Largest Christian university in US fined record amount

The largest Christian university in the U.S. is facing a record-setting fine from the Department of Education for allegedly deceiving thousands of students about the cost of its doctoral programs.
The department announced Tuesday it is fining Grand Canyon University $37.7 million, accusing it of lying to more than 7,500 former and current students about the price of the programs and saying 98 percent of students in them pay more than what is advertised.
The Federal Student Aid (FSA) office found the alleged deception went back to 2017, with the school telling students the programs cost between $40,000 and $49,000. Data from the school showed 78 percent paid $10,000 to $12,000 more, according to the department.
"GCU lied about the cost of its doctoral programs to attract students to enroll," said FSA Chief Operating Officer Richard Cordray. "FSA takes its oversight responsibilities seriously. GCU's lies harmed students, broke their trust, and led to unexpectedly high levels of student debt. Today, we are holding GCU accountable for its actions, protecting students and taxpayers, and upholding the integrity of the federal student aid programs." The office said GCU defended its decisions by saying there were disclosures the programs could cost more due to continuation classes. The department rejected that answer, arguing the information was buried in documents and did not cover the "substantial misrepresentations regarding cost."
The department is ordering GCU to fix the misrepresentation and go off the average debt a student incurs from the program. It also is requiring the school to tell current students about how to report violations and concerns about the university to the federal government.(Gov finding a victim when there is NO Victim involved. More Christian Schools will be targeted guaranteed!)
GCU released a statement Tuesday denying the allegations and denouncing the administration's statement.
The school said the disclaimer the programs could cost more due to continuation classes isplaced prominently in documentsfor students to see and that federal courts already agreed with it because it recently settled a case with similar allegations.
The university contends some of the actions by the department areretaliatory as the GCU has sued the administration to get its for-profit status changed to nonprofit.
"To be clear, GCU does not mislead or deceive students in any way. In fact, the opposite is true given that GCU goes above and beyond what is legally required," the school said. "While the Department requires that universities provide cost estimates only for the first year in college for first-year, first-time students, and only for undergraduate programs, GCU goes beyond these requirements by investing in proprietary technology that provides cost estimates for each year of the program of study and for all of its degree programs, including those at the doctoral level. GCU is looked at by its peers as an industry leader in transparency and its employees have been invited to speak at seven different higher education conferences on these matters."
GCU has 20 days to appeal the decision.

The Education Department plans to use secret shoppers to determine if schools are engaging in practices that violate rules around federal student aid programs.
The Federal Student Aid shoppers will assess recruitment, enrollment, financial aid, and other practices of higher education institutions to help spot potentially misleading or predatory practices, the Education Department said.
The initiative is part of a broader effort by the Biden administration to increase oversight of schools, improve student experiences, and hold low-performing and predatory schools accountable.
"Building the secret shopper program is a good investment that will return dividends towards protecting students and taxpayer dollars," Kyra Taylor, a staff attorney at National Consumer Law Center, told Yahoo Finance. "But this is just the first step [and] investigation alone is not enough. The Department must take bold steps to shut poorly performing schools down and to provide all borrowers who attended those schools with relief."
Shoppers will specifically be on the lookout for misrepresentations related to the following:
Transferability of credits
Job placement rates
Completion and withdrawal rates
Graduates' future earning potential
Career services
Cost of attendance
Amount of federal student aid
Accreditation status
Other practices that could violate regulations that govern participation in the federal student aid programs
If any misrepresentations are found, they can be used as evidence to support the enforcement division of the department or the Office of Inspector General's investigations.
"Secret shopping is another tool in FSA's toolbox as we expand our oversight work to hold predatory schools accountable," Richard Cordray, chief operating officer at Federal Student Aid (FSA), said in a press release. "Our focus - as always - is to ensure that students, borrowers, families, and taxpayers are not being preyed upon to make a quick buck."
Predatory and low-value schools have been a focus of the Biden administration and contribute to the student debt crisis, leading to debt discharges related to the closed school loan discharge and borrower loan defense discharge programs.
If a school closes while students are enrolled, federal student loan borrowers can have their loans discharged. If a school made fraudulent misrepresentations that caused a student to enroll, they can use the borrower loan defense to get their federal student loans discharged.
Under the Biden administration, the Department has discharged $11.4 billion in student loan debt related to the borrower loan defense discharge for students at ITT Tech, DeVry University, Corinthian College, and Westwood College.
Credits that students earned at ITT weren't transferable, and many ITT campuses lacked internet and training equipment, according to ED findings. Corinthian College was accused of misrepresentations about finances and job placement rates.
Westwood College made "substantial misrepresentations" about job placement rates, including "misleading guarantees" about getting jobs in their field of study, "assurances of unrealistic post-graduation salaries," and exaggerations about "the transferability of its credits" when the institution knew those credits "would rarely transfer," according to ED findings.
In addition to the secret shoppers, last year FSA released two bulletins to protect veterans and service members from schools making misrepresentations on the GI Bill and to set up a tip hotline so consumers can report any potential violations of laws for federal student aid programs.
In 2021, the administration also reinstated the Office of Enforcement within Federal Student Aid in charge of school oversight and accountability efforts.
"Schools that engage in fraud or misconduct are on notice that we may be listening and they should clean up accordingly," Kristen Donoghue, chief enforcement officer at FSA, said in the press release. "But schools that treat current and prospective students fairly and act lawfully have nothing to fear from secret shopping."

almost exactly a month before a Norfolk Southern train derailed and spewedhazardous materials in eastern Ohio,the company gave the maximum $10,000 to help bankroll Gov. Mike DeWine's inaugural festivities.
A 6 On Your Side examination of state records shows this contribution, which is part of $29,000 the Virginia-based corporation has contributed to DeWine's political funds since he first ran for governor in 2018, is merely one piece of an extensive, ongoing effort to influence statewide officials and Ohio lawmakers.
In all, the railway company has contributed about $98,000 during the past six years to Ohio statewide and legislative candidates, according to data from the secretary of state. Virtually all went to Republicans, although Norfolk Southern hedged its support for DeWine in 2018 with a $3,000 check to Democratic gubernatorial candidate Richard Cordray.
In addition, the company filed more than 200 state-required quarterly reports disclosing lobbying of state officials or legislators in the same period.
A total of 39 of those public disclosures showed that DeWine or another statewide officialwas the lobbyists' target, while another 167 were aimed at state lawmakers.
Most of the disclosed attempts to influence Ohio leaders came on generic rail or transportation issues. Some efforts, however, were devoted todefeating legislation that would have established tougher safety standardsfor rail yards and train operations.
Years of killing Ohio bills designed to make railroads safer
Getting special attention from Norfolk Southern was a bipartisan measure introduced in two consecutive legislation sessions which would have required a minimum of two-person crews on freight trains - pushed by advocates as a safety measure.
While the size of the crew has not publicly emerged as a factor in the East Palestine derailment, the ardent opposition of Norfolk Southern to that provision and other proposed rail safety measures underscores the company's strong efforts to avoid additional regulation.
In early 2021, lobbyists made their case to the office of Ohio Attorney General Dave Yost against the two-person crew mandate. The bill would have required the attorney general, at the request of the Public Utilities Commission, to bring a civil action against railroads that violated the law.
The penalties would have ranged from a possible $1,000 for a first violation to as much as $10,000 for a third violation within three years of the first.
There was no indication Yost did anything, and he is now threatening to sue the railroad over the East Palestine derailment, per a letter obtained by 6 On Your Side.

In the end, however, the lobbying effort was a success. While neither measure passed, the later version got five hearings in 2021 in the House Transportation and Public Safety Committee.
Republican co-sponsor Brett Hillyer of Uhrichsville had said at the time that the bill contained "railroad safety measures that are long overdue and critical not only for industry safety, but for the communities impacted by the railroads."

Biden to ax Trump investigations of secret foreign money in higher ed, college groups say
Academic freedom group says the reported pledge looks like a "simple case of the chickens letting the fox manage the henhouse."
The Biden administration plans to shutter its predecessor's investigations into undisclosed foreign funding of U.S. colleges and universities, the subject of years of warnings from elected officials, law enforcement and academic freedom groups, according to higher education lobbyists.
The commitment was recorded in an August letter from a higher ed lobbyist recapping a June 23 virtual briefing by top Department of Education officials for the American Council on Education (ACE) and other university groups, including the Council on Governmental Relations (COGR), which includes medical centers and independent research institutes.
Section 117 of the Higher Education Act requires institutions of higher education to file disclosure reports twice yearly that document their gifts from, or contracts with, foreign sources that are valued at $250,000 or more individually or cumulatively within a calendar year.
Higher education groups are miffed at the department for "substantial expansion of Section 117 reporting requirements, similar to what was proposed" under the Trump administration, ACE Senior Vice President Terry Hartle told Office of the Under Secretary Chief of Staff Melanie Muenzer, General Counsel Lisa Brown and Office of Federal Student Aid COO Richard Cordray.
"We also remain concerned that ED continues to assert" that an institution's failure to report foreign gifts violates its "Program Participation Agreement" for federal student aid eligibility, Hartle wrote in the Aug. 16 letter recounting the meeting on behalf of the higher ed groups.
But they are "pleased to learn that ED plans to close the outstanding Section 117 investigations that remain open," he said.
Those plans aren't disclosed in the slide deck by Brown and Cordray for the meeting, which the department said was organized by ACE but which COGR said was called by the feds. It happened about a month before the next disclosure deadline.
The discrepancy was apparently first noticed by Hogan Lovells lawyers who summarized the updated federal guidance on Section 117 for the legal publication Lexology Sept. 19. The Chronicle of Higher Education reported on ACE's letter recounting the pledge Oct. 5.
Asked if department officials explained why they were closing investigations or portrayed it as a policy change, ACE Vice President of Public Affairs Jon Riskind told Just the News, "I'll defer to what's in the letter."
A department spokesperson did not answer whether the pledge was premeditated or represents a policy change; clarify who called the meeting; or explain why the new administration has yet to open a Section 117 investigation of its own.
"The Department is committed to helping institutions of higher education understand and comply with the reporting requirements of Section 117" but is "not in a position to state when it will be closing any of the investigations," the statement read, pointing to its list of investigations and closures, which detail the allegations and resolutions.
Only four out of 19 have been closed, against the University of Texas (Nov. 25, 2020) and Georgetown, Texas A&M University and University of Alabama (Jan. 15, 2021), with the latter also the most recently opened investigation: Dec. 22, 2020.

Biden taps bevy of Obama alums for review of controversial financial agency
Leandra English, who spent months trying to seize control of the Consumer Financial Protection Bureau (CFPB) from President Donald Trump, will lead Joe Biden's transition team for the agency, the Biden campaign announced Tuesday.
English will be in charge of a team of seven others, including the legislative director for the United Autoworkers and six alums of the Obama-era CFPB. The group will advise the Biden campaign on taking over the agency when Biden assumes office in January.
English rose to public attention in 2017, when she claimed the role of acting CFPB director following the departure of Obama-era director Richard Cordray, in direct contention with Trump appointee Mick Mulvaney. In the ensuing months, English lost multiple court battles but continued her claim despite a lack of clarity on what, if anything, she was actually doing day-to-day. This stance made her a hero of the anti-Trump "resistance," with even Democratic leadership calling her the "rightful acting director."
English's appearance on the CFPB, therefore, is a harsh rebuttal to the Trump administration's regulatory agenda. Her appearance on the transition team-along with other Obama alums-indicates that a Biden-era CFPB will return to the aggressive regulatory posture adopted during the Obama administration.
English's protracted battle for control of the CFPB began when Cordray, inspired by two left-wing blog posts, appointed her as acting director just before the end of his term. When Trump appointed Mulvaney, English launched a legal challenge, funded by a mysterious third party, with the goal of denying Trump control of the agency.
English spent the following seven months claiming to be the legitimate leader of the CFPB, bolstered by congressional Democrats who ignored multiple rulings against her claim. After numerous court losses, English finally departed the agency following Trump's nomination of current director Kathy Kraninger to fill the role full time.

Billionaire Jeffrey Epstein, who was arrested in New York on Saturday and later charged with sex trafficking involving dozens of girls, donated thousands of dollars to Democrat candidates and left-leaning committees from 1990 until 2018, according to OpenSecrets.org.
Prominent recipients of Epstein donations include the Democratic Senatorial Campaign Committee, Sen. Chuck Schumer (D-NY), former United States Secretary of State John Kerry (D), former United States Secretary of Agriculture and Rep. Dan Glickman (D-KS), former U.S. Sen. Joe Lieberman (D-CT), and Congresswoman Stacey Plaskett.
According to the online data, Schumer received seven $1,000 donations from Epstein between 1992 and 1997. Victory in New York, a fundraising committee established by Schumer and the Democratic Senatorial Campaign Committee, received a $10,000 donation from Epstein in October of 1998.
In 1998, Epstein also made a $5,000 donation to Win New York, a Schumer-associated committee that helped rake in money for the Liberal Party of New York state.
According to the data, Schumer and Schumer-associated entities received $22,000 from Epstein throughout the 1990s.
A Schumer spokesperson told the Washington Examiner Wednesday that Schumer would be "donating an equal sum" of the Epstein donation "to anti-sex trafficking and anti-violence against women groups."
After she first refused to return the money, Stacey Plaskett, the delegate to the U.S. House of Representatives from the Virgin Islands who received $8,100 from Epstein since 2016, said Thursday that she would not keep the money. Instead, Plaskett has "decided to make contributions to Virgin Islands organizations that work with women and children in the amount of his previous contributions."
Kerry, who served as Secretary of State under Democrat President Barack Obama, received a total of four $1,000 donations from Epstein between 1991 and 2002 during his time as a U.S. senator from Massachussets, according to records from OpenSecrets.org.

Leslie Wexner is the wealthiest Republican in Ohio, a one-time mega-donor with a net worth of nearly $6 billion - but now he has renounced the party he supported since college.
This week, the business magnate whose company owns Victoria's Secret and Bath & Body Works announced that he can no longer support the party, the Columbus Dispatch reported. Speaking at an event for business leaders in Ohio, Wexner said he does not identify as a Republican anymore.
"I'm an independent," he said, adding that he was a GOP supporter since joining the Young Republicans in college. "I won't support this nonsense in the Republican Party."
Wexner has donated large sums to Republican candidates, most recently supporting Jeb Bush's 2016 presidential run, but has become sharply critical of Donald Trump in recent months. Last year, Wexner told employees in a speech that he felt "dirty" by Trump's response to the Unite the Right rally in Charlottesville where white supremacists marched in support of a Confederate statue, with one of them killing a counter-protester. Now, he has decided to leave the party entirely.
Leslie Wexner's announcement came the same day that Barack Obama visited Columbus to stump for Ohio Democratic gubernatorial candidate Richard Cordray, the Huffington Post reported. Wexner said he was inspired by Obama's message.
"I was struck by the genuineness of the man; his candor, humility and empathy for others," Wexner said of Obama.
"I just decided I'm no longer a Republican," he added.
Wexner has now joined a number of other prominent Republicans leaving the party over Donald Trump. Steve Schmidt, who in 2008 served as campaign manager for Republican presidential candidate John McCain, also recently announced that he could no longer support the GOP.
Schmidt said he could not support a party that supported Trump's child immigrant separation policy.
"29 years and nine months ago I registered to vote and became a member of The Republican Party which was founded in 1854 to oppose slavery and stand for the dignity of human life. Obama's Operation Choke Point finally unmasked
James Madison once wrote that "the rights of persons, and the rights of property, are the objects, for the protection of which government was instituted." While in recent years our political leaders have not always lived up to Madison's vision of government, rarely have they engaged in such blatant disregard for our constitutional rights as they did during Operation Choke Point - a secret program launched under the Obama administration to punish political adversaries. Operation Choke Point was a plot by President Obama's Department of Justice, the Federal Deposit Insurance Commission, the Consumer Financial Protection Bureau, and other government agencies to cut off banking and financial services for small businesses and industries that they deemed to be political enemies or otherwise undesirable. Some of these businesses included gun stores, ammunition shops, fireworks stores, small dollar lenders, and home-based charities.
Some government officials tried to deny the existence of the program. That includes former CFPB director, Richard Cordray, who dodged questions from Sen. Mike Crapo in 2014 as to the CFPB's participation in Operation Choke Point. Yet in that same year, Cordray warned banks against doing business with "... unscrupulous lenders and their payment processors." Cordray was not alone in trying to hide the truth about this operation. Officials from the DOJ and FDIC all worked to keep the program's existence from the public and to bury the truth. Finally, however, the truth is now being unmasked. Government documents were just unsealed providing evidence of just how far reaching and destructive Operation Choke Point really was to small businesses.
In this specific case, the documents show how the FDIC engaged in a targeted campaign against lawful and legally operating businesses, cutting them off from banking services without due process or other legal recourse. While most thought the program began around 2013 - at least that was when evidence of the program first began to surface - a senior official with the FDIC was pushing regulators to cut off banking for lawful small dollar lenders at least three years before that. The official told regulators: "... if a bank was found to be involved in payday lending, someone was going to be fired." Brought to light by the unsealed documents, additional instruction was given to regulators that "if an institution in their region was facilitating payday lending, the regional director should require the institution to submit a plan for exiting the business."
Any business deemed to be a political enemy would be considered "high-risk," and as the legal filing that unsealed these new incriminating documents notes, it was made clear "that banks servicing high risk customers through payment processors would incur additional regulatory compliance burdens." In another incident, available now through the deposition of a bank chairman, said the chairman was threatened with criminal referral to the Department of Justice if a business relationship with a small dollar lender was not ended. Equally disturbing is that once a bank cut off services to a business, regulators pressured the bank to claim the action as their own, effectively covering up the government's involvement.
With this new evidence, it has become even more clear how invested the Obama administration was in Operation Choke Point. If an industry stood against their political agenda, it was only a matter of bringing the full force of the administrative and regulatory state against that industry as a means of coercion and punishment. Operation Choke Point was "Chicago-style politics" brought to Washington, D.C.

Mortgage Database
Meanwhile, the Federal Housing Finance Agency, headed by former Congressional Black Caucus leader Mel Watt, is building its own database for racially balancing home loans. The so-called National Mortgage Database Project will compile 16 years of lending data, broken down by race, and hold everything from individual credit scores and employment records.
Mortgage contracts won't be the only financial records vacuumed up by the database. According to federal documents, the repository will include "all credit lines," from credit cards to student loans to car loans - anything reported to credit bureaus. This is even more information than the IRS collects.
The FHFA will also pry into your personal assets and debts and whether you have any bankruptcies. The agency even wants to know the square footage and lot size of your home, as well as your interest rate.
FHFA will share the info with Obama's brainchild, the Consumer Financial Protection Bureau, which acts more like a civil-rights agency, aggressively investigating lenders for racial bias.
The FHFA has offered no clear explanation as to why the government wants to sweep up so much sensitive information on Americans, other than stating it's for "research" and "policymaking."
However, CFPB Director Richard Cordray was more forthcoming, explaining in a recent talk to the radical California-based Greenlining Institute: "We will be better able to identify possible discriminatory lending patterns."
Credit database
CFPB is separately amassing a database to monitor ordinary citizens' credit-card transactions. It hopes to vacuum up some 900 million credit-card accounts - all sorted by race - representing roughly 85% of the US credit-card market. Why? To sniff out "disparities" in interest rates, charge-offs and collections.
Employment database
CFPB also just finalized a rule requiring all regulated banks to report data on minority hiring to an Office of Minority and Women Inclusion. It will collect reams of employment data, broken down by race, to police diversity on Wall Street as part of yet another fishing expedition.
School database
Through its mandatory Civil Rights Data Collection project, the Education Department is gathering information on student suspensions and expulsions, by race, from every public school district in the country. Districts that show disparities in discipline will be targeted for reform.
Those that don't comply will be punished. Several already have been forced to revise their discipline policies, which has led to violent disruptions in classrooms.
Obama's educrats want to know how many blacks versus whites are enrolled in gifted-and-talented and advanced placement classes.
Schools that show blacks and Latinos under-enrolled in such curricula, to an undefined "statistically significant degree," could open themselves up to investigation and lawsuits by the department's Civil Rights Office.
Count on a flood of private lawsuits to piggyback federal discrimination claims, as civil-rights lawyers use the new federal discipline data in their legal strategies against the supposedly racist US school system.
Even if no one has complained about discrimination, even if there is no other evidence of racism, the numbers themselves will "prove" that things are unfair.
Such databases have never before existed. Obama is presiding over the largest consolidation of personal data in US history. He is creating a diversity police state where government race cops and civil-rights lawyers will micromanage demographic outcomes in virtually every aspect of society.
The first black president, quite brilliantly, has built a quasi-reparations infrastructure perpetually fed by racial data that will outlast his administration.

What a difference a year made for Joseph Alcoff.
On Monday, the 37-year-old has a court date in connection with charges he's facing in Philadelphia that include aggravated assault and ethnic intimidation for allegedly being part of an Antifa mob in November that attacked two Marines, Alejandro Godinez and Luis Torres, both Hispanic. Alcoff and two others charged in the attack have pleaded not guilty.
ANTIFA FIGURE CHARGED IN MARINE ATTACK
But while Democratic officials are distancing themselves from Alcoff now, until recently he was a well-connected, aspiring political player in Washington who may have even had a hand in key policy proposals.
His endorsement apparently mattered when several congressional Democrats in February 2018 issued press releases with his quote backing their bill on regulating payday lenders.
As the payday campaign manager for the liberal group Americans for Financial Reform, Alcoff participated in congressional Democratic press conferences, was a guest on a House Democratic podcast and met with senior officials at the Consumer Financial Protection Bureau from 2016 through 2018.
He was also pictured with now-House Financial Services Committee Chairwoman Maxine Waters, D-Calif., and ranking Democrat on the Senate Banking, Housing and Urban Affairs Committee Sen. Sherrod Brown of Ohio. Both committees oversee financial regulatory policies Alcoff was advocating.
Alcoff met with then CFPB Director Richard Cordray and other senior CFPB officials on April 2016, again in March 2017 and a third time in May 2017, as first reported by the Washington Free Beacon.
During this time, he reportedly was an Antifa leader in Washington.

Alcoff's former employer had little to say about the matter.
"As of December, Mr. Alcoff no longer works for AFR," Carter Dougherty, spokesman for Americans for Financial Reform, told Fox News in an email.
Dougherty didn't answer whether Alcoff had been fired or resigned. He also didn't answer whether the organization was aware of Alcoff's associations during his employment.
Alcoff was reportedly also an organizer for Smash Racism DC, the group responsible for gathering and shouting threats outside the home of Fox News host Tucker Carlson in November and for heckling Sen. Ted Cruz, R-Texas, and his wife Heidi at a Washington restaurant in September. Reports have not said Alcoff was directly involved in either incident; only that he was associated with the group.
MARINES TESTIFY ON ANTIFA MOB ATTACK
Democrats are hardly eager to be associated with Alcoff now. Most spokespersons for Democratic members of Congress did not respond to inquiries from Fox News, or distanced themselves from Alcoff.

CFPB Worked With Exposed Antifa Leader on Payday Loan Rule
New leadership expected to announce changes to rule in coming days
The previous leadership of the Consumer Financial Protection Bureau worked closely on its payday lending rule with a top official at a liberal advocacy group who was secretly working double-time as a violent Antifa leader. Records show that former CFPB director Richard Cordray had multiple meetings with Jose Alcoff, the top liaison to the CFPB on the issue of payday lending for liberal advocacy group Americans for Financial Reform.
The meetings between Cordray and Alcoff occurred in 2016 and 2017, before the Daily Caller exposed last December that he had been using alternate identities to promote radical economic theories and participate in movements such as Occupy Wall Street and Antifa. The investigation ultimately led to Alcoff's arrest for his involvement in a racially charged January assault by Antifa on two Marines in Philadelphia. Alcoff hid these activities from his work with Americans for Financial Reform, which had the ear of Cordray during his work to regulate the payday loan industry. Alcoff was working as payday campaign manager for the group and had at least three recorded meetings with Cordray during the crafting of the CFPB's payday lending rule. Cordray met with Alcoff and other liberal activists first in August 2016, according to CFPB records. They met again twice in 2017, in March and then in May. The CFPB finalized the payday lending rule in October 2017.''
Reached for comment on the extent of Alcoff's involvement in its work with the CFPB, Americans for Financial Reform said only that Alcoff no longer works for the group. "As of December, Mr. Alcoff no longer works for AFR," said a spokesman. The group will not say whether Alcoff was fired.
Alcoff continued to work on the issue for Americans for Financial Reform through most of 2018 and often criticized the CFPB's actions under the new leadership of Mick Mulvaney, who took the reins a month after the payday lending rule was finalized. After Mulvaney announced the CFPB would be reworking the payday lending rule, Alcoff slammed the decision on behalf of Americans for Financial Reform. "The consumer bureau used to be a great agency dedicated to enforcing the law and protecting consumers, is now to putting predatory lenders ahead of the law and its mission with this attempt to gut consumer protections," Alcoff said in an Oct. 26, 2018, press release. "Mulvaney's CFPB now wants to wipe out a simple, common-sense requirement that lenders ought to examine a borrower's creditworthiness before making a loan that too often becomes a debt trap for the most vulnerable consumers." The CFPB declined to comment on Alcoff's involvement in the drafting of the original law. The revamped payday lending rule is expected to be released this week.

Republican Mike DeWine was sworn in as governor of Ohio early Monday, taking his oath of office on a stack of nine Bibles held by his wife, Fran DeWine.
DeWine's oath was administered by his son, Ohio Supreme Court Justice Pat DeWine, at the DeWine home in Cedarville, Ohio, just after midnight on Monday. Each Bible was meant to represent one of Mike and Fran's eight children, a spokesman told the Cincinnati Enquirer.
Included in the collection were Bibles belonging to DeWine's great-grandmother, grandmother, aunt, and mother. There was also a World War I-era New Testament belonging to DeWine's grandfather, Albert Liddle, issued to him by the United States Navy.
DeWine, who took a public oath of office at an inaugural event Monday, was elected in November 2018, succeeding John Kasich, who served two four-year terms. DeWine defeated Democratic opponent Richard Cordray with 50.4 percent of the vote, despite not winning the counties containing Columbus, Cincinnati and Cleveland.

Federal judges order Ohio to allow purged voters back in
CINCINNATI (AP) - Federal judges on Wednesday ordered Ohio to allow voters who had been purged for not voting over a six-year period to participate in this year's election.
A divided 6th U.S. Circuit Court of Appeals panel granted an emergency motion sought by voting-rights groups. The ruling overturned in part an Oct. 10 ruling by a federal judge that said voters haven't been illegally purged from Ohio's rolls.
Plaintiffs led by the A. Philip Randolph Institute in June lost their broader challenge to Ohio's election administration process as unconstitutional when the U.S. Supreme Court ruling in favor of Ohio's practices.
But they continued to challenge the confirmation notices the state sent to voters that set off the process of removing them from county voter rolls after not voting in three federal elections or taking other voting-related actions. They said the letters were too vague on letting recipients know the consequences of not responding.
"Plaintiffs have a reasonable, and perhaps even greater, likelihood of success on the merits of their claim that defendant's confirmation notice did not adequately advise registrants of the consequences of failure to respond, as the NVRA (National Voting Rights Act) requires," the court ruled Wednesday.
Judges Julia Smith Gibbons and Eric Clay formed the majority. Judge Eugene Siler Jr. disagreed, saying the plaintiff claims were "all speculation."
Republican Secretary of State Jon Husted said he wouldn't fight the order, to avoid "an unnecessary source of contention with election only five days away." Ohio's procedures will eventually be upheld again, he said, and the state is committed to making it "easy to vote and hard to cheat."
Husted is running for lieutenant governor on a ticket with Attorney General Mike DeWine, who is in a tight race for Democratic gubernatorial nominee Richard Cordray.
The voting-rights groups said that some elections in Ohio, traditionally a swing state, have been settled by small margins, and that turning away potentially thousands of voters could alter outcomes.
"The court's decision will allow more Ohio voters to have their voices heard next Tuesday," attorney Stuart Naifeh of the Demos organization said via email. "Every vote counts, including those cast by voters who may not have been engaged in the political process in recent years. … In today's ruling, the court recognized that the right to vote is too important to allow states to take it away without giving voters meaningful notice."
Partisan fights over ballot access have been playing out around the country. Democrats have accused Republicans of trying to suppress votes from minorities and poorer people who tend to vote for Democrats. Republicans have argued that they are trying to promote ballot integrity and prevent voter fraud.
The 6th Circuit panel found there wasn't an emergency need to block "purges," and that it could consider that part of the appeal later.
Husted said after the Supreme Court ruling in June that no more voters would be removed before the Nov. 6 election.

On January 4, 2012, President Barack Obama appointed Cordray as Director of the Consumer Financial Protection Bureau - a watchdog agency charged with, "scrutinizing unfair practices by debt collectors, mortgage brokers, credit reporting agencies, and predatory payday lenders."[7] He resigned as bureau director on November 24, 2017.[3]
Attorney General of Ohio (2009-2011)
Cordray announced in June 2008 that he would run to serve the remaining unexpired term of Nancy Rogers. On election night, he defeated Republican challenger Mike Crites, receiving fifty-seven percent of the vote.
Ohio Treasurer (2007-2009)
Cordray defeated Republican Sandra O'Brien for State Treasurer in what became a state-wide sweep for the state Democrats in 2006. In the midst of the campaign, Cordray merged "field staffs in the 2006 election and produced a joint mailer" with Ohio Secretary of State Jennifer Brunner, who herself has been linked with the controversial community-based advocacy group, ACORN.[8]
Treasurer of Franklin County, Ohio (2002-2007)
In 2002, Cordray became the first Democrat in a quarter-century to be elected Franklin County Treasurer, replacing Republican Wade Steen, who just a year earlier had been appointed to the position following the health-related resignation of Bobbie M. Hall. Cordray won by a razor-thin margin of 3,232 votes. Throughout the campaign Cordray repeatedly hit on Steen for failing to "collect more than $44 million in delinquent property taxes."[9] He easily won re-election two years later, receiving sixty-four percent of the vote against Republican Jim Timko.
Candidate for U.S. Senate (1998)
Two years later, he chose to run for the United States Senate in the hopes of replacing one-term incumbent Republican Mike DeWine. Cordray placed third in a four-way contest for the Democratic nomination, Ted Celeste (brother of former-governor, Dick Celeste) and Rev. Marvin McMickle, but ahead of last minute entry, Dan Radakovich.
Ohio Democratic Party Central Committee (1996-1997)
Cordray was elected to the Ohio Democratic Party Central Committee for the state's 15th Congressional District in 1996. That same year he was on the short list for United States Attorney General along with Kent Markus and Sharon Zealey, who ultimately received the appointment. He ran for state Attorney General in 1998; he received the Democratic nomination, running unopposed, but was roundly defeated by incumbent Republican Betty Montgomery, who received sixty-two percent of the vote.
Ohio Solicitor General (1993-1996)
In September 1993, Cordray became the first individual appointed as Ohio's Solicitor General, a state governmental office created in an effort to relieve the level of state appellate work. Selected by the state's Attorney General, the Solicitor's main responsibility was to argue cases before both the State Supreme Court and the United States Supreme Court. His most notable was his second, Hanlon v. Berger (1999), which questioned the constitutionality of media ride-alongs with law enforcement officials.[10]
Ohio House of Representatives (1991-1992)
In 1990, Cordray was elected to the Ohio State House of Representatives for the 33rd Congressional District, unseating six-term incumbent Republican Don Gilmore. Also during this time he simultaneously taught courses at both Ohio State University Moritz College of Law and Georgetown University. After the state Apportionment Board redrew state legislative districts in 1991 landed Cordray in one with a twenty-two year incumbent, he chose not to run for re-election.
Instead, he campaigned for the United States House of Representatives seat in Ohio's 15th Congressional District held at the time by outgoing Republican Chalmers Wylie. He easily defeated Bill Buckel for the Democratic nomination, but lost the general election contest to Republican Deborah D. Pryce.

In a scathing resignation letter, one of the country's top student loan officials accuses the Trump administration of betraying American families to serve 'the wishes of the most powerful financial companies in America.'
The Trump administration official tasked with overseeing $1.5 trillion in student loans sent a powerful resignation letter accusing the White House of "open hostility toward protecting the nation's millions of student loan borrowers," the Associated Press reports.
Seth Frotman is resigning as the student loan ombudsman at the Consumer Finance Protection Bureau (CFPB), and his resignation letter addressed to CFPB director Mick Mulvaney didn't mince words.
"The damage you have done to the bureau betrays these families and sacrifices the financial futures of millions of Americans in communities across the country," Frotman wrote to Mulvaney. He added that Mulvaney has "used the bureau to serve the wishes of the most powerful financial companies in America" instead of helping American families.
Frotman, who has worked at CFPB for seven years, said that after just 10 months of Mulvaney's leadership, "it has become clear that consumers no longer have a strong, independent Consumer Bureau on their side."
Frotman laid out a number of specific grievances in his letter, which NPR reproduced in full.
Frotman said that CFPB political appointees "silenced warnings by those of us tasked with standing up for servicemembers and students," and suppressed reports meant to warn borrowers about potential dangers.
Political leadership also undermined the ability of career staff to properly oversee the student loan market, he said.
Frotman accuses current leadership of abandoning its duty to fairly and robustly enforce the law.
In his time at CFPB, Frotman helped return $750 million to student loan borrowers harmed by predatory practices. But under Trump's leadership, according to Frotman, the bureau is now more focused on protecting big banks and lending institutions than on helping families struggling with mounting debt.
Like most agencies under Trump, CFPB has seen quite a bit of controversy. When the former head of the agency, Richard Cordray, resigned to run for governor of Ohio, Trump appointed Mulvaney to the post, even though Mulvaney was also serving as the head of the White House budget office. A legal battle ensued, with many claiming the appointment was illegal.
More recently, the bureau has been trying to scrap efforts to protect members of the military from predatory payday lenders. One veterans group described this effort as "giving a huge smile and thumbs up to slimy payday lenders ripping off our troops."
During his presidential campaign, Trump made grand promises about addressing student loans.
But as usual, Trump decided to side with big business and against struggling families once he got into office.

Mulvaney says he changed the name of the CFPB to 'send a message'
Mick Mulvaney changed the name of an agency he currently heads to "send a message" about following the law, he said Tuesday.
Mulvaney, the acting director of the Consumer Financial Protection Bureau, has changed the agency's name to the Bureau of Consumer Financial Protection to bring it into alignment with the text of the 2010 law that created it.
"We changed the name because it's the name in the statute," Mulvaney told reporters Tuesday at the agency. "And if… your whole theme is going to be, 'we're going to follow the statute,' I thought it was a good, small way – but a very visible way – to send a message."
On Monday, the signage at the agency's headquarters across from the White House changed to read "BCFP," replacing the older "CFPB" signs.
Mulvaney said the changes cost nothing, and are a "good thing," to the extent that they get people asking about the underlying law.
Critics have said that the change hurts the brand value previously built up by the agency operating under the title "CFPB."
Mulvaney has also introduced a new seal for the agency. The design, he said Tuesday, actually took shape under his predecessor, Richard Cordray. Only the name of the agency and a few other details were changed before it rolled out to the public.

President Barack Obama has big plans for Massachusetts Sen. Elizabeth Warren. They both have a 2020 presidential run in their sights - and they are actively plotting to get Warren into the Oval Office as the 46th President of the United States.
That's according to Politico, which reported Monday that secret meetings between Obama and Warren - as well as eight other top Democratic candidates - have been taking place quietly for months inside Obama's third floor personal office in the World Wildlife Fund in Washington, D.C.
Obama wants his ducks in a row to take back the United States, so he's calling in top party leaders to figure out who he'll coach.
"All the meetings were arranged quietly, without even some close advisers to the people involved being told of the conversations, in part because of how much Obama bristles at his private meetings becoming public knowledge," Politico reported.
The meetings are all the same, political experts say: Obama is obsessed with Democrats beating President Donald Trump and restoring his legacy, and the former president is concerned that Democrats are too off-balanced to pull it off.
So he's coaching Democratic frontrunners on what to say and how to strike back alley deals with powerful political figures. He's already met twice with Warren in the past year.
The first was in the spring of 2017 after Warren said she was 'troubled' by the $400,000 Obama was getting to speak at a Wall Street investment firm, describing it as an example of the influence of money that she called 'a snake that slithers through Washington.' Obama responded by inviting her in," Politico reported.
Warren left the meeting promising to leave the issue alone; she's since been invited back. "The second meeting, warmer from start to finish, came just this past April and ran well into 90 minutes. They talked about Richard Cordray, the former head of the Consumer Financial Protection Bureau who is now the Democratic nominee for governor in Ohio. They reminisced. They talked about Trump."
Over the past year, Obama has also had a secret meeting with Vermont Sen. Bernie Sanders, a socialist outsider that voters complained was sabotaged by former Secretary of State Hillary Clinton in the 2016 primary. He's also met with former Vice President Joe Biden, former Massachusetts Gov. Deval Patrick, and five other top Democrats about the 2020 plot.

CFPB Political Battles Will Reignite in June When Mulvaney's Term Is Up
If a nominee is rejected, Mulvaney will serve an additional 210 days.
Because Mick Mulvaney was only appointed to the "acting director" position within the Consumer Financial Protection Bureau last fall, he is term-limited by law in that role to 210 days, a deadline which will come June 22.
Mulvaney, who also heads the Office of Management and Budget, could wind up staying in the position for much longer because of lesser known provisions of the same law, setting off new political battles with Senate democrats over the bureau, and offering up high-risk high-reward gambles for President Trump on the November elections.
With the "acting director" position expiring, President Trump needs to nominate someone for the actual director's position, a nomination that would need Senate confirmation.
"As soon as a nominee is put up from the Trump administration, it triggers other parts of the Federal Vacancies Reform Act, and will basically allow Mulvaney to serve until the Senate actually confirms somebody. And if they reject that nominee, then he gets an additional 210 days of service," said Dan Press, a consumer finance policy analyst at the free-market think tank the Competitive Enterprise Institute.
"So really, I think it sets up a massive conundrum for Democrats," Press added.
"They've got somebody in as acting director who they really dislike, and the Trump administration is probably going to put up someone else that they really dislike, so they're going to have to choose between lesser evils from their perspective, really."
Press said the upshot of these provisions of the Federal Vacancies Reform Act means Mulvaney will likely still be acting director towards the end of this year, and theoretically could be there for much longer.
The most talked about name in the rumor mill for a likely nomination to lead the bureau is Mark McWatters, currently the chairman of the National Credit Union Administration.
Mulvaney's appointment to the acting director position at the CFPB set off one of the more memorable political battles of 2017. When then-Director Richard Cordray resigned to run for governor of Ohio, he tried to handpick his own successor, appointing Deputy Director Leandra English on his way out the door.
Had Cordray been successful in that maneuver, it would have kept Obama-era loyalists in the bureau's leadership for sometime.
President Trump instead appointed Mulvaney to the acting director's position, setting off court battles. Two decisions have upheld the Mulvaney appointment, but English is appealing one of those rulings with her own set of lawyers.

After a Federal judge ruled that Mulvaney is now acting director of the CFPB - his first order of business was to institute a 30-day freeze on all new hiring and regulations.

Both President Trump and Mick Mulvaney have had strong opinions about the CFPB in the past, with Mulvaney saying "It is a completely unaccountable agency, and I think that's wrong," and adding "If the law allowed this place not to exist, I'd sit down with the president to try to make the case that other agencies can do this job well if not more effectively." Mulvaney also called the agency "a sad, sick joke."

What is really amusing is that she (English), was elevated to interim director of the bureau last week by its outgoing director Richard Cordray, an Obama appointee.
She doesn't realize her old boss is leaving his post 8 months early because of the 'deal' he may have made to 'stay on the street'.
This almost gets funnier by the minute.
