SEC Chief Says Crypto Firms Often Mix Client Funds With Their Own
Crypto businesses don't properly safeguard their customers' assets and often mix them with their own funds, according to Securities and Exchange Commission Chair Gary Gensler. (acting like he doesn't know this…he not only noes it he personally participated in FTX's bullshit-cause he certainly knew that Tether gave FTX $38B of those coins to FTX and created out of thin air, when it (tether) was only worth $4B at the time-as shown by his meeting logs-plus he taught classes on Crypto at M.I.T. and his boss was Caroline Ellison's father) "This is largely a noncompliant field," Gensler said in an interview on Bloomberg Television's "Balance of Power With David Westin." "They're commingling customer funds with their businesses."
The blunt assessment by Wall Street's main watchdog follows months of warnings by Gensler and US regulators over potential dangers posed by the digital-asset industry. The SEC has asserted that many tokens and crypto products are really just securities that trade on the blockchain and should be registered with the agency. On Thursday, the regulator announced that the trading platform known as Kraken had agreed to pay a $30 million penalty to settle allegations that its staking products for American clients violated SEC rules. The firm, which also agreed to discontinue them in the US as part of the deal, didn't admit or deny the regulator's claims. (moar settlements with no one admitting a thing…S.E.C. is the most worthless GSE we've ever had) Crypto staking works by letting users generate yields in return for allowing their tokens to be used to facilitate transactions on a blockchain. Like several other digital-asset products, the SEC has said that it can resemble a security that should be registered with the agency.
In his Bloomberg interview on Friday, Gensler took particular issue with how crypto exchanges often play multiple roles. He suggested that their business models can create significant conflicts of interest. "We don't let the New York Stock Exchange also run a hedge fund and trade on the exchange; why would we do it here?" Gensler said. (but you do allow anyone with enough $ to co-locate servers closer the exchange's master servers thus cutting down on latency time-how is that legal again?) Ted Butler: Why Is JP Morgan Above The Law
Recent developments indicate, almost beyond question, that when it comes to silver (and gold), JPMorgan is operating in direct violation of the law. So clear is the proof of this allegation that the only real question is why JPM is allowed to openly flaunt basic commodity and antitrust law? Before getting to the why, let me first establish that JPMorgan is, indeed, violating the law when it comes to silver and gold.
JPMorgan is the largest and most important bank in the US and many would consider its CEO, Jamie Dimon, to be not only the most respected voice in banking, but in the corporate world as a whole. Given its high profile, JPMorgan is closely monitored and analyzed. Despite this coverage, very few know that JPMorgan is the dominant force in silver and gold markets. Yet public data demonstrate that JPMorgan has come to dominate the derivatives and physical sides of silver and gold, particularly since acquiring Bear Stearns in early 2008.
There are two final arbiters in matters of commodity and antitrust law in the US. The federal commodities regulator, the Commodity Futures Trading Commission (CFTC), is responsible for resolving civil infractions in regulated futures trading and the Department of Justice, is the final adjudicator for interstate commodity matters on both a civil and criminal basis.
In regards to the CFTC, the public record indicates the agency was involved in investigating and reviewing allegations of a silver price manipulation on multiple occasions both before and after JPMorgan took over Bear Stearns and it became the largest short seller in COMEX silver and gold futures in March 2008 and would remain so until the present time. The agency began a five-year formal investigation of a potential COMEX silver manipulation in September 2008 that ended inconclusively five years later. Any involvement by JPMorgan in potentially manipulating the silver market was never mentioned by the CFTC, as is typical government policy.

After we reported a week ago that JPMorgan was trying to corner the copper market, many noted this was not surprising, considering the bank's comparable approach in manipulating various other precious metal markets. Naturally, we extrapolated that the main reason why the CFTC continues to refuse to delay implementation of position limits is precisely due to the JP Morgan's need to control commodity pricing precisely due to such manipulative trading practices: "As for the CFTC, we now know why they are so intent on delaying the size limit discussion: after all, any regulation will be forward looking - better let JPM accumulate all commodities it can and distribute these via hidden channels to affiliated subs before the ever so busy Gary Gensler corrupt cronies decide to raise their finger on what is increasingly an ever more blatant market manipulation scheme. At least in this case, JPM will push the price higher unlike what it is doing courtesy of its gold and silver manipulation. However, the PM market (especially Asian accounts) will soon make sure Blythe Masters is looking for a job within 3 months as we predicted a few weeks ago." The only problem with this story is that so far, is that unlike copper, JP Morgan's now legendary paper short in the silver market, long taken for granted by the "less than in mainstream" community, has been persistently ignored by the broader media due to the a lack of concrete evidence. Hopefully that will now change: courtesy of a speech delivered by none other than the CFTC commissioner Bart Chilton, who continues to expose the CFTC and the banker cartel's illegal market manipulation practices, we now have proof that "one trader held over 40 percent of the silver market." As this trader is either JP Morgan directly, or various Blythe Masters proxies, we can only hope that finally the broader outcry against JPM's ongoing attempt to suppress precious metal prices (insert Mike Krieger/Max Keiser "Crush JP Morgan" campaign here) will force the bank to finally unwind its shorts. And if not, perhaps the market speculators will do it for them: as of Friday, the SLV ETF held an absolute record 10,941 tonnes of silver, an increase of 163 tonnes for the week.
What is even more amusing is that the Bart Chilton disclosure came during a speech blasting that other manipulative scourge of the market: High Frequency Trading (it is helpful that over a year after Zero Hedge first recognized HFT as the biggest threat to market stability, subsequently confirmed by the flash crash, now the very CFTC is finally confirming we have been right all along). In an ideal world, there would be an overhaul to both position limit and HFT trading rules. Alas, we live in a world, in which the son of the heretofore biggest known ponzi, Bernie Madoff, has decided to take his own life on the two year anniversary of his father's ignominious collapse. Surely, should the regulators confirm that our own markets are nothing but a massive ponzi, the suicides will be far more pervasive, as all those who "trade the tape" realize they have been following the crowd right over the cliff.

A recent interview with former CFTC Commissioner Bart Chilton nearly knocked me off my feet because it confirmed what I have alleged, starting more than 12 years ago. I'll include the interview later, but first I will set the background of the subject and timeline in order put Chilton's words into the proper perspective. The subject is JPMorgan's manipulation of the silver market. The timeline is important because Chilton does misstate some facts that need to be corrected. I'm not a big fan of articles that include lots of links to past articles, but in this case it's unavoidable.
Shortly after Bart Chilton took office as a commissioner in August 2007, he began to make public speeches in which he asserted that the CFTC was no regulatory pushover, like Barney Fife on the "Andy Griffith Show" but more like Elliot Ness or James Bond and that the agency was a tough cop on the beat. I assumed Chilton was genuine in his faith in the agency, but since he was brand new to commodity regulation I was sure that he was unaware of my allegations to the agency over the prior 20 years about a silver manipulation due to a concentrated short position on the COMEX. So I wrote to him about his claims of regulatory toughness at the agency and encouraged others to do so as well.
To his credit, Commissioner Chilton, responded to my and others' emails quickly, pointing out that CFTC staff were aware of the allegations and having responded in the past, they would do so again in the future.
I would ask you to note that my first contacts with Commissioner Chilton took place shortly after he assumed office in 2007 and the subject matter revolved around the concentrated short position in COMEX silver futures, an issue that has remained at the heart of the allegations of price manipulation to this day.
I continued to email him personally and encouraged others to do so as well, in addition to sending him and the other commissioners all articles I wrote. I think it's fair to say that close to 99% of the thousands of public emails sent to Chilton concerned the silver and gold price manipulation and there can be little doubt that all of those emails came directly or indirectly at my urging. What else could possible account for the high volume of public correspondence with an official of the CFTC?
Early in 2008, Commissioner Chilton indicated to me privately that the agency would be coming out with a new finding concerning the continued numerous public allegations of a silver price manipulation. This new finding would supersede the 15 page public letter of 2004. Perhaps I misinterpreted his message, but I came to believe that the new finding would be much different than the original finding. Instead, on May 13, 2008, the CFTC published another 16 page denial that anything was wrong with the concentrated short position in COMEX silver futures.
Feeling betrayed (something I don't believe I revealed previously), I told Chilton in not-so-polite terms how I felt and ceased personal email contact with him (although I did continue to send my articles to him and all the other commissioners, since they concerned regulatory matters).
In March 2008, nearly two months before the CFTC's 2ndpublic silver letter was published, the largest concentrated COMEX silver (and gold) short, Bear Stearns, failed and its short positions were assumed by JPMorgan.
I certainly knew that Bear Stearns collapsed and was taken over by JPMorgan, but I had no idea at the time that Bear was the biggest single short in COMEX silver and gold or that JPMorgan assumed those short positions. I would only learn of this months later, after the August 2008 Bank Participation Report was issued and revealed for the very first time an enormous silver and gold short position held, as it turned out, by a single US bank. (The reason Bear Stearns had never appeared in the Bank Participation Report was because it was an investment, not a commercial bank like JPMorgan).
Importantly, as a result of this article and others, which encouraged readers to again petition the CFTC, the agency confirmed it had initiated a formal investigation by its Enforcement Division. Fortunately the record of the timeline is clear, although the original confirmation was buried in an overall press release on Oct 2, 2008 -
