Seattle law expiring leaves door open to legal hard drug use in the city
A local law in Seattle aimed toward criminalizing public drug use expired earlier this week without lawmakers instituting a replacement, meaning known possession of drugs and its public use is effectively legal in the city until council members implement new restrictions.
The Seattle City Council voted 5-4 against a statewide bill that would make known possession and public drug use a gross misdemeanor, making it the only city in the state of Washington "where it is legal to use hard drugs in public," according to City Attorney Ann Davison. Local lawmakers have not yet come to an agreement on how to prosecute drug use, leaving the city in limbo until a new bill is passed.
The situation comes after a statewide temporary drug law expired earlier this week, ending a two-year statute that listed drug possession as a misdemeanor and offered treatment to those who were found in violation rather than prosecution for their first two offenses. The stopgap measure was implemented after the state Supreme Court struck down the state's previous law making all drug possession a felony, which opponents argued was unconstitutional because residents could be charged even without knowing they possessed drugs.
State legislators were then tasked with passing a replacement bill, which proved difficult as lawmakers disagreed on how to address the issue. That put the state government in a scramble as they quickly approached the expiration date on Tuesday, prompting Gov. Jay Inslee (D) to call a special session in mid-May to find a solution.
Lawmakers later passed a bipartisan bill that would make known drug possession and public drug use a gross misdemeanor, with offenders being punished with up to 364 days in jail. The law would also allow prosecutors to recommend treatment as an alternative.
However, Seattle's municipal code exempts the city from automatically adopting changes to the state code - teeing the legislation up for a vote that was shot down by the city council.
"We had one job - conform to state law making drug possession and public use a gross misdemeanor - and we failed," councilwoman Sara Nelson said after the vote failed in June. "I'm disappointed that for the time being, the majority of Councilmembers have chosen to stick with the status quo that's claiming more and more lives every day."
Law enforcement can still make arrests in Seattle under the new state law, but prosecutions could be delayed as the city attorney is responsible for handling misdemeanors.
It's not yet clear when lawmakers will reconsider legislation to tackle the city's drug crime problem, but the city council said it plans to reconvene on Sept. 12. That would put the council on track for a vote as soon as Sept. 19. After that, the bill would need to be signed by Seattle Mayor Bruce Harrell, allowing the bill to take effect 30 days later.

CRAZY TOWN GETS CRAZIER: Another insane Monday afternoon in downtown #Seattle. I was doing my usual rounds, about to report some POSITIVE NEWS regarding the encampment sweep at 3rd Ave & Pike St this morning. Mayor Bruce Harrell(@mayorofseattle) defending the corner from "trap tents" that are set up consistently to sell drugs just a block away from City Hall.
Most of these folks are not homeless people. Many live in the nearby DESC buildings, hang out, and attract even more problems. As usual, I wanted to show the progress. But one fella didn't want me pointing the camera at all the drug activity. So he pulled out a knife and started chasing me! He also threatened to kill me and hurled the N-word and racist Asian slurs in my direction. Witnesses called cops. But this maniac ended up tripping on the ground, ending the encounter. I did not wait around for police. Will be happy to provide SPD any information, but I know the agency is understaffed so I will not bother filing a report.
I think I'm gonna take a break from this hood for a while. Just in the past few months, I have been threatened with a hatchet, baseball bat, and knife on this same block. This part of the city is still all upside down. I can't wait for City Hall Park to open up again this summer, just one block away from this madness. Good luck Emerald City. Good luck. LOL.

Homelessness and drug addiction are a growing problem in cities all over the country, but perhaps most visibly in the northwest, where progressive leaders have allowed the problem to flourish.
In Seattle, the Democrat mayor is proposing to give homeless drug addicts 'gift cards' they can use to access treatment services.
This is what passes for solution policy in blue America.
Mayor of Seattle wants to solve drug crisis with gift cards
Seattle Democratic Mayor Bruce Harrell unveiled his fentanyl and downtown activation plan on Monday to combat the massive drug crisis plaguing the city and even included a pilot research program to offer gift cards to encourage drug addicts to accept treatment services.
589 people died due to overdoses in Seattle in 2022, the majority attributed to fentanyl and meth, according to city data. 708 people in King County died from fentanyl in 2022, an average of 1.94 a day.
As of March 15, 172 people in King County have already died of an overdose involving fentanyl, an average of 2.32 a day...
Seattle residents and business owners have said the drug crisis on the streets is scaring people and businesses away from the downtown core. Addicts regularly refuse to accept offers of shelter or services so Harrell's plan also includes providing low-dollar gift cards to incentivize addicts to get treatment.
The plan also called for creating more resources for people dealing with addiction such as a "contingency management" program to keep overdose survivors clean and increase access to overdose prevention medication like Narcan, which is being distributed through new methods including vending machines in King County.
It's amazing that this is an American city.
Gift cards are not going to solve this problem.
It's completely out of control.

Seattle fire chief faces backlash after coordinating with BLM, Antifa rioters during CHAZ occupation

A group of Seattle firefighters have sent a letter to the King County Sheriff, King County prosecutor Leesa Manion, and Seattle Mayor Bruce Harrell calling into question Seattle Fire Chief Harold Scoggins' ability to continue to lead the department following the discovery of evidence that he allegedly coordinated with the BLM/Antifa occupiers of the deadly Capitol Hill Autonomous Zone (CHAZ) in 2020.
According to the letter obtained exclusively by The Post Millennial, the firefighters stated, "Chief Scoggins - while on duty, and in uniform, actively supported the perpetrators of the civil unrest and provided support, acting in the capacity as a city official. He ordered the removal of front-line emergency equipment from Fire Department vehicles and gave it to the people inside the 'autonomous zone', this bypasses set protocols and directly puts patients in way of harm by removing trained personnel and placing undue burden on civilians to administer aid. Chief Scoggins also openly stated that he facilitated the movement of cement blockades into the street of the protest zone, this reckless act made it impossible for the Fire Department to come to the aid of those inside the zone."
One of the firefighters stated in their letter that Scoggins' actions "made us feel completely disempowered. We forcibly abandoned the citizens on the other side of those blockades. It delayed our ability to do our jobs and cost people their lives as a result."
The purpose of that letter, they wrote, "is to express our concern regarding Seattle Fire Chief, Harold Scoggins. Our concern is based on presumed criminal activity and engagement, failure to uphold his sworn oath, failure to adhere to required Seattle City Official expectations, and involvement in conspiracy to commit spoilation. We believe that the included actions of Chief Scoggins have damaged the reputation of the Seattle Fire Department, diminished morale among its members (which has contributed to the staffing shortage across the City and has resulted in loss of life and property caused by longer response times) and marred the trust that the community holds in the Department. The damage that the City and the Fire Department have withstood directly from Chief Scoggins' actions may take decades to restore."
The letter cited a District Court of Western Washington ruling last month in which Scoggins was found to have deleted communications, including thousands of texts, regarding the "autonomous zone" from his city-issued cell phone, which was ordered to be preserved.
According to the letter: "Though the investigation was opened on June 24, 2020, and a Litigation Holds order was placed on the information contained in text messages on Chief Scoggins' device on July 22, 2020, on October 8, 2020 (77 days later), Chief Scoggins took his device to an Apple Store and had a factory reset preformed, deleting all text messages held on the device."

Joe Biden is doubling down on supporting bail reform - the same kind of "bail reform" that allowed Darrell Brooks to roam free for $1,000 when he made reduced bail after hitting his girlfriend with his car.
A few weeks after that incident, Brooks used that same car to hit dozens of people, killing six in Waukesha, Wisc.
But Biden thinks that despite six dead people - including an eight-year-old boy - there's nothing wrong with the policy of ending or reducing cash bail.
Fox6:
"Ending cash bail will not automatically put people charged with crimes on the streets," a White House official told Fox News. "It just means that whether you get bail should be based on the threat you pose, and not how much money you have in your bank account."
"There shouldn't be a separate criminal justice system for wealthy Americans," the official added.
"Ultimately though, this was a decision made by local courts," the official said, referring to Milwaukee county prosecutors releasing Brooks on bail.
How's that policy working out for ya? It was only a little mistake, after all. It's not like they let a mass murderer out on reduced bail, right? Oh...wait.
Mr. Brooks had a history of domestic violence. One glance at his social media would have told anyone how much of a danger this man was to the community.
But because dangerous, violent, homicidal white serial killers are allowed to get out of jail with stupidly low bail, the same courtesy should be shown black violent, homicidal, serial killers, right?

Kimberly Strassel details the political implications for Democrats, who appear to be amazingly tone-deaf on this issue.

Citizens have already responded at the ballot box. On Nov. 2, Minneapolis voters rejected an initiative to abolish the police force. Pro-policing candidates won mayoral races in New York City ( Eric Adams ), Seattle ( Bruce Harrell ) and Buffalo, N.Y. (incumbent Byron Brown, elected as a write-in candidate after losing the Democratic primary to a self-described socialist). On New York's Long Island, two Republican district-attorney candidates beat Democrats in races that were referendums on state bail changes that let repeat offenders go free.
Left-wing Democrats are struggling to adjust. Longtime Milwaukee County District Attorney John Chisholm conceded that Waukesha suspect Darrell Brooks -charged with killing six and injuring at least 40 others-had been let out on "inappropriately low" bail. He promised an internal review. The same Mr. Chisholm previously bragged that his office reduced prosecutions, incarcerations, and cash bails.
Incredibly, less than 48 hours after the vehicular assault by Darrell Brooks, Rep. Alexandria Ocasio-Cortez (D-N.Y.) sent a stern letter to prosecutors in New York's five boroughs, demanding a substantial reduction in cash bail because the jail at Rikers Island was full.
They just don't get it. When the White House can glibly claim that the really, really, violent criminals will still be kept behind bars after the massacre in Waukesha, you know the disconnect is complete - from top to bottom in the Democrat Party.
Good luck to Democratic elected officials caught between public backlash over the growing breakdown of safety and progressives who want yet more change. As AOC and her compatriots complained about "unnecessary pretrial detention" in Waukesha's wake, Rep. Rashida Tlaib of Michigan sat down with Axios to defend her support of the 2020 Breathe Act, which would end life sentences, kill the "three strikes" law, prohibit police use of Tasers, and fully empty federal prisons within 10 years. The White House felt compelled to explain Tuesday that President Biden "does not support abolishing prisons."
Data from the October WSJ/NBC poll found that voters now trust Republicans over Democrats to handle crime by a 22-point margin. Add voter discontent over inflation and Covid, then re-evaluate some of those crucial 2022 swing state races. In Wisconsin a recent Marquette poll found that 69% of registered voters believe crime is rising nationally. Only 19% of independents approve of Mr. Biden, and 23% would vote to re-elect Mr. Evers. Wisconsin Sen. Ron Johnson is considered the GOP's most vulnerable incumbent and hasn't decided if he's running. Democrats are making that decision easier.

Homelessness and drug addiction are a growing problem in cities all over the country, but perhaps most visibly in the northwest, where progressive leaders have allowed the problem to flourish.
In Seattle, the Democrat mayor is proposing to give homeless drug addicts 'gift cards' they can use to access treatment services.
This is what passes for solution policy in blue America.

Mayor of Seattle wants to solve drug crisis with gift cards Seattle Democratic Mayor Bruce Harrell unveiled his fentanyl and downtown activation plan on Monday to combat the massive drug crisis plaguing the city and even included a pilot research program to offer gift cards to encourage drug addicts to accept treatment services. 589 people died due to overdoses in Seattle in 2022, the majority attributed to fentanyl and meth, according to city data. 708 people in King County died from fentanyl in 2022, an average of 1.94 a day.
As of March 15, 172 people in King County have already died of an overdose involving fentanyl, an average of 2.32 a day...
Seattle residents and business owners have said the drug crisis on the streets is scaring people and businesses away from the downtown core. Addicts regularly refuse to accept offers of shelter or services so Harrell's plan also includes providing low-dollar gift cards to incentivize addicts to get treatment.
The plan also called for creating more resources for people dealing with addiction such as a "contingency management" program to keep overdose survivors clean and increase access to overdose prevention medication like Narcan, which is being distributed through new methods including vending machines in King County.
It's amazing that this is an American city.
Gift cards are not going to solve this problem.
It's completely out of control.

Somebody is throwing bags of suspected human poop into City Councilmember Kshama Sawant's Central District yard. The District 3 representative is calling on Mayor Bruce Harrell to direct the Seattle Police Department to do more to investigate what Sawant is calling "a series of disturbing incidents at my home."
She also says she has photos and video of the man Sawant says was caught in the act that police aren't using to pursue the case.

In a press release sent by the Socialist Alternative political group Sawant heads and not from her City Hall office, the veteran councilmember shares a letter sent to Harrell documenting six attacks involving excrement and what Sawant says has been SPD's apathy in investigating the fecal matter.
"As a socialist City Councilmember who has participated in Black Lives Matter protests, I am being told that my case of six threatening incidents involving human excrement doesn't merit even a serious investigation, let alone protection," Sawant writes.
Sawant also criticizes the SPD leak of information from the case to "right-wing media" that she says has encouraged "further attacks" on her and her family.

Now the longest serving member on the council, Sawant faced down a hard fought recall battle last year but remains a divisive figure in Seattle politics. That recall fight hinged on charges including Sawant's participation in a protest march to then-Mayor Jenny Durkan's home address that had been kept secret due to her past role as a federal prosecutor.
Threats against her have made past headlines but the latest incident involves a more direct assault on the councilmember's private life and follows a disturbing incident earlier this year involving an armed man making threats outside the Seattle home of Rep. Pramila Jayapal.
Security for Seattle electeds facing threats, meanwhile, isn't unheard of including Durkan's permanent SPD security detail following the march that got Sawant in political hot water in the recall.
In her letter, Sawant says SPD has closed its investigation and did not follow up on a threatening email calling her "the queen of shit" and saying the councilmember "can sit on your throne of human excrement."
