The Scottish Prison Service (SPS) has concluded a transgender inmate with a history of sexual violence as a male did not pose a threat to other prisoners when previously held in a women's facility. Scottish govt does U-turn on trans prisoners
The Scottish government announced on Sunday that it would provisionally stop having some transgender prisoners sent to female jails. Officials clarified that the measure would apply to those inmates who are known to have acted violently toward women in the past.
The change in stance came shortly after convicted rapist Isla Bryson was transferred to the country's sole all-female prison last week, a move that elicited a public outcry. First Minister Nicola Sturgeon eventually intervened and ordered the transgender prisoner removed from the female facility.
Announcing the decision, Scottish Justice Minister Keith Brown made a point of emphasizing that the assumption that "trans women pose an inherent threat to women" is fallacious.

Trans woman found guilty of rape moved to men's prison
Isla Bryson, a transgender woman found guilty of raping two women before transitioning, has been moved from Scotland's all-female Cornton Vale prison to a male facility after an intervention by Nicola Sturgeon.
The first minister told MSPs earlier on Thursday that Bryson would not be incarcerated in the women's prison "either short term or long term", after a report saying the offender had been transferred there on Tuesday prior to sentencing prompted outrage across the political and campaigning spectrum.
Sturgeon emphasised it was important not to suggest "even inadvertently" that trans women posed an inherent threat to women.
Pressed repeatedly on the matter at first minister's questions on Thursday by the Scottish Conservative leader, Douglas Ross, Sturgeon said she agreed it was not possible to have a rapist incarcerated in a female prison.
Emphasising this was an operational matter for the Scottish Prison Service, she added: "The Scottish Prison Service is in the process of giving effect to the decision it has taken not to incarcerate this prisoner in Cornton Vale."
Ross described the decision as a "screeching U-turn" after the justice secretary, Keith Brown, told MSPs on Wednesday that he trusted the Prison Service to decide.
It later emerged that Sturgeon had made a rare intervention during a meeting involving Brown, which took place shortly before she announced at Holyrood that Bryson was being moved from Cornton Vale.
Sturgeon's official spokesperson said the first minister had not ordered the Prison Service to move Bryson to a male prison but added: "I expect and I think the Prison Service might expect ministers' views to be taken into account."
He denied suggestions Sturgeon had taken part directly in that meeting and acknowledged ministers very rarely were involved in decisions about individual prisoners, but said the first minister believed no rapist should be held in a women's prison.
On Tuesday there was widespread anger that Bryson - who first appeared in court in 2019 as Adam Graham and was known to both victims by that name - was being remanded in a female prison.

TAYLOR, Texas – Three Taylor High School students were arrested Wednesday after they allegedly discussed plans in class about committing a school shooting, according to police.
Police arrested Devant Davis-Brooks, 17, Kadin Watson, 17, and Emmanuel Pina Tejas, 17, on charges of terroristic threat after several students overheard a conversation that the three seniors were discussing detailed plans to coordinate an active shooting at the school involving explosives and firearms. Officials said the conversation took place during class and one student reported it.
"(The student) heard them talking about planning a school shooting and a bombing," said Taylor ISD Superintendent Keith Brown. "There are no joking matters when it comes to school safety now, nothing about shooting up a school or blowing up a school is funny."

The SNP-led Scottish Government recently consulted on the plans to make criminals on shorter sentences eligible for early release.
As part of the plans, those on sentences of four years or fewer could be eligible for early release after only a third of their sentence.
Meanwhile, those on longer sentences could get Parole Board hearings to consider their release after serving the same period.
But the Senators of the College of Justice warned the "proposals raise profound questions concerning the impact on public confidence in the criminal justice system."
The judges panel who oversee Scotland's highest criminal and civil courts, warned that Scots would be left confused to the length of time served behind bars and the sentence passed in the courts.
They added in a submission to a public consultation: "These proposals raise profound questions concerning the impact on public confidence in the criminal justice system and, if implemented, will require the public to be provided with the clearest explanation as to what will seem to many to be a remarkable difference between the sentence imposed and the time spent in custody.
"We are concerned such a fundamental change should be suggested in the absence of research into, or analysis of, processes of rehabilitation which currently operate, their effectiveness, or that which it is contemplated might be available in any future structure."
Other stakeholders ranging from victim support charities to police bosses also raised concerns.
David Hamilton, chairman of the Scottish Police Federation, said: "The early release of prisoners would be a mistake.
"Without adequate additional funding we will be transferring the management, risk and rehabilitation of offenders from the prison service to an under resourced police service."
Victim Support Scotland stressed that freeing criminals earlier would be "alarming" for victims of crime.
They added: "We have heard of too many instances where our justice system does more harm than good to people affected by crime."
Scottish Tory justice spokesman Jamie Greene said: "The latest SNP soft-touch justice scheme would mean prisoners being let back into the community after serving a fraction of their sentence."
The Scottish Government is currently examining responses to the public consultation on the subject which closed last month.
It comes amid anger over cases where killers had been freed part way through their jail term, including Jason Graham.
Jason Graham had changed his surname to Evans before murdering pensioner Esther Brown.
He was a registered sex offender with 23 previous convictions and caged for 19 years for the murder of Glasgow pensioner Ms Brown.

John Swinney has announced he has tested positive for coronavirus and will now be self-isolating.
The Deputy First Minister and Minister for Covid Recovery revealed earlier today that he had managed to avoid catching the virus for two years.
In a tweet announcing his diagnosis Swinney said he will attempt to work if he is feeling better.
The SNP minister tweeted: "After two years of avoiding #Covid_19 I tested positive this morning.
"I will be self-isolating in accordance with the rules and will try to engage with @scotparl business if I feel better than I do just now."
The Cabinet Secretary for Justice Keith Brown has also announced he has tested for the virus.
Like Swinney he took a test this morning and returned a positive result.
He tweeted Swinney saying: "Be safe John, and hopefully you'll be better soon. Like you I've avoided it for two years until I had a positive test this morning. Thank goodness for Zoom!"
It comes as Nicola Sturgeon is set to announce later today if the rules around the wearing of masks in some public places will be dropped.
The First Minister met with her cabinet to discuss the measures that were kept in place following the last review.
The number of patients in hospitals with recently confirmed covid has reached a new record high, with 2,383 people requiring care, up 23 on the previous day, according to latest Scottish Government figures.
There was a drop in the number of patients requiring intensive care which fell to 20, down one on the day before.
Scotland has recorded 39 coronavirus-linked deaths and 9,311 new cases in the past 24 hours, figures published on Tuesday showed.
It means the total number of people who have died within 28 days of testing positive for the virus has risen to 11,359.
So far 4,353,178 people have received their first dose of a Covid-19 vaccination, 4,092,407 have received their second dose, and have 3,450,121 received a third dose or booster.

Scottish Conservative Shadow Justice Secretary Jamie Greene: "This is a real insult to the victims who suffered at the hands of this monster. It is yet another example of the SNP's soft-touch justice system prioritising criminals instead of victims.
"It is little wonder that one of his victims has slammed this lenient sentence after everything they have been through.
"Cases like this are exactly why the Scottish Conservatives have announced plans to give people the power to call on the Lord Advocate to review sentences which are too soft. That can help restore confidence in our justice system and ensure victims will always be the priority."

U.S. State Department spokesperson Jen Psaki said European countries have joined the United States in rejecting the poll.

The U.S. Air Force has fired two more commanders in charge of its nuclear arsenal. Col. Carl Jones was second in command of the 90th Missile Wing at FE Warren Air Force Base in Wyoming, which operates a third of the force's Minuteman 3 intercontinental ballistic missiles. According to the Associated Press, Jones was fired for four separate transgressions, including one described as "shocking." In the most recent case, he was accused of banging on the counter and shouting profanity at a volunteer-run thrift shop. Meanwhile at the 91st Missile Wing at Minot Air Force Base in North Dakota, which oversees another third of the Force's Minuteman missiles, Lt. Col. Jimmy "Keith" Brown was fired for discrimination after he "made statements to subordinates that created a perception within his squadron that pregnancy would negatively affect a woman's career." Another commander at Minot has been disciplined. The news follows a cheating scandal at a base in Montana earlier this year and last year's firing of the commander in charge of the entire intercontinental ballistic missile force for drunken misbehavior in Russia.

Former CIA analyst Ray McGovern is recovering from what he described as a brutal arrest by New York City police after he tried to attend a speech by former CIA director and retired Army General David Petraeus. McGovern says he had a ticket to the event late last week, but was told by security at the 92nd Street Y in Manhattan that he was "not welcome." He told RT he was already suffering from an injured shoulder and police caused him to scream in pain as they tried to force his wrist behind his back. McGovern was held overnight in a jail cell and did not get to ask Petraeus the question he had planned.
