Panhandling is Freedom of Speech, according to the US SUPREME COURT
The Court interprets the First Amendment to generally prohibit any laws that regulate or restrict "expression because of its message, its ideas, its subject matter, or its content."31
Courts subject laws that discriminate on the basis of content to strict scrutiny.33 For a law to survive this exacting test, a court must find that the regulation serves a "compelling state interest" and "is narrowly drawn to achieve that end."34 Courts define narrowly tailored as a "least restrictive means" test.35 Thus, if the government could accomplish its interest in any other way than a content-based regulation on speech, the law fails strict scrutiny and is unconstitutional.36
Panhandling challenges should be seen as a struggle between two First Amendment rights: the right of beggars to express themselves and bystanders to remove themselves from uncomfortable speech.240 This approach, while never broadly advocated for, does have some support from Judge Alex Kozinski of the Ninth Circuit. In his dissent in Berger, Judge Kozinski argued that "[c]itizens visiting the Center also have First Amendment rights: to enjoy the arts, music and programs offered there."241 This captive audience approach would also yield results more in line with what one would expect and desire doctrine to produce within the categorical framework of panhandling laws:
Aggressive-begging statutes that targeted panhandlers who make their audiences captive would possess a chance of passing strict scrutiny.
Extremely specific location bans in places like subway cars242 or lines for popular attractions where audiences cannot avoid panhandling would also stand a chance at surviving such a balancing test regardless of whether or not those venues were public or nonpublic forums. More general location bans, such as those in a popular area of town, would fail because it would ensnare panhandlers who did not create a captive environment.
Blanket bans, which would prevent panhandling that did not create a captive audience, would fail constitutional challenges.

The FBI is conducting a search of President Joe Biden's home in Rehoboth Beach, Delaware, on Wednesday as a special counsel investigation into his handling of classified material begins in earnest.
"Today, with the President's full support and cooperation, the DOJ is conducting a planned search of his home in Rehoboth, Delaware," Biden's personal attorney Bob Bauer wrote in a statement.
"Under DOJ's standard procedures, in the interests of operational security and integrity, it sought to do this work without advance public notice, and we agreed to cooperate," Bauer said. "The search today is a further step in a thorough and timely DOJ process we will continue to fully support and facilitate. We will have further information at the conclusion of today's search."
Reporters positioned in the coastal community observed black sport utility vehicles and sedans arriving to the home mid-morning.
The FBI search in Rehoboth marks the third known occasion that federal agents have searched properties associated with Biden to look for classified material.
The FBI previously searched Biden's home in Wilmington, Delaware, turning up what his lawyer described as multiple items containing classified material. That search occurred January 20.
The FBI also searched the Washington office of the Penn Biden Center in mid-November after Biden's attorneys first discovered classified material in a locked closet at the think tank.
Biden purchased his home in Rehoboth after leaving the vice presidency. He and his wife occasionally spend weekends there, most recently from January 20 to 23.
The search comes on the day that the Justice Department announced special counsel Robert Hur officially began his job overseeing the investigation of Biden's handling of classified documents. Hur takes over for US Attorney John Lausch who conducted an initial review that has since become a full blown criminal investigation.
Hur, who previously served as US attorney in Maryland was nominated to that position by then-President Donald Trump in 2017 and he served in the role until his resignation in 2021. In the job, Hur played a key role in a number of high-profile cases, including a children's book scandal involving then-Baltimore Mayor Catherine Pugh that resulted in Pugh being sentenced to three years in prison.
He was unanimously confirmed by the Senate to the US attorney job in 2018, and at the time he received praise from both of Maryland's Democratic senators, who expressed confidence in his ability to handle critical issues facing the state.
Prior to his time with the DOJ, Hur was a law clerk for Chief Justice William Rehnquist and also clerked for a federal appellate judge, Alex Kozinski.

Why is the FBI withholding information on the DHS whistleblower's laptop and thumb drive?
In Amador County, California, on February 21, Philip Haney, author of See Something Say Nothing: A Homeland Security Officer Exposes the Government's Submission to Jihad, was found dead from a single gunshot wound. News reports suggested suicide but the local sheriff found "this is not the case." The death of Haney, 66, was a homicide, the unlawful killing of one person by another. The Amador County sheriff had no suspects but did find some clues. Deputies recovered "numerous thumb drives and a laptop" from the crime scene, and "those items and numerous other pieces of evidence, were turned over to the FBI." The sheriff "hopes to complete our review of the reports and compare the FBI's analysis with what we have already collected and analyzed within a few weeks after receipt." That was on July 22, and a week after the November 3 election, nearly eight months after the homicide, the FBI "analysis" has not come to light. The lapse could be partly explained by early reporting on the homicide.
"Haney's controversial accusations that the Obama administration could have prevented terrorist attacks were polarizing among Americans," Laura Hoy of CNN reported on February 23. As Hoy explained, "Haney's death is likely to become political ammo for Republicans heading into the 2020 presidential elections." Haney's "death" did not become an election issue because key information failed to emerge from the FBI, which is becoming more like the Soviet KGB. Soviet bosses showed the KGB a man and they found the crime. The FBI deployed the same method with General Michael Flynn, Trump's pick for national security advisor. FBI lawyer Kevin Clinesmith altered a document saying that Trump campaign adviser Carter Page was not a source for the CIA, even though he was. In similar style, former FBI director James Comey, FBI counterintelligence boss Peter Strzok, and FBI lawyer Lisa Page were all participants in illegal covert operations against candidate and President Trump. The KGB also conducted "wet" operations, code for assassination and murder. Those who doubt the FBI could do likewise might consider the case of Randy Weaver, smeared as a "white separatist" and entrapped on bogus charges.
After a gun battle that claimed the life of Weaver's son and a U.S. Marshal, the FBI deployed massive military force against a single family. FBI sniper Lon Horiuchi shot Randy's wife Vicki through the head as she held her infant daughter. Snipers are trained carefully to "acquire" their targets, so the claim that the killing was accidental is hard to accept. Horiuchi faced charges and enjoyed the services of a government lawyer. Even so, William Barr, now U.S. attorney general, organized former attorneys general to support the FBI sniper, and assisted in legal arguments in favor of the FBI. Appeal court judge Alex Kozinski, by contrast, said the FBI had established "a 007 standard for the use of deadly force." In other words, a license to kill. Haney's friends and relatives have a right to wonder if the FBI had some role beyond the withholding of evidence until after the November election. No official probe has been announced, but the FBI provides ample grounds for suspicion.

When will they ever learn? Ninth Circuit Judge Alex Kozinski declared months ago in a much-quoted opinion that there is "an epidemic of Brady violations abroad in the land." And yet, prosecutors continue to deny there's a problem. Indeed, the Department of Justice gets outright indignant at the suggestion, and so do many state court prosecutors. They bristle at the very mention of the possibility. But here's another doozy: The People (of California) v. Efrain Velasco-Palacios. In this unpublished opinion from the Fifth Appellate District, the California Court of Appeal reveals that state prosecutors and California Attorney General Kamala Harris continue to be part of the problem. Kern County prosecutor Robert Murray committed "outrageous government misconduct." Ms. Harris and her staff defended the indefensible-California State prosecutor Murray flat out falsified a transcript of a defendant's confession. Kern County prosecutor Robert Murray added two lines of transcript to "evidence" that the defendant confessed to an even more egregious offense than that with which he had been charged-the already hideous offense of molesting a child. With the two sentences that state's attorney Murray perjuriously added, Murray was able to threaten charges that carried a term of life in prison. Capitalizing to the maximum on his outright fabrication, state's attorney Robert Murray committed his own crime against the defendant at the crucial time when defense counsel was consulting with the defendant on a possible plea.
Prosecutor Murray had ample time and opportunity to correct his lies and his falsification of the transcript, but instead, he let it go until defense counsel had encouraged his client to plead guilty based on this fabricated evidence. Not until after defense counsel requested the original tape recording from which the transcript was made did Mr. Murray admit that he had added the most incriminating statements to the transcript. When confronted with the defense's motion to dismiss the indictment for outrageous prosecutorial misconduct, Mr. Murray claimed his own false alteration of the transcript was "in jest," a "joke" between two lawyers, and harmless to the defendant. Mr. Murray lobbed in another little bombshell for good measure, swearing that defense counsel had said that the defendant's defense was "not viable." Mr. Murray's actions caused the disqualification of defense counsel, and as one might expect, the defendant did not feel that he could trust his own attorney. Defense counsel had to testify at the hearing, the attorney-client privilege was affected, and new counsel had to be named. California Judge H.A. Staley got it right. He found that Mr. Murray's fabrication of "evidence"-falsifying the transcript of a confession during discovery and plea negotiations-was "egregious, outrageous, and . . . shocked the conscience." The trial judge saw no laughing matter-and neither should the rest of us. He dismissed the indictment completely, and in a scathing opinion, also quoted by the appellate court, wrote that the prosecutor's actions "diluted the protections accompanying the right to counsel and ran the risk of fraudulently inducing defendant to enter a plea and forfeit his right to a jury trial." The court refused to "tolerate such outrageous conduct that results in the depravation of basic fundamental constitutional rights that are designed to provide basic fairness."
Undaunted by the criminal conduct of a state prosecutor, or the district court's opinion, Ms. Harris appealed the decision dismissing the indictment. According to the California attorney general, only abject physical brutality would warrant a finding of prosecutorial misconduct and the dismissal of an indictment. Fortunately for all of us-and the Constitution-she lost again. This is Ms. Harris' third strike in hardly as many months-and those are only the ones that have come to our attention.

The California voting rights case you will never hear about
This is so far under the radar that you are guaranteed never to hear about it. A landmark case is crawling its way through the Ninth Circuit Court of Appeals, and no one is the wiser. California's secretary of state and attorney general want it that way.
The case is number 18-17458, titled Citizens for Fair Representation v. Alex Padilla. On March 6, 2020, in Courtroom 1, Third Floor, Room 338, James R. Browning U.S. Courthouse, San Francisco at 9:30 A.M., you were supposed to be able hear oral arguments on how one state senator cannot effectively represent one million Californians and how one state Assembly member cannot represent 500,000 Californians. The basis of this claim is invidious discrimination that has prevented certain minorities from ever having held one of these seats in the Legislature, since its membership is fixed at 40 and 80, respectively.
Why were you not able to hear oral arguments? Well, the Ninth Circuit felt that enough information had been provided by both parties in the case that the court could make a ruling without hearing them in open court. I'm speculating that the real reason this was swept under the rug is that none other than the former chief justice of the Ninth Circuit, Alex Kozinski, was prepared to make the arguments on behalf of the plaintiffs, Citizens for Fair Representation (CFR).
But let me back up a bit. It is relevant to know why this case is rotting in the Ninth Circuit to begin with. The case was originally set in front of the Federal Court of the Eastern District of California. The plaintiffs drew Justice Kimberly J. Mueller as the presiding judge. During oral presentations, the judge was asked by plaintiffs' attorneys if the case is important and not frivolous. She responded in the affirmative. Judge Mueller then asked defendant's counsel if he believed that the question is important, and he stated that it is. As a result, this was issued by the court:
14 MINUTE ORDER issued by Courtroom Deputy A. Waldrop for District Judge Kimberly J. Mueller on 8/2/2017: In light of plaintiffs complaint and notice of requirement of three judge court, (ECF Nos.1, 12), the court has determined this case implicates 28 U.S. C. § 2284(a), providing for the convening of a three judge court. The court thereby DIRECTS the Clerk of Court to formally notify the Chief Judge of the Ninth Circuit of the pendency of this action, as 20 U.S.C. § 2284(b)(1) requires, so that he may appoint a three-judge court. SO ORDERED.
It is important to note that all voting rights cases are to be heard by a three-judge court, and any appeals go straight to the Supreme Court, and that court must hear the case. As such, after some scrambling by California, Justice Mueller rescinded her previous Minute Order with the following:

Mueller: Upon consideration of the parties' filings relating to the question of whether a three judge court need be convened to resolve defendant's pending motion to dismiss and plaintiffs' pending motion to amend, the court has determined that it is premature to request the convening of such a court prior to this court's threshold determination of jurisdiction and justiciability. See Shapiro V. McManus, 136 S. Ct. 450, 455 (2015). Defendant's ex parte application for reconsideration (ECF [15]) is granted to the extent the direction to the clerk of the Court at ECF 14 is WITHDRAWN until the court has resolved the pending motions. The August 25, 2017 hearing on the application for reconsideration is VACATED.
What you may not understand is that this simple Minute Order is of historical importance. Never in the history of these United States has a judge appointed a three-judge court, then rescinded the order. When asked why, Justice Mueller responded that after consulting with others on the court, she changed her original ruling. This is significant, as she cannot "consult" with others who did not sit in attendance at the trial at hand. This would mean that others would aid in a ruling who did not have full knowledge of the information and proceedings. After forcing a couple of amended complaints by the plaintiffs, Judge Mueller finally dismissed the case with prejudice.

Good morning Anons, I have been looking into Judge John Roll this morning. He is the Judge that was killed in Tucson when Gabby Gifford was shot. Before his assassination he declared a Judicial emergency in Tucson because of the massive immigrant crisis.
Proponents of Operation Streamline, including U.S. Sen. John McCain, R-Ariz., call the initiative a success. McCain wrote in a letter to the Arizona Daily Star on June 29, 2010, that the initiative has slowed the flow of illegal immigrants in the Yuma Sector of Arizona to a "trickle" and needs to be expanded.
But Operation Streamline has put a strain on the Tucson courthouse. In a story in the Daily Star just days before the mass shooting, Roll said the increase in felony court filings is a natural outgrowth of the fact there are more than 3,000 Border Patrol officers in the Tucson Sector. He added that 16,000 misdemeanor and petty cases are filed annually as a result of Operation Streamline.
In the months before his death, Roll had declared a "judicial emergency" in Arizona's federal courts and urged a delay in criminal trials of up to six months because of the shortage of judges, the Daily Star reported.

On the 21st of December, 2010, Judge Roll sent a follow-up email to Judge Kozinski. Attached to his email was a letter of support from Gabrielle Giffords - who was also shot (in the head but survived and is making remarkable progress) during the January 8th rampage - and one of her Congressional colleagues. At the time of his death, the need for more judges in southern Arizona remained an open issue.

When Judge Alex Kozinski bolted from the federal bench just in time to put an end to any inquiry into allegations of decades of sexual misconduct, it looked like the end of it. Like the Duke boys crossing the county line, retiring from the federal bench offers complete and total protection from the long arm of justice. Kozinski's strategy was so elegant, the Third Circuit's Maryanne Trump Barry pulled the exact same move once the New York Times started looking into the creative approach she and her brother took with the IRS.

It's now being reported that six former far left liberal Ninth Circuit clerks and externs are now saying that the liberal Judge Alex Kozinski subjected them to sexual comments and unwelcome situations.
One of the former Kozinski clerks, Heidi Bond, who was his clerk between 2006 and 2007 has gone on the record with allegations that on multiple occasions the judge summoned her alone to his chambers in order to show her pornography which was unrelated to any case before the judge. He then asked if the images turned her on. Bond recounts at least three different instances of being shown porn by her boss and says the experiences were shocking. She has also written an extremely disturbing first-person account of her experiences of clerking for Judge Kozinski where she also details Kozinski isolating her from her co-clerks to discuss his sexual history
The Fallout continues today as Harvard Law students seek to stop future attacks:
In August, a group of Harvard and Yale law students sent a memo to the Judicial Conference of the United States - the policy-making body for U.S. federal courts - urging the conference to a "adopt reforms regarding the role and responsibilities of law schools in reporting and responding to complaints of harassment and other abusive workplace practices."
That memo came in response to recommendations put forward by the Federal Judiciary Workplace Conduct Working Group, a committee formed following reports that former Ninth Circuit Judge Alex Kozinski sexually harassed several of his clerks and employees. Kozinski, who stepped down in the wake of the allegations, has said he never intended to make his clerks uncomfortable.
In October, members of the Pipeline Parity Project penned an open letter to the Judicial Conference calling for three policies they believed were missing from the working group's recommendations: a climate survey, an informal reporting structure, and a centralized office to receive reports. Hundreds of students from law schools across the country signed the letter. Pipeline Parity Project members also sent recommendations to the Judicial Conference earlier this month.
Second-year Law student and Pipeline Parity Project member Emma R. Janger said in an interview Thursday that the group set out at its founding to organize in response to Kozinski's alleged sexual harassment of clerks.
"One of the absolutely founding sort of impetuses for Pipeline was the allegations that came out against Ninth Circuit Judge Alex Kozinski," Janger said. "One of the reasons Pipeline was founded was in response . . . the fact that as much as the allegations sent shockwaves, by many important players in the legal profession, Kozinski's harassment was viewed as an open secret."

Here's what Rod Rosenstein's dismissal could mean for Robert Mueller
Special counsel Robert Mueller could see significant changes to the way his Russia investigation operates if President Trump were to fire Deputy Attorney General Rod Rosenstein or if he were to resign, according to close observers of the Justice Department. The question suddenly became relevant this week after it became clear that Rosenstein offered to resign following a report said he was mulling a coup against Trump. The two men are expected to meet Thursday to clear the air about the reports that Rosenstein might be dismissed, but the possibility he might still be let go has some worried that the change could prove to be significant for Mueller's investigation.
Rosenstein oversees the Mueller investigation into whether President Trump's campaign colluded with Russia to defeat Hillary Clinton. And while Mueller's work would continue without Rosenstein, some say it has the potential to be altered, depending on who takes over. The next person in line for that job is Solicitor General Noel Francisco, a Trump appointee confirmed last year in the Senate by a party vote. Francisco is a known conservative lawyer that worked in the George W. Bush administration, as well as in the private sector. Jeffrey Cramer, a former federal prosecutor, told the Washington Examiner that Francisco "is a not a fan of independent counsel type investigations," and could find ways to limit Mueller's work. "At the end of his efforts, Mueller could produce a report" to Francisco, said Cramer. "Legally, the [person overseeing Mueller] could do anything he wants with the report. There would be tremendous political pressure to make the report public to some level." Francisco or anyone else overseeing Mueller would also continue to exert power of decisions such as indictments and search warrants, Cramer explained, so decisions to approve or not approve those actions could change.
Federal guidelines make it clear that whoever replaces Rosenstein could find ways to adjust the way Mueller works. Those guidelines say the special counsel "shall not be subject to the day-to-day supervision of any official of the department." But those same guidelines also say his replacement "may request that the Special Counsel provide an explanation for any investigative or prosecutorial step, and may after review conclude that the action is so inappropriate or unwarranted under established departmental practices that it should not be pursued." The replacement can also rein in the investigation by disciplinary action for "misconduct and breach of ethical duties under the same standards and to the same extent as are other employees" of the Justice Department, according to the guidelines. If Francisco recuses himself from the Mueller investigation, Steve Engel, who heads the department's Office of Legal Counsel, is the next in line. Engel served in the Justice Department during the George W. Bush administration and clerked for Judge Alex Kozinski, who stepped down from his post in December amid sexual misconduct allegations.
If it's Engel, he would have the same flexibility as Francisco to alter Mueller's work. One observer said the nature of Rosenstein's dismissal could affect how Mueller's investigation proceeds.

The letter is addressed to our favorite Deputy Attorney General [RR] and the Senate Judiciary committee.
Also the link goes on to explain how Kamilla Harris is linked to certain members of the University of California system, which imbezzled millions of dollars, but was covered up by Harris as AG. As well as covering up the mysterious suicide in December 2010 of UC Davis Medical Center employee Todd Georlich, who apparently died before he was hanged.
The letter is also details how the same tactics used against Kavanaugh were used against his mentor, Judge Alex Kozinski of the U.S. Court of Appeals for the 9th Circuit.

Fresh off the seeming success of the smear campaign against Congressman Jim Jordan (R-OH), a liberal feminist group is attempting to connect Judge Brett Kavanaugh to the sexual harassment of his former boss.
Kavanaugh had previously clerked for 9th U.S. Circuit Judge Alex Kozinski from 1990 to 1991. Kozinski abruptly retired last year after 15 women accused him of sexual harassment. Now Ultraviolet is tying Kavanaugh to Kozinski by demanding an investigation into whether the Supreme Court nominee knew about his former boss' alleged abuse.
"Judge Kozinski's office had a long history of being a toxic and dangerous environment for women," chief campaigns officer for UltraViolet, Karin Roland, told McClatchy in a statement. Wood v. Ryan
In July 2014, Joseph Rudolph Wood, who had been sentenced to death, filed a motion before the 9th Circuit Court of Appeals claiming a right to know which chemicals were included in the lethal injection that was to be used to execute him. While the court denied his motion, Kozinski issued a dissenting opinion, calling the use of drugs a "misguided effort to mask the brutality of executions by making them look serene and peaceful." He went on to argue that states should revert to more primitive methods like the guillotine, electric chair, gas chamber, and firing squads because they are accurate and do not mask the brutality. He wrote, "Sure, firing squads can be messy, but if we are willing to carry out executions, we should not shield ourselves from the reality that we are shedding human blood. If we, as a society, cannot stomach the splatter from an execution carried out by firing squad, then we shouldn't be carrying out executions at all."[44][45][46][47][48][49][50][51] Wood's execution would subsequently take 1 hour 57 minutes before he was pronounced dead.[50]
