10:45 AM PT – Mayor Rahm Emanuel is very strongly hinting at corruption in the State's Attorney's Office, calling the decision to drop the charges against Smollett a "whitewash of justice."
The Mayor added, "From top to bottom, this is not on the level." He called for accountability from the prosecutors.
Emanuel was joined by Chicago PD Superintendent Eddie Johnson who said he didn't feel justice was served by letting Smollett off the hook.
What's more, Johnson said if Jussie was, in fact, innocent … he should've taken his day in court, and not broker a backdoor deal in secrecy. Bigger picture – Johnson feels the City of Chicago is still owed an apology, as he believes Jussie carried out a hoax.
10:15 AM PT – FOX says, "Jussie Smollett has always maintained his innocence and we are gratified that all charges against him have been dismissed."
As for WHY they were dropped you'll recall State's Attorney Kim Foxx recused herself from the case. She reportedly had asked cops to stand down at the behest of Tina Tchen Michelle Obama's former Chief of Staff and a friend of Jussie's family. The conflict forced Foxx to bow out.

Jussie Smollett was found guilty of lying to police about being the victim of a hate crime, turns out the key to his conviction was a tuna sandwich from Subway.
The 'Empire' star's fate was decided by a jury, following a lengthy Chicago police investigation that started with an original interview of the actor on the night of the so-called hate crime. At the time, Jussie claimed he was out buying a Subway sandwich when he was attacked by two men who put a noose around his neck and poured bleach on him.
According to the former Chicago Police Superintendent, Eddie Johnson, Jussie claimed to have purchased a tuna sandwich at 2 a.m. - which he could understand - but, added, "He comes back and gets attacked in a hate crime, supposed hate crime, and during all this scuffle - they poured bleach on him and all of this - when he got up and went into his apartment building he still had that Subway sandwich with him. That doesn't happen."
Jussie Smollett Kept His Tuna Sandwich Following Alleged Attack
As we reported, the initial interview with the actor was caught on police officer body camera and included a description of the alleged hate crime and the aftermath of the so-called beating. Johnson pointed out that in most cases victims abandon anything they are holding during an attack "because they are afraid."
"This guy had the sandwich in his hand, never been touched. So that was a real tip and a clue to us that something was amiss."
The ex-superintendent sat down with New Nation Now's 'Morning In America' explaining the entire incident was suspicious considering Smollett was so "nonchalant" about removing a noose from his neck - that so-called attackers had placed in there following the attack. Video of the interview gave him pause while investigating the allegations.

In the end, Smollett claimed he was attacked by two men because he was Black and gay. Turns out, the two suspects claimed Jussie actually paid them to stage the attack and lie about the details. A jury found the actor guilty of five felonies including, "telling a police officer he was a hate crime victim, telling an officer he was a battery victim, telling a detective he was a hate crime victim, telling a detective he was a battery victim and then telling a detective again he was battery victim."
Shockingly, during the trial, prosecutors claimed Smollett even staged a rehearsal for the attack, with the two brothers he hired for the hoax.
No Jail Time Expected For 'Empire' Star Following Conviction
At this point, a sentencing hearing will be held to determine what the punishment for the guilty convictions will be...but many believe he will not do any jail time. Part of the reason, Jussie doesn't have a criminal record, and these were non-violent crimes.

One of the defense attorneys, Tina Glandian, suggested during a March 2019 appearance on NBC's "Today" show, that one of the brothers could have used white makeup around his eyes to make Smollett believe he was white. To address skepticism on the jury, Glandian could ask the brothers about a video she talked about on the program that she said shows one of them in whiteface reciting a monologue by the Joker character from a movie.
Given there is so much evidence, including the brothers' own statements, that they participated in the attack, it is not likely that Smollett's attorneys will try to prove they did not take part. That could perhaps lead the defense to contend that Smollett was the victim of a very real attack at the hands of the brothers, perhaps with the help of others, who now are only implicating the actor so prosecutors won't charge them, too.
They $3,500 check could be key. While the brothers say that was their fee to carry out the fake attack, Smollett has offered a different and much more innocent explanation: that he wrote the check to pay one of them to work as his personal trainer.
"I would assume the defense is going to zero in on that," said Joe Lopez, a prominent defense attorney not involved with the case. "If they texted messages regarding training sessions, checks he (Smollett) wrote them for training, photographs, the defense would use all of that."
What they will almost certainly do is attack the brothers' credibility - an effort that will certainly include a reminder to the jury that the brothers are not facing the same criminal charges as Smollett, despite admitting to taking part in the staged attack.
"Everything Smollett is responsible for, they are responsible for," said David Erickson, a former state appellate judge who teaches at Chicago Kent College of Law and who is not involved in the case. "They participated and they walk away? What the hell is that?"
Erickson said he expects prosecutors to confront that issue before Smollett's attorneys do, as they won't want to appear to be trying to hide something.
Finally, Smollett's career could take center stage. On one side, prosecutors could make the same point that then-Police Superintendent Eddie Johnson made when he announced Smollett's arrest in 2019: that Smollett thought the attack would gain him more fame and get him a raise on a hit TV show.
But Lopez said the defense attorneys might ask the jury the same question he has asked himself.
"How would that help him with anything?" he asked. "He's already a star."

Former Air Force Employee Pleads Guilty to Stealing More Than $1.1 Million in Government Funds
Coordinated Congressional Travel in the Office of the Secretary of the Air Force, Office of Legislative Liaison
Greenbelt, Maryland - Eddie Ray Johnson, Jr., age 60, of Brandywine, Maryland, pleaded guilty on May 14, 2021, to the federal charge of theft of government property, in connection with a scheme to use his government-issued travel credit card to obtain more than $1.1 million in cash advances.
The guilty plea was announced by Acting United States Attorney for the District of Maryland Jonathan F. Lenzner; Brigadier General Terry Bullard of the Air Force Office of Special Investigations (OSI); Special Agent in Charge Christopher Dillard of the Defense Criminal Investigative Service (DCIS), Mid-Atlantic Field Office; and Acting Special Agent in Charge Darrell J. Waldon of the Internal Revenue Service - Criminal Investigation (IRS-CI), Washington, D.C. Field Office.
"Eddie Johnson betrayed his position of trust for his personal gain," said Acting U.S. Attorney Jonathan F. Lenzner. "Corrupt public employees rip off the taxpayers and undermine everyone's faith in the government."
According to his plea agreement, from January 2003 to February 2018, Johnson was a civilian Air Force employee, most recently as a travel coordinator in the Secretary of the Air Force, Office of Legislative Liaison, where he planned congressional travel and reviewed and approved accounting packages submitted by trip escorts, among other duties. Johnson admitted that from March 2014 through September 2017, he used his government-issued travel credit card to obtain more than $1.1 million in cash advances, at least $774,000 of which he diverted to his own personal use.
As detailed in the plea agreement, Johnson frequently deposited the stolen funds into a non-interest bearing account opened in his name at a bank branch in the Pentagon. Employees in the Office of Legislative Liaison were instructed to open such accounts so that they could more easily deposit and withdraw government funds for official use without accruing interest. After depositing the stolen funds, Johnson wrote checks to himself, which he deposited into his personal bank accounts, and spent the money for his personal benefit, including on living expenses, a baby grand piano, loan payments for a Harley Davidson motorcycle, and family vacations. Johnson also admitted that he provided cash to his family members, including his spouse.
During execution of a search warrant at Johnson's residence in Brandywine, Maryland on November 6, 2019, law enforcement recovered approximately $15,1740 in cash from Johnson's residence. Johnson agrees that at least $4,000 of the funds seized were the proceeds of his offense.
In all, Johnson's conduct caused a loss to the U.S. government of $1,157,540.69, which includes $26,506.02 in banking and service fees that the Air Force paid monthly in connection with the cash advances Johnson obtained. As part of his plea agreement, Johnson has agreed to the entry of a restitution order in the full amount of the victim's losses.
Johnson faces a maximum sentence of 10 years in federal prison for theft of government property. Actual sentences for federal crimes are typically less than the maximum penalties. A federal district court judge will determine any sentence after taking into account the U.S. Sentencing Guidelines and other statutory factors. U.S. District Judge Paul W. Grimm has scheduled sentencing for September 3, 2021 at 10:00 a.m.
Acting United States Attorney Jonathan F. Lenzner commended the OSI, the DCIS, and the IRS-CI for their work in the investigation. Mr. Lenzner thanked Assistant U.S. Attorneys Dana J. Brusca and Elizabeth Wright, who are prosecuting the case.

Army launches second demonstration satellite

The Army is learning more about small satellites with the launch of its newest technology demonstrator.
Gunsmoke-J, a U.S. Army Space and Missile Defense Command and Assured Position Navigation and Timing/Space Cross Functional Team joint capability technology demonstration satellite, launched into orbit March 22. Gunsmoke-J's experiments will show how its sensors can provide critical data and information key in multi-domain operations.
The launch is the second of three launches. The first Gunsmoke-J technology demonstrator launched Feb. 20 with the next launch scheduled in the coming weeks.
"The command is very excited to have this capability," said Chip Hardy, chief of the Space Applications Division, Space Directorate, USASMDC Technical Center. "The experiments done on orbit will be the culmination of five years of hard work done by the entire Gunsmoke team, led by Mr. Eddie Johnson, in designing, building, integrating and testing these satellites. If successful, Gunsmoke could lead to a follow-on acquisition with a capability that could be a game changer for the tactical warfighter."
Gunsmoke-J is a joint capability technology demonstration executed by SMDC and APNT/CFT, and is sponsored by the Army and the Office of the Under Secretary of Defense for Research and Engineering. If successful, this science and technology effort will help inform future acquisition decisions.
Gunsmoke and potential follow-on small satellite systems are designed to provide information or sufficient data relative to tactical decision-making that is delivered in a timely manner.
Willie Nelson, APNT/CFT director, said Gunsmoke demonstrates the Army's determination to maintain and lead in advanced capabilities, which will directly benefit the Army's ability to operate with unmatched speed and precision.
"Modernizing space requires a unity of effort," Nelson said. "This launch could not have happened if it were not for the strong leadership at USASMDC and strong partnerships we forged across the Army Modernization Enterprise with our program executive offices, centers of excellence and the intelligence community throughout the development process."

(WASHINGTON, DC) Graphic footage captured on Facebook Live shows a mentally handicapped white man being tortured in Chicago by African-American assailants as they laugh and express their disgust for white people and President-elect Donald Trump.
Chicago police announced on Wednesday evening that they had arrested four people in connection with the crime, according to Fox 32.
The video, taken by a woman identified on Facebook as "Brittany Herring," shows a white man tied up with tape across his mouth. The victim is shown being repeatedly hit, sliced at with a knife, berated and his clothes ripped off.
At one point in the video, the primary assailant shouts at the bound man, ** Donald Trump, *! white people, boy! ** white people, boy! while he kicks him.
At another point in the video, the perpetrators laugh about being reported to the police in response to a Facebook commenter claiming they're going to be arrested. They also mock another commenter who said their torture was not funny by claiming it is funny.
More videos emerged later on Wednesday of the crime. In one, the suspects threaten their victim with a knife and beat him before he was tied up. The victim can be heard screaming and pleaded with his attackers to stop. It ends with one of the attackers saying he's going to shank the white male.
Chicago police said they were considering hate crime charges in the case and called the crime "sickening" in a Wednesday night press conference. They confirmed the victim is mentally handicapped and was released from the hospital after being treated for his injuries
Police say he has been extremely traumatized by the crime.
However, Chicago Superintendent Eddie Johnson said he doesn't believe the incident was politically motivated.

The Chicago Sun-Times reported last year that the incident was "an embarrassing drinking-and-driving incident," and cited sources who claimed Johnson "was actually drinking for hours with a member of his security detail, a woman, at a downtown restaurant."
That woman was Officer Cynthia Donald, who filed a lawsuit against Johnson on Thursday, accusing him "of 'shockingly violent, abusive, and harassing conduct' that included multiple instances of forced oral and vaginal sex," CBS News reported.
Donald says she served as Johnson's personal driver.
According to a separate Sun-Times report on Friday, "taxpayers paid for 7 business trip taken by" Johnson and Donald. But Johnson denies Donald's accusations, telling the outlet in a statement, ""the allegations of sexual assault and harassment made by Ms. Donald never happened."
Johnson is married to Nakia Fenner, a lieutenant in the Chicago Police Department.
Also on Friday, USA Today reported that according to new findings published by Chicago's Office of the Inspector General, before Johnson was found asleep in his SUV in a stop sign last October, "he had consumed 'several large servings of rum…the equivalent of 10 alcoholic beverages."
According to the outlet, seven Chicago police officers have been suspended for failing to hold then-Superintendent Johnson accountable on the night their top boss was found allegedly driving under the influence. The IG's office recommended that one of them be terminated.

You are right about the city and it's crime record, however, shootings jumped significantly during the Rham Emanuel years. Which begs the question why, what happened to the police, who owns them?, who controls them?, and better yet who's paying them?. No matter what way you look at it any organization is only as good as the tone set by those running it. If you have problems at the top..they leak all the way to the bottom. Jussie Smollett has been indicted by a special prosecutor in Chicago, nearly a year after the charges against him over an alleged hoax attack were dropped.
Fox 5 reports special prosecutor Dan Webb brought charges against Smollett on Tuesday. It is not clear what those charges are but he is due in court on February 24.
Authorities are yet to confirm the indictment.
It is now more than a year since Smollett claimed he was attacked at 2am in Chicago on January 29 while out getting a sandwich.
He told police his attackers called him racist and homophobic slurs and that they appeared light-skinned.
Nigerian brothers Abel and Ola Osundairo were then identified as the people he'd said attacked him. The pair knew Smollett and told the authorities he paid them to attack him in a staged incident to allegedly boost his celebrity profile and salary.
Smollett was then hit with a 16-count grand jury indictment and faced more than 50 years behind bars until State's Attorney Kim Foxx suddenly dropped all the charges last March in exchange for him doing community service.
It was a decision that blindsided and outraged former mayor Rahm Emanuel and former Chief of Police Eddie Johnson.
Smollett, who has all along insisted he is innocent, then sued the city for malicious prosecution.
There have been various rounds of civil litigation but the cases keep getting delayed because it has been so difficult to identify an impartial prosecutor.

BREAKING: Judge Orders Google To Turn Over An Entire Year Of Jussie Smollett's Data
A Cook County judge has ordered Google to turn over nearly all of Jussie Smollett's data from the last year as prosecutors move forward in investigating the alleged hate crime hoax.
The Chicago Tribune reported, "The warrants, filed last month in Circuit Court, sought a trove of documentation from Smollett and his manager's Google accounts - not just emails but also drafted and deleted messages; any files in their Google Drive cloud storage services; any Google Voice texts, calls and contacts; search and web browsing history; and location data."
In the warrants, investigators asked for an entire year of data, starting in November 2018 and ending in November 2019.
The Tribune added, "Authorities could be looking for any incriminating remarks from Smollett or his manager, especially in the months after State's Attorney Kim Foxx's office abruptly dismissed disorderly conduct charges against the then-'Empire' actor just weeks after his indictment."
Foxx's questionable actions caused public outrage which ultimately contributed to Judge Michael Toomin's decision to appoint a special prosecutor, former U.S. Attorney Dan Webb, to re-prosecute the case.
In a separate report, the Tribune added, "Webb, 73, now the co-chairman of the powerful Winston & Strawn law firm, has investigated the conduct of numerous targets over the years, from corrupt local officials to a former president."
The alleged hate crime hoax, in which Smollett is accused of staging an attack on himself, actually started before the alleged stage attack happened.
NPR reported that on January 22, "Smollett ... says he received a letter at the Chicago studios where the show is filmed. Inside the letter - according to the actor - were a then-unknown powder, a drawing of a stick figure hanging from a tree, and cutout letters stating: 'Smollett Jussie you will die black f***.'"
Exactly one week later, on January 29, Smollett told police that he was attacked late at night by two individuals who he claimed "yelled racist and homophobic slurs at him, beat him up, poured a chemical on him, and left him with a rope wrapped around his neck," NPR added.
Police initially arrested two brothers from the alleged attack, but, after 48 hours in custody, the case turned.
Chicago Police Department's Chief Communications Officer Anthony Guglielmi tweeted on February 15: "Due to new evidence as a result of today's interrogations, the individuals questioned by police in the Empire case have now been released without charging and detectives have additional investigative work to complete."
Days later Smollett was charged and was accused of staging the entire event because he "was dissatisfied with his salary."
"Jussie Smollett took advantage of the pain and anger of racism to promote his career," Chicago Police Superintendent Eddie Johnson said at the time. "I'm left hanging my head and asking why.Why would anyone, especially an African-American man, use the symbolism of a noose to make false accusations? How could someone look at the hatred and suffering associated with that symbol and see an opportunity to manipulate that symbol to further his own public profile? How can an individual who's been embraced by the city of Chicago turn around and slap everyone in this city in the face by making these false claims?"

With corruption scandals linked to ComEd making front page news, the city is quietly renegotiating the franchise agreement that grants the company a monopoly over the delivery of electricity to our homes and businesses.
ComEd - Chicago's investor-owned electric utility - and their parent company, Exelon, have been the subject of some excellent investigative reporting.
So, why aren't we talking about the city's franchise agreement with the utility?
Recent reporting has shined a light on three separate federal investigations into the company and its lobbying activities in Illinois.
We've learned about the millions of dollars ComEd spends on lobbying, Exelon utilities CEO Anne Pramaggiore's abrupt departure and $7.7 million retirement package and the company's practice of hiring politically-connected individuals to advance their interests with limited oversight.
Many Chicagoans may not be aware that ComEd's franchise agreement, set to expire in December 2020, is up for renewal for the first time in 28 years.
This is the contract that sets the terms of ComEd's relationship to the city as our sole electricity provider. Chicagoans are impacted every time we pay our electric bill. The fact that negotiations are happening with limited public scrutiny should concern us all.
Some of us are starting to question this arrangement, which generated over $2 billion in revenues for ComEd and over $200 million in profits for Exelon's shareholders in 2018.
For example, Democratize ComEd - a campaign spearheaded by the Chicago Democratic Socialists of America - is calling for Chicago to form a publicly-owned, municipal utility that prioritizes people over profit.
In July, 1st Ward Ald. Daniel La Spata introduced an order calling for a feasibility study to investigate municipalization. Twenty-two alderpersons co-sponsored the order, which has yet to come up for a vote in the Environmental Protection and Energy Committee.
In October, 12th Wrd Ald. George Cardenas stated that Chicago is in fact commissioning such a study. Since then, there has been no public briefing or further update.
The lack of transparency about the study and the franchise agreement negotiations is incredibly disappointing.
The recent news about ComEd has peeled back the curtain on how the utility has used closed door negotiations and cozy relationships with lawmakers to maximize their profit margin.
We have a once-in-a-generation opportunity to ensure the energy infrastructure we rely on operates in our best interests. It's about time we started asking questions.

It is unclear how the mayor's decision will impact his pension
Chicago police chief Eddie Johnson was dramatically fired on Monday less than a month before he was due to retire for allegedly lying about falling asleep in his car after 'a few drinks' last month.
At a press conference, the city's new mayor Lori Lightfoot spoke furiously as she accused Johnson of deliberately 'misleading' her, the city and the police department when he claimed in October.
Johnson, a 31-year veteran of the force, was found asleep behind the wheel of his car on October 17 at 12.30am after a member of the public called 911.
He later blamed his drowsiness on a mix-up with medication he was taking and said he had had a 'few' drinks at dinner. Johnson subsequently announced he would be retiring in December.
But after conducting an investigation into the incident which included reviewing surveillance footage of the night in question, Mayor Lightfoot said it was clear he lied about the incident.
She refused to say how, saying she wanted to protect his wife and three children, but said it amounted to conduct that was 'unbecoming' of his position.
It rounds off a tumultuous year for Johnson, who is being sued by actor Jussie Smollett for alleging that he faked a racist attack on himself on January 29. Johnson stood in front of reporters in February to accuse Smollett of staging the attack to get a raise on Empire.
It was an extraordinary step for a police chief, but he said he was furious at the way Smollett had allegedly manipulated his force.
Smollett insists he is innocent and that Johnson waged a campaign of unfair treatment against him.

Jussie Smollett is the actor who was accused of false reporting in a hate crime police say he staged to get publicity in Chicago. Charges were initially filed that could have sent Smollett to prison, but those charges were suddenly dropped by prosecuting attorney Kim Fox.
The move stunned Chicago police who are now looking into why she dropped those charges.

"Based on information received from the Indiana State Police regarding Commander Wodnicki, Chicago Police Superintendent Eddie Johnson has ordered an internal investigation into the entirety of a June 12, 2019 traffic stop," CPD spokesman Anthony Guglielmi said in a statement obtained by The Chicago Tribune.
Wodnicki will work with the Bureau of Technical Services in the meantime. He was on the way to work on a case in Chicago at the time of the June 12 incident, Guglielmi said. It was a death investigation.
"Where he was in Indiana and all that part, the traffic stop itself, all of that will be a focus of the Internal Affairs investigation," said Guglielmi.
It was unclear why Wodnicki was in Indiana at the time, by Chesterton, about 45 miles away from Chicago. Cops said Wodnicki was speeding at over 100 mph while on a cell phone at a 70 mph zone.
"On his cell phone," the trooper wrote. "He is not stopping. Passing. Waved at me when I pulled up next to him."
State police went as far as to put out spike strips, and Wodnicki stopped before running those over, they said.
Porter County Prosecutor Gery Germann said that Wodnicki was issued a ticket for only going 80 mph after investigators determined the commander wasn't fleeing, just trying to get to work.
"Once we got everything organized, we weren't overly concerned with it," he said.

The records show Wodnicki was detained by state police for about an hour before being released. He was ticketed for speeding. It was unclear why he was in Indiana.
Before making the traffic stop, the trooper thought Wodnicki's car might be from a local volunteer fire department, authorities said. Like Chicago police cars, that fire department's vehicles are known for their distinctive blue emergency lights, said Gary Germann, prosecuting attorney for Porter County in Indiana.
But when the trooper learned the fire department wasn't on any emergency calls at the time, the trooper decided to pull the car over, Germann said, not knowing its occupant, Wodnicki, was a police officer from Chicago.
Wodnicki still was issued a speeding ticket for traveling 80 mph in a 70-mph zone, even though dispatch records show he was actually traveling at speeds higher than 100 mph. Germann explained the ticket was amended to a less serious infraction after authorities learned Wodnicki wasn't trying to flee the police and was trying to get to work.
"Once we got everything organized, we weren't overly concerned with it," Germann said.
Germann said Wodnicki paid $252.50 in court costs for the ticket. And instead of pleading guilty, the commander qualified for Porter County's "ticket deferral program," which allows motorists caught speeding to avoid a traffic conviction if they don't commit another moving violation for a year.
The Chicago Police Department's Bureau of Internal Affairs is investigating the incident, according to police spokesman Anthony Guglielmi.
"Based on information received from the Indiana State Police regarding Commander Wodnicki, Chicago Police Superintendent Eddie Johnson has ordered an internal investigation into the entirety of a June 12, 2019 traffic stop," Guglielmi said in a statement.

ISP Trooper's attempted to pull Wodnicki over on I-94 westbound near mile marker 26 on June 12 just before 8 p.m.
However, the veteran commander allegedly refused to stop and kept driving. ISP Troopers chasing Wodnicki clocked him driving over 100 mph.
"I got a pace on of 114 mph in the left lane," an officer said. "We are going to go ahead and probably spike strip him right here. He's not stopping here."
Eventually, Wodnicki came to a stop just before running his Ford Fusion police vehicle over the stop strips.
According to ISP records, Wodnicki identified himself as a Chicago Police Officer and told the responding troopers that he was heading to his office in Chicago.
"Can you have a supervisor come to the scene? This is a Chicago cop," said the Indiana State Police Trooper over police radio.
Prior to receiving the police report from Indiana State Police, a spokesman for the Chicago Police Department told CBS2 that Wodnicki claimed he was in Indiana buying ammunition and turned his sirens on after being called to a critical incident in Chicago.
Those claims will now be under investigation and part of the internal probe initiated by CPD Supt. Eddie Johnson.
"Based on information received from the Indiana State Police regarding Commander Wodnicki, Chicago Police Supt. Eddie Johnson has ordered an internal investigation into the entirety of this traffic stop. The commander will be reassigned to CPD's Bureau of Technical Services pending the outcome of this investigation," said a Chicago police spokesman.

Democratic Gov. J.B. Pritzker signed a bill into law Friday that bans private immigration detention centers from the state, making Illinois the first state to take such a measure. The bill, HB 2040, was one of three measures to protect undocumented immigrants. The other two bills Pritzker signed prohibit local law enforcement officers from working with Immigration and Customs Enforcement offers to target migrants in the state and allow undocumented students to receive financial aid at public institutions.
Illinois is bracing itself for mass raids that ICE plans to carry out in many cities, Chicago included, beginning this weekend. The government has increasingly turned to private detention centers to house migrants who entered the country illegally, as U.S. Customs and Border Protection struggles to keep up with the influx of migrants at the southern border who need shelter. Advocates for undocumented immigrants have criticized the Trump administration for treating migrants cruelly at these border shelters. "Illinois is and always will be a welcoming state," Pritzker said in a statement Friday. "Let me be perfectly clear: the state of Illinois stands as a firewall against Donald Trump's attacks on our immigrant communities. In the face of attempts to stoke fear, exploit division, and force families into the shadows, we are taking action."
The imminent ICE operation, set to begin Sunday, aims to apprehend up to 2,000 undocumented immigrants in up to 10 cities. President Trump defended the agency's actions, tweeting, "The people that Ice will apprehend have already been ordered to be deported. This means that they have run from the law and run from the courts. These are people that are supposed to go back to their home country. They broke the law by coming into the country, & now by staying."
Chicago's Democratic Mayor Lori Lightfoot, like Gov. Pritzker, has vowed to protect Chicagoans as best she can, and has directed Chicago Police Superintendent Eddie Johnson to abolish ICE's access to the Chicago Police Department's databases that track undocumented immigrants in Chicago. 52 Shot, 10 Killed as "Summer Violence Season" in Chicago Heats Up
At least 52 people were shot and 10 were murdered in the most violent weekend in Chicago thus far in 2019. Eight of the murder victims were shot, and two were stabbed. The violence eclipsed that of the long Memorial Day weekend in which 43 were shot, seven of them fatally.
Chicago police believe that most of the people shot were targeted by gangs. Deputy Chief Al Nagode, who oversees the city's west side where much of the violence emanated from, said the shootings were "not random" and appear to be motivated by a disputed open-air drug market in the city.
At least two of the murders were likely incidents of domestic violence, according to the Chicago police.
"I can tell you, weekends like this, all our officers take this very personal," Nagode said. "We faced formidable challenges with gang factions settling conflicts with gun violence."
Chicago Police Superintendent Eddie Johnson called the weekend violence "despicable" and said it shows that "the challenges we face are complex and profound."
"I know I speak for everyone at CPD when I say we take these shootings seriously, and there's a heightened sense of urgency and care when it comes to gun violence in this city," Johnson said during a Monday press conference.
More than half the victims were murdered or wounded in a twelve-hour stretch beginning Friday night and extending into Saturday morning. According to Johnson, the violence began on the city's west side and spilled into downtown. Violence also flared on the city's south side and moved into other neighborhoods as the night went on.
Beginning Saturday, police initiated targeted patrols in areas where gang retaliations were expected. The targeted patrols yielded 19 arrests on gun charges and the confiscation of over 90 illegally obtained guns. Johnson also said that the department has some "very good leads" on some of the homicides and expects to make more arrests soon.
Thus far this year in Chicago, 206 people have been murdered. That's actually down 5 murders from the same time period last year. A total of 561 homicides occurred last year, which was down from 2016, when homicides reached a 19-year-high of 777.
The 561 murders for 2018 year outnumbered New York (289 homicides) and Los Angeles (256 homicides) combined.

Tina Tchen refuses subpoena about her role in Jussie Smollett case, process server says
The former chief of staff to Michelle Obama evaded a subpoena Wednesday from retired Illinois Appellate Judge Sheila O'Brien. O'Brien wants Tchen to hand over records related to her conversations with Cook County State's Attorney Kim Foxx regarding the 'Empire' actor.
Chicago attorney Tina Tchen - who was in contact with Cook County State's Attorney Kim Foxx before the charges were dropped against former "Empire" actor Jussie Smollett - refused to be served with a subpoena on Wednesday, according to the process server.
Tchen, who previously served as former First Lady Michelle Obama's chief of staff, refused to accept a subpoena that was issued by former Illinois Appellate Judge Sheila O'Brien.
O'Brien is petitioning for the appointment of a special prosecutor to look into the state's attorney's office's handling of the Smollett case. She is calling for Tchen to attend a May 31 hearing at the Leighton Criminal Courthouse and bring with her copies of "any and all documents, notes, phone records, texts, tape recordings made or received at any time, concerning [Tchen's] conversations with Kim Foxx in re: Jussie Smollett."
Edward Ryan, who operates a private investigation firm in the southwest suburbs, said one of his process servers went to Tchen's law firm in River North on Wednesday, but she refused to come to the lobby to accept the subpoena.
Ryan said the security guard in the building's lobby would not let the process server upstairs. The guard called Tchen in her office and "she said she knew about" the subpoena, but refused to come down.
"I don't know why she'd turn it down. She'll be served eventually," Ryan said.
Neither Tchen nor the law firm she works at responded to requests for comment Wednesday.
Tchen has previously denied any effort to sway the outcome of the Smollett case. In a statement in March, she said: "Shortly after Mr. Smollett reported he was attacked, as a family friend, I contacted Cook County State's Attorney Kim Foxx, who I also know from prior work together. My sole activity was to put the chief prosecutor in the case in touch with an alleged victim's family who had concerns about how the investigation was being characterized in public."
O'Brien is requesting a special prosecutor to look into the state's attorney's decision to abruptly drop disorderly conduct charges against Smollett, who, police said, staged a hate crime attack against himself as a way to enhance his own public profile.
The Chicago Sun-Times reported in February that Tchen passed Foxx's number to a relative of the actor before the charges were dropped. Foxx has acknowledged that she tried to persuade Police Supt. Eddie Johnson to turn the investigation over to the FBI after the family member expressed concerns regarding leaked information about the investigation - information that media outlets attributed to "police sources."
After police determined that Smollett was not a victim and allegedly staged the attack, Foxx cited her conversations with the family member and other communications as the reason she recused herself from Smollett's prosecution.

Tina Tchen refuses subpoena about her role in Jussie Smollett case, process server says
The former chief of staff to Michelle Obama evaded a subpoena Wednesday from retired Illinois Appellate Judge Sheila O'Brien. O'Brien wants Tchen to hand over records related to her conversations with Cook County State's Attorney Kim Foxx regarding the 'Empire' actor.
Chicago attorney Tina Tchen - who was in contact with Cook County State's Attorney Kim Foxx before the charges were dropped against former "Empire" actor Jussie Smollett - refused to be served with a subpoena on Wednesday, according to the process server.
Tchen, who previously served as former First Lady Michelle Obama's chief of staff, refused to accept a subpoena that was issued by former Illinois Appellate Judge Sheila O'Brien.
O'Brien is petitioning for the appointment of a special prosecutor to look into the state's attorney's office's handling of the Smollett case. She is calling for Tchen to attend a May 31 hearing at the Leighton Criminal Courthouse and bring with her copies of "any and all documents, notes, phone records, texts, tape recordings made or received at any time, concerning [Tchen's] conversations with Kim Foxx in re: Jussie Smollett."
Edward Ryan, who operates a private investigation firm in the southwest suburbs, said one of his process servers went to Tchen's law firm in River North on Wednesday, but she refused to come to the lobby to accept the subpoena.
Ryan said the security guard in the building's lobby would not let the process server upstairs. The guard called Tchen in her office and "she said she knew about" the subpoena, but refused to come down.
"I don't know why she'd turn it down. She'll be served eventually," Ryan said.
Neither Tchen nor the law firm she works at responded to requests for comment Wednesday.
Tchen has previously denied any effort to sway the outcome of the Smollett case. In a statement in March, she said: "Shortly after Mr. Smollett reported he was attacked, as a family friend, I contacted Cook County State's Attorney Kim Foxx, who I also know from prior work together. My sole activity was to put the chief prosecutor in the case in touch with an alleged victim's family who had concerns about how the investigation was being characterized in public."
O'Brien is requesting a special prosecutor to look into the state's attorney's decision to abruptly drop disorderly conduct charges against Smollett, who, police said, staged a hate crime attack against himself as a way to enhance his own public profile.
The Chicago Sun-Times reported in in February that Tchen passed Foxx's number to a relative of the actor before the charges were dropped. Foxx has acknowledged that she tried to persuade Police Supt. Eddie Johnson to turn the investigation over to the FBI after the family member expressed concerns regarding leaked information about the investigation - information that media outlets attributed to "police sources."
After police determined that Smollett was not a victim and allegedly staged the attack, Foxx cited her conversations with the family member and other communications as the reason she recused herself from Smollett's prosecution.

Cook County State's Attorney Kim Foxx has been subpoenaed to appear in court as a lawyer seeks the appointment of a special prosecutor to investigate Foxx's handling of the Jussie Smollett case.
Retired appellate judge Sheila O'Brien, who filed the petition for a special prosecutor, also filed a subpoena for Foxx's top deputy, Joseph Magats, and another document requesting Jussie Smollett appear at the hearing.
O'Brien requested Foxx, Magats and Smollett produce the original documents in the "Empire" actor's criminal case to "assure" the public "that they have not been altered or destroyed and will not be destroyed throughout this case," court documents show.
TIMELINE: The Jussie Smollett investigation
Smollett, who is black and openly gay, had told Chicago police that in late January in Streeterville, two white men yelled racist and homophobic slurs at him, poured bleach on him and put a noose around his neck.
After weeks of investigation, Smollett was charged with disorderly conduct; police said he staged the attack and filed a false report.
Then, at a surprise hearing March 26, all charges were dropped.
O'Brien's petition for a special prosecutor claimed Foxx's handling of the case was "plagued with irregularity."
"Foxx's conflict in this matter is beyond dispute," O'Brien wrote, adding that Foxx should have sought appointment of a special prosecutor. "Instead, Foxx misled the public into believing that Smollett's case was handled like any other prosecution and without influence."
Emails and text messages turned over to the Chicago Sun-Times, in response to a records request, showed that weeks before Smollett was charged, and when the actor was considered by police to be a crime victim, Foxx had talked to Chicago lawyer Tina Tchen, who put her in touch with a relative of Smollett's. Foxx also acknowledged urging CPD Supt. Eddie Johnson to turn the investigation over the the FBI.

Chicago's police superintendent recently admitted that his officers often look the other way when they see bad cops breaking the law.
Chicago, IL - Recently, Chicago's top cop, Police Supt. Eddie Johnson-whose base salary is over a quarter of a million annually-told the Chicago Sun Times in an interview that cops "look the other way" all the time when it comes to witnessing misconduct within their ranks. While readers of the Free Thought Project likely know about this blue code of silence within departments, for the superintendent of one of the nation's largest police forces to come out and admit this is noteworthy and utterly astonishing.
The system of US law enforcement is set up to protect itself which makes it nearly impossible for an individual whistleblower to prove wrongdoing. In case after case, TFTP reports incidents in which abuse, violence, and even murder has gone on inside police departments, is widely known inside the department, yet no one speaks up. Chicago is one of the worst departments in this regard.
Crossing the blue line often means career suicide and can also be dangerous. Previously, the Free Thought Project reported on the whistleblowers from the Chicago police department whose very lives were threatened for trying to expose the corruption in their department.
As Shannon Spalding, one of the whistleblowers from the CPD points out, this blue code of silence and punishment is already an unfortunate reality for most and the superintendent's comments back her up.
"It's no secret that if you go against the code of silence, and you report corruption, it will ruin your career," Spalding said.
Spalding and her partner Daniel Echeverria uncovered a massive level of corruption in their department, leading to the arrest of other officers. However, being good cops got them threatened with "going home in a casket."
This cycle of the "blue line" of protection can only persist for so long before there is no one left with enough courage to call out the corruption.
In his interview with the Sun Times, Johnson's words suggest that this is already happening.
"Do I think there might be officers that look the other way? Yeah, I do. ... There are a lot of reasons why cops might not report misconduct. If they see their partner engage in misconduct, they may look the other way," he said.
"Do I think there are issues in that regard? Yeah." said Johnson, stopping short of calling out the systemic problem, adding, "But I' m not going to indict the entire department for the acts of certain individuals ... If I'm made aware of it, I deal with it."
When the Times rhetorically asked the question of "isn't that the very definition of 'code of silence'," the superintendent noted that there is no definition of it in the dictionary.

In an interview with the Chicago Tribune, Sharpton described Emanuel's behavior as "Hypocrisy 101."
"The reason this is of national significance to me, there is a marked difference between how they reacted to this and how they reacted to the Laquan McDonald case. They were not outraged when the video was withheld until after the mayor's election," Sharpton said of Emanuel, police Superintendent Eddie Johnson and other top police officials. "There was a fox in the henhouse then, but the fox wasn't Kim then. The name of that fox was whoever was in the mayor's race."

After evidence came to light that the former chief of staff of Michelle Obama had attempted to intervene on behalf of the Smollett family to get the investigation turned over to the FBI, the ex-aid, prominent Chicago attorney Tina Tchen, has now gone on the record to confirm that she did contact the state's attorney whose office eventually let Smollett off the hook.
In a statement to USA Today on Wednesday, Tchen addressed reports that she had emailed Cook County State's Attorney Kim Foxx to request on behalf of the Smolletts that the investigation be taken out of the hands of the Chicago Police Department, which would eventually conclude that Smollett had orchestrated an alleged "hoax" hate crime against himself.
"I know members of the Smollett family based on prior work together," Tchen said in the statement Wednesday. "Shortly after Mr. Smollett reported he was attacked, as a family friend, I contacted Cook County State's Attorney Kim Foxx, who I also know from prior work together. After Tchen contacted Foxx to voice the Smollett family's "concerns" about how the Chicago police were handling the case, Foxx replied in a February 1 email: "Spoke to the Superintendent [Eddie] Johnson. I convinced him to reach out to FBI to ask that they take over the investigation."
"Spoke to the superintendent earlier, he made the ask," Foxx told a Smollett family member whose name was redacted from released court documents. "Trying to figure out logistics. I'll keep you posted."
"Omg this would be a huge victory," the relative replied.
"I make no guarantees, but I'm trying," responded Foxx.
Foxx later told the Chicago Sun-Times that the Smollett family was concerned about leaks to the media and believed the FBI would keep a "tighter lid on the information."
Though Foxx said she recused herself from the case because of her contact with Tchen and the Smollett family, it was revealed this week that she did not in fact do so. The National District Attorneys Association chided the prosecutor's handling of the case, including Foxx's decision to recuse herself before Smollett was charged last month because she had discussed the case with a Smollett family member. The case was then handed to First Assistant State's Attorney Joseph Magats.
"First, when a chief prosecutor recuses him or herself, the recusal must apply to the entire office, not just the elected or appointed prosecutor," the group said in a news release. "This is consistent with best practices for prosecutors' offices around the country."
The group, which claims to represent roughly 2,700 prosecutors' offices around the country, also said that prosecutors "should not take advice from politically connected friends of the accused."

Email and text messages provided to the Chicago Sun-Times by Foxx's office show former first lady Michelle Obama's chief of staff Tina Tchen contacted Foxx a few days after the report of the attack to set up a telephone conversation with a Smollett relative.
Foxx told the Sun-Times the relative expressed concerns over leaked information that media outlets attributed to "police sources." Foxx then called Chicago Police Superintendent Eddie Johnson to ask him to let the FBI investigate the alleged attack. The contacts were cited by Foxx in recusing herself from the case on Feb. 13, well before Smollett was charged.

In an interview with WBBM-TV on Wednesday, Foxx said no one tried to intervene on Smollett's behalf, despite emails showing that she was contacted by people linked to Smollett about the case.
"There was no attempt, whatsoever, to influence the outcome of this case," she told the television station. "None whatsoever."
Smollett forfeiting his $10,000 bond and doing community service in return for dropping the charges was also a point of criticism by the district attorney's group.
"Third, when a prosecutor seeks to resolve a case through diversion or some other alternative to prosecution, it should be done so with an acknowledgment of culpability on the part of the defendant," the group said. "A case with the consequential effects of Mr. Smollett's should not be resolved without a finding of guilt or innocence."

Foxx defended her office's actions in a separate interview with FOX32 on Wednesday, saying that the dropping of charges "in no way exonerates" Smollett.

When I look at similarly situated people who are charged with the same level of felony without a background I believe in this case, justice was appropriate," she said. "Again I didn't make that decision, he was availed to alternative prosecution model that anybody else without his riches, without his fame were also availed to."

Foxx, the top law enforcement official in Chicago, is currently under intense scrutiny because of a decision to drop all charges against actor Jussie Smollett on March 26. Smollett told police in January that he was attacked by two masked men who yelled, "This is MAGA country," a reference to President Donald Trump's "Make America Great Again" slogan. Smollett, who is gay and black, was walking home from a Subway sandwich store at 2 a.m. in frigid temperatures when he said the alleged Trump supporters attacked him.
But a police investigation found that Smollett had paid two Nigerian brothers with a check to help him stage the alleged hoax.
Foxx, the first African American state's attorney in Cook County, recused herself from the racially charged case in February, after it was revealed she was backchanneling communication with Smollett's family.
Text messages surfaced showing Foxx was in contact with former First Lady Michelle Obama's former chief of staff, Tina Tchen, who is a close friend of the Smollett family.
"I wanted to give you a call on behalf of Jussie Smollett and family who I know. They have concerns about the investigation," Tchen wrote on Feb. 1.
Foxx officially stepped aside, putting her deputy, First Assistant State's Attorney Joseph Magats, in charge. Chicago's police union has called for an investigation into her activities.

Cook County State's Attorney Kim Foxx never "formally" recused herself from the Jussie Smollett case - contrary to the Chicago prosecutor's public announcement that she had done so - a spokesperson for the prosecutor confirms.
In a statement Wednesday, Cook County State's Attorney spox Kiera Ellis said Foxx "did not formally recuse herself or the [State's Attorney] Office based on any actual conflict of interest. As a result, she did not have to seek the appointment of a special prosecutor."
According to Ellis, Foxx's announcement that she had recused herself "was a colloquial use of the term rather than in its legal sense."
"Instead, in an abundance of caution, Fox informally separated herself from the decision-making over the case and left it to her Assistants, as happens in 99.9% of all cases handled by the Office," the spokesperson added.
Prosecutors abruptly dropped all charges against Jussie Smollett on Tuesday after the Empire actor accused of faking a racist, anti-gay attack on himself agreed to let the city keep his $10,000 in bail. However, he maintained his innocence and insisted he was attacked.

Email and text messages given to the Chicago Sun-Times by Foxx show she made the effort after former first lady Michelle Obama's chief of staff Tina Tchen contacted Foxx to set up a telephone conversation with a Smollett relative.
According to the USA Today, Foxx told the former Michelle Obama aide that she "convinced" Chicago Police Superintendent Eddie Johnson to request the FBI "take over" the investigation. In a text message to a Smollett family member, Foxx confirmed that she had made the request. "Spoke to the superintendent earlier, he made the ask," wrote Foxx. "Trying to figure out logistics. I'll keep you posted."
The ensuing conversations were cited by Foxx in recusing herself from Smollett's prosecution.
Foxx told the Sun-Times the relative expressed concerns over leaked information that media outlets attributed to "police sources."
Chicago police spokesman Anthony Guglielmi says the FBI was involved from the start but there was never talk of turning the case over.
As Breitbart News reported Tuesday, progressive billionaire mega-donor George Soros donated $408,000 in 2016 to a super PAC which supported Foxx.
Smollett is accused of lying to the police about a racist and homophobic attack on himself in downtown Chicago on January 29th. The actor told police he was assaulted by two masked individuals, who hurled racist and homophobic insults at him. He said his attackers doused him with an unknown chemical substance, place a thin rope around his neck, and shouted "This is MAGA country!" before fleeing. Police charge Smollett paid $3,500 to the two men, both of whom are black.
The men were brothers Abimbola "Abel" and Olabinjo "Ola" Osundairo, and one of them had worked on Empire. An attorney for them, Gloria Schmidt, has said the brothers agreed to help Smollett because of their friendship with him and the sense that he was helping their careers.

Chicago Mayor Rahm Emanuel and Chicago Police Superintendent Eddie Johnson reaffirmed their positions that Jussie Smollett had generated a fake hate crime attack in order advance his own personal brand after all charges the "Empire" actor were dropped Tuesday. "This is, without a doubt, a whitewash of justice and sends a clear message that, if you are in a position of influence and power, you will get treated one way and other people will be treated another way," Emanuel said at a joint press conference in Chicago alongside Johnson. "There is no accountability, then, in the system. It is wrong, full stop."
The 16 felony charges brought against Smollett in February were dropped Tuesday by the state prosecutor after an unannounced, emergency hearing was held with a judge. The ruling was that Smollett was voluntarily surrendering his $10,000 bond to the city, and the charges dropped were in consideration for his work in the community.
Johnson said he believed Smollett still owed an apology to Chicago, arguing that the actor wouldn't broker a deal behind closed doors if he was falsely accused. "Do I think justice was served? No. What do I think justice is? I think this city is still owed an apology," Johnson said. "When I came on this job, I came on with my honor, my integrity, and my reputation. If someone accused me of doing anything that would circumvent that, I would want my day in court. Period. To clear my name. I have heard that they wanted their day in court with TV cameras, so America could know the truth, but no, they chose to hide behind secrecy and broker a deal to circumvent the judicial system."
In January, Smollett claimed he was attacked by two white men who targeted him for his sexual orientation and race and said they put a noose around his neck and told him he was in "MAGA Country." In February, Chicago police announced they had found two Nigerian-American brothers that had been the ones who accosted Smollett and the attack was organized between them and Smollett himself. Police presented a portion of evidence to a grand jury who then decided to bring forth the charges against Smollett.
Both Emanuel and Johnson said they were not included in the decision to drop the charges, adding they found out when the media found out. Emanuel said that behavior by the state attorney's office was "not on the level." Emanuel and Johnson also insisted that, despite the decision to drop the charges, the blame should remain with Smollett for the hoax.
"I want to say one other thing. Mr. Smollett is still saying he is innocent, still running down the Chicago Police Department. How dare him? How dare him?" Emanuel said. "This is not the superintendent and the detective department's word against his and, even after this whitewash, still no sense of ownership of what he's done. He says that, in fact, he is the wronged in this case. This is an unbelievable, not just whitewash of justice, this is a person now who has been let off scot-free with no sense of accountability of the moral and ethical wrong of his actions. You have a person using hate crime laws that are on the books to protect people who are minorities from violence to then turn around and use those laws to advance your career and your financial reward. Is there no decency in this man?" Emanuel said he couldn't say whether or not the decision was politically motivated, insisting he could only guess at it.

Just days after Jussie Smollett told Chicago police he had fought off a pair of attackers who targeted him in an apparent hate crime, Cook County State's Attorney Kim Foxx tried to persuade Police Supt. Eddie Johnson to turn the investigation over to the FBI.
Foxx's call to Johnson came after an influential supporter of the "Empire" actor reached out to Foxx personally: Tina Tchen, a Chicago attorney and former chief of staff for former First Lady Michelle Obama, according to emails and text messages provided by Foxx to the Chicago Sun-Times in response to a public records request.
Tchen passed Foxx's number to a relative of the actor, and the ensuing conversations with the family member were cited by Foxx last month as the reason she recused herself from Smollett's prosecution as the actor faces disorderly conduct charges for allegedly making a false police report.
Text messages show Tchen contacted Foxx on Feb. 1, three days after Smollett said he was jumped by two men as he walked home from a sandwich shop near his Streeterville home. Tchen texted Foxx to set up an early morning phone call.
"I wanted to give you a call on behalf of Jussie Smollett and family who I know. They have concerns about the investigation," Tchen wrote in a text sent before 5 a.m., seeking to set up a call with Foxx before Tchen left on an 8 a.m. flight to New York.
A few hours later, Foxx received a text from a relative of Smollett, who said she'd received the number from Tchen.
In an interview with the Sun-Times this week, Foxx said that the family member expressed concerns about leaked information about the investigation - information that media outlets attributed to "police sources."
"They had no doubt about the quality of the investigation, but believed that the FBI would have a tighter lid on the information," said Foxx, adding that Johnson initially seemed receptive to the idea of turning the case over to the FBI.
Foxx said she has made similar calls to Johnson in cases involving lower-profile victims.
Police spokesman Anthony Guglielmi said the FBI was involved from the start of the investigation, as is the case in most possible hate crime investigations, but there was never a discussion of the CPD giving up the case to federal investigators. The department confirmed last week that there is an ongoing internal investigation of the unnamed sources who gave the press information.
The conversations with Smollett's relative took place during the period of the investigation when Smollett was considered the victim of a hate crime, not a suspect in a hoax, Foxx said.
Her decision to recuse herself was based on the conversations with the family member, which included information about Smollett.
An email included with the records requested by the Sun-Times shows Foxx's chief ethics officer sent a message to top staff announcing Foxx had recused herself from the case on Feb. 13 - about a week before Smollett was charged, and the same date as her last text message and calls with Smollett's relative.
Foxx spokesman Robert Foley announced that the top prosecutor had recused herself and turned the case over to her top deputy, Joseph Magats, on Feb. 19, without explaining why.
The next day, Foley elaborated in a statement to reporters that Foxx "had conversations with a family member of Jussie Smollett about the incident and their concerns, and facilitated a connection to the Chicago Police Department who were investigating the incident."
The text messages show Foxx told both Tchen and Smollett's relative that Foxx had reached out to Johnson personally about handing the investigation off to the FBI.
"Spoke to the superintendent earlier. He is going to make the ask. Trying to figure out logistics. I'll keep you posted," Foxx wrote the relative that evening.
"OMG this would be a huge victory," the relative texted in reply.
In an email message to Tchen sent the same day, Foxx wrote: "Spoke to the Superintendent Johnson. I convinced him to reach out to FBI to ask that they take over the investigation. He is reaching out now and will get to me shortly."
"I don't think it is odd or rare for prosecutors to talk to police, or for (Foxx) herself to ask what is going on in a particular case," Kling said. "And, once she realized she had talked to a family member who may have given her information about a pending case, recusing herself was exactly the right thing to do."

Cook County prosecutors agreed to drop the charges against Smollett at an unscheduled hearing in the case Tuesday morning. Smollett will forfeit the $10,000 bail he posted after his arrest.

"After reviewing all of the facts and circumstances of the case, including Mr. Smollett's volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case," the Cook County State's Attorney's office stated in an email.
Sources tell CBS 2 that CPD Superintendent Eddie Johnson is furious and that he received no notification about the charges being dropped. CBS 2 is told that he will speak after the police graduation taking place.
Smollett's spokesperson said his record would be "fully expunged."
"Today, all criminal charges against Jussie Smollett were dropped and his record has been wiped clean of the filing of this tragic complaint against him. Jussie was attacked by two people he was unable to identify on January 29th. He was a victim who was vilified and made to appear as a perpetrator as a result of false and inappropriate remarks made to the public causing an inappropriate rush to judgement," spokeswoman Anne Kavanaugh stated in an email.
"Jussie and many others were hurt by these unfair and unwarranted actions. This entire situation is a reminder that there should never be an attempt to prove a case in the court of public opinion. That is wrong. It is a reminder that a victim, in this case Jussie, deserves dignity and respect. Dismissal of charges against the victim in this case was the only just result.
"Jussie is relieved to have this situation behind him and is very much looking forward to getting back to focusing on his family, friends and career."

Smollett was accused of falsifying a police report, and lying to police. Each of the 16 counts against him covers various alleged acts that Smollett falsely described to the officers-including that he was hit by two men, that they yelled racial and homophobic slurs and poured a chemical on him.
Smollett, who is black and openly gay, had told police he was attacked as he was walking home around 2 a.m. on Jan. 29. He claimed two masked men - one of them also wearing a red hat - shouted racist and homophobic slurs as they beat him, put a noose around his neck, and poured a chemical on him.
Police said, in reality, Smollett had paid Ola and Abel Osundairo to stage the attack.
CBS 2's Charlie De Mar has reported Smollett also directed the brothers to buy the noose at a hardware store and the hat and masks at a store in Uptown. Chicago Police Supt. Eddie Johnson said police have the check.
Police said the two brothers wore gloves during the staged attack, and did punch Smollett, but the scratches and bruises on Smollett's face most likely were self-inflicted.
Police at the time said the attack was a publicity stunt because the actor was upset about his pay on the show.
Smollett has denied all the allegations.

Chicago's police union has demanded a federal investigation into the county's top prosecutor for allegedly interfering in the Jussie Smollett case after being contacted by Michelle Obama's former chief of staff.
The Fraternal Order of Police, which represents the department's rank-and-file, sent a letter earlier this week asking the Department of Justice to probe Cook County State's Attorney Kim Foxx, according to ABC 7 Chicago.
Foxx tried to convince Police Superintendent Eddie Johnson to turn Smollett's case over to the FBI - after Tina Tchen, the former senior Obama aide, reached out to her, saying the "Empire" star's family had "concerns."
"That recusal is wholly insufficient," FOP president Kevin Graham said in a statement. "In order for Ms. Foxx to properly charge and try this case, her entire office should have recused itself and a special prosecutor been appointed."
Foxx's office eventually charged Smollett, 36, with 16 felony counts of disorderly conduct for allegedly filing a false police report. The singer-actor, who is gay and black, claimed he was attacked in a racist, homophobic hate crime in January, but police say he staged the beatdown because he was unhappy with his salary on "Empire."
Tchen texted Foxx on Feb. 1 - three days after Smollett reported the attack and when he was still considered a victim.
"I wanted to give you a call on behalf of Jussie Smollett and family who I know. They have concerns about the investigation," Tchen wrote.
Foxx emailed Tchen, a close pal of Mayor Rahm Emmanuel's wife, later the same day, "Spoke to the Superintendent Johnson. I convinced him to Reach out to FBI to ask that they take over the investigation. He is reaching out now and will get to me shortly."

Smollett, who left the courthouse without speaking to reporters, is charged with 16 counts of disorderly conduct.
Prosecutors allege that Smollett, who is black and gay and plays the gay character Jamal Lyon on the hit Fox TV show, hired two friends to help him stage the attack on him in downtown Chicago early on the morning of Jan. 29. They say Smollett was unhappy about his salary and wanted to drum up publicity to help his career.
Smollett has denied that he staged the attack and maintains he is innocent. His lawyers have called the charges against him "prosecutorial overkill."

"They had no doubt about the quality of the investigation, but believed that the FBI would have a tighter lid on the information," Foxx told the outlet.

Exclusive: Grand jury returns 16 felony counts against Jussie Smollett
Embattled TV star Jussie Smollett's legal problems have just become significantly more serious as a Cook County grand jury has returned a 16-count true bill of charges against him in connection with his alleged falsification of a hate crime in Streeterville in late January.
Smollet was charged with a single count of felony disorderly conduct-false report last month based on allegations brought by the Cook County State's Attorney's Office.
But, CWBChicago has learned that a grand jury has now returned a total of 16 felony counts of disorderly conduct-false report against the former star of Empire on Fox.
The grand jury's true bill states that Smollett lied about the attack to two separate police officers–the beat cop who took his initial report and a detective who conducted a follow-up interview the same day.
In one set of charges, the grand jury found that Smollet filed a false police report around 2 a.m. on Jan. 29th in which he told an officer that he was attacked near 341 East Lower North Water Street by two unknown men who were dressed in black and one of whom wore a ski mask. The jury further found that Smollett told the original officer that the attackers called him racial and homophobic slurs and struck him in the face with their hands. The police report connected to these charges also indicate that Smollett claimed that a noose had been placed around his neck and a "chemical" had been poured on him.
The second set of charges returned by the grand jury involves Smollett's alleged false reporting of the incident to a police detective later the same day. Additional details that Smollett apparently included in the second interview include: the men approached him from behind, Smollett fought back, and all three men fell to the ground where Smollett said he was kicked in the back and felt someone pulling on his neck. During this interview, Smollett also told the officer that one offender was a white male wearing a black mask with an open area around the eyes that exposed the attacker's skin, the grand jury found.
While announcing the initial charge against Smollett last month, Chicago Police Superintendent Eddie Johnson said his department believed that Smollett was also responsible for mailing a threat letter to himself that set the stage for the purported hate crime. Nonetheless, no charges were brought against Smollett in connection with the letter by the grand jury.
The new charges against Smollett each carry a potential sentence of probation to four years if convicted. Realistically, though, Smollett is unlikely to be convicted on more than a fraction of the charges. Most Cook County criminal cases are resolved through plea bargains in which a defendant pleads guilty to one and, rarely, two counts of an indictment in return for a favorable sentence. Only by going to trial do most defendants run the real risk of being convicted of more than one or two counts.
National news outlets have been reporting since Smollett's arrest that he had already been "indicted" by a grand jury. As CWBChicago has repeatedly reported, those outlets were incorrect. Shortly before Smollett's arrest, a grand jury was convened in a so-called "John Doe case," a legal maneuver that is designed to lock in the testimony of key witnesses under oath to minimize the risk of that testimony changing later and to preserve the testimony should a witness go missing.

It's Not 'Identity Politics,' It's Anti-White Politics
Every time a manifestly racist, anti-white event goes down, which is frequently, conservative media call it "identity politics." "The left is playing identity politics."
Whatever is convulsing the country; it's not identity politics. For, blacks are not being pitted against Hispanics. Hispanics are not being sicced on Asians, and Ameri-Indians aren't being urged to attack the groups just mentioned. Rather, they're all piling on honky. Hence, anti-white politics or animus.
The ire of the multicultural multitudes is directed exclusively at whites and their putative privilege. Anti-whitism is becoming endemic and systemic.
Take "Empire" actor Jussie Smollett. Smollett deceived the country and the Chicago Police Department about having fallen prey to a hate crime, which, it transpired, he had allegedly crudely orchestrated.
The Chicago Police Department superintendent expressed the requisite righteous indignation that a black man (Smollett) would desecrate symbols of black oppression in the process of framing innocent Others. (A noose had been purchased at Smollett's behest.)
Nobody, Superintendent Eddie Johnson included, said sorry to the accused group, whose reputation had been sullied: "Trump supporters or white persons."

Only after it matters is Good Morning America anchor Robin Roberts admitting she was skeptical of Jussie Smollett's story all along.
As if to prove just how utterly useless she is as a so-called journalist, Roberts only now is saying that there were "a lot of red flags" in Smollett's claim he was the victim of a hate crime at the hands of two white Trump supporters armed with a noose and bleach who were out hunting for blacks and gays in downtown Chicago at 2 a.m. in subzero weather.
"Even though that you all were saying early on there was no reason not the believe his story, there were a lot of red flags, that a lot of people saw of people saw. You all had questions. Even though weren't, of course, going to be public about that," Roberts said during an interview with Chicago's superintendent of police Eddie Johnson earlier this week.
Now you tell us, Robin!
Now you tell us you were skeptical of the story, because when you were the only journalist in America who interviewed Smollett, you expressed no skepticism at all. In fact, you didn't even use the word "alleged" to describe the crime.
Her excuse for her irresponsible softball interview is even worse.
After the hoax blew up and Smollett was arrested and indicted for filing a false report, Roberts said this with a straight face: "We have to remember, at that time, on Tuesday, police officers were saying that his account was consistent. It was credible. And that he was being cooperative. This was all before the interview aired on Thursday and then we found out about the brothers."
Oh, so the media are now believing the police, are taking everything the police tell them as gospel, are setting aside their own skepticism and doubts, their own professional responsibilities, to defer to law enforcement.
When did this rule change happen?
When did the abdication of independence and every tenet of professional journalism occur?
That is not only a terrible and revealing excuse coming from Roberts, it is also not true. When the agenda suits their left-wing cause, the media are always willing to express doubts about what law enforcement tells them. This is merely a handy shield for Roberts to hide her own biases and cowardice behind.

Even after a spate of hundreds of hoax bomb threat were shown to have been carried out by a disturbed Jewish American teenager in Israel and a left-wing journalist, the ADL still included the threats in its 2017 "audit" of antisemitic incidents in the U.S.
Without the hoax threats, the reported increase in antisemitic incidents was far more modest. The number of physical assaults against Jews dropped by almost half.

Jussie Smollett's legal team issued a defiant message Thursday accusing the Chicago police of organizing a "spectacle" and suggesting that politics has something to do with his legal conundrum.
Smollett has been indicted for disorderly conduct for allegedly filing a false report about a hate crime, and earlier in the day police said they believe the 36-year-old actor devised a hoax to further his career.
"Today we witnessed an organized law enforcement spectacle that has no place in the American legal system. The presumption of innocence, a bedrock in the search for justice, was trampled upon at the expense of Mr. Smollett and notably, on the eve of a Mayoral election," Smollett's legal team said in a statement. "Mr. Smollett is a young man of impeccable character and integrity who fiercely and solemnly maintains his innocence and feels betrayed by a system that apparently wants to skip due process and proceed directly to sentencing."

The statement appears to be a rebuke against the Chicago police's top official, who said Smollett sent himself a threatening letter and concocted a fake attack because he was unhappy with his salary.
"'Empire' actor Jussie took advantage of the pain and racism to promote his own career. I am left hanging my head and asking why? Why would anyone, especially an African-American man, use the symbolism of a noose to make false accusations?" Eddie Johnson, the superintendent of the Chicago Police Department, said in a news conference.

Team Smollett's statement also alludes to Chicago's hotly contested mayoral campaign on Tuesday, in which more than 12 candidates are vying to replace Mayor Rahm Emanuel.
Emanuel put out a statement after the police press conference, saying Smollett does not represent the city's values. "All across Chicago, in every neighborhood, there are signs in front yards and windows that read, 'Hate Has No Home Here.' It is a sign that expresses our shared values and defines our great city," Emanuel said in a statement. "Our laws exist to reflect and defend those values, and hate crimes will never be tolerated."
He added: "A single individual who put their perceived self-interest ahead of these shared principles will never trump Chicago's collective spirit."
Smollett faces a felony charge of disorderly conduct and several years of prison time after he filed a police report claiming he was attacked by two men Jan. 29 in Chicago. Smollett, who is black and gay, claimed two white men yelled racist and homophobic slurs, tied a rope around his neck, and poured bleach on him.
Police said two people, Olabinjo Osundairo and Abimbola Osundairo, who are black, were taken into custody and questioned by police about the alleged attack. Johnson said the brothers told police Smollett staged the attack because he was unhappy with his salary. Johnson also said the brothers participated in Smollett's scheme because they were offered money: $3,500 before and another $500 after the alleged attack.
On Thursday, a judge set a $100,000 bond for Smollett as he awaits trial and prosecutors released a four-page summary of his actions. That summary says it was Smollett's idea to have one of his friends, Olabinjo Osundairo, indicate he was a supporter of President Trump during the fake attack. "Defendant Smollett also included that he wanted Ola to place a rope around his neck, pour gasoline on him and yell 'This is MAGA Country,'" it said.

With speculation rising that his career is in jeopardy, Variety reported Thursday evening that Smollett was spotted back on the "Empire" set hours after being released from police custody. The show is wrapping up filming for its fifth season and there is about an episode and a half left to film after Smollet was given a few days to deal with his legal situation.
Earlier in the day, the network behind the series said it was weighing its options in regards to Smollett.
"We understand the seriousness of this matter and we respect the legal process," 20th Century Fox and Fox Entertainment said in a statement Thursday. "We are evaluating the situation and we are considering our options."

Smollett released a statement Thursday evening, saying, "Today Jussie did answer routine followup questions for Chicago Police Department and continues to cooperate."
Smollett's representatives said he is not being written off "Empire."
Twentieth Century Fox Television and Fox Entertainment released a statement saying, "The idea that Jussie Smollett has been, or would be, written off of EMPIRE is patently ridiculous. He remains a core player on this very successful series and we continue to stand behind him."
A source briefed on the Smollett investigation confirmed to ABC News that Chicago police are questioning the two persons of interest – one of whom has appeared on "Empire."
The law enforcement official also told ABC News that the homes of the persons of interest were raided Wednesday night. Police removed shoes, electronic devices and other items they believe could help them determine if the two people played any role in the assault.

Police said they have not found surveillance video that shows the attack. But earlier in the investigation, they did release grainy surveillance images of two possible persons of interest. The photos show two silhouettes on New Street near Illinois Street between 1:30 a.m. and 1:45 a.m. on Jan. 29.
In a statement released Thursday, police said they identified the two people in the surveillance photos and tracked them down using cameras, public transportation records and corroborating info provided by Smollett.
Smollett spoke exclusively with Robin Roberts on "Good Morning America" Thursday. He reflected on what happened to him that morning and what has happened to him since.
"It's the attackers, but also the attacks," he said, adding of those who don't believe his story, "It's not necessarily that you don't believe that this is the truth, you don't even want to see the truth."
Anthony Guglielmi, spokesman for Chicago Police Department, said earlier Thursday morning that he watched the GMA interview with CPD Superintendent Eddie Johnson. Guglielmi said Smollett's comments on GMA are consistent with what he's told Chicago police. Unfortunately, police have no solid evidence to arrest anyone at this time.
The investigation is ongoing.

Smollett has now reportedly released a heavily redacted record of his calls to police however, police Superintendent Eddie Johnson said the records "are not sufficient and do not meet the burden of a criminal investigation," according to the Chicago Tribune.
The growing lack of evidence in the case has reportedly pushed Chicago police to even consider charging Smollett with filing a false report. CBS Chicago and other local outlets report that Johnson still wants Smollett treated as a victim, but will pursue charges against the actor if the case is proven to be a hoax.

Smollett has now reportedly released a heavily redacted record of his calls to police however, police Superintendent Eddie Johnson said the records "are not sufficient and do not meet the burden of a criminal investigation," according to the Chicago Tribune.
The growing lack of evidence in the case has reportedly pushed Chicago police to even consider charging Smollett with filing a false report. CBS Chicago and other local outlets report that Johnson still wants Smollett treated as a victim, but will pursue charges against the actor if the case is proven to be a hoax.

CHICAGO - Nearly two weeks after "Empire" star Jussie Smollett claimed he was the victim of a racist, homophobic attack, cops have yet to identify any suspects - and some people in his tony Chicago neighborhood are growing skeptical.
"I don't believe it happened the way he said it did," said Agin Muhammad, who lives in the same swank high-rise near the Navy Pier as Smollett.
"I've been in this neighborhood five years. I don't believe it, not around here ... Half the people are gay and the other half are black."
A patron at Lizzie McNeill's Irish Pub, about a block from the scene of the alleged Jan. 29 incident, said Smollett's story "doesn't really make sense."
"It's a lie, because Chicago is the most liberal city around," said the man, who wouldn't give his name. "They have cameras everywhere ... Why can't they find the attack?"
Cops have said they found plenty of surveillance video, but none that captured the incident.
Meanwhile, Chicago police said Sunday that Smollett has yet to turn over data from his cellphone to verify that he was on the phone with his music manager, Brandon Moore, when he was allegedly attacked.
Moore has said he heard Smollett's assailants shout a "racial slur" and the words "MAGA country," an apparent reference to President Trump's "Make America Great Again" slogan.
"We have no reason to doubt the statements, but for a criminal investigation, we need to independently confirm the phone records," Chicago police spokesman Anthony Guglielmi said.
"We offered to take the phone to download the data and he expressed he couldn't be without his phone for several hours."

Chicago Police Superintendent Eddie Johnson has said that Smollett, 36, was being treated as a crime victim, but would be held accountable if cops learn he filed a false report.

They are just a few of the more than 530 people murdered in Chicago in 2018, with victims ranging in age from 1 to 93.
And while the city's violence still grips large swaths, especially on the South and West sides, shooting and murder totals fell for the second consecutive year, according to statistics from the Chicago Police Department and Cook County medical examiner's office.
As of Dec. 25, the medical examiner had declared 539 deaths in Chicago in 2018 as homicides. The Sun-Times has counted 542 murders in Chicago in 2018 as of Dec. 25. The Chicago Police Department has said 555 people have been murdered in the city as of Dec. 23.
A death classified as a homicide by the medical examiner's office does not mean it will be considered a murder by Chicago Police. For example, the man who shot and killed three people at Mercy Hospital last year was himself shot at killed by a Chicago Police officer. His death, though ruled a homicide, is not considered a murder by police.
The CPD figure also does not include murders on city expressways, which fall under the jurisdiction of Illinois State Police, or killings deemed justified by CPD investigators, as in cases of self defense.
"The ongoing reductions in violent crime were achieved in large part due to strengthened community partnerships, investments in data-driven policing and the creation of the strategic decision support centers in 20 of the city's 22 police districts," a CPD statement issued Friday evening read.
The city saw 664 murders in 2017 and a staggering 781 a year earlier. And while 2018 saw far fewer murders than those years, the city is still outpacing the totals of 2014 and 2015.
CPD Supt. Eddie Johnson has on many occasions called the city's entrenched gun violence "unacceptable." Last year, Johnson said he thought it's "a reasonable goal" to see the city log fewer than 300 murders in a year.
As of Dec. 23, according to the CPD, the city recorded 2,355 "shooting incidents" as compared to the 2,750 that occurred in the same time span in 2017. A single "shooting incident," though, can have more than one victim.
The largest drop-offs in shooting totals were seen in the Ogden and Austin districts on the West and Southwest sides. In 2017, those districts combined to see 491 shooting incidents. This year, their combined total was 352 as of Dec. 23.
Seven of the CPD's 22 police districts accounted for more than half of all shootings in the city in 2018. Of those seven - all of which are on the South and West sides and include the Ogden and Austin districts - the Harrison District saw the most gun violence by a wide margin, with 340 reported shooting incidents in 2018 as of Dec. 23.
The next highest shooting incident total of any district was 193, logged by the Calumet District on the Far South Side. There were 160 shooting incidents in the district in 2017.
Calumet District officers have been hit especially hard by tragedy this year. Earlier this month, officers Conrad Gary and Eduardo Marmolejo were killed when they were hit by a train near 103rd and Cottage Grove as they were investigating a call of shots fired.
Two officers took their own lives in the district's parking lot, and another officer collapsed and died in the station this year.
According to the medical examiner's office, well over half of Chicago's homicide victims in 2018 - 318 people - were black males between 16 and 41 years old.
The CPD heavily credited its partnerships with federal law enforcement agencies - the DEA, ATF, FBI and U.S. Attorney's Office - with the drop in shootings from 2017. The department went on to note that more than 9,500 illegal guns were recovered in 2018, the most in a single year since 2013.

Retired Chicago police commander accused of stealing $360K in Social Security
A former Chicago police commander was charged earlier this week with stealing more than $360,000 in Social Security funds intended for his deceased mother, WGN-TV reported
"Kenneth Johnson, defendant herein, did steal, purloin, and knowingly convert to his own use money of the United States, namely, approximately $363,064 in funds administered to the Social Security Administration, which funds defendant was not entitled to receive," according to the one-page court document filed Wednesday in a U.S. District Court in Illinois.
The alleged scam spanned more than two decades from June 1994 to November 2017, the document showed.
Johnson, 54, retired in August after 32 years on the force. He was commander of the 7th District in Englewood.
What did the Chicago police say?
Police Superintendent Eddie Johnson told the Chicago Tribune that he was "shocked" when he learned late Wednesday about the charge against Johnson.
"I am shocked and very disappointed by this news," Eddie Johnson said. "I knew Cmdr. Johnson well from his efforts to reduce violence in Englewood, but if proven, these allegations erode the public's trust and tarnish his service to Chicago."
The department said there were no open internal affairs investigations in the case.
Kenneth Johnson was well-respected and had been credited for his efforts in reducing violent crime in his district, one of the most dangerous in the city, according to reports.

Attorney Michael Clancy, who's representing Kenneth Johnson, told the Tribune that his client has been cooperating with federal investigators.
His arraignment is scheduled for Nov. 27. It's not yet known how he will plea.
"There is an arraignment coming up, and we will take a look at his options and go from there," Clancy said.

Chicago Police Superintendent Eddie Johnson's Long Record of Justifying Police Misconduct and Shootings
Chicago detective Dante Servin shot Rekia Boyd in the back of the head late on a warm night in March 2012. Servin was an off-duty detective, a 20-year Chicago police veteran who lived on the block of the shooting, just off Douglas Park on the city's West Side. Boyd was a 22-year-old African-American woman hanging out in the park with some friends. She was unarmed.
As police converged on the scene, Servin told his fellow officers that he had asked Boyd and her friends to quiet down as he drove out of the alley next to his house. According to Servin, a man in the group, Antonio Cross, responded by pointing a gun at him. Servin then fired five shots over his shoulder from inside his car. One hit Cross's hand. Another hit Boyd, who fell to the ground.
Ambulances rushed both victims to the hospital while detectives prepared charges against Cross. Officers, including a canine team, spread out to look for the gun Servin claimed he had seen. Meanwhile, Servin freely wandered the scene, talking with a succession of detectives and police supervisors.
Soon, a deputy chief named Eddie Johnson took command of the crowd of officers outside Servin's house. As the designated on-call incident commander, Johnson assumed responsibility for the department's initial investigation of the shooting. The OCIC is a central part of the department's response to police shootings, operating at the scene "with the authority of the superintendent of police," according to Chicago Police Department regulations.
Johnson faced a difficult task. The first hours after the shooting were marked by conflicting accounts from Servin and multiple civilian witnesses. The undisputed facts of the case were also disturbing: An off-duty officer had shot an unarmed woman in the head. And he had fired into a group of civilians, typically a violation of department rules.
Yet Johnson and the officers under his direct command proceeded to make a number of troubling decisions. In the days after the shooting, witnesses told investigators that Servin appeared to have been drinking. When asked several months after the shooting if he had been drinking that night, Servin told a film crew, "That's my damn business." Police investigators waited six hours to administer a blood alcohol test.
Detectives also discovered cameras mounted on Servin's house that looked directly over the scene of the shooting. When Servin said the cameras didn't work, instead of insisting on inspecting them or obtaining a search warrant, detectives dropped the matter, eventually asking him to sign an affidavit swearing that the cameras were inoperable.
Detectives also quickly uncovered evidence that Cross had been unarmed. Civilian witnesses denied that Cross had a weapon, and although there was a trail of blood and dashcam footage clearly showing Cross's path after the shooting, police were unable to find a gun. Despite these findings, police asked prosecutors to charge Cross with felony assault and issued a press release falsely claiming that Servin had fired only after Cross began to "approach him with a handgun" and "pointed the weapon in the direction of the detective."
At 10:40 a.m., about nine hours after the shooting, Johnson concluded his initial investigation into Servin's use of force and endorsed the detective's account in his official use of force report. "Based on the facts available at this time, Officer Servin acted in compliance with department policy," he wrote, approving Servin's decision to open fire. "Officer Servin fired his weapon at the offender after the offender pointed a firearm at Officer Servin." Johnson did not check the box in his report that would have recommended the case for further investigation. The official use of force report Johnson signed never mentioned Rekia Boyd.

Chicago Police superintendent insists 'everyone has to be accountable' as city violence continues
Following another bloody weekend in the Windy City, Chicago Police Superintendent Eddie Johnson expressed his frustration over "another unacceptable violent weekend," ABC's "Good Morning America" reported.
"Everyone has to be accountable," Johnson said during a news conference Monday at the department's headquarters. "Myself, the first deputy, the mayor and his staff, our judicial partners and the community, everybody has to be accountable - especially the people that decide to pull these triggers. They don't get a pass from us. There is no pass from us."
Authorities said at least 58 people were shot over the weekend and at least six have died from their wounds, according to WBBM-TV. Johnson said the department has increased police presence by 600 officers in neighborhoods with higher crime rates, but that has not been enough to stop the violence.
The department took three persons of interest into custody, according to Johnson, adding that 83 illegal guns were removed from the streets and 29 gun-related arrests were made. Police also shut down a gathering of 68 people that may have involved illegal activities.
Johnson said the shootings are fueled by gang-related conflicts and there must be for tougher punishments from the courts.
"The truth is, and I know you all are tired of hearing me say it, but as long as we fail to create repercussions for carrying and using illegal guns or more importantly, hold repeat violent offenders accountable for their actions," Johnson said. "We're simply going to continue to have these discussions on Monday mornings."
The 59-year-old top cop told reporters that he has lived in Chicago "his entire life" and he has a clear understanding of the tensions between the black community and the police department.
"But the simple fact of it is that the police department can't do it alone," Johnson said of the department.
"These individuals that keep pulling these triggers just feel like they can continue to do it because they're getting away with it," he continued. "It doesn't take a rocket scientist to figure that out. We're not splitting the atom here."
Johnson said people need to provide information to the police and the judicial system must hold them accountable. He said it's "ridiculous" and community members are "sick and tired of it and they should be."
He said it's obvious that Chicago has "way too many guns."
Johnson went on to say that people often compare Chicago to New York and Los Angeles when it comes to gun violence, "but the fact of it is they don't have the illegal gun problem in those cities that we have because we continuously fail to hold people accountable and until we do that we're going to continue seeing it."
"These individuals are showing us every day that they're not afraid to do it, and we have to ask ourselves, 'Why?' Why aren't they afraid?' The consequences of it just isn't there in aren't there in their minds," he said.

Anti-violence protestors shut down major Chicago expressway
Protestors in Chicago shut down a portion of a major interstate on Saturday morning as part of an anti-violence march.
Thousands of people marched onto the Dan Ryan Expressway for a planned protest aimed at urging city officials to take action on gun violence, jobs and the economy.
Law enforcement and the marchers butted heads over how much of the expressway the protest would be able to shut down.
State police originally said that they would work with protestors to keep some lanes open to cars, but according to multiple reports, march leaders continued to negotiate with police to shut down all lanes of the expressway, and were successful for part of the march.
And photos show Chicago Police Superintendent Eddie Johnson and and Rev. Michael Pfleger, the march leader, walking arm-in-arm.

Special Prosecutor Releases Full Report on Investigation of Soros-Backed Prosecutor in Jussie Smollett Case

The office of Special Prosecutor Dan Webb released its full 60-page "summary report" Monday afternoon of its investigation into the office of Cook County State's Attorney Kim Foxx over her improper handling of the Jussie Smollett case in 2019.
Smollett was convicted earlier this month on five of six felony counts of disorderly conduct, relating to faking a hate racist and homophobic crime in 2019, blaming it on Trump supporters, and falsely reporting it to the Chicago Police Department.
Foxx, who was one of several left-wing prosecutors backed by billionaire Democrat donor George Soros in his effort to push "criminal justice reform" across the country, initially dropped criminal charges against Smollett, provoking public outrage.
There was suspicion of political interference, after Tina Tchen, a former aide to First Lady Michelle Obama, reached out to the prosecution on behalf of the Smollett family. Judge Michael Toomin ordered a special prosecutor to intervene, both to take up the Smollett case and to investigate Foxx and her subordinates at the Cook County State Attorney's Office.
Last year, a 12-page summary of the summary was released, in which Webb revealed that while there were abuses of discretion and possible ethical breaches by Foxx and her office, especially in misleading the public about key facts like Smollett's past criminal record, there had been no criminal violations and Tchen's intervention had not been decisive.
The full 60-page summary provides the evidentiary basis for the shorter 12-page version. It includes details of interviews with Foxx and Tchen, as well as others involved, and refers to text messages and other bases for the report's conclusions.
Some of the additional details include confirmation of earlier reports that Foxx's office declined to notify Chicago Police Department Superintendent Eddie Johnson that it was dropping charges against Smollett. Johnson had been vocal in public about his disgust with Smollett's evident attempt to fake a hate crime, wasting resources and diminishing real racism.
The full report also provides further detail about Foxx's false statements that Smollett had no prior criminal record - when, as the 12-page report said, "a prior misdemeanor conviction out of California from September 22, 2007 for DUI, driving without a license, and giving false information to the police, for which he was placed on 24 months of probation." The full 60-page report adds that false statements about Smollett's record were "particularly troubling" because his prior conviction "related, in part, to making a false statement to police," and was therefore similar to the present case in Chicago.
The newly-released report also delves into the question of Foxx's false statements to the public that the evidence was too weak to convict Smollett - after she had said the opposite just days before, confusing everyone and raising suspicions.
The full report does not explain why Foxx dropped charges against Smollett, even though it found that she lied about when she stopped talking to Smollett's family and continued to receive updates about the case after she had recused herself from it.

FBI investigation into threatening letter sent to 'Empire' actor Jussie Smollett remains a loose end
Jussie Smollett walked out of the Leighton Criminal Court Building on Tuesday free of 16 felony counts of falsely reporting he was attacked by two men hurling racist and homophobic slurs.
But a federal investigation remains a loose end hanging over the "Empire" actor.
A week before Smollett reported the attack, he told police he received a letter containing a death threat Jan. 22 at the Fox production studio at 1445 S. Rockwell St. Chicago police officers initially responded, but the FBI took over the investigation because it involved the U.S. Postal Service.
Chicago police Superintendent Eddie Johnson has said the letter is as phony as the attack, which he said Smollett staged when the letter got no publicity. But federal officials have yet to say anything publicly about the letter or possible charges.
Representatives of the FBI and the U.S. Postal Inspection Service declined to comment Wednesday on whether the investigation was continuing, which is routine.
The white envelope was addressed to Smollett in large, childish handwriting with "MAGA" written in the left corner, an apparent reference to President Donald Trump's "Make America Great Again" campaign slogan. Witnesses told police a postal worker dropped off the letter. It was postmarked in southwest suburban Bedford Park on Jan. 18, four days earlier, and bore two American flag stamps.
Smollett told police he and the show's executive producer used gloves to open the envelope. The letter inside depicted a message from letters cut out of a magazine, with a racist and homophobic death threat accompanied by a drawing. The letter contained white powder that was later determined to be crushed pain reliever.
A week later, on Jan. 29, Smollett reported he was attacked by two masked men who hit him, placed a noose around his neck and poured a liquid on him.
But within a month, Smollett was arrested and charged with paying two brothers to stage the attack. The brothers began cooperating after authorities picked them up at O'Hare International Airport on Feb. 13 as they returned from Nigeria.
Chicago Police Department case files released Wednesday in response to a Freedom of Information Act request indicate detectives asked the brothers about the letter during an interview at the South Loop Hotel on Feb. 18. "Both stated they had absolutely nothing to do with that letter," the report says. "Both were emphatic about the denial."
A federal agent assigned as a task force officer was also involved in the investigation, the case files indicate, though the Chicago Police Department often works with federal authorities in such cases.
The agent got copies of search warrants issued against Smollett, was present when the brothers were questioned and was at the police station when Smollett was arrested. The agent also helped to sneak the brothers into the criminal courthouse for a grand jury appearance.

Chen persuaded Kim Foxx to convince Chicago Police Superintendent Eddie Johnson to turn his investigation of to the FBI because the Smollett family was concerned about alleged 'false' leaks. Foxx obviously followed through, which would move the case to the Chicago FBI office.
