European Court of Justice rules Britain free to revoke Brexit unilaterally
The UK is free to unilaterally revoke a notification to depart from the EU, the European Court has ruled. The judicial body said this could be done without changing the terms of London's membership in the bloc.
The European Court of Justice (ECJ) opined in a document issued on Monday that Britain can reverse Article 50, which stipulates the way a member state leaves the bloc. The potentially important ruling comes only one day before the House of Commons votes on Prime Minister Theresa May's Brexit deal with the EU.
"When a Member State has notified the European Council of its intention to withdraw from the European Union, as the UK has done, that Member State is free to revoke unilaterally that notification," the court's decision reads.
By doing so, the respective state "reflects a sovereign decision to retain its status as a Member State of the European Union."
That said, this possibility remains in place "as long as a withdrawal agreement concluded between the EU and that Member State has not entered into force." Another condition is: "If no such agreement has been concluded, for as long as the two-year period from the date of the notification of the intention to withdraw from the EU."
The case was opened when a cross-party group of British politicians asked the court whether an EU member such as the UK can decide on its own to revoke the withdrawal process. It included Labour MEPs Catherine Stihler and David Martin, Scottish MPs Joanna Cherry Alyn Smith, along with Green MSPs Andy Wightman and Ross Greer.
They argued that unilateral revocation is possible and believe it could provide an opening to an alternative to Brexit, namely holding another popular vote to allow the UK to remain in the EU.
"If the UK chooses to change their minds on Brexit, then revoking Article 50 is an option and the European side should make every effort to welcome the UK back with open arms," Smith, the SNP member, was quoted by Reuters.
However, May's environment minister, Michael Gove, a staunch Brexit supporter, denounced the ECJ ruling, insisting the cabinet will not reverse its decision to leave. "We will leave on March 29, [2019]" he said, referring to the date set out in the UK-EU Brexit deal.
In the wake of the landmark vote on the Brexit deal, a group of senior ministers threatened to step down en masse if May does not try to negotiate a better deal in Brussels, according to the Telegraph. The ministers demanded that an alternative deal does not leave the UK trapped within the EU customs union indefinitely.
On Sunday, Will Quince resigned as parliamentary private secretary in the Ministry of Defense, saying in a Telegraph editorial that "I do not want to be explaining to my constituents why Brexit is still not over and we are still obeying EU rules in the early 2020s or beyond."

UK can cancel Brexit, says EU Court
The European Court of Justice (ECJ) has ruled that the UK can cancel Brexit without the permission of the other 27 EU members.
The judges ruled that this could be done without altering the terms of Britain's membership.
A group of anti-Brexit politicians and campaigners argued that the UK should be able to unilaterally halt the Brexit process if it wants to do so.
But their case was opposed by the UK government and the EU itself.
A senior ECJ official - the advocate general - said last week he agreed the UK should be able to change its mind about leaving. His opinion was not legally binding, but the court tends to follow his advice in the majority of cases.
The decision comes the day before the House of Commons is due to vote on the prime minister's Brexit deal with the EU - with MPs widely expected to reject the proposals.
The campaigners hope the victory in their legal case will increase the chances of Brexit being called off completely, potentially through another referendum.
This is because they believe it sends the message that MPs are not facing a choice between accepting Mrs May's deal or leaving the EU with no deal, and that "there are other options, and we can stop the clock."
The case was brought by a cross-party group of politicians, including Scottish Green MSPs Andy Wightman and Ross Greer, SNP MEP Alyn Smith and MP Joanna Cherry and Labour MEPs David Martin and Catherine Stihler, who have been supported by Jolyon Maugham QC of the Good Law Project.
They received a major boost last week when one of the ECJ's advocate generals, Manuel Campos Sanchez-Bordona, issued a statement which backed their position.
Mr Campos Sanchez-Bordona said it was his opinion that if a country decided to leave the EU, it should also have the power to change its mind during the two-year exit process specified in Article 50 of the EU treaty.
Crucially, he also said it should be able to do so without the consent of the other EU states.
But he said the possibility of revoking the decision would be subject to "certain conditions and limits". This includes the withdrawal being a parliamentary decision, and observing "the principles of good faith and sincere co-operation… to prevent abuse of the procedure".

Farage Warns British Political Class 'Colluding' with Euro Politicians 'Against Democracy' After Email Leak
Brexit campaign leader Nigel Farage has warned that the British political class are "colluding" with their European counterparts to thwart Brexit after an email leak.
The LBC host and former UKIP chief is still a working Member of the European Parliament (MEP), and was able to reveal an email from colleague Alyn Smyth - of the anti-Brexit, left-wing, Scottish 'nationalist' SNP - sent to every politician in the 751-strong European Parliament, urging them to help EU loyalists in Britain delay and ultimately defeat Brexit.
"Despite our political differences, as UK MEPs we are united around one fact: if you wish to allow the UK to remain within our EU family, then all ways to do so will necessitate an extension of the Article 50 timetable," Smith wrote.
"Whilst we acknowledge that many details of the next few months remain unclear, it is in a spirit of friendship, solidarity and respect that we ask you, our European friends, to start thinking about this possibility and be ready for this eventuality."
The activation of Article 50 - the EU-mandated mechanism for leaving the bloc - set in train a two-year negotiation period before Britain's exit, and cannot be extended without the agreement of British and EU institutions.
Farage further revealed that Hans-Olaf Henkel, an influential German MEP and former head of the Federation of German Industry, had taken up Smyth's call enthusiastically, replying: "I support everything which would avoid a Brexit, including anything which could delay it. Let me advise you that I have talked to both [European Commission] President [Jean-Claude] Juncker and to [Austrian] Chancellor [Sebastian] Kurz about our initiative."
Denouncing the plot in a column for The Telegraph, Farage declared that Smyth "and the 13 British MEPs who showed utter contempt for their own people in signing his letter, are conspiring with the Germans to make sure Britain cannot become competitive after Brexit."
"I think their intention is to derail Article 50. I call that a collusion against democracy. And I believe they should all hang their heads in shame," he concluded.
