DHS request for more troops at the border is sent to the Pentagon

(CNN)The new Department of Homeland Security Request for Assistance for additional US troops and other logistical support on the southern border has been sent to the Pentagon but has yet to be signed by acting Secretary of Defense Pat Shanahan, according to two US defense officials.
The request arrived late Wednesday and is being reviewed. There are no guarantees that all the requests will be approved, and the Department of Defense has previously rejected requests, pending DHS edits.
At the Pentagon last Friday, Shanahan told reporters he did not "have a finite number" in terms of how many additional troops would be sent but that the Pentagon was "looking at anticipating" what DHS needs prior to the receipt of a formal request for assistance.
"Where DHS loses its capacity is in the migrant family processing, when you think about their finite ability to do apprehensions they're really kind of trapped back in the processing side of things," Shanahan said, "so working with the joint staff, we're finding a way to how do we do more monitoring and detection for them, do we maybe take that on as a mission."
Over the last year thousands of American troops ahve been deployed to the southern border. At its peak, some 5,900 troops were part of the border mission, which has involved surveillance, aviation support and the placement of concertina wire between ports of entry.
Currently there are 3,000 active duty troops and 2,000 National Guard personnel deployed in support of border security.
Two US soldiers on the border recently found themselves in an encounter with armed Mexican troops, an incident that saw the Mexican forces remove one of the American soldiers' sidearms.
President Donald Trump told reporters earlier this month that he is "going to have to call up more military" to the southern border to address a historic increase in the number of migrant apprehensions.
There were more apprehensions on the southern border in March than in any other month in more than a decade, according to data released by Customs and Border Protection.
Department of Homeland Security officials have said the influx of migrants has caused the agency to reach a breaking point. Earlier this month Trump announced then-Homeland Secrurity Secretary Kirstjen Nielsen would be leaving her position, and her second in command, acting deputy Claire Grady, also left the department.

Discussions this week, at the White House meeting and afterward, have included the suggestion that troops may be needed to run the tent city detention camps once immigrants are being housed there, according to the U.S. officials familiar with the conversations.
The Posse Comitatus Act prohibits the use of federal troops for domestic law enforcement inside the U.S. This prevents them from direct interaction with immigrants crossing into the country. One U.S. official said recent meetings have included discussions about whether using active duty troops to run a detention camp would be a violation of Posse Comitatus.
While there has been discussion of an increase in troops, no specific numbers have been mentioned, and officials do not expect a large number of additional troops to be needed for any new mission.
A U.S. border patrol official speaking on the condition of anonymity said the military allows for faster construction than private contractors, who can protest decisions and slow down the process.
"The importance of DOD is that they are able to mobilize quickly because we face an immediate crisis now," said the border patrol official.
As an example of the crisis, the border patrol official said on Tuesday, 253 Central Americans, mainly families were stopped in Santa Teresa, New Mexico. Large groups present a challenge for border agents who must process, shelter and often find medical care for immigrants.
The border patrol official said he is not aware of plans to use troops to run detention facilities for migrants and noted it would be in violation of U.S. law.
The White House meeting came just two days after Trump tweeted that his secretary of Homeland Security, Kirstjen Nielsen, was leaving and that Kevin McAleenan, the CBP commissioner, would replace her as acting secretary. DHS Acting Deputy Secretary Claire Grady has also resigned.
On Wednesday, during a visit to Texas, Trump spoke about increasing the number of U.S. troops assigned to the border mission and alluded to the limitations to using active duty troops there.
"I'm going to have to call up more military. Our military, don't forget, can't act like a military would act. Because if they got a little rough, everybody would go crazy. … Our military can't act like they would normally act. … They have all these horrible laws that the Democrats won't change. They will not change them."
DHS did not immediately respond to a request for comment. In a statement, Defense Department spokesperson Lt. Col. Jamie Davis, said: "As we said last year when we were looking at possible facilities at Fort Bliss and Goodfellow Air Force Base, DOD could be involved in the possible construction of facilities to house immigrants. There are currently no new requests for assistance."

U.S. airport-security head named as No. 2 Homeland Security official
WASHINGTON (Reuters) - The new chief of the Department of Homeland Security (DHS) named the United States' top airport-security official, David Pekoske, his acting deputy on Thursday, as President Donald Trump overhauls the leadership of the domestic-security agency. The move, by Acting DHS Secretary Kevin McAleenan, who took office on Wednesday, temporarily fills a leadership vacuum at the top of DHS, which is responsible for everything from border protection to disaster response. But it also places further strains on an agency of 240,000 employees, many of whose top leadership posts were unfilled even before Trump's management shakeup.
McAleenan remains in charge of U.S. Customs and Border Protection even as he assumes responsibility for all of DHS. Likewise, Pekoske will continue to head the U.S. Transportation Security Administration, which screens airline travelers, while he serves as the No. 2 official at DHS. Both men are serving on a temporary basis.
In recent weeks, Trump has interviewed several candidates for DHS secretary, an appointee who must be confirmed by the Republican-controlled U.S. Senate. Trump has forced out top DHS officials over the past week as the agency tries to stem rising numbers of immigrants arriving at its southern border, many of them families fleeing violence and poverty in Central America. DHS said it arrested or denied entry to more than 103,000 people along the border last month, more than double the figure for March 2018. Trump has grown increasingly frustrated as DHS officials have told him that dramatic immigration changes he wants are not possible under current law, several sources say.
DHS Secretary Kirstjen Nielsen announced her departure on Sunday after clashing with Trump over border security. Her deputy, Claire Grady, stepped down on Tuesday. Trump is trying to force out L. Francis Cissna, who oversees legal immigration programs as director of U.S. Citizenship and Immigration Services, as well as John Mitnick, the top DHS lawyer, according to a source familiar with White House deliberations. Leadership is also in flux at U.S. Immigration and Customs Enforcement, the U.S. Secret Service and the Federal Emergency Management Agency (FEMA). Ten other top positions are either vacant or filled on a temporary basis.

WASHINGTON (AP) - President Donald Trump says there's only one person in charge of his immigration policy: Him.
Asked by reporters Wednesday whether he had considered tapping his influential aide, Stephen Miller, to lead the Department of Homeland Security given Miller's focus on the issue, Trump was ready with praise - but not a promotion.
"Stephen is an excellent guy. He's wonderful person. … He's a brilliant man," Trump said as he departed for Texas. But "frankly, there's only one person that's running it," Trump said. "You know who that is? It's me."
Trump on Sunday announced that Kevin McAleenan, the commissioner of United States Customs and Border Protection, would be taking over as acting Homeland Security secretary in the wake of Kirstjen Nielsen's sudden departure.

Asked whether he was considering nominating McAleenan as his permanent secretary, Trump said, "Could happen."
"We have others, but right now he's the man," said Trump.
Trump continued his focus on immigration during his Texas visit, where he turned a pre-fundraiser roundtable with supporters in San Antonio, Texas, into a forum for venting about illegal immigration, human trafficking and safety concerns on the border.
During the session, Trump announced he would be directing additional members of the military to the border and contended that residents of border states are living in tremendous danger and that nobody has any idea how bad the problem is. Some ranchers, he claimed, had told him they were finding scores of dead bodies on their land.

"They're dying on their fields, all over," he said. "They go over, they find bodies lying over the field, including many pregnant women. Many pregnant women. They give it a little water, go out and start walking. Walk to Dallas and Dallas is 250 miles away."
The comments came a day after Trump said he was not looking to revive the much-criticized practice of separating migrant children from their families at the southern border, as he has privately threatened, amid bipartisan pushback to his shake-up at Homeland Security. At the same time, he suggested the policy had worked to deter migrants from coming into the U.S., although he offered no evidence to support his position.
Last summer the administration separated more than 2,500 children from their families before international outrage forced Trump to halt the practice and a judge ordered them reunited.

"We're not looking to do that," Trump told reporters Tuesday before meeting with Egypt's president at the White House. But he also noted: "Once you don't have it, that's why you see many more people coming. They're coming like it's a picnic, because let's go to Disneyland."
The potential reinstatement of one of the most divisive practices of Trump's tenure was just one aspect of the upheaval at the Department of Homeland Security this week that culminated with Nielsen's resignation. Acting Deputy Secretary Claire Grady, a 28-year civil servant, technically next in line for secretary, was forced to resign Tuesday to make room for Trump's pick to replace Nielsen, according to two people familiar with the decision.

There's only one person running immigration policy in this administration, and it's not Stephen Miller, said President Trump Wednesday as he left for a rally in Texas. "You know who that is? It's me," he said, in case anyone was not clear.
In recent days, Trump's senior aide has been named repeatedly as the mastermind behind a tougher stance on migrants trying to cross the southern border and as the architect of an overhaul of senior personnel at the Department of Homeland Security. Kirstjen Nielsen was ousted as head of the department on Sunday, prompting a round of briefings that Miller - who co-wrote Trump's "American carnage" inauguration speech - had long been gunning for her. It came days after Trump wrongfooted Homeland Security officials by withdrawing his nomination of Ron Vitiello to lead Immigration and Customs Enforcement, again reportedly at the urging of Miller.
Randolph Alles, the Secret Service director, and Claire Grady, the acting Homeland Security deputy secretary, have also both left, with reports of more departures to come. The result was a burgeoning narrative of a hidden puppetmaster leading a clean-out ahead of a major tightening of immigration policy. "Stephen is an excellent guy. He is a wonderful person. People don't know him," said Trump when he was asked about his aide by reporters at the White House before going on to deliver a very public slap-down. "He has been with me from the beginning. He is a brilliant man … and frankly, there is only one person that is running it." He pointed to his own head, in case anyone missed the point.
It is not the first time an adviser has been cut down to size after generating too many headlines. Former White House Chief Strategist Steve Bannon, the other author of the inauguration speech, drew Trump's ire in 2017 after a string of stories about his genius for political strategy that included in a Time front cover headlined "The Great Manipulator."
In recent months Miller, who served as communications director for then-Sen. Jeff Sessions before joining the Trump campaign, has been seen as the new Trump whisperer. Sam Nunberg, an early hire by the Trump 2016 campaign, said it was a mistake to ever take too much credit for policy or personnel decisions. He added that briefings emphasizing Miller's role in the Homeland Security shake-up may be designed to undermine his position. "Miller is going to have to be careful and not take too much credit," he said. "People saying that this was Miller, instead of that this was Trump's decision, is a way to get Miller back."

The acting director of U.S. Immigration and Customs Enforcement (ICE), Ron Vitiello, has resigned amid an agency-wide restructuring of the Department of Homeland Security (DHS).
Vitiello had originally been nominated to take over the post permanently, but his nomination was abruptly pulled last week by President Trump, who said he wanted to go in a "tougher" direction.

Outgoing Homeland Security Secretary Kirstjen Nielsen announced the news of Vitiello's departure on Wednesday, praising his "knowledge and expertise as a seasoned law enforcement professional."
Nielsen said in a statement that Vitiello "has left a legacy of excellence as our Department has expanded and refined our efforts to curb illegal immigration and secure our borders."
Vitiello's last day at ICE will be Friday. Nielsen, whose own departure from the helm of DHS was announced over the weekend, is leaving Wednesday.
The moves come amid a White House shakeup affecting virtually all senior leadership at DHS that has seen the exit this week of Nielsen, Vitiello, Secret Service Director Randolph "Tex" Alles and Acting Deputy Homeland Secretary Claire Grady.
U.S. Citizenship and Immigration Services (USCIS) Director Francis Cissna, USCIS policy and strategy head Kathy Nuebel Kovarik and General Counsel John Mitnick are also reportedly due to resign.
A number of lawmakers from both parties have pushed back on plans to oust senior officials, while even some Trump allies on immigration have expressed concerns that the shakeup may be going too far.
Andrew Arthur, a research fellow at the Center for Immigration Studies (CIS), a think tank that favors reduced immigration, wrote that "these moves raise the question whether the president is irrationally looking for scapegoats on whom to blame for [the border] situation."
"[Trump] must reject purported efforts to remove U.S. Citizenship and Immigration Services (USCIS) Director Francis Cissna," Arthur wrote this week.
The lone survivor at the top of DHS so far is incoming Acting Secretary Kevin McAleenan, who until Wednesday served as U.S. Customs and Border Protection (CBP) commissioner.
Vitiello, a former Border Patrol chief, served as McAleenan's deputy at CBP from 2017 to 2018, before moving on to head ICE in an acting capacity.
With Vitiello's resignation, almost all senior Obama-era border and immigration holdovers are now out at the department.
Sen. Chuck Grassley (R-Iowa) told The Washington Post on Monday that Trump is "pulling the rug out from the very people" working to accomplish his agenda on immigration.
"The president has to have some stability and particularly with the number one issue that he's made for his campaign, throughout his two and a half years of presidency," Grassley said.
The shakeup has also drawn attention to White House adviser Stephen Miller, a key voice within the administration on immigration issues who is seen as a driving force on pushing the president's agenda concerning the border.
Senate Republicans have openly warned in recent days of Miller's outsize influence in the DHS decision-making process in the wake of recent departures at the agency.
"I hope that [Trump's] got more voices than that one in his ear on these issues, because, yeah, I think it's important that he get a whole perspective and range of opinions," said Sen. John Thune (R-S.D.).

Purge continues: Acting DHS Deputy Secretary Claire Grady resigns
Outgoing Homeland Security Secretary Kirstjen Nielsen announced Tuesday night her acting deputy secretary is resigning. Claire Grady, who was next in line after it was announced by President Trump over the weekend that Nielsen was resigning, was reportedly pushed out of the position to make room for Trump's pick, Kevin McAleenan, the chief of Customs and Border Protection. The resignation is the latest in a massive shakeup at the department. Trump announced over Twitter on Sunday that Nielsen was leaving after a tense meeting on immigration and the border. Soon after, Nielsen shared her letter of resignation and said she would officially depart Wednesday after helping with the transition.
Randolph "Tex" Alles, director of the Secret Service, left the White House on Monday after reports that he was told he had 10 days to exit. Trump picked Secret Service assistant director of the Office of Protective Operations, James Murray, to take over May 1.
Two other immigration officials who are reportedly expected to leave the Trump administration soon are L. Francis Cissna, the head of Citizenship and Immigration Services, and John Mitnick, a senior member of Nielsen's team. Nielsen announced Grady's resignation in a string of tweets.

Outgoing DHS Secretary Kirstjen Nielsen announced that Grady had offered President Donald Trump her resignation effective on Wednesday, just days after she turned in her own resignation.
"For the last two years, Claire has served [DHS] with excellence and distinction," Nielsen wrote. "She has been an invaluable asset to DHS – a steady force and a knowledgeable voice."
President Donald Trump announced Nielsen's resignation on Sunday and she agreed to stay on through Wednesday.
Grady's resignation will clear the way for Trump's selection Kevin McAleenan to lead the DHS.

Donald Trump's Enemies, Friends Praise Embattled USCIS Chief
Supporters and opponents of President Donald Trump are rushing to defend Trump's deputy at the U.S. Citizenship and Immigration Services, Lee Francis Cissna.
Sen. Chuck Grassley tweeted in support of Cissna, who is facing immediate firing as Trump cleans house at the Department of Homeland Security, according to a wide series of media reports. Trump has already fired Kirstjen Nielsen and replaced her with Kevin McAleenan, the commissioner of the Customs and Border Protection agency within DHS. Many media reports say Trump also plans to fire the DHS's acting deputy leader Claire Grady, and DHS general counsel John Mitnick. Cissna is also on the chopping block, even though Trump's critics say Cissna has done a very good job for Trump.
Cissna's agency handles a vast amount of tasks - including curbing fraud by migrants, developing and implementing asylum reforms, overseeing the citizenship process, and tracking the visa worker programs, which keep a population of more than 1.5 million white-collar workers in U.S. jobs. "Cissna is the best thing that has happened to that agency since was created," said Dan Stein, president of the Federation for American Immigration Reform. Under President Barack Obama, "it was taken over by people who thought it was their job to rubber-stamp [work] visa applications, to [always] 'Get to Yes' .., [but now] Cissna is applying the law," said Stein.
Cissna is also backed by Mark Krikorian, the director of the Center for Immigration Studies, which favors Trump's "Hire American" policy. Moreover, Krikorian's argument in favor of Cissna is backed by an advocate for cheap labor immigration, Alex Nowrasteh at the Cato Institute, who bitterly opposes Trump's pro-American immigration policies. Cissna's implementation of Trump's pro-American policies also got a backward endorsement from Aaron Reichlin-Melnick, a pro-migration advocate at the immigration lawyers' advocacy group, the Immigration Council. "None of this makes any sense," Reichlin-Melnick wrote. "Cissna has been an extremely effective advocate for the administration's restrictionist priorities, and his agency has little to do with the current border issues. Why fire him?" Via Twitter, Krikorian argued that Cissna is vital for Trump's"Hire American" policy, which has raised wages for Americans since 2017 - and promises to keep raising those wages before the 2020 elections. Firing Cissna "would not be 'cleaning house', it would be burning the house down. Cutting off your nose to spite your face. Throwing out the baby with the bathwater ... There's no one else who is committed to "Hire American" AND capable of implementing it," he wrote. Cissna is a former immigration lawyer who has worked for DHS and on the Hill. Cissna knows what regulations need to be changed before Trump's "Hire American" policy can be fully implemented, and he also knows how to change those rules, a Hill source added.

"Grady has been working as under secretary since August 2017. She has also become acting deputy secretary at DHS, taking over the responsibilities of the vacant position. Before that, she worked in procurement and acquisition at the Department of Defense, as well as other positions at the DHS.
She is reportedly not willing to make life easy for the president. According to anonymous colleagues quoted by the Times, Grady said she had no intention of stepping aside to clear a path for McAleenan to take over Nielsen's job. As such, the president could be forced to push Grady out.
If Trump manages to install McAleenan, the 47-year-old will be tasked with implementing a tougher approach to border security, something Trump reportedly believed Nielsen was unable or unwilling to do. CBS News reported that Nielsen's Sunday meeting with the president was widely expected to mark the end of her DHS tenure, during which time she faced regular criticism from Trump over a perceived lack of action on immigration."
