Aquarium noted manatee's 'change in behavior'
Mote Marine announced Hugh's death in a press release on April 30, when the aquarium described the incident differently.
"After Hugh showed a change in his behavior earlier in the day, animal care staff began closely monitoring him. Saturday late afternoon, Hugh suddenly became unresponsive in his habitat at Mote Aquarium's Marine Mammal Center," the aquarium announced in the news release. "Hugh's Animal Care team responded immediately, and ultimately determined that Hugh had passed away."
On Monday, Mote Marine spokesman Kevin Cooper said staff members who worked with Hugh continue to mourn his death, adding that the aquarium is committed to the USDA's gold standards for animal care. Mote is appealing the USDA findings.
"Our Mote Marine Laboratory family continues to mourn the passing of our beloved manatee Hugh," Cooper said. "Throughout the events leading up to his passing, Mote acted within the professional standards and practices that we have observed throughout Hugh's 27 years with us, and as recommended by the Association of Zoos and Aquariums and the Manatee Rescue and Rehabilitation Partnership."
"Mote's animal care staff communicated with the medical care team as quickly and as often as possible, including communications with experienced certified veterinary technicians, a senior contract manatee veterinarian, and a staff veterinarian," he said.

Hugh, Buffett gained fame picking Super Bowl winners
Hugh was born at the Miami Seaquarium and was moved to Mote Marine in 1996 along with Buffett, who shared a tank with him. Hugh and Buffett were trained to participate in manatee research projects to help Mote Marine staff study their eyesight, hearing, physiology, and body temperature.
The two manatees also gained fame from picking NFL Super Bowl championship teams. Hugh correctly picked the Kansas City Chiefs to win the Super Bowl last season.
"We trust the Mote Marine Laboratory and the Association of Zoos and Aquariums will be examining the laboratory's protocols to ensure this tragedy isn't repeated," Nicole Meyer, a spokesperson for People for the Ethical Treatment of Animals, said in a statement Monday.
Hugh is not the first beloved manatee to die in captivity in the Sarasota-Bradenton region. Snooty, who at the age of 69 was the world's oldest known manatee, made national headlines when he died in a preventable incident at The Bishop Museum of Science and Nature in Bradenton in 2017.
At the time of Snooty's death, aquarium staff knew that a panel leading to the "cave" where Snooty drowned was missing screws, but because of failures in record keeping, reporting, communications and follow-through, no action was taken and no repairs were made.

Outgoing California Gov. Jerry Brown wants to give the residents of his state some very dangerous Christmas presents: Violent criminals.
Just in time for the holidays, Brown granted 143 pardons and an additional 131 sentence commutations that included Kevin Cooper, an inmate sitting on death row after being convicted if killing four members of a Chino Hills family in their home with a hatchet, a knife, and an ice pick in 1983.
In response to a clemency request from Cooper, Brown ordered new DNA tests on four pieces of evidence that includes the handle of the hatchet used to commit the murders and the sheath holding it, PJ Media reports.
Brown justified his order by claiming in a written statement that he is taking "no position as to Mr. Cooper's guilt or innocence at this time." But, he continued, "colorable factual questions have been raised about whether advances in DNA technology warrant limited retesting of certain physical evidence in the case."
Continuing, Brown noted, "The purpose of this new testing is to determine whether another suspected person's DNA, or the DNA of any other identifiable suspect based on a match in the FBI's Combined DNA Index System (CODIS) database, is present on the items tested. Given the nature of the testing requested, and the fact that the murders, in this case, occurred before the advent of DNA technology and related evidence handling protocols, both parties acknowledge the distinct possibility that further testing may yield multiple DNA contributors of unknown origin.
"As such, if the only result of further testing is to yield either no additional DNA matches, or only DNA from unknown contributors, this matter should be closed," he wrote.
As if it isn't bad enough that Cooper has spent nearly 35 years on death row already, escaping the justice that a court and a jury prescribed, now it's entirely possible he'll get out of prison altogether if Brown deems it.

San Bernardino County District Attorney Mike Ramos argued that DNA testing on items including a bloody T-shirt and discarded cigarettes had already put Cooper at the scene and in their family's stolen station wagon. The defense asserts that Cooper's blood was planted on the T-shirt in order to frame a black man for the crime.
The California Supreme Court blocked Brown's attempt to commute the sentence of Kenny Lee, convicted of robbing and murdering a cab driver in 1992. It's the seventh time the court has stepped in to use its power to stop the outgoing governor from issuing sentence commutations for killers in recent weeks.
Brown also granted pardons to five Cambodian refugees brought to the country when they were 5 years old or younger, and now face deportation because of their criminal pasts. He likewise pardoned a Honduran immigrant facing deportation.

California senator in damage control mode after New York Times labels her 'flawed political leader'
Senator Kamala Harris (D., Calif.) said on Friday that her "career as a prosecutor was marked by fierce opposition to the death penalty," but it was just four years ago that she was defending the California death penalty in federal court.
The new stance came days after Harris was spotlighted as a "flawed political leader" by the New York Times for her reluctance to allow for a new DNA test to be used in the case of Kevin Cooper, a man on death row who many believe was framed for murder. Harris declined to comment on the Sunday story but called author Nicholas Kristof on Friday to say she felt "awful" after reading his story. She put out a statement touting her record of opposing the death penalty, which has since been added to the story.
"My career as a prosecutor was marked by fierce opposition to the death penalty while still upholding the law and a commitment to fixing a broken criminal justice system," Harris wrote on Facebook, urging California to allow for DNA testing to be used in Cooper's case.
Harris's Senate office didn't respond to a request for information to support the claim that her career was "marked by fierce opposition to the death penalty," a claim that wasn't challenged by the New York Times despite major action taken by Harris as California's attorney general to defend the state's death penalty.
In 2014, Harris went to the Ninth Circuit Court of Appeals to urge a reversal of a U.S. District Court ruling that California's death penalty was unconstitutional.
In her brief to the federal court, which can be read in full here, Harris defended California's death penalty, which was criticized by the lower court as dysfunctional because of the small percentage of people on death row who actually end up being executed. The judge ruled that the death penalty was "arbitrarily inflicted."
"California provides capital defendants with substantial opportunities to challenge their convictions-and resources for doing so-for the precise purpose of ensuring that the death penalty will not be 'arbitrarily' imposed," Harris wrote in her appeal of the ruling. "Providing that sort of careful, individualized review through direct appeal and state habeas proceedings takes time."
Harris also wrote off policy concerns over the death penalty, pointing out that voters in the state rejected a proposal to abolish the death penalty.
"There has long been healthy public debate over whether to impose the death penalty at all-and, if it is to be imposed, over how best to balance important interests in accuracy, finality, and timeliness in a way that is fiscally manageable and fair to capital defendants, to the public, and to the victims of terrible crimes and their families," Harris wrote. "In 2012, California voters considered and rejected Proposition 34, which would have ended capital punishment in the State."
She argued that "the court mistook its policy critique" of the death penalty "as a proper basis for legal judgment."
The 9th Circuit ruled unanimously on the side of Harris and upheld California's death penalty in 2015.
Harris, who has long maintained that she is personally opposed to the death penalty, had been urged by others opposed to let the ruling stand so it could be used as a tool to challenge death sentences in other states.
In a piece for the San Francisco Chronicle, "Why does Kamala Harris defend the death penalty?," Harris was criticized by a legal scholar opposed to the death penalty for claiming she is personally opposed to the death penalty as she staunchly defended it in court.
"Harris and Brown could simply concede that California's death penalty system is unconstitutional and stop defending it in the federal courts," wrote Stanford Law School's Mugambi Jouet just before the Ninth Circuit's 2015 ruling.
"Ironically, Harris insists that she is personally against the death penalty, as former U.S. Attorney General Eric Holder claimed while continuing to seek it in federal cases," he wrote. "It is not too late for Harris to stand on the right side of history."
Harris did notably refuse to pursue the death penalty as San Francisco district attorney in 2004 against a 21-year-old gang member who killed a cop with a semi-automatic rifle.
Vox concluded last year that her "stance on the constitutionality of the death penalty is a bit of a mystery."
