Democrats Renew Push For Cryptocurrency Regulations, Target Company That Serves As Both Exchange And Bank'

Democratic lawmakers on Monday called upon regulators to examine bank holding company SoFi Technologies, which owns a subsidiary cryptocurrency exchange.
Skepticism of the financial services company occurs after cryptocurrency platform FTX filed for bankruptcy following users' discovery that trading firm Alameda Research borrowed millions in deposits to make investments, causing a liquidity crisis. Former FTX CEO Sam Bankman-Fried controlled both companies and allowed ex-girlfriend Caroline Ellison to lead the latter.
Sen. Sherrod Brown (D-OH), Sen. Jack Reed (D-RI), Sen. Chris Van Hollen (D-MD), and Sen. Tina Smith (D-MN), all of whom sit on the Senate Banking Committee, requested that SoFi CEO Anthony Noto provide information regarding compliance with banking law and determinations on appropriate levels of exposure to digital assets.
"Over the past year, several meltdowns in the crypto market have wiped out trillions in value, including another huge crash last week," the lawmakers said in a letter to Noto. "We are concerned that SoFi's continued nonbank digital asset trading activities pose risks to consumers and safety and soundness risks to your institution."
The Federal Reserve granted SoFi permission to operate as a national bank at the beginning of this year, noting that the company's cryptocurrency unit must be divested or brought into compliance within two years of the approval. "We are concerned that SoFi's continued impermissible digital asset activities demonstrate a failure to take seriously its regulatory commitments and to adhere to its obligations," the lawmakers added.
Bankman-Fried, whose considerable fortune disappeared overnight as the company filed for bankruptcy, is reportedly seeking $8 billion from investors to cover withdrawal requests made by customers. FTX CEO John Ray III, an attorney overseeing the company's bankruptcy proceedings who formerly represented plaintiffs harmed by the collapse of Enron, remarked in a court filing last week that he had never "seen such a complete failure of corporate controls and such a complete absence of trustworthy financial information."
The four lawmakers sent a second letter to leadership of the Federal Reserve, Federal Deposit Insurance Corporation, and Office of the Comptroller of the Currency, requesting that officials continue to "monitor" SoFi and other organizations engaged in cryptocurrency activities.
"As we saw with the crypto meltdown this summer, where crypto-assets lost over $1 trillion in value in a matter of weeks, contagion in the banking system was limited because of regulatory guardrails," the letter said. "In the event of crypto-related exposures at SoFi Digital Assets ultimately require its parent company, bank holding company, or affiliated national bank to seek emergency liquidity or other financial assistance ... taxpayers may be on the hook. Your agencies have publicly acknowledged these types of crypto-related risks."
The House Financial Services Committee is preparing to host hearings regarding the collapse of FTX next month as the Justice Department and the Securities and Exchange Commission prepare their own investigations. Beyond members of Congress, officials in the Biden administration have revealed a willingness to implement more regulations on cryptocurrencies. Treasury Secretary Janet Yellen said during an interview with CBS News that cryptocurrencies require "appropriate supervision and regulation," adding that the administration has identified "regulatory holes that need to be filled for this to be a space where Americans can feel safe doing business."

Shares in the short messaging service have slumped after it reported sluggish revenue and user growth that led to a widening net loss in the fourth quarter despite the new US president's extensive use of it.

In morning trading at Wall Street in New York on Thursday, Twitter shares tumbled more than nine percent as investor hopes are fading for a rebound in growth at the messaging platform.
Twitter reported a net loss in the fourth quarter of $167 million (156.3 million euros), after a $90-million shortfall in the same period a year ago. Revenue in the quarter rose a modest one percent to $717 million.
Moreover, in the closely-watched area of user growth, Twitter ended 2016 with 319 million monthly active users, a gain of four percent from a year ago and only two million more than the prior quarter.
Advertising revenue was down slightly from a year ago at $638 million, with revenue in the important US market falling five percent. For the full year of 2016, Twitter lost $456 million on revenues of $2.5 billion.
Growing impact?
Despite the unimpressive result, Twitter CEO Jack Dorsey remained upbeat about the company's long-term prospects, claiming "the whole world is watching Twitter."
"While we may not be meeting everyone's growth expectations, there's one thing that continues to grow and outpace our peers: Twitter's influence and impact," he said in a statement, adding that the social media network carried the world's "most important commentary and conversations" mobilizing people into action.
However, Twitter has never reported a profit so far, which is why it is eager to revamp its offerings and expand beyond its core base of politicians, celebrities and journalists.
Some analysts had expected a rise in Twitter use following the election of Donald Trump, who is an avid user of the platform and frequently uses it to offer his views on policy.
Outlook improving
Twitter's daily active usage grew for the third consecutive quarter, overcoming declining audience described by CEO Dorsey as "the toughest challenge for any consumer service at scale."
The company is now aiming to become profitable in 2017. "We're hearing positive feedback from our ad partners about our continued acceleration in audience growth and engagement," said chief operating officer Anthony Noto. Revenue growth would, however, continue to lag audience growth, he added, due to the sales cycle, and could be further impacted by the "escalating competition for digital advertising spending."
In a research note, Richard Greenfield of BTIG research firm said he saw positive signs of growing user engagement on Twitter because the service had been "thrust into the global Zeitgeist" after the US presidential election.
"Not only is President Trump actively using Twitter to communicate directly with the American people, his tweets are impacting consumers all around the world," he added. Therefore, Greenfield believes that Twitter's results may improve in the course of next year.

Twatter Announces Departure of COO, Anthony Noto
SAN FRANCISCO, Jan. 23, 2018 /PRNewswire/ – Twatter, Inc. (NYSE: TWTR) today announced that Anthony Noto notified the company on January 22, 2018 that he is resigning from his position as Twatter's Chief Operating Officer in order to accept the chief executive officer role at another company.
Noto's responsibilities for the company's business operations and revenue generating operations will be assumed by other members of Twatter's leadership team. Matt Derella, Twatter's Vice President of Global Revenue and Operations, will continue to lead the company's advertising sales efforts.

SAN FRANCISCO - The embattled online lender Social Finance has poached Twitter's chief operating officer, Anthony Noto, to be its new chief executive, dealing a blow to Twitter's turnaround campaign.
Social Finance, known as SoFi, announced Mr. Noto's hiring on Tuesday, just four months after Mike Cagney was forced to step down as its chief executive because of sexual harassment claims. Mr. Cagney was accused in a lawsuit of having had inappropriate relationships with company employees and questioned over whether he had skirted risk and compliance controls.
In Mr. Noto, SoFi has chosen a fast-rising executive in the tech industry. Mr. Noto, 49, was one of the most respected bankers at Goldman Sachs before becoming the chief financial officer of the National Football League and then Twitter.

Twitter in $810 Million Settlement of Shareholder Suit on Growth
Twitter Inc. agreed to pay $809.5 million to settle a shareholder class action lawsuit that accused the social media company of painting an overly rosy picture of its future.
The suit, originally filed by Twitter shareholder Doris Shenwick, claimed executives misled investors over the company's growth prospects in November 2014, promising an increase in monthly active users to 550 million in the "intermediate" term and more than a billion in the "longer term." The company failed to deliver on either estimate and concealed that it had no basis for those projections, according to the complaint. The suit was filed in federal court in San Francisco in 2016, the year after the company's stock took a nose dive after executives revealed the platform's sluggish growth. After five years of litigation, the case had come down to three allegedly misleading statements made by Twitter executives concerning the growth of the platform. A trial set for Monday was postponed Friday ahead of the settlement.
The proposed settlement concludes without any admission of fault or wrongdoing by Twitter, according to a statement by the company on Monday. In its defense, Twitter had denied that its executives lied or knowingly made misleading statements. It also rejected the idea that statements by former chief financial officer Anthony Noto and former chief executive officer Dick Costolo caused the stock price to fall. Twitter didn't immediately respond to a voicemail seeking comment on the agreement.
Under the pact, Twitter intends to use cash on hand to pay the settlement amount in the fourth quarter and expects to record a charge for the settlement during the third quarter of 2021. The case is In re Twitter Inc. Securities Litigation, 16-cv-05314, U.S. District Court, Northern District of California (San Francisco).
