Navy SEAL commander resigns over dispute with Trump on SEAL Gallagher
Rear Adm. Collin Green, commander of the Naval Special Warfare Command, is stepping down in September over a dispute he had with President Donald Trump regarding disciplining a SEAL.
Green and Trump had a disagreement over the court-martial trial of U.S. Navy SEAL Chief Edward "Eddie" Gallagher in which Trump prevented Green from pursuing a peer evaluation of Gallagher. Trump's intervention freed Gallagher from pretrial detention and restored Gallagher's rank after the conviction. Now Green has decided to retire one year early, The Intercept reported Saturday.
"There's a long tradition in the military," Gallagher's civilian attorney, Timothy Parlatore, told Navy Times. "You don't rebel. You resign."
The Navy accused Gallagher of murder and attempted murder, and was accused of fatally stabbing an ISIS prisoner reportedly on May 3, 2017.
Gallagher was found not guilty on July 2 of most charges but was convicted of posing for a photo with an ISIS fighter's corpse, a crime for which the jury reduced his rank.

Report: Navy Secretary Sides with Admiral, Despite Trump Tweet, on Gallagher Review
U.S. Navy Secretary Richard Spencer said on Friday that SEAL Chief Eddie Gallagher should face a planned "trident review board," despite President Donald Trump's tweet Thursday that Gallagher should remain a SEAL.
Spencer told Reuters at the Halifax International Security Forum in Nova Scotia, Canada, he supports the hearing into whether Gallagher can keep his trident, a symbol of the SEALS, in light of Gallagher's conviction at a general court-martial in San Diego in July.
"I believe the process matters for good order and discipline," Spencer said.
On Tuesday, the Union-Tribune reported that the decision to review the SEAL qualifications of four service members connected to Gallagher's war crimes case by the commander of Naval Special Warfare Command, Rear Adm. Collin Green was made with the support of Navy leadership, including the chief of naval operations, Adm. Mike Gilday.
Gallagher's legal team said the decision to hold board reviews was a challenge to Trump's authority as commander in chief.
Trump has intervened several times on Gallagher's behalf. On Thursday, about an hour after one of Gallagher's lawyers appeared on Fox & Friends decrying the review board, Trump took to Twitter to express his disapproval.
"The Navy will NOT be taking away Warfighter and Navy Seal Eddie Gallagher's Trident Pin. This case was handled very badly from the beginning. Get back to business!"
The Navy Chief of Information, Rear Adm. Charlie Brown, told the Union-Tribune Thursday afternoon that the Navy was waiting for Trump to issue more specific orders before officially canceling the review.
"The Navy follows the lawful orders of the President," Brown said in a statement.
"We will do so in case of an order to stop the administrative review of SOC Gallagher's professional qualification. We are aware of the President's tweet and we are awaiting further guidance."
A senior Navy official told the Union-Tribune late Thursday that, in fact, all the review boards have been halted pending further guidance from Trump.
Navy SEAL Chief Eddie Gallagher was charged with killing a wounded ISIS captive and shooting civilians during his time in Iraq in 2017. At the end of his court-martial, a jury acquitted him of the most serious allegations and convicted him of the offense of posing for photos with the body of the deceased fighter.
A military jury sentenced Gallagher to four months' confinement, which he served before trial, and reduced his rank to petty officer 1st class, or E-6.
On Nov. 15, President Donald Trump restored Gallagher's rank to E-7, or chief petty officer. The same day, Trump pardoned two Army service members accused of war crimes. His action on Gallagher's behalf was not a pardon or an exoneration.

Some Navy SEALs are failing to maintain good order and discipline, and their one-star commander is warning them to clean up their behavior.
Rear Adm. Collin Green, the head of Naval Special Warfare Command, sent a letter to his troops the day after a SEAL platoon was ordered out of Iraq amid reports of a sexual assault and drinking in the war zone. Green says he's not yet sure the elite force has a "culture problem," but they do have a discipline problem that "must be addressed immediately."
"We have a problem," he wrote in the one-page letter dated July 25, which was first reported on by CNN. "… Good order and discipline is the foundation for every military organization and it is a leadership responsibility. As Commander, I own it. … We must now take a proactive approach to prevent the next breach of ethical and professional behavior in our formations."
Green ordered all Naval Special Warfare commanders to call their troops into formation, whether deployed or stateside, within two weeks of the letter.
"I want all hands to understand that 'we have a problem' and that this is our main effort and my top priority," Green wrote.

SEAL boss to force: 'We have a problem'
Months after a Pentagon review came back with an "all clear" for Special Operations Command's ethics and professionalism training, the head of Naval Special Warfare Command declared in a memo to his sailors that something is still not right.
SEAL commanders have until Aug. 7 to report issues and give recommendations on how to fix them, according to a July 25 letter from Rear Adm. Collin Green that was leaked to Navy Times.
"We have a problem," wrote Green in bold black print that he also underlined for emphasis.
"Some of our subordinate formations have failed to maintain good order and discipline and as a result and for good reason, our NSW culture is being questioned," Green wrote. "I don't know yet if we have a culture problem, I do know that we have a good order and discipline problem that must be addressed immediately."
Green admitted that as Naval Special Warfare's commander he owns the problem, but told his commodores that "you also own it" and proposed scrapping the current "consequence management approach" to instilling discipline" to take a more "proactive approach" to misconduct.
The letter came the day after news broke that a spec ops commander in Iraq booted a SEAL Team 7 platoon in the wake of a boozy Independence Day party.
"All Department of Defense personnel are expected to uphold proven standards and to comply with laws and regulations," read a SOCOM statement released July 24. "Alleged violations are thoroughly investigated."
Two days earlier, Navy Times broke a story about an investigation into SEAL Team 10 operators who had been using cocaine, fudging their urinalyses with clean samples and generally flouting the Navy's controlled substance regulations.

Although Green, commander of Naval Special Warfare Command, does not mention specific incidents, the letter comes on the heels of an entire SEAL team being sent home from Iraq following allegations of sexual assault and drinking alcohol during their down time – which is against regulations. Another case involved an internal Navy investigation that found members of SEAL Team 10 allegedly abused cocaine and other illicit substances while they were stationed in Virginia last year. The members were subsequently disciplined.
Green said in the letter that "some of our subordinate formations have failed to maintain good order and discipline and as a result and for good reason," the culture of the Navy's special operations forces "is being questioned."
Concerns raised at highest levels of the Pentagon
The incidents are rising to the highest levels of the Pentagon. Defense Secretary Mark Esper earlier this week spoke to the head of all special operations forces, Gen. Richard Clarke, about recent ethics violations in the military and how they are being addressed. "They discussed some of the recent cases that have emerged in the special operations community. They share the concerns," Jonathan Hoffman, Esper's spokesman told CNN.
Clarke is expected to also send his own memo to the force on ethics and call for a renewed focus on ensuring all special operations forces behave appropriately. CNN has spoken to several military officials who say they don't believe there has necessarily been an increase in incidents of bad behavior, but they have to ensure none of the incidents are tolerated even if they don't rise to the level of full criminal investigations.

Navy SEAL Platoon Removed from Iraq over Reports of Sexual Assault, Alcohol Use
A special operations commander's decision to remove a Navy SEAL platoon from Iraq centered around allegations that a senior enlisted member of the team raped a female comrade, The New York Times reported Thursday.
The Navy is investigating a report that a member of SEAL Team 7's Foxtrot Platoon sexually assaulted a female service member attached to the platoon, according to the Times. Some members of the platoon also allegedly drank during a Fourth of July celebration, a defense official confirmed, which is prohibited in Iraq.
A spokesman for U.S. Special Operations Command declined to comment on the ongoing investigation. But when commanders began investigating the reports of wrongdoing, the entire platoon "invoked their right to remain silent," according to The New York Times, which cited an unnamed senior Navy official with knowledge of the matter.
Maj. Gen. Eric Hill, an Air Force general overseeing all special operations missions in the fight against the Islamic State, booted the team from the war zone "due to a perceived deterioration of good order and discipline within the team during non-operational periods," SOCOM officials said in a statement Wednesday. The SEALs are based in San Diego.

The sexual assault claim raises more questions about serious discipline breakdowns in the SEAL community, which was already embroiled in ongoing legal battles and investigations into cocaine use in the ranks. Cmdr. Tamara Lawrence, a spokeswoman for Navy Special Warfare (NSW), said discipline is critical not only to SEALs' success on the battlefield, but to preserve the trust and confidence of the American people.
"We're actively reinforcing, with the entire Force, basic leadership, readiness, responsibility and ethical principles that must form the foundation of special operations," Lawrence said. "Leaders at all levels must lead in a way that sustains and sharpens that foundation."
Rear Adm. Collin Green, who leads all Navy SEALs, launched a 90-day review earlier this year to assess ethics and discipline problems within the command after several members were kicked out over drug use and others were accused of hazing and war crimes.
That assessment, Lawrence said, was submitted to SOCOM as part of a bigger look into behavior across all spec ops forces. Details about its findings and recommendations have not been made public.
Air Force Chief Master Sgt. Gregory Smith, SOCOM's senior enlisted leader, this week hit back against the idea that there's a culture of lawlessness within the spec ops forces.
"We have challenges, we have fraying," he told reporters at the Pentagon, "but are those things systematic? No."
Foxtrot Platoon was the only group of SEALs operating in Iraq at the time of their removal, the Times reported, and they were not immediately replaced.
Commanders have the authority to pull troops from a mission if they don't feel they can accomplish it during the course of an ongoing investigation, Lawrence said.
"In this case, the commander lost confidence in the platoon's ability to accomplish the mission due to a perceived deterioration of good order and discipline within the team," she said. "To mitigate potential impacts of this redeployment, other NSW personnel are available to complete the assigned operational requirements."
