NY judge accused of racist, anti-gay comments agrees to resign amid misconduct charges
On Friday, a New York judge accused of making a slew of racist and anti-gay comments to and about co-workers agreed to step down from her position effective March 1 and never to accept judicial office in the future, the New York Post reported.
The New York State Commission on Judicial Conduct announced on Monday that Kings County Surrogate's Court Judge Harriet Thompson agreed to resign amid misconduct allegations, which she has denied.
Thompson, who has been a Surrogate's Court judge since 2019, was charged by the CJC in May 2022 for allegedly making "inappropriate comments to and about employees and judges of the Unified Court System."
The written complaint made against Thompson also alleged that she "displayed bias against various individuals and ethnicities; failed to administer Surrogate Court matters in a timely manner, leading to substantial delays; and, as a candidate for Surrogate in 2018, failed to complete mandatory campaign ethics education in a timely manner."
Thompson was accused of making several vile remarks to and about co-workers. The inspector general "substantiated" claims that Thompson had referred to four other judges as "gay racist f**ts" who were "all f*ing each other."
"I hate these gay white men ... being gay is an abomination to mankind," Thompson allegedly said.
According to the state's Office of Court Administration, Thompson was accused of stating, "I do not like Hispanic people. They have a deceitful trait that goes way back to biblical times."
At the time of the allegation, Thompson's attorney told the Post, "The judge denies all of the allegations that are asserted against her."
The judge was scheduled for a formal hearing later this month but provided a physician's note in November claiming that she was "not medically fit to stand trial at this time" due to a medical disability that would require her to have additional procedures. According to the New York Post, Thompson sustained a shoulder injury.
As a result of her claim, the commission filed another complaint against Thompson, accusing her of being medically unfit for office on account of her injury.
Andrew Fisher, Thompson's lawyer, told the Post, "Because of the pain she endures she takes some medication which would interfere with her ability to participate in the defense against the charges that have been made."
In response, Thompson has agreed to resign and drop the lawsuit she filed against the OCA, accusing the administration of wrongful suspension.
"Had Judge Thompson not developed some disabling illness, she would have vigorously defended herself, but found that it was an impossible thing to do at this point," Fisher said. "It should be noted that there are no findings of wrongdoing that have been entered against her."
"She leaves, hopefully, with her reputation intact," Fisher added.
Commission Administrator Robert H. Tembeckjian stated, "The conduct charged against Judge Thompson was egregious and, if established at trial, would have warranted her removal from office. She now claims a medical condition prevents her from performing judicial duties, which opens a different path in furtherance of the public interest for her immediate and permanent departure from the bench."
Thompson's retirement begins March 1, and she will be allowed to keep her judicial pension.

WILMINGTON, Del.; Feb. 4-The Gannett Company, which already owned more newspapers than any other publishing group in the country, took formal control this weekend of the only two newspapers in Delaware with statewide circulation.
This week, the E. I. du Pont de Nemours & Company sold Gannett The Wilmington Morning News and The Evening Journal for $60 million.
While the price was far from the highest ever paid for an American newspaper, the purchase gave Gannett the only papers in Delaware that are circulated statewide. The papers have no serious competition for local newspaper advertising and there is no commercial television station here.
The purchase also gave Gannett a total of 75 papers,. the largest number owned by a single chain in the country. The combined daily circulation of the papers is about 140,000 and the total circulation of its Saturday and Sunday editions is about 200,000.
Yesterday, Gannett appointed Brian J. Donnelly, 44 years old, the former publisher of Gannett's two newspapers in Binghamton, N.Y., as publisher of the News-Journal Company, ,here. Mr. Donnelly and ,other Gannett officials said in interviews here that the papers would cover objectively and impartially the Du Pont Company and family, which have pervasive economic and political power in the state.
Several years ago, editors and reporters of the two papers sometimes quarreled with the Du Pont corporate management over alleged interference in editorial decisions and policies.
"Those were old days," said one Gannett official. Mr. Donnelly added, "We will cover Du Pont in Wilmington the same way we cover I.B.M. in Binghamton or Eastman Kodak in Rochester," the chain's home base in New York State where it operates The Democrat and Chronicle and The Times-Union.
Andrew Fisher, who recently resigned as publisher and president of the Wilmington papers but will remain for an indefinite period as a consultant, said that in the 18 months he has been in charge here, there was "no instance of pressure" from Du Pont on the papers' policies.
"We have been doing a fair, square, clean job on Du Pont," Mr. Fisher said.
Allen H. Neuharth, president of Gannett, said after the officials visited each department of the papers yesterday that he had assured the company's 600 employes that there were no plans to change the size of the editorial, production or business staffs. He said he expected the papers' profits, which were about $2 million last year, to continue to rise.
Gannett's decision to buy the Wilmington papers was made two weeks ago, the culmination of a somewhat unusual procedure for the sale of newspapers in this country.
The Du Pont Company, which acquired direct control of the papers last year when it got Federal approval to merge with one of its subsidiary holding companies, Christiana Securities, set rare rules for prospective buyers. Du Pont insisted on a deposit of $200,000 for the right to examine the newspaper company prospectus and an additional $200,000 to inspect the physical plant.
Several possible buyers, including The New York Times Company, which had been tentatively interested in the Wilmington offer, did not submit the deposits. Gannett's bid of $60 million was the highest received by Du Pont, more than the undisclosed amount offered by the second highest bidder, the Hearst Corporation, and the $55 million reportedly offered by the third highest, The Washington Post Company.
Some reporters and editors on the two papers had hoped Du Pont would sell to The Washington Post. But after the Gannett executives spoke to employees at the downtown offices of the papers, there was no noticeable unrest or- gloom left in their wake.
"They , haven't said anything bad so far, and that's good," said one man in the newsroom.
One Gannett official, answering questions from employees, said there would be "no pink slips Monday unless they were already in- the works" before the Gannett takeover. Mr. Neuharth said, he was pleased with the "profitability" of
the papers, adding, "We don't have any plans for reducing or adding to the work force. These people here know what they're doing."
The acquisition gave Gannett newspapers in 29 states plus one on Guam. The purchase of another, on St. Thomas, the United States Virgin Islands, is expected.

The Labor Party has turned on the hinge of history. In an identity renovation, Labor has become the party of nuclear propulsion - with China the key to this dramatic transformation.
China is remaking the Labor Party today via its strategic assertion, just as Japan's war re-made Labor in the 1940s.
In typical Labor fashion, the national conference embrace of nuclear propulsion has been sanctified with every Labor ritual - this is what Andrew Fisher, John Curtin and Kim Beazley would have done.
Nuclear propulsion has been sold to the party as a new Labor value, as the path to peace through deterrence, the vital contributor to self-reliance, industrial revitalisation and regional stability. Sections of the rank-and-file who cannot stomach these messages have succumbed before Albanese government dictum.
In moving the successful motion, Defence Minister Richard Marles put up in lights his political mission - to resurrect Labor "as the true party of Australia's national defence". Dismissing the Liberals as "defence dilettantes", Marles said Australian history shows Labor, not the Liberals, as the authentic guardian of national security.
Marles knows Labor cannot commit to AUKUS and build nuclear-powered submarines without ideological and political permission - so great is the reversal from its anti-nuclear obsession originating in the 1970s. Marles aspires to rekindle the Australian culture of looking to Labor at times of strategic crisis.
The Albanese government pledged to AUKUS from day one. This week the party followed in its national conference vote on the voices. The anti-AUKUS minority interjected from the floor but staged a lost cause. The numbers weren't counted but the government probably had a 75-25 majority among delegates.
The government has commanded the party. This is a powerful message to assure the AUKUS partners, Britain and America. Labor is not united but the executive government can proceed with a strong party mandate. Anthony Albanese was always going to win this vote but the messages and the way it happened is the story.
The public secret, of course, cannot be discussed: AUKUS was Scott Morrison's idea and initiative. Labor now lays claim to political ownership of AUKUS. In his speech at the end of the debate Albanese told delegates he had reached a personal decision, based on advice, about nuclear-powered submarines as Australia's future.
The personal nature of this decision is critical. Albanese's message: he is a believer in nuclear propulsion. He embraces this as a personal decision that defines his leadership of the party. This caps AUKUS as a turning point in Labor history. A left-wing Labor PM has turned the party's history abandoning his earlier beliefs.
It is a win for realism over nostalgia. Even a few years ago this decision would have been inconceivable.
Albanese called it seeing the world "as it is". He said the AUKUS submarines would be sovereign to Australia, nuclear-powered, not carry nuclear weapons, and Australia's non-proliferation obligations would be upheld. It was, therefore, an act of maturity.
In the debate Marles and Minister for Defence Industry Pat Conroy explicitly invoked China as justification for AUKUS. "In the year 2000, China had six nuclear-powered submarines," Marles said. "By the end of this decade they will have 21. In the year 2000, China had 57 major warships. By the end of this decade, they will have 200. Now these are not our decisions. These are not our choices. But this is the world in which we live."
It is the world that produced AUKUS.
The statement, endorsed by conference and now attached as part of the ALP platform, is titled "Enhancing Australia's National Security" and seeks, above all, to incorporate nuclear-powered submarines as integral to Labor's governing values.
Its philosophy is that Labor will use "all elements of our national power" to protect Australia and shape the world for the better. Diplomacy and deterrence are prime sources in this project. Defence policy is founded on sovereignty and self-reliance. The submarines will be commanded by Australian officers and under the control of the Australian government.
Significantly, the statement says Labor "will maintain the prohibition on the establishment of nuclear power plants". Albanese is ready to fight the Coalition on civil nuclear power. Indeed, for Labor there was always a trade-off embedded in AUKUS: the price for accepting nuclear-powered submarines was rejection of any civil nuclear industry. That is a political axiom.
