Alex Whiting has joined the Specialist Prosecutor's Office (SPO) as Head of Investigations.

Mr Whiting, 54, is a prosecutor of French and US nationality with extensive experience of both domestic and international prosecutions, including stints at both the International Criminal Court (ICC) and the International Criminal Tribunal for the former Yugoslavia (ICTY), as well as a distinguished academic career.

Mr Whiting came to the SPO from Harvard Law School, where he had been a professor of practice since 2013.

Between 2010 and 2013, Mr Whiting was in the Office of the Prosecutor at the ICC where he served first as Investigations Coordinator, overseeing all investigations, and then as Prosecutions Coordinator, overseeing all prosecutions.

Before joining the ICC, Mr Whiting taught for three years as an assistant clinical professor of law at Harvard Law School.

Between 2002 and 2007, Mr Whiting worked for the ICTY, where he was lead prosecutor in the trial of Fatmir Limaj, Isak Musliu, and Haradin Bala, and lead prosecutor in the trials of Milan Marti? and Dragomir Milo?evi?.

Before joining the ICTY, Mr Whiting was a US federal prosecutor, first with the Criminal Section of the Civil Rights Division in Washington, DC, and then with the US Attorney's Office in Boston, Massachusetts, where he focused on organised crime and corruption cases.

Mr Whiting is a graduate of Yale College and Yale Law School.

Special counsel Jack Smith has added a veteran war crimes prosecutor - who served as Smith's deputy during his stint at the Hague - to his team as it prepares to put former President Donald Trump on trial in Washington and Florida.
Alex Whiting worked alongside Smith for three years, helping prosecute crimes against humanity that occurred in Kosovo in the late 1990s. The Yale-educated attorney also worked as a prosecutor with the International Criminal Court from 2010 to 2013. He has taught law classes at Harvard since 2007 as well, hired as an assistant professor by then-Dean Elena Kagan - now a Supreme Court justice - and rising to a visiting professorship in 2013.
Whiting's precise role on Smith's team is unclear. A spokesperson for Smith declined to comment, and Whiting did not immediately return requests for comment. The prosecutors' office in the Hague and Harvard University also did not respond to requests for comment about Whiting's current employment status.
But a POLITICO reporter observed Whiting at the U.S. district courthouse in Washington, D.C., on Wednesday and Thursday, spending several hours monitoring the trial of a Jan. 6 defendant. The judge in the case is Tanya Chutkan, who is slated to preside over Trump's trial in March on federal charges stemming from his efforts to subvert the 2020 election.
During a break in the Jan. 6 trial this week, Whiting introduced himself to prosecutors as a new member of Smith's team, saying he "just joined" the office.
From 2018 to 2022, Smith served as chief prosecutor in the Kosovo Specialist Chamber in the Hague. Whiting temporarily took over that office last year after Attorney General Merrick Garland appointed Smith as special counsel to lead the Trump investigations. Boston attorney Kim West was appointed to permanently succeed Smith in June but did not assume the role immediately.
Whiting has been a frequent commentator on the previous special counsel to investigate Trump: Robert Mueller, who investigated links between Russia and Trump's 2016 campaign. Whiting wrote numerous articles and gave interviews assessing the strength of Mueller's case against Trump, often siding with those who saw extreme legal peril for Trump over his efforts to curb the investigation. Though he was once active on Twitter, his account appears to have been deleted and a Wayback Machine search suggests it was dormant since mid-2022.
Whiting's addition to the team shows Smith is gearing up for a new phase of his efforts - preparing for trials that could send a former president to prison for the first time in U.S. history.
The hire is also another example of Smith turning to allies he has worked closely with at different phases of his career. His top deputies, David Harbach and Raymond Hulser, worked closely with Smith during his Obama-era stint at the Justice Department, where Smith headed the Public Integrity Section.
Harbach, too, was recently spotted observing a potential adversary in the Washington, D.C., federal courthouse. He attended portions of jury selection for former Trump adviser Peter Navarro, who is represented by attorney Stanley Woodward. Woodward also happens to represent Walt Nauta, Trump's co-defendant in Smith's other criminal case against the former president, related to his stash of highly sensitive national security documents at his Florida estate.
It's unclear whether Whiting's attendance at Chutkan's trial was on his own initiative or if he was observing on assignment from the special counsel's office.
In addition to his war crimes work - which also included a five-year stint as a trial lawyer for three war crimes prosecutions stemming from the war in Kosovo - he also spent seven years prosecuting organized crime in Boston for the Justice Department from 1995 to 2002.

Trump was indicted on 37 federal counts related to Jack Smith's classified documents case in Miami in June.

Trump was charged with 31 counts of willful retention of national defense information and 6 other process crimes stemming from his conversations with his lawyer.

Last month Jack Smith hit Trump with 3 additional charges in the investigation into classified documents stored at Mar-a-Lago.

"All I want is justice," the former geography teacher and political activist told me in his home in the tiny village of Rud, about an hour's drive from the capital.

He has long since abandoned any hope of walking again. But he never stopped imagining he might one day see someone held to account. That moment may have come. "This court is the only hope I have for justice," said Rudi.
Thaci resigned as president in 2020 to defend himself against the charges. I recall meeting him years before, in 2010, on a previous visit to Pristina when he was prime minister. In a dark suit and pink tie, he was evocative more of a corporate executive than the rugged former guerrilla leader who helped to conduct the insurrection against Serbia under the nom de guerre of Snake. The purge of rivals he is suspected of conducting did not stop him emerging as the West's favoured partner in Kosovo.
In2010, Joe Biden, then America's vice-president, called him "Kosovo's George Washington". But a report by the European Commission that same year put forward a conflicting view, describing Thaci as "the most dangerous of the KLA's criminal bosses". It had been commissioned after allegations that the KLA had engaged in human organ trafficking were published in a book by a former war crimes prosecutor, Carla del Ponte. This set in motion calls for a reckoning even if claims the KLA had murdered Serb prisoners for their kidneys were never proven. The allegations have no part in the cases before the court.

At the opening of his trial on April 3, Thaci declared: "I am fully not guilty." But Alex Whiting, the prosecutor, said that he would prove the KLA was responsible for hundreds of murders and illegal detentions in Kosovo and northern Albania in 1998 and 1999. "Most of the victims of the abused were fellow Kosovar Albanians . . . Nobody is above the law, even during wartime."
Serbian forces were responsible for the overwhelming majority of the violence in Kosovo and while some were tried at the International Criminal Tribunal for the former Yugoslavia, most of those responsible for ethnic cleansing, rapes and other war crimes in Kosovo have never been punished.
Saranda Bogujevci remembers being lined up with other family members and shot against a garden wall under a hazel tree in her home town as a 13-year-old schoolgirl. She was left for dead, slumped among a pile of corpses of women and children, including her mother and brother, after being hit with 16 bullets in her back, right leg and arm.
This brutal act of ethnic cleansing was carried out by a special Serbian police unit known as the Scorpions. "The older you get the more difficult it is to cope with," she said, describing how she was evacuated for medical treatment to Manchester, where she ended up settling. In 2016, she returned to Kosovo to become an MP in Kurti's party. She too believes the special court may be counterproductive.
"It's important of course that there is justice for all of the victims," she told me. "But no one's talking about crimes Serbia committed. It frustrates me that more pressure is not being put on Serbia to acknowledge what they did. Even today, Serbia continues trying to destabilise us."

Prosecutors of the Kosovo Specialist Chambers Court charged Thaci, Kadri Veseli, Rexhep Selimi, and former KLA spokesman Jakup Krasniqi withmurder, torture, forced disappearances, persecution and cruel treatment of ethnicAlbanians, Roma and Serbs, for the purpose of gaining control over the entire province. The evidence will show that it was to gain power," said prosecutor Alex Whiting, adding that the KLA had a "clear and explicit policy totarget collaborators and perceived traitors, including political opponents." In addition todesire for power, the defendants were motivated by "fear" that their cause might be defeated and "hatred" of Serbs after clashes with the Yugoslav military and police, the prosecutors argued. (Is this prosecutor trying to give them an excuse, fear?)

The indictment alleges that at least 407 people were abducted and extrajudicially imprisoned, and at least 100 of them were murdered, between January 1, 1998 and December 31, 2000. NATO launched a 78-day air war on behalf of the KLA in March 1999.

"I'm fully not guilty," Thaci, 54, told the tribunal, repeating his plea from 2020 when he was detained. The others pleaded not guilty as well.

Thaci went from being a KLA commander known as 'Snake' to the leader of the Democratic Party of Kosovo (PDK) and the first prime minister of the self-proclaimed independent government in 2008. He became president in 2016, but stepped down after the indictment. Serbia does not recognize the breakaway province's declaration of independence.

In 2010, a Council of Europe investigation linked Thaci toorganized crime, including the trade of human organs forcibly harvested from KLA captives*. When the UN tribunal's case against other KLA leaders fell apart due to witness intimidation and murder, the Specialist Chambers was set up in 2015. (*They may be best friends with the Clintons. Thousands of ethnic Albanians rallied in Kosovo over the weekend to protest the trial, and several dozen protested outside the court in the Netherlands as well. Albania's prime minister, Edi Rama, tweeted in support of Thaci, noting that he was "once hailed as the George Washington of Kosovoby Joe Biden himself!" The current US president was a senator at the time, and strongly supported the NATO war.

The German ambassador in Pristina also supported the court, tweeting: "It is not the KLA which is on trial... but individuals who are accused of i.e. grave war crimes." However, the indictment specifically charges Thaci and others withbeing part of a "joint criminal enterprise" to take over Kosovo. That legal doctrine, devised by an American lawyer, was first used by the ad-hoc tribunal for the former Yugoslavia in the 1990s, to go after the Serb military and political leadership.

Former Kosovo president Hashim Thaci led a bloody campaign against opponents that resulted in more than 100 murders during the 1990s independence war against Serbia, the start of his war crimes trial heard Monday.

Thaci and three other top members of the Kosovo Liberation Army (KLA) rebel group all denied 10 counts of war crimes and crimes against humanity as they appeared at a special tribunal in The Hague.

While Thaci and the others went on to be seen as guerrilla heroes, prosecutors said the ethnic Albanian KLA openly enforced a brutal reign of imprisonment, torture and killings to tighten their grip on power during and after the 1998-1999 war.

"These four men were without any doubt the principal leaders of the KLA and they have been celebrated and honoured for it," prosecutor Alex Whiting told the court.

"But there was a darker side to their leadership."

Thaci, wearing a blue tie and charcoal grey suit and listening through headphones, confirmed the plea he entered when he first appeared before the court in 2020.

"I'm fully not guilty," the 54-year-old Thaci told the tribunal.

His fellow defendants, former KLA spokesman Jakup Krasniqi, Thaci's closest political ally Kadri Veseli and key KLA figure Rexhep Selimi, also denied the charges.

Thousands of people rallied in Kosovo's capital Pristina on Sunday in support of Thaci, who resigned as president in late 2020 and handed himself into the court to face charges.

My most informed guess is that this was a subpoena for documents from a bank in China or another country that owns a bank and has a branch office in the United States. It would appear that Mueller served a subpoena on a bank in the US (the Corporation) that is the branch of a foreign bank owned by the foreign government in order to obtain records maintained in the bank outside of the US.

The Circuit Court reviewed an "ex parte submission" from the government, presumably Mueller's office, and found that it "satisfied its burden of establishing a reasonable probability that this 'action is based upon . . . an act outside the territory of the United States in connection with a commercial activity of the foreign state elsewhere' and that the act cause[d] a direct effect in the United States."

The other clue is the claim by "the Corporation" that complying with the subpoena "would require the Corporation to violate Company A's law." This is typically the argument advanced by Chinese banks in opposing US civil and criminal subpoenas for customer information held in China. A similar argument might also apply to other countries with state-owned banks.

A court case stemming from a decades old murder of a Columbia University professor may torpedo Mueller and prevent him from publishing a report on so-called Trump-Russia collusion.

Although the court case is completely unrelated to Mueller's witch hunt, it may prevent him from publishing a report from information obtained by a Washington grand jury.

A Washington appeals court is scheduled to hear the murder case next month and if they side with the DOJ and rule that the judge cannot release any grand jury information, it could derail Mueller from releasing his Russia report, according to legal experts.

This 'sleeper' case could also prevent Mueller from giving a Russia report to Congress.

We all know Mueller and the Democrat-Deep State cabal is gunning for Trump and their ultimate goal is to impeach the President.

Far left Politico reported:

"It is a sleeper case," Harvard Law professor Alex Whiting said. "If the D.C. Circuit were to accept the Department of Justice's arguments...that would have potentially enormous implications for the future of the information from the Mueller investigation. The case at the appeals court was brought by attorney and author Stuart McKeever, who has spent decades investigating the disappearance of Jesus Galindez, a Columbia university professor and political activist who vanished in New York City in 1956. His body was never found, but there are indications that he was kidnapped and flown to the Dominican Republic, where he may have been killed.

McKeever, 82, wants a judge to release secret testimony given to a DC-based grand jury that investigated Galindez's disappearance. But the Justice Department argues that judges don't have "inherent authority" to release such information unless it falls under exemptions approved by Congress, which don't apply in the Galindez case - or in many others, including potentially Mueller's investigation.

"I've been on the journey almost 40 years to tell this story," McKeever said Sunday in a phone interview from his South Carolina home. "The Justice Department does not want this case to break the dam."

The arguments in McKeever's case next month will take place at the D.C. Circuit Court of Appeals in Washington - two floors above where Mueller's grand jury meets. Then there's the midterm elections...

If the Democrats take the House in November, the House Judiciary could subpoena Mueller's report as part of an impeachment probe because of a 1974 DC Circuit ruling, reported Politico.

If Republicans keep the house, a subpoena is less likely therefore Mueller would have a problem given the federal court rule that ensures grand jury secrecy.

According to Politico, last week the judges on the DC Circuit court were announced and they lean right:

Adding to the political drama around the McKeever case: the judges drawn to decide it. The three-judge panel announced by the court last week leans Republican, which is unusual since most of the D.C. Circuit's active judges are Democrats. In addition, the panel will include the appeals court's only Trump appointee, Judge Greg Katsas. Also assigned to the case: Judge Douglas Ginsburg, a Reagan appointee, and Judge Sri Srinivasan, an Obama appointee.

Of course Mueller is prepared to fight this hurdle as he won't let anything get in his way of attempting to get Trump removed, which is his ultimate goal.

One thing is for sure-this is going to be one explosive Autumn in the D.C. swamp.
