Texas Senate moves border Bill that allows state police to arrest migrants at U.S.-Mexico border
Two immigration Bills advanced in the Senate on Thursday evening. A Bill that would increase the minimum sentence for smuggling migrants passed with bipartisan support and will head to the House.

The Senate advanced two immigration-related Bills on Thursday evening, one of which would allow state police to arrest migrants who cross the southern border.
Senate Bill 11 , sponsored by state Sen. Brian Birdwell, R-Granbury, would create a new state crime for illegally entering Texas from Mexico and authorize state police to arrest violators. A first-time offender could be convicted of a misdemeanor, but the penalty would jump to a felony if the person has a criminal record and has repeatedly entered the country illegally.
The Senate gave initial approval to SB 11 with a 19-12 vote. The Bill needs a final vote in the Senate before it goes to the House.
Senate Bill 4, sponsored by state Sen. Pete Flores, R-Pleasanton, would increase the minimum sentence from two years to 10 years for smuggling immigrants or operating a stash house. SB 4 passed with bipartisan support in a 29-2 vote.
Earlier this month, Gov. Greg Abbott called for a third special legislative session since the regular session ended earlier this year, asking lawmakers to pass proposals on school vouchers and immigration enforcement. Abbott had asked lawmakers to approve immigration enforcement proposals during the regular legislative session and the previous special session, but lawmakers couldn't come to an agreement and adjourned without passing an immigration enforcement Bill.
Abbott has been critical of the Biden administration for years, blaming the president for the record-breaking number of Border Patrol apprehensions at the southern border.
Sen. Juan "Chuy" Hinojosa, D-McAllen, raised concerns about the ability of counties to comply with SB 11. He argued the number of people who would be arrested would overwhelm local jails and require significant funding for the defense of migrants who are arrested.
If the legislation passes, Sen. C?sar Blanco estimated that SB 11 would cost El Paso taxpayers - his constituents - an additional $60,000 per day.
"My concern is the State of Texas may add a layer on top of what we are dealing with in terms of both border security and a humanitarian crisis that has developed and continues to affect our communities," the Democrat said on the Senate floor.
Birdwell, who introduced the Bill, said funding allocated during the regular session, as part of Abbott's border security initiative Operation Lone Star, would cover many of the costs associated with the Bill.
According to the latest published federal immigration data, federal agents had 2.2 million encounters with migrants in fiscal year 2023, with September's numbers yet to be published. When that final month is tallied, 2023 could break fiscal year 2022's record-breaking number of 2.3 million migrant encounters.
During a committee meeting on Tuesday, Birdwell said SB 11 could face a legal challenge by the federal government. The U.S. Supreme Court and lower federal courts have ruled that the federal government has sole authority to enforce the country's immigration laws. Over the years, states have tried to implement their own immigration laws, but after legal challenges those laws have been overturned or watered down.
Still, Birdwell said he is confident his Bill could win a legal challenge if the federal government were to sue Texas.
"It is carefully tailored to avoid intruding on federal immigration enforcement authority while providing law enforcement with an important new tool to deter improper or unlawful entry into Texas," he said during the committee meeting.
Birdwell's proposal faced opposition from immigrant rights advocates and Dallas County Assistant Administrator Charles Reed, who testified during the committee meeting that if it became law, it could overwhelm county jails with migrants arrested by state law enforcement. He warned the county may have to raise property taxes if it has to pay to jail a significant number of migrants.
"We are absolutely terrified that this Bill will take us over our [jail capacity]," Reed said.
A financial analysis of the Bill says there's not enough data to estimate its cost, but adding a new criminal offense may cause "additional demands upon state correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement."

National File obtained a video version of the ad this morning.
"Even the Ag Commissioner Sid Miller knows this Bill has got to get through," the narrator notes, referring to a previous ad using the voice of Miller. The previous ad slammed Texas Rep. Dustin Burrows - who is in charge of the legislature's calendar - for allegedly refusing to advance the legislation to a full vote. At press time, the legislature is still waiting for Burrows to assign a day to vote on the Bill, despite it having a total of 45 sponsors.
"Folks outside of Texas can't believe this horrific practice still continues in Texas, but it does, and Dade Phelan and Greg Abbott aren't doing their jobs to stop it. RINO House Speaker Dade Phelan has one job: Send a Bill to Greg Abbott's desk that prevents chemical castration, and protects our kids from crazy doctors and parents. Stop this evil practice of permanently mutilating our kids."
Conservative activists in Texas have informed National File that Abbott is pressuring the legislature to stall the Bill and keep it from coming to a vote before the end of the 2021 legislative session to appease large, politically left wing corporations who have come to Texas in recent years. Previously, former U.S. House candidate Chris Ekstrom told National File that "Abbott's woke corporate cronies have decreed that we can't be Texas anymore, and no one's taken more money from them than Greg Abbott, no one in the country," said Ekstrom. "Not even Joe Biden."
Similarly, Abbott is reportedly pressuring a different state legislator to stall legislation that would make it illegal for employers to discriminate against employees based on their COVID-19 vaccination status. Without the Bill signed into law, a Texas nurse claims she was fired for her refusal to get the vaccine, even though she has recently tested positive for COVID-19 antibodies that suggest she is currently naturally immunized from the disease.

Hallmark Channel Again Bends Over to Online Gestapo Bully Mobsters on Pro-Deviant Ads
Hallmark reverses position on same-sex couple ads after public outcry
(Reuters) - The chief executive officer of Hallmark Cards apologized on Sunday night and said the company would reverse an earlier decision to pull television advertisements featuring same-sex couples from the wedding registry and planning website Zola.
In a statement, CEO Mike Perry said cable television's Hallmark Channel "will be reaching out to Zola to reestablish our partnership and reinstate the commercials."
Hallmark Channel faced a public outcry after it pulled the ads last week, under pressure from the conservative group One Million Moms.
The One Million Moms website said the group had "personally spoken with Crown Family Networks CEO Bill Abbott" who confirmed Hallmark pulled the commercial and said the advertisement aired in error. Crown Media Family Networks is the parent company of Hallmark Channel.
The decision to pull the ads prompted reactions from thousands of Twitter users as well as Democratic presidential contender Pete Buttigieg, comedian Ellen DeGeneres, California Governor Gavin Newsom and streaming company Netflix <NFLX.O>.
On Saturday DeGeneres tweeted to her 79.1 million followers: "Isn't it almost 2020? @hallmarkchannel, @BillAbbottHC... what are you thinking? Please explain. We're all ears."
The Netflix U.S. Twitter account tweeted: "Titles Featuring Lesbians Joyfully Existing And Also It's Christmas Can We Just Let People Love Who They Love" above the titles and images from the Netflix film "Let It Snow" and sitcom "Merry Happy Whatever", which feature lesbian characters.
Newsom tweeted a link to the ad, with the message "Same-sex marriage is the law of the land. There is no one way to love and be loved."
Saturday Night Live also weighed in with a skit about a fictitious Hallmark Channel matchmaking show, which ended with comedian Aidy Bryant's character saying: "This is Emily Cringle for Hallmark, reminding you to stay straight out there."
The LGBTQ advocacy group GLAAD launched a boycott, and the #BoycottHallmarkChannel hashtag was featured in over 16,000 tweets as of Sunday afternoon.
On Dec. 2, Zola began airing six ads on Hallmark, four of which featured a lesbian couple. On Dec. 11 Crown Media notified Zola those four ads would no longer be airing, with the explanation that Crown Media is "not allowed to accept creatives that are deemed controversial."
Zola then pulled its remaining ads from Hallmark, according to a Zola executive.
"The only difference between the commercials that were flagged and the ones that were approved was that the commercials that did not meet Hallmark's standards included a lesbian couple kissing," wrote Mike Chi, Zola's chief marketing officer, in a statement prior to Hallmark's reversal.

The Hallmark Channel has stopped airing four commercials featuring a same-sex "wedding" after backlash from viewers.
The commercials were for the wedding planning website Zola.com. The ad that sparked the backlash ended with the two women, one in a white suit and the other in a white dress, kissing. The other ads that were pulled also featured same-sex kisses.
One Million Moms (1MM) immediately asked Hallmark to pull the ad, collecting comments from viewers about how the commercial "ruined" their experience watching the "family friendly" channel. 1MM subsequently announced it spoke with Bill Abbott, the CEO of Hallmark's parent company Crown Media Family Networks, "who confirmed [the] Hallmark Channel has pulled the Zola.com commercial, featuring a same-sex couple, from their network. He reported the advertisement aired in error, but he was informed about it after hearing from concerned 1MM supporters."
"The call to our office gave us the opportunity to also confirm the Hallmark Channel will continue to be a safe and family friendly network. Praise the Lord!" 1MM announced.
"The debate surrounding these commercials on all sides was distracting from the purpose of our network, which is to provide entertainment value," Crown Family Media Network said in a Friday evening statement, as reported by the New York Times. That outlet reported that similar ads of heterosexual couples were deemed appropriate for the channel.
"We are not allowed to accept creatives that are deemed controversial," a Hallmark account representative told Zola via email.
"Hallmark approved a commercial where a heterosexual couple kissed," Mike Chi, Zola's chief marketing officer, told the New York Times. "All kisses, couples[,] and marriages are equal celebrations of love and we will no longer be advertising on Hallmark."
Abbott raised eyebrows in November after suggesting the channel may begin to feature homosexual story lines.
"We're open to really any type of movie of any type of relationship," he told The Hollywood Reporter podcast.
Hallmark's removal of the lesbian ads and Abbott's conversation with 1MM suggest the channel may be listening to its loyal viewers rather than the LGBT mob.
