow out of our economy untaxed, which is a disservice to Americans," said a statement FAIR President Dan Stein made about the remittances. "When our country urgently needs tax revenue to improve physical and societal infrastructure programs, it's imperative to address this drain on our resources immediately."

The exported funds should be taxed, partly because a tax would help reduce the amount of exported funds, said FAIR's report: It is bad enough that American taxpayers are being asked to provide welfare for foreign nationals in the United States. It only adds insult to injury when our state, local and federal governments allow income that could be taxed to reduce some of the costs associated with unchecked mass migration (both legal and illegal) to simply flow out of the U.S. economy and into foreign pockets.

The funds come from the roughly 45 million foreign-born legal immigrants and illegal migrants who are living alongside 280 million Americans. The migrants come from various countries, including Mexico, China, and India.

The immigrant and migrants are under family pressure to support their relatives living at home, where U.S. dollars have a high value. The report said: American dollars are generally worth significantly more than the local currency in developing countries. For example, according to 2017 data, the average hourly wage in India is about 61.9 Rupees, or roughly $0.90. That means that a U.S.-based relative can provide an Indian citizen with one month's wages by remitting roughly $150 per month. A slightly larger remittance of $250-$500 per month can support an extended Indian family in a comparatively luxurious style.

But the exported funds are lost to local American retailers, employees, and governments, the report said: Rather than being used to purchase goods and services [locally] in the United States, the majority of remittance monies go directly into the pockets of foreign businesses. A smaller portion of remittance payments indirectly wind up in the coffers of foreign governments through duties imposed upon the cash transfer itself or taxes on the goods and services purchased with that cash. The money sent abroad is typically disposable income (that would often be spent on small luxuries) ... When immigrants remit portions of their income to other countries, it places more pressure on the local jurisdictions in the states where they reside to make up that lost revenue elsewhere. This often results in higher overall taxation rates. Furthermore, local businesses suffer because those who send remittance payments abroad typically end up with less disposable income. Money sent to other countries means less money to spend on goods and services in the communities where foreign-born individuals live.

Trump has already fired Kirstjen Nielsen and replaced her with Kevin McAleenan, the commissioner of the Customs and Border Protection agency within DHS. Many media reports say Trump also plans to fire the DHS's acting deputy leader Claire Grady, and DHS general counsel John Mitnick. Cissna is also on the chopping block, even though Trump's critics say Cissna has done a very good job for Trump.

Cissna's agency handles a vast amount of tasks - including curbing fraud by migrants, developing and implementing asylum reforms, overseeing the citizenship process, and tracking the visa worker programs, which keep a population of more than 1.5 million white-collar workers in U.S. jobs. "Cissna is the best thing that has happened to that agency since was created," said Dan Stein, president of the Federation for American Immigration Reform. Under President Barack Obama, "it was taken over by people who thought it was their job to rubber-stamp [work] visa applications, to [always] 'Get to Yes' .., [but now] Cissna is applying the law," said Stein.

Cissna is also backed by Mark Krikorian, the director of the Center for Immigration Studies, which favors Trump's "Hire American" policy. Moreover, Krikorian's argument in favor of Cissna is backed by an advocate for cheap labor immigration, Alex Nowrasteh at the Cato Institute, who bitterly opposes Trump's pro-American immigration policies. Cissna's implementation of Trump's pro-American policies also got a backward endorsement from Aaron Reichlin-Melnick, a pro-migration advocate at the immigration lawyers' advocacy group, the Immigration Council. "None of this makes any sense," Reichlin-Melnick wrote. "Cissna has been an extremely effective advocate for the administration's restrictionist priorities, and his agency has little to do with the current border issues. Why fire him?" Via Twitter, Krikorian argued that Cissna is vital for Trump's"Hire American" policy, which has raised wages for Americans since 2017 - and promises to keep raising those wages before the 2020 elections. Firing Cissna "would not be 'cleaning house', it would be burning the house down. Cutting off your nose to spite your face. Throwing out the baby with the bathwater ... There's no one else who is committed to "Hire American" AND capable of implementing it," he wrote. Cissna is a former immigration lawyer who has worked for DHS and on the Hill. Cissna knows what regulations need to be changed before Trump's "Hire American" policy can be fully implemented, and he also knows how to change those rules, a Hill source added.

If this bill has all this crap in it just so POTUS can get a token billion for the wall then all we've been given has been empty promises. I'm finding it very hard to trust the plan in this situation.

A federal judge in New York has ruled against the Trump administration's decision to add a citizenship question to the 2020 census.

The issue ignited heated debate among lawmakers in March:

(27 Mar 2018) - AP - The Trump administration's decision to ask people about their citizenship in the 2020 Census set off worries Tuesday that noncitizens will dodge the survey altogether, diluting political representation for states that tend to vote Democratic and robbing their communities of federal dollars.

Those who support adding the question to the census say Democrats are opposed to the question because it would reveal how many noncitizens are living in the country.

"The only argument here is that the opponents don't want the American people to know and understand how large the foreign born population is and what percent of them percentage of them are here illegally," said Dan Stein, president of the Federation for American Immigration Reform.
