Biden's Transition Team Is Stacked With Former Facebook And Zuckerberg Insiders
Biden announced Friday that former Facebook Director of Public Policy Louisa Terrell would direct his White House Office of Legislative Affairs, which will put her in charge of advancing Biden's agenda in Congress. Terrell, who lobbied for Facebook from 2011 through 2013, currently oversees legislative affairs for the Biden transition team.
Terrell's appointment to the influential Biden administration post comes shortly after Biden campaign spokesman Bill Russo said in a now-deleted tweet that Facebook was "shredding the fabric of our democracy" for allowing disinformation to propagate on the social media network following the election.
Democratic National Committee Chief Mobilization Officer Patrick Stevenson also tweeted following the election that Facebook and the Republican Party are "the two biggest institutional threats to our democracy."
Biden told The New York Times editorial board in January that Zuckerberg is "a real problem."
"I've never been a big fan of Facebook, as you probably know," Biden said. "I've never been a big Zuckerberg fan."
The Biden transition team told Politico on Monday that it supports the criticisms the campaign levied against Facebook.
Politico previously reported that at least two former Facebook board members serve positions in Biden's transition team.
Biden transition co-chair Jeff Zients served on the Facebook board of directors from 2018 to early 2020, and Erskine Bowles, who held a seat on Facebook's board from 2011 to 2019, serves as an advisor to the transition team, according to Politico.
Zients reportedly left Facebook due to disagreements with how disinformation was handled on the network and Bowles left after Facebook leadership refused to follow his political advice, according to The Wall Street Journal.
Politico also reported that a former Facebook executive who helped the company navigate the FTC's probe into Cambridge Analytica, Jessica Hertz, was named general counsel for Biden's transition team in September, an appointment that was criticized by the left-wing of the Democratic party.
"The ultimate arbiter for ethics for the Biden transition was a senior regulatory official for Facebook up until a few months ago, at a time when progressives and the Biden campaign are fighting against the right-wing agenda of Facebook," said the Director of the Revolving Door Project, Jeff Hauser, according to Politico.
And at least three individuals serving posts on Biden transition agency review teams recently worked for Zuckerberg's charity, the Chan Zuckerberg Initiative.
Former Facebook engineering director and current Chan Zuckerberg Initiative Vice President David Recordon serves on the Biden transition agency review team for the Executive Office of the President, Management and Administration.
Also serving on the agency review team with Recordon is former Chan Zuckerberg Initiative Technical Program Manager Austin Lin.
Lin, who according to his LinkedIn profile held the same title during a brief stint at Facebook in 2017 and 2018, also serves on Biden's agency review team overseeing the National Security Council.
And Chan Zuckerberg Initiative Director of Engineering Andrew Nacin holds a seat on the Biden agency review team overseeing the United States Digital Service.
The Biden transition team did not immediately return a request for comment.

Former Facebook leaders are now transition insiders
The president-elect has hired former Facebook executives even though some in his camp consider the company enemy No. 1.
Some on the Biden campaign thought they had two opponents to beat: first Donald Trump and then Facebook.
But people with close ties to Facebook and CEO Mark Zuckerberg have already become inside players in the Biden transition, suggesting that the president-elect is not slamming the door on the company.
Former Facebook board member Jeff Zients is co-chairing Biden's transition team. Another former board member is an adviser. Two others - one who was a Facebook director and another who was a company lobbyist - have taken leadership roles. And Biden himself has a friendly relationship with a top Facebook executive, former U.K. Deputy Prime Minister Nick Clegg.
That set-up is already creating an awkward contrast with the vocal Facebook-haters in the party. DNC's chief mobilization officer Patrick Stevenson tweeted last week that "the two biggest institutional threats to our democracy are the Republican Party and Facebook." Campaign spokesperson Bill Russo argued shortly after the race was called for Biden that Facebook is "shredding the fabric of our democracy."
One senior Democratic strategist close to the campaign put it more plainly. "We basically think they're an immoral company," said the strategist, speaking anonymously to discuss the thinking inside the party. "There are thousands and thousands of people in their 20s and 30s and 40s who will be incensed to find themselves working for Secretary of Commerce Sheryl Sandberg, or taking a soft touch to Facebook because Nick Clegg and Joe Biden go way back."
Much of the anger comes from rancor over the company's failure to prevent Russian misinformation campaigns in the 2016 election and a feeling that Facebook didn't do enough to address the spread of false information or hate-filled posts in the 2020 race. Others in the progressive wing of the party, including Massachusetts Sen. Elizabeth Warren, have focused on Facebook's market power and called it a monopoly that needs to be broken up.
The question becomes whether, after Inauguration Day, a Biden administration acts on the anger coming from the Democratic party's anti-Facebook factions or if it absorbs Facebook back into the Democratic establishment, embracing the friendly relationship of the Obama years.

Big League Censorship? Michigan Attorney General Threatens Criminal Prosecution Over Posting Of Video Alleging Voter Fraud
I have been commenting on the ongoing challenges to the presidential election. While I have not seen evidence of systemic voter fraud, there are hundreds of affidavits alleging localized fraud, including cases of deceased persons voting. The challenges should be heard and the evidence should be examined. However, the most worrisome response came out of Michigan this week where Michigan Attorney General Dana Nessel's Office of Public Information threatened a website, Big League Politics, with criminal prosecution if it did not take down a video of alleged voting fraud. The video may indeed be misleading or false. However, the threat of criminal prosecution by the Michigan Attorney General's office is a chilling escalation of the crackdown on free speech in this country and the calls for censorship on the Internet.

The calls mirror the trend in Europe where countries like France, Germany, and England have criminalized speech with ever expanding examples of prohibited expressions and views.
The Cease and Desist letter instructs the site to remove all posts, links, and anything similar immediately which correspond with #LeakDetroit." Assistant Attorney General Danielle Hagaman-Clark states that "failure to comply will result in criminal prosecution." There is no citation for the penal code provision that makes such an allegation or posting a crime, a standard element in such notice letters.
The letter refers to false information about how poll workers counted challenged votes prior to 2020 and whether challenged ballots could be taken out of the official count. Again, the claims could well be misleading or false, but I fail to see the ability of Nessel to criminalize such assertions. Political campaigns are often replete with exaggerated claims on both sides.

For those of us in the free speech community, these threats are chilling. We saw incredible abuses before the election in Twitter barring access to a true story in the New York Post about Hunter Biden and his alleged global influence peddling scheme. Notably, no one in the Biden camp (including Biden himself) thought that it was a threat to our democracy to have Twitter block the story (while later admitting that it was a mistake).
I have previously objected to such regulation of speech. What is most disturbing is how liberals have embraced censorship and even declared that "China was right" on Internet controls. Many Democrats have fallen back on the false narrative that the First Amendment does not regulate private companies so this is not an attack on free speech. Free speech is a human right that is not solely based or exclusively defined by the First Amendment. Censorship by Internet companies is a "Little Brother" threat long discussed by free speech advocates. Some may willingly embrace corporate speech controls but it is still a denial of free speech.
This is why I recently described myself as an Internet Originalist:
The alternative is "internet originalism" - no censorship. If social media companies returned to their original roles, there would be no slippery slope of political bias or opportunism; they would assume the same status as telephone companies. We do not need companies to protect us from harmful or "misleading" thoughts. The solution to bad speech is more speech, not approved speech.
If Pelosi demanded that Verizon or Sprint interrupt calls to stop people saying false or misleading things, the public would be outraged. Twitter serves the same communicative function between consenting parties; it simply allows thousands of people to participate in such digital exchanges. Those people do not sign up to exchange thoughts only to have Dorsey or some other internet overlord monitor their conversations and "protect" them from errant or harmful thoughts.
Russo's comments mirror the comments of other Democrats who are seeking greater censorship. Indeed, in the recent Senate hearing on Twitter's suppression of the Biden story, Democratic senators ignored the admissions of Big Tech CEOs that they were wrong to bar the story and, instead, insisted that the CEOs pledge to substantially increase such censorship. Senator Jacky Rosen warned the CEOS that "you are not doing enough" to prevent "disinformation, conspiracy theories and hate speech on your platforms."

Bill Russo, deputy communications director for the Biden campaign, sent out a series of tweets criticizing Facebook's handling of misinformation and calls for violence related to the election. Russo specifically called out Facebook's handling of posts by Steve Bannon, a former advisor to President Donald Trump, and the news outlet Bannon previously ran, Breitbart.
The criticism could be an early indication of President-elect Joe Biden's approach to the social media platform and potentially the tech industry at-large. Biden has given few hints about how he would handle the laundry list of concerns around the tech industry, which span from content moderation to antitrust issues.
But the sparse comments he has given so far do not bode well for the tech industry and specifically for Facebook.
"No, I've never been a fan of Facebook, as you probably know," he told the New York Times Editorial Board, according to a transcript published in January. "I've never been a big Zuckerberg fan. I think he's a real problem."
Biden also told the Times he believed Section 230 of the Communications Decency Act, which protects tech platforms from being held liable for their users' posts, should be "revoked." That's a far bolder stance than most lawmakers on ether side of the aisle have stated, given that the law also allows platforms to take down objectionable posts, like those promoting violence or harassment.
Facebook banned a network of pages linked to Bannon on Monday for "artificially boost[ing]" the number of people who would get to see their posts on the platform. A group originally called "Stop the Steal,"which amplified Trump's baseless claims about election fraud, was among the pages Facebook found to have violated its policies and removed. A Bannon spokesperson did not provide comment on the removals Monday.
But according to Russo, the action was too little too late. The group had already exposed thousands of users to the baseless theories and several more popped up after its removal, according to Russo.
Facebook did not immediately respond to a request for comment.
Russo also criticized Facebook for maintaining Bannon's page on its platform after Bannon called for the beheading of government infectious diseases-expert Dr. Anthony Fauci and Federal Bureau of Investigation Director Christopher Wray in a podcast. Twitter suspended the podcast from its platform and Google-owned YouTube also took down the episode.
After Bannon released the episode, his lawyers defending him on charges that he defrauded donors to a nonprofit sought to be released from his case.
Russo contrasted Facebook's approach to election misinformation with Twitter's, which has more aggressive policies for labeling potentially misleading information. He claimed while Twitter prevented election misinformation from Trump from being spread widely, "Facebook continued to actively promote the posts in feeds."
Russo said in a tweet that the campaign had "pleaded with Facebook for over a year to be serious about these problems. They have not."
The messages signal Facebook is likely to face continued scrutiny under the Biden administration. The company has been under investigation by the Federal Trade Commission and a coalition of states over antitrust concerns for well over a year. The federal agency could bring charges against Facebook as soon as this month, according to Politico.

Biden's campaign wrote in the New York Times no less to explain the former VP will be going on the offensive against Facebook:
"Real changes to Facebook's policies for their platform and how they enforce them are necessary to protect against a repeat of the role that disinformation played in the 2016 election and that continues to threaten our democracy today," said Bill Russo, a spokesman for the Biden campaign.

We live in a democracy, where the elected officials decide the rules around campaigns.
Two weeks ago the President of the United States issued an executive order directing Federal agencies to prevent social media sites from engaging in activities like fact-checking political statements.
This week, the Democratic candidate for President started a petition calling on us to do the exact opposite.
Just as they have done with broadcast networks - where the US government prohibits rejecting politicians' campaign ads - the people's elected representatives should set the rules, and we will follow them.
There is an election coming in November and we will protect political speech, even when we strongly disagree with it.
Ironically, as Biden raises his attacks on Zuckerberg et al., his campaign is increasingly turning to the site to reach voters with ads. In recent days, he spent $5 million in advertising on Facebook, surging past political ad spending by Mr. Trump, who has dominated Facebook throughout the campaign season.
"Biden is doing the right thing by pushing the platform to be more ethical and by not walking away from it, which is not realistic," said Erik Smith, a former Democratic strategist and co-founder of Seven Letter, a crisis communications firm.
"But he's running a race against an opponent who has a 10-mile start on Facebook."

Biden Accuser Wants Him to 'Acknowledge' Wrongdoing Over Alleged Incident
Former U.S. Vice President Joe Biden on March 31 denied ever acting inappropriately after allegations came out that he made a woman uncomfortable when he kissed her at a campaign event back in 2014. But the accuser responded the same day, saying she wanted Biden to "change."
"In my many years on the campaign trail and in public life, I have offered countless handshakes, hugs, expressions of affection, support and comfort," Biden said in a statement. "And not once-never-did I believe I acted inappropriately. If it is suggested I did so, I will listen respectfully. But it was never my intention."
Biden said he did not recall the 2014 incident.
Former Nevada state assemblywoman Lucy Flores responded to the new statement and said it was "certainly better" than the initial response from Biden's spokesman, Bill Russo, on CNN's "State of the Union."
Russo's initial statement said, in part, that "Neither then, nor in the years since, did (Biden) or the staff with him at the time have an inkling that Ms. Flores had been at any time uncomfortable, nor do they recall what she describes."

Flores said she was glad Biden was willing to listen, but noted that she wants him to acknowledge more of what happened.
"If he is saying that he never believed that that was inappropriate, then frankly I think that's a little bit of a disconnect," she said. "I want him to change his behavior, and I want him to acknowledge that it was wrong," she continued.
In an op-ed posted on The Cut on March 29, Flores detailed how she felt Biden get closer to her from behind at a campaign rally. Biden was there to offer his support in her bid for lieutenant governor in Nevada.
"He leaned further in and inhaled my hair. I was mortified. I thought to myself, "I didn't wash my hair today and the vice-president of the United States is smelling it... He proceeded to plant a big slow kiss on the back of my head. My brain couldn't process what was happening. I was embarrassed. I was shocked. I was confused."
"I couldn't move and I couldn't say anything. I wanted nothing more than to get Biden away from me. My name was called and I was never happier to get on stage in front of an audience," she wrote.
In describing the incident, she told CNN that the Biden's actions were "completely inappropriate" and not normal in a "professional setting." She said she believes his alleged behavior was "disqualifying" for Biden's likely run for 2020. Biden has not yet made any formal announcement but has indicated that he has been considering whether to run or not.
Weeks ago, Biden had a slip of the tongue and almost announced running for president as he gave a speech to a dinner gathering of Democrats in Delaware.
Biden failed to develop a strong base of political support in his two previous presidential runs, dropping out of the race both times. If he were to be elected, he would be 78 years old when taking office, which would make him the oldest president-elect in U.S. history. He grew up in Scranton, Pennsylvania, and has spent more than four decades in Washington, mostly as a U.S. senator representing Delaware.
Flores also argued in her response that is not the first time that Biden has interacted with woman inappropriately.
"I just can't imagine that there was never a situation where someone said to him, 'Mr. Vice President, you probably should stop doing that. You should probably stop touching women in that way. You should probably keep your hands to yourself,'" she told CNN.

President Donald Trump weighed in on the matter with a little more sarcasm. "Welcome to the world, Joe," Trump said at a fundraising dinner for Republican House races. "You having a good time, Joe?" Trump himself has denied multiple accusations of sexual misconduct on his part.
Pelosi, D-Calif., said Biden "has to understand that in the world we are in now people's space is important to them and what's important is how they receive it, not necessarily how you intended it."
Her remarks at an event sponsored by Politico came as Biden's aides are striking a more aggressive tone as he considers seeking the 2020 Democratic presidential nomination and faces scrutiny over his past behavior toward women.
In a statement Monday, Biden spokesman Bill Russo blasted "right wing trolls" from "the dark recesses of the internet" for conflating images of Biden embracing acquaintances, colleagues and friends in his official capacity during swearing-in ceremonies with uninvited touching.
Two women have said Biden touched them inappropriately in the past. Amy Lappos, a former aide to Democratic Rep. Jim Himes of Connecticut, said Monday that Biden touched her face with both hands and rubbed noses in 2009. Former Nevada politician Lucy Flores penned a magazine essay last week in which she wrote that Biden kissed her on the back of the head in 2014.
The developments underscored the challenge facing Biden should he decide to seek the White House. Following historic wins in the 2018 midterms, Democratic politics is dominated by energy from women. The allegations could leave the 76-year-old Biden, long known for his affectionate mannerisms, appearing out of touch with the party as the Democratic presidential primary begins.
Lappos told The Associated Press that she and other Himes aides were helping out at a fundraiser in a private home in Hartford, Connecticut, in October 2009 when Biden entered the kitchen to thank the group for pitching in.
"After he finished speaking, he stopped to talk to us about how important a congressional staff is, which I thought was awesome," Lappos said.
She said she was stunned as Biden moved toward her.
"He wrapped both his hands around my face and pulled me in," said Lappos, who is now 43. "I thought, 'Oh, God, he's going to kiss me.' Instead, he rubbed noses with me."
Biden said nothing, she said, then moved off.
She said the experience left her feeling "weird and uncomfortable" and was "absolutely disrespectful of my personal boundaries."
The Hartford Courant first reported Lappos' assertion.
Russo, Biden's spokesman, didn't directly respond to Lappos, instead referring to a Sunday statement in which Biden said he doesn't believe he has acted inappropriately during his long public life. The former vice president said in that statement: "We have arrived at an important time when women feel they can and should relate their experiences, and men should pay attention. And I will."
Biden hasn't made a final decision on whether to run for the White House. But aides who weren't authorized to discuss internal conversations and spoke on the condition of anonymity said there were no signs that his team was slowing its preparations for a campaign.
Asked on Monday by the AP about the accusations against Biden, Pelosi said, "I don't think that this disqualifies him from running for president, not at all."
Biden's potential Democratic rivals haven't rushed to back him up. Sen. Kamala Harris of California said Tuesday that she believed his accusers but that it's up to Biden to decide whether to run.
Over the weekend, presidential candidate Elizabeth Warren said Biden "needs to give an answer" about what occurred. Another 2020 hopeful, Kirsten Gillibrand, said, "If Vice President Biden becomes a candidate, this is a topic he'll have to engage on further."
Ultraviolet, a women's advocacy group, tweeted: "Joe Biden cannot paint himself as a champion of women and then refuse to listen and learn from a woman who says his actions demeaned her. Good intentions don't matter if the actions are inappropriate. Do better, Joe. And thank you @LucyFlores for coming forward."

Allegations have mounted in the past week of inappropriate contact, threatening to end Biden's 2020 White House hopes before a formal campaign gets off the ground.
Spokesman Bill Russo said Monday in a lengthy statement that the women involved now say nothing unseemly happened, and argued that right-wing antagonists purposefully concocted photos designed to turn up the temperature of outrage.

A Trump supporter posted a crudely touched-up photo Sunday on Twitter, appearing to depict Biden groping the breast of Stephanie Carter, former Defense Secretary Ash Carter's wife, with his right hand during Mr. Carter's swearing-in ceremony. In the original picture, both of Biden's hands are visible on the woman's shoulders.

House Speaker Nancy Pelosi, who on Monday defended Joe Biden after two women complained about him touching them inappropriately, changed her tune on Tuesday.
"Join the straight-arm club," Pelosi said in advice to Biden during a Washington breakfast event on Tuesday. "Just pretend you have a cold and I have a cold," the California Democrat said.
The Speaker said Biden "has to understand that in the world we are in now people's space is important to them and what's important is how they receive it, not necessarily how you intended it," the Associated Press reported.
Last week, Lucy Flores, a former Democratic Nevada assemblywoman who was running for higher office, came out with allegations that Biden inappropriately touched her during a campaign rally in 2014, saying she felt uncomfortable and demeaned by his touching. Then on Monday, another woman came forward with new allegations. Amy Lappos told the Hartford Courant that "Biden touched her inappropriately and rubbed noses with her during a 2009 political fundraiser in Greenwich when he was vice president."
Pelosi initially said the new allegations against the former vice president should affect Biden's run for the presidency, which he has not yet announced. Asked on Monday if she thinks the claims from two women should prevent Biden from being president, Pelosi said: "No. No, I do not."
"I don't think that this disqualifies him from being president," the California Democrat said. "Not at all."
Lappos, the second woman to come out, said the touching by Biden "wasn't sexual, but he did grab me by the head," the Hartford Courant reported. "He put his hand around my neck and pulled me in to rub noses with me. When he was pulling me in, I thought he was going to kiss me on the mouth."
And she said Biden crossed the line. "There's absolutely a line of decency. There's a line of respect. Crossing that line is not grandfatherly. It's not cultural. It's not affection. It's sexism or misogyny."
Meanwhile, Democrats running for president, have not defended Biden.
"I believe Lucy Flores," Sen. Elizabeth Warren of Massachusetts said in Iowa on Sunday. "And Joe Biden needs to give an answer." When Sen. Bernie Sanders of Vermont was asked if Flores' allegation disqualifies Biden from running for president, he said: "That's a decision for the vice president to make."
Former Colorado Gov. John Hickenlooper, also a 2020 candidate, said Biden's actions were cause for concern. "Certainly, I think it's very disconcerting and I think that women have to be heard and we should start by believing them." And another candidate, Sen. Amy Klobuchar of Minnesota said she has "no reason not to believe" Flores.
"I think we know from campaigns and politics that people raise issues and they have to address them, and that's what he will have to do with the voters if he gets into the race," she said on Sunday.

But we have arrived at an important time when women feel they can and should relate their experiences, and men should pay attention. And I will."

"He didn't mean it as anything other than that. And I guess, there has never been a problem before," she defended him.

Biden-Abrams ticket is music to ears of some Dems
Democrats hoping that Joe Biden jumps into the Democratic race for the White House are salivating over idea he could pick Stacey Abrams as his running mate early in the process.
"It would be a bold and smart move," said one Democratic operative who has been in touch with Team Biden. "Who wouldn't want Stacey Abrams as your partner? I think you've got to own the narrative. She's so popular, so exciting, so commercial. It would be a bold move. No one can tell me it's a net negative."
Biden's camp on Friday pushed back against rumors of a "pre-cooked" Biden-Abrams ticket.
"@JoeBiden has an enormous amount of respect for @staceyabrams (it is why he endorsed her!) - but these rumors about discussions on a pre-cooked ticket are false, plain and simple," Biden spokesman Bill Russo wrote in a tweet.
But Russo's tweet didn't completely knock down the idea that Biden's camp has been talking about the idea, and sources confirmed to The Hill that it has been under discussion.
Abrams, who was narrowly defeated in her bid for Georgia's governorship in November, could negate lingering doubts surrounding whether Biden is the historic candidate Democrats need in an election against President Trump.
While Biden is leading polls and would enter the primary as a front-runner, he faces significant doubts about whether he's liberal enough to defeat rivals such as Sens. Elizabeth Warren (D-Mass.), Bernie Sanders (I-Vt.) and Kamala Harris (D-Calif.).
He also faces questions about this age - he'd be 78 a few weeks after Election Day 2020 - and whether a party propelled by the energy of woman and minority voters should elect an older white male as it standard-bearer.
Democrats say bringing Abrams aboard would immediately counter many of those arguments while giving his campaign a forward shine in the #MeToo era. It would also help secure women, black voters and millennials to Biden's side, who will all be essential to winning a primary and general election.
"It answers the concerns about Biden's age," said Democratic strategist Brad Bannon. "Abrams broadens Biden's reach with women and blacks. And it's innovative which helps a candidate like Biden who comes across as a traditional politician."
Biden's team, including longtime advisers Steve Ricchetti and Mike Donilon, are continuing to look at the idea, according to sources familiar with their internal conversations.
Ricchetti, who is expected to serve as a top adviser on Biden's campaign "sees the pros and cons" of the Abrams idea, according to one longtime Biden ally.
One con, some Biden allies say, it that it would highlight a point that Biden couldn't seal the nomination himself.
They point to Sen. Ted Cruz (R-Texas), who in a last-ditch effort to beat Trump in the 2016 Republican primary picked former Hewlett-Packard CEO Carly Fiorina to be his running mate.
"It makes him seem sort of desperate," said one Biden ally.
The former vice president and those around him are spending an enormous amount of time trying to figure out his entry into the race. Biden is now expected to enter the race later next month, likely after the Easter holiday, sources say.
