'Suspicious Reversal:' DOJ Backs Down from Massive Fraud Case Against Dem Megadonor Dish CEO, BlackRock
FCC insiders are raising concerns over the Justice Department's sudden push to settle a multi-billion dollar fraud lawsuit against Democratic megadonor Charlie Ergen's Dish Network and BlackRock, just before they were set to be deposed.
Last year, Elon Musk tweeted that Dish Network CEO and major political donor Charlie Ergen "is trying steal" wireless internet through his lobbying. He previously accused Ergen of engaging in "sneaky moves" at the FCC. Musk was criticizing Ergen's failed lobbying and lawfare efforts to have the government punish SpaceX who was competing for spectrum.
A Senior FCC official told Breitbart News he is raising alarm bells over what he calls "a suspicious reversal by the Justice Department" to protect Ergen, as well as executives at Blackrock, to prevent them from testifying about allegedly fraudulent conduct in a wireless auction.
Under FCC regulations, the agency grants discounted "bidding credits" to small businesses called "designated entities" in wireless spectrum auctions. In 2015, Dish Networks - hardly a small business with a valuation over $25 billion at the time - with backing from BlackRock-financed Northstar Wireless and SNR Wireless who went on to win the auctions, describing themselves as ""very small businesses". These credits were worth $3.3 billion dollars and pushed out legitimate smaller businesses out of the auction.
Northstar and SNR disclosed they received financing from Dish but claimed to act independently. After the FCC further reviewed the arrangements, then Chairman Ajit Pai determined Dish and its "shell bidders want this spectrum at a taxpayer-funded discount" and Dish had "de facto control" over the companies and denied the credits.
The FCC and Justice Department also endorsed a False Claims Act qui tam which VermonTel, a smaller company pushed out by Dish, filed in 2015. The suit has alleged the entire bidding process was fraudulent. Qui tam actions allow certain private parties to litigate fraud cases on behalf of the U.S. government.

Dish Network CEO makes early exit

Dish Network said its CEO Erik Carlson is resigning Nov. 12 ahead of the broadcaster's merger with EchoStar, its sister company focused on providing broadband services from space, after posting a steep drop in satellite TV customers.
Announcing earnings results Nov. 6, Dish Network said net pay-TV subscribers fell by about 64,000 in the three months to Sept. 30 to 8.84 million, split between 6.72 million for its DISH TV satellite broadcast business and 2.33 million for its SLING TV streaming service.
The Englewood, Colorado-based company had added 30,000 pay-TV subscribers during the same period last year - typically a strong quarter for the company in the run-up to NFL and college football events in the United States.
However, growing competition from other streaming services saw Dish Network's revenues for the third quarter of 2023 fall nearly 10% year-on-year to $3.1 billion.
The company also posted a net loss of $139 million, compared with $412 million in net income earned in the year-ago quarter.
To diversify revenues Dish Network has been heavily investing in a 5G network across the United States that it hopes to better support by combining with EchoStar, which is sitting on around $2 billion in cash reserves. Both companies are controlled by billionaire Charlie Ergen.
EchoStar reported a 17% year-on-year fall in revenues for the three months to Sept. 30 to $413.1 million as it waits on Jupiter-3, the operator's latest satellite slated to enter service in December to relieve capacity constraints that have been holding back subscriber growth.
Hughes Network Systems, EchoStar's internet provider subsidiary, has about 1.6 million subscribers after declining 65,000 from the end of 2022.
EchoStar reported $37.4 million in net income for the third quarter of 2023, down $19 million year-on-year.
Dish Network and EchoStar said they intend to complete the merger before the end of 2023 when it was announced in August, and did not provide an updated timing Nov. 6.
Carlson was due to step down once the transaction closed to make room for EchoStar CEO Hamid Akhavan, who would serve as CEO of the combined company.
Dish Network said Carlson notified the company of his decision to resign Nov. 3, adding that he will remain on the board through the closing of its merger with EchoStar.
In October, the companies amended their all-share merger deal so that EchoStar, rather than Dish Network, would be the surviving entity and stock.

ENGLEWOOD, Colo., Dec. 13, 2019 /PRNewswire/ – DISH Network Corporation ("DISH") announced today that it has completed its previously announced rights offering to raise approximately $1 billion.
Of the 29,834,992 newly issued shares of DISH's Class A common stock, approximately 81% of the shares were issued through the exercise of the subscription rights (including the exercise in full by DISH's Chairman and largest shareholder Charles W. Ergen) and approximately 19% of the shares were issued through Mr. Ergen's standby purchase commitment.
The rights offering was made pursuant to DISH's effective shelf registration statement on Form S-3 (No. 333-234552), filed with the Securities and Exchange Commission (the "SEC") on November 7, 2019, and the prospectus supplement filed with the SEC on November 22, 2019.

Dish founder Ergen (chairman) says he asked for senator's help on T-Mobile/Sprint
Dish Network Corp Chairman Charlie Ergen testified on Wednesday that the Justice Department's antitrust chief advised him on June 10 to ask a senator to speak to the Federal Communications Commission about approving a key piece of the merger of wireless carriers T-Mobile and Sprint. The Justice Department approved the merger in July after the carriers agreed to sell some assets to satellite provider Dish. The merger, however, was still subject to approval by the FCC, which came in October. Ergen's testimony on Wednesday came during the trial of a lawsuit filed in June by a group of U.S. states seeking to block the Sprint and T-Mobile merger. The states, led by New York and California, say the merger would lead to higher prices for customers.
The purchase by Englewood, Colorado-based Dish of the Sprint assets would allow Dish to build a viable competitor to the combined T-Mobile/Sprint, Verizon and AT&T. It is unusual for a Justice Department official to suggest to a company that it use access to U.S. senators to lobby another federal government agency. Attorneys for the states on Wednesday presented a text message from June 10 in which Makan Delrahim, the Justice Department's antitrust division chief, told Ergen: "Today would be a good day to have your Senator friends contact the chairman," a reference to FCC Chairman Ajit Pai. The states opposing the merger filed their lawsuit the next day. A spokesman for Pai declined to comment on Wednesday. Ergen testified that he asked Senator Cory Gardner of Colorado to speak with Pai and also spoke with Senate majority leader Mitch McConnell, but said he did not recall asking McConnell to reach out to anyone. Ergen did not say when he spoke to Gardner or McConnell.
The trial is scheduled to run until Friday, but the parties and the judge agreed to hold court on Saturday if needed. The states, in their argument that Dish is not a suitable company to become a fourth carrier, pointed to a 2015 letter from the FCC that said two companies owned by Dish had inappropriately claimed $3 billion in taxpayer-funded discounts when they purchased spectrum. A statement from Pai at the time said Dish would need to pay back the $3 billion.
