RALEIGH, N.C. (AP) - The North Carolina Court of Appeals ruled Tuesday that Gov. Roy Cooper's secretary of health and human services should not be immune from a lawsuit over the administration's restrictions on large gatherings in the early months of the coronavirus
The Department of Health and Human Services temporarily shut down Ace Speedway, a small stock car racetrack in Alamance County, in June 2020 after it repeatedly defied Cooper's executive order limiting outdoor crowds to mitigate the spread of COVID-19.
The racetrack filed counterclaims that August, alleging the department unlawfully singled out the business for its acts of protest and violated its employees' constitutional right to earn a living.
The appeals court unanimously upheld a January 2021 trial court ruling denying a DHHS motion to dismiss Ace Speedway's claims that the agency selectively enforced the governor's orders and impeded the racetrack's ability to make money.
"This case makes us consider the use of overwhelming power by the State against the individual liberties of its citizens and how that use of power may be challenged," the judges wrote.
DHHS Secretary Kody Kinsley, whose predecessor filed the 2020 order to close the speedway, argued before the appeals court that executive officials should be immune from civil lawsuits. But the court ruled Ace's claims were "sufficient to survive the secretary's motion to dismiss" the lawsuit.
Three days after Cooper issued an executive order placing a 25-person cap on all outdoor gatherings, Ace Speedway hosted approximately 2,550 spectators for its first race of the season on May 23, 2020.
A sign posted on site at a subsequent race that June labeled the 2,000-person gathering a "peaceful protest of injustice and inequality everywhere," the lawsuit states.
When the speedway continued to draw crowds of 1,000 or more, the governor's office ordered Alamance County Sheriff Terry Johnson to intervene. After Johnson refused to issue a misdemeanor citation, the Cooper administration declared Ace Speedway an "imminent hazard" for the spread of COVID-19 and called for its closure until the emergency order expired.
A court has yet to rule on the merits of Ace Speedway's claims. But the panel of three Republican judges drew attention Tuesday to a clause in the state Constitution guaranteeing North Carolinians a right to the "fruits of their labor." Recent court precedents say the clause is synonymous with the right to earn a living.
The ruling noted that the order to close the racetrack "restricted or otherwise interfered with the lawful operation of a business serving the public."

A popular high school teacher was killed in a shootout with a Mexican drug cartel last week.
Authorities say Barney Dale Harris and his brother-in-law tried to rob its "stash house."
In a press conference, the Alamance County sheriff called the scene an "old Western shootout."

A high school teacher and coach in North Carolina was killed last week in a shootout with the Mexican drug cartel after attempting to rob an alleged "stash house" belonging to the group, authorities said Wednesday.
Barney Dale Harris, a high school Spanish teacher and head basketball coach, and his brother-in-law, Steven Alexander Stewart Jr. are accused of breaking into a mobile home belonging to a member of the Jalisco New Generation Cartel, according to NBC News.
Alamance County Sheriff Terry Johnson said at a Wednesday news conference the Jalisco New Generations cartel is one of the world's most powerful drug trafficking organizations, the outlet reported.
"I can tell you right now, when we are dealing with the Mexican drug cartel, someone is going to die as a result of this," 11 Eyewitness News reported Johnson said.
Investigators say Harris and Stewart Jr. broke into the home of Alonso Beltra Lara in the early morning of April 8, and waited for him to return home.
When the 18-year-old Lara arrived, authorities say Harris and Stewart Jr. questioned him about a stash of money and drugs. When Lara refused to cooperate, he was taken outside, bound by his feet, and shot "execution style," twice in the back of the head, according to The Charlotte Observer.
Additional cartel members then arrived and opened fire, killing Harris, 11 Eyewitness News reported.
Deputies responded to the scene around 1 a.m. after receiving multiple calls of gunfire at the mobile home located about 30 miles northwest of Greensboro, the sheriff's office said.
When authorities arrived, they found Harris dead in a bedroom wearing a bulletproof vest, mask, and gloves, according to The Observer. Lara was found alive, though he was later pronounced dead at the hospital.
"It was almost like an old Western shootout," Johnson said.
No other injuries were reported, but Johnson said officers found over 30 shell casings in and around the mobile home, including bullet holes in three nearby mobile homes, The Observer reported.
Deputies seized five firearms, 1.2 kilograms of cocaine, and roughly $7,000 in cash from the scene, authorities said.
Stewart Jr., 32 was arrested on Sunday after officers searched his home and found what they described as "related objects tied to the crime scene," according to NBC. He was charged with first-degree burglary and first-degree murder, and is being held without bond in an Alamance County jail.
In a Wednesday press conference, Johnson warned of possible retaliation by the cartel, saying, "the Mexican cartels, they don't forget, they're gonna pay back somebody, somewhere. And that concerns me greatly as sheriff of this county."
Harris's school Union Academy Charter School in Monroe, posted a statement responding to his death last week that has since been taken down, according to The Observer.
"The UA community is mourning the unexpected loss of teacher and coach Barney Harris," the school posted. "UA students, staff, and families are asked to wear UA Spirit Wear on Monday, April 12, to celebrate the life of Coach Barney Harris whose motto 'All Love…No Fear' will be forever a part of who we are as a school."
After the sheriff announced more details Wednesday, the school released another statement to WBTV.
"The Union Academy family was shocked and devastated to hear the information and will continue to focus on supporting our students and families," the school told the outlet.

NC High School Coach Killed While Reportedly Robbing Sinaloa Cartel Stash House
A high school basketball coach in North Carolina is dead after he allegedly attempted to steal from a local Sinaloa Cartel drug runner. Police in Alamance County say the coach went with another man to steal money and drugs.
Alamance County Sheriff Terry Johnson told reporters, "It was believed that this was during a home invasion for money and drugs," WCNC NBC reported.
Union Academy basketball coach Barney Harris reportedly went to a house on April 8 with another man to carry out the home invasion robbery. During the attempted robbery, a shootout ensued leaving Harris mortally wounded.
Sheriff Johnson said the house was a drug-running operation for the Sinaloa Cartel. Harris, and his brother-in-law Steven Alexander Stewart, Jr., killed the drug runner shortly before the shootout began. Harris, who wore a ballistic vest, sustained multiple gunshot wounds. He died at the scene.
"I can tell you this right now. When we are dealing with the Mexican drug cartel, somebody's probably going to die as a result of this right here, somewhere else," the sheriff said. "And we did not want to put it out there until we could get a good grip of what's going on here."
ABC11 reported that Harris and Stewart arrived at the mobile home and found 18-year-old Alonso Beltran Lara inside. The duo allegedly interrogated the cartel member about the location of the stash. When he refused to answer, they shot him in the head, police investigators stated.
"And they were trying to find the money and drugs and apparently he didn't give them the information to do that and he was technically close range, two bullets to the back of the head, he was executed," Sheriff Johnson stated.
Investigators found multiple firearms at the scene and described the incident as "an old western shootout." Stewart managed to escape and was later arrested by sheriff's deputies. He faces charges of first-degree murder and first-degree burglary.
Johnson said other mobile homes nearby were struck by gunfire but no one was injured.
"The neighbors are shooting and the bullets are hitting over here in our trailer," a frightened neighbor said in a 911 call.
Retired FBI Assistant Director Chris Swecker told the local NBC affiliate the Sinaloa Cartel has a "significant presence in Alamance County." The county is located between Greensboro and Durham, North Carolina.
"The cartels are notorious for their violence," Swecker continued. "They are probably the most violent criminal organization on the face of the earth."
During the investigation, police seized multiple firearms, $7,000 in cash and approximately 1.2 kilograms of cocaine.
WSOC-TV9 reported the Union Academy hired Harris as a basketball coach in July 2017. He also taught Spanish and coached the varsity men's track team.
Police are currently searching for Juan Daniel Salinas Lara in connection with the drug trafficking operation.

North Carolina Sheriffs, Dealing With Cartel Violence, Call for Congress to Fund Wall
More than 1,400 miles north of the southwest border, sheriffs are battling drug trafficking, overdoses, gang and cartel violence, and human trafficking.
"If something gets through the border, within a few days, two or three days, it's across this country," said Rockingham County Sheriff Sam Page.
Sheriffs in North Carolina are calling on Congress to approve funding for a border wall and better border security.
North Carolina has become a major hub for the transport and distribution of wholesale cocaine and other drugs throughout the northeastern corridor, according to the Drug Enforcement Administration (DEA).
Page said he does what he can to support the sheriffs situated in counties along the southwest border.
"If we can support them, it prevents a lot of those drugs from coming in and getting into our communities here in the interior United States," Page said.
"If we fail to secure our borders, every sheriff in America will become a border sheriff."
Alamance County Sheriff Terry Johnson said his county has huge problems with the Sinaloa cartel and its drug trafficking operations.
Alamance is right on the intersection of two major interstates, I-40 and I-95, and nearby city Greensboro has become the drug trafficking hub for the southeastern United States, Johnson said.
In March, 35 members and associates of the Nine Trey Gangsters, a set of the United Blood Nation gang, pled guilty in North Carolina to racketeering conspiracy and related charges of drug trafficking, wire fraud, and firearm possession, according to a 2018 DEA report.
The gang's leaders were also directing-from both inside the prisons and in communities-the gang's assaults, robberies, and drug trafficking up and down the Eastern United States, the report said.
