Trump's lawyer confirms his concern about Supreme Court ballot ruling
by Miranda Nazzaro - 01/03/24 5:13 PM ET
Former President Trump's attorney Alina Habba on Wednesday said the former president is concerned the U.S. Supreme Court justices may "shy away from being pro-Trump," and rule against him in regard to the recent decisions in Colorado and Maine that kicked him off the states' 2024 primary ballots.
Responding to New York Times reporter Maggie Haberman's recent comments about Trump's concerns, Habba during an interview on Fox News said, "That's a concern he's voiced to me, he's voiced to everybody publicly, not privately. And I can tell you that his concern is a valid one."
"You know, Republicans are conservative, they get nervous. They unfortunately ... sometimes shy away from being pro-Trump because they feel that even if the law is on our side, they are swayed much like the Democratic side, right?" Habba told Fox News anchor Martha MacCallum. "So they're trying so hard to look neutral that sometimes, they make the wrong call."
Colorado and Maine both removed Trump from their 2024 state primary ballots last month, ruling he is ineligible to run for president under the 14th Amendment's insurrection clause.
Trump on Wednesday appealed Colorado's ruling to the U.S. Supreme Court, one day after he appealed Maine's decision - which came from Maine's Secretary of State Shenna Bellows - in the state's superior court, though the dispute could ultimately also reach the U.S. Supreme Court, which currently has a 6-3 conservative majority.
Three of the justices on the nation's highest bench were appointed by Trump, a point of concern Haberman addressed last week.
"They believe, generally speaking, he and his advisers, that they will have success at the Supreme Court, but he has also voiced some concern that a court that has - he appointed three of the justices at the Supreme Court and gave the conservatives a supermajority - he is concerned that they are going to look as if they're trying not to rule in his favor and might rule against him," Haberman said during a CNN appearance last week.
"It's a very clean cut," she said. "There's no ... politics that should be involved in this. It's just simply American, and if the justices read the law, as I do, as most Americans and attorneys do, even [Alan Dershowitz] - who's a known liberal - it's just a simple decision, and it should have nothing to do with if you're Republican or Democrat."
Habba was making an apparent reference to attorney Alan Dershowitz's comments against rulings from Colorado and Maine. Dershowitz last month called Colorado's decision "an attempt to totally manipulate an amendment that was never designed to disqualify people in future election," Forbes reported.
A number of legal experts have thrown out varying predictions for how the nation's highest court could rule if it decides to hear the case. Former Attorney General Bill Barr called Colorado's case "legally wrong and untenable," while former federal Judge Michael Luttig said the Centennial State's ruling is not "anti-democratic," but rather the conduct that prompted the disqualification was anti-democratic.
Former White House lawyer Ty Cobb predicted the U.S. Supreme Court could rule "9-0" in favor of Trump if he appeals the Colorado Supreme Court decision, saying last month he believes the "law is clear."

More than 30 law enforcement officers at various levels participated in the operation, putting in countless hours of investigative work to make these arrests, the release states.
The four-day operation resulted in 27 individuals being arrested on a broad range of charges including failure to register as a sex offender; failure to register an email address; failure to register an Internet identifier, such as a social media account or Internet provider; possession of child pornography; traveling to meet a minor for sex; lewd and lascivious battery and aggravated sexual battery, the release states.
"I and the Panama City Police Department are proud to team up with dozens of local, state and federal law enforcement officers, focused and dedicated to protecting the most innocent," Panama City Police Chief Mark Smith said. >>13191366 Lin Wood, About time to call it a day. (PB)
This flash in the pan is doing dog coms now? How ironic.
Interesting high level cases. Especially for a guy specializing personal injury cases and medical malpractice.
Wood lived with friends and graduated from Mark Smith High School in Macon, Georgia in 1970. He attended Mercer University, graduating cum laude in 1974, and Mercer University School of Law, graduating cum laude in 1977.[24] He was admitted to the Georgia Bar.[25] From 1977 to 1996, Wood litigated personal injury cases and medical malpractice cases in the State of Georgia
Richard Jewell
Wood's first libel and defamation client was Richard Jewell,[3][4][5][6] the security guard falsely accused in the Centennial Olympic Park bombing in Atlanta in 1996. Wood sued a number of media outlets, as well as Jewell's employer. Wood reached monetary settlements from Jewell's employer, CNN, and NBC, while Time published a clarification, but paid no settlement.[26] In 2012, after fifteen years of litigation, the Georgia Supreme Court upheld trial court decisions ruling against Jewell in his libel suit against the Atlanta Journal-Constitution.[27]
JonBenet Ramsey
Jewell was quickly followed by other high-profile cases, including John and Patsy Ramsey, the parents of JonBenét Ramsey, whose 1996 murder is still unsolved.[28] Wood represented John and Patsy Ramsey and their son Burke, pursuing defamation claims on their behalf against St. Martin's Press, Time Inc., The Fox News Channel, American Media, Inc., Star, The Globe, Court TV and The New York Post.[citation needed] The lawsuit against Star was settled.[29]
John and Patsy Ramsey were also sued in two separate defamation lawsuits arising from the publication of their book, The Death of Innocence. The suit was brought by two individuals named in the book as having been investigated by Boulder police as suspects in JonBenét's murder. The Ramseys were defended in those lawsuits by Lin Wood and three other Atlanta attorneys, James C. Rawls, Eric P. Schroeder, and S. Derek Bauer. The lawsuits against the Ramseys were dismissed.[30]
In 2016, Wood represented Burke Ramsey, older brother of murder victim JonBenet Ramsey, in a pair of related lawsuits stemming from the CBS network docuseries The Case of: JonBenét Ramsey. The first suit was filed against Dr. Werner Spitz, a Michigan-based forensic pathologist, over his assertion in a promotional CBS Detroit radio interview that Burke killed his sister when a young child.[31] The other suit was against CBS and other parties involved in the docuseries, where the same allegations were made. Both lawsuits were settled out of court.[32]

What an inspiration this man is. Horry Sheet!
Lin Wood was raised in Macon, Georgia, since age 3. He stated that his family struggled financially with frequent episodes of domestic abuse involving his parents.[6][7] He has one sister, Diane Wood Stern, born February 1951 and a half sister, Linda Martin, born in 1946. After a school dance, the then 16-year-old Wood returned home to find his father had beaten his mother to death.[6][7][8] L. Lin Wood Sr. pleaded guilty to involuntary manslaughter, a charge reduced from first-degree murder.[9] He served a little over two years in prison. Wood has stated that it was this experience that solidified his earlier decision to become a lawyer.[6][7][8]
Wood lived with friends and graduated from Mark Smith High School in Macon, Georgia in 1970.
Wood graduated from Mercer University cum laude in 1974, and graduated from Walter F. George School of Law cum laude in 1977. From 1977 to 1996 Wood litigated personal injury cases and medical malpractice cases in the State of Georgia.[6][7]

Smith & Wesson Stepping Up Production as Sales Soar 140 Percent
Gun maker pledges 'max capacity' production that could lead to more jobs, shifts for workers
One of the nation's largest gun makers is ramping up production after a record-breaking first quarter in 2020.
Smith & Wesson, one of only two publicly traded gun manufacturers in America, reported a 140 percent year-over-year jump in gun sales between the beginning of May and the end of July. The company moved 584,000 guns in that period, an unprecedented demand that caused inventories to fall. That's why the company has doubled down on its efforts to manufacture more guns in order to meet continuing demand.
"As we've seen before during these surge periods, these results reflect that despite our record numbers in Market share growth, consumer demand for our products during the quarter still exceeded our internal manufacturing capacity levels, " Mark Smith, Smith & Wesson president and CEO, told investors in a call on Thursday. "We're continuing to ramp up.... We're going to go to maximum capacity,"
The move comes as Americans have rushed to gun stores at a record pace since March. The first eight months of 2020 have already seen more gun sales than all of 2019. Smith echoed reMarks made in July by the CEO of Sturm, Ruger & Co., the other publicly traded American gun company, when he said demand was beyond anything he had previously encountered.
"When we get into these surge environments like this, and as you can see from the [gun background check numbers] we've never seen one quite this high, the demand in the industry just outstrips the industry's ability to supply," Smith said. "And we're no different. You can look at the inventory numbers from us and from some of the other firearms, retailers, and manufacturers, and I think we're just out of inventory."
Mark Oliva, a spokesman for the National Shooting Sports Foundation, called the announcement a "significant move" that shows gun makers expect demand to increase. The industry expert said increased production could lead to more manufacturing jobs being created, as well as increased pay for workers as shifts increase.
"It's a demand issue," he said. "It's not a supply issue. Materials are there, the labor force is there, but before [a] manufacturer is going to invest on hiring more people, adding another shift, buying more machinery, they want to be sure. I mean, that's a very costly thing to do. And nobody wants to lay people off when things go down and eventually this will settle out. The question is where will it settle out and when?"

GOP Insider Mark Smith: Trump's 'Silent Majority' Is Growing Thanks to Black Lives Matter
The Black Lives Matter movement is helping grow a "silent majority" of Americans supporting President Donald Trump, determined Mark Smith, president of the Da Vinci Group, offering his reMarks on Monday's edition of SiriusXM's Breitbart News Daily with host Alex Marlow.
"At the grassroots level, where [Trump] has had great success and continues to have great success making sure that he is speaking to and for those Americans who are in that silent majority," Smith said, "and I will argue very strongly that that silent majority, on a day-to-day basis, thanks to the folks at Black Lives Matter and the professional race business in this country, are making more and more recruits."
Smith said a message of national unity can overcome narratives of fragmentation pushed by Democrats and the broader left.
"For Americans to feel comfortable reelecting a president they've gotten to know over the last three and a half years, the emphasis [should be] that we are all Americans, that we are men, women and families," advised Smith. "We're a country blessed to have an enormously diverse culture."
Smith added, "This President can bring us all together as Americans, not broken up into little distinct classes and little distinct groups. That's not what America is, and most people believe that. So if he continues to discuss those types of things but also pivots back to the economy - which is obviously going to be a concern, we're going to have a specific degree of unemployment - and illustrating that he's capable of moving that in the right direction, I think he'll have a very good day in November."
Smith questioned the reliability of political polling which relies on answers from whoever it is "who picks up the phone."
"Here's the problem with today's polling," Smith began, "first of all, there is no science in it, it's an art. ... Number two, most importantly, is the heavy oversampling of Democrats that are in these polls and [the] fact that they are not talking to likely voters and they are, in many cases, not even talking to registered voters, they're just talking to a person who picks up the phone. [That out] of a sample of a thousand people, somehow, we're going to extrapolate that Joe Biden is 14 points ahead of President Trump is ridiculous."
"Liberal media" often use polls to push "their narrative of what should be," added Smith. "We saw them do that with the Mrs. Clinton four years ago, we obviously know, thank God, what the outcome of that election was. I personally believe they're trying to do it again. It's not going to work.
Smith added his view Americans simply aren't going to "fall for this nonsense. All these folks in the fake news media, they all party together on Zoom, these days, and they're trying to get Biden elected, and it's not going to work."
Smith reMarked, "Joe Biden is a hand puppet for the the Democrats and the progressive left. He's like the Jack Abramoff of presidential candidates. He talks a lot, takes for himself, and does nothing for anybody else."
Smith concluded, "Biden, unfortunately, illustrates on a daily basis that aging and dementia are dangerous realities."

Foreign ownership of thousands of U.S. aircraft cloaked in secrecy
Why does a small East Texas town called Onalaska have more than 1,000 registered aircraft - and no airport?
Author: Tanya Eiserer, Mark Smith

Updated: 10:30 PM CST February 14, 2019
ONALASKA, Texas - Onalaska, Texas, has a secret.
Nestled along the piney shores of an East Texas lake, Onalaska lacks an airport.
A WFAA review, however, has found more than 1,000 registered aircraft claiming an Onalaska address. That's equivalent to one plane for every three Onalaska residents, which is more per capita than anywhere else in the country.
In fact, more planes are registered to Onalaska than the number of registered planes in entire cities such as Seattle, San Antonio, San Diego, or even New York.
Just as surprising, the aircraft are registered to only two Onalaska P.O. boxes. That's because the aircraft owners do not live there. Not even close.
WFAA has learned Onalaska is ground zero for a practice that allows foreigners to anonymously register their planes, and one that critics say makes the United States an easy target for drug dealers, terrorists and other criminals seeking to register their planes.

Sanders campaign wages recount fight in Iowa
February 19, 2020 11:42 AM
Print this article
The fight over who won the Iowa caucuses isn't over just yet after Bernie Sanders's campaign asked for a recount.
Sanders, 78, and former South Bend, Indiana, Mayor Pete Buttigieg, 38, both claimed victory in the first Democratic primary contest this month after Buttigieg received the most delegates, while the Vermont senator notched up the most raw votes statewide.
But with the delegate count forming the only path toward the 2020 presidential nomination, Sanders's camp wants another partial review of the results after the outcome of a recanvass released late Tuesday left Buttigieg with 563.207 "state delegate equivalents," the number by which national delegates are allocated, to his 563.127. As it stands, Buttigieg has 14 delegates to Sanders's 12.
"While it is clear that Sen. Sanders won the popular vote in Iowa by 6,000 votes, the recanvass process reduced the State Delegate Equivalent deficit by 97 percent," Sanders campaign spokesman Jeff Weaver said in a statement.
Weaver added, "We now believe a recount will give Sen. Sanders enough State Delegate Equivalents to put him over the top by that metric as well. We want to thank the people of Iowa, our supporters, our volunteers and everyone who made this possible."
The Iowa Democratic Party, under the new leadership of Mark Smith, late Tuesday, published the results of the limited-scope recanvass requested by the Buttigieg and Sanders teams. But the party announced the changes to official outcomes at 29 precincts, either because of incorrect caucus math or misapplication of caucus rules, didn't result in a national delegate reallocation.
Representatives for Buttigieg have until Wednesday night to join Sanders in asking for another review.
Smith was elected chairman of the Iowa Democratic Party over the weekend after Troy Price quit following the chaos of the caucuses.
On the day of the Feb. 3 contest, complaints emerged regarding a mobile application the Iowa Democratic Party rolled out to expedite the reporting process. When results weren't quickly returned that night, media speculation that a snafu had occurred was confirmed. The party then slowly released figures as they became available over the course of the next week, with those records still containing inconsistencies between initial and final caucus alignments the first time the mostly volunteer organization disclosed the full data set. The fiasco became a national embarrassment, even drawing criticism from Democratic National Committee Chairman Tom Perez.
While the Democratic field is focused on this Saturday's caucuses in Nevada and beyond, top-tier candidates are bracing for a protracted fight to become the party's standard-bearer, including Michael Bloomberg, who officially enters the race on March 3, or Super Tuesday..

Chairman of the Iowa Democratic Party Troy Price resigned following the Iowa Caucus, which was mired with reporting issues that resulted in a delay to the final results. State Representative Mark Smith is expected to replace him as interim chairman.
"While it is my desire to stay in this role and see this process through to completion, I do believe it is time for the Iowa Democratic Party to begin looking forward, and my presence in my current role makes that more difficult," Price stated.

Philadelphia Energy Solutions files for bankruptcy after refinery fire
Philadelphia Energy Solutions filed for Chapter 11 bankruptcy protection, the company said on Monday, its second such filing in less than two years, after a fire last month prompted it to close the largest refinery on the U.S. East Coast.
Following the June 21 explosions and blaze, PES started shutting down the 335,000 barrel-per-day Philadelphia plant without a planned restart. Some 1,000 workers are being laid off.
The company's lenders agreed to provide up to $100 million in new financing to PES to usher it through the bankruptcy, it said.
The agreement allows PES to "safely wind down our refining operations and, with the support of our insurers and stakeholders, best position the company for a successful reorganization, the rebuilding of our damaged infrastructure, and a restart of our refining operations," Mark Smith, chief executive officer of PES Energy, said in a statement.
"The success of our plan is critical to energy supply and security for the region, the Commonwealth of Pennsylvania and the City of Philadelphia," Smith said.
PES could receive payouts of $1.25 billion in insurance claims connected to the fire and business closure, according to two sources briefed on the company's policies.
The potential payouts include $1 billion for property damage and $250 million for loss of business, the sources said.
The insurance payouts were expected to be used as collateral for the new bankruptcy financing, the sources said.
PES has multiple owners, including investment bank Credit Suisse and investment firm Bardin Hill, and has both assets and liabilities between $1 billion and $10 billion, court filings show.

Philadelphia refinery that suffered huge explosion will shut down
The largest refinery on the East Coast is slated to close and be sold after a large explosion and fire almost a week ago devastated the Philadelphia complex. Philadelphia Energy Solutions CEO Mark Smith said Wednesday that the company "made the difficult decision" to begin shutting down the facility, which is located directly within the city and near residential neighborhoods.
"While our teams include some of the most talented people in the industry, the recent fire at the refinery complex has made it impossible for us to continue operations," Smith added. The CEO said he is committed to winding down operations, preparing it to be sold. "As part of the winddown, the company will position the refinery complex for a sale and restart," he said.
The fire is under investigation by a number of federal agencies, including the Environmental Protection Agency. The EPA said it will await the results of the investigation before making any decision on enforcement actions against the refinery. "We will consider our federal enforcement options, if warranted, when the current Chemical Safety Board (CSB) and Occupation Safety and Health Administration (OSHA) investigations near completion," an EPA spokeswoman told the Washington Examiner. Pennsylvania Republican Sen. Pat Toomey said his "sympathies are with the hardworking employees who are losing their jobs." Toomey said he hopes a "viable option" could be found to stave off the closure, and his office intends to stay in touch with workers and management at the refinery.

Former CEO resigns from Billington board
Insider Media reported that former chief executive of Barnsley based structural steel and construction safety specialist Billington Holdings has resigned from the board. Mr Stephen George Thomas Fareham has been associated with the group for more than 50 years. He served as chief executive from October 2006 to January 2015 and was managing director of structural steel construction subsidiary Billington Structures from 1991 to 2014. Mr Fareham has resigned from his position as non-executive director with immediate effect.
Mr Peter Hems, outgoing non- executive chairman of Billington, said that "It has become evident that, following the recently announced board changes, and in order to comply with corporate governance best practice, it will be necessary for Billington to introduce some additional financial expertise to the non-executive director team. Therefore, Steve has decided that it was the right time to stand down, thereby enabling the company to commence the search for a replacement with the relevant financial expertise. With the recent addition of Mr Ian Lawson to the board, Billington already has a good strength and depth of industry experience at the necessary level."
Mr Mark Smith, chief executive of Billington, added that "The retirement of Steve brings the end of an era for the Billington Group. The company and I personally owe him a great deal of thanks for his hard work, dedication and diligence over his tenure in office. We wish Steve a very long and happy retirement."

Website devoted to adverse reactions suffered by medical employees
Mark Smith -2 days ago
Hi all I have been following this group for awhile now and wanted to share my story. I work in mental health and my state (Maine) mandated vaccinations to continue working in health fields. Two weeks after my second dose of pfizer I developed the following symptoms. Internal tremors/vibrations in my chest and back, sometimes eyes, intermittent muscle twitches/spasms that can last for 5 minutes and can occur anywhere and essential tremor. All this is accompanied with some kind of what I call dizziness but there is no spinning, it's hard to describing but I simply don't feel good, laying in bed is preferable to almost anything. These symptoms have persisted for 8 months now. A brain MRI showed nothing out of the norm and blood tests we've done are normal. Off to see a neurologist next. I do worry this is something that's killing me. Anyone with similar symptoms that have had improvements please share, it is somewhat comforting that it's not just me. My mother also had an issue with the moderna shot, her lymph nodes have been swollen( the largest 4cm) for 12 months now, not cancerous yet painful. One node is being removed soon and her surgeon said he's seen alot of this post vaccine, just wanted to share that incase anyone has experienced something similar. Thank you all I pray we all heal quickly.

SCOTUS DECISION JUST NOW: THE ATF IS IN BIG TROUBLE...
https://www.youtube.com/watch?v=wxKHyNj44Qo
Today, the U.S. Supreme Court in Sackett v EPA issued a major ruling cutting back on the authority of the EPA and by extension all federal executive branch agencies such as the ATF to enact laws via regulations. The Sackett opinion contains powerful language that can likely be used against the ATF in various contexts including in the ongoing legal fights over the bump stock ban and the pistol brace rules. Mark Smith breaks it down.
