Middlesex County Man Admits Participation in Conspiracy to Illegally Export Firearms and Other Items to Ukraine
NEWARK, N.J. - An Edison, New Jersey, man today admitted that he conspired to export, without a license, firearms and other items subject to the export control list, U.S. Attorney Craig Carpenito announced.
Gene Shilman, 62, a native of the Soviet Union, pleaded guilty before U.S. District Court Judge Katharine S. Hayden in Newark federal court to an information charging him with one count of conspiracy to violate the Arms Export Control Act, the International Emergency Economic Powers Act, and the Export Control Reform Act.
According to documents filed in this case and statements made in court:
From May 2014 through October 2018, Shilman entered into a conspiracy that included a conspirator living in Ukraine. Shilman exported defense articles regulated by the Arms Export Control Act. He exported to Ukraine items that are on the commerce control list as well as items with both defense and civilian uses that are subject to the Export Control Reform Act. Shilman never obtained the required export license from the U.S. Department of Commerce.
Shilman ordered and received firearm components and parts, ammunition, night-vision goggles and bulletproof vests from various vendors and firearms dealers in the United States. He received numerous wire transfers from overseas locations to pay for the purchase of these items. Shilman repackaged and shipped these munitions to overseas locations without the required export licenses.
In September 2018, Shilman completed a Customs Declaration form at a U.S. Post Office in Middlesex County, New Jersey, on which he falsely represented that the contents of the parcel destined for Ukraine contained tools and cartridges. An inspection of the parcel revealed that it actually contained multiple upper receivers, ammunition magazines and threaded barrels for handguns and a set of front and rear sights for a handgun.
The conspiracy count with which Shilman is charged carries a maximum potential sentence of five years in prison.
U.S. Attorney Carpenito credited special agents of the FBI, under the direction of Special Agent in Charge Gregory W. Ehrie in Newark; and the U.S. Department of Commerce, under the direction of Special Agent in Charge Jonathan Carson, with the investigation leading to the arrests.
The government is represented by Assistant U.S. Attorney and Thomas S. Kearney of the U.S. Attorney's Office National Security Unit in Newark.

Attorney General William P. Barr on the Nomination of Jay Clayton to Serve as U.S. Attorney for the Southern District of New York
Attorney General William P. Barr has released the following statement:
"I am pleased to announce that President Trump intends to nominate Jay Clayton, currently the Chairman of the Securities and Exchange Commission, to serve as the next United States Attorney for the Southern District of New York. For the past three years, Jay has been an extraordinarily successful SEC Chairman, overseeing efforts to modernize regulation of the capital markets, protect Main Street investors, enhance American competitiveness, and address challenges ranging from cybersecurity issues to the COVID-19 pandemic. His management experience and expertise in financial regulation give him an ideal background to lead the United States Attorney's Office for the Southern District of New York, and he will be a worthy successor to the many historic figures who have held that post. On behalf of the President, I thank Jay for accepting this nomination, and I look forward to working with him soon.
On my recommendation, the President has appointed Craig Carpenito, currently the United States Attorney for the District of New Jersey, to serve as the Acting United States Attorney for the Southern District of New York, while the Senate is considering Jay Clayton's nomination. This appointment will be effective July 3, and Craig will work closely with the outgoing United States Attorney to ensure a smooth transition. I thank Craig for his continued service and for taking on this important interim responsibility.
Finally, I thank Geoffrey Berman, who is stepping down after two-and-a-half years of service as United States Attorney for the Southern District of New York. With tenacity and savvy, Geoff has done an excellent job leading one of our nation's most significant U.S. Attorney's Offices, achieving many successes on consequential civil and criminal matters. I appreciate his service to the Department of Justice and our nation, and I wish him well in the future."

Sudhan M. Thomas, 45, of Jersey City, New Jersey, was charged in a 26-count indictment with embezzling funds from JCETP, an organization receiving federal funds (Count 1), and wire fraud (Counts 2 to 6) and money laundering (Counts 7 to 9) in connection with the JCETP theft. In connection with other schemes, Thomas was charged with wire fraud for embezzling money from his 2016 JCBOED campaign (Count 10); wire fraud for embezzling money from his 2019 JCBOED campaign (Counts 11 and 12); bank fraud for stealing checks issued by and to another JCBOED candidate's campaign in 2018 (Counts 13 and 14); and mail and wire fraud for schemes to defraud two separate Florida companies (Counts 15 to 26). Thomas was charged by criminal complaint in January 2020 with embezzling funds from JCETP and was released on a $75,000 unsecured bond.
Paul H. Appel, 78, of Point Pleasant, New Jersey, also is charged as Thomas' accomplice in Counts 1, 7 to 10, and 15 to 26 of the indictment.

Approximately 1,875 pieces of mail - including 627 pieces of first class, 873 pieces of standard class, two pieces of certified mail, 99 general election ballots destined for residents in West Orange, and 276 campaign flyers from local candidates for West Orange Town Council and Board of Education - were recovered from dumpsters in North Arlington and West Orange on Oct. 2, 2020, and Oct. 5, 2020. The mail had been scheduled to be delivered on Sept. 28, Oct. 1, and Oct. 2, 2020, to addresses on certain postal routes in Orange and West Orange. On the delivery dates for which mail was recovered, Beauchene was the only mail carrier assigned to deliver mail to the addresses on the recovered mail.
The recovered mail was placed back into the mail stream for delivery to its intended recipients. Copies of the recovered mail were made and retained as evidence.
The delay of mail charge is punishable by a maximum penalty of five years in prison and a $250,000 fine. The obstruction of mail charge is punishable by a maximum penalty of six months in prison and a $5,000 fine.
U.S. Attorney Carpenito credited special agents of the USPS-Office of Inspector General, under the direction of Special Agent in Charge Matthew Modafferi, Northeast Area Field Office, with the investigation leading to today's arrest. He also thanked the North Arlington Police Department, under the direction of Scott Hedenberg, for their assistance.
The government is represented by Assistant U.S. Attorney Sara F. Merin of the Special Prosecutions Division in Newark.
The charge and allegations in the complaint are merely accusations, and the defendant is presumed innocent unless and until proven guilty.

For decades, federal prosecutors have been told not to mount election fraud investigations in the final months before an election for fear they could depress voter turnout or erode confidence in the results. Now, the Justice Department has lifted that prohibition weeks before the presidential election.
The move comes as President Donald Trump and Attorney General William Barr have promoted a false narrative that voter fraud is rampant, potentially undermining Americans' faith in the election.
A Justice Department lawyer in Washington said in a memo to prosecutors on Friday that they could investigate suspicions of election fraud before votes are tabulated. That reversed a decadeslong policy that largely forbade aggressively conducting such inquiries during campaigns to keep their existence from becoming public and possibly "chilling legitimate voting and campaign activities" or "interjecting the investigation itself as an issue" for voters.
The memo creates "an exception to the general noninterference with elections policy" for suspicions of election fraud, particularly misconduct by federal government workers, including postal workers or military employees; both groups transport mail-in ballots. The exception allows investigators to take overt investigative steps, like questioning witnesses, that were previously off limits in such inquiries until after election results were certified.
The move also allows prosecutors to make more of a spectacle of election fraud in the weeks before the vote on Nov. 3. The U.S. attorney in New Jersey, Craig Carpenito, promoted an arrest on Wednesday of a postal worker suspected of discarding mail, including dozens of ballots, which were found and put back in the mail.

NEW YORK - Audrey Strauss emerged as the next chief federal prosecutor in Manhattan after her former boss, Geoffrey Berman, agreed to leave the job Saturday, ending a confrontation with Attorney General William Barr. In a statement, Berman said he decided to step down because Barr reversed course on a plan to appoint an outsider as his immediate replacement and instead named Strauss acting U.S. attorney for the Southern District of New York.

Who is Strauss?
Strauss, 72, has been Berman's second-in-command since April 2019, but her history in the Manhattan U.S. attorney's Office stretches back more than four decades. A graduate of Barnard College and Columbia Law School, Strauss first became a Southern District federal prosecutor in 1976. She served in the office until 1983 and then worked in Washington as a staff lawyer in the independent counsel investigation into the Reagan-era Iran-Contra affair.
Before rejoining the Southern District in 2018, Strauss had a long career in the private sector, including stints as a partner at New York law firm Fried Frank Harris Shriver & Jacobson LLP and as chief legal and compliance officer at Alcoa Corp., where she oversaw the aluminum producer's $384 million settlement in 2014 of federal probes into whether it paid bribes to members of Bahrain's royal family and officials at a state-owned company. Strauss also previously served as a board member on the Innocence Project, a non-profit that seeks to exonerate wrongfully convicted prisoners.

The Southern District's leading role in prosecuting white-collar crime, terrorism, political corruption and organized crime is buttressed by its longstanding reputation for independence, such that it is frequently referred to as the "Sovereign District of New York." Barr's original plan to shuffle top New Jersey federal prosecutor Craig Carpenito into Berman's role raised alarm bells, but the choice of Strauss showed the attorney general would "respect the normal operation of law" and maintain the office's independence, Berman said. His predecessor, Preet Bharara - who was also fired after refusing to quit - likewise tweeted Saturday that the office will "continue the long tradition of integrity and independence" under Strauss.

The move was viewed as a win for SDNY, where prosecutors had become uneasy over the prospect of a new leader viewed as loyal to Barr.
Berman's 18-hour hold-out appeared to force Barr to walk back his initial plan to appoint Carpenito. It isn't clear why Barr changed course but his appointment of Strauss proved enough for Berman to step down.

In Portland, a would-be anarchist outside the Federal Courthouse allegedly attacked a Deputy U.S. Marshal with a large hammer, landing blows on the officer's neck and shouting expletives and as other deputies pulled him off. On the courthouse barricade were scribbled the letters, A.C.A.B. - an acronym for "all cops are bastards."
In Oakland, a violent extremist allegedly used a peaceful protest as cover to murder an FPS Officer stationed at the Federal Courthouse, firing at the officer and his partner before taking off.
In response to this type of violence, Attorney General Barr directed U.S. Attorney Craig Carpenito in the District of New Jersey and me to stand up a Task Force to Combat Violent Anti-Government Extremism.
Working in close collaboration with the FBI, the Task Force aims to investigate, prosecute extremists of all persuasions.
We will follow where the evidence leads us, investigating any person or group who plans to commit or commits violence in the name of anarchist ideology.
Our goal is to focus on cases where violent extremists commit federal crimes and to seek ways to disrupt these criminal acts before they harm Americans.
Of course, let me be very clear with this final point - adhering to repugnant ideologies is not a crime, nor is expressing those beliefs. The right to freedom of speech is enshrined in our First Amendment. But committing violence or inciting violence in order to further that dogma is a criminal act, and it's one that we should all take very seriously.

The complaint also alleges that video of the incident shows Lloyd as he breaks off and destroys the wheels of cannons located at the base of the statue. Lloyd is also captured on video pulling on ropes in an effort to topple the statue, and handing a hammer to an unidentified individual involved in the incident. Judd was arrested on Friday and appeared in Superior Court of the District of Columbia today... The remaining defendants have not yet been apprehended.

On Friday, President Donald Trump signed an executive order aimed at protecting federal monuments across the country.

Geoffrey S. Berman, the United States Attorney for the Southern District of New York, today announced the selection of Audrey Strauss as Senior Counsel to the US Attorney.
Ms. Strauss will return to the Office where she was an Assistant US Attorney for seven years, from 1976 to 1983, and tried more than twenty cases, eventually being promoted to the Chief of Appeals in the Criminal Division and later as Chief of the Securities and Commodities Fraud Unit. Ms. Strauss also served on the staff for the Independent Counsel for the Iran Contra matter. Following her public service, Ms. Strauss practiced at the firms of Fried Frank Harris & Jacobson, where she was a Litigation Partner from 1990 to 2012, and Mudge Rose Guthrie & Alexander, where she became a partner in 1986. Most recently, Ms. Strauss served as Vice President and Chief Legal Officer for Alcoa Inc. Ms. Strauss earned her Juris Doctor degree at Columbia Law School, where she was a Harlan Fiske Stone Scholar and a Kent Scholar. She received her Bachelor of Arts degree cum laude from Barnard College.
In making the appointment, Manhattan US Attorney Geoffrey S. Berman said: "I'm delighted to announce that Audrey Strauss will be (re)-joining us today in her new role as Senior Counsel to the US Attorney. Audrey's career has been notable for her commitment to the legal profession and the rule of law: she served as an Officer and Trustee of the Federal Bar Council, as a former President of the New York Council of Defense Lawyers, and as a board member of the Office of Appellate Defender. Most recently Audrey has served as a board member of the Innocence Project, a position she just left in order to come back to serve the Office. Audrey Strauss, deputy U.S. attorney for the Southern District of New York, who just in the past year took over the office's investigations into President Donald Trump's business and campaign finances, will now serve as the top prosecutor following the sudden firing of U.S. Attorney Geoffrey Berman.

Attorney General William P. Barr has released the following statement:
"I am pleased to announce that President Trump intends to nominate Jay Clayton, currently the Chairman of the Securities and Exchange Commission, to serve as the next United States Attorney for the Southern District of New York. For the past three years, Jay has been an extraordinarily successful SEC Chairman, overseeing efforts to modernize regulation of the capital markets, protect Main Street investors, enhance American competitiveness, and address challenges ranging from cybersecurity issues to the COVID-19 pandemic. His management experience and expertise in financial regulation give him an ideal background to lead the United States Attorney's Office for the Southern District of New York, and he will be a worthy successor to the many historic figures who have held that post. On behalf of the President, I thank Jay for accepting this nomination, and I look forward to working with him soon.
On my recommendation, the President has appointed Craig Carpenito, currently the United States Attorney for the District of New Jersey, to serve as the Acting United States Attorney for the Southern District of New York, while the Senate is considering Jay Clayton's nomination. This appointment will be effective July 3, and Craig will work closely with the outgoing United States Attorney to ensure a smooth transition. I thank Craig for his continued service and for taking on this important interim responsibility.

Ma claimed that he had hundreds of employees when the charges say he had only himself as an employee. Berman said: "Small businesses are facing uncertainty and unprecedented challenges, the least of which should be opportunists attempting to loot the federal funds meant to assist them."[82]
On May 22, 2020, Berman announced fraud charges against movie producer William Sadleir, who founded Aviron Pictures. He was charged with siphoning off more than $20 million from his production company and putting more than $14 million of it into his mansion. He is also charged with lying to his investor, a New York based fund. Berman stated: "Thanks to the dedicated work of our law-enforcement partners at the FBI, Sadleir will be held accountable for his behind-the-scenes misdeeds."[83]
On June 12, 2020, Berman announced the unsealing of a complaint against Inigo Philbrick, an art dealer with galleries in London and Miami, charged with defrauding client of over $20 million. Berman stayed: "You can't sell more than 100 percent ownership in a single piece of art, which Philbrick allegedly did, among other scams. When his schemes began to unravel, Philbrick allegedly fled the country. Now he is in U.S custody and facing justice."[84][85]
On June 19, 2020, Attorney General William Barr announced that Berman would step down from his position. The U.S. attorney for the Southern District of New York pushed back Friday night against reports that he was resigning from the position.
Geoffrey Berman, who oversaw prosecutions of allies of President Donald Trump as well as a probe of Trump's personal lawyer Rudy Giuliani said he learned he was stepping down when he read a press release about it, The Associated Press reported.
Reacting to the news of his departure, Berman said he would not be leaving right away.

"I will step down when a presidentially appointed nominee is confirmed by the Senate. Until then, our investigations will move forward without delay or interruption," Berman said in a statement.
The earlier report that Berman was resigning came in a statement from Attorney General William Barr, the AP reported.
The attorney general said President Trump intends to nominate Jay Clayton, chairman of the Securities and Exchange Commission, to replace Berman, with the U.S. attorney in New Jersey, Craig Carpenito, serving on an acting basis beginning July 3.
Berman has been in the position for more than two years. Barr's announcement late Friday, came after he visited New York City and met with local police officials there.
Preet Bharara, who served in the New York position prior to Berman, disputed Barr's claim that Berman had resigned.
"Doesn't sound like 'stepping down,'" Bharara wrote on Twitter. "Why does a president get rid of his own hand-picked US Attorney in SDNY on a Friday night, less than 5 months before the election?"
Katherine Flaunders, a reporter with ABC News, wrote on Twitter that Barr had offered Berman other jobs, including head of the Civil Division at the Justice Department, but Berman declined the offers.
The report of Berman's ouster was likely to raise additional questions from congressional Democrats who have accused Barr of politicizing the Justice Department and acting more like Trump's personal attorney rather than the nation's chief law enforcement officer.
The news comes just days after former national security adviser John Bolton claimed in his tell-all book that Trump promised Turkish President Recep Tayyip Erdogan he'd interfere in Halkbank case that was being prosecuted in the Southern District.
The office has prosecuted a number of Trump associates, including Trump's former personal lawyer and fixer Michael Cohen, who served a prison sentence for lying to Congress and campaign finance crimes, and has also been investigating Giuliani and his associates.
Federal prosecutors in New York are investigating Giuliani's business dealings, including whether he failed to register as a foreign agent, according to people familiar with the probe. The people were not authorized to discuss the investigation publicly and spoke on the condition of anonymity.
Berman, a Republican who contributed to the president's election campaign, worked for the same law firm as Giuliani and was put in his job by the Trump administration. But as U.S. attorney, he won over some skeptics after he went after Trump allies.
He had recused himself from directly overseeing the Cohen investigation for reasons that were never disclosed.
Berman was appointed by then-Attorney General Jeff Sessions in January 2018, months after Bharara was fired after refusing to resign along with dozens of other federal prosecutors appointed by President Barack Obama.
Three months later, FBI agents raided Cohen's offices, an act the president decried as a politically motivated witch hunt.
Berman has taken a direct hand in other investigations that have angered Trump.
His office subpoenaed Trump's inaugural committee for a wide range of documents as part of an investigation into various potential crimes, including possible illegal contributions from foreigners to inaugural events.
And weeks before the 2018 midterm election, Berman announced insider trading charges against an ardent Trump supporter, Republican Rep. Chris Collins.
Collins, who represented western New York, has since resigned.

President Donald Trump has fired Geoffrey Berman as the U.S. attorney for the Southern District of New York, sources familiar with the decision told ABC News. The surprise move comes two years into a tenure that included the prosecution of Michael Cohen, Jeffrey Epstein and two associates of Rudy Giuliani.
The decision was delivered personally by U.S. Attorney General William Barr, who a Justice Department official told ABC News offered Berman other positions, including head of the Civil Division at Main Justice. He declined the offer and was subsequently fired and Craig Carpenito, the U.S. attorney in New Jersey, was named to lead the office on an interim basis.
Berman issued a statement late Friday saying he had no intention of taking the firing in stride. "I learned in a press release from the Attorney General tonight that I was 'stepping down' as United States Attorney," he said. "I have not resigned, and have no intention of resigning, my position, to which I was appointed by the Judges of the United States District Court for the Southern District of New York. Trump intends to nominate Jay Clayton of the Securities and Exchange Commission to replace Berman.
"The attorney general has known Jay Clayton for years and holds him in high regard," a Justice Department official told ABC News. "Jay was getting ready to leave the administration and go back to New York. He expressed interest in SDNY. The attorney general thought it was a good idea. He offered Berman other positions, including head of the Civil Division at Main Justice. Berman declined. That's that."
Berman's tenure included several politically sensitive investigations, like the case against Trump's former personal attorney, Cohen. He was named the interim replacement for former U.S. attorney Preet Bharara in 2018 by then-Attorney General Jeff Sessions.
Trump failed to nominate him or any other permanent replacement and, after 120 days, the district court appointed Berman to the job. By law, Berman serves until the vacancy is filled.
In refusing to go quietly, Berman declared the office's investigations continue unabated. That would include the investigation into the president's personal lawyer, Rudy Giuliani. Berman's office is believed to still be actively investigating the president's personal attorney, Giuliani, related to his contacts with Lev Parnas and Igor Fruman – two central characters in the Ukraine impeachment scandal.

Larsen, Special Agent-in-Charge, Internal Revenue Service Criminal Investigation, New York Field Office (IRS-CI), announced the charges.
On March 18, 2020, in response to the COVID-19 pandemic, President Donald Trump issued Executive Order 13909 invoking the Defense Production Act making it illegal to acquire medical supplies and devices designated by the Secretary of Health and Human Services (HHS) as scarce in order to hoard them or sell them for excessive prices.
According to court filings, between March 2020 and April 2020, Bulloch and Young sought out potential investors to sell one million KN95 respirator masks for double or triple the purchase price. To conceal their exorbitant markup on the masks, Bulloch created and signed an escrow agreement for a purported investor that falsely stated that the profits on the re-sale of the masks would not exceed 10 percent. Unbeknownst to the defendants, the purported investor was a federal law enforcement agent.
"As alleged, the defendants conspired to turn a huge profit from the urgent need for surgical masks in New York during the pandemic," stated United States Attorney Donoghue. "When the Attorney General said that those engaged in price gouging should expect a knock on the door, he meant it and when we knock with one hand, we usually have a warrant in the other." NEWARK, N.J. - A Union County, New Jersey, man was charged today with allegedly filing a false tax return for tax year 2013, U.S. Attorney Craig Carpenito announced.
Anthony Salters, 57, of Hillside, New Jersey, is charged by complaint with subscribing to a false tax return. A summons was issued for Salters to appear in Newark federal court at a time to be scheduled by U.S. Magistrate Judge Leda Dunn Wettre.
According to documents filed in this case and statements made in court:
Salters was a principal of Media Allies LLC, a company that purportedly provided public relations services. On Feb. 12, 2014, Salters signed, filed, and caused to be filed with the IRS a U.S. Individual Income Tax Return, Form 1040, for tax year 2013, which contained a written declaration that it was filed under penalty of perjury and which falsely stated that Salters' business income was zero and his total income was zero.

Pentax Medical Company Agrees to Pay $43 Million to Resolve Criminal Investigation Concerning Misbranded Endoscopes
Company Shipped Medical Devices Without Approved Instructions for Use and Failed to File FDA-Required Adverse Event Reports of Serious Infections
Pentax Medical Company will pay $43 million to resolve criminal charges based on the company's shipment of four types of endoscopes for 18 months without FDA-cleared instructions for use and the company's failure to file timely reports of two infections associated with its endoscopes, the Department of Justice announced today.
Pentax was charged in a criminal complaint filed today in Newark federal court with distributing misbranded medical devices in interstate commerce in violation of the Federal Food, Drug, and Cosmetic Act (FDCA). Pentax has entered into a three-year deferred. As a result of the conduct outlined in the criminal complaint, Pentax has agreed to pay a $40 million criminal fine and to forfeit $3 million.
-"In carrying out its responsibilities to protect the health and safety of patients treated with medical devices, the FDA relies on manufacturers to provide health care professionals with the correct, approved or cleared instructions for safe use of the devices, and to report promptly to the FDA potential product safety issues," said Assistant Attorney General Jody Hunt of the Department of Justice's Civil Division.
-"Pentax made a decision to ignore the cleared instructions for use of its endoscopes, believing that doing so would increase its sales, putting profits over patient safety," said U.S. Attorney Craig Carpenito for the District of New Jersey. "In doing so, and by failing to report to the FDA certain adverse events relating to those endoscopes, it broke the law, jeopardized the health of patients, and, ultimately, cost itself $43 million on fines and forfeiture."
-The criminal complaint against Pentax, which Pentax agrees is true, charges that Pentax made a deliberate business decision not to use revised FDA-cleared instructions for cleaning its endoscopes because Pentax feared the new instructions would cause it to lose business. Endoscopes are reusable devices that must be cleaned after each use or else infectious material may remain and be transmitted to subsequent patients. In 2014, the FDA told Pentax to revise its existing cleaning instructions for four types of endoscopes and add cleaning steps. Pentax agreed, and FDA cleared, revised cleaning instructions in April 2014. Pentax was then required to include these revised cleaning instructions when it shipped those four endoscopes.
-Instead, for the next 18 months, Pentax shipped the four types of endoscopes with the old instructions for use - not the newly enhanced, FDA-cleared cleaning instructions. Pentax decided not to use the enhanced cleaning instructions because they required customers to spend more time cleaning the endoscopes. One internal email warned that the increase of cleaning time from five minutes to 25 minutes would be "catastrophic," and another predicted that customers "will be very upset and could switch away from PENTAX because of the extra time, manpower, and cost to perform the new protocol."
-Pentax continued shipping the four types of endoscopes without the FDA-cleared cleaning instructions until September 2015. At that time, Pentax started including FDA-cleared instructions for two of the endoscopes and newly validated cleaning instructions for the other two types of endoscopes. Pentax made $18 million in gross profits from selling the four types endoscopes during this 18-month period.
-Pentax was also charged with and admitted failing to file timely reports of two infection incidents associated with its endoscope. To enable FDA and others to identify and monitor adverse events, the FDCA requires medical device manufacturers to file adverse event reports - known as Medical Device Reports (MDRs) - within 30 days of becoming aware of information that reasonably suggests that the manufacturer's device may have caused or contributed to a death or serious injury.
-In June 2013, Pentax learned that four patients at Advocate Lutheran General Hospital in Chicago were infected with drug-resistant bacteria after being treated with the same Pentax endoscope. Pentax failed to file MDRs within 30 days because its employees did not understand the reporting requirements.
-In late June 2014, Pentax learned that four patients at Massachusetts General Hospital in Boston were infected with Escherichia coli bacteria

Baruch Feldheim, 43, was arrested on Monday for allegedly hoarding desperately needed medical supplies including 80,000 N95 masks which he was selling at a 700% markup.
When the FBI came to arrest him, he coughed on them and claimed he had the coronavirus.
According to a Department of Justice press release, Feldheim was hoarding enough medical supplies "to outfit an entire hospital."

NEWARK, N.J. - A Brooklyn man was arrested today for allegedly coughing on FBI agents while claiming to have COVID-19, and with lying to them about his accumulation and sale of surgical masks, medical gowns, and other medical supplies, U.S. Attorney Craig Carpenito announced.
Baruch Feldheim, 43, was arrested by special agents of the FBI today and charged by complaint with assaulting a federal officer and with making false statements to law enforcement. Feldheim is scheduled to have his initial appearance this afternoon before U.S. Magistrate Judge Michael A. Hammer in Newark federal court.
According to documents filed in this case and statements made in court:
On March 25, 2020, the Department of Health and Human Services issued an executive order designating certain scarce health and medical resources necessary to respond to the spread of the Coronavirus. Those designated materials included N95 filtering face-piece respirators, personal protection equipment (PPE) face masks, surgical masks, sterilization services, and disinfecting devices, among other things.
Feldheim allegedly sold certain designated materials, including N95 respirators, to doctors and nurses at inflated prices. In one instance, on March 18, 2020, a doctor in New Jersey contacted Feldheim via a WhatsApp chat group labeled "Virus2020!" Feldheim agreed to sell to the doctor approximately 1,000 N95 masks and other assorted materials for $12,000, an approximately 700 percent markup from the normal price charged for those materials. Feldheim directed the doctor to an auto repair shop in Irvington, New Jersey, to pick up the order. According to the doctor, the repair shop contained enough materials, including hand sanitizers, Clorox wipes, chemical cleaning supply agents, and surgical supplies, to outfit an entire hospital. Feldheim later told the doctor that he had been forced to move all of those supplies from Irvington to another location.
On March 23, 2020, Feldheim allegedly offered to sell a nurse a quantity of surgical gowns and directed the nurse to his residence in Brooklyn. Feldheim also received, on March 25, 2020, a shipment from Canada containing approximately eight pallets of medical facemasks. On March 27, 2020, FBI agents observed an empty box of N95 masks outside of Feldheim's residence.

'Greater acts of mayhem': Bomb in van of Jersey City shooters could have killed people five football fields away
The two people who attacked a kosher market in Jersey City, New Jersey, had a bomb in their U-Haul van so powerful that it could have killed or injured people up to 500 yards away. FBI special agent in charge Greg Ehrie said at a Monday press conference that the bomb discovered inside the vehicle would have resulted in a large explosion. He also said that the duo had enough bomb construction materials to have built a second explosive device, according to NJ.com.
The gunmen, 47-year-old David Anderson and 50-year-old Francine Graham, were killed during a shootout with law enforcement on Dec. 10. The violence that day began when the two fatally shot Jersey City Police Department Detective Joseph Seals, 40, in the head. From there, the pair headed to a nearby kosher market and killed three civilians. Once the scene was cleared, investigators found the U-Haul van that the couple was in possession of and discovered an unexploded but viable homemade explosive device. "I do this because my creator makes me do this and I hate who he hates," read a note that was found along with the bomb.
The ideology of Anderson and Graham was partially inspired by the Black Hebrew Israelite movement, the members of which believe that they are the true decedents of the ancient Israelites and God's chosen people, not practitioners of Judaism. Despite the connection or possible inspiration, authorities believe the two worked alone in the attack. The Southern Poverty Law Center said of the religion that "there is a rising extremist sector within the Hebrew Israelite movement whose adherents believe that Jews are devilish impostors and who openly condemn whites as evil personified, deserving only death or slavery."
Prior to the Jersey City attack, Anderson and Graham had also researched attacking a Jewish community center in Bayonne, New Jersey. Authorities on Monday said that the two planned for more bloodshed in hopes of sowing fear in the Jewish community. U.S. Attorney Craig Carpenito called the attack "profoundly un-American" and an "evil and cowardly act." "We know now that they planned greater acts of mayhem on both communities," he said. According to Carpenito, video from the kosher market recorded Anderson saying, "They stole our heritage, they stole our birthright, and they hired these guys to stop us."
Authorities also said that the duo were suspects in two other crimes prior to the Jersey City attack. The first was when they fired two bullets at a Jewish person driving a vehicle near Newark. Although the back window of the car was shot out, no one was injured in the attack. They are also accused of killing taxi driver Michael Rumberger on Dec. 7. Investigators said they bludgeoned him and then shot him in the head, leaving his body in the trunk of his car. Rumberger's blood was discovered on a bible belonging to Anderson and Graham.
The two had traveled to Ohio, and Graham legally purchased the weapons used during the kosher market attack. While there, they also trained on how to use the guns, although Anderson had previously served in the Army Reserve. Anderson was not able to purchase the weapons because he is a convicted felon who has spent time in prison on multiple gun charges. The FBI is investigating the shooting as an act of domestic terrorism.

The U.S. attorney in New Jersey and the head of the local FBI said Monday that the bomb found in the van of alleged domestic terrorists Francine Graham and David Anderson could have killed or maimed people up to five football fields away.
They also said there was enough material in the van to make a second bomb.
Four innocent people, including a veteran Jersey City police detective and father of five, died in the hail of prolonged gunfire. Most of the victims were found inside the JC Koshoper Supermarket on Martin Luther King Boulevard during what officials have described as a hate-fueled terror spree on Dec. 10.
The officer who died, Det. Joseph Seals, was killed at a cemetery, where authorities said he had gone to meet with a man to talk about the return of a vehicle impounded by police. Details will never be definitive, authoritis said, but investigators believe Seals approached the suspects' van because cops were looking for it in connection with the murder of a livery driver the prior weekend. Cops are still looking into a possible connection between the driver's death and the terror that was unleashed in Jersey City on Dec. 10.
Seals' death first brought law enforcement near the scene of what would become a horrific bloodbath, leaving schools with bullet-riddled windows and the neighborhood locked down.
U.S. Attorney Craig Carpenito said of Seals, "We believe he threw off a broader plan," and that his actions "probably saved dozens if not more lives."

Chinese National Sentenced to Over Three Years in Prison for Trafficking Counterfeit Apple Goods into the United States
A Chinese national living in the United States on a student visa was sentenced today to 37 months in prison followed by one year of supervised release for his role in a scheme to traffic and smuggle counterfeit Apple products, including phony iPhones and iPads, from China into the United States.

Jianhua "Jeff" Li, 44, previously pleaded guilty before U.S. District Judge Kevin McNulty of the District of New Jersey, to one count of conspiracy to traffic in counterfeit goods and labels and smuggle goods into the United States and one count of trafficking in counterfeit goods. Judge McNulty imposed the sentence today in Newark federal court.
According to documents filed in this case and statements made in court, from July 2009 through February 2014, Li, working through his company Dream Digitals, conspired with Andreina Becerra, Roberto Volpe, Rosario LaMarca and others to smuggle and traffic into the United States from China more than 40,000 electronic devices and accessories, including iPads and iPhones, along with labels and packaging bearing counterfeit Apple trademarks.
Li shipped the devices separately from the labels to avoid detection by U.S. Customs and Border Protection officials. The devices were then shipped to conspirators all over the United States. Proceeds were funneled back to conspirator accounts in Florida and New Jersey via structured cash deposits and then a portion was transferred to conspirators in Italy, further disguising the source of the funds. Over $1.1 million in sales proceeds were wired from U.S. accounts into accounts Li controlled overseas.
LaMarca, Becerra, and Volpe previously pleaded guilty to their respective roles in the scheme. LaMarca was sentenced July 21, 2017, to serve 37 months in prison. Becerra and Volpe were sentenced Oct. 15, 2018, to serve three years' probation and 22 months in prison, respectively.
The HSI Newark Seaport Investigations Group and the Bergen County Prosecutor's Financial Crimes Unit investigated the case with significant assistance from HSI Attaché Rome, Europol and Italy's Guardia di Finanza.

NEWARK-An Atlantic County, New Jersey, man who was previously employed by the N.J. Department of Child Protection and Permanency (NJDCP&P) was charged today for allegedly receiving, distributing and producing images of child sexual abuse, U.S. Attorney Craig Carpenito announced.
Kayan Frazier, 27, of Somers Point, New Jersey, is charged by complaint with one count of producing visual depictions of a child engaged in sexually explicit conduct, one count of receipt of child pornography and one count of distribution of child pornography. Frazier is expected to appear this afternoon before U.S. Magistrate Judge Karen M. Williams in Camden federal court.

After receiving a report of images of child sexual abuse distributed via Tumblr, law enforcement officers identified Frazier, who was then employed as a case worker at NJDCP&P, as the sender. On April 12, 2019, the Atlantic County Prosecutor's Office obtained a search warrant for Frazier's residence and, while executing the warrant, observed Frazier in the company of a minor. Law enforcement officers recovered thousands of additional images of child pornography on Frazier's cellular telephone and other electronic media, which included images of the minor at his residence.
Frazier was arrested on April 15, 2019, by the Atlantic County Prosecutor's Office and charged with child endangerment, and has been detained without bail.
The receipt and distribution of child pornography offenses each carry a mandatory minimum sentence of five years in prison, a maximum potential penalty of 20 years in prison, and a $250,000 fine. The production of child pornography carries a mandatory minimum sentence of 15 years in prison, a maximum potential penalty of 30 years in prison, and a $250,000 fine.
U.S. Attorney Carpenito credited special agents of FBI, Atlantic City Resident Agency, under the direction of Special Agent in Charge Gregory W. The United States had imposed sanctions on the company in 2009 for allegedly providing U.S.-dollar financial services for North Korean companies involved in the export of ballistic missiles and conventional weapons, the indictment said. The four defendants also established front companies to conduct sales transactions on behalf of KKBC. Prosecutors said that between December 2009 and September 2015, the defendants established the front companies in jurisdictions such as the British Virgin Islands, the Seychelles, Hong Kong, Wales, England, and Anguilla. They also opened Chinese bank accounts held in the names of the front companies at banks in China that maintained correspondent accounts in the United States, the indictment said. These front companies facilitated financial transactions for KKBC, thus hiding the sanctioned bank's involvement from the U.S. banking system-including, in one case, from a bank processing center in Newark, New Jersey. According to the indictment, the defendants, through the front companies, purchased sugar and fertilizer for the benefit of KKBC. The sales transactions were allegedly financed or guaranteed by the North Korean bank.
The U.S. Department of Treasury's Office of Foreign Assets Control imposed sanctions on Dandong Hongxiang when federal charges were first announced in September 2016, the first time Washington had taken such a step against a Chinese company. U.S. charges ex-CEO of cryptocurrency company Longfin with $66 million fraud
NEW YORK (Reuters) - U.S. prosecutors said on Wednesday the former chief executive of Longfin Corp has been indicted for engineering an accounting fraud that inflated the revenue of the now-defunct cryptocurrency company by more than $66 million.
The securities fraud charge against Venkata Meenavalli, 49, of India, was announced 18 months after Longfin shares went on a roller-coaster ride as cryptocurrencies were coming into fashion, rising more than 13-fold over a few days and briefly making the company worth more than $3 billion.
Prosecutors said Meenavalli generated fraudulent documents that caused Longfin to report as revenue millions of dollars of commodities "transactions" that were actually "sham, round-trip events" between the company and entities he controlled.
U.S. Attorney Craig Carpenito in New Jersey said the more than $66 million of revenue should never have been recognized, and made Longfin shares look more attractive to investors.
Longfin, which was based in New York and had offices in Lyndhurst, New Jersey, shut down last November.
Meenavalli could not immediately be reached for comment, and a lawyer for him could not immediately be identified.
A default judgment was entered in January against Meenavalli in a related U.S. Securities and Exchange Commission civil case filed in April 2018 against him, Longfin and three associates.
In that case, the SEC won a court order freezing $27 million of trading proceeds after accusing Veenamalli of arranging the issuance of Longfin shares to Andy Altahawi, Dorababu Penumarthi and Suresh Tammineedi, which were sold after the stock soared.
The SEC said those three defendants agreed to settle.
It said Altahawi will pay a $2.9 million fine, return $21 million of alleged wrongful gains, and accept a five-year public company officer and director ban, and Penumarthi and Tammineedi will pay more than $1.7 million and $241,000, respectively. None of those defendants admitted or denied wrongdoing.

Maile also possessed additional images of child sexual abuse in New Jersey at the time of his arrest.

Instead, Dropala sold in excess of 100 false OSHA 10 cards for approximately $200 per card.
The count to which Dropala pleaded guilty carries a maximum potential penalty of five years in prison and a $250,000 fine. Sentencing is scheduled for July 2, 2019.

Two Ukrainian men have been charged for their roles in a large-scale, international conspiracy to hack into the Securities and Exchange Commission's (SEC) computer systems and profit by trading on critical information they stole.
In a 16-count indictment unsealed today in the District of New Jersey, Artem Radchenko, 27, and Oleksandr Ieremenko, 26, both of Kiev, Ukraine, are charged with securities fraud conspiracy, wire fraud conspiracy, computer fraud conspiracy, wire fraud, and computer fraud. The SEC also filed a civil complaint today charging Ieremenko along with several other individuals and entities.
The indictment alleges that Radchenko and Ieremenko hacked into the SEC's Electronic Data Gathering, Analysis and Retrieval (EDGAR) system and stole thousands of files, including annual and quarterly earnings reports containing confidential, non-public, financial information, which publicly traded companies are required to disclose to the SEC. The defendants and others then profited by selling access to the confidential information in these reports and trading on this stolen information prior to its distribution to the investing public.
"The defendants allegedly orchestrated sophisticated computer intrusions to steal non-public information from the SEC, compromising the integrity of the market and depriving honest investors of a level playing field," said Assistant Attorney General Benczkowski. "The Department of Justice will aggressively pursue and prosecute those who attack our financial markets and seek to profit unfairly, no matter where such offenders reside."

NEWARK, N.J. - A music teacher and singer/songwriter who performed for children at synagogues, Jewish community centers, camps and conventions nationwide was sentenced today to 82 months in prison for receiving images of child sexual abuse, U.S. Attorney Craig Carpenito announced.
Eric S. Komar, 47, of Hillsborough, New Jersey, previously pleaded guilty before U.S. District Judge William J. Martini to an information charging him with one count of receiving child pornography. Judge Martini imposed the sentence today in Newark federal court.

There are a total of 93 U.S. Attorneys in the Department of Justice. As of 12 April 2018, 65 were nominated and 60 confirmed by the Senate. Last week, another three were confirmed (California, Central District; Hawaii; and Missouri, Western District) for a total of 63. In comparison to prior presidents, the number confirmed after 15 months in office: Reagan (71 after 1 year), Clinton (81), Bush (75), and Obama (51). Trump has done better than Obama but is underperforming the others.
Interim (with approval of district court) and acting US Attorneys can serve indefinitely until someone is approved by the Senate. Once confirmed, the person is limited to a four-year term. Some interim and acting appointees are nominated while others are not. Trump has not submitted nominees yet for the 28 districts below.
Interestingly, Rodriguez-Velez of Puerto Rico has been interim for over 10 years and Myers of North Dakota has been acting/interim for 3 years. Maybe there is something special about these two or the others listed causing the nomination submission slow roll. According to one article, eight of the top ten states with public corruption convictions are here. Sessions broke with long-standing tradition of appointing a Texan as head prosecutor for Nevada and a North Carolian as head prosecutor for U.S. Virgin Islands. Both of those have pretty bad crime problems.
