In his ruling, Tuchi admitted that "the Court declined to make a finding as to whether the case was brought for an improper purpose."
He cited Federal Rule of Civil Procedure 11(c)(4), which states in part, "The sanction imposed . . . must be limited to what suffices to deter repetition of the conduct or comparable conduct by others similarly situated..."
The judge alluded to case law, "The purpose of imposing sanctions under Rule 11 is not 'compensating the prevailing party,' but 'deterring, and if necessary punishing improper conduct.'"
At the same time, Tuchi acknowledged, "the imposition of sanctions is an extraordinary remedy to be exercised with caution and restraint," citing the Ninth Circuit stating they should be used "only in the most egregious situations."
Tuchi divided up the sanctions among Lake's three attorneys.
Retired Harvard Law School professor Alan Dershowitz asserted that he only participated in the case as "of counsel," meaning he was not one of the primary attorneys. He said he wrote only one paragraph of the complaint. However, Tuchi referenced sanctions issued against another election attorney, Lin Wood, who was also merely of counsel in an election challenge lawsuit.
He said, "The Sixth Circuit rejected Mr. Wood's argument that the district court was 'required to undertake an individual analysis of his conduct before it could sanction him.'"
Tuchi disagreed with Dershowitz's contention that his role was minimal.
"In any event, Mr. Dershowitz's subjective intent is not controlling at this stage," he said. "The need for general deterrence [when it comes to his role is] significant," the judge said. He reasoned, "Failing to impose meaningful sanctions here might very well encourage others to follow suit by lending their credibility to documents filed in court without facing any real consequence if their certifications prove hollow or incomplete."
Since Dershowitz's role was substantially smaller than the other attorneys, Tuchi reduced his share of the sanctions to 10 percent, $12,220. Attorneys Kurt Olsen and Andrew Parker were assigned the remainder of the $122,200.
In their lawsuit, Lake and Finchem denounced the "nullification of Plaintiffs' fundamental rights as candidates and as voters to vote and have their votes properly counted without being diluted or debased by other fictitious or manipulated votes." They cited a 2001 case, Bonas v. Town of N. Smithfield, which held, "[O]ne thing is clear: total and complete disenfranchisement of the electorate as a whole is patently and fundamentally unfair (and, hence, amenable to rectification in a federal court)."
Maricopa County Republican Committee censured Mitchell in June for representing county officials twice and asking for sanctions against Lake. Maricopa County Superior Court Judge Peter Thompson rejected the county's motion for sanctions against Lake in her election contest lawsuit, stating it wasn't "groundless." The Arizona Supreme Court issued nominal $2,000 sanctions against Lake's attorneys in May over her election challenge lawsuit.
Progressive-funded attorneys have filed multiple lawsuits in Arizona related to the 2020 and 2022 elections, but none have been sanctioned or disciplined by the State Bar of Arizona. The 65 Project files bar complaints against election attorneys representing Republicans in election-related lawsuits and has filed them against Dershowitz, Olsen, and Parker.
Last fall, Tuchi struck down a new Arizona law championed by Republicans that made it a crime to record law enforcement activity within eight feet after receiving a warning from an officer. Attorney General Kris Mayes agreed to pay Arizona news outlets, including The Arizona Republic, $46,000 and the ACLU $23,000 for attorney fees and costs.
Dershowitz said he intends to appeal. Tuchi ordered payment due in 30 days, but if appealed it will go on hold.

It is very simple to call for massive changes when you have no idea how those changes will affect you, or when you believe they won't.
That lesson was learned by a group of college students at the University of Oxford's St. John's College who are occupying the institution in protest over the so-called climate crisis when they sent a letter to one of the school's professors.

The professor, Andrew Parker, who also is involved in university finances, received the letter in which the students requested a meeting.
Among their demands was that the school divest from its investments in fossil fuels, to which Parker had a fantastic response.
"I am not able to arrange any divestment at short notice," he said in the letter to the students, The Times of London reported Friday.
"But I can arrange for the gas central heating in college to be switched off with immediate effect, Parker said. "Please let me know if you support this proposal."

But wouldn't you know it, one student did not like that idea very much. In fact, he wrote back chastising the professor for trivializing their request.
"You are right that I am being provocative but I am provoking some clear thinking, I hope," Parker said in response.
"It is all too easy to request others to do things that carry no personal cost to yourself. The question is whether you and others are prepared to make personal sacrifices to achieve the goals of environmental improvement (which I support as a goal)."
Spot on. It is too easy to make demands when the consequences for your demands do not directly affect you.
There's a good chance that the college will cave to these students' demands because that is what liberal colleges do.
They have created a monster that has now begun to consume them.
Just last week, an Oxford professor had to hire security guards to protect her from transgender rights activists.

But if colleges and universities continue giving in to these miscreants, they should expect more of the same to continue happening.
Such students are bullies, and bullies never stop making demands when you keep giving them what they want.
"This is an inappropriate and flippant response by the bursar to what we were hoping would be a mature discussion," protestor Fergus Green said, according to The Times. "It's January and it would be borderline dangerous to switch off the central heating."
Oh, really?
So young Mr. Green is just fine with using fossil fuels when it benefits him, but the rest of us better figure something else out so we do not bring on the wrath of Fergus.

Their successors are expected to come from within their organisations, although there has been a drive in recent years for personnel to 'cross pollinate' between agencies.
Ciaran Martin, 45, who set up the National Cyber Security Centre in 2016, will also leave his post in the summer. Mr Martin will take up a role in the private sector and become a visiting professor at King's College London, he announced on Friday evening.
Philip Ingram, a former military intelligence officer who advises on security matters, said the government will be careful to ensure there is no "gap in the wider understanding" of the threats facing Britain as the pivotal roles are handed over.
"Global events will have a great impact on the selection of their successors," he told the Telegraph.
"They don't necessarily need to be spies from with in the agencies but they need credibility. Whoever comes in needs to be knowledgeable on the current issues so you don't get a gap in the wider understanding. It will be very interesting to see who they put in there [as] they will also need to get on with government.
"I don't think it's an issue that they're both going at the same time. There is nothing to stop them appointing from out of different agencies; there has been a move to bring more outsiders in."

Sir Alex has been head of SIS since 2014 and has provided advice to three Prime Ministers: David Cameron, Theresa May and Boris Johnson. Director General of MI5, Sir Andrew Parker, has been in post since April 2013.
Sir Alex, known in his organisation as 'C', was due to retire in November 2019 after serving the traditional five-year tenure in the role.
However, last April Theresa May confirmed he would remain in post for at least another year on the recommendation of Sir Mark Sedwill, the Cabinet Secretary who also serves as National Security Advisor, to oversee any security issues that may have arisen from Brexit.
The Telegraph understands a shortlist of three people has been drawn up to become the new 'C', with at least one currently serving in another government department.

Sir Andrew has previously warned that Britain faces "a three dimensional threat: at home, overseas, and online" and that losses in Syria and Iraq by the Islamic State of Iraq and the Levant (Isil) shows that "ideology does not require territory to survive".
High on the list of priorities for the new Director General of MI5, expected to be in post in the first half of 2020, will be the threat to the UK from Isil fighters returning from Syria, Libya and Iraq.
There are an estimated 2,000 foreign fighters held in custody in Syria, mainly by Kurdish forces, and the number of escapees after the recent Turkish incursion following the partial US withdrawal was less than feared.
However, the problem is still thought to be a major concern in Whitehall as the scale of the potential threat is unprecedented and few of the underlying radicalising practices or grievances have been addressed in the Arab world.

The threat from a resurgent Russia in the wake of the invasion of Ukraine and the nerve agent attack in Salisbury in 2018, will also demand attention from the new spy chiefs.
Likewise China, from where the Telegraph understands the espionage threat is considered significant, growing and severe.
Security concerns over technology firm Huawei and pressure on China's leadership could increase global tensions, experts believe. President Xi Jinping is currently managing demands of internal stability, wider territorial integrity in the South China Sea and economic growth.

The Telegraph has published two separate articles detailing their version of when the heads of UK intelligence were briefed about a dossier of claims about President Donald Trump's alleged ties to Russia.
According to The Telegraph, the UK spy chiefs were briefed about the dossier-written by former MI6 agent Christopher Steele-before Trump was made aware of its existence by former FBI Director James Comey, but, notably, after the 2016 presidential election had taken place:
"The heads of MI5 and MI6 and one of [Prime Minister Theresa] May's most trusted security advisers were told about former British intelligence officer Christopher Steele's memos on the Trump campaign in the weeks after his November 2016 election victory."
The Telegraph article goes to significant lengths to make two separate points: that UK intelligence heads were briefed on Steele's information only after the 2016 presidential election had concluded, and that May was never directly informed of the dossier's existence. Interestingly, the article points out that the prime minister "may have known Mr. Steele" from the UK's inquiry into the poisoning death of Russian defector Alexander Litvinenko, when May was home secretary.
The Telegraph also noted the involvement of Charles Farr, the former chairman of Britain's Joint Intelligence Committee (JIC). The role of the JIC is to "assess events and situations relating to external affairs, defence, terrorism [and] major international criminal activity." The JIC is also responsible for the "liaison with Commonwealth and foreign intelligence organisations."
The JIC's website specifically notes that "members of the Committee are to bring to the attention of their ministers and departments, as appropriate, assessments that appear to require operational, planning or policy action."
The Telegraph reported that Steele met with Farr on two separate occasions to inform him of the events and information contained within his dossier. The two men, both former MI6 agents, had known each other for decades. The first meeting was reported as being one week after the 2016 presidential election in mid-November 2016:
"Together, they looked at what Mr. Steele had brought-more than a dozen memos originally sent to his client, Fusion GPS, spelling out in detail the alleged Trump-Kremlin links.
"For hours, the pair worked through the information-now collectively known as the 'Steele dossier'-line by line.
"Farr would ask questions, Mr. Steele would spell out what he knew."
According to The Telegraph article, by the end of his first meeting with Steele, Farr had decided that the allegations within the Steele dossier "had to go up the chain of command."
"Within days, according to well-placed sources, the allegations were shared with the most senior intelligence figures in the country," The Telegraph reported.
"It is understood that Alex Younger, the MI6 chief, and Andrew Parker, the MI5 director general, were informed of the dossier."
The article also referenced a second meeting with Farr in late November 2016, approximately 10 days after the alleged date of their first meeting. The two men met again for follow-up questioning and to discuss the addition of two new memos written by Steele, one of which reportedly detailed "how the Russians were allegedly trying to block Mitt Romney's possible appointment as US secretary of state." It was also around this time that the heads of MI6 and MI5 were allegedly briefed on the dossier.

The trigger for Nunes's letter was a report published in the British press Sunday that Christopher Steele, a former MI6 officer, briefed high-level British government officials about his investigation into possible ties between Trump and the Russian government.
The U.K. Telegraph reported that a week after Trump's election win, Steele briefed Sir Charles Farr, who then chaired Britain's Joint Intelligence Committee, about his investigation of Trump's possible ties to Russia.
Farr passed the information to other high-level British intelligence officials, including MI5 director Andrew Parker and MI6 director Alex Younger. According to the Telegraph, the prime minister was not briefed on the information.
Nunes asserted in his letter, which was obtained by The Daily Caller News Foundation, that the report raises "important questions" about the British government's role in "spreading the dossier's false allegations and what actions they may have taken in response to the allegations."
Nunes has led the Republican effort to investigate the FBI's handling of the dossier, which was used to obtain surveillance warrants against former Trump campaign adviser Carter Page. Republicans have cried foul because Steele's dossier was unverified when cited by the FBI. It was also funded by the Clinton campaign and DNC.
Steele's 35-page report has been all but debunked by the special counsel's report, which found no evidence of a conspiracy between the Trump campaign and Kremlin.
"To better understand these matters, I respectfully request that you ask Prime Minster May about the British government's knowledge of the Steele dossier and whether the British government took any unilateral actions based on information provided by Steele or at the request of any U.S. departments or agencies," Nunes wrote in the letter.
Nunes listed seven areas he hopes Trump will discuss with May.
He wants to find out if any British officials tasked Steele with gathering additional information on Trump, as well as whether British intelligence discussed Steele with their American counterparts.
One question listed by Nunes could cause some stress on the U.S.-U.K. relationship.

UK Intel Agencies Frame Spygate Involvement Ahead of Trump's Declassification
The Telegraph published two separate articles detailing their version of when the heads of UK intelligence were briefed about the contents of former MI6 agent Christopher Steele's dossier of claims about President Donald Trump's ties to Russia. According to The Telegraph, the UK spy chiefs were briefed before Trump was made aware of their existence by former FBI Director James Comey, but notably after the 2016 presidential election had taken place: "The heads of MI5 and MI6 and one of [Prime Minister Theresa] May's most trusted security advisers were told about former British intelligence officer Christopher Steele's memos on the Trump campaign in the weeks after his November 2016 election victory."
The Telegraph article goes to significant lengths to make two separate points: that UK intelligence heads were briefed on Steele's information only after the 2016 presidential election had concluded, and that May was never directly informed of the dossier's existence. Interestingly, the article points out that the prime minister "may have known Mr. Steele" from the UK's inquiry into the poisoning death of Alexander Litvinenko, when May was home secretary. The Telegraph also noted the involvement of Charles Farr, the former chairman of Britain's Joint Intelligence Committee (JIC). The role of the JIC is to "assess events and situations relating to external affairs, defence, terrorism [and] major international criminal activity." The JIC is also responsible for the "liaison with Commonwealth and foreign intelligence organisations." The JIC's website specifically notes that: "Members of the Committee are to bring to the attention of their ministers and departments, as appropriate, assessments that appear to require operational, planning or policy action."
The Telegraph reported that Steele met with Farr on two separate occasions to inform him of the events and information contained within his dossier. The two men, both former MI6 agents, had known each other for decades. The first meeting was reported as being one week after the 2016 presidential election in mid-November 2016: "Together, they looked at what Mr. Steele had brought-more than a dozen memos originally sent to his client, Fusion GPS, spelling out in detail the alleged Trump-Kremlin links. "For hours, the pair worked through the information-now collectively known as the 'Steele dossier'-line by line. "Farr would ask questions, Mr. Steele would spell out what he knew."
According to The Telegraph article, by the end of his first meeting with Steele, Farr had decided that the allegations within the Steele dossier "had to go up the chain of command." "Within days, according to well-placed sources, the allegations were shared with the most senior intelligence figures in the country. "It is understood that Alex Younger, the MI6 chief, and Andrew Parker, the MI5 director general, were informed of the dossier," The Telegraph reported.
The article also referenced a second meeting with Farr in late November 2016, approximately 10 days after the alleged date of their first meeting. The two men met again for follow-up questioning and to discuss the addition of two new memos written by Steele, one of which reportedly detailed "how the Russians were allegedly trying to block Mitt Romney's possible appointment as US secretary of state." It was also around this time that the heads of MI6 and MI5 were allegedly briefed on the dossier.

Sir Iain Robert Lobban, KCMG, CB (born 1960) is a former British civil servant. He was the Director of the Government Communications Headquarters (GCHQ), the British signals intelligence agency, from 2008 to 2014.
Education and career
Born in Nigeria, Lobban graduated from the University of Leeds with a Bachelor of Arts in languages.[1][2] He joined GCHQ in 1983 and undertook a variety of roles before joining the GCHQ Board in 2001.[2] He was a participant of the Cabinet Office's Top Management Programme that year. He has also completed the Higher Command and Staff Course at the Ministry of Defence's staff college at Shrivenham.[3] Whilst on the Board he was responsible for moving the operations of GCHQ into its new base at The Doughnut at Benhall, Gloucestershire. 'It would be an issue': Malcolm Turnbull intervenes in UK's Huawei debate
London: Former Australian prime minister Malcolm Turnbull has warned Boris Johnson that allowing Chinese company Huawei to build Britain's 5G network would compromise the ability of the Five Eyes countries to collect and share intelligence.
Mr Turnbull responded to the UK Prime Minister's challenge issued earlier that critics of Huawei should offer alternatives. Johnson's National Security Council (NSC) is due to make a decision within a fortnight, nearly 12 months after the original determination was due.
Speaking on BBC Radio 4's The World at One program, Mr Turnbull said the main risk the Australian security agencies had identified was not through potential Chinese interception of intelligence but by denial of access to the network.
Australian Labor and Liberal governments have blocked Huawei from the national broadband and 5G networks, while the US and New Zealand have implemented bans.
"We did a lot of work [to see] how we could mitigate the risk and the conclusion we came to was that there just wasn't a satisfactory mitigation of the risk," he said.
This week the outgoing head of MI5 Andrew Parker shrugged off US threats that Five Eyes intelligence could be cut if the British went ahead with the Chinese vendor.
But Mr Turnbull said it would be an issue.
"I think the fact that the other Eyes - the other parties to that Five Eyes relationship - are taking a different approach indicates it would become an issue," he said.
"How serious an issue it became only time would tell, but I have to say that prudence would suggest that the better course of action is not to use high-risk vendors and 5G, there are alternatives, European alternatives."
Earlier Johnson appeared unmoved by a US delegation of security officials which flew to Britain for last-minute lobbying, a retreat from his position after the NATO summit and his one-on-one meeting with US President Donald Trump.
"The British public deserve to have access to the best possible technology," Johnson said when asked about Huawei in a BBC TV interview on Tuesday. "We want to put in gigabit broadband for everybody. If people oppose one brand or another, then they have to tell us what's the alternative."
Turnbull said the British could use two "very large vendors" in Erickson and Nokia, "so there are plenty of alternatives".
While Johnson said that as Prime Minister he did not want "to put in any infrastructure that is going to prejudice our national security or our ability to cooperate with Five Eyes intelligence partners", his comments suggest his NSC may come to the same conclusion as that of his predecessor Theresa May and allow some Huawei involvement.
Huawei welcomed Johnson's comments and reiterated its stance that it would not comply with Chinese law if ever ordered to conduct espionage by Beijing.
Mr Johnson's former Cabinet colleague Liam Fox, who was the former Trade Secretary and part of Theresa May's NSC, said Chinese law that can require Chinese companies to spy on Beijing's behalf posed a "particular problem" for Britain.
"I think that that provides all Western countries with pause for thought if you're dealing with a company that can be ordered by its government to carry out espionage on their behalf effectively, where does that leave you in terms of dealing with them?"Fox told the Institute for Government in London.

The Queen has appointed a former head of MI5 as a senior Royal family official, Buckingham Palace has said.
Andrew Parker, Baron of Minsmere, will take up the role of Lord Chamberlain on April 1 - the most senior official position in the family.
He will succeed Earl Peel, who is retiring after more than 14 years in the post.
Baron Parker served as director-general of MI5 from April 2013 until last year and was a career intelligence officer having joined MI5 in 1983.
He hosted the Queen's first visit to MI5's headquarters in central London in February last year, when she praised the intelligence agency's officers for the "tireless work you do to keep our country safe".
Earl Peel, 73, delayed his retirement due to Covid-19 while the search for his successor took place.
He was due to step down at the end of 2020 but extended his notice period by around three months.
Baron Parker will head the Queen's working household and it will be his job to ensure the smooth running of all the different departments.
The post of Lord Chamberlain, which pays around £90,000 a year, is a part-time one and includes chairing regular meetings of all heads of department.
Baron Parker led the intelligence agency's response to the July 7 London terrorist attacks in 2005, and the following year his teams played a leading role in the disruption of Al-Qaeda's attempt to attack multiple airliners with bombs hidden in drinks bottles.
He was later promoted to deputy director-general of MI5 in 2007 before becoming head of the security service in 2013.
He retired from the post in April last year and in an interview that month said the pandemic could force ministers to "adjust the dials" on public spending.
The Lord Chamberlain also oversees all senior appointments in the household, is the channel of communication between the sovereign and the House of Lords and ensures coordination between Buckingham Palace and Clarence House.
The position dates from the Middle Ages, when the King's Chamberlain often acted as the king's spokesman in council and parliament.
On ceremonial occasions, the Lord Chamberlain carries a white staff and a gold key, the symbols of his office.
